A handbreadth of exposed skin on a woman, in a place she normally keeps covered — even if she is his own wife — one is forbidden to recite the Shema opposite it. The Rema adds: Some say this applies specifically to one's own wife, but with another woman even less than a handbreadth is considered nakedness (ervah) (Hagahot Maimoni, chapter 3). And it appears from the words of the Rosh that a handbreadth on a woman is nakedness even with respect to another woman, except that she herself may recite even though she is unclothed, as above in siman 74.
The hair of a woman that she normally keeps covered — one is forbidden to recite opposite it. The Rema adds: (even his own wife's hair). But unmarried girls whose custom is to go with their hair uncovered — it is permitted (to recite opposite it). The Rema adds: And likewise the hairs of (married) women that customarily protrude outside their head-covering, (Beit Yosef in the name of the Rashba), and all the more so the hair of a wig, even hair she normally keeps covered (the new glosses on the Alfasi).
One should take care to avoid hearing the singing voice of a woman during the recitation of Shema. The Rema adds: even his own wife's, but a (speaking) voice that one is accustomed to is not considered nakedness (Beit Yosef in the name of the Ohel Mo'ed and the Hagahot Maimoni).
It is forbidden to recite opposite nakedness, even that of a non-Jew, and likewise it is forbidden opposite the nakedness of a child. (Some permit reciting opposite the nakedness of a child so long as he is not yet capable of intercourse — Rabbeinu Yerucham, the Rosh in the chapter 'Mi She-meto,' and the מהר"א of Prague). and this (strict view) is the essential ruling. (See Yoreh De'ah, siman 265).
Nakedness (seen) through a glass lantern, where one sees it through its (transparent) walls — it is forbidden to recite opposite it, for it is written, 'and no nakedness of anything shall be seen in you,' and here it is (in fact) visible.
If nakedness was opposite him and he turned his face away from it, or he closed his eyes, or it was nighttime, or he is blind — he is permitted to recite, for the Torah made it depend on seeing, and here he does not see it.
(1) 'In a place she normally (keeps covered)' — because this brings a person to (forbidden) thoughts when he gazes at it, it is included in (the category of) nakedness, and it is forbidden to recite or to mention any matter of holiness opposite it, just as opposite actual nakedness. And according to what we will explain below in se'if 6 in the name of the later authorities, that opposite actual nakedness it is forbidden even when he closes his eyes, until he turns his face away — the same applies here; though some permit here if he is careful not to look at all. And when it is impossible otherwise, it appears that one may rely on this.
(2) 'She normally keeps covered' — but her face and hands, according to the custom that they are normally exposed in that place, and likewise the soles of the feet up to the leg [that is, up to the place called 'kniya' in the vernacular], in a place where they customarily go barefoot — one may recite opposite them, since, because he is accustomed to them, he does not come to (forbidden) thoughts. But in a place where they are normally covered, their measure is a handbreadth, like the rest of a woman's body; however her arms and lower leg, even if they customarily go exposed in the manner of immodest women, are forbidden.
(3) 'His wife' — and therefore one must take care, when she is nursing and her breast is exposed, not to speak any words of holiness at that time.
(4) 'It is forbidden to recite' — see the Pri Megadim, who brings differing opinions regarding the case after the fact (bedi'avad), whether one must go back and recite again, as with full nakedness. And in the Derech HaChaim it is implied that even after the fact one must go back and recite again. Nevertheless it appears to me that when he did not intend to gaze, one should not be stringent after the fact to go back and recite again, even with another woman.
(5) 'But, etc.' — see the Nishmat Adam, who writes that according to all opinions this is only Rabbinic, and closing the eyes is effective here, and likewise for a woman's hair discussed in se'if 2.
(6) 'With another woman' — whether unmarried or a married woman.
