לא ילך אדם במבואות המטונפות אויניח ידו על פיו ויקרא קריאת שמע ואפילו אם היה קורא ובא צריך להפסיק בכשיגיע למבוי המטונף וכשיוצא משם אפי' שהה כדי לגמו' את כולה אינו צריך לחזו' אלא למקום שפסק הגה וי"א שחוזר לראש וגכן עיקר [וע"ל סי' ס"ה]:
One should not walk through filthy alleyways and place his hand over his mouth and recite the Shema. And even if he was reciting [the Shema] as he came along, he must stop when he reaches the filthy alley. And when he emerges from there, even if he tarried long enough to have finished the whole [Shema], he need not go back [to the beginning], but only to the place where he stopped. The Rema adds: And some say that he goes back to the beginning, and so is the essential ruling. (And see above, Siman 65.)
דאפי' להרהר הבד"ת ואסור זבבית הכסא חובבית המרחץ ובמקום הטנופת והוא המקום שיש בו צואה ומי רגלים: הגה ואפי' הלכות המרחץ אסור ללמוד במרחץ (ר"ן פ' כירה ונ"י בשם א"ח): דברים של חול מותר לאמרם שם בטלשון הקודש וכן הכנויים כגון רחום ניאמן וכיוצא בו מיאותר לאמרם שם אבל השמות שיבאינם נמחקין אסור להזכירם שם ואם נזדמן לו שם ליגהפריש מדבר האסור מפריש ואפילו בלשון הקודש וידבענייני קודש: הגה וטובמקום שמותר להרהר בד"ת מותר לטזפסוק דין ובלבד שלא יאמר טעמו של דבר (ר"ן פ"ק דשבת ופרק כל הצלמים):
Even to merely think words of Torah is forbidden in a privy, in a bathhouse, and in a place of filth, and that is a place where there is excrement or urine. The Rema adds: And even the laws of the bathhouse are forbidden to study in the bathhouse (the Ran, chapter Kirah, and the Nimukei Yosef in the name of א"ח). Mundane matters may be said there in the Holy Tongue, and likewise the [divine] epithets, such as "Merciful" and "Faithful" and the like, may be said there; but the [holy] Names that may not be erased are forbidden to mention there. And if the occasion arises there to keep [someone] away from a forbidden matter, he may do so, and even in the Holy Tongue and concerning holy matters. The Rema adds: And in a place where it is permitted to think words of Torah, one may [also] rule a point of law, provided that he does not state the reason for the matter (the Ran, first chapter of Shabbos, and the chapter Kol HaTzelamim).
משנה ברורה
(א) ויניח ידו וכו' - כלומר שקורא כ"כ בלחש עד שאינו ניכר כלל שמרחש בשפתיו ג"כ אסור:
(1) "and place his hand, etc." — that is to say, even if he recites so quietly that it is not at all noticeable that he is stirring his lips, this too is forbidden.
(ב) כשיגיע - ר"ל בתוך ד"א ואם הוא לפניו אסור כמלא עיניו:
(2) "when he reaches" — that is to say, within four cubits; and if it is in front of him, it is forbidden as far as his eye can see.
(ג) וכן עיקר - עיין בסימן ס"ה במשנה ברורה שביארנו שם כל פרטי הדין:
(3) "and so is the essential ruling" — see in Siman 65 in the Mishnah Berurah, where we explained there all the particulars of this law.
(ד) אפילו להרהר - ואפילו בזמן שאין שם אדם:
(4) "even to think [words of Torah]" — and even at a time when no person is present there.
(ה) בד"ת - וכן אסור לעיין בבה"כ במשקלי השמות והפעלים של לשון הקודש שאין דרך להגיע לידיעה רק ע"פ הכתובים ויבוא להרהר במקרא ופשוט דמותר אדם להתבונן בבה"כ בגודל שפלותו ושבסופו יחזור כולו להיות עפר רימה ותולעה ואין נאה לו הגאוה:
(5) "words of Torah" — and likewise it is forbidden to study in the privy the [grammatical] patterns of the nouns and verbs of the Holy Tongue, since there is no way to arrive at [their] knowledge except by way of the [Scriptural] verses, and he would thereby come to think about Scripture. And it is obvious that a person is permitted to contemplate in the privy the extent of his lowliness, and that in the end he will wholly return to become dust, maggot, and worm, and that arrogance is unbecoming to him.
(ו) אסור - ויחשוב שם חשבונות ביתו והוצאותיו כדי שלא יבא לידי הרהור ובשבת יחשוב בבנינים וציורים נאים:
(6) "it is forbidden" — and he should think there about his household accounts and his expenses, so that he not come to [Torah] thought; and on Shabbos he should think about beautiful buildings and designs.
