אומר אשליח צבור ישתבח מעומד:

The shaliach tzibbur (prayer leader) recites Yishtabach while standing.

באין לומר ישתבח גאא"כ דאמר ברוך שאמר וקצת פסוקי דזמרה:

One may not say Yishtabach unless he has first recited Baruch She'amar and at least some of Pesukei DeZimra (the verses of praise).

One should not recite the blessing over wrapping oneself in tzitzis in the interval between Pesukei DeZimra and Yishtabach, but rather between Yishtabach and the Yotzer blessing (and see further, siman 54, seif 3). The Rema adds: The shaliach tzibbur, if he did not have a tallis beforehand, should wrap himself in tzitzis before he begins Yishtabach, so that he can say Kaddish immediately after Yishtabach and not make an interruption. (Kol Bo, siman 5.) And likewise, if there is no minyan in the synagogue, the shaliach tzibbur should hold off on saying Yishtabach and stay silent until a minyan arrives, and then say Yishtabach and Kaddish. (Maharil.)

A shaliach tzibbur must be worthy (fit for the role), and who is considered worthy? One who is free of transgressions, and against whom no bad reputation has been raised, even in his youth; who is humble and acceptable to the congregation, has a pleasant manner and a sweet voice, and is practiced in reading Torah, Nevi'im (Prophets), and Kesuvim (Writings).

If they cannot find someone who possesses all of these qualities, they should choose the best member of the congregation in wisdom and good deeds. The Rema adds: And if there is here an unlearned man who is elderly and has a pleasant voice, and the people desire him, and (also) a thirteen-year-old who understands what he says but whose voice is not pleasant, the younger one takes precedence (Mordechai, end of the first chapter of Chullin). One who committed a transgression unintentionally, such as one who killed a person accidentally, and repented, is permitted to be a shaliach tzibbur; but if he acted deliberately, he may not, since in any case a bad name went out about him before his repentance. (Responsum of the Or Zarua on Tractate Berachos.)

One appoints (as a regular chazzan) only one whose beard is full, out of respect for the congregation. But occasionally, once he has grown two (pubic) hairs (a sign of maturity), he may go down before the ark (to lead), provided he is not formally appointed by the congregation or by a shaliach tzibbur who appoints him to lighten his own burden, to pray in his stead at fixed times.

אם אין שם מי שיודע להיות ש"ץ כי אם בן י"ג ויום א' מוטב שיהא הוא ש"ץ משיבטלו מלשמוע קדוש' וקדיש:

If there is no one present who knows how to serve as shaliach tzibbur except one who is thirteen years and one day old, it is better that he serve as the shaliach tzibbur than that they lose out on hearing Kedusha and Kaddish.

One who does not have a (full) beard — as long as it is evident that he has reached the age at which his beard should fill in, we regard his beard as full; we apply this to him, and therefore a twenty-year-old, even though he has no beard, we may appoint him. The Rema adds: And likewise, if he had a beard, even a little, we regard his beard as full, if he is eighteen years old or older. (Beis Yosef in the name of Maseches Sofrim, chapter 14, and the Nimukei Yosef on the chapter 'HaKorei Omed.')

As for a saris (a man who is sexually undeveloped and sterile), there are those who say it is permitted to appoint him, if he is twenty years old.

יש ללמוד זכות על מקומות שנוהגים שהקטנים יורדין לפני התיבה להתפלל לתפלת ערבית לאבמוצאי שבתות: הגה ובמקומות שלא נהגו כן אין לקטן לעבור לפני התיבה אפי' בלבתפלת ערבית אפי' הגיע לכלל י"ג שנים ביום השבת אין להתפלל ערבית של שבת דלגהרי עדיין אין לו י"ג שנה [מהרי"ל]:

One should find justification for those places whose custom is that minors go down before the ark to lead the evening prayer on Motzaei Shabbos (Saturday night). The Rema adds: But in places that did not adopt this custom, a minor should not pass before the ark (to lead), even for the evening prayer. Even if he reached the age of thirteen years on Shabbos day itself, he may not lead the Shabbos evening prayer, for he still is not (a full) thirteen years old (Maharil).

A shaliach tzibbur who draws out the prayer at length so that his sweet voice will be heard — if this is because he rejoices in his heart that he offers thanks to Hashem in a pleasant melody, may a blessing come upon him; provided that he prays with seriousness and stands in awe and reverence. But if he intends to show off his voice and delights in his own voice, this is disgraceful. And in any case, whoever prolongs his prayer does not act well, because of the burden it places on the congregation.

אין ממנין מי שקור' לזלאלפי"ן עייני"ן לחולעייני"ן אלפי"ן:

One does not appoint someone who reads alephs as ayins and ayins as alephs.

A pocheach (the verse 'My servant Yeshayahu went naked' the Targum renders 'My servant Yeshayahu pocheach'), which refers to one whose garment is torn and whose arms are exposed — he should not go down before the ark.

מאסומא יורד לפני התיבה ובלבד מבשלא יקרא בתורה משום דברים שבכתב אי אתה רשאי לאומרם על פה:

A blind man may go down before the ark (to lead), provided he does not read from the Torah (for the congregation), because matters that are written you are not permitted to recite from memory.

ש"צ קבוע יורד לפני התיבה מעצמו מגולא ימתין שיאמרו לו:

A regular (appointed) shaliach tzibbur goes down before the ark on his own and need not wait until he is asked.

מי שאינו ש"צ קבוע צריך מדלסרב מעט קודם שירד לפני התיבה ולא יותר מדאי אלא פעם ראשונ' מסרב וכשיאמרו לו פעם שנייה מכין עצמו כמי שרוצה לעמוד ובפעם שלישית יעמוד ואם האומר לו שירד הוא אדם גדול אינו מסרב לו מהכלל:

One who is not the regular shaliach tzibbur should refuse a little before going down before the ark, but not too much: rather, the first time he declines, and when they ask him a second time he readies himself, like one who wishes to rise, and on the third time he rises (and leads). And if the one telling him to go down is a great (distinguished) man, he does not decline to him at all.

אם טעה ש"ץ וצריכין להעמיד אחר תחתיו אותו שמעמידין תחתיו לא יסרב:

If the shaliach tzibbur made an error and they must appoint another in his place, the one being appointed in his place should not decline.

האומר איני יורד לפני התיבה מפני שבגדי צבועין או מפני שברגלי סנדל מולא ירד מזבאותה תפלה כלל מפני שדרך האפיקורסין להקפיד בכך וחיישינן שמא אפיקורסות נזרקה בו: הגה [ואפי' אם נותן אמחמתלא לדבריו לא מהני] [ב"י בשם ר' יהונתן]:

One who says, 'I will not go down before the ark because my garments are colored,' or 'because there is a sandal on my foot,' should not go down at all for that prayer, because it is the way of heretics to be particular about such things, and we suspect that perhaps heresy has taken root in him. The Rema adds: And even if he offers an excuse for his words, it does not help. (Beis Yosef in the name of Rabbi Yehonasan.)

Some prevent a convert from serving as shaliach tzibbur, but their view has been rejected. Even a single individual may object and say, 'I do not want so-and-so to be chazzan,' unless he had already consented to him from the outset. The Rema adds: This applies only where that individual has a valid reason, in the judgment of the town's leaders; but otherwise, the individual cannot object to the shaliach tzibbur (Mahari Weil, siman 60). And if he hates him, he may object to him before he has consented to him (Maharam Padua, siman 104, and Maharik, root 44). And one who hates the shaliach tzibbur should not be called up to the Torah when he reads the Tochacha (the passage of rebuke). (Or Zarua.)

אם אחד רוצה לומר תפלה נטבשביל אביו ואחד רוצה לומר בשביל אחר מי סשירצה הקהל שיאמר התפלה סאהוא יאמר:

If one person wishes to lead the prayer on behalf of his father, and another wishes to lead on behalf of someone else, whichever one the congregation wants to lead the prayer, he shall lead it.

אין למנות ש"צ ע"פ השר סבאע"פ שרוב הצבור חפצים בו:

One may not appoint a shaliach tzibbur on the authority of the governing officer, even though the majority of the congregation wants him.

A shaliach tzibbur who serves for pay is preferable to one who serves as a volunteer. The Rema adds: A person should not lead the prayer without the congregation's consent; and anyone who leads by force and in a domineering manner, one does not answer Amen after his blessings (Binyamin Ze'ev, siman 163, and the Agudah, chapter 'Keitzad Mevarchin').

סזשכר ש"ץ פורעים סחמקופת הקהל אע"פ שהש"ץ מוציא הדל כעשיר מ"מ אין יד העני משגת כעשיר: הגה ויש אומרים שגובין חסטצי לפי ממון וחצי לפי הנפשות וכן הוא מנהג העקהלות [מהר"ם פאדווה סי' מ"ד]:

The shaliach tzibbur's wages are paid from the community fund, for although the shaliach tzibbur serves the poor man just as the rich man, nevertheless the poor man's means do not reach those of the rich. The Rema adds: And some say that they collect half according to wealth and half according to the number of people, and such is the custom of the communities (Maharam Padua, siman 44).

