צואה אבעששית מותר בלקרות גכנגדה אף ע"פ שרואה אותה דרך דפנותיה משום דבכסוי תלה רחמנא דכתיב וכסית את צאתך והא מתכסיא:

Excrement in a glass lantern — it is permitted to recite facing it, even though one sees it through its walls, because the Torah made the matter depend on covering, as it is written, “and you shall cover your excrement,” and here it is covered.

צואה בגומא מניח דסנדלו עליה וקורא דחשיבה כמכוסה וכיון שאין ריח רע מגיע לו מותר והוא השלא יהא סנדלו ונוגע בה:

Excrement in a pit — he places his sandal over it and recites, since it is considered covered, and since no foul odor reaches him it is permitted; provided that his sandal does not touch it.

העבירו צואה זלפניו אסור לקרות חכנגדה ופי חזיר כצואה עוברת דמי אפילו עולה מן הנהר אין הרחיצה מועלת לו טדהוי כגרף של רעי:

If excrement was passed before him, it is forbidden to recite facing it; and the mouth of a pig is like passing excrement, even when it comes up from the river, the washing does not help it, since it is like a chamber pot of filth.

היתה צואה על בשרו ומכוסה יבבגדיו או שהכניס ידיו בבית הכסא דרך יאחור ואינו מריח ריח רע יש יבמתירים לקרות ויש אוסרין וי"א שלא התיר המתיר בצוא' על בשרו אלא במקום שהיא נכסת מאליה בלא מלבוש יגכגון אצילי ידיו ונכון לעשות ידכדברי המחמיר: הגה ושכבת זרע על בשרו דטוינו כצואה (מהרי"ל הל' י"כ):

If there was excrement on his flesh but covered by his clothes, or he inserted his hands into a privy through a hole, and he does not smell a foul odor — some permit reciting, and some forbid; and some say that the one who permits allowed excrement on his flesh only in a place where it is covered on its own without a garment, such as the joints of his arms; and it is proper to act according to the stringent view. The Rema adds: semen on one's flesh has the same law as excrement (Maharil, Laws of Yom Kippur).

Excrement at the anus — even if it is covered, it is forbidden to recite according to all, even if it is not visible when he stands but is visible when he sits.

היה לפניו כמעט צואה יכול לבטלה ברוק שירוק בה ויקרא כנגדה והוא שיהא כאהרוק עבה ואין הביטול מועיל אלא לפי שעה אבל אם לא יקרא מיד והרוק נימוח ונבלע בה לא בטלה:

If there was a little excrement before him, he can nullify it with saliva, by spitting on it and reciting facing it; provided that the saliva is thick. And the nullification is effective only for the moment; but if he does not recite at once and the saliva dissolves and is absorbed into it, it is not nullified.

ספק אם צואה בבית כבמותר לקרות כגדחזקת בית שאין בה צואה ספק אם צואה באשפ' אסור משום כדדחזקת אשפה שיש בה צואה אבל כהספק מי רגלים כואפילו באשפ' מותר משום דלא אסרה תור' לקרות כנגד מי רגלים אלא כזכנגד עמוד של קלוח ואחר שנפל לא מיתסר אלא מדרבנן ובספיקן לא גזרו:

If it is doubtful whether there is excrement in a house, it is permitted to recite, since the presumptive status of a house is that there is no excrement in it. If it is doubtful whether there is excrement in a refuse-heap, it is forbidden, because the presumptive status of a refuse-heap is that there is excrement in it. But a doubt about urine, even in a refuse-heap, is permitted, because the Torah forbade reciting facing urine only facing the column of its stream, and after it has fallen it is forbidden only rabbinically, and in their doubtful cases they did not decree.

קרא כחבמקום שראוי להסתפק בצוא' כטומצאה אחר כך לצריך לחזור לאולקרות אבל אם אין המקום ראוי להסתפק בו לבאין צריך לחזור ולקרות ומי רגלים אפי' מצאן במקום שראוי להסתפק לגא"צ לחזור ולקרות:

If he recited in a place where it is reasonable to suspect excrement and afterward found it, he must go back and recite again; but if the place is not one where it is reasonable to suspect, he need not go back and recite. And urine — even if he found it in a place where it is reasonable to suspect, he need not go back and recite.

