The time for the morning prayer (Shacharis): its mitzvah is that one should begin it together with sunrise (haneitz hachamah), as it is written, 'They shall fear You together with the sun' — that one pray as the sun appears. But if one prayed from when dawn (amud hashachar) rose and the face of the east was already lit, he has fulfilled his obligation. Its time continues until the end of four hours, which is a third of the day. And if one erred or transgressed and prayed after four hours, up until midday (chatzos) — although he does not have the reward of a prayer said in its proper time, he does at least have the reward of prayer. The Rema adds: But after midday it is forbidden to pray the morning prayer (Shacharis) (Beit Yosef in the name of the Rashba, in the chapter 'Tefillas HaShachar'), and see further at the beginning of siman 108.

Once the time for prayer has arrived, it is forbidden for a person to go early to his friend's doorway to greet him (to say 'shalom'), because 'Shalom' is one of the Names of the Holy One, blessed be He. But he is permitted to say to him, 'Tzafra d'mari tav' ('a good morning to my master'). And even this is permitted only when he needed to go to see to some matter (and passes by on the way); but if he is not going for anything except to greet him before praying, even this wording is forbidden. Likewise, it is forbidden to bow to him when he goes early to his doorway. And some say that bowing is forbidden even when he did not go early to his doorway. But if he had already begun to recite the (morning) blessings (afterward), one need not be so concerned. And if he did not go early to his doorway, but merely happened upon him on the road, he is permitted to greet him (to give him 'shalom'). And some say that even when one meets his friend in the marketplace, he should say to him only 'Tzafra d'mari tav,' so that he takes to heart that he is forbidden to delay with any other matters at all until he has prayed.

It is forbidden for him to engage in his own affairs, or to set out on a journey, until he has prayed the Shemoneh Esrei (the eighteen-blessing Amidah). (And some are lenient once one has recited part of the morning blessings, before he has said 'Baruch She'amar'; but it is good to be stringent in this.) (Terumas HaDeshen, siman 18.) And he may not eat, nor drink; but water is permitted to drink before praying, whether on a weekday or on Shabbos and Yom Tov. Likewise, foods and drinks taken for a medical need are permitted.
הצמא כהוהרעב הרי הם בכלל החולים אם יש בו יכולת לכוין דעתו יתפלל ואם לאו אם רצה אל יתפלל עד שיאכל כווישתה:
One who is thirsty or hungry is included among the category of the sick. If he has the ability to focus his mind (in prayer), let him pray. But if not, then if he wishes, he should not pray until he eats and drinks.
ואם כזהתחיל לאכול קודם עלות השחר כחצריך להפסיק כטוי"א שאינו צריך להפסיק:
And if one began to eat before dawn (amud hashachar) rose, he must interrupt (his meal to pray). And some say that he need not interrupt.
אפי' לללמוד אסו' לאמשיגיע זמן תפלה והיינו מי שרגיל להתפלל לבבבית מדרשו ואינו רגיל לילך לב"ה דאיכא למיחש דלמא לגמטריד בגירסיה לדויעבור זמן ק"ש ותפלה אבל מי שרגיל לילך לב"ה מות' ואם הוא להמלמד לאחרים אפילו אם אינו רגיל לילך לב"ה מות' כיון שהשעה עוברת דזכות הרבים דבר גדול הוא ואם לא ילמדו עכשיו יתבטלו ולא יוכלו ללמוד [וע"ל סי' ק"ו]:
Even to study Torah is forbidden once the time for prayer has arrived. This refers to one who is accustomed to pray in his own study hall (beis midrash) and is not accustomed to go to the synagogue (beis haknesses), for there is reason to be concerned that he may become engrossed in his learning and let the time of Shema and prayer pass. But one who is accustomed to go to the synagogue is permitted (to learn first). And if he teaches others, then even if he is not accustomed to go to the synagogue, he is permitted, since the hour is passing, for the merit of the many is a great thing; and if they do not study now, they will be prevented and unable to study (later). [And see further, siman 106.]
מותר לולהסתפר וליכנס למרחץ סמוך לשחרית שלא גזרו אלא סמוך למנחה לזשהוא דבר המצוי:
It is permitted to take a haircut and to enter the bathhouse close to the time of Shacharis, for they decreed (against such things) only close to Minchah, which is a common occurrence (people frequent the bathhouse by day).
בשעת הדחק כגון לחשצריך להשכים לדרך לטיכול להתפלל ממשעלה עמוד השחר וימתין מלקרות ק"ש עד שיגיע זמנה מא[אם אפשר לו לקרות ק"ש על הדרך דהיינו שיתכוין בפסוק ראשון וכמו שנתבאר לעיל סי' נ"ח] [ב"י בשם הרשב"א] ואף על פי שאינו סומך גאולה לתפלה מבהכי עדיף טפי שיתפלל בביתו מעומד ממה שיתפלל בזמנה והוא מהלך ויסמוך גאולה לתפלה:
In a pressing situation (sha'as had'chak) — for example, when one must set out early on a journey — he may pray from when dawn (amud hashachar) has risen, and he should wait to recite Shema until its proper time arrives. [If it is possible for him to recite Shema on the road — that is, that he will concentrate on the first verse — as was explained above in siman 58.] [Beit Yosef in the name of the Rashba.] And even though he is not thereby joining redemption (Ge'ulah) to prayer (Tefillah), this is preferable — that he pray at home while standing, rather than that he pray in its proper time while he is walking (and thus able to) join redemption to prayer.