צבור שצריכין לשכור רב וש"ץ ואין בידם כדי שכר שניהם אם הוא רב מובהק וגדול בתורה ובקי בהורא' עאהוא קודם עבואם לאו ש"ץ קודם:

A community that needs to hire (both) a rav and a shaliach tzibbur and does not have enough to pay both their salaries: if he is an outstanding rav, great in Torah and expert in rendering halachic rulings, he takes precedence; and if not, the shaliach tzibbur takes precedence.

אין מסלקין עגחזן מאומנתו אא"כ נמצא עדבו פסול: הגה ועהאין מסלקין אותו משום רנון בעלמא כגון שיצא עליו שם שעונתפס עם הנכרית אעזו שמסר אדם אבל אם באו עעחליו עדים בזה וכיוצא בזה מעטעבירין אותו ושליח צבור שהוא שוחט ובודק לא יתפלל בבגדים הפצואין ומסריחין ואם אינו רוצה לפאהחליף בגדיו בשעת התפלה ולהתפלל מעבירין אותו. וש"צ המנבל פיו או שמרנן בפבשירי הנכרים מוחין בידו שלא לעשות כן ואם אינו שומע מעבירין אותו [כל בו דף קכ"ה ע"ד] ופגש"צ שהזקין ופדרוצה למנות בנו לסייעו לפרקים אע"פ שאין קול בנו עפהרב כקולו אם ממלא מקומו בשאר דברים בנו קודם לכל אדם ואין הצבור יכולין למחות בידו: [תשובת רשב"א סי' ט']:

One does not remove a chazzan from his post unless a disqualifying fault is found in him. The Rema adds: And one does not remove him merely on account of a rumor, such as where a report emerged that he was caught with a non-Jewish woman or that he informed on a person; but if witnesses came against him regarding this or the like, we remove him. And a shaliach tzibbur who is (also) a shochet and inspector should not pray in soiled, foul-smelling garments; and if he refuses to change his clothes at the time of prayer and to pray, we remove him. And a shaliach tzibbur who speaks foully or who sings with the tunes of the non-Jews, we protest against him not to do so; and if he does not heed, we remove him (Kol Bo, folio 125, column 4). And a shaliach tzibbur who has grown old and wishes to appoint his son to assist him at times, even though his son's voice is not as sweet as his own, if he fills his place in other respects, his son takes precedence over anyone else, and the congregation cannot object to it. (Responsum of the Rashba, siman 9.)

A community accustomed to appoint men over the needs of the public for a set term, and when the term arrives these leave and others enter in their place — whether for the chazzan, for the charity fund, or for the other appointees needed by the community, whether they receive pay for it or do not receive pay — even if they did not fix a term for them, the unstated case follows the stated one, since they were accustomed thus. The Rema adds: There is one who wrote that the shaliach tzibbur should pray from a siddur designated for the congregation, for it was surely written for its (proper) sake (Maharil in the name of the Rokeach).

(א) שליח ציבור וכו' - כדי שיסמוך לו הקדיש מיד ולא יצטרך להפסיק ביניהן בהעמידה לפני התיבה אבל בסימן נ"א ס"ו בהג"ה משמע דאפילו מי שמתפלל ביחידי צריך ג"כ לעמוד באמירת ישתבח ועיין באליהו רבא שתירץ דהתם ממנהגא והכא מדינא וכן כתב הגר"א וכן כתב בעט"ז דנוהגים אנשי מעשה לעמוד כשאומרים ישתבח בין בשבת בין בחול ואפילו ביחידי. כל הט"ו שבחים שבישתבח מן שיר ושבחה עד מעתה יזהר מאד שלא להפסיק ביניהן והמפסיק עונשו גדול אבל א"צ שיהיה בנשימה אחת [ח"א בשם הגר"א וכן כתב הגרי"ע וכן משמע בזוהר תרומה דלא כשל"ה]:

(1) 'The shaliach tzibbur, etc.' — He stands so that he can join Kaddish to it immediately, and will not need to interrupt between them by taking his place before the ark. However, in siman 51, seif 6, in the Rema's gloss, it is implied that even one who prays alone must likewise stand while reciting Yishtabach. See the Eliyah Rabbah, who resolves this: there it is a matter of custom, while here it is a matter of law. The Vilna Gaon wrote likewise, and the Ateres Zahav likewise wrote that men of (pious) deeds are accustomed to stand when they say Yishtabach, whether on Shabbos or a weekday, and even when praying alone. All fifteen expressions of praise in Yishtabach, from 'shir ushvachah' until 'me'atah,' one should be very careful not to interrupt between them, and the punishment of one who interrupts is great; but they need not be said in a single breath (Chayei Adam in the name of the Vilna Gaon; and so the הגרי"ע wrote, and so it is implied in the Zohar, Terumah, contrary to the Shela"h).

(ב) אין לומר - בין ש"ץ ובין אדם אחר:

(2) 'One may not say' — this refers to both the shaliach tzibbur and any other person.

(ג) אא"כ - דישתבח היא הברכה אחרונה שניתקנה לומר לאחר פסד"ז ומתחלת בלא ברוך כי היא סמוכה לברכת ב"ש ע"כ אין לומר אותה בלא ב"ש ולא כטועין שכשהם בדרך או שאר שעת הדחק מתחילין מישתבח שמברכין עי"ז ברכה לבטלה:

(3) 'Unless' — because Yishtabach is the closing blessing instituted to be said after Pesukei DeZimra, and it begins without the word 'Baruch,' since it is adjacent to the blessing of Baruch She'amar (which opens with 'Baruch'); therefore one may not say it without Baruch She'amar. This is not like those who err, who — when traveling or in other pressing circumstances — begin from Yishtabach, thereby reciting a blessing in vain.

(ד) אמר ב"ש - ע"כ אבל או יארצייט שהתאחרו לבוא לבהכ"נ עד קרוב לברכו ומוכרחים לעמוד עכ"פ לומר ישתבח לפני התיבה כי אסור להפסיק בין ישתבח לקדיש יראו עכ"פ לומר מתחלה לעצמם ב"ש ואשרי וכן החזן בשבת שהתאחר לבוא עד קרוב לברכו יראה עכ"פ לומר מתחלה לעצמו ב"ש ואשרי ונשמת וכנ"ל בסימן נ"ב במ"ב סק"ה:

(4) 'He said Baruch She'amar' — that is: A mourner or one observing a yahrzeit who was delayed in coming to the synagogue until close to Barchu, and who must in any case stand to say Yishtabach before the ark — since it is forbidden to interrupt between Yishtabach and Kaddish — should at least take care to first recite for themselves Baruch She'amar and Ashrei. Likewise the chazzan on Shabbos who was delayed in coming until close to Barchu should at least take care to first recite for himself Baruch She'amar, Ashrei, and Nishmas, as explained above in siman 52, in the Mishnah Berurah, note 5.

(ה) אין לברך - אפילו אם לא היה לו טלית עד עתה ואף שהוא בין הפרקים מ"מ כיון שהברכה קאי על פסוקי דזמרה אין ראוי שיהא הפסק בינם לבין ברכה אחרונה דידהו דהברכה ראויה להיות סמוך להמצוה אבל מקודם לזה בפסוקי דזמרה עכ"פ בין הפרקים יניח הטלית ויברך ומכ"ש לענין תפילין דמותר לברך עליהן בין הפרקים ובפרט אם הוא ברבים ומתבייש לישב בלי טלית ותפילין:

(5) 'One should not bless' — meaning even if he had no tallis until now, and even though he is now between the sections (of Pesukei DeZimra), nevertheless, since the blessing (of Yishtabach) pertains to Pesukei DeZimra, it is not fitting that there be an interruption between them and their concluding blessing, for the blessing should be adjacent to the mitzvah. But before this point, during Pesukei DeZimra, he may at least — between the sections — put on the tallis and bless. And all the more so with tefillin, that it is permitted to bless over them between the sections, especially if he is among many people and would be embarrassed to sit without a tallis and tefillin.

(ו) ציצית - וה"ה לענין תפילין. א"ר:

(6) 'Tzitzis' — and the same applies to tefillin. (Eliyah Rabbah.)

(ז) בין ישתבח ליוצר - כ"ז הוא דוקא אם לא היה לו מקודם דאל"ה גם זה אסור וזהו שציין רמ"א ועיין לקמן וכו':

(7) 'Between Yishtabach and Yotzer' — all this applies specifically where he did not have (a tallis) beforehand, for otherwise even this (interval) would be forbidden. This is why the Rema noted, 'And see further, etc.'

