אאומרים בקדיש וא"א אותו בפחות מי' גזכרים בני חורין דגדולים שהביאו ב' שערות הוה"ה לקדושה וברכו שאין נאמרין בפחות מעשרה:

We say Kaddish, and we do not say it, with fewer than ten (a minyan) free adult males who have grown two (pubic) hairs; and the same law applies to Kedushah and to Barchu, that they are not recited with fewer than ten.

ואם התחיל זלומר קדיש חאו קדושה בעשר' ויצאו מקצתן גומרים טאותו הקדיש או אותה יהקדושה שהתחיל והוא שנשתיירו יארובן: הגה ומ"מ עיבבירה הוא לצאת ועליה' נאמר ועוזבי ה' יכלו [ירושלמי] איגבל אם נשארו י' מידותר לצאת [מרדכי פ' בתרא דמגילה]:

If one began to say Kaddish or Kedushah with ten, and some of them left, he finishes that Kaddish or that Kedushah which he began — provided that the majority remained. The Rema adds: Even so, it is a transgression to leave, and of them the verse says, 'and those who forsake Hashem shall be consumed.' [Yerushalmi] But if ten remain, one is permitted to leave. [Mordechai, last chapter of Megillah]

If he began with Avos (the first blessing of Shemoneh Esrei), and some left, he finishes even Kedushah. The Rema adds: If some left after they had begun to pray Yotzer (the morning blessings around Shema), the chazzan should not begin to pray the repetition aloud, since the Yotzer prayer is already complete. But if they left after he had already begun aloud, and Kedushah — they may complete the entire order of Kedushah and say the full Kaddish that follows it, for it belongs to the prayer, since he says, 'May their prayers be accepted,' etc.; but they do not read from the Torah, for that is a separate matter; and the evening prayer, with the Kaddish after it, does not belong to Shema and its blessings. Some permit saying a matter of holiness with nine, combining a minor who is more than six years old and knows to Whom we pray; but their words do not seem correct to the great authorities. And the same law applies that a slave and a woman do not combine (for the minyan). The Rema adds: And even by means of a Chumash in his hand one may not combine him; however, some are accustomed to be lenient in a time of pressing need. [The Rosh, Mordechai, and Hagahos Maimoni, chapter 9 of the Laws of Prayer]

If one has not grown two hairs, even though he is old in years, his status is that of a minor, until the majority of his years have passed, for then it becomes clear that he is a saris (one sexually undeveloped), if the signs of a saris appeared on him beforehand; (but if not,) his status is that of an adult. The Rema adds: However, we are not exacting about the hairs; rather, whoever has reached the age of adulthood, we presume to be an adult, and we say, regarding this matter, that he presumably grew two hairs. ואם התחיל לבאחד מעשרה להתפלל לבדו ואינו יכול לענות עמה' לגאו שהוא ישן אפ"ה לדמצטרף עמה':

And if one of the ten began to pray by himself, and cannot answer together with them, or is asleep, even so he combines with them (for the minyan).

כשאחד מתפלל לבדו להנכון שהאחרים ימתינו מלומר קדיש לועד שיגמור לזכדי שיזכה גם הוא:

When one is praying by himself, it is proper that the others wait to say Kaddish until he finishes, so that he too may merit (to answer with them).

לחחרש המדבר ואינו שומע או שומע ואינו מדבר הן כפקחין ומצטרפים אבל מי שאינו שומע ואינו מדבר הרי הוא כשוטה וקטן:

A deaf-mute who speaks but does not hear, or hears but does not speak, is like a mentally competent person and they combine; but one who neither hears nor speaks is like a mentally incapacitated person and a minor.

לעולם הוא קטן עד שיביא לטב' שערות מאחר שיהיה מאבן י"ג מבויום אחד ושנת העיבור בת י"ג חדש:

One is always a minor until he grows two hairs, after he has become thirteen years and one day old; and the year of a leap year is a full thirteen months (i.e. the extra month is included).

If one boy was born on the 29th of Adar Rishon (first Adar) of a leap year, and another boy was born in Adar Sheni (second Adar), on the first of it, and the thirteenth year is not a leap year: the one born on the 29th of Adar Rishon must wait until the 29th of Adar in the thirteenth year to become thirteen years old; and the one born after him, on the first of Adar Sheni, will be thirteen years old once the first of Adar of the thirteenth year arrives. The Rema adds: And one who was born in Adar and reaches bar mitzvah in a leap year does not become bar mitzvah until Adar Sheni. [Responsa of Mahar"i Mintz, siman 9]

עבריין שעבר על גזירת הצבור מואו שעבר עבירה אם מזלא נידוהו נמנה למנין עשרה:

A transgressor who violated a decree of the community, or who committed a sin, if they did not place him under a ban, is counted for the tally of ten.

מנודה אין מצרפין אותו לכל דבר שצריך י' אבל מותר להתפלל בב"ה שהוא שם אלא אם כן פירשו להחמיר עליו בכך:

One under a ban of excommunication — we do not combine him for anything that requires ten; but he is permitted to pray in the synagogue where he is present, unless they expressly specified to be stringent with him in this.

צריך שיהיו מחכל העשרה במקום מטאחד וש"ץ עמהם והעומד בתוך הפתח מן האגף ולחוץ דהיינו כשסוגר הדלת במקום נ[שפה] פנימית נאשל עובי הדלת ולחוץ כלחוץ:

All ten must be in one place, with the chazzan among them. And one who stands within the doorway, from the doorstop outward — that is, at the place where the door closes, from the inner edge of the door's thickness outward — is considered as outside.

