If there are people who each prayed on his own, individually, and did not hear either Kaddish or Kedushah, one of them stands and recites Kaddish, Barchu, and the first blessing, Yotzer Or, and no more. This is called poreis al Shema (spreading out over the Shema), an expression of cutting a slice, since one recites only a portion of it. The Rema adds: Nowadays the custom is not to recite the entire blessing of Yotzer Or, but rather one recites Kaddish and Barchu, and they answer after him, 'Baruch Hashem...' and so on. Some say that one performs poreis al Shema at the evening Shema just as in the morning [Kol Bo, and the Beit Yosef in the name of the Ran], but the custom is not so, because there is no Kaddish before Barchu of the evening service. And after they finish the blessing of Yotzer Or, he recites Avot, Gevurot, Kedushah, and Atah Kadosh; this is called 'passing before the ark' (leading the prayer). These things are not done with fewer than ten, since they are matters of sanctity (devarim shebikedushah), and one must seek out six who have not heard, that is, the majority of the ten. And if they are not to be found, they recite it even for the sake of one who has not heard. Even one who has already heard may perform poreis al Shema and lead the prayer for the sake of that one who has not heard; but nevertheless, if that one who has not heard is competent to perform poreis al Shema and lead the prayer, it is better that he himself perform poreis and lead, than that one who has already heard should perform poreis and lead. The Rema adds: One who leads the prayer and has recited the first three blessings should complete the entire Amidah and not interrupt, even though he has already prayed; but the others may stop afterward. And all the more so, if the one who performs poreis and leads had not prayed beforehand, he should complete his prayer, even though he will then need to recite the Shema afterward and will not juxtapose Geulah to the Amidah [Beit Yosef in the name of the Mahari"a]. It is forbidden to interrupt for these matters between Geulah and the Amidah, or during the Shema and its blessings; and therefore the chazzan may not interrupt between the Shema and the Amidah, or during the Shema and its blessings, in order to perform poreis al Shema for those who come to the synagogue after the congregation has prayed, [reciting] Kaddish and Barchu, once he has already begun the blessing of Yotzer Or. But in the evening blessing, which is optional, he may interrupt in order to discharge others' obligation. And nevertheless, another man may perform poreis al Shema, or pray the entire prayer with ten, even in that same synagogue where they have already prayed, to discharge others' obligation, only that the second chazzan should not stand in the place where the first stood, for this appears as a disgrace to the first group, as though they had not fulfilled their obligation the first time [Responsum of Mahari Mintz, siman 15]. And it seems to me that this is only while the first group is still in the synagogue, having merely finished their order of prayer; but if the first group has left, the chazzan may stand even in the place where the first stood.
A blind person, even though he has never seen the luminaries in his life, may perform poreis al Shema and recite the blessing 'Who forms the luminaries,' for he too benefits from the luminaries that others see, in that they show him the way on which he should walk.
(1) 'Each one' - The Radbaz, in responsum siman 241, part 4, disagrees with this, and these are his words: If ten prayed, each one individually, the obligation of Kaddish and Kedushah has flown away from them, as we say regarding the Grace after Meals [further on in siman 194, se'if 1]; and since it has flown away from them, even though ten later joined together, they cannot go back and pray with Kaddish and Kedushah; and if they went back and did so, it would be a blessing in vain; see there. His words are cited in brief in the Magen Avraham, and the Magen Giborim and the Chayei Adam cite his words as the halacha. But in the responsum of הרמ"ע, siman 84, and in the Derech HaChaim in the laws of Barchu, letter 3, it is implied that they rule like the Shulchan Aruch; yet in the responsum of the Chatam Sofer, Orach Chaim section, siman 17, he writes that the common practice accords with the Radbaz. Yet even according to the Radbaz, if there is one among them who has not yet prayed, he may perform poreis al Shema and also lead the prayer, but he should not first pray the Amidah silently; rather he should pray the Amidah aloud right away, for in such a case the notion that the obligation of prayer has flown away does not apply, since he is reciting it for himself. And so wrote the Magen Giborim in siman 124. And likewise, one of those who have already fulfilled their obligation may perform poreis al Shema and lead the prayer for his sake, as [stated] further on in the Shulchan Aruch, since there is at least one who has not yet fulfilled the obligation of prayer, for all Israel are responsible for one another [the Radbaz there].
(2) 'And recites Kaddish' - See above in siman 54, in the Rema's gloss, that one must first recite some verses.
(3) 'Yotzer Or' - Even though in our times everyone is knowledgeable and does not need the blessing of the one who blesses to discharge their obligation through the blessing, and all the more so according to what the Mechaber is discussing, where they have all already recited the blessing, each on his own, nevertheless the Mechaber holds that he recites Yotzer Or, so that they should not appear as deniers, God forbid, since he tells them to bless and there is none among them who blesses. Therefore he recites Yotzer Or, aloud, and the others listen, and one who listens is as one who recites.
(4) 'Nowadays,' etc. - We hold that since they answer, 'Blessed is Hashem, the blessed One, forever and ever,' he no longer appears as a denier, just as is the case with the blessing over the Torah. And see the Eliyah Rabbah and the Magen Giborim, who likewise concurred with this.
(5) 'Just as in the morning' - That is to say, even if they have all already prayed, each one on his own.
(6) 'But the custom is not so' - The Pri Megadim writes: it seems certain that if there is one who has not yet prayed Maariv, he may stand before the amud (prayer lectern) together with the nine who have prayed, and recite Barchu aloud, and also recite the first blessing aloud, and he fulfills his obligation even according to the Mechaber; and it is possible that he may also recite the Kaddish that precedes the Shemoneh Esrei; end of his words.