(ח) מיהו הש"ץ וכו' - דגנאי הוא לציבור להמתין עליו בין ישתבח לקדיש וגם הקדיש קאי על ישתבח ע"כ יתעטף תיכף בטלית וה"ה בתפילין ויברך אך אם לא הביאו לו הטלית עד לאחר שגמר ישתבח קודם שאמר הקדיש יכול להניח שם ולברך והקהל ימתינו הואיל וא"א בלא"ה וכמו שיתבאר לקמן בסוף סימן נ"ד בהג"ה עי"ש:

(8) 'However, the shaliach tzibbur, etc.' — because it is a disgrace for the congregation to wait for him between Yishtabach and Kaddish, and also because the Kaddish relates to Yishtabach; therefore he should wrap himself at once in the tallis — and likewise the tefillin — and bless. But if the tallis was not brought to him until after he finished Yishtabach, before he said Kaddish, he may put it on there and bless, and the congregation should wait, since there is no alternative in any case, as will be explained at the end of siman 54 in the Rema's gloss. See there.

(ט) ימתין הש"ץ - כדי שיהיה יוכל להסמיך לו אח"כ הקדיש מיד אבל היחיד יאמר ישתבח מיד וכן בשבת אם גמר פסוקי דזמרה קודם הש"ץ יאמר ישתבח מיד:

(9) 'The shaliach tzibbur should wait' — so that he will be able to join Kaddish to it immediately afterward. But an individual (praying alone) should say Yishtabach right away; and likewise on Shabbos, if one finished Pesukei DeZimra before the shaliach tzibbur, he should say Yishtabach right away.

(י) וישתוק - פי' שלא יפסיק בדיבור ויוכל להמתין חצי שעה עם ישתבח ואפילו שהא מחמת אונס כדי לגמור כולה א"צ לחזור לראש:

(10) 'And he should stay silent' — meaning that he should not interrupt with speech, and he may wait even half an hour before saying Yishtabach. And even if he paused due to circumstances beyond his control, in order to complete the whole (of Pesukei DeZimra), he need not go back to the beginning.

(יא) ישתבח וקדיש - ובדיעבד אם גמר ג"כ ברכת ישתבח ואח"כ באו מנין יאמרו עכ"פ שלשה פסוקים מפסוקי דזמרה ויוכל הש"ץ לומר קדיש כי בלא"ה אין לומר קדיש כיון שלא היו בעת אמירת קצת פסוקי דזמרה או ישתבח עכ"פ:

(11) 'Yishtabach and Kaddish' — And after the fact, if he had already finished the blessing of Yishtabach as well, and only then a minyan arrived, they should at least say three verses of Pesukei DeZimra, and then the shaliach tzibbur may say Kaddish; for otherwise Kaddish may not be said, since they were not present when some of Pesukei DeZimra, or at least Yishtabach, was recited.

(יב) צריך - דכתיב נתנה עלי בקולה ע"כ שנאתיה ואחז"ל זה ש"ץ שאינו הגון. והספרים האריכו מאד בגודל גנות הממנים ש"ץ שאינו הגון כי מונעים עי"ז טוב מישראל:

(12) 'Must (be worthy)' — because it is written, 'She raised her voice against Me; therefore I hated her' (Yirmiyahu 12:8), and our Sages expounded: this refers to a shaliach tzibbur who is not worthy. The (mussar) works dwell at great length on the gravity of appointing an unworthy shaliach tzibbur, for through this they withhold good from Israel.

(יג) הגון - וראוי שיהיו בגדי ש"ץ ארוכים שלא יראו רגליו ויכנס לבהכ"נ ראשון ויצא אחרון. ולא יהיה טפש וסכל אלא שיהיה יוכל לדבר בעיסקי הקהל כפי מה שצריך. טוב להדר אחר ש"ץ צדיק בן צדיק כי אינו דומה תפלת צדיק בן צדיק לתפלת צדיק בן רשע ומה שכתב הרא"ש שאין מעלת הש"ץ תלוי ביחוס משפחה דאפילו אם הוא ממשפחה בזויה וצדיק טוב לקרב מזרע רחוקים ר"ל ג"כ רק שאינו מיוחס אבל מ"מ אין אביו רשע [אחרונים] אין מומין פוסלין אלא בכהנים ולא בש"ץ ואדרבה לב נשבר ונדכה אלקים לא תבזה ויש מחמירין בזה לכתחלה היכא דאיכא ראוי והגון כיוצא בו ועיין לקמן בס"ק מ"א לענין סומא מה שכתבנו שם:

(13) 'Worthy' — It is proper that the shaliach tzibbur's garments be long, so that his feet are not seen, and that he enter the synagogue first and leave last. He should not be foolish and simple, but rather able to speak on communal matters as needed. It is good to seek a shaliach tzibbur who is a righteous man, the son of a righteous man, for the prayer of a righteous man who is the son of a righteous man is not like the prayer of a righteous man who is the son of a wicked man. And what the Rosh wrote — that the fitness of the shaliach tzibbur does not depend on family lineage, for even if he is from a lowly family yet righteous, it is good to draw near those of distant lineage — means only that he lacks distinguished lineage, but in any case his father is not wicked (the Acharonim). Physical blemishes disqualify only among Kohanim, not for a shaliach tzibbur; on the contrary, 'a broken and contrite heart, O God, You will not despise' (Tehillim 51:19). But some are stringent about this initially, where there is available a fit and worthy man of comparable stature. And see further, in note 41, regarding a blind man, what we wrote there.

(יד) מעבירות - העובר על השבועה אין ביתו ריקם ואע"פ שעדיין לא העידו עליו מ"מ יש לחוש לקול להושיב ב"ד על ככה ואפילו אם לא עבר רק על שבועת ביטוי דלהבא מ"מ אין ראוי למנותו לש"ץ עי"ש [א"ר] וכתב שם עוד בשם משפט צדק דמי שהוא פסול מחמת עבירה פסול להיות ש"ץ אפילו באקראי וכתב הפמ"ג דהיינו דוקא בשלא עשה תשובה:

(14) 'Of transgressions' — One who violates an oath, his household is not free of consequence; and even though witnesses have not yet testified against him, one should nonetheless be concerned about the report and convene a beis din regarding it. And even if he transgressed only a sh'vuas bittui (a personal oath) concerning the future, it is nevertheless improper to appoint him as shaliach tzibbur; see there (Eliyah Rabbah). And he further wrote there, in the name of the Mishpat Tzedek, that one who is disqualified on account of a transgression is disqualified from being a shaliach tzibbur even occasionally. And the Pri Megadim wrote that this is specifically where he has not repented.

(טו) ושלא יצא וכו' - דוקא למנותו לכתחלה אבל להעבירו ולסלקו אחר שהוחזק ש"ץ אין לנו כיון שלא נשמע עליו עתה מאומה מיהו כשיצא עליו עתה ש"ר והוא קלא דלא פסק אפילו יחיד מוחה עליו להעבירו [כה"ג בשם ראב"ח] ועיין לקמן בסעיף כ"ה בבה"ל מה שכתבנו בזה ואפילו אם נתברר בעדים שחטא אם עשה תשובה אין מעבירין אותו לכו"ע:

(15) 'And that no (bad name) has emerged, etc.' — This applies specifically to appointing him initially; but to depose and remove him after he has been established as shaliach tzibbur, we have no basis, since nothing has been heard against him now. However, when a bad report has now emerged about him, and it is a rumor that has not ceased, even a single individual may protest to have him removed (Knesses HaGedolah in the name of ראב"ח). And see further, at seif 25, in the Biur Halacha, what we wrote about this. And even if it was established through witnesses that he sinned, if he repented, we do not remove him, according to all opinions.

(טז) בילדותו - אפילו נתברר לנו שעשה אז תשובה ע"ז הענין אפ"ה אין למנותו לכתחלה לש"ץ. ש"ץ שכבר העבירוהו ועמד כך ימים ושנים בהסכמת הקהל ורוצים עכשיו למנותו הוי כתחלת קבלה ואפילו מיעוט יכולים למחות. אם המוחים הם המנהיגים הוי כאלו מוחים כל הקהל אם לא במקום שיש בוררים ויש תקנה שלא לשנות גזרתם אז אין מועיל מחאת הפרנסים:

(16) 'In his youth' — Even if it has become clear to us that he repented at that time for this matter, even so, one should not appoint him initially as shaliach tzibbur. A shaliach tzibbur whom they already deposed, and who remained so for days and years with the congregation's agreement, and they now wish to reappoint him — this is like an initial acceptance, and even a minority can object. If the objectors are the community leaders, it is as though the entire congregation objects, unless in a place where there are appointed electors and an ordinance not to alter their decree, in which case the objection of the community leaders is of no avail.