מי שעומד אחורי בית הכנסת וביניהם חלון אפי' גבוה כמה קומות אפילו אינו רוחב ארבע ומראה להם פניו משם נבמצטרף עמהם לעשרה: הגה גנגגין ועליות אינן בכלל בית והעומד עליהם אינו מצטרף [ר"י נ"ג ח"ז]:

One who stands behind the synagogue with a window between them, even (up) many stories high, even if it is not four wide, and he shows them his face through it, combines with them for the ten. The Rema adds: Roofs and upper stories are not included in 'the house,' and one standing on them does not combine. [Rabbeinu Yerucham, nesiv 3, chelek 7]

אם מקצתן בפנים ומקצתן בחוץ וש"ץ תוך הפתח נדהוא מצרפן:

If some are inside and some are outside, and the chazzan is within the doorway, he joins them together.

A small courtyard that was breached along its full (shared) side into a large one — that is, the small one was breached at its point of connection to the large one, and that whole wall which separated them fell, and in the large one there remained, from the remnant of this fallen wall, short piers (pasim) [meaning: a bit of straight, even wall] from here and from there — the large one is like something set apart from the small one, and the small one is not set apart from the large one, but is rather like a corner of it. Therefore, if nine are in the large one and one in the small one, they combine, for the small one is drawn after the large one, and it is as if it were inside the large one, since the majority are in the large one. But if there were nine in the small one and one in the large one, or five in this one and five in that one, they do not combine.

היה ש"ץ בקטנה וצבור בגדולה מוציאן ידי חובתן שהוא נגרר אחריהם אבל אם היה ש"ץ בגדולה וצבור בקטנה נואינו מוציאן ידי חובתן שאין הרוב נגרר אחר היחיד:

If the chazzan was in the small courtyard and the congregation in the large one, he fulfills their obligation for them, for he is drawn after them; but if the chazzan was in the large one and the congregation in the small one, he does not fulfill their obligation, for the majority are not drawn after the individual.

אם קצת העשר' בב"ה נזוקצתם בעזרה נחאינם מצטרפין:

If some of the ten are in the synagogue and some in the (adjoining) courtyard, they do not combine.

נטש"ץ בתיבה וט' בב"ה מצטרפין אע"פ שהיא גבוה י' ורחבה ד' ויש לה מחיצות גבוהות י' מפני שהיא בטלה לגבי ב"ה ויש מי שכת' דה"מ כשאין המחיצו' מגיעות לתקרת הגג:

A chazzan on the platform (bimah) and nine in the synagogue combine, even though it is ten (tefachim) high and four wide and has partitions ten high, because it is nullified relative to the synagogue. But there is one who wrote that this applies only when the partitions do not reach the ceiling of the roof.

היו עשרה במקום אחד ואומרים קדיש וקדושה אפי' מי סשאינו עמהם סאיכול לענות סבוי"א שצריך סגשלא יהא מפסיק סדטינוף או סהעכו"ם:

If there were ten in one place and they are saying Kaddish and Kedushah, even one who is not among them may answer. And some say that it is required that there not intervene (between them) filth or an idolater.

עיר שאין בה אלא עשרה ואחד מהם רוצה לצאת בימים הנוראים כופין אותו לישאר או להשכיר אחר סובמקומו ואם הם סזי"א ורוצים לצאת שנים ישכירו שניהם אחד בשותפות במקומן ושניהם יפרעו בשוה ואם אחד עני ואחד עשיר פורעין סחחציו לפי ממון וחציו לפי נפשות ושכר החזן סטעל היוצאים כעל הנשארים. הגה [ואין חילוק בין אם רוצה לילך זמן ארוך קודם י"ט או לא כל שלא יחזור ביום טוב מהרי"ל סימן תכ"ז]:

A city that has only ten (men), and one of them wishes to leave on the Days of Awe (Rosh Hashanah and Yom Kippur), we compel him to remain or to hire another in his place. And if they are eleven and two wish to leave, both shall hire one man jointly in their place, and both pay equally. And if one is poor and one is wealthy, they pay half according to wealth and half according to persons (per capita). And the wage of the chazzan falls on those leaving just as on those remaining. The Rema adds: And there is no difference whether he wishes to go a long time before the festival or not, as long as he does not return by the festival. [Maharil, siman 427]

אין כופין להשכיר להשלים מנין כי אם עבימים הנוראים וכגון שאין חסרים כי אם אחד או שנים אא"כ מנהג קבוע ומפורסם בעיר לכוף להשכיר אפי' בחסרון ג' או ד' אם יש מנין עאמיושבי העיר כופין עבלשכור חזן: הגה וכן במקום שאין מנין תמיד בב"ה כופין זה את זה בקנסות שיבואו תמיד מנין לב"ה שלא יתבטל העגתמיד [תשובת ריב"ש סי' תקי"ח] וע"ל ריש סי' ק"ן אם כופין זה את זה לבנות בהכ"נ:

We do not compel one to hire (a man) to complete a minyan except on the Days of Awe, and (even then) only when they are lacking but one or two; unless there is a fixed and well-known custom in the city to compel hiring even when three or four are lacking. If there is a minyan from the residents of the city, we compel them to hire a chazzan. The Rema adds: And likewise in a place where there is not always a minyan in the synagogue, they compel one another with fines that a minyan always come to the synagogue, so that the daily (communal service) not cease. [Responsa of the Rivash, siman 518] And see later, the beginning of siman 150, whether they compel one another to build a synagogue.

משנה ברורה

(א) אומרים וכו' - כאשר טוב למעט בברכות כך טוב למעט בקדישים ועיין באחרונים שקראו תגר ע"ז שנאספים עשרה ב"א ואומרים כמה קדישים על פסוקי תורה או משנה או גמרא. עשרה יהודים לועזים שאין מי שיודע בלשון הקודש להוציא אותם י"ח יוכל אחד מהם להיות ש"ץ ולומר קדיש וקדושה בלשון לע"ז:

(1) On the words 'We say, etc.': Just as it is good to minimize in blessings, so it is good to minimize in Kaddishes; and see in the later authorities who protested against this — that ten people gather and say many Kaddishes over verses of Torah, or Mishnah, or Gemara. Ten foreign-speaking Jews among whom none knows the Holy Tongue to discharge their obligation — one of them may serve as chazzan and say Kaddish and Kedushah in the foreign language.