(7) 'That there is no Kaddish' - And for the sake of Barchu alone we are not so particular. And even though in some places they recite three verses and Kaddish before Barchu in the evening, this is merely a custom, and we are not particular about this Kaddish, unlike the Kaddish after Yishtabach in the morning, which is a custom of the early ones, about which we are more particular.
(8) 'And Kedushah,' etc. - See the Rema's gloss nearby, that he completes the entire Amidah as well; and see above in se'if katan 1, that the opinion of the Radbaz is that one should not apply the law of leading the prayer unless there is among them at least one who has not yet prayed. And the Magen Avraham writes: however, it seems to me that if there are not six there who have not prayed, the chazzan should not pray silently, but should begin immediately aloud, for the main purpose of the repetition in this case is only for the sake of Kedushah, and he recites the first three [blessings] aloud and the rest silently; but when there is a majority of a minyan, they are like a full congregation. And see the Biur Halacha.
(9) 'Is called passing [before the ark],' etc. - And this is not common nowadays, because it is customary to perform poreis al Shema for those who come late, after the conclusion of the silent Shemoneh Esrei, before the chazzan begins the prayer aloud, and through him they fulfill the matter of Kedushah. [And one must be careful, when they gather at the entrance of the synagogue to perform poreis al Shema, that they not pass in front of those who are praying.] But if it happened that someone was delayed and came to pray after the prayer, he may perform poreis al Shema and lead the prayer.
(10) 'Who has not heard' - And if he heard from those called up to the Torah, that suffices, and they do not repeat it for his sake, unless he is now standing before the blessing of Yotzer Or, in which case it is permitted to perform poreis for his sake, as we wrote at the beginning of the siman; see there.
(11) 'It is better that he perform poreis' - Nowadays the custom is that the mourners always perform poreis al Shema, even if they have heard and there is another who has not heard, and this is not correct; so wrote the Magen Avraham. But the Pri Megadim justified the custom, since there is no time to seek out a knowledgeable person during the silent Shemoneh Esrei; but certainly, if there is time and there is one who knows and has not prayed, it is fitting that he perform poreis.
(12) 'May stop' - And go on their way, for the main point was only for the sake of Kedushah.
(13) 'That he should complete his prayer' - That is to say, all the more so he should not interrupt in this, since the prayer is needed by him, for himself, to fulfill through it his obligation of prayer, even though thereby he will afterward need to recite only the Shema, and will not juxtapose Geulah to the Amidah. And accordingly, a person who was delayed in coming to the synagogue and did not hear Barchu and Kedushah, and is concerned that there may not later be a minyan in the synagogue when he reaches the Amidah, may perform poreis and lead the prayer, praying all eighteen blessings, so that he will be able to say Kedushah, and afterward he will recite the Shema and its blessings and not pray again. But the Magen Avraham writes that ideally it is not proper to do so, nullifying the mitzvah of juxtaposing Geulah to the Amidah for the sake of Kedushah; rather he should pray in order and juxtapose Geulah to the Amidah, and if there are then ten in the synagogue, he says Kedushah. And see the Biur Halacha.
(14) 'And has begun' - But if he has not yet begun, he goes back and recites Barchu for those who came to the synagogue.
(15) 'May stop' - That is to say, between Geulah and the Amidah, namely after the conclusion of the blessing of Hashkiveinu; and in any case one interrupts there with verses as well, but in the middle of the blessings he should not interrupt.
(16) 'The first group has left' - And likewise, if it is an established arrangement that they pray in this synagogue several times, one after another, there is no objection [Magen Giborim and ש"א].
(17) 'Where [the first] stood,' etc. - Moreover, if the later group has no chazzan, even the first chazzan may pray a second time to discharge the obligation of the later group as well [the Levush and the Magen Avraham]; and it is obvious that in this case the chazzan need not stand before the ark for the entire duration of the prayer, but rather, when they reach Barchu, he recites Kaddish and Barchu before them, and afterward they recite by themselves from Yotzer Or onward until the completion of the silent Shemoneh Esrei, for in our places all are knowledgeable and it is not customary to fulfill this obligation through the chazzan; and afterward he stands before the ark to repeat the prayer as customary, with all the Kaddishim that follow the prayer.
(18) 'The first' - The Mishpetei Shmuel writes that if the first group took out a Torah scroll and read from it, it is not the custom for the second group to take out a Torah scroll another time and read from it. And he gave a reason for this, that it is on account of a slight to the Torah scroll: lest people say that they found a disqualification in the first scroll, and for that reason took out a second; and even if it is this very same scroll, people might still say of the first group that it is a different one that they took out because of a disqualification they found in the first; and also that there is a slight to the first group, in that people would say they did not fulfill the obligation of the reading. And for this reason, if the first group went home, like the vatikin (those who pray early), or it is a place with an established arrangement to pray several times one after another, there is no objection. And all this is by force of custom, but by strict law there is no prohibition whatsoever in any case, for there is no concern for a slight to the first reading except when the one who goes up to read in the second was one who had already gone up in the first, and also only when he goes up and reads immediately one after the other, without another person interrupting in between, as will be explained in siman 144; but here, where they interrupt a great deal and it is also a different congregation, there is no concern about this at all [Magen Giborim].
(19) 'Performs poreis' - And he may also lead the prayer, as above in siman 53, se'if 14; see there and in the Mishnah Berurah. One should prevent a minor from performing poreis al Shema; however, once one has reached thirteen years, one is not particular as to whether he has grown two hairs (signs of maturity), since the blessings of the Shema are rabbinic [Pri Megadim].
