אתפילין שכתבן עבד באו אשה גאו קטן אפילו הגיע דלחינוך (או עכו"ם) האו כותי ואו מומר לע"א זאו מוסר פסולים משום דכתיב וקשרתם וכתבתם כל חשאינו בקשירה או אינו מאמין בה אינו בכתיבה:
Tefillin written by a slave, a woman, or a minor even one who has reached the age of training, (or a non-Jew) or a Kusi, or an apostate to idolatry, or an informer are invalid, because it is written “you shall bind them” and “you shall write them”: anyone who is not included in the binding, or who does not believe in it, is not included in the writing.
כל שפסול לכתבן פסול טבכל תיקון יעשייתן:
Anyone who is invalid to write them is invalid for any aspect of preparing and making them.
גר שחזר לדתו מחמת יאיראה כשר לכתוב תפילין:
A convert who reverted to his former faith out of fear [of being killed] is valid to write tefillin.
תפילין שכתבם יבאפיקורס (פי' מיאני) ייגשרפו וידי"א יגנזו:
Tefillin written by a heretic (apikoros) (meaning a min), must be burned; and some say they should be buried away (geniza).
נמצאו ביד אפיקורס ואין יודע מי כתבן טויגנזו:
If they were found in the possession of a heretic and it is not known who wrote them, they should be buried away.
נמצאו ביד עכו"ם ואין יודע מי כתבם טזכשרים:
If they were found in the possession of a non-Jew and it is not known who wrote them, they are valid.
אין לוקחין תפילין ומזוזות וספרים מן העכו"ם יזיותר מכדי דמיהן יחהרבה כדי שלא להרגיל לגנבן ולגוזלן:
We do not buy tefillin, mezuzos, and sacred books from a non-Jew for much more than their value, so as not to accustom [non-Jews] to stealing and robbing them.
אין נקחין אלא יטמן המומחה שבקי בחסירות ויתרות:
They may be bought only from an expert who is proficient in the defective and plene spellings.

If one bought from someone who is not an expert, he must check them. If he bought a hundred cases (batim) from him, he checks three of the cases: two of the head [-tefillin] and one of the hand, or two of the hand and one of the head. If he found them valid, this man is established [as reliable], and they are all valid, and the rest need no checking. But if he bought them in separate bundles, the presumption is that they were bought from many different people; therefore he checks from each bundle two of the head and one of the hand, or two of the hand and one of the head. A seller of tefillin who said that they had belonged to a great man is believed, and they need no checking.
תפילין שהוחזקו בכשרות אינם צריכים בדיקה כולעולם ואם אינו מניחן אלא כזלפרקים צריכים בדיקה פעמים בשבוע: הגה ואם אין לו מי שיוכל לבדוק ולחזור ולתופרן יכחניחם כך בלא בדיקה: (ב"י בשם אורחת חיים):
Tefillin that have been established as valid never need checking again. But if one wears them only occasionally, they require checking twice in seven [years]. The Rema adds: If he has no one who can check them and re-sew them, he may wear them as they are, without checking. (Beis Yosef in the name of the Orchos Chaim.)
משנה ברורה
(א) תפילין - וה"ה ס"ת ומזוזה:
(1) “Tefillin” — and likewise a Torah scroll and a mezuzah.
(ב) או אשה - וה"ה טומטום ואנדרוגינוס דהם בכלל ספק אשה:
(2) “or a woman” — and likewise a tumtum and an androginos, for they fall under the category of a possible woman.