משנה ברורה

(א) בעששית - הוא של זכוכית או דבר אחר המנהיר:

(1) 'In a glass lantern' — it is made of glass or another translucent material.

(ב) לקרות - דע דבכל ההלכות אלו עד סי' פ"ח וכן לענין איסור ערוה הנ"ל כ"מ שנזכר הדין לענין ק"ש בין לענין היתר בין לענין איסור הוא לאו דוקא ק"ש דה"ה תורה ותפלה וכל עניני הקדושה ובין שאומרם בלשון קודש ובין בלשון חול:

(2) 'To recite' — know that in all these laws, up to siman 88, and likewise regarding the prohibition of nakedness mentioned above, wherever the law is stated with respect to the Shema, whether for leniency or for prohibition, it is not specifically the Shema, for the same applies to Torah study, prayer, and all matters of holiness, whether he says them in the holy tongue or in a secular language.

(ג) כנגדה - ואם מגיע לו ריח רע אסור ואפילו למ"ד בסימן ע"ט ס"ב דהפסקה מועלת לר"ר דוקא מחיצה שהוא רשות בפני עצמו אבל כפיית כלי לא ומ"מ א"צ בזה ד"א ממקום שכלה הריח אלא כ"ז שאין מגיע אליו סגי כ"כ הפמ"ג בסימן זה אבל בסימן ע"ט במ"ז נשאר בצ"ע ועיין בסימן ע"ט בבה"ל:

(3) 'Facing it' — and if a foul odor reaches him it is forbidden. And even according to the opinion in siman 79, se'if 2, that a separation is effective against a foul odor, that is only a partition that forms a domain unto itself, but overturning a vessel does not; and nevertheless in this case one does not need four cubits from where the odor ends, rather as long as it does not reach him it suffices. So wrote the Pri Megadim in this siman, but in siman 79, in the מ"ז, he leaves it requiring further study; and see in siman 79 in the Biur Halacha.

(ד) סנדלו - לאו דוקא סנדל ה"ה באיזה דבר שמכסה מהני ונקט סנדל דלא תימא דבטיל לגבי גופו והוי כמו שמכסה אותה ברגלו יחיפה דבודאי אין גופו חשוב כיסוי קמ"ל:

(4) 'His sandal' — not specifically a sandal; the same applies to any object that covers — it works. And he mentioned a sandal so that you should not say that it is nullified relative to his body and would be like covering it with his bare foot, for certainly his own body is not considered a covering — this it comes to teach us.

(ה) שלא יהא וכו' - ר"ל אפילו אם אין הצואה מתפשט על צדדי הסנדל מבחוץ ואינו נראה ואע"ג דבעששית אפילו נוגע ודבוקה בה שרי מפני שאינו נראה מבחוץ סנדלו גרע טפי מפני שעתה הוא מלבוש שלו ע"כ אם חלצו וכיסה בו שרי:

(5) 'That it should not... etc.' — that is to say, even if the excrement does not spread onto the sides of the sandal on the outside and is not visible. And although with a glass lantern it is permitted even when it touches and is stuck to it, because it is not visible from outside, his sandal is worse, because it is now his garment; therefore if he removed it and covered with it, it is permitted.

(ו) נוגע - עיין בע"ת ופמ"ג שמצדדים לומר דאם אחר שקרא ק"ש וברכותיה מצא צואה דבוקה בסנדלו מתחתיתו חוזר וקורא ק"ש בלא ברכותיה עי"ש הטעם ואם נתפשט הצואה גם בצדדי הסנדל מבחוץ עיין לקמן סעיף ח' ס"ק ל' מה שנכתוב שם:

(6) 'Touching' — see the ע"ת and the Pri Megadim, who incline to say that if, after reciting the Shema and its blessings, he found excrement stuck to the bottom of his sandal, he goes back and recites the Shema without its blessings — see there the reason. And if the excrement spread also onto the sides of the sandal on the outside, see below, se'if 8, se'if katan 30, what we will write there.

(ז) לפניו - וה"ה אם היתה שטה ע"פ המים:

(7) 'Before him' — and likewise if it was floating on the surface of the water.