משנה ברורה
(א) עם הנץ - היא השעה שהחמה מתחלת לזרוח בראשי ההרים. וראוי ונכון ליזהר בזה לכתחלה אף בימי הסליחות וכן בחורף כשמשכימים ובאים לבהכ"נ בבוקר השכם ימתינו מלהתפלל עד הנץ וכדלעיל בסי' נ"ח ס"א ע"ש אך כשמשכים לצאת לדרך וכה"ג שאר דחק ואונס דמותר להקדים כדלקמן בס"ח עכ"פ ימתינו מלברך על התפילין עד שיכיר את חבירו הרגיל עמו קצת ברחוק ד"א דמקודם אסור לברך עליהן וכדלעיל בסימן ל' ס"א עי"ש במשנה ברורה. כתב בפמ"ג בסימן תצ"ד דבחג השבועות שניעורין כל הלילה מותר להתפלל קודם הנץ דכשילכו לביתם בהשכמה טורח הוא להתקבץ שנית. ומ"מ יש ליזהר שלא לקרות ק"ש כ"כ בהשכמה דהיינו קודם שיראה את חבירו ברחוק ד' אמות ויכירנו דזה אסור לכתחלה וכדלעיל בסימן נ"ח עיי"ש:
(1) 'Together with sunrise (haneitz)' — this is the moment when the sun begins to shine on the tops of the mountains. It is fitting and proper to be careful about this ideally (l'chatchilah), even during the days of Selichos; and likewise in the winter, when people rise early and come to the synagogue in the early morning, they should wait to pray until sunrise, as was explained above in siman 58, se'if 1 — see there. However, when one rises early to set out on a journey, or the like — other cases of pressing circumstance and compulsion — where he is permitted to pray earlier, as will be explained below in se'if 8, in any case they should wait to recite the blessing over the tefillin until he can recognize a somewhat-familiar acquaintance at a distance of four cubits (amos); for before that it is forbidden to recite the blessing over them, as was explained above in siman 30, se'if 1 — see there in the Mishnah Berurah. The Pri Megadim wrote in siman 494 that on the festival of Shavuos, when people stay awake the entire night, it is permitted to pray before sunrise, since if they were to go home in the early morning, it would be burdensome to gather together a second time. Nevertheless, one should be careful not to recite Shema so early in the morning — that is, before he can see his acquaintance at a distance of four cubits and recognize him — for this is forbidden ideally, as was explained above in siman 58; see there.
(ב) עמוד השחר - עה"ש הוא מה שמתחיל השחר להבריק במקצתו מעט מעט ומשמע מדברי המחבר דקודם האיר אף בדיעבד לא יצא וכן הסכימו הרבה אחרונים דלא כמ"א וע' בבה"ל:
(2) 'Dawn (amud hashachar)' — dawn is when the light of morning begins to gleam in part, little by little. It is implied from the words of the Mechaber that before the east has become lit, even after the fact (b'di'avad) one has not fulfilled his obligation; and so too many of the later authorities (Acharonim) agreed, not like the Magen Avraham — and see the Biur Halacha.
(ג) פני המזרח - ובעינן שיאיר פני כל המזרח ולא סגי במה שהבריק השחר כנקודה בלבד. כתב בחידושי רע"א דאף שהכוכבים נראין עדיין ברקיע מ"מ יום הוא:
(3) 'The face of the east' — we require that the entire face of the east be lit, and it does not suffice that the dawn has merely gleamed as a single point. Rabbi Akiva Eiger wrote in his glosses that even though the stars are still visible in the sky, nevertheless it is (already) day.
(ד) יצא - בדיעבד ואפילו שלא בשעת הדחק ובשעת הדחק כגון במשכים לצאת לדרך וכה"ג שאר דחק ואונס אפילו לכתחילה וכדלקמן בס"ח עי"ש. ודע דדברי הש"ע אינם אמורים רק לענין חובת מצות תפלה בלבד דיצא בה אחר שהאיר המזרח דבזה כבר הגיע זמנה דניתקנה כנגד התמיד ושחיטת התמיד היה תיכף משהאיר המזרח אבל לענין ק"ש שקודם התפלה לא איירי המחבר בסימן זה ועיין לעיל בסימן נ"ח במ"ב סקי"ט דלא יצא בזה ידי חובת ק"ש אף דיעבד אם רגיל לעשות כן עד שיכיר את חבירו הרגיל עמו קצת ברחוק ד"א וזה מאוחר מזמן דהאיר המזרח ובפרט כשרוצה אז להניח תפילין ולברך עליהן דבוודאי אין לברך עד שיגיע הזמן דמשיכיר הנ"ל:
(4) 'He has fulfilled his obligation' — after the fact (b'di'avad), and even when it is not a pressing situation; and in a pressing situation — such as one who rises early to set out on a journey, or the like, other cases of pressing circumstance and compulsion — even ideally (l'chatchilah), as will be explained below in se'if 8; see there. And know that the words of the Shulchan Aruch are stated only regarding the obligation of the mitzvah of prayer alone — that one fulfills it after the east has become lit, for by then its time has already arrived, since it was instituted to correspond to the daily Tamid offering, and the slaughtering of the Tamid was immediately once the east became lit. But regarding the recitation of Shema that precedes the prayer, the Mechaber is not speaking in this siman; and see above in siman 58, in the Mishnah Berurah, se'if katan 19, that one does not thereby fulfill his obligation of Shema, even after the fact, if he is accustomed to do so — until he can recognize a somewhat-familiar acquaintance at a distance of four cubits (amos), and this is later than the time when the east became lit. And especially when he wishes then to don tefillin and recite the blessing over them, for certainly one should not recite the blessing until the above-mentioned time of 'when he can recognize' arrives.
(ה) היום - ואם היום אורך י"ח שעות הוי ו' שעות על היום וכשהיום ארוך ט' שעות הוי ג' שעות דלעולם משערין שעות אלו לפי ענין היום והם נקראין שעות זמניות שהיום מתחלק לי"ב חלקים. וענין השליש הוא שתפלת השחר הוא נגד קרבן תמיד ולעולם לא איחרו אותו מלהקריב לאחר שליש היום וצריך לגמור התפלת י"ח בתוך השליש היום:
(5) 'The day' — if the day is eighteen hours long, then (a third) is six hours into the day; and when the day is (only) nine hours long, it is three hours; for these hours are always measured according to the length of the particular day. They are called 'seasonal hours' (sha'os zemaniyos), the day being divided into twelve parts. And the reason for the (limit of a) third: the morning prayer corresponds to the daily Tamid offering, and they never delayed offering it later than a third of the day; and one must complete the Shemoneh Esrei within the first third of the day.