(ב) קדיש - פי' אחר פסוקי דזמרה ובעינן עשרה שכל דבר שבקדושה כגון קדיש וקדושה וברכו וקה"ת ונשיאת כפים אין אומרים אותו בפחות מעשרה שנא' ונקדשתי בתוך בני ישראל וילפינן בגז"ש דתוך תוך ממרגלים דכתיב עד מתי לעדה הרעה הזאת יצאו יהושע וכלב נשאר עשרה וקוראין עדה. וכל הקדישים שוין לזה אפילו קדיש דרבנן שאחר הלימוד. כתב הט"ז דבעת אמירת פסוקי דזמרה א"צ עשרה דאפילו אם אמרוהו ביחידות כל שיש עשרה בשעת אמירת הקדיש די בכך וכן אם התחילו להתפלל ערבית ביחידות ובאו עשרה לעת אמירת הקדיש יכול לומר הקדיש וכן בכל לימוד שאדם לומר פסוקים או אגדה או באמירת עלינו או באמירת אשרי שקודם מנחה או באמירת תהלים בבקר אם היה בלי מנין ונזדמן תיכף מנין שיש לומר קדיש ומ"א בסימן ס"ט ורל"ד לא כ"כ וכן מהגר"א בסימן רל"ד מוכח כהמ"א ע"כ הסכימו האחרונים [הפמ"ג ודה"ח וש"פ] דהנכון שיאמרו אח"כ מזמור או ג' פסוקים ויאמרו קדיש. ועיין בפמ"ג במ"ז אות ג' דמוכח מיניה דלענין פסוקי דזמרה ולענין תפלת ערבית גם המ"א מודה להט"ז:

(2) On the word 'Kaddish': That is, the Kaddish said after Pesukei DeZimra. And we require ten, for any matter of holiness — such as Kaddish, Kedushah, Barchu, the reading of the Torah, and the priestly blessing — is not said with fewer than ten, as it says, 'And I shall be sanctified among the Children of Israel,' and we derive it by a gezeirah shavah (verbal analogy) of 'among'–'among' from the spies, as it is written, 'How long shall this evil congregation...' — for once Yehoshua and Calev departed, ten remained, and they are called a 'congregation.' And all the Kaddishes are equal in this, even the Rabbinic Kaddish said after study. The Taz wrote that at the time of saying Pesukei DeZimra one does not need ten, for even if they said it individually, as long as there are ten at the time of saying the Kaddish, that suffices; and likewise if they began to pray Maariv individually and ten came by the time of the Kaddish, he may say the Kaddish; and likewise in any study where a person says verses or Aggadah, or when saying Aleinu, or Ashrei before Minchah, or Tehillim in the morning, if it was without a minyan and a minyan then chanced to arrive when a Kaddish is to be said. But the Magen Avraham, in simanim 69 and 234, did not write so, and likewise from the Vilna Gaon in siman 234 it is proven like the Magen Avraham. Therefore the later authorities agreed [the Pri Megadim, the Derech HaChaim, and other authorities] that the proper course is to afterward say a psalm or three verses and then say Kaddish. And see the Pri Megadim in the Mishbetzos Zahav, os 3, from which it is proven that regarding Pesukei DeZimra and the evening prayer, even the Magen Avraham concedes to the Taz.

(ג) זכרים וכו' - לאפוקי נשים ועבדים וקטנים וה"ה טומטום ואנדרוגינוס וחצי עבד וחצי בן חורין אינו מצטרף [פמ"ג]:

(3) On the words 'males, etc.': This excludes women, slaves, and minors. And the same applies to a tumtum, an androgynos, and one who is half-slave and half-free — he does not combine. [Pri Megadim]

(ד) גדולים - עיין פר"ח סימן ס"ט שקרא ערער על המקומות שנוהגין שהקטן אומר קדיש וברכו והקהל עונים אחריו דשלא כדין הם עושים ואפילו אם יש עשרה אנשים גדולים חוץ ממנו ועיין בפמ"ג שם שמצדד ג"כ להחמיר בזה לכתחלה. כתב בהלק"ט סי' מ"ח כששנים או ג' אומרים קדיש יחד ואחד מקדים אם באים כל אחד תוך כדי דיבור יענה עם הראשון או עם האחרון אמן ויעלה לכולם ואם יש הפסק יענה על כל אחד ואחד. אדם הנוצר ע"י ספר יצירה אם מצטרף ליו"ד ולכל דבר שבקדושה עיין בתשובת חכם צבי סי' ס"ג ובספר עיקרי דינים מה שכתב בענין זה:

(4) On the word 'adults': See the Pri Chadash, siman 69, who protested against the places where the custom is that a minor says Kaddish and Barchu and the congregation answers after him, that they act improperly — and this even if there are ten adult men besides him. And see the Pri Megadim there, who also inclines to be stringent in this initially. The Halachos Ketanos, siman 48, wrote: when two or three say Kaddish together and one precedes, if each comes within 'toch kedei dibbur' (a short span of speech), he answers Amen with the first or with the last, and it counts for all of them; but if there is an interruption, he answers for each and every one. As to whether a person created by means of the Sefer Yetzirah combines for the ten and for any matter of holiness, see the Responsa of the Chacham Tzvi, siman 63, and the Sefer Ikarei Dinim, what he wrote on this matter.