(ח) כנגדה - עיין בב"י דסובר דאין לחלק בין צואה קבועה לעוברת ע"כ גם בזה בעינן הרחקה מלפניו כמלא עיניו ומלאחריו ד"א ממקום שכלה הריח וכן העלה הט"ז והפר"מ אך אם העבירו צואה מלפניו ע"פ רחבו אז די בד' אמות דהיינו קודם שמגיע לד' אמותיו או אחר שנתרחקה ממנו ד' אמות שרי כיון שהוא אז מצדו ואמרינן בסימן ע"ט דמצדו הוי כמו לאחריו דסגי בד"א ממקום שכלה הריח [דעד מקום שכלה הריח הוא כמו צואה ממש כיון דריח רע שיש לו עיקר הוא וכדלקמן בסי' ע"ט] והב"ח והא"ר פסקו דכיון דצואה עוברת היא ואינה עומדת במקום אחד סגי בהרחקת ד' אמות ממקום שכלה הריח אפילו מלפניו. ויש להחמיר לכתחילה ולענין דיעבד אם כבר קרא והתפלל והיתה הצואה עוברת לפניו חוץ לד"א עיין בפמ"ג שכתב וזה לשונו וכבר כתבנו כל היכא דאיכא פלוגתא חוזר וקורא ק"ש בלא ברכותי' ובתפלה אינו חוזר ומתפלל עי"ש עוד:

(8) 'Facing it' — see the Beit Yosef, who holds that one should not distinguish between fixed excrement and passing excrement; therefore in this case too we require distancing — in front of him, as far as the eye can see, and behind him, four cubits from where the odor ends. And so concluded the Taz and the פר"מ. But if they passed excrement in front of him across his width, then four cubits suffices — that is, before it reaches his four cubits, or after it has moved four cubits away from him, it is permitted, since it is then at his side, and we say in siman 79 that at his side is like behind him, for which four cubits from where the odor ends suffices [for up to the place where the odor ends it is like actual excrement, since it is a foul odor that has a tangible source, as below in siman 79]. And the Bach and the Eliyah Rabbah ruled that since it is passing excrement and does not remain in one place, four cubits' distance from where the odor ends suffices, even in front of him. And one should be stringent to begin with. And regarding after the fact, if he already recited and prayed while the excrement was passing before him beyond four cubits, see the Pri Megadim, who wrote as follows: we have already written that wherever there is a dispute, he goes back and recites the Shema without its blessings, but for the Amidah he does not go back and pray again — see there further.

(ט) דהוי כגרף - ואם החלון פתוח וחזיר עובר אם מותר לקרות עיין בסימן ע"ט ס"ב בבאור הלכה ובמשנה ברורה מה שנכתוב שם:

(9) 'Since it is like a chamber pot' — and if the window is open and a pig passes by, whether it is permitted to recite, see in siman 79, se'if 2, in the Biur Halacha and the Mishnah Berurah what we will write there.

(י) בבגדיו - ומי שידיו מטונפות מקינוח ביהכ"ס אם אין בהם ממשות צואה אלא לכלוך בעלמא והלך ריחה והיא על ידו דומיא דמלמולי זיעה שרי לקרות כנגדה אפי' בלי כיסוי ודוקא אחר משום דלאו כצואה דמיא אבל הוא גופא כל שידיו מלוכלכות מלמולי זיעה וחיכוך הראש אסור לקרות ק"ש ותפלה עד שיטול ידיו או עכ"פ אם אין לו מים ינקה ידיו וכדלעיל בסימן ד' [פמ"ג] ועיין בבה"ל:

(10) 'By his clothes' — and one whose hands are soiled from wiping in the privy: if there is no substance of excrement on them but only mere dirtiness and its odor has gone, and it is on his hand similar to rubbings of sweat, it is permitted to recite facing it even without a covering. And this is only for another person, since it is not considered like excrement; but he himself, whenever his hands are dirtied from rubbings of sweat and scratching the head, is forbidden to recite the Shema and pray until he washes his hands, or at least, if he has no water, he should clean his hands, as above in siman 4 [Pri Megadim]; and see in the Biur Halacha.

(יא) חור - ר"ל מחיצה יש בינו לבין בה"כ ופשט ידו לפנים מן המחיצה דאלת"ה הלא י"א בסימן פ"ג דאסור לקרות כנגד מחיצת בה"כ דכצואה דמיא:

(11) 'A hole' — that is to say, there is a partition between him and the privy, and he stretched his hand inside the partition; for otherwise, some say in siman 83 that it is forbidden to recite facing the wall of a privy, since it is considered like excrement.