(ז) בבה"כ - ואפילו בתוך הד"א של הבה"כ ממקום שכלה הריח ג"כ אסור להרהר ועיין לעיל בסימן ע"ט במ"ב סק"ג. כתב בספר תוספות ירושלים בשם הירושלמי דבבורסקי אסור להתפלל וכן להזכיר כל דבר שבקדושה והוא שהותחל העיבוד שיש ריח רע אבל אם עדיין לא התחיל מותר ופשוט דבזמן שאסור הוא אפילו להאומן עצמו שמורגל בהריח רע ואינו מרגיש כל שבני אדם מצטערים מזה הר"ר וכדלעיל בסימן ע"ט ס"א:
(7) "in the privy" — and even within the four cubits of the privy, from the place where the odor ends, it is likewise forbidden to think [words of Torah]; and see earlier, in Siman 79, in the Mishnah Berurah, se'if katan 3. It is written in the sefer Tosefos Yerushalayim, in the name of the Yerushalmi, that in a tannery it is forbidden to pray, and likewise to mention anything of holiness, and this is [specifically] once the tanning process has begun, so that there is a foul odor, but if it has not yet begun, it is permitted. And it is obvious that when it is forbidden, it is so even for the craftsman himself, who is accustomed to the foul odor and does not [consciously] sense it, as long as [other] people are pained by this foul odor, as [explained] earlier, in Siman 79, se'if 1.
(ח) ובבית המרחץ - כי נפיש זוהמא בתוכו ומאוס והו"ל הצואה ובה"כ וטעם איסור ההרהור בכל אלו המקומות משום דבעינן והיה מחניך קדוש וליכא [שבת קנ"א] כתב ב"י מי שתלמודו שגור בפיו והרהר בבה"כ ובבית המרחץ לאונסו מותר יש אומרים דכיון דאנוס הוא בהרהורו יכול אפילו לבטא בשפתיו וכן משמע מזבחים ק"ב ע"ב אבל בספר ברכי יוסף מסיק דהדבור אסור בכל גווני והראיה מהגמרא יש לדחות כמש"כ שם הרב ברכת הזבח וצאן קדשים עי"ש ומה שכתב דאם הרהר לאונסו מותר היינו ר"ל דאם הרהר לא עבד איסורא מאחר שהיה לאונסו ברם לכתחילה חובת גברא לדחות ההרהור וכ"ש דהדבור אסור וכ"כ בספר ישועות יעקב דהדבור אסור:
(8) "and in a bathhouse" — for filth is abundant within it and it is repulsive, and it therefore has the status of excrement and a privy. And the reason for the prohibition of thinking [words of Torah] in all these places is because we require "your camp shall be holy," and here it is lacking. [Shabbos 151]. The Beis Yosef wrote: one whose learning is fluent in his mouth and who thought [words of Torah] in the privy or the bathhouse under duress — it is permitted. Some say that since he is under duress in his thought, he may even utter [the words] with his lips, and so it is implied from Zevachim 102b. But in the sefer Birkei Yosef he concludes that speech is forbidden in every case, and the proof from the Gemara can be refuted, as the Rav [author of] Birkas HaZevach and Tzon Kodashim wrote there; see there. And that which [the Beis Yosef] wrote, that if he thought [words of Torah] under duress it is permitted — this means, that is to say, that if he [merely] thought, he has not committed a transgression, since it was under duress; but at the outset it is a personal obligation to push away the thought, and all the more so that speech is forbidden. And so too it is written in the sefer Yeshuos Yaakov, that speech is forbidden.
(ט) בלשון הקדש - ומדת חסידות הוא להחמיר:
(9) "in the Holy Tongue" — and it is a measure of piety to be stringent [and refrain even from this].
(י) נאמן - הראב"ד אוסר ברחום וכתב הב"ח ויש להחמיר וכ"פ הפר"ח מיהו בלע"ז לכו"ע שרי הואיל וזה אינו מיוחד דוקא להקב"ה משא"כ שאר ד"ת וכ"ש השמות שאינם נמחקין אסור לאמור שם אפילו בלשון לע"ז כגון גא"ט בלשון אשכנז או בוגא בלשון פולין ורוסיא וכה"ג שאף ששם זה אין בו קדושה באותיות כתיבתו ומותר למוחקו מ"מ יש בו משום בזיון בהזכרתו במקום טינופת כמו בהזכרת השלום שמותר ג"כ למוחקו ואעפ"כ כיון שהקב"ה נקרא בו אע"פ שאינו מיוחד לו אסור להזכירו כשמתכוין על ענין השלום וכמש"כ סי' פ"ד וכ"ש בזה שלכמה דברים דינם כשמות שבלשה"ק כגון לענין שבועה ולענין הזכרת ש"ש לבטלה ולענין קללת חבירו בשם:
(10) "Faithful" — the Ra'avad forbids [saying] "Merciful," and the Bach wrote that one should be stringent, and so too ruled the Pri Chadash. However, in a foreign language it is permitted according to all, since [the epithet] is not designated exclusively for the Holy One, unlike other words of Torah. And all the more so the Names that may not be erased are forbidden to say there even in a foreign language, such as "Gott" in the German (Yiddish) tongue, or "Boga" in the Polish and Russian tongue, and the like; for although such a name has no sanctity in the letters of its writing and it is permitted to erase it, nevertheless there is in it [a concern of] disgrace when mentioning it in a place of filth, just as with mentioning "Shalom" [as a name], which too is permitted to erase, and even so, since the Holy One is called by it, even though it is not exclusive to Him, it is forbidden to mention it when one intends the concept of peace, as we wrote in Siman 84. And all the more so in this case, for in several respects their law is like [that of] the Names in the Holy Tongue, such as regarding an oath, regarding uttering the Divine Name in vain, and regarding cursing one's fellow with the [Divine] Name.