(7) 'Less than a handbreadth' — and if the lower leg is exposed, some say that even with one's own wife, and even less than a handbreadth, it is forbidden to recite opposite her, since it is a place that provokes (forbidden) thoughts more than the other limbs. All of this speaks only to the prohibition of reciting Shema, for according to many decisors the prohibition is to recite opposite the exposed area even when one does not intend to gaze. But regarding the prohibition of gazing, all agree that one who gazes at a woman — even at her little finger — since he gazes at her for pleasure, transgresses the negative command 'do not stray after your eyes,' and they said that even if he has Torah and good deeds to his credit, he will not be spared from the judgment of Gehinnom. But mere incidental seeing, in innocence and without deriving pleasure, is permitted — except on grounds of moral conduct (mussar). And in the work Minchat Shmuel he proves that a distinguished person must be careful in every case. And the Pri Megadim writes that in places that are normally covered [such as her arms, and likewise the other parts of the body], even mere seeing is forbidden. And the decisors write that our unmarried girls are included among menstruants once they reach the age of menstruation, and are included among the forbidden relations (arayot).
(8) 'From the words of the Rosh, etc.' — but the Rashba disagrees with this; his reasoning is that just as she herself may recite when she is unclothed, which shows that the exposure of her whole body is not subject to 'and no nakedness shall be seen in you' except for men, and because of (forbidden) thoughts — so too another woman too is permitted to recite and pray opposite her when she is unclothed. And the later authorities agree with the Rashba, and hold that even the Rosh concedes this. Know further that according to all, it is permitted to recite opposite her when she is unclothed only when she is sitting, so that her lower front is not visible; but when she is standing, her law is like that of a man's nakedness, and it is forbidden even in a different domain.
(9) 'Of a woman' — but a man's hair, even (pubic) hair of the nakedness that protrudes through a hole in his garment — one may recite opposite it, but if the (scrotal) sac is visible, it is nakedness.
(10) 'That she normally keeps covered' — even if she normally covers it only in the marketplace and not in the house and courtyard, it is nevertheless included in nakedness according to all, even in the house, and it is forbidden to recite there opposite her if a little of it becomes exposed. Know further that even if the custom of this woman and her companions in that place is to go with uncovered head in the marketplace, in the manner of immodest women, it is forbidden, just as with the exposure of her lower leg, which is forbidden in every case, as above in se'if katan 2, since they are required by law to cover their hair [and there is a Torah prohibition in this, for it is written 'and he shall uncover the woman's head,' which implies that it is (normally) covered]. And also all daughters of Israel who hold fast to the law of Moses have been careful about this from the days of our forefathers, always and until now; it is included in nakedness, and it is forbidden to recite opposite them. The exclusion applies only to unmarried girls, who are permitted to go with uncovered head, or, for instance, to hair that protrudes outside her head-covering, for this depends on the custom of the places: if the custom of the daughters of Israel in that place is to be careful that not even the tiniest bit protrudes outside her head-wrappings, then it is automatically included in nakedness, and it is forbidden to recite opposite them, and one cannot say it is permitted on the grounds that, since one is accustomed to it, there is no (forbidden) thought, as (explained) further on.
(11) 'Unmarried girls' — but betrothed unmarried girls are forbidden to go with uncovered head, and likewise unmarried girls who have had relations must cover the head. Nevertheless, if she acted licentiously and does not wish to go out with a veil on her head in the manner of (married) women, one cannot compel her.
(12) 'Whose custom, etc.' — see the Magen Avraham, who writes that they should go with uncovered head only if their hair is braided and not loose; but the Machatzit HaShekel and the Magen Giborim are lenient in this. The Chayei Adam writes: non-Jewish women, who are not commanded to cover their hair — it requires examination whether their law in this matter is like that of unmarried girls.
(13) 'That customarily (protrude), etc.' — that is to say, one may recite in this case even opposite another woman, since, because one is accustomed to it, there is no (forbidden) thought; but to intentionally gaze at another woman, even at the hairs outside her head-covering, is forbidden (Eliyah Rabbah).
