If one needed to relieve himself he should not pray; and if he did pray, his prayer is an abomination and he must go back and pray again. And these words apply when he cannot hold himself back for the time it takes to walk a parsah (a set distance); but if he can hold himself back for the measure of a parsah, he has fulfilled his obligation after the fact. Ideally, however, he should not pray until he first checks himself well. The Rema adds: anyone who needs to relieve himself is forbidden even in words of Torah, as long as his body is made repulsive by his bodily needs [Hagahot Maimoni, chapter 4 of the Laws of Prayer].
If in the middle of his prayer (the Amidah) an urge arose in him, he holds himself back until he finishes and does not interrupt. But if during the reciting of the Shema and its blessings such an urge arose, whether for a small need or a large one, he reads on as usual. The Rema adds: this is only when he does not feel the urge so strongly that it would already involve the prohibition of "do not make yourself repulsive"; but otherwise it is better to interrupt [the responsum of the Rashba, siman 131, ruled it is permitted, and the Terumat HaDeshen, siman 16, ruled it is forbidden, and one must draw a distinction in this way]. And if he wishes to step away and urinate, he may do so.
Before prayer one must remove his phlegm and mucus and anything that distracts him.
One must wash his hands with water if he has some; and if he has none, he must go after it, up to a parsah. And these words apply when he is traveling on the road and the water lies ahead of him; but if he would have to turn back to a place of water, up to a mil he turns back, more than a mil he does not turn back. And if he fears that the time for prayer will pass, he cleans his hands on a pebble, or with dirt, or with anything that cleans [and see below, siman 233].
If he washed his hands in the morning and then let his attention lapse, they require a fresh washing for prayer, if he has water, even though he is not aware of any dirt on them; and he does not recite a blessing. But if he has no water readily available, he need not go back and wash. The Rema adds: even if his hands were dirty and he washes them for prayer, he does not recite a blessing, as above in siman 6.
One standing in prayer who recalls that he touched a soiled place — it is enough to clean with dirt or with pebbles, or he rubs his hands on the wall.
A "soiled place" means the parts of a person that are covered, since traces of sweat are found on them; and likewise if he scratched his head. The Rema adds: therefore it is forbidden to touch these places while standing in prayer or engaged in Torah [Kol Bo]; and likewise the discharge of the ear and the nose, except by means of a cloth [the Maharil].
One who has urinated should not pray until he waits the time it takes to walk four cubits, because of the droplets (that may remain on him); and one who has prayed should not urinate until he waits the time it takes to walk four cubits, for throughout those four cubits his prayer is still fluent in his mouth and his lips still murmur it.
One who has spat should not pray until he waits (the time to walk) four cubits. One who has prayed should not spit until he waits four cubits. And this is only when he spits willingly, but if spittle came to him on its own, it is permitted [see above, siman 97].
It is good to give charity before prayer.
(1) 'He should not pray' — for it is written, "Prepare to meet your God, O Israel," and it is written, "Guard your feet when you go to the house of God"; and our Sages said: the Holy One, blessed be He, said, guard your orifices at the time you stand before Me in prayer.
(2) 'And he must' — some say this applies specifically to a large need, but for a small need, after the fact, he need not go back and pray again; and some disagree.
(3) 'Walking a parsah' — it is four mil, which is a measure of an hour and a fifth.
(4) 'Can hold' — that is to say, from the start of the prayer he had the strength to hold out for this measure. And it implies that even if afterward, immediately after the prayer, he went and relieved himself, and this was within this measure, he has fulfilled his obligation after the fact.
(5) 'But ideally' — that is to say, even if he can hold himself back for longer than a parsah, since he senses in himself a bit that he needs to relieve himself; and even if, by relieving himself, he will not be able to pray with the congregation, even so it is better to pray alone with a clean body. However, if he sees that by checking himself the time for prayer will pass entirely, the Magen Avraham and the other later authorities agreed that he may pray, if he estimates that he can hold out for a measure of an hour and a fifth.
(6) 'Even in words of Torah' — and all the more so in the Shema and other blessings. And after the fact, it is implied from the words of the Pri Megadim that he need not go back and recite again, and so wrote the Ramban in the Milchamot.