(ג) או קטן - וכיון דילפינן מקרא בעינן שיהא דוקא גדול ממש דהיינו שהביא ב"ש אחר שהוא בן י"ג שנה אבל אם ספק לנו אם הביא ב"ש פסול לכתוב אם לא שנתמלא זקנו דהיינו שיש ריבוי שער בזקנו אף שהם קטנים מאד [סמ"ע בח"מ סימן ל"ה] או שעברו רוב שנותיו או שנולדו בו סימני סריס וכדלקמן בסימן נ"ה ס"ה. ויש לגעור בסופרים שמניחין לנערים לכתוב תפילין ואין מדקדקין אם הביאו סימני גדלות או לא. ועיין לעיל בסימן ל"ב סעיף קטן ק"ג מש"כ שם בשם הלבוש מענין זה ועיין בבה"ל:
(3) “or a minor” — since we derive this from the verse, we require that he be specifically a full adult, that is, that he has produced two hairs (signs of maturity) after he is thirteen years old. But if we are in doubt whether he has produced two hairs, he is invalid to write, unless his beard has filled out, that is, that there is abundant hair in his beard even if the hairs are very small [the Sma in Choshen Mishpat, siman 35], or that the majority of his years have passed, or that signs of a saris (one physically incapable of maturing) have appeared in him, as [explained] further on in siman 55, se’if 5. And one should rebuke the scribes who allow youths to write tefillin and are not careful whether they have produced signs of adulthood or not. And see above in siman 32, se’if katan 103, what is written there in the name of the Levush on this matter, and see the Biur Halacha.
(ד) לחינוך - באמת אפילו גדול לא כל זמן שלא ידעינן שהביא ב"ש אך לענין גדול אם אח"כ בדקנוהו ומצאנו שיש לו ב"ש תלינן שהיה לו ג"כ בעת הכתיבה [ח"מ סימן ל"ה] משא"כ בקטן דאינו מועיל אז שערות:
(4) “the age of training” — in truth, even an adult [is invalid] as long as we do not know that he has produced two hairs. But regarding an adult, if we later examined him and found that he has two hairs, we assume that he had them also at the time of writing [Choshen Mishpat, siman 35], unlike a minor, for whom hairs that appear only then are of no avail.
(ה) או כותי - כצ"ל. דעו"ג בלא"ה פסול שאין כותב לשמה:
(5) “or a Kusi” — this is the correct reading. For an idolater is in any case invalid, since he does not write for the sake [of the mitzvah].
(ו) או מומר לעבו"ג - דבזה הוא כמומר לכל התורה וה"ה אם הוא מומר לחלל שבת בפרהסיא אבל אם הוא מומר לשאר עבירות קי"ל דמומר לדבר אחד לא הוי מומר לכל התורה כולה לבד אם הוא עושה להכעיס דבזה אפילו לד"א דינו ככותי וכדאיתא ביו"ד סימן ב'. ויש מחמירין יותר דצריך גניזה. וכ"ז אם הוא מומר לשאר עבירות אבל אם הוא מומר לתפילין שאינו מניח תפילין אפילו אם אינו עושה זה להכעיס פסול דתו איננו בר קשירה לבד אם היה לזה רק מומר לתיאבון כגון שהלך אחר עסקיו עדיין הוא בכלל בר קשירה וכ"ז הוא לענין דיעבד אבל לכתחלה יש להחמיר שלא להניח לאיש כזה לכתוב סת"ם כי יש מחמירין אפילו במומר לתיאבון ואפילו באחרים עומדין ע"ג ואומרין לו שיכתוב לשמה ועיין בבה"ל. וכתב הפמ"ג דאפילו הוא מומר לחלל שבת בפרהסיא באיסור דרבנן כגון מוקצה והוצאה לכרמלית יש להחמיר עכ"פ לכתחלה שלא להניחו לכתוב סת"ם ואפילו בדיעבד צ"ע:
(6) “or an apostate to idolatry” — for such a one is like an apostate to the entire Torah; and likewise if he is an apostate for desecrating Shabbos in public. But if he is an apostate for other transgressions, it is established that an apostate to one thing is not an apostate to the entire Torah, except if he does it out of spite, for in that case, even for one thing, his law is like that of a Kusi, as stated in Yoreh Deah, siman 2. And some are more stringent, that it requires geniza. And all this is when he is an apostate for other transgressions; but if he is an apostate regarding tefillin, that he does not wear tefillin, even if he does not do this out of spite, he is invalid, for he is no longer included in the binding — except if in this he was only an apostate out of appetite, such as that he went after his own affairs; [then] he is still included in the binding. And all this is regarding after the fact (bedieved), but at the outset one should be stringent not to allow such a man to write STaM (Torah scrolls, tefillin, and mezuzos), for some are stringent even regarding an apostate out of appetite, and even when others stand over him and tell him to write for the sake [of the mitzvah]; and see the Biur Halacha. And the Pri Megadim wrote that even if he is an apostate for desecrating Shabbos in public through a rabbinic prohibition, such as muktzeh or carrying into a karmelis, one should be stringent, at least at the outset, not to allow him to write STaM, and even after the fact it requires further study.