(יב) מתירין - דכתיב כל הנשמה תהלל יה דהיינו הפה והחוטם בכלל ההילול אבל לא שאר איברים דאפילו אינם נקיים שרי והיש אוסרין טעמם דכתיב כל עצמותי תאמרנה ה' מי כמוך בעינן שיהיו כולם נקיים ופשוט דלפ"ז ה"ה אם אחד מאיבריו הוא בתוך ד' אמות של הצואה ג"כ אסור מטעם זה ואם הצואה היא על בגדיו ומכוסה מלמעלה ג"כ לכו"ע שרי ומ"מ יזהר כל אדם שיהיו תמיד בגדיו נקיים ובפרט בעת התפלה:

(12) 'Permit' — for it is written, “Let every soul praise the Lord,” meaning the mouth and the nose are included in the praising, but not the other limbs, for even if they are not clean it is permitted. And those who forbid, their reason is that it is written, “All my bones shall say, Lord, who is like You,” so we require that they all be clean. And it is obvious that accordingly, the same applies if one of his limbs is within four cubits of the excrement — it too is forbidden for this reason. And if the excrement is on his clothes and covered from above, it is likewise permitted according to all; and nevertheless every person should take care that his clothes always be clean, especially at the time of prayer.

(יג) כגון אצילי ידיו - ר"ל אז מהני כיסוי בגד [פמ"ג]:

(13) 'Such as the joints of his arms' — that is to say, in that case the covering of a garment is effective [Pri Megadim].

(יד) כדברי המחמיר - ובעת הדחק יש לסמוך אדברי המתירין שדוקא הפה והחוטם הוא בכלל ההילול אבל לא שאר איברים [ח"א]:

(14) 'According to the stringent view' — and in pressing circumstances one may rely on those who permit, that only the mouth and the nose are included in the praising, but not the other limbs [Chayei Adam].

(טו) דינו כצואה - ר"ל ע"כ יש להחמיר בה כשהיא על בשרו אף שהיא מכוסה כמו בצואה וכנ"ל אבל כשהיא על בגדיו ומכוסה שרי לכו"ע וכנ"ל בצואה וי"א דאינו כצואה מיהו בס"ח סימן תק"ט מוכח דאפילו על בגדיו ומכוסה יש לרחצו או לפשטו שלא יהיה דבוק בו הטומאה ומכ"ש כשנכשל ח"ו ע"י קרי שלא יהיה לו למזכרת איסור:

(15) 'Its law is like excrement' — that is to say, therefore one must be stringent with it when it is on his flesh even though it is covered, just as with excrement, as above; but when it is on his clothes and covered it is permitted according to all, as above regarding excrement. And some say it is not like excrement. However, in Sefer Chasidim, siman 509, it is proven that even when it is on his clothes and covered, he should wash it off or remove the garment, so that the impurity should not cling to him, and all the more so when he has stumbled, God forbid, through a seminal emission, so that it should not serve him as a reminder of transgression.

(טז) בפי טבעת - מי שיש לו חולי הטחורים וזב ממנו דם תמיד ואגב הדם יוצא ממנו ליחה סרוחה מעופשת ויש לו ריח רע אסור בכל דבר שבקדושה כל זמן שליחה סרוחה שותת ממנו ואם אין שם ריח רע אם הדם או הליחה יוצא דרך דחיה בסירוגין הוי מן המעים ויש לו תקנה ברחיצת מקום הזוהמא ואם שותת ויורד תדיר מעצמה אז הוי מפי הטבעת וא"צ תקנה:

(16) 'At the anus' — one who has the ailment of hemorrhoids and blood constantly flows from him, and along with the blood a putrid, foul discharge comes out of him and it has a foul odor — he is forbidden in any matter of holiness as long as the putrid discharge flows from him. And if there is no foul odor there: if the blood or discharge comes out by being pushed out intermittently, it is from the intestines and there is a remedy for it by washing the place of the filth; but if it flows and descends continually on its own, then it is from the anus and needs no remedy.