(יז) לעם - כתב בתשובת מהר"מ מינ"ץ יזהר החזן אם יש ריב וקטטה בין שני בע"ב שיהא בשב ואל תעשה הן בדיבור הן במעשה הן בגלוי הן בסתר וכ"ש אם יש עסק ריב עם אדם אחר שאינו מהעיר עם בע"ב שיהא בשב ואל תעשה ואפילו אם אותו האדם הוא מחותנו או קרוב שלו. ואם יש לו שום קטט ואיבה עם אחד מהקהל אז צריך להעמיד את הדבר לפני הרב או הקהל לפשר ולעשות ככל אשר נראה להם נכון ואם יש חסרון ומניעה מצד שכנגדו אז הוא נקי ומה יש לו לעשות:

(17) 'To the people' — In the responsa of Maharam Mintz it is written: The chazzan should take care, if there is a quarrel and strife between two householders, to remain passive and take no action, neither in speech nor in deed, neither openly nor in secret. And all the more so, if there is a dispute between an outsider (not from the town) and a townsman, he should remain passive and take no action, even if that person is his relative by marriage or a kinsman of his. And if he himself has any quarrel or enmity with one of the congregation, then he must bring the matter before the rav or the congregation to arbitrate and to do whatever seems right to them. And if the shortcoming and obstruction is on the side of his opponent, then he is blameless — for what can he do?

(יח) ורגיל לקרות - כדי שיהיו הפסוקים המעורבים בתוך התפלה סדורים בפיו גם אם אינו רגיל לקרות הוא בכלל מסיר אזנו משמוע תורה גם תפלתו תועבה [א"ר]. כתב בפמ"ג בסימן תקפ"א ס"א איתא דבר"ה ויוה"כ בעינן שיהא נשוי ובן שלשים ומשמע בשאר ימות השנה אפילו אינו נשוי מ"מ נ"ל דנשוי קודם לבחור ואפילו אם נתמלא זקנו:

(18) 'And accustomed to read' — so that the verses interwoven within the prayers will be fluent on his lips. Also, if one is not accustomed to read (Scripture), he is included in 'one who turns his ear from hearing Torah — even his prayer is an abomination' (Mishlei 28:9) (Eliyah Rabbah). The Pri Megadim wrote, in siman 581, seif 1: it is stated that for Rosh Hashanah and Yom Kippur we require that he be married and thirty years old, and it is implied that during the rest of the year even one who is not married (may serve). Nevertheless, it seems to me that a married man takes precedence over a bachelor, even if the bachelor's beard has filled in.

(יט) הוא קודם - אפילו להיות ש"ץ קבוע כל שהוא י"ג שנה והביא שתי שערות:

(19) 'He takes precedence' — even to be a permanent shaliach tzibbur, as long as he is thirteen years old and has grown two hairs.

(כ) מותר להיות - דלא מיקרי אין פרקו נאה אלא דוקא שהיה מועד לעשות דברים שאינן מהוגנים אבל מי שבא לידו שגגת מעשה ומתחרט ה"ז צדיק גמור לכל דבריו ומותר למנותו לכתחלה לש"ץ:

(20) 'Is permitted to be' — for one is not called 'whose conduct is unseemly' except specifically where he was in the habit of doing improper things; but one to whom an inadvertent act occurred and who regrets it, he is a wholly righteous man in all respects, and may be appointed even initially as shaliach tzibbur.

(כא) עשה במזיד - לאו דוקא הרג דה"ה שאר עבירות וכדלעיל בסעיף ד' דבעינן שלא יצא עליו שם רע אפילו מילדותו וכ"כ בכל בו בפירוש [א"ר]:

(21) 'Acted deliberately' — not specifically killing, for the same applies to other transgressions, as (stated) above in seif 4, that we require that no bad name have emerged about him, even from his youth. And so, too, the Kol Bo wrote explicitly (Eliyah Rabbah).

(כב) דמ"מ יצא וכו' - עיין במ"א שהביא בשם הרבה פוסקים דאפילו במזיד כל ששב שרי להיות ש"ץ קבוע דדוקא לענין ת"צ מחמרינן שלא יצא עליו ש"ר אפילו מילדותו אבל להיות ש"ץ קבעו לשאר ימות השנה מותר למנותו אפילו לכתחלה כל ששב בתשובה וכזה הביא הפמ"ג בשם א"ר להלכה וכתב בא"ר דבימים נוראים עכ"פ יש להחמיר לדון בדין תעניות דבאמת אפילו בשאר ימות השנה יש בזה הרבה דיעות בין הפוסקים עיין בכה"ג ובביאור הגר"א וכ"ז היינו שלא למנותו לכתחלה אבל אין מסלקין אותו לכו"ע אם שב בתשובה. ש"ץ שהוציא פעמים רבות טריפות מת"י מסלקין אותו מש"ץ דשוב דיינינן ליה כמזיד ועיין בפמ"ג דמסתפק דאפילו בפ"א ידינוהו כמזיד. ומ"מ אם שב בתשובה אין מסלקין אותו מש"ץ אפילו אם הוציא פעמים רבות:

(22) 'Since in any case (a bad name) went out, etc.' — See the Magen Avraham, who cites in the name of many poskim that even one who sinned deliberately, so long as he has repented, may be a permanent shaliach tzibbur; for it is specifically regarding a communal fast that we are stringent that no bad name have emerged about him, even from his youth, but to be a permanent shaliach tzibbur for the rest of the year, he may be appointed even initially, so long as he has repented. The Pri Megadim cited such a ruling in the name of the Eliyah Rabbah as the halacha. And the Eliyah Rabbah wrote that on the Days of Awe, at least, one should be stringent and judge (the case) by the law of a fast day; for in truth, even for the rest of the year there are many opinions on this among the poskim — see the Knesses HaGedolah and the commentary of the Vilna Gaon. All this refers to not appointing him initially; but as for removing him, we do not remove him, according to all opinions, if he has repented. A shaliach tzibbur (who is also a shochet) who many times let treifos out from under his hand — we remove him from being shaliach tzibbur, for we then judge him as a deliberate sinner. And see the Pri Megadim, who is in doubt whether even a single time we would judge him as deliberate. But in any case, if he repented, we do not remove him from being shaliach tzibbur, even if he let out treifos many times.

(כג) כבוד הצבור - ואין הצבור יכולים למחול על כבודם בזה:

(23) 'The honor of the congregation' — and the congregation cannot waive its honor in this matter.

(כד) באקראי - כ"ז בשאר ימות השנה אבל בתעניות ובר"ה ויוה"כ אפילו באקראי אין מורידין למי שלא נתמלא זקנו וגם בזה אין להקל אפילו ע"י מחילת הצבור:

(24) 'Occasionally' — all this is during the rest of the year, but on fast days, Rosh Hashanah, and Yom Kippur, even occasionally, we do not send down (to lead) one whose beard has not filled in; and in this too one may not be lenient, even with the congregation's waiver.

(כה) משהביא שתי שערות - ר"ל אחר שהגיע לי"ג שנה דקודם לא מהני השערות ועיין במ"א שכתב דמסתמא אין צריך לבדוק אחר השערות בזה דבדבר דרבנן אזלינן בתר רובא שמביאין ב' שערות באותו הזמן ועיין בפמ"ג שכתב דלהרמב"ם דסובר תפלה דאורייתא יהיה אסור להש"ץ הזה להוציא ידי אחרים בתפלה עד שנדע בודאי שהביא ב"ש ע"ש:

(25) 'Once he has grown two hairs' — that is to say, after he has reached thirteen years, for before that the hairs are of no effect. And see the Magen Avraham, who wrote that presumably one need not check for the hairs in this case, for in a rabbinic matter we follow the majority, who grow two hairs by that age. And see the Pri Megadim, who wrote that according to the Rambam, who holds prayer is a Torah obligation, it would be forbidden for such a shaliach tzibbur to fulfill others' obligation through his prayer, until we know with certainty that he has grown two hairs. See there.

(כו) ידועים - דזה הוי קביעות לאותם העתים ואין בכלל זה אם מינוהו הקהל שיהיה הוא מוכן להתפלל אם לפעמים לא יהיה החזן בבהכ"נ שיעמוד זה להתפלל אין בזה איסור כלל דאין זה מיקרי קבוע כיון שאפשר שלא יבוא לידי כך ולא אסרו בקבוע אלא לעתים ידועים שבאותו העת הוא קבוע בודאי [ט"ז] וב"ח וא"ר חולקין דג"ז מיקרי קבוע ולא מקרי אקראי אלא כשלא נתמנה כל עיקר:

(26) 'Fixed (times)' — for this constitutes a fixed appointment for those times. But not included in this is where the congregation designated him to be ready to lead, so that if at times the chazzan is not in the synagogue, this one would rise to lead — in this there is no prohibition at all, for this is not called a fixed appointment, since it is possible the situation will not arise. They forbade only a fixed appointment for defined times, when at that time he is certainly the fixed leader (Taz). But the Bach and the Eliyah Rabbah disagree, holding that this too is called a fixed appointment and is not called occasional, except where he was not appointed at all.