(ז) או וכו' - עיין בה"ט דאפילו בלתיאבון לבד ואפילו פ"א:
(7) “or, etc.” — see the Be’er Heitev, that [he is invalid] even out of appetite alone, and even a single time.
(ח) שאינו בקשירה וכו' - ועבד ואשה וכותי אין מוזהר על הקשירה וקטן אף שהגיע לחינוך מדרבנן בעלמא הוא [ב"י] ועיין בבה"ל. ובכל אלו לא מהני אפי' גדול עומד על גבו ורואהו שיהיו לשמן:
(8) “who is not included in the binding, etc.” — a slave, a woman, and a Kusi are not commanded regarding the binding, and a minor, even one who has reached the age of training, is obligated only rabbinically [Beis Yosef], and see the Biur Halacha. And in all these cases it does not help even for an adult to stand over him and watch him, that they be [written] for their sake.
(ט) בכל - ומי שנקטעה ידו השמאלית אע"פ שאינו בקשירה יכול לכתוב תפילין דגברא בר חיובא הוא אלא פומא הוא דכאיב ליה:
(9) “for any” — and one whose left arm has been amputated, even though he cannot bind [the hand-tefillin], may write tefillin, for he is a man who is inherently obligated; it is only that his limb is impaired (a circumstantial, not an essential, exemption).
(י) עשייתן - ודוקא שעושה מעשה בגוף התפילין כגון חיפוי הבתים ותפירתן וכ"ש עשיית השי"ן בעור הבתים או להגיה איזה אות דעתה הוא פסול וע"י הגהתו יוכשר דזה הוא כתיבה ממש אבל עיבוד הקלף איננו בכלל זה וכשר ע"י עו"ג וכ"ש ע"י אשה רק דבעו"ג בעינן שיהיה ישראל עוע"ג ויראה שיהיה לשמה וכדלעיל בסימן ל"ב ס"ט וה"ה בקטן. והשחרת הבתים והרצועות עיין לעיל בסימן ל"ג שביררנו שם דינם בעזה"י. וגרירת דבק שבין אות לאות לכתחלה יש ליזהר שלא לעשות על ידם ובדיעבד אין להחמיר דגרירה לא מיקרי כתיבה ועיין היטב לעיל בסימן ל"ב סק"פ. וכ"ז בתפילין דבעינן כסדרן אבל בס"ת אם אפשר לגרור צדדי האותיות במקום שנגעו ולחזור ולכותבן יעשה דזה מיקרי לכתחלה:
(10) “their making” — and this is specifically when he performs an action on the body of the tefillin, such as covering the batim (compartments) and sewing them, and all the more so making the shin on the leather of the batim, or correcting some letter that is now invalid and through his correction becomes valid, for this is actual writing. But the processing of the parchment is not included in this, and it is valid [when done] by an idolater, and all the more so by a woman — except that with an idolater we require that a Jew stand over him and see that it is done for the sake [of the mitzvah], as above in siman 32, se’if 9, and likewise regarding a minor. And regarding blackening the batim and the straps, see above in siman 33, where we clarified their law, with God’s help. And regarding scraping off glue that is between one letter and another, at the outset one should be careful not to have it done by them, but after the fact one need not be stringent, for scraping is not called writing; and see well above in siman 32, se’if katan 80. And all this is regarding tefillin, where we require [the writing to be] in order; but in a Torah scroll, if it is possible to scrape the sides of the letters where they touched and then rewrite them, he should do so, for this is considered the ideal way.