(ו) או עבר - ר"ל שבמזיד שהה את התפלה עד שעבר זמנה ואח"כ התפלל אעפ"כ יצא ידי חובת תפלה אף שהיתה שלא בזמנה וה"ה שלכתחילה אם לא התפלל מקודם צריך להתפלל אחר ד' שעות עד חצות רק שאין לו שכר כתפלה בזמנה. וטוב שיתפלל אז בתורת נדבה כי יש פוסקים שסוברים דבהזיד עד ד' שעות שוב לא מצי להתפלל כלל ע"כ יתפלל ויתנה שאם מצד הדין הוא פטור הוא בתורת נדבה [פמ"ג]:
(6) 'Or transgressed' — that is to say, that one deliberately (b'meizid) delayed the prayer until its time had passed, and afterward prayed — even so, he has fulfilled his obligation of prayer, though it was not in its proper time. And likewise, ideally (l'chatchilah), if he did not pray earlier, he must pray after four hours, up until midday, only that he does not have the reward of a prayer said in its proper time. And it is good that he then pray as a voluntary offering (nedavah), for there are decisors (poskim) who hold that if one deliberately (delayed) until (after) four hours, he can no longer pray at all; therefore let him pray and stipulate that if by law he is exempt, this is a voluntary prayer. [Pri Megadim.]
(ז) ואחר חצות - משמע מלשון הר"ב דאפילו תיכף אחר חצות אסור להתפלל שחרית ואדלעיל קאי בין עבר במזיד או טעה בשוגג ויש מקילין בהחצי שעה שאחר חצות ולדינא משמע מפמ"ג ודה"ח שאין לזוז מפסק הר"ב וכן משמע מביאור הגר"א דבאמת כבר הגיע זמן מנחה שמתחלת מתחילת שבע אלא מטעם שאין אנו בקיאים ושמא יבוא לטעות וע"כ אסרו חז"ל ע"כ כששגג או נאנס ולא התפלל קודם חצות ימתין אחר חצות חצי שעה (דהיינו כדי שיגיע זמן תפלת מנחה) ויתפלל מנחה ואח"כ שחרית בתורת השלמה ולא להיפך וגם דוקא בשגג או נאנס אבל במזיד אין לו תקנה כמו שיתבאר כ"ז בסימן ק"ח. אמנם בדיעבד אם התפלל שחרית בחצי שעה זו שאחר חצות יצא וא"צ להתפלל שנית [דה"ח עי"ש עוד] ועיין בחידושי רע"א מה שכתב בשם הצל"ח בענין זה:
(7) 'And after midday' — it is implied from the language of the Rema that even immediately after midday it is forbidden to pray Shacharis, and this refers back to the earlier case, whether one transgressed deliberately or erred inadvertently (b'shogeg). And some are lenient during the half-hour after midday; but as a matter of law it is implied from the Pri Megadim and the דה"ח that one should not budge from the ruling of the Rema. And so too it is implied from the Biur of the Vilna Gaon, that in truth the time for Minchah has already arrived, since it begins from the start of the seventh (halachic) hour, only that, for the reason that we are not expert (in the exact times) and one might come to err, the Sages forbade it. Therefore, when one erred or was compelled and did not pray before midday, he should wait a half-hour after midday (that is, so that the time for the Minchah prayer will have arrived), and pray Minchah, and afterward Shacharis as a make-up (tashlumin), and not the reverse. And also, this is specifically when one erred or was compelled; but if deliberately, he has no remedy, as all this will be explained in siman 108. However, after the fact, if one did pray Shacharis during this half-hour after midday, he has fulfilled his obligation and need not pray again. [דה"ח, see there further.] And see in the glosses of Rabbi Akiva Eiger what he wrote in the name of the צל"ח on this matter.
(ח) זמן תפלה - היינו מעמוד השחר ועיין בבה"ל בס"א:
(8) 'The time for prayer' — that is, from dawn (amud hashachar). And see the Biur Halacha on se'if 1.
(ט) להקדים וכו' - וה"ה אם הולך בבהכנ"ס ממקום הקבוע לו למקום חבירו ליתן לו שלום:
(9) 'To go early, etc.' — and the same applies if he walks within the synagogue from his fixed place to his friend's place to greet him (to give him 'shalom').
(י) לפתח חבירו - וה"ה אם היה אביו או רבו. ואם יש לחוש לאיבת גברא אלמא אם יכול ליתן ידו בלא אמירת שלום שפיר דמי [פמ"ג] וכשפגעו בדרך יש להקל בגברא אלמא גם באמירת שלום דבלא"ה מדינא מותר וכדלקמן כנ"ל:
(10) 'To his friend's doorway' — and the same applies if it was his father or his teacher (rav). And if there is reason to be concerned about the enmity of a powerful man (gavra alma), then if he can offer him his hand without saying 'shalom,' this is proper. [Pri Megadim.] And when they met on the road, one may be lenient with a powerful man even to say 'shalom,' for in any case by law it is permitted, as (will be explained) below — as stated.
(יא) דשמו וכו' - ואין ראוי להזכיר שמו על האדם ולכבדו קודם שמכבד להקב"ה. ובלשון לע"ז יש לעיין. ומסתברא דאם אומר הרחום ירחמך או החנון יחננך וכדומה שרי דמברכו בשמו של הקב"ה [פמ"ג עיי"ש עוד]:
(11) 'Because (Shalom is) His Name, etc.' — it is not fitting to invoke His Name upon a person and to honor him with it before he has honored the Holy One, blessed be He. And regarding (greeting) in a foreign language (using a translated word), the matter requires examination. It stands to reason that if one says, 'May the Merciful One have mercy on you,' or 'May the Gracious One favor you,' or the like, it is permitted, since he is blessing him with the Name of the Holy One, blessed be He. [Pri Megadim; see there further.]