(כז) שאין לו זקן - ולפי גירסת הגר"א במסכת סופרים פי"ד עי"ש יהיה תלוי דין זה בדין מינוי הסריס המבואר בס"ט:

(27) 'Who has no beard' — and according to the Vilna Gaon's textual reading in Maseches Sofrim, chapter 14 — see there — this law would depend on the law of appointing a saris, explained in seif 9.

(כח) סריס - דהיינו שנראו בו סימני סריס דאל"ה כיון שלא הביא שתי שערות אמרינן עדיין הוא קטן כמו שכתב סימן נ"ה ס"ה עי"ש במ"ב. ומהרש"ל בחולין סימן מ"ה כתב שאין למנות סריס דגנאי הוא לצבור:

(28) 'A saris' — meaning that the signs of a saris are evident in him; for otherwise, since he has not grown two hairs, we say he is still a minor, as is written in siman 55, seif 5 — see there in the Mishnah Berurah. And the Maharshal, in (his commentary on) Chullin, siman 45, wrote that one should not appoint a saris, for it is a disgrace to the congregation.

(כט) בן עשרים - דקודם אפילו נראו בו סימני סריס בלא"ה לא יוכל להיות ש"ץ אפילו באקראי דעדיין הוא קטן:

(29) 'Twenty years old' — for before that age, even if the signs of a saris are evident in him, he still cannot be a shaliach tzibbur, even occasionally, since he is still (considered) a minor.

(ל) תפלת ערבית - לפי שאין מוציאין את הרבים ידי חובתן שהרי אינן מחזירין את התפלה רק שאומרים ברכו וקדיש. ועוד טעמים אחרים עיין בב"י וכ"ז נדחק רק לקיים המנהג אבל הוא בעצמו סובר דאין נכון לכתחלה לעשות כן:

(30) 'The evening prayer' — because (at Maariv) the leader does not fulfill the obligation of the many on their behalf, for they do not repeat the Amidah aloud; they only say Barchu and Kaddish. And there are other reasons — see the Beis Yosef. All this is a strained justification, only to uphold the custom; but he himself holds that it is not proper to do so initially.

(לא) במוצאי שבתות - ה"ה ערבית דחול אלא שהמנהג שנהגו באותן המקומות היה במוצאי שבתות:

(31) 'On Motzaei Shabbos' — the same applies to a weekday evening prayer; it is only that the custom that took hold in those places was on Motzaei Shabbos.

(לב) בתפילת ערבית - משום ברכו שבה וה"ה שלא יפרוס על שמע למי שלא שמע ברכו בשחרית דבאמת ברכו נמי מצוה על כל הצבור לשמען שחרית וערבית וקטן שאין חייב אינו מוציאם בזה:

(32) 'For the evening prayer' — because of the Barchu it contains. And likewise he should not lead the Barchu of Shema for one who did not hear Barchu at Shacharis, for in truth Barchu too is a mitzvah incumbent on the whole congregation to hear, morning and evening, and a minor, who is not obligated, cannot discharge their obligation in this.

(לג) דהרי עדיין - ר"ל במקומות שנוהגין להתפלל של שבת בע"ש מבעוד יום משום תוספת שבת מ"מ הרי עדיין לא נשלמו לו י"ג שנה עד ליל שבת שתוספת שבת אינו מועיל לענין שנות ימי הנער אבל אם מתפלל בלילה ערבית אחר צאת הכוכבים מותר לירד לפני התיבה ומה שאמר בכל מקום י"ג שנה ויום אחד לא שצריך יום אחד יותר אלא ר"ל שצריך י"ג שנים שלימות מיום אל יום לאפוקי חסרון מקצת שעות הלכך מיד בתחלת לילה נתמלאו שנותיו והוי גדול. ואפילו נולד ביום ר"ה קודם בין השמשות נעשה ב"מ בתחלת ליל ר"ה של שנת י"ד:

(33) 'For (he) still' — that is to say, in places where the custom is to pray the Shabbos service on Friday while it is still day, on account of tosefes Shabbos (adding to Shabbos), nevertheless he has still not completed his thirteen years until Shabbos night, for tosefes Shabbos does not count regarding the reckoning of the youth's years. But if he prays the evening service at night, after the stars come out, he is permitted to go down before the ark. And what is stated everywhere, 'thirteen years and one day,' does not mean that one extra day is required, but rather means that a full thirteen years, from day to day, are required, excluding any shortfall of a few hours; therefore, immediately at nightfall his years are complete and he is an adult. And even if he was born on Rosh Hashanah day before twilight, he becomes an adult at the onset of Rosh Hashanah night of his fourteenth year.

(לד) ש"ץ - מי שיש לו קול נעים ירנן להקב"ה ולא שאר רננות ואם רקק יקנח פיו ואח"כ יתפלל [ס"ח סי' רנ"א]:

(34) 'A shaliach tzibbur' — one who has a pleasant voice should sing to the Holy One, blessed be He, and not (waste it on) other songs; and if he spat, he should wipe his mouth and then pray (Sefer Chasidim, siman 251).

(לה) מגונה - איתא בס"ח בשעה שרשב"ג יצא לדין ליהרג אמר לר' ישמעאל כה"ג אחי מפני מה אני יוצא ליהרג א"ל שמא היית דורש ברבים ושמח לבך ונהנית מד"ת א"ל אחי נחמתני:

(35) 'Disgraceful' — It is related in Sefer Chasidim: when Rabban Shimon ben Gamliel was led out to be judged and put to death, he said to Rabbi Yishmael the Kohen Gadol, 'My brother, why am I being led out to be killed?' He replied, 'Perhaps you were expounding in public, and your heart rejoiced, and you took (excessive) pleasure in words of Torah.' He said to him, 'My brother, you have comforted me.'

(לו) הצבור - כתב בים של שלמה סי' נ' אסור לו להאריך שלא ברצון הקהל אפילו בשבת ויו"ט ואף ברצון הקהל יותר מדאי מגונה כי אין זה לא מחציו לד' ולא מחציו לכם. כתב שכנה"ג בשם תשובת ר"י ברונא ש"ץ שנפסל קולו אם נשמע כאלו הוא מרתת ושבור פסול. עוד כתב אם שני חזנים שוים כהן קודם ללוי לוי לישראל ות"ח קודם לע"ה אפילו הוא כהן וכ"ש לוי:

(36) 'The congregation' — The Yam Shel Shlomo wrote, siman 50: he is forbidden to prolong (the prayer) against the congregation's wishes, even on Shabbos and Yom Tov; and even with the congregation's consent, prolonging it too much is disgraceful, for this is neither 'half of it for Hashem' nor 'half of it for you.' The Shiyurei Knesses HaGedolah wrote in the name of the responsa of Rabbi Yisrael Bruna: a shaliach tzibbur whose voice became impaired — if it sounds as though he is trembling and broken — is disqualified. He further wrote: if two chazzanim are equal, a Kohen takes precedence over a Levi, and a Levi over a Yisrael, and a Torah scholar takes precedence over an unlearned man, even if the latter is a Kohen, and all the more so a Levi.

(לז) לאלפי"ן עייני"ן - פי' הברת העין הוא בחוזק ועמוקה יותר מהברת האלף וה"ה למי שקורא חתי"ן ההי"ן או שקורא לשיבולת סיבולת. ואם כולם מדברים כך מותר להיות ש"ץ [מ"א בשם הרדב"ז] ודע עוד דה"ה לכל מי שאינו יכול להוציא האותיות כתיקונן כגון שהוא כבד פה וכבד לשון ג"כ אין מורידין אותו לפני התיבה [כן מוכח מהרמב"ם פט"ו מהלכות נשיאת כפים ה"א ופ"ח מה' תפלה הלכה י"ב עי"ש בכ"מ וצ"ע מירושלמי פ' היה קורא הלכה ד' דאיתא שם היה לשונו ערוך ע"ש בפני משה דמתיר בענין זה מפני שמ"מ אינו משנה האותיות מהוייתן עי"ש אכן לפי מה שפירש שם הבעל ספר חרדים את דברי הירושלמי ניחא]:

(37) 'Alephs as ayins' — meaning that the pronunciation of the ayin is forceful and deeper than the pronunciation of the aleph. And the same applies to one who reads chesim as hei's, or who reads 'shibboles' as 'sibboles.' But if everyone (in that place) speaks that way, he is permitted to be a shaliach tzibbur (Magen Avraham in the name of the Radbaz). Know further that the same applies to anyone who cannot pronounce the letters properly, such as one who is heavy of mouth and heavy of tongue — he too is not sent down before the ark (this is proven from the Rambam, chapter 15 of Hilchos Nesias Kapayim, halacha 1, and chapter 8 of Hilchos Tefillah, halacha 12 — see there in the Kesef Mishneh). But this requires further study from the Yerushalmi, chapter 'Hayah Korei,' halacha 4, where it is stated 'if his tongue was fluent' — see there in the Pnei Moshe, who permits in such a case, since in any event he does not alter the letters from their essence — see there; however, according to how the author of Sefer Chareidim there explained the words of the Yerushalmi, it is resolved).