(יא) יראה - שלא יהרגוהו ואף דבאמת הי"ל למסור נפשו על אמונת ה' מ"מ לא יצא מכלל ישראל עי"ז כיון דהיה באונס ועי' במ"א שהעלה דאין להקל בזה אפי' אם בצינעא הוא שומר את התורה רק שבהנחת תפילין הוא מתעצל דהלא עכ"פ אינו בקשירה וכ"ש אם הוא מומר לכל התורה כולה אם לא שמחמת פחד שלא יהרגוהו הוא ירא לקיים את התורה אפילו בצינעא. ועיין בביאור הגר"א שמסכים ג"כ להמ"א. עוד כתב המ"א בשם הד"מ דאף דבס"ת ממזר וגר תושב [היינו שקיבל עליו שבע מצות בני נח] פסולים לכתוב כמו שכתב ביו"ד סימן רפ"א אפ"ה בתפילין ומזוזות אין לחוש וכל האחרונים הסכימו דגר תושב פסול לכתיבת סת"ם דהא אינו בקשירה ועיין בבה"ל:
(11) “fear” — that they would kill him. And although in truth he should have given his life for faith in God, nevertheless he has not left the category of Israel through this, since it was under coercion. And see the Magen Avraham, who concluded that one should not be lenient in this, even if he privately keeps the Torah and is merely lax about wearing tefillin, for at any rate he is not included in the binding — and all the more so if he is an apostate to the entire Torah — unless it is out of fear of being killed that he is afraid to fulfill the Torah even in private. And see the commentary of the Vilna Gaon, who also agrees with the Magen Avraham. The Magen Avraham further wrote in the name of the Darchei Moshe that although, for a Torah scroll, a mamzer and a ger toshav (resident alien) [that is, one who has accepted upon himself the seven Noachide commandments] are invalid to write, as is stated in Yoreh Deah, siman 281, nevertheless, for tefillin and mezuzos there is no concern — yet all the later authorities agreed that a ger toshav is invalid for writing STaM, for he is not included in the binding; and see the Biur Halacha.
(יב) אפיקורוס - ועיין בבה"ל:
(12) “a heretic” — and see the Biur Halacha.
(יג) ישרפו - עם אזכרותיהן וכדלקמן בסימן של"ד סכ"א עי"ש דסתמו כשכותב לשם עבו"ג הוא כותב:
(13) “must be burned” — together with the Divine Names in them, as [explained] further on in siman 334, se’if 21, see there, for the presumption is that when he writes, he writes for the sake of idolatry.
(יד) וי"א יגנזו - דאין דרך אפיקורס להניח תפילין ובודאי כתבו למכור לישראל ואפשר שלא כתבו לשם עבו"ג. ודעת המחבר לפסוק כדעה א' לכן כתבו בסתמא וכן דעת הט"ז והפרישה והגר"א בביאורו:
(14) “and some say they should be buried away” — for it is not the way of a heretic to wear tefillin, and surely he wrote them to sell to a Jew, and it is possible that he did not write them for the sake of idolatry. And the opinion of the Mechaber is to rule like the first view, therefore he wrote it without attribution; and such is the opinion of the Taz, the Prisha, and the Vilna Gaon in his commentary.
(טו) יגנזו - מספק שמא הוא כתבן אבל אין לשרוף מספק דהלא כתיב לא תעשון כן לה' אלהיכם:
(15) “they should be buried away” — out of doubt, lest he was the one who wrote them; but they should not be burned out of doubt, for it is written, “You shall not do so to Hashem your God.”