(יב) כשהוצרך - ר"ל שהוצרך ללכת דרך חצירו של חבירו בראיית איזה עסק ואגב זה הולך לפתחו לומר לו צפרא דמרי טב אבל ליתן לו שלום אף בכה"ג אסור וע' בבה"ל. ודע דמה שכתב הש"ע לראות איזה עסק דוקא לראות אבל להתעסק ממש אסור קודם התפלה וכדלקמן בס"ג:
(12) 'When he needed' — that is to say, that he needed to go by way of his friend's courtyard to look into some matter, and incidentally to that he goes to his doorway to say to him, 'Tzafra d'mari tav.' But to greet him with 'shalom,' even in such a case, is forbidden — and see the Biur Halacha. And know that when the Shulchan Aruch wrote 'to see to some matter,' it means specifically to look into it, but to actually engage in the matter is forbidden before praying, as will be explained below in se'if 3.
(יג) וי"א וכו' - וכן יש להורות [ב"ח וע"ת]:
(13) 'And some say, etc.' — and so one should rule. [the Bach and ע"ת.]
(יד) אין לחוש - פי' דאז מותר לכרוע כשאין משכים לפתחו אבל במשכים לפתחו בין לכרוע או נתינת שלום אפילו התחיל בברכות אסור:
(14) 'One need not be concerned' — the meaning is that then it is permitted to bow, (specifically) when he did not go early to his doorway; but when he did go early to his doorway, whether to bow or to greet with 'shalom,' even if he had already begun the blessings, it is forbidden.
(טו) במוצא וכו' - ולא יתן שלום אע"פ דרגיל ליתן לו שלום:
(15) 'When he meets, etc.' — and he should not greet him with 'shalom,' even though he is accustomed to greet him.
(טז) כדי שיתן - ר"ל דאף דמדינא מותר מ"מ נהגו קדמונינו להחמיר בזה מזה הטעם ואם התחיל הברכות אין לחוש כ"כ ומותר ליתן שלום. וכ"ז לפתוח לומר לחבירו שלום אבל כשחבירו שואל בשלומו מותר להשיב בכל ענין וכ"ש דמי שכבר התפלל מותר להשכים לפתחו של חבירו שלא התפלל ליתן לו שלום אע"פ שיצטרך להשיבו:
(16) 'So that he takes to heart' — that is to say, that although by law it is permitted, nevertheless our early predecessors were accustomed to be stringent in this, for this reason; and if he had already begun the blessings, one need not be so concerned, and it is permitted to greet with 'shalom.' And all this refers to being the first to say 'shalom' to his friend; but when his friend inquires after his welfare, he is permitted to respond in any case. And all the more so, one who has already prayed is permitted to go early to the doorway of a friend who has not yet prayed, to greet him with 'shalom,' even though (that friend) will have to respond to him.
(יז) להתעסק וכו' - וקודם אור הבוקר שרי לעשות מלאכה [של"ה וח"ש] וכתב הא"ר דמ"מ אין לעשות שום ענין עד שיברך סדר הברכות. ופשוט דכוונתו בחצי שעה שסמוך לאור הבוקר:
(17) 'To engage (in his affairs), etc.' — before the light of morning it is permitted to do work [the Shela"h and ח"ש]. And the Eliyah Rabbah wrote that nevertheless one should not do any (significant) activity until he recites the order of the (morning) blessings; and it is obvious that his intent is the half-hour close to the light of morning.
(יח) בצרכיו - ומי שיש לו עבדים עברים או משרתים שצריך שישמשוהו יזהירם מבערב שבקומם ממטתם ירחצו ידיהם ויברכו הברכות ויקראו פרשה אחת של שמע ואח"כ יכול לעשות צרכיו וכ"ז הוא ממדת חסידות אבל מדינא אין קפידא:
(18) 'In his affairs' — and one who has Hebrew bondsmen or servants who must attend to him should instruct them from the evening before, that upon rising from their beds they should wash their hands, recite the (morning) blessings, and read one passage of Shema, and afterward he may have them see to his affairs. And all this is a measure of piety (middas chassidus), but by strict law there is no objection.
(יט) לילך לדרך - ואפילו קודם מנחה ומעריב אם הגיע זמנם דינם כמו קודם שחרית:
(19) 'To set out on a journey' — and even before Minchah and Ma'ariv, if their time has arrived, their law is the same as before Shacharis.
(כ) עד שיתפלל - ואפילו אם במקום שיבוא יהיה יכול ג"כ להתפלל עם הצבור בזמנו אעפ"כ אסור דהליכה בדרך הוי כעוסק בצרכיו אך כ"ז שלא בשעת הדחק אבל בשעת הדחק שאין השיירא ממתנת לו יכול לילך מקודם לדרך ויתפלל בדרך וכדלקמן בס"ח ומשמע מהרבה פוסקים דאפילו כבר הנץ החמה ג"כ מותר בזה:
(20) 'Until he has prayed' — and even if, at the place he is coming to, he would also be able to pray with the congregation in its proper time, even so it is forbidden, for traveling on the road is like engaging in one's own affairs. But all this is when it is not a pressing situation; however, in a pressing situation, where the caravan does not wait for him, he may go on the road first and pray on the way, as will be explained below in se'if 8. And it is implied from many decisors that even after sunrise (haneitz) has already occurred, this too is permitted.
(כא) ולא לאכול - והעובר ע"ז אמרו חז"ל שעליו אמר הכתוב ואותי השלכת אחר גוך אמר הקב"ה לאחר שאכל ושתה ונתגאה קבל עליו מלכות שמים וגם הסמיכו דבריהם על הפסוק לא תאכלו על הדם לא תאכלו קודם שתתפללו על דמכם ואפילו טעימה בעלמא אסור:
(21) 'And he may not eat' — and of one who transgresses this, the Sages said that concerning him Scripture states, 'And you have cast Me behind your back' — the Holy One, blessed be He, says: After he ate and drank and grew proud, (only then) did he accept upon himself the yoke of Heaven. They also supported their words on the verse, 'You shall not eat over the blood' — do not eat before you have prayed on behalf of your blood (your life). And even a mere tasting is forbidden.
