אסור לקרות אכנגד מי רגלים בעד שיטיל לתוכן גרביעית מים ואז מותר ולא שנא דעל גבי קרקע לא שנא בכלי ובלבד שלא יהא עביט ההמיוחד להם [ודין עביט ע"ל סימן פ"ז] לא שנא היו והם בכלי תחל' וניתן עליהם מים לא שנא המים בכלי תחל':
It is forbidden to recite (the Shema or words of Torah) opposite urine, until one casts a revi'it (about 3 oz.) of water into it, and then it is permitted. There is no difference whether the urine is on the ground or in a vessel; provided only that it not be a chamber-pot designated for them (which cannot be made fit merely by adding water). (The law of such a chamber-pot, see above in siman 87.) And there is no difference whether the urine was in the vessel first and water was then placed upon it, or whether the water was in the vessel first (and the urine came into it).
רביעית שאמרו למי רגלים של זפעם א' ולשל שני פעמים חשני רביעיות ולשל שלש שלשה: הגה וכן לעולם:
The revi'it they specified is for the urine of one urination; for that of two urinations, two revi'iyot; and for that of three, three. The Rema adds: and so on always (a revi'it for each urination).
משנה ברורה
(א) כנגד וכו' - וצריך לזה כל דיני הרחקה כמו לקמן בסימן ע"ט ס"א לענין צואה:
(1) 'Opposite, etc.' — and for this one needs all the laws of distancing (keeping the required distance from it), just as further on in siman 79, se'if 1, regarding excrement.
(ב) עד שיטיל וכו' - לפי שמן התורה אין אסור לקרות רק כנגד עמוד של קלוח בלבד ואחר שנפל על הארץ אין איסורו רק מדברי סופרים וכנ"ל בסוף סימן ע"ו לכן הקילו חז"ל שיכול לבטלם ע"י רביעית מים ואפילו היו המי רגלים מרובין ולפ"ז אינו מועיל הרביעית מים אלא דוקא כשאין מסריחין אבל אם ידוע שהם מסריחין דאז אסור מד"ת לקרות נגדם אין מועיל רביעית אלא צריך שירבה עליהן מים לבטל הסרחון:
(2) 'Until he casts, etc.' — because by Torah law it is forbidden to recite only opposite the actual column of the flowing stream itself, and once it has fallen to the ground its prohibition is only Rabbinic, as stated above at the end of siman 76. Therefore the Sages were lenient, allowing one to nullify it by means of a revi'it of water, and this holds even if the urine was abundant. According to this, the revi'it of water helps only specifically when the urine does not give off a foul smell; but if it is known that it stinks — in which case reciting opposite it is forbidden by Torah law — a revi'it does not help; rather he must pour a large amount of water over it to nullify the stench.
(ג) רביעית מים - י"א דבעינן דוקא בבת אחת דאל"ה קמא קמא בטיל:
(3) 'A revi'it of water' — some say we require it to be poured specifically all at once, for otherwise each small amount is nullified as it arrives (first-first is nullified), and never adds up to the needed measure.
(ד) ע"ג קרקע - ויראה שילכו המים על כל מקומות שהמי רגלים נשפכים שם שהם טופח ע"מ להטפיח ועיין בבה"ל:
(4) 'On the ground' — and he should make sure the water spreads over all the places where the urine was spilled, such that they are wet enough to moisten (moist enough that touching them transfers wetness), and see in the Be'ur Halacha.
(ה) המיוחד להם - שאז אפילו אין בו מי רגלים כלל אסור לקרות נגדו ואינו מועיל בנתינת המים להכשיר הכלי עצמו כמו שיתבאר בסימן פ"ז:
(5) 'Designated for them' — for in that case, even if there is no urine in it at all, it is forbidden to recite opposite it, and placing water in it does not help to render the vessel itself fit, as will be explained in siman 87.
(ו) הם בכלי תחלה - וכן אם היו מים כרביעית תחלה ע"ג קרקע והשתין אח"כ על גבי המים מותר לקרות ק"ש ואפילו אם עתה מחמת מי רגלים נתפשט יותר:
(6) 'They were in the vessel first' — and likewise, if a revi'it of water was on the ground first, and he then urinated onto that water, it is permitted to recite the Shema, even if now, on account of the urine, the liquid has spread out further.
(ז) פעם אחת - ואפילו אם השתין הרבה די ברביעית וכנ"ל בסק"ב וכן אם השתין רק מעט י"א דצריך ג"כ רביעית אבל בתשובת חכם צבי סי' ק"ב פסק דאם המי רגלים הם פחותים מרביעית דסגי ברוב מים לבטלן וא"צ רביעית דלא אמרו רביעית אלא להקל שאף אם המי רגלים של פ"א הם מרובים מרביעית סגי ברביעית לבטלן אבל לא להחמיר ואפילו אם המי רגלים הם משתי פעמים סגי ברוב מים לבטלן וכן הסכימו האחרונים ועיין עוד מש"כ לקמן סימן פ"ב במ"ב סק"ד:
(7) 'One time' — even if he urinated a great deal, a single revi'it suffices, as stated above in se'if katan 2. Likewise, if he urinated only a little, some say a full revi'it is still required; but in the responsa of the Chacham Tzvi, siman 102, he ruled that if the urine is less than a revi'it, a majority of water over it suffices to nullify it and a full revi'it is not needed — for they stated the measure of a revi'it only as a leniency, namely that even if the urine of one urination is more than a revi'it, a revi'it still suffices to nullify it, but not as a stringency (to demand a full revi'it where less water would do). And even if the urine is from two urinations, a majority of water over it suffices to nullify it. And so the Acharonim (later authorities) concurred. And see further what is written below in siman 82, in the Mishnah Berurah, se'if katan 4.
(ח) שתי רביעיות - פסק כדעת הרמב"ם ושארי פוסקים ולא כדעת הרשב"א שמיקל בזה כמו שמבואר בב"י ובמגן גבורים מצדד לומר דאין ביניהם מחלוקת ואף הרמב"ם לא קאמר דבעי ב' רביעית לב' פעמים רק בשבאו זה אחר זה כגון שהשתין ונתן לתוכו רביעית מים כשחוזר ומשתין צריך עוד הפעם לתת לתוכו מים וכן לעולם ולא מהני לזה מה שהטיל הרביעית בפעם ראשונה אבל אם השתין כמה פעמים ורוצה לקרות כנגדן די בהטלת רביעית לבד עי"ש ובביאור הגר"א מסכים ג"כ להלכה דדי בהטלת רביעית לבד בזה עי"ש כי קצרתי:
(8) 'Two revi'iyot' — he ruled in accordance with the view of the Rambam and the rest of the poskim, and not like the view of the Rashba, who is lenient in this, as is explained in the Beit Yosef. And the Magen Giborim inclines to say that there is really no dispute between them, for even the Rambam only said that two revi'iyot are needed for two urinations when they came one after the other — for example, he urinated and placed a revi'it of water into it; when he urinates again he must once more add water into it, and so on always. The revi'it he cast the first time does not help for this later urine. But if he urinated several times all together and wishes to recite opposite them, casting a single revi'it alone suffices. See there. And in the commentary of the Vilna Gaon he too agrees, as a matter of halacha, that casting a single revi'it alone suffices in this case. See there, for I have been brief.