(יא) מותר לאמרם - דגם בני אדם מכונים בהם לפעמים כמו שנאמר חנון ורחום וצדיק ודוקא באומר כך אבל באומר הרחום ירחם עליך י"ל דאסור כמו שאלת שלום [פמ"ג]:
(11) "may be said" — for people too are sometimes described by them, as it says, "gracious and merciful and righteous." And this is specifically when he says it thus [as a mere description], but when one says, "May the Merciful One have mercy on you," it can be said that it is forbidden, like a greeting of peace; [the Pri Megadim].
(יב) שאינם נמחקים - ל"ד דהא איכא שלום דאסור להזכיר שם וכנ"ל בסי' פ"ד:
(12) "that may not be erased" — this is not precise (lav davka), for there is [the name] "Shalom," which is forbidden to mention there [though it may be erased], as [explained] above in Siman 84.
(יג) להפריש מדבר איסור - וה"ה אם נכנס בלבו הרהור עבירה מותר להרהר שם בד"ת מפני שזהו כמו להפרישו מאיסור שהתורה מצלת מהרהורים רעים:
(13) "to keep [someone] away from a forbidden matter" — and likewise, if a sinful thought enters his heart, it is permitted to think words of Torah there, because this is like separating him from a prohibition, for the Torah rescues [a person] from evil thoughts.
(יד) ובענייני קודש - דהיינו לומר לו אפילו בלשון הוראה שאסור לעשות כן וא"צ לדקדק ולומר אל תעשה כך בלי לשון הוראה ויש מחמירין וסוברין דאסור לומר בלשון הנראה דזה הוא תורה כגון אם רואה בע"פ שמגלחין אחר חצות יאמר אין מגלחין דלשון זה אינו לשון הוראה אע"ג דממילא נשמע דאסור אבל לא יאמר אסור לגלח ונ"ל דאם אין דבריו נשמעין בקיצור יוכל להעריך לפניהם גודל האיסור בכל חלקיו כדי להפרישן. כתב המ"א בשם הר"ן אפילו בלא אפרושי מאיסורא שרי לומר לחבירו עשה לי כך וכך אפילו אם ממילא הוי הוראה שבזה מורה לו שהוא מותר לעשות כן כיון שאינו אומרם בלשון הוראה:
(14) "and concerning holy matters" — that is, to tell him — even in the language of a [halachic] ruling — that it is forbidden to do so, and he need not be particular to say "do not do thus" without the language of a ruling. But some are stringent and hold that it is forbidden to say [it] in phrasing that appears to be [teaching] Torah; for example, if on Erev Pesach he sees [people] shaving after midday, he should say, "One does not shave [now]," for this phrasing is not the language of a ruling, even though it is automatically understood [from it] that it is forbidden; but he should not say, "It is forbidden to shave." And it appears to me that if his words are not heeded when [stated] briefly, he may lay out before them the gravity of the prohibition in all its parts, in order to keep them away [from it]. The Magen Avraham wrote in the name of the Ran: even without [the purpose of] keeping [someone] away from a prohibition, it is permitted to say to one's fellow, "Do such and such for me," even if it thereby automatically constitutes a ruling, in that he thereby instructs him that it is permitted to do so, since he does not say it in the language of a ruling.
(טו) ובמקום שמותר - כגון בבית אמצעי של מרחץ וכנ"ל או כגון שהוא בעצמו אינו נקי לגמרי כגון שנגע בידיו במקומות המכוסים דאם ידיו או שאר מקומות מגופו מטונפות ממש אפילו ההרהור אסור [פמ"ג]:
(15) "and in a place where it is permitted" — such as in the middle room of a bathhouse, as above, or such as when he himself is not entirely clean, for example if he touched with his hands the covered parts [of his body]; for if his hands or other parts of his body are actually soiled, even the [Torah] thought is forbidden. [the Pri Megadim].
(טז) לפסוק דין - דהוי כמו הרהור שמחשב הטעם בלבו ועיין לעיל סימן מ"ז ס"ד במ"ב ובה"ל:
(16) "to rule a point of law" — for it is like [mere] thought, in that he works out the reason in his heart; and see earlier, Siman 47, se'if 4, in the Mishnah Berurah and the Biur Halacha.