(כב) מים מותר - דלא שייך בהו גאוה ודוקא בלא צוקער אבל עם צוקער אסור וכ"ש משקה שכר (שקורין ביער) ודאי אסור. וטיי"א וקאפ"ע מותר לשתותו קודם תפלה כדי שיוכל לכוין דעתו ולהתפלל ובפרט בהמקומות שרגילין בהם ואין מתיישב הדעת בלתם וכ"ז בלא צוקער ובלא חלב [אחרונים] והעולם נוהגין להקל לשתות עם צוקער ואפשר דכוונת האחרונים וכן הרדב"ז שכתב דעם צוקער אין לך גאוה גדולה מזו קודם התפלה רק אם נותן הצוקער בתוך הטיי"א למתקו דזהו אסור קודם התפלה אבל אם לוקח מעט צוק"ר בפיו בעת השתייה ובלתי זה אין יכול לשתות הטיי"א אין זה בכלל גאוה. היוצא מדברינו דבנתינת הצוקע"ר בתוך הטיי"א או לאכול מעט מיני תרגימא בעת השתייה כדי שלא לשתות הטיי"א וקאפ"ע אליבא ריקנא אין שום צד להקל בזה קודם התפלה אם לא מי שיש לו חלישת הלב והוא צריך זה לרפואה. ומ"מ טוב שיאמר מתחילה עכ"פ פרשת שמע ישראל. כתב בספר פ"ת החדש דיש למנוע מלשתות הטיי"א בבוקר קודם התפלה באסיפת חבירים עי"ש טעמו. ומלבד זה רגיל להסתעף מזה איסור אחר דהלא כתב הרשב"א והובא בב"י דלכך אסור לו לאדם לעסוק בחפציו קודם שיתפלל כדי שלא יפנה לבו לשום דבר עד שיתפלל וכ"כ בש"ע סוף סעיף ב' שהוא אסור להתעכב בדברים אחרים כלל עד שיתפלל והרגילין באסיפת חברים בעת שתית הטיי"א רגיל לפעמים ע"י ריבוי השיחה לעבור עי"ז גם זמן ק"ש ותפלה:
(22) 'Water is permitted' — for haughtiness (ga'avah) does not apply to it. And this is specifically without sugar; but with sugar it is forbidden, and all the more so an intoxicating beverage (that they call 'beer') is certainly forbidden. But tea and coffee are permitted to drink before praying, so that one can focus his mind and pray, and especially in those places where people are accustomed to them and the mind is not settled without them. And all this is without sugar and without milk. [Acharonim.] The world (common practice), however, is lenient to drink it with sugar; and it is possible that the intent of the Acharonim — and likewise the Radbaz, who wrote that with sugar there is no greater haughtiness than this before praying — is only if one puts the sugar into the tea to sweeten it, that this is forbidden before praying; but if one takes a little sugar in his mouth at the time of drinking, and without this he cannot drink the tea, this is not in the category of haughtiness. What emerges from our words is that as for putting the sugar into the tea, or eating a little confection (mini targima) at the time of drinking so as not to drink the tea and coffee on an empty stomach, there is no ground to be lenient in this before praying, except for one who has a weakness of the heart and needs this as a remedy. And nevertheless it is good that he first say, at least, the passage of 'Shema Yisrael.' It is written in the new sefer פ"ת that one should refrain from drinking tea in the morning before praying at a gathering of friends — see there for his reasoning. And apart from this, another prohibition tends to branch out from it; for behold the Rashba wrote, and it is cited in the Beit Yosef, that a person is forbidden to occupy himself with his affairs before he prays, so that he not turn his heart to anything until he prays; and so too it is written in the Shulchan Aruch at the end of se'if 2, that one is forbidden to delay with any other matters at all until he prays. And those accustomed to gather with friends at the time of drinking tea are apt at times, through excessive conversation, to let pass thereby even the time of Shema and prayer.
(כג) בשבת - כלומר דלא תימא דבשבת אסור בלא"ה משום דאסור לטעום קודם קידוש קמ"ל דאינו אסור רק דוקא בשהגיע זמן קידוש והכא כיון שלא התפלל לא הגיע עדיין זמן קידוש ואחר תפלת מוסף אסור משום קידוש וקודם מוסף עיין סימן רפ"ו ס"ג:
(23) 'On Shabbos' — that is, you should not say that on Shabbos it is forbidden in any case, because one may not taste anything before Kiddush. It comes to teach us that it is forbidden only specifically once the time for Kiddush has arrived, and here, since he has not yet prayed, the time for Kiddush has not yet arrived. And after the Musaf prayer it is forbidden, because of Kiddush; and (concerning drinking) before Musaf, see siman 286, se'if 3.
(כד) מותר - אפילו אוכלין ומשקין טובים דשייך בהו גאוה כיון שאינו עושה משום גאוה אלא לרפואה אע"פ שאינו חולה גמור שרי וכ"ש שמותר לשתות קודם התפלה הרקות ושיקויים לרפואה:
(24) 'Permitted' — even fine foods and drinks, to which haughtiness would apply, since he is not doing so out of haughtiness but for a remedy, even though he is not fully ill, it is permitted; and all the more so is it permitted to drink, before praying, extracts and potions for a remedy.
(כה) והרעב - הרבה [לבוש]:
(25) 'Or hungry' — very (hungry). [the Levush.]
(כו) וישתה - משמע שאינו מחוייב מדקאמר אם רוצה והטעם משום דעכשיו בזמן הזה בלא"ה אין מכוונים כ"כ ומ"מ אם רוצה לאכול ולשתות קודם כדי שיכוין מותר ועיין בא"ר:
(26) 'And drink' — it is implied that he is not obligated (to eat first), since it says 'if he wishes.' And the reason is that nowadays, in these times, we do not concentrate so much in any case. Nevertheless, if he wishes to eat and drink beforehand so that he may concentrate, it is permitted — and see the Eliyah Rabbah.