(יז) אסור לקרות - ובדיעבד אם קרא ק"ש חוזר וקורא אך לענין תפלה צ"ע אם יחזור ויתפלל כ"כ הח"א אבל הרבה אחרונים כתבו שצריך לחזור ולהתפלל:

(17) 'It is forbidden to recite' — and after the fact, if he recited the Shema, he goes back and recites again; but regarding the Amidah it requires further study whether he should go back and pray again — so wrote the Chayei Adam; but many of the later authorities wrote that he must go back and pray again.

(יח) לדברי הכל - ר"ל אפילו לדברי המתיר בס"ד בצואה על בשרו ומכוסה שאני הכא דבמקומה נפיש זוהמא טפי ע"כ יש לו לאדם להתעורר ולראות תמיד שיהא נקי פי הטבעת שלו ולרחצו במים או ברוק כדי שלא ישאר שמה אפילו משהו מצואה [של"ה וח"א]:

(18) 'According to all' — that is to say, even according to the one who permits in se'if 4 regarding excrement on his flesh that is covered, it is different here, for in this place there is more filth; therefore a person should rouse himself and always see that his anus is clean, and wash it with water or saliva so that not even a trace of excrement remains there [the Shela"h and the Chayei Adam].

(יט) כשהוא יושב - אבל אם אינה נראית אפילו כשהוא יושב מותר שלא ניתנה תורה למלאכי השרת:

(19) 'When he sits' — but if it is not visible even when he sits, it is permitted, for the Torah was not given to the ministering angels.

(כ) מעט צואה - אפילו כל שהוא כי אין שיעור לאיסור צואה. כתב בחידושי רע"א בשם הנזירות שמשון דא"צ להרחיק ממה שהאדם מקיא אף שהוא מאוס:

(20) 'A little excrement' — even the smallest amount, for there is no minimum measure for the prohibition of excrement. It is written in the novellae of Rabbi Akiva Eiger in the name of the Nezirus Shimshon that one need not distance himself from what a person vomits, even though it is repulsive.

(כא) הרוק עבה - אז חשיב כיסוי ודוקא כשאין מגיע לו ריח רע. ואם נותן מים ע"ג הצואה לא מהני אא"כ המים עכורים שאין הצואה נראית מתוכם ולא דמי לצואה בעששית דהתם כסוי מעליא הוא משא"כ בזה ולכן יש ליזהר לקרות נגד עביט מלא מים אשר השליכו בתוכו בגדי קטנים שיש בהם צואה:

(21) 'The saliva is thick' — then it is considered a covering, and only when no foul odor reaches him. And if he places water over the excrement it does not help, unless the water is murky so that the excrement is not visible through it; and it is not similar to excrement in a glass lantern, for there it is a superior covering, which is not the case here. Therefore one must be careful about reciting facing a chamber-vessel full of water into which children's garments that have excrement on them have been thrown.

(כב) מותר לקרות - והיכא דמצא צואה ואינו יודע אם הוא צואת כלבים ושאר בהמה וחיה או צואת אדם דעת המ"א דאזלינן בזה בתר המצוי דאם מצויין תינוקות יותר מכלבים אפילו בבית אסור וה"ה איפכא באשפה אם מצויין כלבים יותר תלינן דהוא מכלבים להקל ודוקא אם בדק האשפה ולא נמצא בו שאר צואה בלתי זה דאל"ה הלא אמרינן דסתם אשפה חזקה שיש בו צואה דרגילין להפנות שם וכן פסקו האחרונים כהמג"א:

(22) 'It is permitted to recite' — and where one found excrement and does not know whether it is the excrement of dogs and other domestic or wild animals, or human excrement, the Magen Avraham's view is that in this we follow what is common: if infants are more common there than dogs, even in a house it is forbidden; and likewise the reverse in a refuse-heap: if dogs are more common, we assume it is from dogs, leniently. And this is only if he examined the refuse-heap and found no other excrement in it besides this, for otherwise we say that an ordinary refuse-heap has a presumption that there is excrement in it, since people are accustomed to relieve themselves there. And so the later authorities ruled, like the Magen Avraham.

(כג) דחזקת בית - ואם מצוי שם קטנים צריך לבדוק:

(23) 'For the presumptive status of a house' — and if small children are common there, he must examine.