(ה) וה"ה לקדושה - וה"ה לכל חזרת הש"ץ שצריך עשרה דמקרי דבר שבקדושה מפני הקדושה שיש בה [מגילה כ"ג והר"ן שם] אין פוחתין משבעה קדישים בכל יום כנגד שבע ביום הללתיך דהיינו א' אחר פסוקי דזמרה שהוא אחר ישתבח וב' חצי קדיש אחר תפלת י"ח ברכות וג' אחר סדר קדושה ובו אומרים ג"כ תתקבל צלותהון שהוא שייך ג"כ לתפלת י"ח וד' אחר עלינו שיש בו אמירת פסוקים וה' אחר אשרי במנחה וששי אחר תפלת מנחה ז' אחר ק"ש של ערבית קודם תפלת י"ח וקדיש שאחר תפלת ערבית אף דהוא ג"כ מצוה לא קחשבינן בכלל אלו השבעה עי"ש בלבוש הטעם:

(5) On the words 'and the same applies to Kedushah': And the same applies to the entire repetition of the chazzan, which requires ten, for it is called a matter of holiness because of the Kedushah within it. [Megillah 23, and the Ran there] One does not say fewer than seven Kaddishes each day, corresponding to 'Seven times a day I praise You.' That is: (1) after Pesukei DeZimra, which is after Yishtabach; (2) the half-Kaddish after the Shemoneh Esrei of eighteen blessings; (3) after the order of Kedushah — and in it one also says 'May their prayers be accepted,' which belongs also to the Shemoneh Esrei; (4) after Aleinu, which contains the saying of verses; (5) after Ashrei at Minchah; (6) after the Minchah prayer; (7) after the Shema of the evening, before the Shemoneh Esrei. And the Kaddish after the evening Shemoneh Esrei, though it too is a mitzvah, we do not count among these seven; see there in the Levush for the reason.

(ו) אם התחיל - וה"ה בכל דבר שצריך עשרה כגון נ"כ וקריאת התורה והפטרה בנביא גומרין כל מה ששייך לענין זה כיון שכבר התחילו בו בעשרה אבל לא מתחילין מה שהוא ענין אחר:

(6) On the words 'If he began': And the same applies to anything that requires ten, such as the priestly blessing, the reading of the Torah, and the Haftarah in a prophet: they finish all that pertains to this matter, since they already began it with ten; but they do not begin what is a separate matter.

(ז) לומר קדיש - ואם התחיל לומר ישתבח בעשרה ויצאו מקצתן וכן אם התחיל לומר אשרי שקודם מנחה בעשרה ויצאו מקצתן מסתפק הפמ"ג דאולי יוכל לומר הקדיש שאחר זה כי הקדיש שייך לישתבח ואשרי. ועי' בשע"ת בשם א"ר אמנם בספר מאמר מרדכי ובדרך החיים ובח"א כולם פסקו דלא יוכל לומר הקדיש בזה:

(7) On the words 'to say Kaddish': And if one began to say Yishtabach with ten and some left, and likewise if one began to say Ashrei before Minchah with ten and some left, the Pri Megadim is in doubt: perhaps he may say the Kaddish that follows, since the Kaddish belongs to Yishtabach and to Ashrei. And see the Shaarei Teshuvah in the name of the Eliyah Rabbah. However, the Maamar Mordechai, the Derech HaChaim, and the Chayei Adam all ruled that he may not say the Kaddish in this case.

(ח) או קדושה - לאו דוקא דה"ה אפילו רק באבות וכדלקמיה בס"ג ואפשר דנקט לרבותא דסיפא דאפילו בזה דוקא אם נשתיירו רובן:

(8) On the words 'or Kedushah': This is not precise, for the same applies even if he began only with Avos, as stated further in se'if 3; and it is possible that he mentioned Kedushah for the stringency of the latter clause — that even in this case, only if the majority remained.

(ט) אותו הקדיש - ואם היה הקדיש שקודם ברכו כתב הדה"ח בשם א"ר דיוכל לומר ג"כ הברכו דכולא חדא ענינא הוא. ובספר מאמר מרדכי חולק ע"ז עי"ש:

(9) On the words 'that Kaddish': And if it was the Kaddish that precedes Barchu, the Derech HaChaim wrote in the name of the Eliyah Rabbah that he may also say the Barchu, for it is all one matter. But the Maamar Mordechai disagrees with this; see there.

(י) הקדושה - וה"ה כל תפלת י"ח. ולפי מה שמבואר בהג"ה שבסעיף ג' גומר גם החצי קדיש וקדיש שלם שלאחריה. וכתבו האחרונים דיאמר ג"כ ברכה דאלהינו ברכנו בברכה המשולשת וכו' דכל שהתחיל בתפלת י"ח גומרה אע"ג דתנן אין נושאין כפים בפחות מעשרה ואפילו אם התחיל התפלה בעשרה וכדאיתא בר"ן וב"י היינו דוקא נ"כ ממש ומשום שהוא ענין אחר אבל תפלת אלקינו יאמר מאחר שהתחיל בתפלת י"ח וג"ז שייך לתפלת י"ח:

(10) On the word 'the Kedushah': And the same applies to the entire Shemoneh Esrei. And according to what is explained in the gloss on se'if 3, he also finishes the half-Kaddish and the full Kaddish that follow it. And the later authorities wrote that he should also say the blessing 'Our God, bless us with the threefold blessing,' etc., for whoever began the Shemoneh Esrei finishes it, even though we learned that one does not perform the priestly blessing with fewer than ten, even if he began the prayer with ten, as stated in the Ran and the Beis Yosef — that refers specifically to the actual priestly blessing, because it is a separate matter; but the prayer of 'Our God' he does say, since he began the Shemoneh Esrei, and this too belongs to the Shemoneh Esrei.