(טז) כשרים - דסתם עו"ג אין בקיאין לכתוב ובודאי ישראל כתבו. ובפרט במקומותינו שידוע שאין א"י יודעין לכתוב אפילו בס"ת שנמצא בידן מסיק הש"ך [ביו"ד בסימן רפ"א סק"ד] דלכו"ע כשרה דתלינן דהא"י בזזו אותה:
(16) “they are valid” — for ordinary idolaters are not skilled in writing, and surely a Jew wrote them. And especially in our regions, where it is known that non-Jews do not know how to write, even regarding a Torah scroll found in their possession, the Shach concludes [in Yoreh Deah, siman 281, se’if katan 4] that according to all it is valid, for we assume that the non-Jews plundered it.
(יז) יותר וכו' - אבל במעט יותר משויין [דהיינו עד כדי חצי דינר בתפילין ולפי ערך זה בס"ת] חייבין לקנות מהן ואף דס"ת שנמצא ביד א"י י"א דיגנז [ביו"ד סימן רפ"א] אעפ"כ חייבין לקנות מהם ואפילו במעט יותר וכדי לגונזן בכדי שלא יבואו העו"ג לזלזל בהם ופשוט דה"ה אם הם פסולין מחמת עצמם ג"כ חייבין לקנות מהעו"ג כדי לגונזן אבל בכתבן אפיקורס דטעונין שריפה א"צ ליקח מהם:
(17) “more, etc.” — but for a little more than their value [that is, up to half a dinar for tefillin, and proportionally for a Torah scroll] one is obligated to buy them; and although a Torah scroll found in the possession of a non-Jew — some say should be buried away [Yoreh Deah, siman 281] — even so, one is obligated to buy them, even for a little more, in order to bury them away, so that the idolaters not come to treat them with disgrace. And it is obvious that likewise, if they are invalid in themselves, one is also obligated to buy them from the idolater in order to bury them away; but those written by a heretic, which require burning, one need not buy from them.
(יח) הרבה - ואעפ"כ לא יסלק עצמו הישראל תיכף ממנו אף שאומר הרבה ומחוייב לעסוק אתו פן ישוה עמו. אך כשהעו"ג עומד על דבריו מניחן בידו. ומבואר בש"ס דאסור לומר לעו"ג שיתנם בזול יותר מדאי דלמא ירגז העו"ג וינהג בהם מנהג בזיון:
(18) “much” — even so, the Jew should not immediately withdraw from him, even though [the non-Jew] demands much, and he is obligated to keep bargaining with him, lest he come to an agreement with him. But when the non-Jew stands firm on his terms, he leaves them in his hand. And it is explained in the Gemara that it is forbidden to tell the non-Jew to give them for too low a price, lest the non-Jew become angry and treat them with disgrace.
(יט) מן המומחה - אבל לא ממי שאינו מומחה אע"פ שהלוקח רוצה לבדקן לפי שיש לחוש שמא יתעצל בבדיקתן מפני שטורח הוא לו להסיר התפירה ולחזור ולתופרן. ופשוט דמי שהוא סופר קבוע לרבים הוא בכלל מומחה. ומזוזה וה"ה פרשיות של תפילין ניקחות אפילו שלא מן המומחה ובתנאי שיבדקנה אח"כ:
(19) “from an expert” — but not from one who is not an expert, even though the buyer intends to check them, because there is concern that he may become lax in checking them, since it is troublesome for him to remove the stitching and re-sew them. And it is obvious that one who is an established scribe for the public is included among experts. And a mezuzah — and likewise the parchment portions of tefillin — may be bought even not from an expert, on condition that he check it afterward.
(כ) לקח - בדיעבד או שאין שם מומחה בעיר:
(20) “if he bought” — after the fact, or when there is no expert in the city.
(כא) לבדקן - בחסירות ויתירות וה"ה בתמונת האותיות אם הם כהלכה וכנ"ל בסי' ל"ו ס"א ואין לחוש שמא עיבדן שלא לשמן דהכל בקיאין בזה:
(21) “to check them” — for the defective and plene spellings, and likewise the form of the letters, whether they are according to halacha, as above in siman 36, se’if 1; and there is no concern that he processed them not for their sake, for everyone is proficient in this.