(כז) התחיל לאכול - אפי' היה בהיתר דהיינו שהיה יותר מחצי שעה עד עה"ש דבתוך הח"ש אסור להתחיל לאכול וכמו שכתב הרמ"א בסי' תרנ"ב לגבי לולב וה"ה לגבי ק"ש דאורייתא ודוקא אם אוכל יותר מכביצה דהוי דרך קבע או לשתות בכשיעור זה אבל בפחות מזה מותר עד עה"ש:
(27) 'Began to eat' — even if it was permissibly — that is, that there was more than a half-hour until dawn (amud hashachar) — for within the (final) half-hour it is forbidden to begin eating, as the Rema wrote in siman 652 regarding the lulav, and the same applies regarding Shema, which is of Torah origin. And this is specifically if he eats more than an egg's volume (k'beitzah), which is a fixed manner (of eating), or drinks a comparable measure; but with less than this, it is permitted until dawn.
(כח) צריך להפסיק - כשעולה עה"ש ואע"ג דבתפלת המנחה א"צ להפסיק כמ"ש סי' רל"ב הכא שאני כיון דאסמכוה אקרא דלא תאכלו על הדם לא תאכלו קודם שתתפללו על דמכם צריך להפסיק ובשם הזוהר כתבו האחרונים שאפילו קם בחצות הלילה אסור לטעום קודם שמתפלל וכתב הפמ"ג דדוקא כשהיה ישן ואפשר דשתייה שרי ומדינא אפילו ישן מותר לאכול ולשתות ומ"מ נכון לכתחלה ליזהר בזה אם אינו מוכרח ועיין במחצית השקל שכתב דבתשו' שב יעקב סי' ח' כתב בשם סידור האר"י ז"ל שהרח"ו עצמו כשהיה חלש לבו אכל או שתה איזה דבר לחזק גופו ולא אסר כ"א לאכול למלאות תאותו עי"ש ובח"א כלל ט"ז כ' ג"כ דהקם קודם אור היום ולבו חלש ועי"ז מתבטל מלימודו מותר לאכול:
(28) 'He must interrupt' — when dawn (amud hashachar) rises. And although for the Minchah prayer one need not interrupt (a meal), as written in siman 232, here it is different, since they supported (the prohibition) on the verse 'You shall not eat over the blood' — do not eat before you have prayed on behalf of your blood — (so) he must interrupt. And in the name of the Zohar the later authorities wrote that even one who arose at midnight may not taste anything before he prays; and the Pri Megadim wrote that this is specifically when he had been sleeping, and it is possible that drinking is permitted. By strict law, even one who slept is permitted to eat and drink; nevertheless it is proper, ideally, to be careful in this if he is not compelled (by need). And see in the Machatzis HaShekel, who wrote that in the responsa Shev Yaakov, siman 8, it is written in the name of the Siddur of the Arizal, of blessed memory, that Rav Chaim Vital himself, when his heart was weak, would eat or drink something to strengthen his body, and (the Arizal) forbade only eating to fill one's appetite — see there. And in Chayei Adam, klal 16, it is likewise written that one who arose before daylight and whose heart is weak, and who is thereby kept from his learning, is permitted to eat.
(כט) וי"א שא"צ וכו' - ר"ל לתפלה אפילו התחיל באיסור אלא לק"ש בלבד שהיא מן התורה צריך להפסיק אם התחיל באיסור וקורא ק"ש בלא ברכותיה שברכותיה הם מד"ס ולאחר שיגמור יקרא הק"ש עם ברכותיה ויתפלל וכ' האחרונים שהעיקר כסברא הראשונה ואם בירך בהמ"ז ועוסק בשתייה צריך להפסיק לד"ה:
(29) 'And some say that he need not, etc.' — that is to say, (he need not interrupt) for prayer, even if he began (eating) in a forbidden manner; but only for Shema, which is of Torah origin, he must interrupt if he began in a forbidden manner, and he reads Shema without its blessings, since its blessings are of Rabbinic origin (mid'rabbanan); and after he finishes, he reads the Shema with its blessings and prays. And the later authorities wrote that the main ruling is like the first view. And if he recited Birkas HaMazon and is engaged in drinking, he must interrupt according to all opinions.
(ל) ללמוד אסור - ר"ל להתחיל ללמוד אבל אם כבר התחיל אפילו אחר שהגיע הזמן שוב אינו פוסק אם ישאר לו שהות אח"כ להתפלל בזמן תפלה אך ק"ש י"א דצריך להפסיק ולקרותה כיון שהתחיל אחר שכבר הגיע זמנה ויש מקילין גם בזה אם לא שירא שיעבור הזמן ועיין לקמן בסי' ק"ו בבה"ל:
(30) 'To study is forbidden' — that is to say, to begin studying; but if he already began, even after the (prayer) time arrived, he does not then interrupt, provided that enough time will remain afterward to pray within the time of prayer. As for Shema, however, some say that he must interrupt and recite it, since he began after its time had already arrived; and some are lenient even in this, provided he does not fear that the time will pass. And see below in siman 106, in the Biur Halacha.
(לא) משיגיע וכו' - היינו משעלה עמוד השחר אבל קודם לזה מותר אפילו להתחיל וכשהתחיל ממילא שוב אינו פוסק אם לא שירא שיעבור הזמן ויש מקילין לכתחילה אפילו אחר שעלה עה"ש כ"ז שלא הגיע זמן סמוך להנץ שראוי להתפלל בו לכתחילה:
(31) 'Once (the time) arrives, etc.' — that is, from when dawn (amud hashachar) has risen; but before this, it is permitted even to begin (studying), and once he has begun, he consequently does not then interrupt, unless he fears that the time will pass. And some are lenient even ideally (to begin) even after dawn has risen, as long as the time close to sunrise (haneitz) — which is fitting for praying ideally — has not yet arrived.
