It is forbidden to enter a fixed privy (beis hakisei kavua) in order to urinate while wearing tefillin on his head, this being a decree lest he [forget and] relieve himself while wearing them. But if he holds them in his hand, he is permitted to urinate while [carrying] them, even in a fixed privy. The Rema adds: This [leniency of urinating while holding them] applies specifically when he urinates while seated, where there is no concern for splashes; but if he urinates while standing, it is obvious that it is forbidden, for [a fixed privy] is no better than a temporary privy [in this regard]. And likewise, if he urinates while seated, or onto loose earth, where there are no splashes, it is permitted even in a temporary privy. There is no distinction between a fixed and a temporary privy with regard to this matter [of splashes], except that in a fixed privy a person presumably relieves himself while seated, whereas in a temporary privy he presumably does so while standing, since he is not [there] to move his bowels. (Beis Yosef in the name of the Nimukei Yosef and the Migdal Oz.) And in a temporary privy it is permitted to urinate while they are on his head, but if he holds them in his hand, it is forbidden to urinate while [carrying] them standing, even if he grasps them through his garment, because he will need to wipe with his hand the splashes on his legs [and might do so with the hand holding the tefillin]. Rather, he removes them at a distance of four cubits and hands them to his fellow. And from the words of the Rambam it appears that it is forbidden to urinate while they are on his head, whether in a fixed privy or in a temporary privy, and one should be concerned for his words [and act stringently].
בית הכסא קבוע היינו שיש בו צואה והוא על פני השדה יגבלא חפירה:
A fixed privy (beis hakisei kavua) is one that has excrement in it, and it is on the surface of the open field, without a pit having been dug.
ידבית הכסא עראי היינו כגון להשתין מים שאין אדם הולך בשבילם לבית הכסא והפעם הזאת נעשה המקום הזה טובית הכסא תחילה:
A temporary privy (beis hakisei arai) is, for example, [a spot used] to pass water, for which a person does not [normally] go to a privy, and on this occasion this place is being made into a privy for the first time.
טזאם הם בחיקו וחגור חגורה יזאו בבגדו בידו מותר בין להשתין בין לפנות:
If they [the tefillin] are in his bosom and he is wearing a belt [so they will not fall], or [held] through his garment in his hand, it is permitted, both to urinate and to move his bowels.
אם רוצה ליכנס יחלבית הכסא קבוע לעשו' צרכיו חולצן ברחוק ד' אמות: הגה וי"א אפי' בלא צרכיו (ב"י בשם רב האי) ויטטוב להחמיר וגוללן ברצועות שלהן ואוחזן בכימינו ובבגדו כנגד לבו ויזהר שלא תהא רצועה יוצאת מתחת ידו טפח וכשיוצא מרחיק ד' אמות ומניחן:
If a person wishes to enter a fixed privy to relieve himself, he removes them [the tefillin] at a distance of four cubits. The Rema adds: And some say [that he removes them at four cubits' distance] even when he is not [entering] to relieve himself (Beis Yosef in the name of Rav Hai). It is good to be stringent [like this view]. He rolls them up in their own straps and holds them in his right hand, through his garment, opposite his heart, and he takes care that no strap protrude a handbreadth out from under his hand. And when he comes out, he moves off four cubits [from the privy] and puts them [back] on.
היה לבוש בתפילין והוצרך לבית הכסא בלילה או סמוך לחשיכה שאין שהות להניחם עוד אחר שיצא לא יכנוס בהם כאגלולין בבגדו ואפי' להשתין מים בבית הכסא קבוע אלא כיצד יעשה חולצן ומניחן בכלי כבאם היה בו טפח או בכלי שאינו כליין אע"פ שאין בו טפח ואוחז הכלי כגבידו ונכנס:
If a person was wearing tefillin and needed [to go] to the privy at night, or close to nightfall, when there is no [longer] time to don them again after he comes out, he should not enter with them wrapped up in his garment — and this is so even [when he goes only] to pass water in a fixed privy. Rather, what should he do? He removes them and places them in a vessel, if it has a handbreadth [of space], or in a vessel that is not their [designated] vessel, even if it does not have a handbreadth, and he holds the vessel in his hand and enters.
בד"א בבית הכסא שבשד' אבל בב"הכ שבבית לא יכניסם כדכלל כיון שיכול להניחם במקום כההמשתמר:
In what case were these words said [that he brings the tefillin in with him]? Regarding a privy that is out in the field; but regarding a privy that is inside a house, he should not bring them in at all, since he is able to leave them in a guarded place.