(יא) רובן - היינו ששה ולא בעינן רובא דמינכר [פמ"ג]:

(11) On the word 'the majority': That means six, and we do not require a discernible majority. [Pri Megadim]

(יב) עבירה היא - נ"ל שר"ל אם אינו ממתין עד שיגמרו אותו הענין אבל אם ממתין עד שיגמרו הענין די בזה כגון אם אחד הצטרף עם ט' לברכו אינו מחוייב להמתין על צירוף של חזרת הש"ץ שהוא ענין אחר ואם היה עמהם בצירופם בעת שהתחיל הש"ץ בקול רם צריך להמתין עד שיגמרו כל סדר הקדושה וקדיש שלם שלאחריה וכן כל כי האי גווני:

(12) On the words 'it is a transgression': It seems to me that this means: if he does not wait until they finish that matter; but if he waits until they finish the matter, that suffices. For example, if one joined nine for Barchu, he is not obligated to wait to be counted for the chazzan's repetition, which is a separate matter; but if he was among those counted at the time the chazzan began aloud, he must wait until they finish the entire order of Kedushah and the full Kaddish that follows it; and so in all cases of this kind.

(יג) אבל אם נשארו וכו' - עיין בבה"ל:

(13) On the words 'but if there remained, etc.': See the Biur Halachah.

(יד) מותר לצאת - והוא שכבר שמעו קדושה והקדישים עד עלינו:

(14) On the words 'he is permitted to leave': And that is provided they have already heard Kedushah and the Kaddishes up to Aleinu.

(טו) אפילו קדושה - וה"ה דגומר הש"ץ כל תפלת י"ח ולא נקט קדושה אלא משום דלא נימא דהוא ענין אחר:

(15) On the words 'even Kedushah': And the same applies that the chazzan finishes the entire Shemoneh Esrei; and the Shulchan Aruch mentioned Kedushah only so that we should not say it is a separate matter.

(טז) לאחר שהתחילו - נקט האי לישנא לאפוקי ממהר"ש שהובא בד"מ שרוצה להקל בזה אבל באמת לפי הסכמת הפוסקים הוא אפילו אם התפלה בלחש היה ג"כ בעשרה דינא הוא שלא יתחיל הש"ץ בקול רם בפחות מעשרה:

(16) On the words 'after they began': He used this wording to exclude the view of the Maharshal, cited in the Darchei Moshe, who wished to be lenient in this; but in truth, according to the consensus of the authorities, even if the silent prayer too was with ten, the law is that the chazzan should not begin aloud with fewer than ten.

(יז) להתפלל יוצר - עיין באחרונים שהסכימו דאפילו לא אמרו רק קדיש וברכו בעשרה ויצאו מקצתן קודם שהתחילו כלל ברכת יוצר מקרי כמו שהתחילו כבר בעשרה ויכולין להוציא אחרים עד שמ"ע אפילו בפחות מעשרה:

(17) On the words 'to pray Yotzer': See the later authorities who agreed that even if they said only Kaddish and Barchu with ten and some left before they began the Yotzer blessing at all, it is considered as if they already began with ten, and they may discharge others' obligation up to the Shemoneh Esrei, even with fewer than ten.

(יח) וקדושה - לאו דוקא דאפילו עדיין לא אמרו קדושה כיון שהתחילו להתפלל בקול רם ואפילו רק באבות לבד גומרים אף הקדיש שלם:

(18) On the word 'and Kedushah': This is not precise, for even if they have not yet said Kedushah, since they began to pray aloud, and even only with Avos alone, they finish even the full Kaddish.

(יט) הקדיש שלם - וכ"ש החצי קדיש שאחר תפלת י"ח:

(19) On the words 'the full Kaddish': And all the more so the half-Kaddish after the Shemoneh Esrei.

(כ) שלאחריה - אבל הקדיש שאחר עלינו לא יאמר בזה ואפילו אם התחיל לומר עלינו בעשרה ויצאו מקצתן ג"כ לא יאמר הקדיש דאינו אלא מנהג ומכ"ש לשיר היחוד או לקדיש שאומרים למזמור או אחר הלימוד דצריך דוקא מנין בשעת קדיש:

(20) On the word 'that follows it': But the Kaddish after Aleinu he does not say in this case; and even if he began to say Aleinu with ten and some left, he likewise does not say the Kaddish, for it is only a custom; and all the more so for the Shir HaYichud, or for the Kaddish said over a psalm or after study, for these specifically require a minyan at the time of the Kaddish.

(כא) בתורה - אם אירע כן ביום ב' וה':

(21) On the words 'from the Torah': If this happened on a Monday or Thursday, when the Torah is read.

(כב) לק"ש וברכותיה - ומשו"ה אם התחילו ברכת ערבית בעשרה או אפילו רק ברכו לחוד ואח"כ יצאו מקצתן אין לו רק לגמור הקדיש שקודם התפלה לפי שהקדיש שייך לברכת ק"ש אבל לא יאמר הקדיש שאחר תפלת י"ח לפי שהתפלה אינה חבור לברכות של ק"ש וכ"ש סדר קדושה וקדיש במוצאי שבת אבל אם היו עשרה בשעה שהתחילו להתפלל תפלת ח"י בלחש ואח"כ יצאו מקצתן י"ל הקדיש שלם שלאחר התפלה דהקדיש שייך לתפלה ובמו"ש יכול לומר הח"ק שאחר התפלה וגם הסדר קדושה וקדיש שלם שאח"כ לפי שכל זה שייך לתפלה כמו בשחרית:

(22) On the words 'to Shema and its blessings': And therefore, if they began the evening blessings with ten, or even only Barchu alone, and afterward some left, he may only finish the Kaddish before the prayer, since that Kaddish belongs to the blessings of Shema; but he may not say the Kaddish after the Shemoneh Esrei, since the evening prayer is not joined to the blessings of Shema, and all the more so the order of Kedushah and Kaddish on Motzaei Shabbos. But if there were ten when they began to pray the Shemoneh Esrei silently and afterward some left, he may say the full Kaddish after the prayer, since that Kaddish belongs to the prayer; and on Motzaei Shabbos he may say the half-Kaddish after the prayer, and also the order of Kedushah and the full Kaddish thereafter, since all this belongs to the prayer, as at Shacharis.