(לב) בבית מדרשו - ר"ל ביחידות ואם רגילין צבור להתאסף אליו שם גם בזה מותר דוודאי יזכרוהו כשיבואו ועיין סימן צ' סי"ח בהג"ה:
(32) 'In his own study hall' — that is, (praying) in private. But if a congregation is accustomed to gather to him there, in this case too it is permitted, for they will surely remind him when they come. And see siman 90, se'if 18, in the Rema's gloss.
(לג) מיטריד בגירסיה - עיין בח"א שכתב דאפילו יש לו שיעור קבוע מה שלומד דליכא למיחש כ"כ שמא ימשך בלימוד אפ"ה אסור ולכן מי שהוא בדרך או דר בישוב אפילו בקיץ אע"ג שמצוה להתפלל בשעה שהצבור מתפללין מ"מ כיון שאסור ללמוד קודם שמתפלל מוטב שיתפלל תיכף כדי שלא יתבטל מלימודו ובזה"ז דעוברי דרכים ע"פ רוב אינם למודים תורה בדרך והיה מהראוי שימתינו על זמן שהצבור מתפללין מ"מ כיון שנמשך מזה שעוברים זמן ק"ש ולפעמים גם זמן תפלה לכן יזהרו שתיכף בקומם קודם שיעסקו בשום דבר יתפללו ומכ"ש דבקהלות גדולות מתפללין תיכף כשהאיר היום וא"כ לעולם הוא בשעה שהצבור מתפללין עכ"ל. ויראה לצמצם בעת שמברך על התפילין שיהיה יכול להכיר את חבירו ברחוק ד"א וכמו שכתבנו למעלה:
(33) 'He may become engrossed in his learning' — see in Chayei Adam, who wrote that even if he has a fixed portion (shiur) that he studies, so that there is not so much concern that he will be drawn on in his learning, even so it is forbidden. Therefore, one who is on the road, or dwells in a (remote) settlement — even in the summer, although it is a mitzvah to pray at the time the congregation prays — nevertheless, since it is forbidden to study before he prays, it is better that he pray at once, so that he not be kept from his learning. And nowadays, since travelers for the most part do not study Torah on the road, and it would have been fitting for them to wait until the time the congregation prays, nevertheless, since it results from this that they let the time of Shema, and sometimes also the time of prayer, pass, therefore let them be careful that, immediately upon rising, before they occupy themselves with anything, they pray. And all the more so in large communities, where they pray immediately when the day has become light, so that (praying) is always at the time the congregation prays. End of his words. And he should take care to be precise, at the time he recites the blessing over the tefillin, that he be able to recognize his acquaintance at a distance of four cubits, as we wrote above.
(לד) ויעבור וכו' - ואם אמר לחבירו שאינו לומד שאם יטרד בגירסא יזכרנו שלא יעביר הזמן מותר ללמוד:
(34) 'And he will let (the time) pass, etc.' — but if he told a friend who is not (himself) studying that, should he become engrossed in his learning, (the friend) should remind him so that he not let the time pass, he is permitted to study.
(לה) מלמד לאחרים וכו' - ודוקא אם לא יעבור ק"ש עי"ז דאם ירא שיעבור הזמן מחוייב לקרותה מקודם כיון שכבר הגיע הזמן וכמו שהוכחתי לקמן בסימן ק"ו בבה"ל:
(35) 'Teaches others, etc.' — and this is specifically if he will not thereby let (the time of) Shema pass; for if he fears that the time will pass, he is obligated to recite it first, since the time has already arrived, as I have demonstrated below in siman 106, in the Biur Halacha.
(לו) להסתפר וכו' - דוקא סמוך לשחרית דהיינו קודם שעלה עמוד השחר אבל משעלה עמוד השחר גם זה אסור [א"ר] וכתב הפמ"ג דדין ובורסקי וסעודה אסור סמוך לשחרית כמו סמוך למנחה ועיין לעיל בסימן ע' בבה"ל. ולקנות צרכי סעודה בע"ש קודם תפלה שרי דחפצי שמים המה הא בחול אסור:
(36) 'To take a haircut, etc.' — specifically close to Shacharis — that is, before dawn (amud hashachar) has risen; but from when dawn has risen, this too is forbidden. [Eliyah Rabbah.] And the Pri Megadim wrote that (holding) a court session, tanning, and a meal are forbidden close to Shacharis, just as close to Minchah; and see above in siman 70, in the Biur Halacha. And to purchase the needs of a (Shabbos) meal on Erev Shabbos before praying is permitted, for these are matters of a mitzvah (cheftzei shamayim); but on a weekday it is forbidden.
(לז) שהוא דבר וכו' - שרוב העם נכנסין שם ביום אבל בשחר דבר שאינו מצוי הוא ולא גזרו בו ואותן המלאכות שדרך בני אדם להשכים להם קודם עה"ש יש שמחמירים וסוברים דבחצי שעה שקודם עה"ש אסור כמו סמוך למנחה וכדלעיל בסימן ע' בבה"ל עי"ש ע"כ טוב שיאמר ברכות מקודם:
(37) 'Which is a common occurrence, etc.' — for the majority of people enter there (the bathhouse) during the day; but in the early morning it is an uncommon thing, and they did not decree concerning it. And as for those kinds of work that people are accustomed to rise early for, before dawn (amud hashachar), there are those who are stringent and hold that during the half-hour before dawn it is forbidden, just as close to Minchah, as above in siman 70 in the Biur Halacha — see there; therefore it is good that he first recite the (morning) blessings.
(לח) שצריך וכו' - ואין השיירא ממתנת לו או שאר דחק ואונס:
(38) 'That he must, etc.' — and the caravan does not wait for him; or other cases of pressing circumstance and compulsion.