(לח) ולעייני"ן אלפי"ן - עיין בפר"ח שהעלה דבזמן דליכא אחר ראוי כמותו מותר להורידו לתיבה אפילו בחתי"ן ההי"ן אבל בעל פני משה הנ"ל חולק עליו וסובר דאפילו בדליכא אחר לא שרי כ"א היכא דכשהוא מכוין לקרות אותו לחי"ת על ידי טורח יכול לקרות אותו שפיר ונראה עוד דאפי' לפר"ח אין מותר למנותו לש"ץ בקבע פן יזדמן מחר אחר טוב ממנו רק לפעם זה מותר להורידו בדליכא ראוי כמותו כההיא מעשה דר"ח שם בגמרא:

(38) 'And ayins as alephs' — See the Pri Chadash, who concluded that at a time when there is no other as fit as he, he may be sent down to the ark, even (one who reads) chesim as hei's. But the author of the Pnei Moshe, mentioned above, disagrees with him, and holds that even where there is no other, it is not permitted, except where, when he takes care to pronounce it as a ches with effort, he is able to pronounce it properly. And it further seems that even according to the Pri Chadash, it is not permitted to appoint him as a permanent leader, lest tomorrow another, better than he, become available; only for this one occasion is it permitted to send him down, where there is no other as fit as he, as in that incident of ר"ח there in the Gemara.

(לט) וזרועותיו - וגם כתפיו:

(39) 'And his arms' — and also his shoulders.

(מ) לפני התיבה - להעשות ש"ץ להתפלל אבל פורס הוא על שמע לבד וגם אינו קורא בתורה שגנאי הוא:

(40) 'Before the ark' — to become the shaliach tzibbur to lead the prayer; but he may lead the Barchu of Shema alone, and he also does not read from the Torah, for it is a disgrace (in his torn state).

(מא) סומא - אפילו בשתי עיניו וחייב בכל המצות מן התורה דקי"ל כרבנן דר' יהודא. ובתשובת חות יאיר סי' קע"ו העלה שאעפ"כ לא יתפלל סומא בימים נוראים אפי' באחד מעיניו היכא דאיכא אחר ראוי והגון כיוצא בו ע"ש טעמו ובספר אליהו רבא באות י' חולק עליו ונ"ל דאף לדברי החו"י היינו רק שלא למנותו לכתחלה אבל לא לסלקו מש"ץ אם נעשה סומא. ש"ץ שיש לו כבידות אזנים שאינו שומע כלל מסיק בחידושי רע"א דלא יהיה ש"ץ דאף דאם לא השמיע לאזנו יצא מ"מ כיון דלכתחלה צריך להשמיע לאזנו אינו מוציא אחרים לכתחלה:

(41) 'A blind man' — even one blind in both eyes; and he is obligated in all the mitzvos by Torah law, for we rule like the Rabbanan against Rabbi Yehudah. And in the responsa Chavos Yair, siman 176, he concluded that even so, a blind man should not lead on the Days of Awe, even one blind in only one eye, where there is another, fit and worthy, of comparable stature — see there for his reasoning. And in the Eliyah Rabbah, in note 10, he disagrees with him. And it seems to me that even according to the Chavos Yair, this is only not to appoint him initially, but not to remove him from being shaliach tzibbur if he became blind. A shaliach tzibbur who has such heaviness of hearing that he cannot hear at all — the Chidushei Rabbi Akiva Eiger concludes that he should not be a shaliach tzibbur, for although one who did not make (the prayer) audible to his own ear has fulfilled his obligation, nevertheless, since one should ideally make it audible to his ear, he does not discharge others' obligation in the first instance.

(מב) שלא יקרא - עיין לקמן סימן קל"ט ס"ד בהג"ה:

(42) 'That he not read' — see further, siman 139, seif 4, in the Rema's gloss.

(מג) ולא ימתין - שהרי כבר מינוהו לזה:

(43) 'And need not wait' — for they have already appointed him for this.

(מד) לסרב - שליח ציבור שלא רצה להיות עוד ש"ץ וקבלו אחר במקומו א"צ רשות כיון שבידו עוד להיות ש"ץ ודוקא מהקהל א"צ רשות אבל מהש"ץ השני צריך ליטול רשות כן כתב בתשובת יד אליהו ולפי מה שביארנו בבה"ל גם ש"ץ כזה צריך ליטול רשות מתחלה:

(44) 'To decline' — A shaliach tzibbur who no longer wished to serve, and they accepted another in his place — he needs no permission (to resume), since it is still within his power to be shaliach tzibbur. This is specifically that he needs no permission from the congregation, but from the second shaliach tzibbur he must obtain permission; so it is written in the responsa Yad Eliyahu. And according to what we explained in the Biur Halacha, even such a shaliach tzibbur must obtain permission at the outset.

(מה) כלל - דאין מסרבין לגדול. וכתבו התוספות סוף פרק ז' דפסחים דבדבר גסות ושררה אפילו האומר לו הוא אדם גדול יסרב:

(45) 'At all' — for one does not decline to a great man. And Tosafos wrote, at the end of chapter 7 of Pesachim, that in a matter of arrogance and authority, even if the one addressing him is a great man, he should decline.

(מו) לא ירד - ואפילו אם הוא מתחרט אח"כ ואומר הריני עובר בצבועים לא שבקינן ליה:

(46) 'He should not go down' — and even if he later regrets it and says, 'Here, I will lead even in colored garments,' we do not allow him.

(מז) באותה תפלה - דכיון שלא שמענו ממנו בהדיא דברי אפיקורסות די לחוש עי"ז לאותה תפלה לבד:

(47) 'For that prayer' — since we did not hear explicit words of heresy from him, it is enough to be concerned on this account for that prayer alone.

(מח) אמתלא - כגון שאמר שדיבורו היה לכבוד המקום וללבוש לבנים מ"מ כיון שהצבור בקשו ממנו להתפלל להם כך לא היה לו להיות סרבן כיון דמדינא מותר. כתב הפר"ח דוקא אם אח"כ אמר האמתלא אבל אם מיד כשאמר שאיני עובר בצבועים אמר תיכף הטעם שאין דרך כבוד לד' כ"א בלבנים ירד עי"ש:

(48) 'An excuse' — such as if he said that his statement was for the honor of the Omnipresent, to wear white; nevertheless, since the congregation asked him to lead them (as is), he should not have been obstinate, since by law it is permitted. The Pri Chadash wrote: this is specifically if he stated the excuse afterward; but if immediately, when he said 'I will not lead in colored garments,' he at once gave the reason, that it is not honorable to Hashem except in white, he may lead — see there.

(מט) מלהיות ש"ץ - לפי שלא יוכל לאמר אלהי אבותינו אבל כשהוא מתפלל בינו לבין עצמו יאמר אלהי אבות ישראל:

(49) 'From being a shaliach tzibbur' — because he (a convert) cannot say 'God of our fathers'; but when he prays by himself, he says 'God of the fathers of Israel.'

(נ) ונדחו דבריהם - דהוא יכול לומר ג"כ אלהי אבותינו דאברהם נקרא אב המון גוים כדכתיב כי אב המון וגו' מפני שלמד לכל העולם אמונת ד'. ש"ץ ממזר תלוי במחלוקת אם ממזר כשר לכתוב תפילין [כן כתוב בשיורי כנה"ג] ולפי זה להמ"א בסי' ל"ט שכתב בשם הד"מ דמותר לכתוב תפילין מותר להיות ש"ץ אמנם בספר ברכי יוסף ביו"ד רפ"א מסיק דש"ץ לא יהיה ותפילין שכתב כשרים:

(50) 'And their words are rejected' — for he too can say 'God of our fathers,' since Avraham is called 'father of a multitude of nations,' as it is written, 'For a father of a multitude (of nations I have made you),' etc., because he taught the whole world faith in Hashem. Whether a mamzer may be a shaliach tzibbur depends on the dispute over whether a mamzer is fit to write tefillin (so it is written in the Shiyurei Knesses HaGedolah). Accordingly, per the Magen Avraham in siman 39, who wrote in the name of the Darchei Moshe that a mamzer may write tefillin, he may also be a shaliach tzibbur. However, in the Birkei Yosef, on Yoreh De'ah, beginning of siman 281, he concludes that he should not be a shaliach tzibbur, though the tefillin he wrote are valid.

