The Shulchan Aruch rules: if one drank a revi'is of wine, he should not pray until the effect of his wine wears off; and if he drank more than that, if he is able to speak before a king (i.e., his mind is not too clouded), then if he prayed, his prayer is a valid prayer; but if he is not able to speak before a king, then if he prayed, his prayer is an abomination, and he must go back and pray again once the wine has worn off him; and even if the time for that prayer has already passed, he makes it up in the following prayer, as is the law for one who erred unintentionally (a shogeg). The Rema adds: The law of the Shema is the same as the law of prayer; but other blessings he may recite even though he is drunk (Mordechai, beginning of chapter HaDar; Hagahot Maimoni, chapter 4 of the Laws of Prayer).

A journey of a mil, or any amount of sleep, dispels the effect of the wine; and this applies when he drank only a revi'is, but if he drank more, all the more so, for then sleep intoxicates him further and travel wearies him; and this applies to one traveling on foot, but for one riding, the journey certainly dispels the wine.

For each person who has drunk (a shasui), it is enough to go by what he senses within himself, that his wine has worn off. The Rema adds: And therefore people are not careful with our wines, which are not strong, for they pray even though they drank a revi'is or more (Terumat HaDeshen, siman 42); and all the more so if they pray from a siddur held in hand, that we are not concerned about slight drunkenness, as stated above.

(1) 'One who drank wine' — it appears that the same law applies to other intoxicating drinks, as the Taz wrote below in siman 128, se'if katan 35, regarding the priestly blessing; and even according to the Magen Avraham there, who is lenient regarding the priestly blessing, it stands to reason that prayer is more stringent and is forbidden, just as with wine; so wrote the Magen Giborim; see there. And according to the view of the Taz just cited, for other drinks we do not require the measure of a revi'is; see there. But it appears to me that nevertheless we require that it contain enough to intoxicate as a revi'is of wine does.

(2) 'A revi'is worth' — this is specifically if he drank it all at once, but in two separate drinks, or if it was diluted with a little water, it is permitted; and if he drank more than a revi'is, then in every case it is forbidden until the wine wears off him, as below in siman 128, se'if 38. And all this is when he can still speak before a king, for otherwise there is no distinction in this regard relevant to our matter, which deals with prayer. The Magen Avraham wrote in the name of the Semak that wine drunk during a meal does not intoxicate; and see further there. And the Pri Megadim wrote that all this depends on what he perceives in his own mind.

(3) 'He should not pray' — even if because of this the time for prayer will pass; so the Pri Chadash. And see at the end of this siman, in the name of the Yam Shel Shlomo, that nowadays, since in any case people do not concentrate so much in prayer, one need not be so concerned to be stringent if by his waiting the time for prayer will pass.

(4) 'Until his wine wears off' — even if he is accustomed to drink a great deal and is not at all drunk from a revi'is, even so, he should not pray at the outset if he drank a revi'is of wine [Birkei Yosef].

(5) 'An abomination' — it is as though he worships idols; and if he refrains from praying while drunk, he is saved from all trouble. So the Talmud.

(6) 'As the law of an unintentional offender' — even if he began to drink after the time for prayer had already arrived, since he assumed he would have time to pray after the small amount of wine that he began to drink with a settled mind would wear off, and afterward his heart was drawn to the drinking and he forgot about the prayer, and he became so drunk that no time remained for the wine to wear off before the time for prayer passed — this too is called unintentional (shogeg). Nevertheless, certainly if it is close to Mincha and the time will pass, certainly, if he gets drunk such that he will not be able to let the wine wear off in so short a time, he is a willful offender (mezid) according to all, and he has no make-up prayer.

(7) 'And the law of the Shema' — and the blessings of the Shema also have the same law as the Shema. So the Eliyah Rabbah.

(8) 'As the law of prayer' — that is, even one who has merely drunk (a shasui) is forbidden at the outset to recite the Shema. And the Levush wrote that some are lenient regarding the Shema even if he is drunk, for prayer is different, since it is a request for one's needs; and so it is written in Likutei HaRamban at its end. However, in the commentary of the Vilna Gaon he expounds at length on the words of the Yerushalmi that bear on this matter, and according to his words the conclusion of the Yerushalmi is to forbid a drunk person to recite the Shema. Therefore one should take care at the outset not to come to such a state; but after the fact, if he became drunk, he should not exempt himself from the Shema on this account, similar to what the Magen Avraham wrote below in siman 185 regarding Birkat HaMazon; and if his wine wears off before the time for Shema passes, he should go back and recite the passages.

(9) 'But other blessings' — this includes even Birkat HaMazon, which is a Torah obligation; and see below in siman 185 and what I wrote there.

(10) 'He may recite the blessing' — but he is not counted toward a quorum of ten; and regarding the three needed for a zimmun, it may perhaps be permitted.

(11) 'That he is drunk' — see the commentary of the Vilna Gaon; and according to his words one should be stringent at the outset with a drunk person who cannot speak before a king, even for other blessings, and so wrote the Pri Megadim in Yoreh Deah, siman 1, se'if katan 35, in the Mishbetzot Zahav. And all this is when he has not reached the drunkenness of Lot, for otherwise he is considered completely like one bereft of understanding, according to all, and is then exempt from all the mitzvot. Therefore, even after the fact, if he recited and blessed while in that state, he is not thereby discharged, for he was exempt at that time, and he is obligated afterward to go back and recite and bless. So the Pri Chadash and Pri Megadim.

(12) 'A journey of a mil' — whether walking or riding; and some say that for one riding we specifically require three mil.

(13) 'Intoxicates him' — this is specifically a little sleep, but much sleep dispels the wine [the Magen Avraham in the name of the Kesef Mishneh].

(14) 'But one riding' — since he does not have so much exertion.

(15) 'Dispels the wine' — and that is when he rode three mil; and nevertheless it all depends on the amount of wine, for if he drank a great deal, a journey of three mil does not dispel it.

(16) 'And therefore one is not [careful], etc.' — this refers to one who has merely drunk (a shasui), for whom there is no prohibition except at the outset; but for a drunk person, whose prayer is an abomination, one must certainly take care even for us, and he must go back and pray again [the Bach and the Taz].

(17) 'That we are not concerned' — that is, this is to justify the custom, but nevertheless it is not proper [Pri Megadim]. The Yam Shel Shlomo wrote in the second chapter of Beitzah that on Yom Tov one may pray Mincha even though he drinks a little, for it is impossible to wait until his wine wears off; and all the more so nowadays, when in any case people do not concentrate much, that one need not be particular about one who has merely drunk.
