A minor who has reached the stage where another child like him is able to eat a kezayis (olive's bulk) of grain within the time it takes an adult to eat a peras (a half-loaf's worth) — one must distance oneself from his excrement or from his urine (when reciting the Shema or praying).

If he was reciting (the Shema) and saw excrement in front of him, he should walk on until he leaves it behind him four cubits (amos). And if that is impossible — such as when there is a river before him, or some other obstruction — he should walk on until he leaves it to the side four cubits. And he need not go back except to the place where he stopped. But according to HaRav (Rabbeinu) Yonah, if he was in a place where he should have taken to heart that there is excrement there, he must return to the beginning. (And see above, siman 76, se'if 8.)

(1) 'A minor who has reached' — specifically a minor; but an adult — even if he cannot eat grain at all — one must distance oneself from his excrement and his urine. And for this matter, 'adult' means one who is already six or already seven years old [the Pri Megadim].

(2) 'The stage where another (child)' — that is to say, even though we have not actually seen this particular child eat, since another child like him is able to eat, presumably he too is able to eat. And even if he can eat it only when it is cooked, that still counts as eating. But if the minor is weak, and it is known to us that he cannot eat a kezayis within the time of eating a peras, one need not distance oneself from his excrement and urine, even if he is three or four years old. This applies only if he was never in his life able to eat a kezayis within the time of eating a peras; but if he was once able to eat and afterwards grew weak and can no longer do so — and even if he has not eaten grain for many days, so that this excrement certainly does not come from grain — nevertheless his law is like that of an adult, from whom one must always distance oneself, even one who can never eat grain at all. And more than this: even if the minor has in fact never yet eaten any kind of grain, nevertheless, if by his nature he was capable of eating the kezayis of grain within the time of eating a peras, his intestines make foul-smelling every kind of food he eats, just like an adult's. And some are lenient regarding a minor if it is known that he has not eaten grain for many days, and all the more so if he has never eaten it. But a priori one should certainly be stringent and distance oneself even from the excrement of such a minor, for it is a doubt regarding a Torah prohibition. After the fact, however, if he prayed opposite it, he need not repeat, for one may rely on the opinion of those who are lenient — unless we actually saw that this minor himself also ate, for then, according to all opinions, his law is like an adult's, and even after the fact he must go back and pray again.

(3) 'Grain' — all five species (of grain) are called dagan, and their excrement is foul-smelling. For a cooked food prepared for an infant, we measure according to how much of that same species an adult can eat in the time of eating a peras. And the measure of a peras: some say three eggs, and some say four eggs. All this is according to the strict letter of the law; but it is good and proper to distance oneself from the excrement of a minor, even one only eight days old. The Magen Avraham wrote in the name of the Maharshal (Rabbi Shlomo Luria) that it is not proper to recite the Shema opposite small children, since they typically pat about in refuse, a place of excrement, and their clothes and shoes are soiled.

(4) 'An adult' — this 'adult' means an average person, for there is one who by his nature eats quickly, and one who eats more slowly (so we take a middling person as the standard). And if the minor needs longer than this measure to eat a kezayis, he is like one who eats half a kezayis today and half a kezayis tomorrow; for such is the halacha l'Moshe mi'Sinai (a law given to Moshe at Sinai) generally, that eating does not combine (into a single act) over so long a delay.

(5) 'One must distance oneself' — for anyone who has reached this stage, his excrement is foul-smelling.

(6) 'Or from his urine' — it appears that since he has reached this measure, even opposite his stream (of urine) it is forbidden by Torah law, just like that of any other adult.

(7) 'He was reciting' — and likewise if he was praying.

(8) 'And saw excrement' — the same applies regarding urine, as below in siman 90, se'if 27. But as for going back afterward, in the case of urine, according to all opinions he returns only to the place where he stopped, as stated above at the end of siman 76.

(9) 'In front of him' — it speaks of a case where it is more than four cubits from the place where the smell ends; for if it were within four (cubits), according to all he would have to return to the beginning, since he was negligent, for he should have checked at the outset, as stated above at the end of siman 76.

(10) 'That he leaves it (behind him)' — and likewise he may simply turn his face to the west side, since he is not standing in the Shemoneh Esrei (the Eighteen-blessing Amidah, during which one may not turn).

(11) 'Four cubits' — measured from the place where the smell ends.

(12) 'A river before him' — and it speaks of a case where he cannot turn his face to the west for some reason, for otherwise he would simply turn his face; and see the Magen Avraham.

(13) 'To the place where he stopped' — he (the first opinion) holds that since it was not within his four cubits, we do not say that he should have checked, for the Torah did not burden him to check as far as the eye can see. And the latter opinion holds that since it was a place where one ought to have suspected (excrement), he was negligent, for he should not have recited and prayed until the matter was clarified to him. And see the Eliyah Rabbah, who wrote that the Rosh and the Rokeach also hold like Rabbeinu Yonah. Nevertheless, in practice it appears that one should not be stringent after the fact, for the דה"ח and the Shulchan Shlomo and yet other latter-day authorities of our time all cited only the first opinion as the law. And if he delayed long enough to finish the whole of it, see above in siman 65 and in the Mishnah Berurah there.