(14) 'To protrude, etc.' — that is to say, apart from the cap on her head she has a 'tzamet' — a cloth that constrains the hair so it does not go out — and the small amount that cannot be constrained and protrudes from the tzamet, concerning this the Rashba is lenient (Chatam Sofer, siman 36, see there). But in the Zohar, Parashat Naso, he was very stringent that not a single hair of a woman should be visible, for it brings danger upon the household and causes her children not to be esteemed in their generation, and causes the 'other side' (sitra achra) to dwell in the house. And all the more so if they go about the marketplace like this. Therefore a woman should see to it that even the beams of her house not behold a single hair of her head; and if she does so, what is written? 'Your children shall be like olive shoots' — just as an olive, etc. — her children will be exalted in distinction above the rest of the world's people; and moreover her husband is blessed with all the blessings from above and the blessings from below, with wealth, with children, and with children's children (end of his words, in brief). And the Magen Avraham writes that it is fitting to conduct oneself in accordance with the Zohar. And in (tractate) Yoma it is related, in the account of Kimchit, that in the merit of the exceptional modesty she had — that the beams of her house never saw the hair of her undergarment — High Priests came forth from her.
(15) 'Wig hair' — he calls 'nochrit' the hair that has been cut off and is no longer attached to her flesh, and he holds that concerning this our Sages did not say 'a woman's hair is nakedness,' and it is also permitted to uncover it, and there is no issue of 'uncovering the head' in it. But some disagree and say that even with a wig, 'a woman's hair is nakedness' applies, and the prohibition of uncovering the head. And the Pri Megadim writes that in lands where women go out with a wig uncovered, they have on whom to rely — the Shulchan Aruch — and it is implied from him there that even her own hair which was cut off and then reattached to her head — one may likewise be lenient. But in the work Magen Giborim he was stringent in this, see there. And he further writes there that if it is not the custom of the place for women to go about in a wig, the law is certainly with those who are stringent in this, because of appearance's sake (mar'it ayin), see there.
(16) 'One should take care, etc.' — and after the fact, if he recited, he goes back and recites again without the blessings; see the Bi'ur of the Vilna Gaon and the Pri Megadim.
(17) 'A woman's singing' — even that of an unmarried woman. But when it is not during the recitation of Shema it is permitted, provided he does not intend to derive pleasure from it, so that he not come to (forbidden) thoughts. But the singing of a married woman, and likewise all forbidden relations, is always forbidden to hear; and likewise an unmarried woman who is a menstruant is among the forbidden relations, and our unmarried girls are all presumed to be menstruants once the time of menstruation reaches them. And the singing voice of an unmarried non-Jewish woman is likewise included in nakedness, and it is forbidden to hear, whether for a priest or an Israelite. Nevertheless, if he is traveling among non-Jews, or in a city, and he is compelled, unable to protest, since we do not find that this is called nakedness by Torah law, he is permitted to recite and to bless; for otherwise, since we dwell among non-Jews, we would be prevented from Torah and prayer, and about this it is said, 'It is a time to act for the Lord; they have voided Your Torah.' But he should strengthen his heart to focus on the holy matter he is engaged in, and not turn his heart to the sound of the singing.
(18) 'That one is accustomed to' — that is to say, since he is accustomed to it, he will not come to (forbidden) thoughts; and this is so even with a married woman. Even so, it is forbidden to intend to derive pleasure from her speech, for even at her garments it is forbidden to gaze for pleasure.
(19) 'Opposite nakedness' — for it is written, 'For the Lord your God walks in the midst of your camp... therefore your camp shall be holy, and no nakedness of anything shall be seen in you, etc.' From here the Sages learned that in every situation where the Lord our God walks with us — that is, when we are engaged in Shema, prayer, or words of Torah — one must take care that the Lord not see in us any nakedness of a matter, that is, that there be no nakedness opposite the face of the person reciting or praying, within the full range of his sight, as is proven in siman 79, se'if 2. And likewise that he not be unclothed at that time, whereby his own nakedness becomes visible — this too is included in this verse.