(כב) ואין השאר - והוא שאומר שכתבן בעצמו או שאומר שלקחן מאדם אחד ותלינן שאותו האדם כתבן הכל בעצמו כיון שהם בצבת א' וכמש"כ הפרישה:
(22) “and the rest [need no checking]” — and this is when he says that he wrote them himself, or when he says that he bought them from one man, and we assume that that man wrote them all himself, since they are in one bundle, as the Prisha wrote.
(כג) גדול - נראה דה"ה אם אמר שלקחן ממומחה:
(23) “a great man” — it appears that the same applies if he said that he bought them from an expert.
(כד) נאמן - דעד אחד נאמן באיסורין וכתב המ"א דעכ"פ בעינן שמכירין אותו שהוא מוחזק בכשרות עיין יו"ד סימן קי"ט ס"ב בהג"ה. ולפי המבואר שם מוכח דאם ראינוהו שלבשן בעצמו נאמן בכל גווני דלעבור בעצמו בודאי אינו חשוד. וע"ש בש"ך סק"א:
(24) “is believed” — for a single witness is believed regarding matters of prohibition. And the Magen Avraham wrote that in any case we require that he be known as one presumed to be trustworthy; see Yoreh Deah, siman 119, se’if 2, in the gloss. And according to what is explained there, it is proven that if we saw him wear them himself, he is believed in all circumstances, for he is surely not suspected of transgressing on his own account. And see there the Shach, se’if katan 1.
(כה) ואינם צריכין בדיקה - שחזקה על חבר שאינו מוציא מת"י דבר שאינו מתוקן:
(25) “and they need no checking” — for there is a presumption regarding a chaver (a scrupulous person) that he does not let anything unfit leave his hands.
(כו) לעולם - שכל זמן שחיפויין שלם הרי הן בחזקתן מן הדין ואין חוששין שמא נמחקה אות מתוכן או ניקבה. ומ"מ נכון לבדקן מפני שמתקלקלין מפני הזיעה. ואם נקרע חיפוי הבתים או שנשרו במים צריכין בדיקה תיכף שמא נמחק הכתב או נתקלקל. וכל שצריך בדיקה מן הדין ואין לו מי שיבדוק ויתפור אותם מניחם בלא ברכה דלא שייך אוקמיה אחזקה כה"ג וכתב הח"א דה"ה אם מונחים במקום לח והכל לפי הענין:
(26) “ever” — for as long as their covering is intact, they retain their presumption [of validity] by law, and we do not suspect that a letter within them has been erased or perforated. Nevertheless it is proper to check them, since they deteriorate from perspiration. And if the covering of the batim tore, or they fell into water, they require checking immediately, lest the writing was erased or damaged. And whenever checking is required by law and he has no one to check and sew them, he wears them without a blessing, for relying on the presumption does not apply in such a case. And the Chayei Adam wrote that the same applies if they are kept in a damp place; and it all depends on the circumstances.
(כז) לפרקים - דחיישינן שמא נתעפשו לכך יבדקם שני פעמים בשמיטה:
(27) “occasionally” — for we are concerned lest they became moldy; therefore he should check them twice within a shemitta cycle (seven years).
(כח) יניחם כך - ולענין ברכה משמע מח"א דצריך לברך והטעם נראה משום דלא ראינו עליהן ריעותא ברורה משא"כ בנשרו במים או שנתקלקל העור וכנ"ל ולמעשה צ"ע. המוצא תפילין מושלכין בגניזה בלא רצועות ופתוחים יש לחוש שיש להם פסול נסתר אבל אם מצאן דרך הינוח בכיסן ליכא למיחש:
(28) “he may wear them as they are” — and regarding a blessing, it is implied from the Chayei Adam that he must recite the blessing, and the reason appears to be that we have seen no clear defect in them, unlike where they fell into water or the leather was damaged, as above; and in practice it requires further study. One who finds tefillin cast into a geniza without straps and open should be concerned that they have a hidden defect; but if he found them placed [properly] in their bag, there is no concern.