(לט) יכול להתפלל - פי' דבסתם דרך אינו יכול לכוין בתפלה בין כשהוא מהלך ברגליו או יושב בעגלה או בספינה ולפיכך אמרו חכמים שטוב יותר שיתפלל משעלה עה"ש אף שאינו עדיין עיקר זמן תפלה וגם לא יוכל לסמוך גאולה לתפלה כי לא יוכל לקרוא אז ק"ש דעדיין לא הגיע זמנה עד שיכיר את חבירו ברחוק ד"א מ"מ זהו טוב יותר משיתפלל בדרך בזמנו עם סמיכת גאולה לתפלה כי בביתו יוכל להתפלל בעמידה:
(39) 'He may pray' — the meaning is that on an ordinary journey one cannot concentrate in prayer, whether while walking on his feet, or sitting in a wagon, or on a boat. Therefore the Sages said that it is better that he pray from when dawn (amud hashachar) has risen, even though it is not yet the primary time for prayer, and even though he will not be able to join redemption to prayer — for he cannot then recite Shema, since its time has not yet arrived, until he can recognize his acquaintance at a distance of four cubits — nevertheless this is better than that he pray on the road in its proper time with joining redemption to prayer, for at home he is able to pray while standing.
(מ) משעלה עה"ש - עיין בביאור הלכה בס"א שכתבנו בשם הרבה פוסקים דס"ל דדוקא אחר שהאיר מזרח וקודם לזה לא הגיע עדיין זמן תפלה. ובפרט כשרוצה אז לברך על התפילין דזה אפילו לדעת המקילין אסור אפילו אחר שהאיר מזרח עד זמן שיכיר את חבירו ברחוק ד"א ואם הגיע הזמן הזה לכ"ע יקרא ק"ש ויתפלל בביתו כתקונה אף שעדיין לא הנץ החמה כיון שהוא שעת הדחק. ואם הוא בדרך במלון והשיירא שלו עומדים להתפלל קודם זה הזמן ומשער דעד ברכו יגיע הזמן יוכל הוא להתחיל ברכת ברוך שאמר ג"כ עמהם לע"ע בלא תפילין או שילבש תפילין בלי ברכה ואחר שיגיע בין ישתבח ליוצר יראה אם הגיע הזמן ימשמש בהן ויברך:
(40) 'From when dawn has risen' — see in the Biur Halacha on se'if 1, where we wrote in the name of many decisors who hold that it is specifically after the east has become lit, and before this the time for prayer has not yet arrived. And especially when he wishes then to recite the blessing over the tefillin, for this, even according to the lenient opinion, is forbidden — even after the east has become lit — until the time when he can recognize his acquaintance at a distance of four cubits. And if this time has arrived, then according to all he should recite Shema and pray at home in its proper form, even though sunrise (haneitz) has not yet occurred, since it is a pressing situation. And if he is on the road at an inn, and his caravan is about to pray before this time, and he estimates that by 'Barchu' the time will arrive, he may begin the blessing of 'Baruch She'amar' together with them as well, for now without tefillin, or he should don tefillin without a blessing; and after he reaches (the point) between 'Yishtabach' and 'Yotzer,' he should see whether the time has arrived, (and if so) feel them and recite the blessing.
(מא) אם אפשר וכו' - ר"ל דאם יודע שגם ק"ש פסוק ראשון לא יוכל לכוין בדרך כגון שהוא במקום גדודי חיה וליסטים מותר לקרוא ק"ש בביתו ג"כ תיכף משעלה עה"ש אע"פ שעדיין לא הגיע עיקר הזמן וכדלעיל בסימן נ"ח ס"ג:
(41) 'If it is possible, etc.' — that is to say, that if he knows that he will not be able to concentrate even on the first verse of Shema on the road — such as when he is in a place of bands of wild beasts and bandits — he is permitted to recite Shema at home as well, immediately from when dawn (amud hashachar) has risen, even though the primary time has not yet arrived, as above in siman 58, se'if 3.
(מב) הכי עדיף - ורוב העולם אין נזהרין בזה ואפשר משום דנוהגים כאידך פוסקים דס"ל דמסמך גאולה לתפלה עדיף ע"כ מתפללין בדרך עם סמיכת גאולה לתפלה [מ"א עי"ש עוד]. עוד כתב אם הוא בדרך ומתיירא שיעבור זמן ק"ש יקרא ק"ש בלי ברכות וכשיבוא למלון יקרא עוד הפעם ק"ש עם ברכותיה ויסמוך גאולה לתפלה ואם הוא רואה שיעבור גם זמן תפלה [שהיא רק עד ד' שעות] ודאי יתפלל י"ח ג"כ בדרך מהלך או מיושב [פמ"ג] וכשנוסע בלילה ויכול לבוא במלון להתפלל שם מעריב נכון להתאחר להתפלל עד בואו שם ולא יתפלל בעודו בדרך אם לא שהוא ישן על העגלה ויש לחוש שמא בתוך כך יעלה עמוד השחר ועיין ברל"ה בשע"ת סק"ג או שהוא ירא שמא לא יהיה לו שם מקום מנוחה להתפלל שיבלבלוהו שם בני הבית:
(42) 'This is preferable' — but the majority of the world is not careful about this, and it is possible that this is because they follow the other decisors, who hold that joining redemption to prayer is preferable; therefore they pray on the road with the joining of redemption to prayer. [Magen Avraham; see there further.] He further wrote: if one is on the road and fears that the time of Shema will pass, he should recite Shema without its blessings, and when he arrives at the inn he should recite Shema once again with its blessings and join redemption to prayer. And if he sees that the time for prayer will also pass — which is only until four hours — he should certainly pray the Shemoneh Esrei as well on the road, whether walking or seated. [Pri Megadim.] And when one travels at night and is able to come to an inn to pray Ma'ariv there, it is proper to delay praying until his arrival there, and he should not pray while still on the road — unless he is sleeping on the wagon and there is concern that in the meantime dawn (amud hashachar) may rise. And see in siman 235, in the שע"ת, se'if katan 3; or (the reason not to pray earlier is) that he fears he may not have there a restful place to pray, since the members of the household may confuse him there.