(כג) ע"י חומש וכו' - דלא מחשבינן הקטן לאיש ע"י שאוחז חומש בידו:

(23) On the words 'by means of a Chumash, etc.': For we do not reckon the minor as an adult by virtue of his holding a Chumash in his hand.

(כד) בשעת הדחק - ר"ל אפילו בלי חומש וכדעת היש מתירין הנ"ל. ודוקא אחד ולא ב' ובלבוש כתב שלא ראה נוהגין לצרפו אפילו בשעת הדחק ובזמנינו נוהגים לצרף קטן ע"י חומש שבידו ומיהו דוקא לשמוע ברכו וקדיש שהוא חיוב אבל קדיש שאחר עלינו לא יאמרו [מ"א] והרבה אחרונים מחמירין שלא לצרף שום קטן אפילו בשעת הדחק עד שיושלם לו הי"ג שנים. אונן אינו מצטרף למנין והיינו כל אונן שחייב להתאבל עליו אפילו אינו מוטל עליו לקברו כגון שאינו יורש שלו אם הוא בעיר שהמת שם אינו מצטרף ואפילו אם יש לו מי שיתעסק עמו בקבורתו אם לא שמסרו להכתפים וכמו שיתבאר בסימן ע"א אבל אם המת בעיר אחרת ונודע לו קודם הקבורה ויש שם מי שישתדל עבורו שדינו שאם רצה לקרות רשאי ואין מוחין בידו הוא מצטרף למנין. ומיהו כ"ז לענין אונן אבל באבל ודאי מצטרף לברהמ"ז ולתפלה:

(24) On the words 'in a time of pressing need': That is, even without a Chumash, in accordance with the view of 'some permit' mentioned above. And specifically one minor, not two. And the Levush wrote that he did not see people accustomed to combine him even in a time of pressing need; but in our times they are accustomed to combine a minor by means of a Chumash in his hand. However, this is only to hear Barchu and Kaddish, which are an obligation; but the Kaddish after Aleinu they should not say by combining him. [Magen Avraham] And many later authorities are stringent not to combine any minor, even in a time of pressing need, until he completes thirteen years. An onen (one whose close relative has died and is not yet buried) does not combine for the minyan. And this means any onen obligated to mourn for the deceased, even if the burial does not fall upon him — such as when he is not his heir — if he is in the city where the deceased is, he does not combine, and even if he has someone to attend to the burial with him — unless they handed it over to the pallbearers, as will be explained in siman 71. But if the deceased is in another city and he learned of it before the burial, and there is someone there to arrange matters on his behalf, whose law is that if he wished to read he is permitted and none prevent him — he combines for the minyan. However, all this is regarding an onen; but a mourner, after burial, certainly combines for the Grace after Meals and for prayer.

(כה) שתי שערות - בשאר מקומות הגוף אפילו הביא ב' שערות בזקן [ב"ש באה"ע סימן קע"ב סק"ה]:

(25) On the words 'two hairs': This refers to hairs on the other places of the body, even if he has grown two hairs in the beard. [Beis Shmuel, Even HaEzer, siman 172, sk 5]

(כו) דינו כקטן - ואם הביא שתי שערות נעשה גדול מיום שהביא לא למפרע:

(26) On the words 'his status is that of a minor': And if he grows two hairs, he becomes an adult from the day he grew them, not retroactively.

(כז) רוב שנותיו - ולא בעינן רק יום אחד יותר על ל"ה שנה:

(27) On the words 'the majority of his years': And we require only one day more than thirty-five years (half of the (biblical) seventy).

(כח) שאז יתברר - ר"ל ואז נעשה גדול למפרע משנת י"ג ויום אחד:

(28) On the words 'for then it becomes clear': That is, and then he becomes an adult retroactively, from the age of thirteen years and one day.

(כט) סימני סריס - מבואר באה"ע בסימן קע"ב סעיף ה' ואפילו אחד מן הסימנים הנזכרים שם מהני להשוותו לסריס אם לא הביא שתי שערות גם בזקן כמבואר בהג"ה שם:

(29) On the words 'the signs of a saris': This is explained in Even HaEzer, siman 172, se'if 5. And even one of the signs mentioned there suffices to render him like a saris, if he has not grown two hairs, including in the beard, as explained in the gloss there.

(ל) דינו כגדול - ודוקא כשהגיע לשנת עשרים [היינו ל' יום בשנת עשרים כן הוא דעת רוב הפוסקים באה"ע בסימן קנ"ה סי"ב] ולא הביא שתי שערות דאז מהני הסימנים לשוייה לסריס למפרע בין שנולדו לו הסימנים בשנת כ' או קודם לזה אבל קודם שהגיע לשנת עשרים אע"פ שיש לו כל הסימני סריסות אמרינן עדיין הוא קטן. ועיין בפמ"ג שמצדד לומר דלענין תפלה שהוא מדרבנן אפשר דיש להקל לצרפו אפילו קודם עשרים אם נראה בו סימני סריס:

(30) On the words 'his status is that of an adult': And this applies specifically when he has reached the twentieth year [that is, thirty days into the twentieth year; so is the view of most authorities in Even HaEzer, siman 155, se'if 12] and has not grown two hairs — for then the signs render him a saris retroactively, whether the signs appeared in the twentieth year or before that. But before he reaches the twentieth year, even though he has all the signs of a saris, we say he is still a minor. And see the Pri Megadim, who inclines to say that regarding prayer, which is Rabbinic, it is possible to be lenient and combine him even before twenty, if the signs of a saris are seen in him.