אם שכח תפילין בראשו ועשה בהם צרכיו מניח ידו עליהן כועד שיגמור עמוד הראשון ויוצא וחולצן וחוזר ונכנס:
If a person forgot [that he had] tefillin on his head and relieved himself while wearing them, he places his hand over them until he finishes the first stream [and does not hold it back], and then he goes out, removes them, and comes back in [to continue].
מותר כזלרופא ליקח עביט של מי רגלים בידו ותפילין בראשו ובעל נפש יחמיר לעצמו:
It is permitted for a physician to take a chamber pot of urine in his hand while [wearing] tefillin on his head [in order to examine it], but a spiritually sensitive person will be stringent with himself.

(א) להשתין - המג"א בסק"ט כתב דמה שכתב המחבר להשתין לרבותא נקט דאפילו להשתין אע"פ שהוא חייו של אדם אסור לכנס וכ"ש שלא לצורך:
On the words 'to urinate': The Magen Avraham, in se'if katan 9, wrote that the Shulchan Aruch mentioned 'to urinate' [rather than moving one's bowels] to teach an added point (rabusa): that even merely to urinate — even though [holding it in endangers] a person's very life — it is forbidden to enter [wearing tefillin], and all the more so [where there is] no need at all.
(ב) בתפילין שבראשו - ה"ה דבזרוע נמי אסור מה"ט והא דנקט בראשו בא למעוטי אם אוחזן בידו:
On the words 'with tefillin on his head': and likewise the arm-tefillin are forbidden for this same reason; and the reason it specified 'on his head' is to exclude [the case] where he holds them in his hand, [which is permitted].
(ג) בידו - ר"ל בבגדו וביד ימינו כנגד לבו כמש"כ בס"ה:
On the word 'in his hand': that is to say, [holding them] through his garment, in his right hand, opposite his heart, as is written in se'if 5.
(ד) פשיטא דאסור - באוחזן בידו שמא יקנח הניצוצות וה"ה כשהם בראשו דאסור דחיישינן שמא ישב ויעשה בהם צרכיו [פמ"ג]:
On the words 'it is obvious that it is forbidden': when he holds them in his hand, [the concern is] lest he wipe off the splashes [with that hand]; and likewise when they are on his head it is forbidden, for we are concerned lest he sit down and relieve himself while wearing them [Pri Megadim].
(ה) תיחוח - או במקום מדרון:
On the word 'loose [earth]': or [where he urinates] on a slope [so the urine runs off and does not splash back].
(ו) נמי שרי ואין חילוק וכו' - ומ"מ יש חילוק קצת דבקבע דיש חשש שמא יעשה צרכיו צריך שיהיה בבגדו ובידו כמ"ש בסק"ג ובעראי אפילו בידו לבד נמי מותר בזה דליכא חשש ניצוצות:
On the words 'is also permitted, and there is no distinction, etc.': Nevertheless there is a slight distinction: in a fixed privy, where there is a concern lest he relieve himself, [the tefillin] must be [held] through his garment and in his hand, as was written in se'if katan 3; but in a temporary privy, even holding them in his hand alone is permitted in this case, since there is no concern for splashes.
(ז) ובבה"כ עראי וכו' - דלא גזרינן ביה שמא יפנה בהם ורק שיזהר שלא יפיח בהם:
On the words 'and in a temporary privy, etc.': for in it we do not decree [a prohibition] out of concern lest he move his bowels while wearing them; he need only take care not to break wind while wearing them.
(ח) מפני שצריך וכו' - וחיישינן שמא ישפשף הניצוצות שנופלין על רגליו ביד שאוחז בה התפילין:
On the words 'because he will need, etc.': we are concerned lest he wipe the splashes that fall on his legs with the very hand in which he is holding the tefillin.
(ט) חולצן ברחוק וכו' - עיין מ"א שכתב דמש"כ המחבר מתחלה אסור להשתין בהן מעומד מיירי בין בעראי ובין בקבוע וכמו שכ' בהג"ה ומש"כ אלא חולצן ברחוק ד"א מיירי בקבוע דאי בבה"כ עראי חולץ ומשתין לאלתר וכ"כ הט"ז:
On the words 'he removes them at a distance, etc.': See the Magen Avraham, who wrote that what the Shulchan Aruch said at the outset — that it is forbidden to urinate while [wearing] them standing — refers both to a temporary and to a fixed privy, as [is explained] in the Rema's gloss; and what he wrote — 'rather he removes them at a distance of four cubits' — refers [specifically] to a fixed privy, for in a temporary privy he [simply] removes them and urinates on the spot; and so too wrote the Taz.