(7) 'That his body is repulsive' — even if he does not feel the urge so much that it would involve "do not make yourself repulsive," since he cannot hold himself back for a parsah; and within a parsah it is permitted even for the Shema. And the שע״ת above in siman 6, note 4, is stringent in this. And if he is teaching Torah to the public or lecturing, and in the middle he needs to relieve himself, even for a large need, he is permitted to hold himself back, for "do not make yourself repulsive" is only a rabbinic prohibition, and it is set aside for the sake of human dignity.
(8) 'In the middle' — that is to say, before the prayer he checked himself, or he did not need to relieve himself at all; therefore, even though afterward the urge arose, even for a large need, he may not interrupt in the middle. And it is obvious that after he finishes the Shemoneh Esrei it is forbidden for him to keep holding himself back in order to say Kedushah, for this is a separate matter, similar to what is stated above in siman 55, se'if 3, in the Rema's gloss; see there. And if he can hold himself back for a parsah, see above, note 7.
(9) 'During the Shema' — that is to say, even though during the Shema and its blessings he may walk from this place to another to relieve himself there or to urinate, as he concludes at the end of the se'if, even so, if he wishes he may read on as usual and need not interrupt, since he had checked himself beforehand. And see the Biur Halachah, where we explained that this is only permitted up until the Shemoneh Esrei; but the Shemoneh Esrei, which is a separate matter, is forbidden for him to say, since he needs to relieve himself. Therefore he should see to interrupt, at least at the blessing of Emet VeYatziv, and go out to relieve himself, so that he will afterward be able to join redemption to prayer; and it is better still if he can go out between the sections. And likewise, if the urge arose before he began the blessings of the Shema, it seems he is forbidden to recite the blessings of the Shema before he checks himself. And accordingly, based on what is explained above at the end of siman 54, that Barchu belongs to the blessing of the Shema, and after Barchu it is regarded as the middle of the section of Yotzer Or: if the urge arose at the end of Pesukei DeZimra, it is forbidden for him to say Barchu, for it is a separate matter — unless he can hold himself back for a parsah, in which case one may rely on the lenient view, as above in note 7.
(10) 'That he does not feel the urge' — that is to say, he is not pressed to relieve himself, but there is only a mere stirring [the Eliyah Rabbah in siman 3].
(11) 'But otherwise' — that is to say, even though he can hold himself back until he finishes, nevertheless it is better that he interrupt, whether for a large need or a small one, because of the prohibition of "do not make yourself repulsive"; and this refers to the earlier clause, and to prayer as well. And see the Magen Avraham, who elaborates on this ruling, and concludes that in public even the Terumat HaDeshen concedes to the Rashba that one should not interrupt in the middle of prayer, out of human dignity; and even in private one may likewise rely on the Rashba not to interrupt. And so wrote the ח״א, that it is forbidden to interrupt. And in the Derech HaChaim he wrote that if there is in it the concern of "do not make yourself repulsive," he may interrupt; but in any case, even according to him there is no obligation to interrupt, since he can hold himself back until he finishes the prayer. And if he cannot hold out until he finishes the Shemoneh Esrei, he may go out and relieve himself in the middle, only that he not interrupt with speech [the ח״א]; and it is implied from this that afterward he need not return to the beginning, since before the prayer he did not need to relieve himself — provided that, through going out, he does not delay long enough to have completed the entire prayer.
(12) 'And if he wishes' — this refers to the Shema mentioned just before, which depends on his wish; for in the Amidah he may not move from his place until he finishes [the Pri Megadim].
(13) 'To wash' — the reason for this, see above at the beginning of siman 4 in the Mishnah Berurah. And for the Minchah and Ma'ariv prayers, too, washing is required, as below in siman 233, se'if 2. And the Rambam's view is that where one is required to wash his hands and did not wash, and also did not clean them on a pebble, even after the fact his prayer is no prayer; and this requires further study in practice [the Pri Megadim]. And see the Biur Halachah, where we explained that he does not go back and pray again.
(14) 'With water' — and drying is not indispensable here, as it is indispensable in the washing before eating [
(15) 'He must' — and this is specifically when he knows they are dirty; but with hands whose state is unknown he is lenient, shortly ahead in se'if 5; see there.