(כד) דחזקת אשפה - לאו חזקה גמורה דא"כ אפילו במי רגלים היה אסור אלא ר"ל שדרך להמצא שם צואה ע"כ אסור עד שיבדוק אח"כ מצאתי שכ"כ בלבוש:

(24) 'For the presumptive status of a refuse-heap' — it is not a full presumption, for if so, even with urine it would be forbidden; rather it means that excrement is commonly found there, therefore it is forbidden until he examines. Afterward I found that the Levush wrote so.

(כה) ספק מי רגלים - ואם הוא יודע שהיה כאן מי רגלים ונסתפק אם הטיל לתוכו רביעית מים וכיוצא בו כתב הח"א דכיון דאיתחזק איסורא אזלינן לחומרא אפילו במילתא דרבנן ומ"מ בשעת הדחק שיתבטל עי"ז מק"ש ותפלה יוכל לסמוך על הפוסקים דאפילו בזה אזלינן לקולא במילתא דרבנן. ואם אירע לו כזה בצואה דהיינו שהוא יודע שהיה כאן צואה בבית ונסתפק אם פינוהו נראה דאסור לקרות ולהתפלל עד שיתברר לו דהלא הוא מילתא דאורייתא:

(25) 'A doubt about urine' — and if he knows that there was urine here and is in doubt whether he cast a revi'is of water into it or the like, the Chayei Adam wrote that since a prohibition has been established, we rule stringently even in a rabbinic matter; and nevertheless, in pressing circumstances where the Shema and prayer would thereby be missed, he may rely on the authorities who hold that even in this we rule leniently in a rabbinic matter. And if such a case happened to him with excrement — namely, that he knows there was excrement here in the house and is in doubt whether they removed it — it appears that it is forbidden to recite and pray until it becomes clear to him, for it is a Torah-level matter.

(כו) אפילו באשפה וכו' - ר"ל לאחר שבדקוה שלא נמצא בה צואה וגם שאין מגיע ממנה ריח רע דאל"ה תיפוק ליה משום אשפה גופא כמש"כ בסימן ע"ט ס"ח:

(26) 'Even in a refuse-heap, etc.' — that is to say, after they examined it and no excrement was found in it, and also that no foul odor reaches him from it; for otherwise it would be derived from the refuse-heap itself, as written in siman 79, se'if 8.

(כז) כנגד העמוד - כתב המ"א בשם הרא"ש דשותת לא חשיב נגד העמוד ושרי מדאורייתא ובהגהות הגר"ח צאנזאר מפקפק בזה עי"ש:

(27) 'Facing the stream' — the Magen Avraham wrote in the name of the Rosh that a trickle is not considered facing the stream and is permitted by Torah law; and in the glosses of the Gaon R' Chaim Tzanzer he casts doubt on this — see there.

(כח) במקום שראוי - דהיינו במקום שמצוי שם קטנים וכיו"ב:

(28) 'In a place where it is reasonable' — namely, in a place where small children are common, and the like.

(כט) ומצאה אח"כ - בתוך ד' אמותיו ואם נמצאת חוץ לד"א בתוך שיעור כמלא עיניו עיין לקמן סימן פ"א ס"ב ובמ"ב שם:

(29) 'And found it afterward' — within his four cubits; and if it was found beyond four cubits, within the range of as far as the eye can see, see below, siman 81, se'if 2, and in the Mishnah Berurah there.

(ל) צריך לחזור - דזבח רשעים תועבה דה"ל לבדוק המקום. ופשוט דה"ה אם לאחר התפלה מצא שהיו בגדיו או מנעליו מטונפין ויודע שנטנפו ע"י שהיה קודם התפלה במקום מטונף כגון בה"כ וכה"ג במקום האשפתות ולא שמר א"ע להיות נקי בצאתו משם דצריך לחזור דפשע ואם ישב בלילה במקום שהיה שם צואת חתול וכיוצא ונדבק בבגדו והתפלל בבהכ"נ ובשובו לביתו מצא שהטינוף דבוק בבגד א"צ לחזור ולקרות ולהתפלל דדמי לאין המקום ראוי להסתפק [שע"ת]:

(30) 'He must go back' — for “the sacrifice of the wicked is an abomination,” since he should have examined the place.