(י) לחבירו - דהוא בעצמו אסור לאחוז בהן אז אף דמיירי בקבוע ומבואר לקמן בס"ה דיאחוז בבגדו ובידו כיון דמיירי כשמשתין מעומד וחיישינן משום ניצוצות:
On the words 'to his fellow': for he himself is forbidden to hold them at that time, even though [this case] deals with a fixed privy, and it is explained below in se'if 5 that [normally] he may hold them through his garment and in his hand — since here it deals with one urinating while standing, and we are concerned on account of splashes.
(יא) כשהן בראשו - וה"ה בזרועו דס"ל דגזרינן שמא יפיח בהם אבל כשהן בכיסן ואוחז הכיס בידו מותר להשתין בהן לד"ה שכשהן בכיסן אין איסור בהפחה כמו שיתבאר בסימן מ"ד:
On the words 'while they are on his head': and likewise on his arm, for [the Rambam] holds that we decree [a prohibition] lest he break wind while wearing them; but when they are in their pouch and he holds the pouch in his hand, it is permitted to urinate [while carrying] them according to all opinions, for when they are in their pouch there is no prohibition [concerning] breaking wind, as will be explained in siman 44.
(יב) לדבריו - ולעת הצורך כגון שיתבטל עי"ז מתפלה בצבור יכול לסמוך אדיעה ראשונה אך שיזהר הרבה שלא יבוא לידי הפחה כ"כ הח"א ומ"מ נוהגין לחלוץ הש"ר. וגם הש"י נכון להסיר הרצועות מכף היד שלא יבוא לשפשף הניצוצות בהם:
On the words 'for his words [the Rambam's]': In a time of pressing need — for example, where [removing the tefillin] would cause him to miss praying with the congregation — he may rely on the first opinion [that permits], but he must be very careful not to come to break wind; so wrote the Chayei Adam. Nevertheless, the custom is to remove the shel rosh (head-tefillin); and as for the shel yad (hand-tefillin) as well, it is proper to remove the straps from the palm of the hand, so that he not come to wipe the splashes with them.
(יג) בלא חפירה - ר"ל אז צריך לחלצן ברחוק ד"א אבל אם הוא בחפירה הרי החפירה הוא רשות לעצמו ובה"כ שלמעלה רשות לעצמו ואין לו דין בה"כ כלל כמו שיתבאר בסימן י"ג ומותר ליכנס בתוכו בתפילין שעליו ומ"מ קודם שישתין צריך לחלצן לד"ה כמו בשאר בה"כ קבוע כן מסיק המ"א בד"א להשתין אבל לעשות צרכיו משמע מדברי הב"י דיש להחמיר לחלוץ ברחוק ד"א ממקום שרוצה לעשות צרכיו אפילו נפנה במקום שאינו בה"כ כלל אלא בחצירו או ע"פ השדה:
On the words 'without a pit dug': that is to say, in that case [where the filth lies on open ground] he must remove them at a distance of four cubits; but if [the filth] is in a pit, the pit is a domain unto itself and the privy-area above it is a domain unto itself, and [that upper area] has no status of a privy at all, as will be explained in siman 13, and it is permitted to enter it with the tefillin upon him. Nevertheless, before he urinates he must remove them, according to all opinions, just as in any other fixed privy; so concludes the Magen Avraham. [All of this is said] with regard to urinating, but with regard to moving his bowels, it is implied from the words of the Beis Yosef that one should be stringent to remove them at a distance of four cubits from the place where he wishes to relieve himself, even if he relieves himself in a place that is not a privy at all, but rather in his courtyard or out on the open field.
(יד) בה"כ עראי וכו' - פי' הא דאמרינן לעיל דמותר להשתין בו בתפילין שבראשו היינו במקום שאין בו צואה וגם הוא מקום שאין רגילין לפנות שם ולכך לא גזרינן שמא יפנה בהתפילין ואפילו אם הוא מקום צנוע:
On the words 'a temporary privy, etc.': This explains: what we said above — that it is permitted to urinate there while wearing tefillin on his head — refers to a place that has no excrement in it and is also a place where people are not accustomed to relieve themselves, and therefore we do not decree [a prohibition] lest he move his bowels while wearing the tefillin — and this is so even if it is a private, secluded spot.
(טו) בה"כ תחלה - עיין בפמ"ג דס"ל דהאי לישנא לאו דוקא דאפילו מיוחד מכמה זמנים להשתין מ"מ עראי יחשב:
On the words 'a privy for the first time': See the Pri Megadim, who holds that this wording is not exact: for even [a place] that has been designated for a long while for urinating is nevertheless considered a temporary privy.
(טז) אם הם בחיקו וכו' - דתו ליכא למיחש משום ניצוצות וגם משום שמא יפלו ממנו ומותר בין בבה"כ קבוע ובין בעראי:
On the words 'if they are in his bosom, etc.': for then there is no longer any concern on account of splashes, nor on account of their falling from him; and it is permitted whether in a fixed privy or in a temporary one.
(יז) או בבגדו בידו - צ"ע דבס"א כתב אפילו תופס אותם בבגדו אסור ועיין בט"ז ומ"א שנדחקו בזה מאד ובביאור הגר"א כתב דסעיף זה שהוא מבעל התרומות הוא שיטה אחרת החולק על הא דס"א וס"ל דבבגדו וידו תו לא חיישינן לשפשוף הניצוצות וכן הכריח בספר מאמר מרדכי. ובקשורין בבגדו לכו"ע מותר:
On the words 'or [holding] them through his garment in his hand': This requires investigation, for in se'if 1 he wrote that even if he grasps them through his garment it is forbidden; and see the Taz and the Magen Avraham, who were greatly hard-pressed [to reconcile this]. And in the Bei'ur HaGra it is written that this se'if, which is drawn from the Baal HaTerumos, is a different approach that disputes what is stated in se'if 1, and holds that [when the tefillin are held] through his garment and in his hand, we are no longer concerned about his wiping the splashes; and so too the sefer Maamar Mordechai concluded [is the halachah]. And when they are tied up in his garment, all agree that it is permitted.
(יח) לבה"כ קבוע - נקט קבוע משום סיפא לאשמעינן דאפילו בקבוע מכניס התפילין עמו משום שמירה אבל אה"נ דאפילו באינו קבוע כלל צריך לחלוץ ברחוק ד"א ממקום שרוצה לפנות וכדלעיל בסוף ס"ק י"ג. וכן מה דנקט לעשות צרכיו ג"כ משום רבותא דסיפא אבל באמת ה"ה להשתין צריך לחלוץ ברחוק ד"א וכדלעיל בס"א:
On the words 'to a fixed privy': He specified 'fixed' on account of the latter clause, to teach us that even in a fixed privy he may bring the tefillin in with him for safekeeping; but indeed, even [in a place] that is not a fixed privy at all, he must remove them at a distance of four cubits from the place where he wishes to relieve himself, as [stated] above at the end of se'if katan 13. Likewise, the fact that he specified 'to relieve himself' is also on account of the added point of the latter clause, but in truth the same applies to urinating: he must remove them at a distance of four cubits, as [stated] above in se'if 1.
(יט) וטוב להחמיר - המ"א מסיק דמדינא אסור לכנס לבהכ"ס בתפילין דלא גרע ממרחץ לקמן בסימן מ"ה ס"ב ועיין בפמ"ג ובמאמר מרדכי שכתבו דמדברי הרא"ש לא משמע הכי גם מדברי רב האי לא משמע הכי ע"ש ובספר האשכול בשם הגאון משמע כתירוצו דהמג"א עי"ש:
On the words 'and it is good to be stringent': The Magen Avraham concludes that by strict law it is forbidden to enter a privy while wearing tefillin, for it is no less [stringent] than a bathhouse, [as stated] below in siman 45, se'if 2; but see the Pri Megadim and the Maamar Mordechai, who wrote that from the words of the Rosh this is not implied, and from the words of Rav Hai too this is not implied — see there; while in the Sefer HaEshkol, in the name of the Gaon, it is implied like the resolution of the Magen Avraham — see there.