(20) 'Of a non-Jew' — even though it is said of them 'whose flesh is the flesh of donkeys,' one might think they are considered merely like an animal — therefore it teaches us (that this is not so).
(21) 'The nakedness of a child' — see the Beit Yosef, that he was concerned for the view of the stringent authorities only initially (le-chatchilah), but after the fact, if he recited, he does not go back and recite again.
(22) 'And some permit' — and a child himself may recite when he is unclothed, up to nine years old; and opposite the nakedness of an adult male it is permitted (for the child to recite) only until he reaches the age of education (chinuch). And see the Magen Avraham, and see siman 343.
(23) 'Of intercourse' — that is, for a male child up to nine years old, and for a female child up to three years old.
(24) 'And this is the essential ruling' — the Magen Avraham writes: nevertheless the circumciser should not hold the (infant's) member in his hand during the blessing, though the Eliyah Rabbah and the Machatzit HaShekel are lenient. And the Pri Megadim writes that nowadays, when they are not so expert, there is cause to be concerned for danger, and one should hold it in his hand. And the Vilna Gaon too, in Yoreh De'ah siman 265, ruled that it is forbidden to act as the Magen Avraham (says).
(25) 'Through a glass lantern' — it is (a lantern) of glass, or a thin translucent cloth, through which the nakedness is visible, or a handbreadth of a woman's flesh in a place that is normally covered, for this too is called nakedness, as above in se'if 1. And closing the eyes is permitted in all of this according to all, since the nakedness is at any rate covered (Chayei Adam; and so too the Pri Megadim wrote regarding a glass lantern).
(26) 'It is forbidden to recite' — even if she is in another house and he sees her through the glass in the window, since the verse made it depend on seeing; and even after the fact one must go back and recite again.
(27) 'Nakedness opposite him' — see the Pri Megadim and the other later authorities, that when he himself is unclothed, it is possible that even according to the Shulchan Aruch none of these remedies is effective.
(28) 'And he turned his face away' — that is to say, even turning the face alone without (turning) his body, for this is no worse than closing the eyes, which is permitted for him; and see shortly (in the next note).

(29) 'Or he closed (his eyes), etc.' — the later authorities agreed that all these remedies, apart from turning the face away, are not effective, for it is not written 'you shall not see,' but rather 'it shall not be seen,' that is to say, the viewer shall not see. And even turning the face away, which is permitted, is only when he turned his whole body and stands to the other side, so that the nakedness is to his side; but if he turned his face alone, it is not effective. And thus, when he himself is unclothed, no remedy can be conceived that would permit him to speak words of Torah. And the Mishbetzot Zahav writes that if he is in one domain and an unclothed person is in another domain opposite him, and he closes his eyes from seeing him, it may be said that this is permitted according to all. And so it is somewhat implied in the Derech HaChaim; but in siman 79, note 8, in the Eshel Avraham, it is implied that he retracted from this, and likewise in the Chayei Adam, klal 4, note 9, it is not implied so. However, if a glass window separates between him and the nakedness, and he closes his eyes from seeing it, it is effective according to all, since there is at any rate some partition that covers off the nakedness. It is permitted to think about words of Torah when he is unclothed, and needless to say opposite another's nakedness, for it is said 'nakedness of a matter (davar)' — speech (dibbur) is forbidden, but thought is permitted. Nevertheless he should not, at that time, hear a blessing from his fellow in order to fulfill his obligation, for one cannot apply 'one who hears is as one who recites,' since he is unable to respond (Acharonim).

(30) 'That it depends on seeing' — that is to say, even though it is near him, within his four cubits — for regarding excrement we hold in siman 79 that it is forbidden even if it is behind him — in this case (of nakedness) the verse revealed that it depends only on seeing. And the practical difference in all this, even for us who are stringent about closing the eyes, as above, is that nevertheless, if he turned his face and body away from the nakedness, it is effective according to all, even when it is near him.