(נא) יכול לעכב - בעת ההתמנות והטעם שהרי התפלות במקום התמידים תקנום וכל ישראל יש להם חלק בתמידים ומי יוכל להקריב קרבנו שלא מדעתו אם לא שכבר הסכים עליו ואז אין יחיד וגם חצי הקהל יכולין להעבירו אפי' רוצים ליתן לו שכרו משלם כיון שלא עשה שלא כהוגן אבל רוב הקהל יכולין להעבירו אם נותנין לו שכרו משלם [א"ז] ועכשיו הרשות להעבירו רק ביד ז' טובי העיר או הנבררים כל מקום ומקום לפי התקנה [פמ"ג]:

(51) 'May object' — at the time of the appointment. The reason: the prayers were instituted in place of the daily tamid offerings, and all of Israel have a share in the tamid offerings, and who can offer his sacrifice without his consent, unless he had already agreed to him? And then neither an individual nor even half the congregation can remove him, even if they are willing to pay him his full wage, since he did nothing improper; but the majority of the congregation can remove him if they pay him his full wage (Or Zarua). And nowadays the authority to remove him lies only with the seven town leaders or the appointed electors, each and every place according to its ordinance (Pri Megadim).

(נב) איני רוצה - ודוקא שיש ש"ץ אחר שיוכלו הקהל להשכירו בדמיו אבל אם אינו בנמצא או שהוא בנמצא אלא שבא להוסיף בדמים יכולין הקהל לומר לו אין בידינו להוסיף אלא הוא יוסיף משלו ואף אם יברר טענתו שזה השני הוא מעולה מן הראשון כנגד תוספות הדמים אפ"ה יכולין הקהל לומר אין יכולת כ"כ בידינו להוסיף בדמים:

(52) 'I do not want' — This is specifically where there is another shaliach tzibbur whom the congregation could hire for his price; but if none is available, or one is available yet demands a higher price, the congregation may tell him, 'It is not in our means to add more; rather, let him (the objector) add from his own funds.' And even if he substantiates his claim that this second one is superior to the first, warranting the extra cost, even so the congregation may say, 'We do not have such great means to add to the price.'

(נג) שפלוני יהיה חזן - ה"ה בכל המינוים יכול למחות אפילו בחכם מרביץ תורה [תופס ישיבה] ודוקא כשרוצה לקבל אחר אבל אם מוחה שאינו רוצה שיהיה מרביץ תורה בקהל פשיטא שאין במחאתו כלום ואפילו המיעוט יכולין לכוף לרוב ואפילו ברוצה למנות אחר אם אותו שרוב הקהל מסכימים עליו הוא עדיף מזה ג"כ אינו יכול למחות ואפשר דאפילו מיעוט יכולין לכוף לרוב לשכור מעולה [כנה"ג] כתבו האחרונים שזה הדין דשו"ע הוא דוקא בימיהם אבל היום שידוע שבעו"ה הרבה מחזיקין במחלוקת בלי טעם וריח וכונתם שלא לש"ש אם היו צריכין לשאול לכל יחיד ויחיד בענין המינויים בין לענין מינוי הש"ץ או מרביץ תורה ואב"ד בעיר וכל כה"ג לא היו מסכימים לעולם ע"כ הולכין אחר רוב פורעי המס ואפילו פסולי קורבי ביניהם [מ"א] ועכשיו המנהג שהולכין אחר ז' טובי העיר או אחר הנבררים מן הקהל ע"ז כל מקום ומקום לפי מנהגו [פמ"ג] והכל שלא ירבו המחלוקת ואין משגיחין על יחיד והמ"א כתב עוד טעם דלא שייך היום דין דעיכוב יחיד לענין ש"ץ דדוקא בזמניהם שהיה הש"ץ מוציא רבים י"ח בתפילתו אז היה יחיד יכול לעכב דאין נעשה שלוחו בע"כ משא"כ עתה שכולם בקיאים רק הש"ץ הוא לפיוטים אע"פ שאומר קדיש וברכו אין כל כך קפידא:

(53) 'That so-and-so be chazzan' — the same applies to all communal appointments — he may object, even to a scholar who disseminates Torah (a rosh yeshiva); but only when he wishes to accept another in his stead. But if he objects because he does not want there to be one who disseminates Torah in the community, obviously his objection has no substance, and even the minority can compel the majority (to appoint one). And even when he wishes to appoint another, if the one on whom the majority of the congregation agrees is superior to this one, he likewise cannot object; and possibly even the minority can compel the majority to hire the superior one (Knesses HaGedolah). The Acharonim wrote that this ruling of the Shulchan Aruch applies specifically in their times, but today, when it is known that — in our many sins — many cling to strife without rhyme or reason, and their intent is not for the sake of Heaven, if one had to consult each and every individual regarding the appointments, whether regarding appointing the shaliach tzibbur, or one who disseminates Torah, or the av beis din of the city, and all such matters, they would never reach agreement; therefore we follow the majority of the tax-payers, even (counting) those disqualified by kinship among them (Magen Avraham). And nowadays the custom is to follow the seven town leaders, or those elected by the congregation over this, each and every place according to its custom (Pri Megadim). and all this is so that strife will not multiply, and one does not heed an individual. And the Magen Avraham gave a further reason why an individual's objection does not apply today regarding a shaliach tzibbur: for it was specifically in their times, when the shaliach tzibbur discharged the many's obligation with his prayer, that an individual could object, since one cannot be made his agent against his will; whereas now, when everyone is proficient and the shaliach tzibbur is only for the piyutim, even though he says Kaddish and Barchu, there is not so much objection.

(נד) מתחלה - ואם קבלוהו לזמן ונשלם הזמן לא מקרי הסכים עליו מתחלה דעכשיו הוי קבלה חדשה וכאלו לא היה שם עדיין [ט"ז] ועיין מה שכתבנו בסוף ס"ק הקודם. ראובן שהיה ש"ץ שכיר שנה והשלים שנתו והתחיל להתפלל ימים מספר מהשנה החדשה ומקצת אנשים מיחו בו באמרם שכבר נשלם השנה שהשכירוהו ושאינם רוצים אותו עוד והש"ץ טען שמאחר שכבר התחיל להתפלל בהימים נוראים שהם מהשנה החדשה ולא מיאנו בו שלהיותו שכיר שנה מקצתה ככולה ושיפרעו לו משלם פסק בתשובת מ"ץ דהדין עם הש"ץ. עיין לקט הקמח י"ד ע"א:

(54) 'From the outset' — And if they accepted him for a fixed term and the term ended, it is not called 'having agreed to him from the outset,' for now it is a new acceptance, as though he had not yet been there (Taz). And see what we wrote at the end of the previous note. Reuven, who was a shaliach tzibbur hired by the year and completed his year, then began to lead for a number of days into the new year, and some people objected to him, saying that the year for which they hired him was already over and that they no longer wanted him; and the shaliach tzibbur argued that since he had already begun to lead on the Days of Awe, which belong to the new year, and they had not objected to him — for as a yearly hire, part of the year is like the whole, and they must pay him in full — the responsum מ"ץ ruled that the law is with the shaliach tzibbur. See Leket HaKemach, folio 14a.

(נה) טובי העיר - ר"ל שהציע לפניהם איזה ענין שבשביל זה אינו מתרצה בו כגון שמידותיו אינם ישרים בעיניו וכה"ג ולא טענת פסול דבזה לכו"ע אין יחיד יכול למחות כל זמן שלא בירר כי יש לחוש לפגמו:

(55) 'The town leaders' — that is, that he laid before them some matter on account of which he is not agreeable to him, such as that his character traits are not upright in his eyes, and the like, but not a claim of (halachic) disqualification; for regarding that, by all opinions an individual cannot object, as long as he has not proven it, since there is concern for damaging the other's reputation.

(נו) שונאו - ר"ל שידוע באמת מכבר שהם שונאים זה לזה לכך יכול למחות בו דאינו נעשה שלוחו לתפלה בע"כ אבל אם אומר שהוא שונאו לאו כל כמיניה:

(56) 'He hates him' — that is, where it is genuinely known from before that they hate one another; therefore he may object to him, since one cannot be made his agent for prayer against his will. But if he merely claims that (the leader) hates him, it is not within his power (to be believed).