(לא) לענין זה - ר"ל לענין תפלה שהיא מדרבנן ואפילו לדעת הפוסקים דתפלה היא דאורייתא עכ"פ צירוף עשרה לאו דאורייתא הוא ע"כ סמכינן ע"ז ואמרינן כיון שבא לכלל שנותיו מסתמא הביא שתי שערות דרוב אנשים מכיון שהגיעו לכלל שנים מסתמא מביאין ב' שערות אבל לענין שאר חיובא דאורייתא אינו מועיל [ועיין בפמ"ג שמאריך בזה ומסיק דמשום דהוא מיעוט המצוי ע"כ החמירו מדרבנן לענין דאורייתא כמו לענין בדיקת הריאה]:

(31) On the words 'regarding this matter': That is, regarding prayer, which is Rabbinic; and even according to the authorities who hold that prayer is Biblical, in any case the requirement of ten is not Biblical. Therefore we rely on this and say: since he has reached the (proper) number of years, he presumably grew two hairs, for most men, once they have reached the (proper) age, presumably grow two hairs; but regarding other Biblical obligations, this does not suffice. [And see the Pri Megadim who elaborates on this and concludes that because it is a common minority, they were therefore stringent by Rabbinic law regarding Biblical matters, as with the inspection of the lung.]

(לב) אחד מהעשרה - ה"ה יותר מאחד ובלבד שישארו רובם שאין מתפללים ש"ע ויכולין לענות עמהם ויש מחמירין ביותר מאחד ובישן בודאי אין לצרף אפילו במקום הדחק ביותר מאחד כי בלא"ה יש הרבה פוסקים המחמירי' בישן וכדלקמיה:

(32) On the words 'one of the ten': The same applies to more than one, provided the majority remain who are not praying the silent Shemoneh Esrei and can answer together with them. But some are stringent regarding more than one; and with a sleeping person one certainly may not combine, even in a pressing situation, for more than one, for in any case there are many authorities who are stringent regarding a sleeping person, as (stated) further on.

(לג) או שהוא ישן - עיין בפמ"ג שכתב דה"ה לענין זימון עשרה ג"כ ישן מצטרף לדעת הש"ע כמו לענין תפלה ולענין קריאת התורה ונשיאת כפים צ"ע אך לענין קריאת המגילה בודאי אין הישן מצטרף לעשרה לכו"ע דבמגילה בעי עשרה לפרסומי ניסא ובישן ליכא פרסום:

(33) On the words 'or he is asleep': See the Pri Megadim who wrote that the same applies to a zimmun of ten — a sleeping person combines according to the Shulchan Aruch's view, just as regarding prayer; but regarding the reading of the Torah and the priestly blessing, it requires further study. However, regarding the reading of the Megillah, a sleeping person certainly does not combine for the ten, according to all, for the Megillah requires ten in order to publicize the miracle, and with a sleeping person there is no publicity.

(לד) מצטרף עמהם - דבכל עשרה שהם גדולים שכינה שריא ביניהם דונקדשתי בתוך בני ישראל קרינן בהו ולא דמי לקטן דלאו בר קדושה הוא. ועיין בט"ז שחולק לענין ישן וס"ל דאין מצטרף והסכים עמו הפר"ח דישן חשיב כשוטה עי"ש ע"כ לכתחילה בודאי צריך להקיצו ועכ"פ לעוררו שיהיה מתנמנם ועיין בבה"ל:

(34) On the words 'he combines with them': For among any ten who are adults, the Divine Presence dwells among them, since 'And I shall be sanctified among the Children of Israel' applies to them, and this is unlike a minor, who is not fit for holiness. And see the Taz who disagrees regarding a sleeping person and holds that he does not combine, and the Pri Chadash agreed with him, that a sleeping person is regarded like one mentally incapacitated; see there. Therefore, initially one certainly must wake him, or at least rouse him so that he be dozing (half-awake); and see the Biur Halachah.

(לה) נכון וכו' - ואפילו אם יש מנין בלעדו:

(35) On the words 'it is proper, etc.': And this even if there is a minyan without him.

(לו) עד שיגמור - וה"ה בישן צריך להקיצו ואם לא רצה לעמוד א"צ להמתין לדעת השו"ע ומצטרף אבל יש חולקין בזה וכמו שכתבתי בס"ק ל"ד:

(36) On the words 'until he finishes': And the same applies to a sleeping person — one must wake him; and if he did not wish to rise, one need not wait, according to the Shulchan Aruch, and he combines; but some disagree in this, as I wrote in sk 34.

(לז) כדי שיזכה - ודוקא אם ישאר שהות ביום להתפלל:

(37) On the words 'so that he may merit': And specifically if there remains time in the day to pray.

(לח) חרש המדבר - ודעת הט"ז לקמן בסימן קכ"ד ס"ב שאין מצרפין למנין מי שאינו שומע אע"ג שהוא מדבר שלא ידע לענות אמן על הברכות שמברך הש"ץ אכן הרבה מסכימין עם פסק השו"ע וסוברין שאין זה מעכב לענין צירוף ואם הוא מכוין הברכות וכשרואה שעונין עונה עמהם דומיא דהנפת הסודרין בבהכ"נ של אלכסנדריא שמבין בשעה שמסיים הש"ץ סוף הברכה ועונה אמן מצטרף לכו"ע:

(38) On the words 'a deaf-mute who speaks': And the view of the Taz later, in siman 124, se'if 2, is that we do not combine for the minyan one who does not hear, even though he speaks, for he cannot know to answer Amen to the blessings the chazzan recites. But many agree with the ruling of the Shulchan Aruch and hold that this does not impede regarding combining, and if he concentrates on the blessings and, when he sees them answering, answers with them — similar to the waving of the scarves in the synagogue of Alexandria, so that he understands when the chazzan concludes the blessing and answers Amen — he combines according to all.

(לט) ב' שערות - ומקומן ושיעור גדלותן מבואר באה"ע בסי' קנ"ה סי"ז וי"ח:

(39) On the words 'two hairs': Their location and the required measure of their growth are explained in Even HaEzer, siman 155, se'ifim 17 and 18.

