If a person is in doubt whether he prayed, he goes back and prays again, and he need not add anything new (since resolving the doubt is itself the reason for repeating). But if he is certain that he prayed, he does not repeat the prayer without a novelty (some new element in the blessings). By means of such a novelty he may go back and pray a voluntary (nedavah) prayer as many times as he wishes, except for the Musaf prayer, which is not prayed as a voluntary offering. And on Shabbat and Yom Tov he does not pray a voluntary prayer at all. And if he began to pray thinking that he had not prayed, and then remembered that he had already prayed, he stops, even in the middle of a blessing, even if he could add a novelty to it.

(א) אם התפלל - ולענין ק"ש וברכותיה אם נסתפק עיין לעיל בסימן ס"ז:

(1) 'If he prayed' — and regarding the Shema and its blessings, if one became in doubt, see earlier in siman 67.

(ב) חוזר ומתפלל - ומתנה ואומר אם לא התפללתי תהא לחובתי ואם התפללתי תהא לנדבה ואע"פ שכל ספק מד"ס להקל מ"מ הכא חוזר ומתפלל מפני שהלואי שיתפלל אדם כל היום בתורת נדבה וע"י חידוש וכדלקמיה והכא כשחוזר ומתפלל על הספק א"צ חידוש דאין לך חידוש גדול מזה שיצא ידי ספיקו. כתב בדרך החיים דערבית בספק אינו צריך לחזור ולהתפלל תפלת י"ח דקבעוה חובה בודאי לא בספק אבל מדברי הפמ"ג משמע רק דאין חוב עליו לכו"ע עי"ש אבל לכתחילה נכון הוא שיחזור ויתפלל גם בערבית כי באמת גם בערבית אפילו למ"ד רשות מ"מ לכתחילה מצוה היא וממילא מה שיצא ידי ספיקו נחשב כחידוש גם בערבית וכן משמע לענ"ד מלשון הרמב"ם פ"י מהלכות תפלה עי"ש ועצהי"ט יראה לחדש דבר בהחזרה:

(2) 'He goes back and prays' — and he makes a stipulation, saying: If I have not prayed, let this be my obligation, and if I have prayed, let it be a voluntary prayer. And even though in every doubt in a matter of rabbinic origin we rule leniently, nevertheless here he goes back and prays, because it would be desirable for a person to pray the whole day as a voluntary prayer, by means of a novelty, as stated further on. And here, when he goes back and prays on account of the doubt, he does not need a novelty, for there is no greater novelty than this, that he thereby resolves his doubt. The Derech HaChaim wrote that for Maariv, when one is in doubt, he need not go back and pray the Shemoneh Esrei, since they fixed it as an obligation only in a case of certainty, not in a case of doubt. But from the words of the Pri Megadim it is implied only that there is no obligation upon him according to all opinions; see there. But ideally it is proper that he go back and pray also at Maariv, for in truth, even at Maariv, even according to the one who holds it is optional, ideally it is a mitzvah; and consequently the very fact that he resolves his doubt is reckoned as a novelty at Maariv as well. And so it appears, in my humble opinion, from the language of the Rambam in chapter 10 of the Laws of Prayer; see there. And the best advice is that he see to add a novelty in the repeated prayer.

(ג) אינו חוזר וכו' - דתפילות כנגד תמידים תקנום והוי כמקריב שני תמידין לשם חובה שאסור משום בל תוסיף ואפילו התפלל מתחלה ביחיד ועכשיו רוצה להתפלל בצבור אפ"ה אסור:

(3) 'He does not go back, etc.' — for the prayers were instituted to correspond to the daily tamid offerings, and this would be like one who offers two tamid offerings as an obligation, which is forbidden because of "do not add" (bal tosif). And even if he prayed at first as an individual and now wishes to pray with the congregation, it is nonetheless forbidden.

(ד) ומתפלל בנדבה - פי' דוקא בנדבה אבל לשם חובה אפילו בחידוש אסור והא דבעינן חידוש בנדבה דע"י החידוש מינכר מתוכה שתפילתו היא לשם תחנונים ולא לשם חובה ובלא חידוש מיחזי כמי שעושה אותה לשם חובה ועיין בב"י שביאר דעת הטור דה"ה אם מתפלל תפילה שלא בתורת חובה וגם לא התכוין בה לשום נדבה והוא מחדש בה דשפיר דמי דע"י החידוש מינכר שהיא לשם תחנונים ועיין בביאור הלכה:

(4) 'And he prays a voluntary prayer' — that is, only as a voluntary prayer, but as an obligation it is forbidden even with a novelty. And the reason we require a novelty in the voluntary prayer is that through the novelty it is recognizable from within the prayer itself that his prayer is for supplication and not as an obligation; and without a novelty it looks like one who is performing it as an obligation. And see the Beit Yosef, who explained the view of the Tur that the same applies if a person prays a prayer neither as an obligation nor with intent for any voluntary offering, but he adds a novelty in it — that it is acceptable, since through the novelty it is recognizable that it is for supplication. (ה) מתפלת מוסף - ר"ל אפילו דשל ר"ח וחוה"מ כיון שאומר ומוספים כהלכתם והמוספין אינן קרבין אלא משל צבור ואין היחיד יכול לנדב אותם ועיין באחרונים שכתבו דלפ"ז בתפלת מוסף וה"ה בשבת ויו"ט בכל התפילות אם נסתפק אם התפלל אותם אינו יכול לחזור ולהתפלל אותם דהרי צריך להתנות וכנ"ל בסק"ב ובזה אינו יכול להתנות ועיין לקמן בסימן קכ"ד ס"א בבה"ל:

(5) 'Than the Musaf prayer' — that is to say, even the Musaf of Rosh Chodesh and Chol HaMoed, since one recites "and the additional offerings according to their law," and the Musaf offerings are brought only from communal funds, and an individual cannot donate them as a freewill offering. And see the later authorities who wrote that, according to this, regarding the Musaf prayer — and likewise on Shabbat and Yom Tov in all the prayers — if one became in doubt whether he prayed them, he cannot go back and pray them again, for he would need to make a stipulation, as stated above in se'if katan 2, and in this case he cannot make such a stipulation. (ו) כלל - לפי שאין נדרים ונדבות קרבין בהם:

(6) 'At all' — because vow-offerings and freewill-offerings are not brought on them (Shabbat and Yom Tov).

(ז) אפילו יכול וכו' - דתחלת תפילתו היה מסתמא בודאי לשם חובה שהרי היה סבור שלא התפלל עדיין ולא מהני בה חידוש ולכך אפילו אם ירצה עתה לגומרה לשם נדבה לא מהני כיון שכבר התחיל בה לשם חובה דא"א להביא קרבן שחציו חובה וחציו נדבה. וכ"ז כשהתחיל על דעת שלא התפלל אבל אם היה לו ספק אם התפלל והתחיל בתנאי וכנ"ל בסק"ב ונזכר באמצע שהתפלל י"ל דא"צ חידוש וגומר כך לשם נדבה דכיון שהתחיל מתחלה כהוגן אדעתא דספיקא וספק הוי כחידוש תו אין צריך חידוש ובלבוש משמע שגומרה ע"י חידוש אפשר דהוא על צד היותר טוב:

(7) 'Even if he could, etc.' — for the beginning of his prayer was presumably certainly as an obligation, since he thought he had not yet prayed, and a novelty does not help in it (an obligatory prayer cannot be turned voluntary). Therefore, even if he now wishes to finish it as a voluntary prayer, it does not help, since he already began it as an obligation, for it is impossible to bring a sacrifice that is half obligatory and half voluntary. And all this is when he began thinking that he had not prayed; but if he had a doubt whether he had prayed and began with a stipulation, as stated above in se'if katan 2, and remembered in the middle that he had prayed, one could say that he does not need a novelty and may finish it thus as a voluntary prayer, since he began properly from the outset on account of the doubt, and a doubt is like a novelty, so he no longer needs a novelty. And from the Levush it is implied that he finishes it by means of a novelty; possibly that is only by way of preference.

(ח) מהאמצעיות - אבל לא בג' ראשונות ובג' אחרונות וכדלקמן בסימן קי"ב:

(8) 'Of the middle blessings' — but not in the first three or the last three blessings, as stated further on in siman 112.

(ט) כלל - דאין צבור מקריבין קרבן נדבה אלא לקיץ המזבח כשהמזבח בטל וזהו דבר שאינו מצוי לכן אין להתפלל י"ח כנגד זה אבל יחיד יכול להתפלל נדבה ע"י חידוש אפילו בצבור:

(9) 'At all' — for a congregation brings a freewill offering only for the "dessert of the altar" (keitz ha-mizbe'ach), when the altar is otherwise idle, and that is an uncommon occurrence; therefore one should not pray the Shemoneh Esrei corresponding to it. But an individual may pray a voluntary prayer by means of a novelty, even together with the congregation.