(כ) בימינו - אבל לא בשמאלו מפני שצריך לקנח בה כמש"כ בס"ג והכא ליכא למיחש לניצוצות שיבוא לשפשף ביד שאוחז בה התפילין דכיון שמיירי בבה"כ קבוע מסתמא עושה צרכיו מיושב. כתב הרמ"ע סימן נ"ט דמותר לכנס בתפילין למבואות המטונפות אפי' יש שם מקום מטונף להדיא וטוב לכסותו בכובע ואם רוצה לחלצן ולחזור ולהניחן שפיר דמי והמג"א מצדד לומר דכשיודע שיכנס דרך מבואות המטונפות לא יניחם בביתו אלא בבהכ"נ או שיניחם בביתו ויכסם במבואות המטונפות ונסתפק המחה"ש דאפשר דצריך לכסות ג"כ הרצועות וכ"ש ג' כריכות שעל האצבע ובתשובות רדב"ז ח"ד סימן ל"ו משמע ג"כ שסובר דמדינא צריך לכסות התפילין במקומות המטונפות וכל שאי אפשר לו לכסותם מוטב שיניחם בבהכ"נ ומשמע שם דהדלי"ת והיו"ד שברצועות אין צריך לכסות שהם דרך קשירה לא דרך כתיבה עי"ש:
On the words 'in his right hand': but not in his left hand, because he needs [that hand] to clean himself, as is written in se'if 3; and here there is no concern for splashes — that he might wipe with the hand holding the tefillin — since, as this deals with a fixed privy, he presumably relieves himself while seated. The Rema mi-Fano, in responsum 59, wrote that it is permitted to enter filthy alleyways while wearing tefillin, even where there is an openly filthy spot there, and it is good to cover them [the tefillin] with a hat; and if he wishes to remove them and then put them back on afterward, that is fine. The Magen Avraham inclines to say that when a person knows he will pass through filthy alleyways, he should not don them at home but rather in the synagogue, or [if] he does don them at home he should cover them while in the filthy alleyways. The Machatzis HaShekel was in doubt, [suggesting] that perhaps one must cover the straps as well, and all the more so the three windings on the finger. And in the Responsa of the Radbaz, part 4, siman 36, it is likewise implied that he holds that by strict law one must cover the tefillin in filthy places, and whenever it is impossible for him to cover them, it is better that he don them in the synagogue; and it is implied there that the dalet and the yud [formed] on the straps need not be covered, since they come about through knotting, not through writing — see there.
(כא) גלולין בבגדו - ר"ל מה שהותר בסעיף הקודם לאוחזן בימינו בבגדו דוקא כשיש לו שהות להניחם עוד אח"כ לא הטריחוהו להניחם בכלי משא"כ באין שהות:
On the words 'wrapped up in his garment': that is to say, what was permitted in the previous se'if — to hold them in his right hand through his garment — [applies] specifically when he has time to don them again afterward, [in which case] they did not trouble him to place them in a vessel; which is not so when there is no time [before nightfall].
(כב) אם היה בו טפח - אבל כשאין בו טפח בטל לגבי התפילין כיון שהוא כליין ואסור להכניסם לבה"כ:
On the words 'if it had a handbreadth [of space]': but when it does not have a handbreadth, [the vessel] is subsumed to the tefillin, since it is their [designated] vessel, and it is then forbidden to bring them into a privy.
(כג) בידו ונכנס - שלא יטלו אותם עוברי דרכים [גמרא עי"ש]:
On the words 'in his hand, and he enters': so that passersby not take them [while he is inside] [Gemara — see there].
(כד) כלל - משמע דאפילו בכיס לא יכניסם ועיין במחצית השקל שכתב דאם הם בכיסן ונותנן בכיס התפור במלבושו דאותו כיס אינו כליין והוי כלי תוך כלי ומותר:
On the word 'at all': this implies that he may not bring them in even in a pouch; but see the Machatzis HaShekel, who wrote that if they are in their own pouch and he places [that pouch] into a pocket sewn into his garment, then, since that pocket is not the tefillin's [designated] vessel, this constitutes a vessel within a vessel, and it is permitted.
(כה) המשתמר - ושאר ספרים וכתבים שיש בהן שמות אם הם בכיס שרי להכניסן ויש אומרים דבעינן דוקא תיק בתוך תיק אם צריך ליכנס לבה"כ וכדלעיל לענין תפילין וס"ת אסור בכל גווני. וכתב בש"ת דאותן המלבישין התינוקות בקמיע שכתוב שמות בקלף צריך ליזהר שיהיה כלי בתוך כלי כיון שהתינוקות נפנים בהם בעודם עליהם:
On the word 'guarded': As for other books and writings that contain [Divine] Names, if they are in a pouch it is permitted to bring them in; and some say that one specifically requires a case within a case if he needs to enter a privy, as above regarding tefillin. But a Torah scroll is forbidden [to bring in] in any manner whatsoever. And the Shaarei Teshuvah wrote that those who dress children in an amulet on which [Divine] Names are written on parchment must take care that there be a vessel within a vessel, since the children relieve themselves while [the amulets] are still upon them.
(כו) עד שיגמור - דעמוד החוזר מביא האדם לידי הדרוקן וסילון החוזר מביא האדם לידי ירקון:
On the words 'until he finishes': for a suppressed column [of excrement, held back,] brings a person to dropsy (hidrokan), and a suppressed jet of urine brings a person to jaundice (yerakon).
(כז) לרופא ליקח וכו' - לבדוק בו החולה וא"צ לחלוץ אז התפילין ועובדא הוי ברופא וה"ה בכל אדם:
On the words 'for a physician to take, etc.': [the chamber pot of urine] in order to examine the patient by means of it, and he need not remove the tefillin at that time; the incident [in the Gemara] happened to involve a physician, but the same law applies to any person.