(נז) קודם וכו' - אבל אם נעשה שונא לש"ץ לאחר שהסכים עליו תו אין היחיד יכול למחות אלא הש"ץ מחוייב לומר בפירוש שיסיר הקנאה מלבו ויוציאנו בתפלתו. גם אם מכוין שלא להוציא השונא גם אוהבים לא יצאו ע"כ צריכין החזנים ליזהר בזה [פמ"ג] כתב בד"מ בשם א"ז אין ש"ץ צריך להחניף לצבור במילי דשמיא וצריך להוכיחן. אך בעניני עצמו יראה להעביר על מדותיו ויהיה אהוב להקהל וכדלקמיה:

(57) 'Before, etc.' — but if he became an enemy of the shaliach tzibbur after having agreed to him, the individual can no longer object; rather, the shaliach tzibbur is obligated to declare explicitly that he removes the animosity from his heart and will discharge his obligation in his prayer. Moreover, if he intends not to discharge the obligation of the one he hates, then even those he loves will not fulfill their obligation; therefore chazzanim must be careful about this (Pri Megadim). The Darchei Moshe wrote in the name of the Or Zarua: a shaliach tzibbur need not flatter the congregation in matters of Heaven, and he must rebuke them; but in his own personal affairs he should see to overlook slights (against himself) and be beloved to the congregation, as (stated) further on.

(נח) שונא לש"ץ - ר"ל כיון שהוא שונא לש"ץ מסתמא הש"ץ ג"כ אינו אוהבו כי כמים הפנים לפנים וגו' ואולי יכוין ש"ץ הקורא בהתוכחה נגד פניו וחשש סכנה היא לו ע"כ פסק דמפני זה אפילו קראהו לא יעלה וכנה"ג כתב דיותר טוב שיעלה משיכנס לעונש בשביל שהוא מבזה כבוד התורה וכן הסכים הגר"א וכן כתב בספר שערי אפרים וז"ל צריך שיהיה אהוב להצבור והוא אוהבם ואם אירע שהקורא יש לו שנאה על אחד מהצבור מוטל על הסגן שלא יצוה לקרות לזה לפרשת התוכחה מפני שסכנה היא ואם יודע שהקורא שונאו ומתיירא שמא יקראוהו יצא בין גברא לגברא מבהכ"נ עד שיקראו אחר ויכנס אח"כ ואם לא יצא וקראוהו יעלה כיון שהוא מתכוין משום כבוד התורה שומר מצוה לא ידע דבר רע. ואסור להקורא לחשוב בשעת קריאתו ענין קללה לנוכח שום אדם עי"ש וכתב בפתחי שערים דאף להמג"א יעלה בדיעבד אם קראהו:

(58) 'One who hates the shaliach tzibbur' — that is, since he hates the shaliach tzibbur, presumably the shaliach tzibbur too does not love him, for 'as water reflects a face to a face,' etc. (Mishlei 27:19). And perhaps the shaliach tzibbur reading the Tochacha might direct it against him, and there is a concern of danger to him; therefore he ruled that for this reason, even if he was called up, he should not go up. But the Knesses HaGedolah wrote that it is better that he go up than incur punishment for disgracing the honor of the Torah; and the Vilna Gaon concurred, and so it is written in the Shaarei Efraim, whose language is as follows: he must be beloved to the congregation and love them; and if it happens that the reader has enmity toward one of the congregation, it is incumbent on the gabbai not to call this person up for the portion of the Tochacha, because it is a danger. And if one knows the reader hates him and fears he might be called up, he should step out between one aliyah and the next, leaving the synagogue until another is called, and re-enter afterward. But if he did not step out and was called up, he should go up, since he intends it for the honor of the Torah — 'one who keeps a mitzvah will know no evil thing' (Koheles 8:5). And it is forbidden for the reader, while reading, to direct the matter of the curse against any person see there. And the Pischei She'arim wrote that even according to the Magen Avraham, after the fact he should go up if he was called.

(נט) בשביל אביו - פי' שמת אביו ורוצה להתפלל כדרך האבלים כי תפלה היא יותר מצוה מאמירת הקדיש:

(59) 'On behalf of his father' — meaning his father died and he wishes to lead the prayer in the manner of mourners, for leading the prayer is a greater mitzvah than reciting the Kaddish.

(ס) שירצה הקהל - הטעם דדוקא קדיש יכול לומר בשביל אביו ואין רשות ביד הקהל לדחותו אבל לא יכול להיות שליח הקהל להתפלל על כרחם ולענין זה הוא ג"כ כמו בש"ץ שאין יחיד מוחה כדי שלא ירבה המחלוקת אלא הולכין אחר רוב או הנבררים לזה וכמו שכתבנו לעיל בשם האחרונים. יש מקומות שיש להם תקנה בבהכ"נ שאין מניחין לאבל להתפלל כל השבוע לפני התיבה כ"א להש"ץ הקבוע שלהם אין לדחות התקנה [ונעשית מפני ע"ה שאינם יודעים ומבינים הברכות והתפילות ואומרים טעות ואיכא זילותא לכך תקנו אפילו על היודעים שלא יתפללו משום דלא ליתי לאנצויי] אכן במקום דליכא תקנה ומנהג קבוע מצוה לקהל להניח לאבל להתפלל שהוא נחת רוח למת ומצילו מדינו של גהינם ומיהו ודאי כשאין יכול לחתוך האותיות וכדומה אין לו להתפלל לפני העמוד. כתב המ"א אם יש אבל ומוהל נדחה האבל מן התפלה מחמת המוהל ויום שמת בו אביו ואמו שקורין יארצייט דוחה למוהל ולאבל וכל זה שאין הקהל מקפידין ע"ז אבל יש רשות ביד הקהל לבחור עליהם מי שירצו:

(60) 'Whom the congregation wants' — the reason: specifically Kaddish he may say for his father, and the congregation has no right to push him aside; but he cannot be the congregation's agent to lead the prayer against their will. And regarding this it is also like the case of a shaliach tzibbur, where an individual does not object, so that strife will not increase; rather, we follow the majority or those elected for this, as we wrote above in the name of the Acharonim. There are places that have an ordinance in the synagogue not to let a mourner lead the whole week before the ark, but only their regular shaliach tzibbur — one should not override the ordinance (it was enacted on account of the unlearned, who do not know or understand the blessings and prayers and say them in error, and there is degradation of the prayers; therefore they ordained even regarding those who do know, that they should not lead, so that it not come to quarreling). However, in a place where there is no ordinance and fixed custom, it is a mitzvah for the congregation to let the mourner lead, for it is a gratification to the deceased and saves him from the judgment of Gehinnom. Nevertheless, certainly where he cannot enunciate the letters and the like, he should not lead before the amud. The Magen Avraham wrote: if there is a mourner and a mohel, the mourner yields the prayer on account of the mohel; and the day on which one's father or mother died, called a yahrzeit, takes precedence over both the mohel and the mourner. And all this is where the congregation is not particular about it, but the congregation has the right to choose over them whomever they wish.

(סא) הוא יאמר - ובתפלת מעריב שהיא אינו כנגד תמידים רק כנגד איברים ופדרים אפשר דא"צ דעת בעלים ואין הקהל יכולין לעכב לאבל להתפלל מעריב דמצוה שיתפלל מי שמת לו אביו ואמו ומ"מ ודאי אין להתקוטט בשביל שום מצוה עם הצבור וכדלקמיה בסעיף קטן ס"ה [פמ"ג]:

(61) 'He shall lead it' — But for the Maariv prayer, which does not correspond to the tamid offerings but to the (burning of the) limbs and fats, it is possible that the owner's consent is not needed, and the congregation cannot prevent a mourner from leading Maariv, for it is a mitzvah that one who has lost his father or mother lead the prayer. Nevertheless, one should certainly not quarrel with the congregation over any mitzvah, as (stated) below in note 65 (Pri Megadim).

(סב) אף שרוב הצבור חפצים בו - והשר ביקש מהמיעוט הממאנים שיסכימו עליו כי חלילה לקבל עבודת בוראנו ע"י העכומ"ז:

(62) 'Even though the majority of the congregation wants him' — even where the officer requested of the refusing minority that they agree to him; for Heaven forbid to accept the service of our Creator through a non-Jew.

(סג) בשכר עדיף - שבזה אין אחר שאינו הגון רשאי לפשוט רגלו להתפלל ואם היה בנדבה הרשות נתונה לכל וכפרוץ הדבר יעלה מי שאינו הגון ועוד הש"ץ יהי' בעצמו יותר נזהר בתפלתו ובתיקונו הואיל ושכיר הוא. ואף שיש בחנם צריכין העניים ג"כ ליתן שכירות הש"ץ שש"ץ בשכר עדיף [פמ"ג]:

(63) 'For pay is preferable' — for in this way, another who is unworthy is not permitted to thrust himself forward to lead; whereas if it were voluntary, permission would be given to all, and once the matter is breached, an unworthy person might go up. And furthermore, the shaliach tzibbur himself will be more careful in his prayer and its proper form, since he is a hired man. And even where one is available for free, the poor too must contribute to the shaliach tzibbur's wages, for a paid shaliach tzibbur is preferable (Pri Megadim).

(סד) להתפלל - או לתקוע [ב"י]:

(64) 'To lead the prayer' — or to sound the shofar (Beis Yosef).