(16) 'To go back, etc.' — and if, because of this, he would have to travel afterward alone, or if, because of this, he would be unable to reach his destination while it is still day, he need not go back at all.
(17) 'Traveling on the road' — and one who rides has the same law in all this as one who walks on foot. Also, there is no difference between a bad road and a good one. And all this is specifically when he knows for certain that he will find water there, but in a case of doubt, no.
(18) 'Turn back' — and all the more so when he is sitting at home, that he is certainly obligated, ideally, to go after water, if he knows his hands are dirty.
(19) 'Up to a mil' — and many authorities hold that a mil itself has the same law as more than a mil.
(20) 'The time for prayer' — entirely. And if he is in a place where there are ten who are praying, and by going after water the time of the congregation's prayer would pass, the Bach wrote that even though he has time, he need not go back, and he cleans with something that cleans.
(21) 'He cleans his hands' — that is to say, he should not then go after water, lest the time pass; and all the more so regarding the Shema, that it is certainly forbidden for him to wait for water if there is a concern that the time may pass; rather he cleans and reads. And many authorities hold that for the Shema, as soon as the start of its time arrives, if he has no water he cleans and reads and does not wait for water.
(22) 'Siman 233' — for there the time of Minchah is explained.
(23) 'And let his attention lapse' — that is to say, he let much time pass between the washing and the prayer, until his attention lapsed; and all the more so does lapse of attention apply between the morning washing and the Minchah prayer.
(24) 'Require a washing' — for since his attention lapsed from guarding them, hands are active, and perhaps they touched a soiled place.
(25) 'For prayer' — but for Torah, blessings, and the Shema, hands of unknown state are fit; though in siman 4 the Pri Megadim wrote that for the Shema hands of unknown state are unfit.
(26) 'He need not, etc.' — nevertheless he must clean them with something that cleans, lest a little filth or sweat is stuck to them through touching the covered places, and it will be wiped off by the cleaning. And it is only with hands of unknown state that the Mechaber is lenient; but if he touched a soiled place, and all the more so if he relieved himself, even for the Minchah prayer he must go after water.
(27) 'One standing in prayer' — but if he is standing in the Shema or in Pesukei DeZimra, he must go and wash his hands.
(28) 'And recalls that he touched' — he put it this way because, ideally, it is forbidden to touch (these places) during the prayer itself, as below; but the same law applies if he touched during the prayer itself.
(29) 'Or engaged in Torah' — and after the fact a mere cleaning suffices for Torah and for blessings, even though he has water. And see above at the end of siman 4 in the Mishnah Berurah. And if he touched clay and mire, it is possible that even ideally it is permitted so; but above at the end of siman 4 the Pri Megadim wrote that he must clean first even for words of Torah, and so it seems proper to be stringent, ideally, with mire.
(30) 'The ear and the nose' — and the Vilna Gaon is lenient in this, and so it is written in the שע״ת in the name of the Mor U'Ketziah.
(31) 'One who has urinated' — that is to say, into a vessel, and the vessel was removed, and any such case, where it is not forbidden to pray on account of the urine itself.
(32) 'That he waits enough, etc.' — and after four cubits the Sages estimated that the droplets on his member are absorbed into his garment.
(33) 'Enough to walk' — that is to say, the time it takes to walk four cubits; but after he has waited this measure it is permitted to urinate even in the place where he prayed. Nevertheless, it is a measure of piety not to urinate within four cubits of the place of prayer. It is written in the ס״ח, siman 828, that one should not urinate or spit in a place where he covered the blood of a beast or fowl with a blessing, while the blood is still covered.
(34) 'Willingly' — meaning, one who spits because of a stroll [the Rosh].
(35) 'And see above, siman 97' — that is to say, at times it is permitted even during the prayer.
(36) 'Prayer' — for it is written, "And I, through righteousness (tzedek), will behold Your face"; and in some holy communities the custom was established to give charity upon reaching the verse "and wealth... and You rule over all." And there are places where they are accustomed to collect charity during the Torah reading, and this is improper, for through it they neglect hearing the Torah reading and answering "Barchu et Hashem," etc.