(מ) אחר שיהיה - שכן קבלו חז"ל הלמ"מ שלא יקרא הזכר איש עד שישלמו לו י"ג שנה ויביא ג"כ שתי שערות והוא מכלל כל השיעורין שקבלו חז"ל הלכה למשה מסיני ואמנם קי"ל כיון שהגיעו לכלל שנים חזקה שהביאו ב' שערות ולכן אפילו אם אנו רואין שאין להם ב' שערות חיישינן שמא היה להם אלא שנשרו שכן דרך שערות הללו לנשור פעמים מחמת כחישות ופעמים מחמת שמנונית ומ"מ לא סמכינן על חזקה זו לגמרי אלא דדיינין ליה כספק ולכן אזלינן תמיד לחומרא בכל דבר שהוא מדאורייתא ובדרבנן לקולא ועיין לקמן בסימן קצ"ט במ"א ס"ק ח' וצע"ק ועיין לעיל בסקל"א מה שכתבנו שם בשם הפמ"ג:

(40) On the words 'after he has become': For so did our Sages receive as a halachah to Moshe from Sinai, that a male is not called a 'man' until he completes thirteen years and also grows two hairs; and this is among all the measures that the Sages received as a halachah to Moshe from Sinai. Nevertheless, we hold that once they have reached the (proper) number of years, there is a presumption that they grew two hairs. Therefore, even if we see that they have no two hairs, we suspect that perhaps they had them but they fell out, for it is the way of these hairs to fall out — sometimes from thinness of the body and sometimes from fatness. Nevertheless, we do not rely on this presumption entirely, but rather treat him as a doubtful case; and therefore we always follow the stringent view in anything Biblical, and the lenient view in Rabbinic matters. And see later in siman 199 in the Magen Avraham, sk 8, and it requires some study. And see above in sk 31 what we wrote there in the name of the Pri Megadim.

(מא) בן י"ג - ואביו מהימן ע"ז ולא איש אחר כן איתא בקידושין ס"ד ע"א בתוד"ה נאמן. ואם מת אביו ואינו יודע אימתי נעשה בן י"ג שנה לכאורה דינא הוא דמכיון שהביא ב' שערות חייב ליזהר במצות התורה כדין שאר גדול דספיקא דאורייתא הוא ועיין:

(41) On the words 'thirteen years old': And his father is believed regarding this, but not another man; so it is stated in Kiddushin 64a, in Tosafos beginning 'ne'eman.' And if his father died and he does not know when he became thirteen years old, seemingly the law is that, since he has grown two hairs, he is obligated to be careful with the Torah's mitzvos like any other adult, for it is a Biblical doubt; and see (further).

(מב) ויום אחד - לאו דוקא יום אלא כיון שנכנס תחלת היום משנת י"ד ואפילו שעה אחת ואפילו רגע אחת סגי ואפילו נולד בסוף יום ר"ה כיון שעדיין הוא ודאי יום נעשה בן י"ג שנה בתחלת ליל ר"ה של שנת י"ד [אחרונים] ואם היה בין השמשות בעת הלידה דיינינן ליה לספק ואזלינן לחומרא בכל דבר שהוא מדאורייתא:

(42) On the words 'and one day': It is not specifically a full day; rather, once the beginning of the day of the fourteenth year has entered — even one hour, even one moment — it suffices. And even if he was born at the end of the day of Rosh Hashanah, since it is still certainly day, he becomes thirteen at the beginning of the night of Rosh Hashanah of the fourteenth year. [later authorities] And if it was twilight (bein hashemashos) at the time of birth, we treat him as a doubtful case and follow the stringent view in anything Biblical.

(מג) אינה מעוברת - אבל אם בשנת י"ג היה ג"כ עיבור אז בודאי היינו אומרים הנולד בראשון יהיה בר מצוה באדר ראשון והשני באדר שני [הסכמת אחרונים דלא כמ"א]:

(43) On the words 'is not a leap year': But if the thirteenth year was also a leap year, then we would certainly say that the one born in the first Adar becomes bar mitzvah in Adar Rishon, and the one born in the second, in Adar Sheni. [the consensus of the later authorities, unlike the Magen Avraham]

(מד) עד כ"ט לאדר - דמהו דתימא שיחשב האדר הראשון שנולד בו במקום שבט וכיון שיגיע כ"ט בשבט בשנת י"ג יהיה נעשה בר מצוה קמ"ל דלא אמרינן כן:

(44) On the words 'until the 29th of Adar': For one might have thought that the Adar Rishon in which he was born should be reckoned in place of Shevat, and once the 29th of Shevat in the thirteenth year arrives he would become bar mitzvah; it therefore teaches us that we do not say so.

(מה) אינו נעשה - אע"ג דכבר כתב המחבר סעיף ט' דחודש העיבור בכלל מ"מ ה"א דוקא בנולד בחודש אחר כגון בר"ח ניסן ושנת י"ג מעוברת אין נעשה בר מצוה עד ר"ח ניסן אבל נולד בר"ח אדר ה"א דנעשה בר מצוה בר"ח אדר ראשון קמ"ל דאדר ראשון לא נקרא אדר אלא חודש העיבור מיקרי שהרי אין קורין את המגילה באדר ראשון ואנן בעינן י"ג שנים שלימים. מי שנולד ביום ראשון בר"ח כסליו והיו אז ב' ימים ר"ח ובשנת י"ג היה חשון חסר וכסליו אינו אלא יום אחד ר"ח אעפ"כ אינו נעשה בר מצוה עד ר"ח כסליו. ומי שנולד בר"ח כסליו ולא היה רק יום אחד ר"ח ובשנת י"ג היו שני ימים ר"ח נעשה בר מצוה ביום א' דר"ח:
