מצות תפילין שיכתוב ארבע פרשיות שהן קדש לי כל בכור עד למועדה והיה כי יביאך עד כי בחוזק יד הוציאנו ה' ממצרים אופ' שמע עד ובשעריך ופ' והיה אם שמוע עד על הארץ: הגה וצריך לבכתבם בגסדר הזה לכתוב תחלה הקודמת בתורה ואם שינה פדסול ולכתחלה יכתוב של יד קהודם של ראש.
The mitzvah of tefillin is that one writes four Torah passages. They are: Kadesh Li Kol Bechor (Exodus 13:1-10) up to lemoadah; Vehaya Ki Yeviacha (Exodus 13:11-16) up to ki bechozek yad hotzianu Hashem miMitzrayim (for with a strong hand Hashem brought us out of Egypt); the passage of Shema (Deut. 6:4-9) up to uvishareicha; and the passage of Vehaya Im Shamoa (Deut. 11:13-21) up to al haaretz. The Rema adds: One must write them in this order, writing first whichever passage comes earlier in the Torah; and if he changed the order, it is invalid. Ideally one should write the hand-tefillin (shel yad) before the head-tefillin (shel rosh).
בשל ראש יכתוב כל אחת בקלף לבדה ושל יד כותב כולם ובקלף אחד:
For the head-tefillin one writes each of the four passages on its own separate parchment, whereas for the hand-tefillin one writes all of them together on a single parchment.

He writes them with black ink, whether the ink contains gall-nut water (mei aftzim) or is made without gall-nut water. The Rema adds: Ideally one should be stringent to write with ink made from the soot of wood or of oils, soaked in gall-nut water [Maharil, responsum 119], as will be explained in Yoreh Deah, siman 271. If he wrote even a single letter with other kinds of colored dyes, or with gold, these are invalid. If he scattered gold dust over letters that were already written in valid ink beneath, he removes the gold, the underlying writing remains, and it is valid. But if he scattered the gold onto a letter of a Divine Name (azkarah), there is no remedy, because it is forbidden to remove the gold, since doing so would be like erasing the Divine Name.

He must take care that no letter touches its neighbor; rather every letter must be encircled by blank parchment (mukaf gevil). The Rema adds: He should write complete writing (ketivah tammah), so that not even the tip (kotzo) of a yud is lacking, and each letter is fitted with its crownlets (tagin) as required [Tur, Orach Chaim]; and ideally one should write somewhat bold, heavy letters, so that they will not be rubbed out quickly. Likewise it is a mitzvah to beautify them, both outside and inside [Divrei Mordechai].
צריך יזשיכתוב בימינו אפילו אם הוא שולט בשני ידיו ואם כתב יחבשמאל פסול אם אפשר למצוא אחרים כתובים בימין ואיטר יד שמאל דידיה יטהוה ימין:
He must write with his right hand, even if he is equally skilled with both hands (ambidextrous); and if he wrote with his left hand it is invalid, provided one can find other pairs written with the right hand. A left-handed person (iter) writes with his left hand, for that hand is regarded as his right.

One need not rule guide-lines (sirtut) except for the top line; but if he does not know how to keep the line straight without ruling, he should rule all the lines. He should not rule with lead, because the track of the ruling would remain visibly colored. The Rema adds: Some say one must always rule, above and below and on the sides, even if he knows how to write straight without ruling; and so is the custom [Baruch Sheamar; Mordechai; Sefer Terumah; and the Semag].

It is a law given to Moshe at Sinai (halachah leMoshe miSinai) that tefillin are written on kelaf (the outer layer of a split hide), and not on duchsustos (the inner layer), and not on gevil (a whole, unsplit hide). One writes on the kelaf on the side that faced the flesh, and if he changed this, it is invalid. What is kelaf and what is duchsustos? When the hide is being processed, it is split into two layers. The outer part, which faces the hair, is called kelaf, and the inner part, which was attached to the flesh, is called duchsustos. Accordingly, when we say one writes on the kelaf on the flesh-side, it means the surface closest to the flesh, namely the place where it had joined the duchsustos while the two were still attached. Our parchments, which are not split, nevertheless have the status of kelaf, and one writes on them on the flesh side. For the scraping of its upper surface on the hair-side removes only as much as is needed to prepare and smooth it, and even if one were splitting the hide into two, he would still have to scrape off that much. From the flesh side, by contrast, they scrape a great deal, until nothing remains but the kelaf alone.

The kelaf must be tanned with gall-nuts (aftzim) or with lime, and it must be processed lishmah (for the sake of the mitzvah). It is good to articulate with the lips, at the start of the tanning, that he is processing it for the sake of tefillin or of a Torah scroll. But if he processed it for the sake of a mezuzah, it is invalid.

If a non-Jew tanned it: according to the Rambam it is invalid, even if a Jew told him to process it lishmah; but according to the Rosh it is valid if a Jew stands over him and assists him. The Rema adds: it is enough that the Jew help with a small part of the tanning [Beit Yosef in the name of the Rosh]; and so is the custom. See above, siman 11, seif 2.

When one marks the stitching-holes with an awl in the shape of letters, as a mark of identification, even though it would be easy for a non-Jew to forge them, we are not concerned, because the non-Jew is afraid the Jew will recognize any forgery by visual recognition (teviut ayin).

A hide that was tanned not lishmah, and whether there is a remedy to re-tan it lishmah, will be explained in the Tur, Yoreh Deah, siman 271.
יהיה הקלף מעור בהמה חיה ועוף הטהורים אפילו מנבלה וטריפה שלהם אבל לא מעור בהמה וחיה ועוף הטמאים דכתיב למען תהיה תורת ה' בפיך ממין המותר לפיך ולא מעור דג אפילו הוא טהור משום דנפיש זוהמיה:
The kelaf must come from the hide of a kosher domesticated animal, wild animal, or bird, even from a carcass (nevelah) or a fatally-defective one (tereifah) of such a species, but not from the hide of a non-kosher domesticated animal, wild animal, or bird, for it is written, so that the Torah of Hashem may be in your mouth, implying only a species permitted to your mouth; and not from the hide of a fish, even a kosher one, because its slime is excessive.
יהיה הקלף שלם שלא יהא בו נקבים שאין הדיו עובר עליו דהיינו שלא תהא האות נראית בו חלוקה לבלשתים:
The kelaf must be whole, without holes over which the ink cannot pass, meaning that the letter must not appear, at such a hole, as though split into two.
הסופרים הזריזים עושים שלשה מיני קלפים העב יותר לכתוב בו פרשת שמע שהיא קטנה לגוהדק ממנו לפרשת והיה אם שמוע שהיא יותר גדולה ולפרשת קדש ולפרש' והיה כי יביאך שהם ארוכות עושים קלף דק מאוד ובזה יתמלאו הבתים בשוה וזהו נוי לתפילין:
The diligent scribes prepare three thicknesses of kelaf: the thickest, on which they write the passage of Shema, which is short; a thinner one for the passage of Vehaya Im Shamoa, which is longer; and for the passages Kadesh and Vehaya Ki Yeviacha, which are the longest, they make very thin kelaf. In this way the compartments (batim) fill up evenly, and this is a beautification of the tefillin.

If, after the letter was written, a hole was pierced within the space of a hei or a mem, it is valid, even if its entire interior was pierced, since the hole itself fills the whole hollow of the letter. But the Yerushalmi implies that even on its inner side the letter must be encircled by kelaf. If the inner (left) leg of a hei was pierced, even if only the slightest trace of it remains, it is valid according to the Rosh. The Rema adds: But the other decisors require that a full small letter's worth remain, and this is the halachah [Beit Yosef]. If the right leg was pierced: if a full small letter's worth of it remains it is valid, and if not it is invalid.

If one of the letters became broken (a gap appearing in its stroke) -- the Rema adds: this refers to simple letters such as a vav or a zayin, or where the leg of a nun or the like became broken [Mordechai] -- if a child who is neither especially clever nor especially dull knows how to read it, it is valid; and if not, it is invalid. One need not cover the surrounding letters for him, though some are accustomed to do so. The Rema adds: However, if we ourselves see that the proper form of the letter has not been preserved, it is invalid, even if the child reads it correctly [Mordechai; Maharik, root 69; and Rivash]. This leniency, that we validate a broken letter, applies only when it was written validly and broke afterward; but if from the outset, when it was written, there was already a hole there and the letter broke at that hole, or if the leg of a final kaf or the like reaches the very edge of the kelaf, with no kelaf surrounding it there from the start, it is invalid.

If a drop of ink fell into a letter so that the letter is no longer recognizable, there is no remedy by scraping away the ink so as to make the letter recognizable again, for that would be chak tochot (forming a letter by carving out its surroundings), and it is invalid, since we require and he shall write, not and he shall carve. The same applies if he erred and wrote a dalet in place of a resh, or a bet in place of a kaf: there is no remedy by erasing the corner-projection (tag) to correct the letter, because that too would be like chak tochot.

An open mem whose opening became joined and sealed shut: it does not help to scrape away the join and reopen it, because that would be like chak tochot. What is its remedy? He scrapes off the entire front stroke (chartom) so that it is left in the form of a bent nun, and then rewrites what he scraped off. As for a resh that he shaped like a dalet (with a sharp corner), one should be stringent and say that it does not suffice to scrape only the leg or only the roof and rewrite it as a resh, because both the roof and the leg were formed in invalidity; therefore he must scrape off both. If one letter became joined to another, whether before it was finished or after it was finished, it is invalid; and if he scraped and separated them it is valid, and this is not called chak tochot, since each letter itself had been written properly. If the legs of a hei or a kuf touched the roof, he scrapes off the leg and rewrites it, and he need not scrape the whole letter, since the roof itself was written properly. If the leg of an alef touched the roof of the alef, or the inner face of the alef touched the lower stroke beneath it, it is invalid, and there is no remedy by scraping to separate them, for that would be like chak tochot; rather he scrapes off everything made in invalidity and rewrites it. The Rema adds: The same law applies to the yuds of the shin, the tzadi, the ayin, and the pei, if they touched the body of the letter beyond their proper point of attachment: [Beit Yosef].

At the start of the writing he should say aloud: I am writing for the sake of the holiness of tefillin. Besides this, each time he writes a Divine Name (azkarah) he must state that he writes it for the sake of the holiness of the Name. The Rema adds: Some say it suffices if he merely has in mind that he is writing the Divine Names for their sake; since he already declared it aloud at the start of the writing, that is enough [Rosh; Tur, Yoreh Deah and Orach Chaim]. One may be lenient in this after the fact; and when he begins to grow drowsy he should not write, for he does not then write with proper intent [Or Zarua].

One must be exacting about defective and superfluous spellings (chaserot and yeterot), for if even a single letter is missing or extra, they are invalid, and it emerges that those who wear them recite a blessing in vain each day, and also pass each day without the mitzvah of tefillin, so the scribe's culpability is great. Therefore one who occupies himself with the writing of tefillin and their repair must be exceedingly God-fearing and anxious at the word of Hashem.

Each passage, after writing it, he should read carefully, with concentration and precision, two or three times, and he should read it again before placing it in its compartment, so that one passage is not exchanged for another.
טוב לנסות הקולמוס קהקודם שיתחיל לכתוב הפרשה שלא יהא עליו דיו יותר מדאי ויפסיד וכן יזהר קודם שיכתוב כל שם לקרות כל קומה שכתב כדי שלא יבואו לידי גניזה קזעל ידו:
It is good to test the quill before beginning to write the passage, so that it not carry too much ink and spoil the writing. Likewise, before writing each Divine Name he should be careful to read over all he has written, so that the sheets will not come to require burial (genizah) on his account.

If he found that one letter is missing, there is no remedy, for if he were to add it now, the passages would be written out of order (shelo kesidran) and invalid, since it is written vehayu, meaning they must be written in their proper sequence, as they are. But if there is one extra letter, there is a remedy: he scrapes it off, provided it is at the end or the beginning of a word. If, however, it is in the middle of a word, there is no remedy, because once he scrapes it out the word will look like two separate words.

It is permitted to write over the place of a scraping or of an erasure, even a Divine Name. He should not erase while the ink is still wet; rather he should let it dry well, for then it will scrape off easily and leave no trace behind.

Any letter that is written improperly and does not bear its proper form, for example: the leg of an alef touched the roof of the alef, or the inner face of the alef touched the lower stroke beneath it, or the leg of a hei or the leg of a kuf was touching the roof, or one letter was split so as to read as two letters, such as a tzadi written as a yud and a nun, or a shin written as an ayin and a yud, or a chet written as two zayins; if, after he had already written the letters following it, he went back and corrected these, that is shelo kesidran (out of order) and they are invalid. But merely to separate attached letters after writing the ones after them is permitted, for since each letter already bears its proper form, separating it from its neighbor is not considered an act of writing. The same applies if some of the yuds atop the alefs, shins, and ayins, or the legs of the tavs, were not touching the body of the letter, and a child who is neither clever nor dull recognizes them: even though he already wrote the following letters, he may go back and correct them, for since the form of the letter was recognizable there is no problem of writing out of order. There is an authority who says the same applies if the two arms of a chet at the top are not touching each other, but their separation is not plainly evident: even though the child reads them as two zayins, one is permitted to join them.

Letters and words that were partly erased: if their trace is still recognizable enough that a child who is neither clever nor dull can read them, it is permitted to pass a quill over them to improve and refresh the writing, and this is not considered writing out of order (shelo kesidran).

One should take care that the head of a lamed does not project into the airspace (the inner hollow) of a hei or a chet, even without actually touching it.
אם אין הפרשיות קלגשגורו' בפיו צריך שיכתוב קלדמתוך הכתב:
If the passages are not fluent by heart in his mouth, he must copy them from a written text.
אינו רשאי לכתוב אלא אם כן קלהיודע לקרות:
He is not permitted to write tefillin unless he himself knows how to read.

If he is not copying from a written text, he may not write from memory what another person dictates to him, unless he himself first repeats it and reads it aloud.

He must leave a blank margin above the writing, the width of the roof of a lamed (the Rema notes: so that the letters too are surrounded by blank parchment) [responsum of the Maharil, siman 134; and Beit Shmuel]; and below, the measure of a final kaf and a final nun; but at the beginning and end of the lines he need not leave any margin at all. The Rema adds: However, the scribes were accustomed to leave a little at the beginning and end [Agur; Rokeach]. He must leave between each word the width of a letter, and likewise between the lines the height of a full line, and between each letter the width of a hair's breadth, just as in a Torah scroll, and as will be explained in the Tur, Yoreh Deah. He must also leave a little blank space between one verse and the next.

He should make the lines even, so that one line is not indented and another protruding; and at the very least he should take care not to write three letters beyond the line (into the margin), though if he did write them, it is not thereby invalid.

He should make all its passages 'open' (petuchah) except the last passage as written in the Torah, namely Vehaya Im Shamoa, which he should make 'closed' (setumah); and if he changed this, it is invalid. (Some validate them even if all are made open) [Maharam Padua, siman 77, citing Orchot Chaim; and Beit Yosef citing the Ittur.] In these lands the custom is to begin even the passage Vehaya Im Shamoa at the head of a line, like the other passages. Therefore they were accustomed that the passages Kadesh Li, Vehaya Ki Yeviacha, and Shema each begin at the head of a line; and at the end of Kadesh Li and at the end of Vehaya Ki Yeviacha they leave a blank space wide enough to write nine letters, while at the end of Shema they leave no blank space, or if they do, it is less than the space needed to write nine letters. And the passage Vehaya Im Shamoa they begin in the middle of the top line, leaving before it a blank space wide enough to write nine letters. It emerges that three passages are 'open' according to both the Rambam and the Rosh, while the last passage is 'closed' according to the view of the Rambam.

The leather of the compartments (batim) must come from the hide of a kosher domesticated animal, wild animal, or bird, even from a carcass or a fatally-defective one of such a species; and he may make them from kelaf or from the hide of a fetus (shalil). The Rema adds: Likewise the straps may be made from kelaf or from the hide of a fetus [Mordechai]. The leather must be tanned lishmah wherever possible.

Tefillin, whether of the head or of the hand, it is a law given to Moshe at Sinai that they be square, both in their stitching and along their diagonal, that is, their square must be exact, the length equal to the width, so that they have the precise diagonal of which the Sages said: every cubit in a square yields a cubit and two-fifths along its diagonal. He must make square both the base on which they sit and the compartments themselves. The Rema adds: But regarding the height of the compartments one need not be particular if it exceeds their width and length [Beit Yosef, citing the Rosh, the Semak, the Mordechai, and Rambam ch. 3]. If he made them square and after a time their squareness became spoiled, there is one who says he must re-square them. The Rema adds: He should make all four compartments equal, so that no one of them is larger than another [Baruch Sheamar].

The leather of the compartments -- it is a mitzvah to make it black [and see above, siman 33]. The groove that runs between one compartment and the next must reach down to the seam; and if it did not reach, it is still valid, provided the groove is recognizable, so that the four separate heads of the head-tefillin are visible to all.

The shin of the tefillin: it is a law given to Moshe at Sinai that on the leather of the head-tefillin's compartments he form a kind of raised shin, pressed out from the folds of the leather, one on its right and one on its left; the one on the wearer's right has three heads, and the one on the wearer's left has four heads. The Rema adds: However, if he reversed them, it is not thereby disqualified [Mordechai; Semag; Tosafot, ch. HaKometz].

The titura of the tefillin is a law given to Moshe at Sinai: he places leather underneath to cover the mouths of the compartments, and it looks like the plank of a bridge -- which is why it is called titura (a plank). The ma'avarta of the tefillin is likewise a law given to Moshe at Sinai: the titura is made longer on one side, and in that extension he forms the ma'avarta. How? He trims it on both sides so that it is not as wide as the titura itself, so that the square shape of the titura remains recognizable. Through that ma'avarta the strap passes, and for that reason it is called ma'avarta (a passageway). In the hand-tefillin too he makes a titura and a ma'avarta. He rolls each passage from its end back to its beginning and wraps them in a small piece of kelaf; and some are particular to wrap them only in kosher kelaf. It is a law given to Moshe at Sinai that he wrap over it the hair of a kosher domesticated or wild animal. The Rema adds: The custom is to wrap hair over the passage, then wrap kosher kelaf over that, and again wrap hair over that [Agur, siman 45]. They were accustomed that this hair be from a calf; and if he did not find calf's hair, he wraps with that of a cow or an ox, and he first washes the hair well until it is somewhat clean. This hair must be left visible outside the compartments.

He should place each passage in its own compartment so that it stands upright within its compartment.

The upper margin should be at the top -- this being the top line -- and the lower margin toward the mouth of the compartments. The Rema adds: The beginning of the passage should lie toward the right of a reader, so that if one comes to open and read them, they would lie before him the right way round [Terumat HaDeshen; and Beit Yosef in the name of Orchot Chaim].

If he wrote all four passages on a single kelaf, they are valid, even if there is no space between them, provided there is a thread or cord between each compartment. For the hand-tefillin, he writes the four passages on one kelaf, rolls them from end to beginning, wraps kelaf and calf's hair over them, and inserts them into their single compartment, just as for the head-tefillin. If he wrote them on four separate kelafim and placed them in four compartments, he has fulfilled the mitzvah, provided he spreads (that is, covers) leather over the four compartments so that they appear as a single compartment. The Rema adds: The custom is to glue them together so that the whole appears as one kelaf, and they should be careful to use kosher glue [Baruch Sheamar; Agur, siman 57].
אם צפה הבתים בזהב רכאאו בעור בהמ' טמא' פסולים:
If he overlaid the compartments with gold, or with the hide of a non-kosher animal, they are invalid.

It is a law given to Moshe at Sinai that tefillin be sewn with the sinews of kosher domesticated and wild animals, and it is good to sew specifically with the sinews of an ox.

One should not buy sinews from a non-Jew, since we are concerned that they may be from a non-kosher animal. In a place where sinews are not available, they sew with taliaduras (cords made from kelaf) until sinews become available to them.

He should sew three stitches on each side, and the sewing thread should run around from both sides, and he passes the sewing thread between each compartment. The Rema adds: However, if he made only ten stitches, or even fewer, it is not thereby disqualified [Mordechai]. And there is one who says that these twelve stitches should be made with a single thread.

He inserts the strap into the ma'avarta and makes a knot shaped like a dalet on the head-tefillin, and one shaped like a yud on the hand-tefillin, so as to complete the letters of the Divine Name Shaddai together with the shin on the head-tefillin. The Rema adds: The custom is to draw leather over the compartment of the hand-tefillin, across the width of the arm, its width being like the width of the compartment (Tur); and he should not make the knots until after he has formed the shin on the tefillin; afterward he makes the dalet, and after that the yud, following the order of the letters of the Divine Name.

(1) 'And the passage of Shema' -- the Mishnah Berurah explains: one must write the dalet of the word echad so large that it equals about four small dalets [Magen Avraham]; though it is possible that one does not measure by that exact script; rather, in any script, so long as its dalet is made very much larger than the small dalets, that suffices. For this reason the custom is simply to write it larger than the other dalets of that same script.
(ב) לכתבם - כל הפרשיות בין מהש"י ובין מהש"ר:
(2) 'To write them' -- meaning all the passages, both those of the hand-tefillin and those of the head-tefillin.
(ג) כסדר הזה - דכתיב והיו הדברים וגו' בהוייתן יהו. וכ"ש שצריך ליזהר מטעם זה שיהיה כל פרשה ופרשה גופא נכתבת כסדרה שלא יחסר בה אפילו אות אחת כי לא יהיה לו תקנה אח"כ להשלימה וכדלקמן בסעיף כ"ג:
(3) 'In this order' -- since it is written, and these words shall be...: vehayu, 'they shall be,' teaches that they must be written in their proper sequence, as they are. And all the more so, for this same reason, one must take care that each individual passage itself be written in its own order, so that not even a single letter be missing within it, for afterward he would have no remedy to complete it, as explained below in se'if 23.
(ד) פסול - היינו התפילין שנעשו מאותן הפרשיות אבל הפרשיות עצמן לא נפסלו כגון אם התחיל לכתוב מפרשת והיה כי יביאך יוכל לצרף לזה פרשת קדש מתפילין אחרים אם יודע בודאי שנכתב קודם אלו דאל"ה ספק תורה לחומרא וה"ה אם בעת הכתיבה היה כסדרן רק אח"כ נפסל פרשה אחת המוקדמת נתבטל ממילא כל הפרשיות שאחריה ולענין צירוף מפרשיות אחרים ג"כ הדין כנ"ל:
(4) 'Invalid' -- this means the tefillin assembled from those passages; but the passages themselves are not thereby disqualified. For example, if he began writing with the passage Vehaya Ki Yeviacha, he may combine with it the passage Kadesh from another set of tefillin, provided he knows for certain that it was written before these; for otherwise it is a doubt in Torah law, which is treated stringently. The same applies if, at the time of writing, the order was correct, but afterward one of the earlier passages became invalid: automatically all the passages written after it are nullified, and regarding combining passages from another set, the law is likewise as stated above.
(ה) קודם - משום דמוקדם בפסוק וי"א להיפך מפני שש"ר קדושתו חמורה משל יד ואנו נוהגין כמ"ש הרב בהגה ובדיעבד לכו"ע אין קפידא. כתוב בספר הכוונות שלכתחלה יזהר לכתוב כל הפרשיות ש"ר ושל יד רצופים ולא יפסיק ביניהם בשום דיבור כלל ועי' בש"ת:
(5) 'Before' -- because it comes earlier in the Torah's verses; and some say the reverse, since the head-tefillin's holiness is weightier than the hand's, but we follow the practice as the Rav (the Rema) wrote in his gloss; and after the fact all agree there is no concern. It is written in Sefer HaKavvanot that ideally one should take care to write all the passages, of the head and of the hand, in an unbroken sequence, and not interrupt between them with any speech at all; see Shaarei Teshuvah.
(ו) בקלף אחד - מדכתיב והיה לאות על ידך דמשמע אות אחד כלומר בית אחד וכשם שהוא אות אחד מבחוץ כך יש להיות לכתחלה אות א' מבפנים שתהיה על קלף אחד אבל בש"ר שיש בו ד' בתים צריך שיהי' הפרשיות כתובות בד' קלפים וכ"ז רק לכתחלה וכמו שיתבאר הכל לקמן בסעיף מ"ז. ודע דתש"י צריך להיות ג"כ כתוב דוקא בד' עמודים כל פרשה בעמוד אחר:
(6) 'On one kelaf' -- since it is written, and it shall be a sign upon your hand, implying a single sign, that is, a single compartment; and just as it is one sign on the outside, so ideally it should be one sign on the inside, namely that it be written on a single kelaf. But in the head-tefillin, which has four compartments, the passages must be written on four separate kelafim. All of this is only the ideal, as will be fully explained below in se'if 47. And know that the head-tefillin, too, must specifically be written in four columns, each passage in its own column.
(ז) בדיו שחור - ודיו שמראהו דומה למראה הכחול עיין בביאור הלכה:
(7) 'With black ink' -- regarding ink whose appearance resembles the color blue, see the Biur Halacha.

(8) 'From the soot of wood' -- that is, he should not add to it gum (kuma) or vitriol (kankantom, called in the vernacular 'copper water'), because ideally we require writing that is capable of being erased, whereas gum or vitriol make the writing permanent and unerasable; but all this is only for the choicest fulfillment of the mitzvah. As a matter of strict law, however, even the Rema concedes that one may make ink from gall-nut water, gum, and vitriol; and such is the custom today, by mixing the three together and boiling them, for this is better [as written in the responsa Mishkenot Yaakov, siman 37]. See the Magen Avraham, who wrote that in his day he too never saw even one of the great scholars practice to make ink from the soot of wood and oils [though possibly they were making it from thorn-ink, as he concluded in the name of the Maharil]. So too ruled Sefer Get Mekushar and Sefer Birkei Yosef, to follow our present custom, since ink made from the soot of wood and oils spoils and is erased easily; therefore it is no longer used nowadays. Ink made from gall-nut water alone, without gum (called in the vernacular 'gum'), or from vitriol alone, is invalid even after the fact; so wrote the Gra in his commentary below, siman 691, see there; and see the Biur Halacha. It is permitted to write tefillin and mezuzot with ink made from setam yeinam (ownerless gentile wine); see Shaarei Teshuvah, sk 4. The ink itself need not be made lishmah.
(ט) אות אחת - ל"ד דה"ה מקצת האות כגון קוצו של יוד:
(9) 'One letter' -- this is not meant literally, for the same applies to part of a letter, such as the tip (kotz) of a yud.
(י) בשאר מיני צבעונים - שאינם שחור כגון האדום והירוק וכיוצא בהם:
(10) 'With other kinds of colored dyes' -- meaning dyes that are not black, such as red, green, and the like.

(11) 'He removes the gold' -- even though, as long as he has not removed it, it is invalid, since the upper (gold) writing nullifies the lower writing, nevertheless the act of removal is not deemed writing out of order, since he is not writing but merely removing, and the lower writing thereby remains of itself.
(יב) בחברתה - ואם האות גדול ונדבק בסופו באופן שאם נגרר מה שדבק מ"מ ישאר צורת אות יש מכשירין ויש פוסלין והסכימו האחרונים להחמיר ע"כ צריך לגרור מקום הדבק ואף בתפילין ומזוזות מהני תיקון כיון דלא נשתנה צורת האות מקודם:
(12) 'To its neighbor' -- if the letter is large and became joined at its end in such a way that, were the joined part scraped away, the letter's form would still remain, some validate it and some invalidate it, and the later authorities agreed to be stringent; therefore one must scrape away the point of attachment. Even in tefillin and mezuzot such a repair is effective, since the form of the letter was not changed from what it was before.
(יג) כל אות - ואפילו האות האחרון מהשיטה צריכה להיות מוקפת גויל מארבע רוחותיה ולעיכובא הוא אפילו בדיעבד וכדלקמן בסוף סעיף ט"ז ואפילו אם יחסר הקפת גויל להקוץ של היוד ג"כ פסול הוא וכדאיתא במנחות דף כ"ט וכל פרטי דין הזה עיין לקמן בסעי' י"ז ובסימן ל"ו:
(13) 'Every letter' -- even the last letter of the line must be surrounded by blank parchment (gevil) on all four sides, and this is indispensable, invalidating even after the fact, as explained below at the end of se'if 16. Even if the surrounding gevil is lacking merely for the tip of a yud, it too is invalid, as stated in Menachot, folio 29. For all the details of this law, see below in se'if 17 and in siman 36.
(יד) כתיבה תמה - דהיינו שלא יכתוב ביתי"ן כפי"ן כפי"ן ביתי"ן זייני"ן נוני"ן נוני"ן זייני"ן וכל כיוצא בזה:
(14) 'Complete writing' (ketivah tammah) -- that is, he must not write bets that look like kafs, kafs like bets, zayins like nuns, nuns like zayins, and anything of the kind.
(טו) קוצו של יוד - היינו עוקץ שמאל של יוד וכ"ש אם חסר רגל ימין דפסול ותמונת היוד עיין לקמן בדיני צורת האותיות בסימן ל"ו ומש"כ בשם הפמ"ג:
(15) 'The tip of the yud' -- this refers to the left point of the yud; and all the more so, if the right leg is missing, it is invalid. For the form of the yud, see below in the laws of the shapes of the letters in siman 36, and what is written there in the name of the Pri Megadim.
(טז) כהלכתו - באותיות שעטנ"ז ג"ץ וזה הוא רק לכתחלה דבדיעבד כשר לרוב הפוסקים אם לא תייג וכדלקמן בסימן ל"ו ס"ג עי"ש שמבואר שם כל פרטי דיני התיוג:
(16) 'As required' -- this concerns the letters sha'atnez getz (which require crownlets), and it applies only ideally, for after the fact it is valid, according to most decisors, even if he did not add the crownlets, as explained below in siman 36, se'if 3, see there, where all the details of the laws of the crownlets (tiyug) are set out.
(יז) שיכתוב בימינו - דאין דרך כתיבה בשמאל וה"ה לעשות איזה תיקון בשמאל בענין הכתיבה דפסול אבל להפריד נגיעות שבאותיות נראה דכשר אפילו בשמאל דומיא דמכשרינן באנשים הפסולין לזה לקמן בסימן ל"ט עכ"פ בדיעבד עי"ש:
(17) 'That he write with his right hand' -- because there is no normal way of writing with the left hand; and the same applies to making any repair with the left hand in a matter of the writing itself, that it is invalid. But to separate letters that are touching, it appears valid even with the left hand, similar to our validating this even for people otherwise unfit to write, below in siman 39, at least after the fact, see there.
(יח) בשמאל - היינו בשולט בימין לבד אבל אם שולט בשתי ידיו אפילו כתב בשמאלו כשר ואפילו אם שולט בימינו לבד אם אי אפשר למצוא אחרים יניחם אך לא יברך עליהם. וסופר שכותב בימין וכל מלאכתו בשמאל או להיפך כתב הפמ"ג שנכון לכתחלה שלא לקבלו לסופר ובדיעבד אין לאסור עי"ש הטעם:
(18) 'With the left' -- this refers to one whose dexterity is in his right hand alone; but one who is skilled with both hands -- even if he wrote with his left -- it is valid. Even where the writer was right-handed only, if no other tefillin can be found one may still wear these, but without reciting a blessing over them. As for a scribe who writes with his right but does all his other work with his left, or the reverse, the Pri Megadim wrote that it is proper, ideally, not to engage him as a scribe, though after the fact one should not forbid it; see there for the reason.
(יט) הוי ימין - ע"כ אם כתב בימינו פסול כמו בשמאל דעלמא וכנ"ל אם אפשר למצוא אחרים וכתב הרמ"ע מעשה היה במצרים שתפס אחד הקולמוס בשפתיו וכתב בו ופסלו דאין דרך כתיבה בפה לכו"ע וכתב המ"א דפסול אפילו אם א"א למצוא אחרים. ועיין בספר משנת אברהם בשם הגט מקושר ועוד פוסקים דמשוין זה או הכותב ברגלו להכותב ביד שמאל:
(19) 'Is his right' -- therefore, if a left-handed person wrote with his right hand, it is invalid, just like an ordinary person's left, and as above, when other tefillin can be found. The Rama'a (Rabbi Menachem Azariah of Fano) wrote of an incident in Egypt where someone gripped the quill in his lips and wrote with it, and he disqualified it, since by all opinions there is no normal way of writing with the mouth. The Magen Avraham wrote that it is invalid even if no others can be found. See Sefer Mishnat Avraham, in the name of the Get Mekushar and other decisors, who equate this case, or one who writes with his foot, to one who writes with his left hand.
(כ) שיטה עליונה - משום דתפילין אין עליה הלמ"מ לשרטט כמו מזוזה רק משום דאסור לכתוב ג' תיבות מפסוק בלי שרטוט ע"כ כשמשרטט שיטה עליונה די כי סתם בני אדם יודעים לאמן ידם לכתוב כל השיטות ישרות אחר שכתבו שיטה עליונה וקאמר אין צריך משום דאם ירצה לשרטט כל השיטין כדי לכתוב יותר ביושר ליפות השיטות הרשות בידו. ואם לא שירטט אפילו שיטה עליונה עיין בביאור הלכה:
(20) 'The top line' -- because for tefillin there is no law from Moshe at Sinai to rule lines, as there is for a mezuzah; it is only because one may not write three words of a verse without ruling. Therefore, once he rules the top line it suffices, since ordinary people know how to train their hand to write all the remaining lines straight after they have written the top line. It says he 'need not,' because if he wishes to rule all the lines in order to write more evenly and beautify the lines, he is permitted to do so. And if he did not rule even the top line, see the Biur Halacha.
(כא) ישרטט - פי' לכתחלה משום זה אלי ואנוהו אבל בדיעבד אפילו אם לא שירטט וכתב השיטות עקומות אין לפסול התפילין:
(21) 'He should rule' -- meaning only ideally, based on the verse 'This is my God and I will glorify Him' (the duty to beautify a mitzvah); but after the fact, even if he did not rule and wrote the lines crooked, one should not invalidate the tefillin.
(כב) בעופרת - וכן בדיו ובסיקרא וכל כיוצא בזה ואפילו בין השיטין אסור לשרטט בו וכל זה לכתחלה אבל בדיעבד אין להחמיר כן כתב הל"ח והא"ר ובתשובת דבר שמואל סימן שס"ב מפקפק בזה מאוד אם משורטט בשום צבע שחור מחמת נגיעת אות באות ע"י השירטוט השחור אם לא דכתב מתחת השירטוט עי"ש:
(22) 'With lead' -- and likewise with ink, with red dye (sikra), and anything of the kind; and even between the lines it is forbidden to rule with such a colored substance. All this is only ideally; but after the fact one need not be stringent -- so wrote the Lechem Chamudot and the Eliyah Rabbah. In the responsum Devar Shmuel, siman 362, he casts great doubt on this, where it is ruled with any black coloring, out of concern that one letter may touch another by means of the black ruling line, unless he wrote beneath the ruling, see there.
(כג) בעפצים או בסיד - ולעיכובא הוא דלא מיקרי קלף בלא זה רק דיפתרא ויניח העור בסיד עד שיפול השער מאליו ולא ע"י גרירה ואם הוציאו קודם לכן לא יכתוב עליו דהוי דיפתרא עדיין ופסול ויש מי שחולק וכתב דסופר שהוציא העורות לאחר ד' ימים ועדיין לא עבר שערות מעליהן נראה דבדיעבד אין קפידא דלא תליא בשער כלל דכיון דכבר הונח בסיד וניתקן כהוגן לא מיקרי דיפתרא עי"ש:
(23) 'With gall-nuts or with lime' -- this is indispensable, for without it the material is not called kelaf but only diftera (untanned hide). He should leave the hide in the lime until the hair falls off by itself, and not by scraping. If he removed it before then, he should not write on it, for it is still diftera and invalid. There is one who disagrees, writing that if a scribe took the hides out after four days and the hairs had not yet come off them, it appears that after the fact there is no concern, for the matter does not depend on the hair at all; since it was already placed in lime and properly processed, it is not called diftera, see there.
(כד) בשפתיו - ובדיעבד דיו במחשבה:
(24) 'With his lips' -- and after the fact, mere intent suffices.
(כה) בתחלת - ויותר אין צריך לא להוציא בשפתיו ולא לחשוב שמתעבדים לשמה אלא בתחלתו בלבד ואפילו נמשך העיבוד כמה ימים דכל העושה על דעת ראשונה הוא עושה. ותחילת העיבוד מיקרי כשמשים העורות לתוך הסיד ולא בעת שמשימם לתוך המים קודם מפני דזה לא מיקרי עדיין עיבוד:
(25) 'At the start' -- beyond this he need do nothing more -- neither say it with his lips nor even think that they are being processed lishmah -- except at the very start, and even if the tanning continues for several days, since whoever acts does so on the strength of his original intent. The start of the tanning is reckoned from when he places the hides into the lime, not when he first puts them into water beforehand, for that is not yet considered tanning.
(כו) לשם ס"ת - דקדושתה חמורה מתפילין ובכלל מאתים מנה ואעפ"כ מותר לשנות לתו"מ אף דקדושתם קלה ממנה אבל לדבר חול אסור לשנותו לבד אם התנה בפירוש בתחלת עיבודן שיהא מותר לשנותו אף לדבר חול אז מותר לשנותו. והנכון שינהגו כן הסופרים לכתחלה בעת שמשימים העורות לתוך הסיד שיאמרו אני נותן עורות אלו לתוך הסיד לשם קדושת ס"ת ואני מתנה לכשארצה שאוכל לשנותו לכל דבר ולא כמו שנהגו הסופרים שאומרים לשם ס"ת או תפילין או מזוזות או שאר דבר רשות דאז מסתפקים האחרונים אם מהני ועיין בביאור הלכה:
(26) 'For the sake of a Torah scroll' -- because a Torah scroll's holiness is weightier than that of tefillin, and 'within two hundred lies one hundred' (the greater includes the lesser); even so, one may reassign it to tefillin or mezuzot, though their holiness is lighter than its, but for a mundane purpose it may not be reassigned, unless he explicitly stipulated at the start of the tanning that it be permitted to reassign it even to a mundane use, in which case it may be reassigned. It is proper that scribes adopt this practice ideally: as they place the hides into the lime they should say, 'I place these hides into the lime for the sake of the holiness of a Torah scroll, and I stipulate that, should I wish, I may reassign it to any purpose' -- rather than as some scribes were accustomed, who say 'for the sake of a Torah scroll, or tefillin, or mezuzot, or some other optional purpose,' for then the later authorities are in doubt whether it is effective; see the Biur Halacha.
(כז) פסול - ולא מהני רק למזוזה בלבד דקדושתה קלה מתפילין ואם עיבד לתפילין מהני אף למזוזה ולא לס"ת ואם עיבד העור לשם רצועות לא מהני לכתוב פרשיות עליו אם עשה אח"כ קלף מהן דקדושתן חמורה ואפילו לעשות מהן עור בתים יש לומר נמי דפסול דקדושתן חמורה מרצועה [פמ"ג וע"ש עוד מה שכתב בזה]:
(27) 'Invalid' -- and processing for a mezuzah is effective only for a mezuzah, since its holiness is lighter than tefillin. But if he processed it for tefillin, it works even for a mezuzah, though not for a Torah scroll. And if he processed the hide for the sake of straps, it does not work to write the passages on it, if he later made kelaf from it, since the passages' holiness is weightier. Even to make from it the leather of the compartments, one may argue it is invalid, since their holiness is weightier than a strap's [Pri Megadim; and see there further what he wrote on this].
(כח) אפילו - דס"ל להרמב"ם דעכו"ם עושה אדעתא דנפשיה ואף על פי שהעכו"ם אומר ששומע לישראל אין פיו ולבו שוין בזה אבל הרא"ש ס"ל דכיון שהוא עומד ע"ג בתחלה בעת שמשים העורות לתוך הסיד ואומר לו שיתנם אז לתוך הסיד לשמה ולא בעינן הכונה של העכו"ם לזה רק בעת רגע נתינתם לסיד ציית ליה אשעה מועטת כזה ונותנם אדעתא דהכי אבל אם הישראל העומד ע"ג חישב בלבו לבד לשמה לא מהני ואפילו אומר לו בפירוש כל שעומד מרחוק ואינו מלמדו לא מהני אפילו להרא"ש:
(28) 'Even' -- for the Rambam holds that a non-Jew acts on his own intent (adata denafshei), and even though the non-Jew says he is heeding the Jew, his mouth and heart do not agree in this. But the Rosh holds that since the Jew stands over him at the outset, when he places the hides into the lime, and tells him to place them into the lime then lishmah, and we require the non-Jew's intent only at the very moment of placing them into the lime -- for so brief an instant he obeys him, and places them with that intent in mind. But if the Jew standing over him merely thought lishmah in his heart, it is not effective; and even if he tells him explicitly, so long as he stands at a distance and does not direct him, it is not effective, even according to the Rosh.
(כט) קצת - אפי' אם לא סייעו רק בסוף העיבוד ואפילו גם זה הסיוע לא היה רק בשותפות עם העכו"ם כשר וכ"ז למצוה בעלמא אבל בדיעבד להרא"ש כשר אפילו לא סייעו כלל דעכו"ם אדעתא דישראל המצווהו לעשות לשמה עביד:
(29) 'A little' -- even if he assisted only at the end of the tanning, and even if that assistance too was only in partnership with the non-Jew, it is valid. All this is only for the ideal; but after the fact, according to the Rosh it is valid even if he did not assist at all, since the non-Jew acts on the intent of the Jew who instructed him to do it lishmah.
(ל) וכן נוהגין - והמנהג לפי דברי אחרונים לכתחלה צריך להיות כך שישים הישראל בעצמו העורות לתוך הסיד לשמה ויאמר לעכו"ם שכל שאר מלאכת העיבוד שיעשה הוא יעשה ג"כ לשמה ויכול העכו"ם אח"כ להוציאו בעצמו ולתקנו וא"צ עוד לעמוד ע"ג ולסייעו עוד. ואם נתן הישראל העורות בעצמו לתוך הסיד לשמה ולא אמר כלום להעכו"ם כתב הפמ"ג דצ"ע בזה [כי לפי דברי הב"י ביו"ד בסימן רע"א כשר אפילו לדברי הרמב"ם והב"ח אוסר] אכן לפי דברי הנו"ב בסימן קע"ה עי"ש וביאורי הגאון מהר"מ בנעט על המרדכי סוף הלכות ס"ת יש להקל בדיעבד. ואם סייעו הישראל להעכו"ם קצת בסוף ובזה גמר מלאכת העיבוד ולא אמר לעכו"ם כלל שיעשה לשמה זה בודאי לא מהני דמסייע אין בו ממש. וה"מ שזה גמר העיבוד לא עשה בעצמו רק בסיוע עם העכו"ם אבל אם גמרו הישראל בעצמו בלא סיוע העכו"ם כגון שהוציא הישראל העורות מן הסיד קודם שנגמר עיבודן וחזר והניחם בתוך הסיד לשמה הט"ז ביו"ד והגאון מהר"מ הנ"ל מקילין בזה ואין למחות ביד הנוהג להקל כדבריהן וכמו שביררנו בביאור הלכה:
(30) 'And so is the custom' -- According to the later authorities the custom ideally should be as follows: the Jew himself places the hides into the lime lishmah, and tells the non-Jew that all the rest of the tanning work he performs should likewise be done lishmah, and the non-Jew may thereafter take it out himself and prepare it, and the Jew need not stand over him or assist him any further. If the Jew placed the hides into the lime himself lishmah but said nothing to the non-Jew, the Pri Megadim wrote that the matter requires further study, [for according to the Beit Yosef in Yoreh Deah, siman 271, it is valid even by the Rambam's view, while the Bach forbids]; however, according to the Noda BiYehuda in siman 175 (see there), and the commentary of the Gaon Maharam Banet on the Mordechai at the end of the laws of a Torah scroll, one may be lenient after the fact. And if the Jew assisted the non-Jew a little at the end, thereby completing the tanning work, but never told the non-Jew to do it lishmah, this certainly does not help, for a mere helper has no real substance. This applies where the Jew did not carry out this completion of the tanning by himself but only assisting alongside the non-Jew; but if the Jew completed it entirely by himself, without the non-Jew's help, for example, the Jew took the hides out of the lime before their tanning was finished and then replaced them in the lime lishmah, the Taz in Yoreh Deah and the aforementioned Gaon Maharam are lenient in this; and one should not protest against one who follows their lenient view, as we clarified in the Biur Halacha.
(לא) בטביעות עין - שנתן בסימנין או שאלו הנקבים נעשו יותר מחדש משלו וי"א שיכתוב בראש בפנים במקום שאין דרך לעבד הראש וישאר הכתב עד אחר העיבוד ולא יסמן במרצע מחמת חשש זיוף ובדיעבד יש להקל כהש"ע:
(31) 'By visual recognition' -- which he applied by means of the identifying marks, or because these holes are recognizably fresher than his own would be. Some say instead that he should write a mark on the inner side of the head of the hide, in a spot where it is not usual to process the head, so that the writing remains until after the tanning, and he should not mark it with an awl, out of concern for forgery; but after the fact one may be lenient, as the Shulchan Aruch rules.
(לב) לשתים - שהוא קטן כל כך עד שכשמעביר עליו בקולמוס נסתם הנקב בדיו ואין הנקב נרגש בקולמוס כותבין עליו אע"פ שנפל מעט דיו במקום ההוא ונראה נקב דק כנגד השמש כשר אבל אם ניקב כ"כ שאין הדיו עובר עליו פסול שהאות נראית חלוקה לשתים על ידו ואפילו אם הנקב באמצע עובי האות בגגו או בירכו ודיו מקיפה מכל צד פסול ואפילו אם עד מקום הנקב יש צורת אות. וכ"ז קודם כתיבה אבל אם לאחר כתיבה נחלק האות לשתים ע"י נקב רואין אם יש בו צורת האות עד מקום הנקב כשר וכמו שיתבאר בסמוך בסעיף ט"ז ועיין ביאור הלכה:
(32) 'Into two' -- the hole is so small that when he passes the quill over it the hole is sealed with ink and is not felt by the quill; one may write on it, and even though a little ink fell in that spot and a fine hole is visible when held against the sun, it is valid. But if it was pierced so much that the ink does not carry across it, it is invalid, for the letter appears split into two because of it. And even if the hole is in the middle of the thickness of the letter, in its roof or its leg, with ink surrounding it on every side, it is invalid, even if up to the place of the hole there is a full letter-form. All this is before writing; but if after the writing the letter became divided in two by a hole, we examine it: if it still has the form of the letter up to the place of the hole, it is valid, as will be explained shortly in se'if 16; and see the Biur Halacha.
(לג) והדק ממנו לפרשת והא"ש - ט"ס וצ"ל לפרשת והיה כי יביאך שהיא יותר גדולה ולפרשת קדש ולפרשת והא"ש שהם ארוכות וכו' [ביאור הגר"א ויד אהרן] ורמ"י כתב שהסופרים שלהם עושים תיקון אחר שכל הקלפים הם שוים באורך א' ובעובי א' אלא שמניחין גליונין מפרשיות הקצרות:
(33) 'And a thinner one for the passage Vehaya Im Shamoa' -- this is a printer's error; it should read: 'for the passage Vehaya Ki Yeviacha, which is larger, and for the passages Kadesh and Vehaya Im Shamoa, which are long,' and so forth [Biur HaGra; Yad Aharon]. The Rama'i wrote that their scribes use a different arrangement: all the kelafim are equal in a single length and a single thickness, except that they leave wider margins for the shorter passages.
(לד) לאחר שנכתב וכו' - נקדים ב' הקדמות ואח"כ נבאר בעזה"י. א' כל אות צריך שיהא עליו צורתו הראוי לאותו אות וא"ל פסול ובזה אין חילוק אם לא נכתב כהלכתו או אם אח"כ נתקלקל. ב' כל אות שאין גויל מוקף לה מארבע רוחותיה פסולה ובדין זה יש שני פרטים. א' דוקא אם לא היה מוקף גויל קודם כתיבה אבל אם לאחר כתיבה נעשה נקב או קרע סמוך לאות מבחוץ ועי"ז אינו מוקף גויל כשר וכמו שיתבאר בסעיף ט"ז בשו"ע. ב' דעת רוב הפוסקים דאין צריך להיות מוקף גויל רק מבחוץ להאותיות ולא בתוכן חוץ מהירושלמי שמחמיר בזה. ועתה נבוא לבאר השו"ע אם לאחר שנכתב ניקב וכו' הטעם דבפנים אין צריך להקפת גויל ולפ"ז אפילו אם הנקב קודם כתיבה כשר והאי דנקט אם לאחר שנכתב ניקב משום דלכתחלה אין לכתוב אפילו אם הנקב באמצע חללו ואין ממלא את תוכו אבל באמת אם עבר וכתב אפילו אם היה הנקב קודם שנכתב כשר וא"צ שום תקון:
(34) 'After it was written,' etc. -- we shall first set out two premises and then explain, with God's help. First: every letter must bear the form proper to that letter, and if not, it is invalid; and in this there is no difference whether it was not written properly to begin with or became spoiled afterward. Second: any letter not surrounded by blank parchment (gevil) on all four sides is invalid; and in this law there are two particulars. One: this applies specifically if it was not surrounded by gevil already before the writing; but if after the writing a hole or tear formed next to the letter on the outside, so that it is no longer surrounded by gevil, it is valid, as will be explained in se'if 16 in the Shulchan Aruch. Two: most decisors hold that the surrounding gevil is required only outside the letters and not within them, except for the Yerushalmi, who is stringent in this. Now we come to explain the Shulchan Aruch's ruling, 'if after it was written it was pierced,' etc.: the reason is that within the letter no surrounding gevil is required; and according to this, even if the hole preceded the writing, it is valid. It phrased it as 'if after it was written it was pierced' only because ideally one should not write even where the hole is in the middle of the letter's hollow and does not fill its interior; but in truth, if he transgressed and wrote, then even if the hole was there before it was written, it is valid and requires no repair.
(לה) בתוך הה"א - וה"ה שאר אותיות שיש להן ג' דפנות ויש חלל בתוכו אבל ך' פשוטה וכ"ש וי"ו וכדומה לאו תוך מיקרי:
(35) 'Within the hei' -- the same applies to other letters that have three sides with a hollow enclosed within; but a final (straight) kaf -- and all the more so a vav and the like -- is not considered to have an 'interior.'
(לו) כל החלל - ואפילו נגע הנקיבה באות גופא כל שנשאר שריטה דקה מבחוץ כשר דאין שיעור לעובי האותיות:
(36) 'The whole hollow' -- even if the hole reached the body of the letter itself, so long as a thin sliver of the stroke remains on the outside it is valid, for there is no fixed measure for the thickness of the letters.
(לז) שגם בפנים וכו' - וא"כ דינו כמבחוץ אם היה הנקב בתוכו קודם כתיבה פסול ועיין בט"ז ובפמ"ג בשם הלבוש שיש להחמיר כהירושלמי. ודע דלהירושלמי צריך הקפת גויל בכל הצדדים מבפנים כמו מבחוץ ע"כ אם ניקב בתוכו קודם הכתיבה אצל האות ועי"ז איננו מוקף גויל יש לגרור מעט מבפנים מעובי הקו של האות ויהיה מוקף גויל ועיין בביאור הלכה סוף ד"ה אבל בירושלמי וכו':
(37) 'That also inside,' etc. -- and if so, its law is like the outside: if the hole was inside it before the writing, it is invalid. See the Taz and the Pri Megadim, in the name of the Levush, that one should be stringent like the Yerushalmi. And know that according to the Yerushalmi, surrounding gevil is required on all sides within, just as without; therefore, if it was pierced within before the writing, right beside the letter, so that it is not surrounded by gevil, one should scrape a little on the inside from the thickness of the letter's stroke, so that it becomes surrounded by gevil. See the Biur Halacha at the end of the passage beginning 'But in the Yerushalmi,' etc.
(לח) ניקב - וה"ה אם נמחק קצת מהדיו ולא ניקב. ודוקא בה"א פליג הרא"ש ומכשיר אם נשאר כל שהוא בין למעלה מהנקב ובין למטה דסבר דאין שיעור להנקודה התלויה בה ואפילו אם כתב מתחלה רגל קצר כזה כשר להרא"ש אבל בשאר אותיות כמו חי"ת וכדומה גם הרא"ש מודה דהרגל השמאלי דינו כמו רגל ימיני:
(38) 'Was pierced' -- the same applies if some of the ink was rubbed off, even without an actual hole. It is specifically regarding the hei that the Rosh disagrees and validates it if any amount remains, whether above the hole or below it, since he holds there is no fixed measure for the leg that hangs from it. And even if he initially wrote such a short leg, it is valid according to the Rosh. But regarding other letters, such as a chet and the like, even the Rosh concedes that the left leg has the same law as the right leg.
(לט) מצריכין כמלא וכו' - ומיירי בענין שאין בו חסרון משום הקפת גויל כגון שניקב לאחר הכתיבה כדבסמוך סט"ז בסופו דאל"ה פסול אפי' אם נשתייר יותר מכמלא אות קטנה גם להרא"ש:
(39) 'Require a full [small letter],' etc. -- this speaks of a case where there is no deficiency of surrounding gevil, for example where it was pierced after the writing, as explained shortly, in se'if 16 near its end; for otherwise it is invalid even if more than a full small letter's worth remains, even according to the Rosh.
(מ) והכי הלכתא - מדבריו אלו משמע דלא להחמיר בלבד פסק כדעת ש"פ אלא דפשיטא ליה דהלכה כוותיהו וא"כ צריך להזהיר מאד להסופרים שנכשלין בזה. ובתפילין ומזוזות דבעינן כסדרן לכאורה לא מהני שום תיקון אפילו התינוק קוראו לאות כיון שאנו רואין שאין לו צורת אות דבלא זה לא מיקרי ה' לפי דעת אלו הפוסקים וכדלקמן בסכ"ה ע"ש. ומ"מ נראה דיש להקל ע"י תיקון ודומיא שהקיל הפמ"ג בכף פשוטה שעשאו מרובע ע"י תיקון עי"ש:
(40) 'And this is the halachah' -- his wording here implies that he ruled not merely to be stringent like the view of many decisors, but that it is clear to him the halachah accords with them; if so, one must strongly warn the scribes who stumble in this. In tefillin and mezuzot, where we require writing in order (kesidran), seemingly no repair helps, even if a child reads it as that letter, since we ourselves see that it lacks the letter's proper form, for without that form it is not called a hei according to the view of these decisors, as explained below in sk 25, see there. Nevertheless it appears one may be lenient by means of a repair, similar to the Pri Megadim's leniency regarding a straight kaf that was made square, corrected by a repair, see there.
(מא) ניקב - וה"ה אם נפסק האות בלא נקב או נמחק קצה האות ומיירי השו"ע בארכו וה"ה אם נפסק קצת מעביו בין ע"י נקיבה או ע"י מחיקה אם נשאר שריטה דקה שחור כמו וי"ו או יו"ד דקה כשר דאין שיעור לעובי האותיות אלא דבניקב בין בעביו בין בארכו בעינן שניקב לאחר הכתיבה וכדלקמן בסט"ז [ממ"א ודה"ח]:
(41) 'Was pierced' -- the same applies if the letter broke without a hole, or the edge of the letter was erased; and the Shulchan Aruch is speaking of a break along its length. The same applies if a little of its thickness broke off, whether by a hole or by erasure: if a fine black sliver remains, like a thin vav or yud, it is valid, for there is no fixed measure for the thickness of the letters. Except that with a hole -- whether in its thickness or its length -- we require that it was pierced after the writing, as explained below in se'if 16 [Magen Avraham; Derech HaChaim].
(מב) הימיני - של ה"א. כתב הפמ"ג נראה לי דה"ה לשאר אותיות כגון ד' ל' פ' פשוטה צ' פשוטה קו"ף רי"ש או תי"ו או חי"ת [לכאורה בחי"ת בין רגלה הימיני או השמאלי] אם נשאר מהירך הימיני כיו"ד די בכך עכ"ל ועיין לקמן בסימן ל"ו בדיני צורת האותיות באות ל' ופ' פשוטה וצ' פשוטה וקו"ף ובאות תי"ו:
(42) 'The right leg' -- namely of a hei. The Pri Megadim wrote: it appears to me the same applies to other letters, such as a dalet, lamed, straight pei, straight tzadi, kuf, resh, tav, or chet (seemingly in a chet, whether its right leg or its left): if there remains of the right leg the amount of a yud, that suffices; end of his words. See below in siman 36, in the laws of the shapes of the letters, at the letter lamed, straight pei, straight tzadi, and kuf, and at the letter tav.
(מג) אם נשתייר - היינו מהנקב לצד מעלה ולא מצרפינן ליה מה שלמטה מהנקב אפילו אם תינוק דלא חכים ולא טיפש קראה לאות כיון דאנו רואין שלא נשאר צורת האות כתיקונו וכמו שנתבאר בסמוך בשם הט"ז אבל אם נשתייר מהנקב ולמעלה [או מההפסק ולמעלה אם נפסק האות באמצע] כשיעור אות קטנה כשר ואין צריך להראותו לתינוק וה"ה אם כתב לכתחלה רגל קטנה קצרה כזה דכשר ועיין ביד אפרים ובביאור הלכה:
(43) 'If there remains' -- that is, from the hole upward, and we do not combine with it whatever is below the hole, even if a child who is neither clever nor dull read it as the letter, since we see that the form of the letter has not remained as it should, as was explained just above in the name of the Taz. But if there remains, from the hole upward (or from the break upward, if the letter broke in its middle), the measure of a small letter, it is valid, and one need not show it to a child; and the same applies if he wrote from the start such a small, short leg, that it is valid. See Yad Ephraim and the Biur Halacha.
(מד) מלא או"ק - היינו יו"ד ובקוץ התחתון שלו לפי מה דפסק לקמן בסי' ל"ו בב"י דלא מיקרי יו"ד בלא קוץ התחתון:
(44) 'A full small letter' -- that is, a yud, including its lower tip (kotz), in accordance with his ruling below in siman 36 in the Beit Yosef, that it is not called a yud without its lower tip.
(מה) נפסק - י"ל בשני אופנים או מחמת נקב וזה אין כשר כ"א בניקב אח"כ כמו שיתבאר בסמוך בפנים או ע"י שנחסר הדיו באותו מקום ובאופן זה היה קאי הדין דשו"ע אפילו אם בתחלת הכתיבה נעשה כך:
(45) 'Broke' -- this can be understood in two ways: either because of a hole -- and this is valid only if it was pierced afterward, as will be explained shortly in the text -- or because the ink is lacking in that spot; and in this case the Shulchan Aruch's ruling applies even if it was made so at the very start of the writing.
(מו) הפשוטות - ולפיכך אין מועיל בה אם נשתייר כמלא יו"ד דאדרבה נראית כיו"ד ופסול הלכך בעינן תינוק בזה:
(46) 'The simple letters' -- and therefore, in such a letter, it does not help if a full yud's worth remains -- on the contrary, it then looks like a yud and is invalid; therefore we require a child's reading in this case.
(מז) או שנפסק רגל הנו"ן - כצ"ל. ופי' נו"ן פשוטה וכיוצא בה כגון כ"ף פשוטה שרגלה קצרה ודומה קצת לדל"ת או לרי"ש [מפמ"ג ודה"ח]:
(47) 'Or the leg of the nun broke' -- thus it should read. The meaning is a final (straight) nun and the like, such as a final kaf whose leg became short and resembles somewhat a dalet or a resh [Pri Megadim; Derech HaChaim].
(מח) אם תינוק - עיין בט"ז שכתב דהך נפסק מיירי שנפסק קצת מאורך האות ולמטה לגמרי ולא נשאר ממנו רק החלק שקודם ההפסק אז תלוי בקריאת התינוק אם ספק לנו אם נשאר כשיעור של האות ההוא אבל אם נשתייר גם למטה מן ההפסק דהיינו שנעשה ההפסק ברחבו של רגל האות ואחר ההפסק נשאר עוד למטה חלק מן הרגל בזה לא מועיל תינוק דהתינוק יצרף מה שלמטה ממנו לחלק העליון ובאמת אין לו צירוף וזה דומה לנפסק רגל הא' אלא צריך לכסות את חלק הנשאר אחר ההפסק ואין זה דומה למש"כ השו"ע כאן דאין צריך לכסות שאר האותיות דבזה ודאי מודה דצריך לכסות וכן הסכמת האחרונים [דלא כמש"כ בספר ישועות יעקב להקל כשיטת המאירי. ובביאור הגר"א בסימן ל"ו משמע ג"כ כהט"ז דלא מצרפינן להאות מה שלמטה]:
(48) 'If a child' -- see the Taz, who wrote that this 'break' refers to a case where a bit of the length of the letter broke off, and everything below it is gone, leaving only the part above the break; then it depends on the child's reading, where we are in doubt whether the measure of that letter remains. But if something remains below the break too -- that is, the break runs across the width of the letter's leg, and beneath the break a further portion of the leg remains -- in this a child does not help, for the child would join what is below it to the upper portion, whereas in truth there is no joining, and this resembles the case of a hei whose leg broke; rather, he must cover the part remaining below the break. This is not like the Shulchan Aruch's statement here that one need not cover the other letters, for in this case he certainly concedes that one must cover; and so is the consensus of the later authorities [not like Sefer Yeshuot Yaakov, who is lenient following the Meiri; and the commentary of the Gra in siman 36 likewise implies like the Taz, that we do not combine to the letter what is below it].
(מט) לא חכם - היינו חכם כ"כ שמבין הענין ומתוך זה הוא אומר האות הנפסק ויהיה מתפרש שפיר אבל אין נקרא חכם אם הוא חכם בהכרת האותיות היטיב ואין מבין מה שכתוב לפניו דזהו ודאי ג"כ כשר:
(49) 'Not clever' -- that is, so clever that he grasps the sense of the passage, and from that reasons out the broken letter, so that it reads correctly; but he is not called 'clever' if he is merely skilled at recognizing the letters well yet does not understand what is written before him, for such a reader's identification is certainly valid too.
(נ) ולא טפש - טיפש היינו שאינו יודע לקרות האותיות וכל שיודע לקרות האותיות אע"ג דאינו בקי כ"כ בצורת האותיות כל שאומר דאין בו צורת אות פסול הוא:
(50) 'Nor foolish' -- 'foolish' means one who does not know how to read the letters; and anyone who does know how to read the letters, even if he is not so expert in their exact forms, whenever such a reader says the shape is not a valid letter, it is invalid.
(נא) וא"צ לכסות - וכן כתב הלבוש אבל המ"א בשם מהרי"ט כתב דצריך לכסות מה שלפניו שאם יתחיל מתחלת המקרא סרכיה נקיט ואזיל ואפילו תינוק שלא למד באותה פרשה אפילו הכי צריך לכסות לו מה שלפניו עד תיבה זו אבל תיבה זו וגם מה שלאחריה א"צ לכסותו כלל בכל גווני:
(51) 'And one need not cover' -- so wrote the Levush; but the Magen Avraham, in the name of the Maharit, wrote that one must cover what precedes it, for if he begins from the start of the verse he will read on by rote habit, and even a child who has not studied that passage -- even so one must cover for him what precedes it, up to this word; but this word itself, and also what follows it, one need not cover at all, in any case.
(נב) האות - כגון אלפי"ן שאין היו"ד שלהן נוגעת אל עצמן וכן נקודת הפ"א שאין נוגעת לגגה וכן לכל אותיות שאינן פשוטות שיש הפסק באמצען שהוא פסול בין אם נעשה זה בעת הכתיבה או לאחר הכתיבה שלא מהני קריאת התינוק אלא היכא שנפסק האות ובציר לה משיעורא ומחמת זה דומה האות במקצת לאות אחר כגון וי"ו קטיעה שאנו מסופקין אם הגיע לאורך וי"ו או כשיעור יו"ד ולכך תועיל קריאת התינוק דגילוי מילתא בעלמא הוא דאורך וי"ו יש לה מדלא קראה יו"ד וה"ה לאות נו"ן פשוטה וכ"ף פשוטה שיש ספק אם יש להם שיעור ארכן או כ' כפופה שדומה במקצת לבי"ת וכה"ג שיש להסתפק אם תמונתה דומה לאות אחרת אבל היכא שאנו רואין שאין האות נשאר בצורתה מה מועיל בראיית התינוק ועינינו רואין שאין האות בצורתה. ולכן אין להכשיר האל"ף שרגל שמאלו אין נוגע לקו האמצעי בשביל שהתינוק יקראנה אל"ף דמפני הפירוד לא יטעה לומר שהיא עיין הפוכה. וה"ה בפשוטות אם אנו רואים ודאי שאין בו צורת אות לא מהני מה דתינוק קורא אותו כך רק בספק לנו אם יש בו שיעור כראוי מהני וכ"ז בלא תיקון ולענין תיקון עיין בבה"ל:
(52) 'The letter' -- such as alefs whose yud does not touch their body, and the point of a pei that does not touch its roof, and likewise all non-straight letters that have a gap in their middle, such a letter is invalid, whether this happened at the time of writing or afterward, and a child's reading does not help -- except where the letter broke and became less than its required measure, and because of this the letter somewhat resembles a different letter, such as a shortened vav, where we are in doubt whether it reached the length of a vav or only the measure of a yud; there the child's reading helps, for it is a mere disclosure of the fact that it has a vav's length, since he did not read it as a yud. The same applies to a final nun or a final kaf where there is doubt whether they have their proper length, or a bent kaf that somewhat resembles a bet, and similar cases where one may be in doubt whether its shape resembles another letter. But where we see that the letter does not retain its form, what does the child's reading help, when our own eyes see that the letter is not in its proper form? Therefore one should not validate an alef whose left leg does not touch the middle stroke merely because a child reads it 'alef,' for owing to the separation he would not mistakenly call it an inverted ayin. The same applies to the straight letters: if we see for certain that it has no valid letter-form, it does not help that a child reads it so; only where we are in doubt whether it has the proper measure does the child's reading help. All this is without a repair; regarding a repair, see the Biur Halacha.
(נג) כשנפסק אות - וה"ה מה דמכשיר לעיל בסט"ו את ניקב רגל הה"א אבל בניקב חללו דמכשיר שם המחבר הוא אפילו ניקב קודם הכתיבה ולא נקט שם אם לאחר שנכתב וכו' אלא משום סיפא דניקב רגל:
(53) 'When a letter broke' -- and the same applies to what was validated above in se'if 15, the case where 'the leg of the hei was pierced.' But the case 'its hollow was pierced,' which the Mechaber validated there, holds even if it was pierced before the writing; he only phrased it there as 'if after it was written' etc. on account of the latter clause, 'the leg was pierced.'
(נד) ואח"כ נפסק - והטעם דלא בעינן מוקף גויל רק בעת הכתיבה ולפ"ז אפילו אם מגיע הנקב מאות לאות שסמוך לו ג"כ כשר אכן הדה"ח בהלכות קה"ת בדין כ"ו מחמיר בזה ועיין בביה"ל. ודע עוד דבענין נגיעת האותיות אפילו אם יודע בבירור שנעשה לאחר הכתיבה ג"כ פסול [דה"ח שם וכן משמע בב"ש באה"ע בסימן קכ"ה סקכ"ט עי"ש דס"ל ג"כ דצריך לחוש לתי' א' שבב"י בד"ה וא"ת וכו' דאין מחלק בנגיעה בין אם לא הוקף בעת הכתיבה או אח"כ]:
(54) 'And afterward broke' -- the reason is that we require surrounding gevil only at the time of the writing; and accordingly, even if the hole extends from one letter to the letter beside it, it is likewise valid. However, the Derech HaChaim, in the laws of reading the Torah, law 26, is stringent in this; see the Biur Halacha. And know further that with regard to letters touching, even if he knows for certain it happened after the writing, it too is invalid [Derech HaChaim there; and so is implied by the Beit Shmuel in Even HaEzer, siman 125, sk 29, see there, that he too holds one must be concerned for the first answer in the Beit Yosef, in the passage beginning 'And if you ask' etc., which draws no distinction, regarding touching, between its not being surrounded at the time of writing or afterward].
(נה) מתחלה - ובספק מתי נעשה הנקב תולין דאחר הכתיבה נעשה דמסתמא אם היה בעת הכתיבה היה הסופר רואהו אם לא שהנקב קטן מאד [דה"ח]:
(55) 'From the start' -- and where it is in doubt when the hole was made, we assume it was made after the writing, since presumably, had it been there at the time of writing, the scribe would have seen it -- unless the hole is very small [Derech HaChaim].
(נו) נקב - דוקא נקב או קרע אף שאין ניכר כלל ההפסק ומשום דלא היה מוקף גויל בעת הכתיבה [לבוש"ר] אבל הפסק בעלמא כשר וא"צ שום תיקון כיון שיש שיעור אות עד מקום ההוא וכדלעיל בסט"ו וסט"ז. ואם נמצאות שריטות דקות בתוך שיעור אות עיין בביאור הלכה בסעיף כ"ה:
(56) 'A hole' -- specifically a hole or a tear -- even though the break is not recognizable at all -- and this is because it was not surrounded by gevil at the time of writing [Levushei Serad]; but a mere break is valid and needs no repair, since there is a full letter's measure up to that point, as above in se'if 15 and se'if 16. And if fine scratches are found within the measure of a letter, see the Biur Halacha at se'if 25.
(נז) רגל - וכ"ש גגי האותיות ואמצען שאין להם היקף גויל בעת הכתיבה ונקט רגל לרבותא אף דבעת כתיבת סוף הרגל כבר נגמר צורת האות כראוי אפ"ה כל זמן שלא סלק ידו מן האות מיקרי ד"ז בעת הכתיבה ובעינן לכל האות הקפת גויל:
(57) 'A leg' -- and all the more so the roofs of the letters and their middles, which lack surrounding gevil at the time of writing. It specified 'a leg' as a novelty: even though, when he writes the end of the leg, the form of the letter is already properly complete, nevertheless, as long as he has not lifted his hand from the letter, this is still considered 'at the time of writing,' and surrounding gevil is required for the whole letter.
(נח) בלי הקף - ואפילו אם היא ארוכה כראוי דהיינו שיש בה שיעור שאפילו אם נגררה קצת למטה ישאר צורת אות מ"מ פסול [מ"א בס"ק כ"א ועיין במ"א סק"ג]:
(58) 'Without surrounding' -- even if the leg is properly long -- that is, it has enough length that, were it scraped a little at the bottom, the letter's form would still remain -- even so it is invalid [Magen Avraham, sk 21; and see Magen Avraham, sk 3].
(נט) מתחלתו - אבל אם נחתך הקלף אח"כ ועי"ז אין מוקף גויל כשר:
(59) 'From its start' -- but if the kelaf was cut only afterward, and thereby the letter is not surrounded by gevil, it is valid.
(ס) פסול - ואם רוצה לתקן יגרר קצת כדי שיהיה מוקף גויל אבל דיבוק מטלית לא מהני להקפת גויל דבעינן הקפת האות מגוף הסת"מ:
(60) 'Invalid' -- and if he wishes to repair it, he should scrape a little so that it becomes surrounded by gevil; but attaching a patch does not help for the surrounding gevil, since we require that the letter be encircled by the body of the Torah scroll, tefillin, or mezuzah itself.
(סא) דיו - וה"ה צבע אחר אם עי"ז נשתנה צורת האות אבל נטף שעוה על האות אף שמכסה להאות ואינה ניכרת אעפ"כ מותר לסלק דשעוה אין מבטל הכתב ועיין בבה"ל:
(61) 'Ink' -- the same applies to any other coloring, if thereby the form of the letter was changed. But if wax dripped onto the letter, even though it covers the letter so it is not recognizable, one may nonetheless remove it, since wax does not nullify the writing; see the Biur Halacha.
(סב) לתוך - בין שנגע הטיפה בגוף האות או לא. וה"ה אם נפלה הטפה על קווי האות ממש ונתפשט הטפה גם מבחוץ להאות עד שאינו ניכר האות בתמונתו עי"ז:
(62) 'Into' -- whether the drop touched the body of the letter or not. The same applies if the drop fell directly on the strokes of the letter and spread out beyond the letter as well, so that the letter's form is no longer recognizable because of it.
(סג) ואינה ניכרת - בין שעי"ז נשתנה תמונתה לאות אחרת כגון שנפלה טפה תוך חלל ב' ונראית כפ"א או שאבדה תמונתה ואין שמה עליה. וה"ה בשאר אותיות ואפילו אם ע"י הטיפה נחסר רק קוצה של יו"ד בין בימין או שמאל פסול. ואם מסתפק בהאות אם צורתו עליו או לא מראה לתינוק דלא חכים ולא טיפש:
(63) 'And it is not recognizable' -- whether thereby its shape changed into another letter -- for example, a drop fell inside the hollow of a bet so that it looks like a pei -- or its form was lost and its name no longer applies to it. The same applies to the other letters; and even if the drop caused only the tip of a yud to be lost, whether on the right or the left, it is invalid. And if he is in doubt about the letter, whether its proper form remains or not, he shows it to a child who is neither clever nor dull.
(סד) לגרור - ואפילו מעביר קולמוס על האות לאחר שחק תוכו אינו מועיל. מ"א:
(64) 'To scrape' -- and even passing a quill over the letter after he has carved out its interior does not help. Magen Avraham.
(סה) הדיו - ואפילו אם הטפה לח עדיין והאות כבר נתייבש לא אמרינן שהיא ככסוי בעלמא על האות כיון שעכ"פ נפסל צורת האות קודם התיקון:
(65) 'The ink' -- even if the drop is still wet while the letter itself has already dried, we do not say that it is merely a covering over the letter, since in any case the form of the letter was already invalidated before the repair.
(סו) חק תוכות - פי' שחוקק התוך של האות וסביבו וממילא נשאר מה שאינו מוחק בצורת אות:
(66) 'Chak tochot' -- that is, he carves out the inner space of the letter and around it, so that automatically what he does not erase is left in the shape of the letter.
(סז) ולא וחקק - וזה ג"כ חקיקה מיקרי כיון שאינו עושה מעשה בגוף האות אלא יגרור ג"כ קצת מהאות עד שלא ישאר צורתו עליו ואח"כ יתקננו אם לא כתב עדיין אחר אות זו דאל"ה פסול בתו"מ דבעינן כסדרן. וכ"ז הדין דשו"ע הוא מחמת שהאות אינו ניכר ונתבטל עי"ז כתיבה הראשונה אבל אם לא נשתנה צורת האות יכול למחוק טיפת הדיו ואין חילוק בין שנפל הדיו לתוך חלל האות בלבד או גם על האות גופא ונתעבה גג האות או גם הירך עי"ז אפ"ה יוכל לתקן ולא מיקרי חק תוכות מאחר שהאות ניכר עדיין. ומדינא אפילו תיקון לא בעי בזה רק יותר טוב שיתקן ע"כ יכול לעשות תיקון זה אפילו בתו"מ דבעינן כסדרן ועיין בבה"ל. ודע עוד דהשו"ע מיירי אפילו נפלה הטיפה אחר שנגמר האות וכ"ש אם נפלה קודם שנגמר האות כדין וגמר מתחלה האות ואין ניכר עדיין דבזה כו"ע סוברים דאין תקנה בגרירת הטפה דהרי לא היה עליו מעולם שם אות רק עתה ע"י גרירה והוי חק תוכות ממש אך אם גרר מתחלה הטפה ורוצה עתה לגמור האות בזה יש דיעות בין הפוסקים דהרד"ך סובר דלא מהני דס"ל דכיון שנפלה הטפה על מקצת האות נתבטל ממנו שם כתיבה והוי כחקיקה בעלמא ומה מהני אף אם יגמר האות ע"י כתיבה וכ"ש אם נפלה על הקלף טפת דיו ממש ונעשה כמין חצי אות דלא שרי להשלים האות ע"י כתיבה והב"י והרמ"א [באה"ע בסי' קכ"ה ס"ד] מקילין אפילו בזה הדין האחרון וסוברין דלא מיקרי חק תוכות אלא כשגומר האות ע"י חקיקה אך האחרונים מצדדין להחמיר בזה הדין האחרון אם לא שמושך הטפת דיו הלחה ומזיזה ממקום למקום עד שעושה ממנה אות שלם דזה הוי כתיבה:
(67) 'And not "and he shall carve"' -- this too is called carving, since he does not perform an act on the body of the letter; rather, he must also scrape a little of the letter until its form no longer remains upon it, and afterward fix it -- provided he has not yet written after this letter; for otherwise it is invalid in tefillin and mezuzot, where we require kesidran. All this ruling of the Shulchan Aruch is because the letter is not recognizable and the original writing was thereby nullified; but if the form of the letter did not change, he may erase the drop of ink; and it makes no difference whether the ink fell only inside the hollow of the letter, or also on the letter itself, thickening the roof of the letter, or even the leg -- even so he may fix it, and it is not called chak tochot, since the letter is still recognizable. By law he does not even need to repair it in this case, only it is better that he do so; therefore he may make this repair even in tefillin and mezuzot, where we require kesidran; see the Biur Halacha. And know further that the Shulchan Aruch speaks even where the drop fell after the letter was finished, and all the more so if it fell before the letter was completed properly, so that he finished it first and it is still not recognizable; for in this all agree there is no remedy by scraping the drop, since it never bore the name of a letter -- only now, through scraping -- and it is actual chak tochot. But if he scraped the drop first and now wishes to complete the letter, here there are differing views among the decisors: the Radach holds it does not help, since he maintains that once the drop fell on part of the letter the status of writing was nullified from it, and it becomes mere carving, and how would it help even if he completes the letter by writing; and all the more so if an actual drop of ink fell on the kelaf and became like half a letter, that it is not permitted to complete the letter by writing. The Beit Yosef and the Rema [in Even HaEzer, siman 125, se'if 4] are lenient even in this latter case, holding that it is called chak tochot only when he completes the letter by carving. But the later authorities incline to be stringent in this latter case -- unless he draws the still-wet drop of ink and shifts it from place to place until he forms a complete letter from it, for that is genuine writing.
(סח) אין תקנה - פי' ע"י המחיקה אין תקנה אבל מותר להוסיף דיו ולעשותו עגול. וכן אם טעה וכתב רי"ש במקום ד' וכ' במקום ב' והוו אותיות עבין אין תקנה שיגררן ויעמידן בתמונת ד' וב' אבל מותר להוסיף עליהן דיו ולעשותן בתמונת ד' וב'. וכן אם טעה וכתב במקום זיי"ן נו"ן פשוטה אין תקנה שיגררו ויעמידו על זיי"ן דזה הוי חק תוכות ממש אלא צריך למוחקו לגמרי וכן אם טעה וכתב ה"א במקום ד' אין תקנה לגרור הרגל של הה"א וישאר ד' דדומה לסמ"ך וב' שנפל טפת דיו שם ונתקלקל תמונתו עי"ז דלא מהני גרירת הטפה משום דאין עושה מעשה בגוף האות וה"נ כה"ג אלא צריך לגרור ג"כ קצת הגג עד שישאר כמו וי"ו או לגרור הירך עד שלא ישאר צורת ד' עליו ואח"כ יתקננו כללא דמילתא גורר לא מהני להיות כתיבה בכך ומיקרי חק תוכות אבל כותב מהני שמעבה האות מדלי"ת רי"ש או מרי"ש ד' שכותב התג. ולענין שלא כסדרן נהפוך הוא גורר כשר כגון בדיבוק אות לאות וכדלקמן דזה לא מיקרי מעשה בגוף האות וכותב פסול. ומה שהתרנו להוסיף דיו ולהעמידן על תמונתן היינו כשלא כתב האותיות שאחר זה:
(68) 'There is no remedy' -- meaning by erasing there is no remedy, but it is permitted to add ink and round it out. Likewise if he erred and wrote a resh in place of a dalet, or a kaf in place of a bet, and they came out as thick letters, there is no remedy to scrape them into the form of a dalet or a bet; but it is permitted to add ink to them and shape them into a dalet and a bet. Likewise if he erred and wrote a final nun in place of a zayin, there is no remedy to scrape it into a zayin, for that is actual chak tochot; rather he must erase it entirely. Likewise if he erred and wrote a hei in place of a dalet, there is no remedy to scrape off the leg of the hei so that a dalet remains -- which is comparable to a samech, or to a bet on which a drop of ink fell and spoiled its shape -- for scraping the drop does not help, since he performs no act on the body of the letter; and here it is the same. Rather he must also scrape a little of the roof until it is left like a vav, or scrape the leg until the form of the dalet no longer remains upon it, and then fix it. The rule of the matter: scraping does not help to count as writing, and is called chak tochot; but writing helps -- as when he thickens a letter from a dalet into a resh, or from a resh into a dalet by writing the corner (tag). And regarding writing out of order, it is the reverse: scraping is valid -- such as separating one letter joined to another, as below, since that is not an act on the body of the letter -- while writing is invalid. And what we permitted -- to add ink and set them into their proper form -- applies only where he has not yet written the letters that follow.
(סט) למחוק התג - ואפילו אם אח"כ ימשוך ג"כ גגו ותחתיתו של הכ' לא מהני דבלא"ה צורתה עליה:
(69) 'To erase the tag' -- and even if afterward he also extends the roof and base of the kaf, it does not help, for even without that its invalid form is already upon it.
(ע) שנדבק - ואם פוסל בזה נגיעה דקה כחוט השערה עיין מה שכתבנו לקמן לענין ה"א ועיין בבה"ל:
(70) 'That became attached' -- and whether a fine touching, thin as a hair, invalidates in this case, see what we wrote below regarding a hei, and see the Biur Halacha.
(עא) ונסתמה - והוי כמ"ם סתום שמקומו רק בסוף תיבה ולא באמצעותה וכן כל אותיות מנצפ"ך הכפולין בא"ב כותב את הראשונות בתחלת התיבה ובאמצעיתה והאחרונות בסוף ואם שינה פסול:
(71) 'And it closed up' -- and it becomes like a closed (final) mem, whose place is only at the end of a word and not in its middle. So too for all the letters mem-nun-tzadi-pei-kaf, which have double forms in the alphabet: he writes the ordinary forms at the beginning and middle of the word, and the final forms at the end; and if he reversed them, it is invalid.
(עב) ולפותחה - וה"ה שאר אותיות שנתקלקל תמונתם בעת הכתיבה או אח"כ וע"י הגרירה יעמדו על תמונתם כגון ד' שהמשיך רגלו ודומה לך' פשוטה וכל כה"ג אין מועיל להן גרירה כיון שאינו עושה מעשה בגוף האות הנשאר אלא ימחוק רגלו וכנ"ל בס"ק ס"ח ואח"כ יתקננו. וה"ה דמהני בזה אם המשיך גגו של האות לרחבה עד שנראה לכל שהוא ד' אבל לעיל בכתב ה"א במקום ד' דכתבנו שם דצריך ג"כ למחוק רגל הד' או גגו מלבד רגל הה"א לא מהני עצה זו דהמשכת גג הד' דהרי בלא"ה צורתו עליו לכך לא מיקרי זה שום תיקון:
(72) 'And to open it' -- the same applies to other letters whose shape was spoiled, whether at the time of writing or afterward, and which by scraping would be restored to their proper shape, such as a dalet whose leg he extended so that it resembles a final kaf, and all similar cases: scraping does not help them, since he performs no act on the body of the letter that remains; rather he should erase its leg, as above in sk 68, and then fix it. The same applies -- and it does help here -- if he extends the roof of the letter across its width until it is plain to all that it is a dalet. But earlier, regarding writing a hei in place of a dalet, where we said that one must also erase the leg of the dalet or its roof, besides the leg of the hei, this counsel of extending the roof of the dalet does not help, for even without it its invalid form is upon it; therefore this counts as no repair at all.
(עג) כחק תוכות - דבגוף האות אין עושה שום מעשה אלא גורר הסתימה וה"ה אם טעה וכתב ח' במקום ב' זייני"ן אין מועיל לגרור הגג לבד מהך טעמא אלא צריך לגררם עד שיבטלם מתמונתם. וכן אם טעה ועשה ך' פשוטה למעלה כעין דל"ת שלפי דעת הרבה מן הפוסקים היא פסולה כמו שיבואר לקמן בסי' ל"ו ג"כ אין מועיל לגרור התג ולעשותה עגולה דהוי חק תוכות אלא יוסיף עליה דיו ויעשה עגולה. ונראה דלא מעכב שלא כסדרן בתיקון זה דבלא"ה צורתה עליה:
(73) 'Like chak tochot' -- for on the body of the letter he performs no act at all, but merely scrapes away the sealed part. The same applies if he erred and wrote a chet in place of two zayins: it does not help to scrape only the connecting roof, for that same reason; rather he must scrape them until he abolishes their present form. Likewise if he erred and made a final kaf with a dalet-like corner on top -- which according to many decisors is invalid, as will be explained below in siman 36 -- here too it does not help to scrape off the corner and round it, for that is chak tochot; rather he should add ink to it and make it round. And it appears that the requirement of kesidran does not impede this repair, since even without it its form is already upon it.
(עד) ומה תקנתה - כל שכתוב בסעיף זה שיש תקנה היינו קודם שכתב אות שאחריו דאל"ה פסול בתו"מ דבעינן בהן כסדרן דוקא לבד מהיכא שנבאר בהדיא דלא מעכב בזה כסדרן:
(74) 'And what is its remedy' -- wherever this se'if says there is a remedy, it means before he wrote the letter after it; for otherwise it is invalid, in tefillin and mezuzot, where we specifically require kesidran, except in cases we explicitly note that kesidran does not impede.
(עה) כצורת נ"כ - כי כתיבת המ' פתוחה הוא בב' כתיבות דהיינו בתחלה כותבין כמו נו"ן כפופה ואח"כ תולין בצדה כמו וי"ו וא"כ כל שנעשה הפסול בו דהיינו הו' צריך לגוררו כולו אבל הנו"ן שנכתב בהכשר אין צריך לגוררו וה"ה בכל אות שנכתב בב' כתיבות כגון ג' וכיו"ב ונעשה פסול בכתיבה א' אין צריך לגרור רק אותה לאפוקי ברי"ש שעשאה כמין ד' דבפעם א' נכתב הכל בפסול צריך הכל לגרור:
(75) 'Like the form of a bent nun' -- because an open mem is formed in two strokes: first one writes something like a bent nun, and then one hangs a vav-like stroke at its side. Accordingly, whatever the invalidity occurred in -- namely the vav -- he must scrape away entirely; but the nun, which was written validly, he need not scrape. The same applies to any letter written in two strokes, such as a gimel and the like, where the invalidity occurred in one stroke: he need scrape only that stroke. This excludes a resh that he shaped like a dalet, where the whole was written in a single stroke, in invalidity, so he must scrape it all.
(עו) ורי"ש - או וי"ו שעשאו כמין רי"ש וכל כה"ג שנעשה בכתיבה אחת:
(76) 'And a resh' -- or a vav that he made in the form of a resh, and all similar cases made in a single stroke.
(עז) כמין ד' - וה"ה בגגו של כ' פשוטה שעשאו רחב עד שנראה כד' או רי"ש ועיין בבה"ל. והסופרים נכשלין בזה בעו"ה:
(77) 'In the form of a dalet' -- the same applies to the roof of a final kaf that he made so wide that it looks like a dalet or a resh; see the Biur Halacha. Scribes stumble in this, in our many sins.
(עח) שנגמרה - האות בארכו כראוי כגון שכתב תיבת לו ונדבק הוי"ו בקצהו להלמ"ד וכל כיוצא בזה ואפילו בנגיעה כל דהו שלא נשתנית עי"ז האות מצורתה אפ"ה פסול דבעינן שיהא האות מוקף גויל. ואם נתפשטו האותיות מכח לחות הדיו שקורין גיפלאסין עד שנראין כדבוקין ומ"מ נראה שאין האותיות נוגעין כשר ואם האותיות נוגעין אף שנעשה זה לאחר הכתיבה אפ"ה פסול אה"ע בסימן קכ"ה סט"ז בהג"ה ובב"ש עי"ש ועיין לעיל בבה"ל בסוף סט"ז. ואם נמצא דיבוק בין אות לאות כשהוציאו ס"ת לקריאה עיין לקמן בסימן קמ"ג בבה"ל:
(78) 'That was completed' -- the letter, in its full proper length -- for example, he wrote the word lo (lamed-vav) and the vav became attached at its tip to the lamed, and all similar cases; even with the slightest touching, though the letter did not thereby change from its form, it is nonetheless invalid, for we require every letter to be surrounded by gevil. And if the letters spread out from the wetness of the ink (what is called 'bleeding') until they appear joined, yet it can still be seen that the letters are not actually touching, it is valid. But if the letters are actually touching, even though this happened after the writing, it is still invalid [Even HaEzer, siman 125, se'if 16, in the gloss and the Beit Shmuel, see there]; and see above in the Biur Halacha at the end of se'if 16. And if an attachment is found between one letter and another when the Torah scroll was taken out for reading, see below in siman 143 in the Biur Halacha.
(עט) כשר - וה"ה אם רגלי האותיות או גגן ואמצען מגיע לסוף בלי היקף קלף רשאי לגרר קצת דלא גרע מנדבק אות לאות דמהני גרירה. ודע דבזה אין מעכב שלא כסדרן כמבואר לקמן בסכ"ה מאחר דאין מוסיף בגוף האות. ואפילו באותיות השם שנגמרו ודיבוקן למטה רשאי לגרור:
(79) 'It is valid' -- the same applies if the legs of the letters, or their roofs and middles, reach the edge with no kelaf surrounding them: he may scrape a little, for it is no worse than one letter joined to another, where scraping helps. And know that here the requirement of kesidran does not impede, as explained below in sk 25, since he adds nothing to the body of the letter. And even in the letters of a Divine Name that were completed and whose attachment is below, he may scrape.
(פ) חק תוכות - ומיירי שלא נשתנה האות מצורתה ע"י הדביקות אבל אם נשתנית האות מצורתה ואין התינוק יכול לקרותה וכ"ש אם נשתנית לצורת אות אחרת כגון וי"ו שנדבק בסופו לנו"ן כפופה דיבוק עב שנראית כצורת טי"ת עד שתינוק דלא חכים ולא טיפש יקרא אותו לטי"ת לא מהני גרירת הדיבוק בזה דהוי כמ"ם שנסתמה ומקרי חק תוכות וע"כ צריך לגרור גם הנו"ן שגם הוא נשתנה מצורתו ונפסל ע"י הדיבוק וכן כל כיוצא בזה:
(80) 'Chak tochot' -- it speaks of a case where the letter did not change from its form because of the attachment; but if the letter did change from its form and a child cannot read it -- and all the more so if it changed into the form of a different letter -- for example, a vav that became attached at its end to a bent nun with a thick join, so that it looks like a tet, until a child who is neither clever nor dull reads it as a tet -- scraping the join does not help in this, for it is like a mem that became sealed, and is called chak tochot; therefore he must also scrape the nun, which likewise changed from its form and became invalid through the join; and so in all similar cases.
(פא) כתקונה - ובנפלה טפת דיו בסי"ז אף דנכתבה מתחלה כתקונה נתקלקלה ע"י הטפה ואינה ניכרת משא"כ בזה דאפילו קודם הגרירה ניכר היטב כל אות בפני עצמה ולפ"ז אם כל אורך האות דבוקה לחברתה לא מהני גרירה. והפר"ח מיקל בזה. ועיין בש"א ובנתיב חיים:
(81) 'Properly' -- in the case of a drop of ink falling, in sk 17, even though the letter was written properly at first, it became spoiled by the drop and is no longer recognizable; which is not so here, for even before the scraping each letter is well recognizable on its own. According to this, if the entire length of the letter is attached to its neighbor, scraping does not help. The Pri Chadash is lenient in this; and see the later authorities cited there and Nativ Chaim.
(פב) אם נגעו - אבל אם יש הפסק דק אפילו רק כחוט השערה כשר:
(82) 'If they touched' -- but if there is a fine gap, even only as thin as a hair, it is valid.
(פג) הה"א - אף אם נדבק רק כחוט השערה באופן שהתינוק יודע שהוא ה"א אפ"ה צריך לגרור כל הרגל דכל שאין צורת אות עליו כמו שנמסרה למשה מסיני אין שם אות עליו וכן בקו"ף לא מהני קריאת התינוק:
(83) 'The hei' -- even if it became attached only by a hair's width, in a way that the child knows it is a hei, even so he must scrape off the entire leg, for anything that does not bear the letter's proper form, as it was transmitted to Moshe at Sinai, has no letter-status upon it; and likewise with a kuf, the child's reading does not help.
(פד) יגרור - ולא מהני הפרדה בעלמא משום דהוי כחק תוכות:
(84) 'He scrapes' -- and mere separation does not help, because it would be like chak tochot.
(פה) הרגל - פי' כולו בין בה"א בין בקו"ף כיון שנעשה בפיסול ועיין בבה"ל:
(85) 'The leg' -- that is, the whole leg, whether in a hei or a kuf, since it was formed in invalidity; and see the Biur Halacha.
(פו) בגג האל"ף - דאין להיו"ד העליון והתחתון ליגע בהגג אלא בדקות שבהם כמו שיתבאר לקמן במ"ב בסימן ל"ו בדיני צורת האותיות:
(86) 'To the roof of the alef' -- for the upper yud and the lower yud should touch the roof only with their thin points, as will be explained below in the Mishnah Berurah in siman 36, in the laws of the forms of the letters.
(פז) פני האל"ף - היינו היו"ד העליון והיינו דוקא שנדבקה כולה שנפסדה צורתה אבל אם נתפשט מעט ואינו דק כראוי ליופי הכתיבה אם נשאר הפרש אין בכך כלום ואין צריך שום תיקון:
(87) 'The face of the alef' -- that is, the upper yud; and this is specifically where it became wholly attached, so that its form was ruined. But if it merely spread a little and is not as thin as it should be for the beauty of the writing, so long as a distinction remains, it is nothing, and no repair is required.
(פח) להפרידה - פי להפריד את הנגיעה לבדה וישאר האות ממילא כראוי:
(88) 'To separate it' -- meaning to separate only the point of contact, so that the letter is automatically left as it should be.
(פט) כל וכו' - היינו שיגרור הרגל כולו ולא סגי שיפריד הרגל מעל האל"ף עד שיבטלנו מצורת אות לבד כיון שנכתב כל הרגל בפסול. וכן בנדבק יו"ד שעל האל"ף בגג שתחתיו צריך לגרור כל היו"ד ולכותבו מחדש ויש שמחמירין בנדבק היו"ד העליון בעת הכתיבה לגרור כל האל"ף עבור זה כי ממילא נכתב אח"כ שאר האות בפסול עי"ז אך בדיעבד צ"ע אם יש להחמיר בזה וכמו שכתבתי בבה"ל:
(89) 'All,' etc. -- that is, he must scrape the entire leg; it does not suffice merely to separate the leg from the alef so as to remove it from the letter-form alone, since the whole leg was written in invalidity. Likewise, if the yud atop the alef became attached to the stroke beneath it, he must scrape off the entire yud and rewrite it anew. And some are stringent, when the upper yud became attached at the time of writing, to scrape the whole alef on this account, since the rest of the letter was then automatically written in invalidity because of it; but after the fact it requires study whether one should be stringent in this, as I wrote in the Biur Halacha.
(צ) ביוד"י - דהיינו שהיו"ד נעשה קו ישר ולית צורת יו"ד אבל אין מזיק אם נתעבה הקו מעט:
(90) 'The yuds' -- that is, the yud became a straight line and no longer has the form of a yud; but it does no harm if the line thickened a little.
(צא) והפ"א - וה"ה אם רגל השמאלי של התי"ו נעשה ישר ולא יוצא למטה לחוץ. ועיין בלבושי שרד שנשאר בצ"ע למה צריך כלל גרירה ימשיך אח"כ ויעבה מעט את יו"ד השי"ן עד שיהיה כהוגן וכן כה"ג ברגל התי"ו עי"ש וכן משמע בפמ"ג במ"ז אות כ' דמהני עצה זו אפילו באל"ף ועיין בסוף דברי הלבושי שרד. וכ"ז כשלא כתב התיבות שאח"ז דאל"ה בודאי לא מהני תיקון להתי"ו וכה"ג משום שלא כסדרן כיון שאין בו עתה צורת תי"ו:
(91) 'And the pei' -- the same applies if the left leg of the tav became straight and does not project downward and outward. See the Levushei Serad, who remained in doubt why any scraping is needed at all; let him instead extend and thicken a little the yud of the shin until it is proper, and likewise in such a case with the leg of the tav, see there; and so is implied in the Pri Megadim, Mishbetzot Zahav, letter kaf, that this counsel helps even in an alef; and see at the end of the words of the Levushei Serad. All this is where he has not yet written the words after it; for otherwise a repair certainly does not help for the tav and the like, because of shelo kesidran, since it does not now bear the form of a tav.
(צב) בתחלת - דאם יהיה אף אות אחת שלא נכתב לשם תפילין פסול ולא מהני העברת קולמוס לשמה [יו"ד רע"ד] ותחלת ר"ל תחלת כל הפרשיות יאמר אני כותב פרשיות אלו לשם וכו' ומהני זה מדינא אפילו אם הפסיק בין הפרשיות אך מ"מ טוב יותר שיאמר תחלת כל פרשה וכו':
(92) 'At the start' -- for if even one letter was not written for the sake of tefillin, it is invalid, and passing a quill over it lishmah does not help [Yoreh Deah 274]. And 'the start' means: at the start of all the passages he should say, 'I am writing these passages for the sake of...' etc. This is effective by law even if he interrupted between the passages; nevertheless it is better that he say it at the start of each passage, and so on.
(צג) הכתיבה - נראה דה"ה בתיקון האותיות הנפרדות דצריך לשמן הואיל דבלא"ה התפילין הם פסולים דאין עליהם צורת אותיות כראוי:
(93) 'The writing' -- it appears that the same applies to the repair of separated letters, that it must be done for their sake, since otherwise the tefillin are invalid, for they do not bear the proper form of letters.
(צד) יאמר - ואם אחר כותב צריך גם הוא לומר כן אף באמצע כשהוא מתחיל:
(94) 'He should say' -- and if another person writes, he too must declare this, even in the middle of the work, when he begins.
(צה) בפיו - ולא סגי במחשבה אף בדיעבד [א"ר ופמ"ג] ועיין בחידושי רע"א:
(95) 'With his mouth' -- and thought does not suffice, even after the fact [Eliyah Rabbah; Pri Megadim]; and see the novellae of Rabbi Akiva Eiger.
(צו) אני כותב וכו' - יש שכתבו דנכון שיאמר אז ג"כ וכל אזכרות שבו לשם קדושת השם דשמא ישכח אח"כ לקדש השם במקומו ועיין בבה"ל:
(96) 'I am writing,' etc. -- some wrote that it is proper that he then also add, 'and all the Divine Names in it are for the sake of the holiness of the Name,' lest he forget afterward to sanctify the Name in its place; and see the Biur Halacha.
(צז) בכל פעם - ואם כותב ב' אזכרות בלי הפסק די בקידוש אחד:
(97) 'Each time' -- and if he writes two Divine Names without interruption, a single sanctification suffices.
(צח) בתחילת הכתיבה - שהוא כותב לשם קדושת תפילין ואף דלא הזכיר בתחלה קדושת האזכרות סגי דמ"מ הרי הזכיר לשם קדושה אבל אם גם בתחלה לא הזכיר בפירוש רק במחשבה בעלמא או שעתה לא קידש את האזכרות אפי' במחשבה אפילו בדיעבד לא יצא:
(98) 'At the start of the writing' -- namely that he writes for the sake of the holiness of tefillin; and even though he did not mention at the start the holiness of the Divine Names, it suffices, since in any case he stated 'for the sake of holiness.' But if even at the start he did not state it explicitly, only in mere thought, or if now he did not sanctify the Divine Names even in thought, then even after the fact he has not fulfilled the obligation.
(צט) בדיעבד - אבל לכתחלה צריך לומר בפירוש בכל פעם שכותב האזכרה לשם קדושת השם אפילו אם אמר בתחלת הכתיבה וכל האזכרות שבו וכן פסקו האחרונים:
(99) 'After the fact' -- but ideally one must state explicitly, each time he writes a Divine Name, 'for the sake of the holiness of the Name,' even if at the start of the writing he already said 'and all the Divine Names in it'; and so the later authorities ruled.
(ק) חסר או יתר - אפילו אם התיבה לא נשתנה לקריאתה בזה כגון במלא וחסר וכדלקמן:
(100) 'Missing or extra' -- even if the word's pronunciation is unchanged thereby, such as with full (malei) and defective (chaser) spelling, as explained below.
(קא) אות אחת - ואפילו אם קוצו של יו"ד חסר מעכב כדאיתא מנחות כ"ט א':
(101) 'One letter' -- and even if only the tip of a yud is missing, it invalidates, as stated in Menachot 29a.
(קב) מרובה - מלבד עון גזל החמור:
(102) 'Great' -- apart from the grave sin of theft (defrauding the buyer).
(קג) וחרד לדבר השם - ראיתי להעתיק פה לשון הלבוש הצריך מאד לענינינו דז"ל ולא כמו שעושין עכשיו כמה סופרים שמניחין נערים המתלמדין לכתוב תפילין כדי שירגילום בכתב ואח"כ רואה הסופר אם נכתבו כהלכתן בחסירותן ויתירותן וסגי ליה בהכי ואח"כ מניחין אותן בבתים ומוכרין אותם ומחשבין להם הסופרים אותן המעות בשכר הלימוד להנער ומראים להם פני היתר לומר הרי אנו בזה כגומלי חסדים עם הנערים העניים ללמוד להם מלאכת הכתיבה בחנם והיא מלאכת ה' אבל אני אומר יצא שכרם בהפסדם ואדרבה לא טוב המה עושים בעמם כי הנער נער ואין יודע בין ימינו לשמאלו ואין לו שום כונה בעולם רק הם כמתעסקים בכתיבה ליפות הכתב ולא לשום קדושה ושום כונת מצוה בעולם והרי עונש הסופר מרובה מאד שמכשיל את הבריות שמניחין אותן התפילין הפסולין [וכדלעיל בסעיף י"ט] ולא עוד כדי להשביח את מקחו יאמר הסופר לכל אני כתבתים ובכוונה כתבתים וכו' וכל העושין כן בודאי עתידין ליתן את הדין ולקבל עונשין הרבה מאוד ועליהם נאמר ארור עושה מלאכת ה' רמיה ע"כ יזהר כל סופר ויתרחק מזה וטוב לו דלשמן האמור אצל תפילין אין הכונה לשם בעל התפילין כמו גבי גט דצריך לשם האיש והאשה רק לשם קדושת תפילין עי"ש וסיים ע"ז ומן הראוי למי שיש כח בידו למנות כותבי תפילין מהוגנים אנשי אמת שונאי בצע בעלי תורה יראי אלקים וחרדים על דברו בכל עיר כמו שממנים שוחטים ובודקים שלא יאמינו לכל הסופרים שאין כוונתם אלא להרויח ממון ע"י כתיבה ותיקון יפה בעשיית התפילין ואף כי גם כוונה זו טובה היתה לייפות המצוה בנוייה זה דוקא אם היה להם כוונה קדושה ג"כ אבל בזה אינם נזהרים ודי בזה עכ"ל הטהור. וכתב בספר ב"ש יכתוב אותיות טובים ותמימות ולא שבורות ובמתון ובכוונה גדולה ולא ימהר אדם בכתיבתה כדי להרויח ממון הרבה כי אותו ריוח ילך לאיבוד ולדיראון ויפסיד נשמתו כי הוא מחטיא את הרבים וכל מי שכותב תפילין טובים וכשרים כפי יכולתו שכרו כפול ומכופל וניצול מדינה של גיהנם. וכתב בס"ח סי' פ"ה וצדקתו עומדת לעד זה המזכה רבים כגון המלמד ליראי השם תיקון תפילין לתקן לאחרים ועיין בסימן ל"ט מתי אדם ראוי לכתוב תפילין:
(103) 'And anxious at the word of Hashem' -- I saw fit to transcribe here the language of the Levush, which is most pertinent to our subject; his words are as follows: Not as some scribes do nowadays, who set young apprentices to write tefillin in order to train them in the script, and afterward the scribe checks whether they were written correctly in their defective and full spellings, and that suffices for him, and then they place them in the batim and sell them, reckoning the proceeds to the lad as payment for his tuition. They present a face of permission, saying: in this we are like people doing kindness with poor lads, teaching them the craft of writing for free -- and it is the work of Hashem. But I say: their gain is cancelled by their loss; on the contrary, they do no good among their people, for the lad is only a lad, who does not know his right hand from his left and has no intent whatsoever, they are merely occupied in writing to beautify the script, and not for any holiness or any mitzvah-intent at all. And the scribe's punishment is very great, for he causes people to stumble, who wear those invalid tefillin [as above in se'if 19]. Moreover, to enhance his wares, the scribe tells everyone: 'I wrote them, and I wrote them with proper intent,' and so on. All who act so will certainly one day render an account and receive very great punishment, and of them it is said, 'Cursed is he who does the work of Hashem deceitfully.' Therefore let every scribe beware and keep far from this, and it will be well with him. The 'for their sake' stated regarding tefillin does not mean for the sake of the owner of the tefillin, as with a get, which requires being for the sake of the man and the woman; rather it means for the sake of the holiness of tefillin, see there. He concluded: It is fitting for whoever has the power to appoint, in every city, proper tefillin-writers -- men of truth, who spurn ill-gotten gain, masters of Torah, God-fearing and anxious at His word -- just as slaughterers and examiners are appointed, so as not to rely on every scribe whose only aim is to earn money through fine writing and workmanship in making the tefillin. And although this intent too would be good -- to beautify the mitzvah in its adornment -- that is only if they also had a holy intention; but in this they are not careful; and this is enough. End of his pure words. Sefer Baruch She'amar wrote: He should write good, whole letters, not broken ones, and with deliberateness and great intent; a person should not rush its writing in order to earn much money, for that profit will go to ruin and disgrace, and he will forfeit his soul, since he leads the public into sin. But whoever writes good and valid tefillin to the best of his ability, his reward is doubled and redoubled, and he is saved from the judgment of Gehinnom. Sefer Chasidim, siman 85, wrote: 'And his righteousness stands forever' -- this refers to one who benefits the many, such as one who teaches the God-fearing how to repair tefillin, to make repairs for others. And see in siman 39 regarding when a person is fit to write tefillin.
(קד) יקראנה היטב - שאם ימצא איזה אות חסר באיזה פרשה לא היא לבדה נפסלה אלא גם כל מה שאחריה משום שיהיו שלא כסדרן וכדלעיל בריש הסימן:
(104) 'He should read it well' -- for if he finds some letter missing in a passage, not only that passage is invalidated, but also everything written after it, because they would be out of order (shelo kesidran), as above at the beginning of the siman.
(קה) קודם שיתחיל - אינו ר"ל בתחלת הפרשה דוקא אלא קודם שיתחיל לכתוב בהפרשה:
(105) 'Before he begins' -- this does not mean specifically at the very start of the passage, but before he begins to write within the passage.
(קו) מה שכתב - באותה פרשה ולא השלפניה:
(106) 'What he has written' -- in that same passage, and not in the one before it.
(קז) על ידו - וכשטובל הקולמוס לכתוב בו את השם לא יתחיל לכתוב אותו מיד שלא יפסידנו ברבוי דיו או אולי יש עליו שער ולא יצא הכתב מיושר וגם משום שצריך לקדש הדיו שעל הקולמוס טרם שיכתוב השם לכן יכוין להניח אות אחת מלכתוב קודם השם ובאותו אות יתחיל לכתוב ואם לא עשה כן יחפש אחר אות או תג שצריכה דיו וימלאנה וכותב את השם ואם צריך דיו קודם שיגמור השם אז יטבול באותיות שלפני השם שהם לחים עדיין ויגמור השם אבל לא יטבול באותיות השם עצמן ויש מקילין לטבול באותיות השם עצמן דביזוי ליכא כיון שהוא כדי להשלים בו את השם. ואם האותיות שלפניו אינם לחין אזי יטבול מחדש ויחפש אחר אות או תג שצריכין דיו וכנ"ל וכ"ז הוא למצוה ולא לעיכובא בדיעבד:
(107) 'On his account' -- when he dips the quill to write the Divine Name with it, he should not begin writing it at once, lest he spoil it with an excess of ink, or lest there be a hair on it and the writing not come out straight; and also because he must sanctify the ink on the quill before he writes the Name. Therefore he should plan to leave one letter unwritten before the Name, and begin writing (after dipping) with that letter; and if he did not do so, he should look for a letter or a crownlet (tag) that still needs ink, fill it in, and then write the Name. And if he needs more ink before finishing the Name, he should dip into the letters before the Name, which are still wet, and finish the Name; but he should not dip into the letters of the Name themselves. Some are lenient to dip even into the letters of the Name themselves, for there is no disgrace, since it is in order to complete the Name with it. And if the letters before it are not wet, then he dips anew and searches for a letter or crownlet that needs ink, as above. All this is for the ideal fulfillment and is not indispensable after the fact.
(קח) תקנה - בהשלמה ומיירי שמכאן עד סוף הפ' יש שמות שאינם נמחקין דאל"ה יגרוד עד סופה:
(108) 'A remedy' -- by completion; and it speaks of where, from here to the end of the passage, there are Divine Names that may not be erased; for otherwise he would simply scrape everything to the end of the passage.
(קט) בהוייתן יהו - פי' כסדר שנכתבות בתורה יהיו כתובין:
(109) 'In their being they shall be' -- that is, they must be written in the same order in which they appear in the Torah.
(קי) אות אחת - ואם כתב תיבה יתירה יגררנה ויוכל להניח המקום חלק [אם אין לו אותיות מהתיבות שלפניה שיהיה יוכל להמשיכן במקום ההוא] ואין החלק פוסל כל שאין במקומו כשיעור הריוח שבין פרשה לפרשה שהוא כדי ט' אותיות. ולפעמים יש תקנה אפילו בזה כגון שיכול להמשיך האות מן התיבה שלפניה כדי למעט הרויח של ט' אותיות. ויותר מזה דבאופן זה שיפסל התפילין מחמת הרויח אז אפילו אם בסיום התיבה שלפניה יש שם ה"א או קו"ף יוכל להמשיך גגן כדי למעט הריוח ואע"פ שע"י ההמשכה לא יהיה הרגל של הה"א והקו"ף בסופה אין קפידא בדיעבד. וכתב הפמ"ג דבתיבה כפולה טוב יותר למחוק השניה דתיבה הראשונה כדין נכתב. ואם קודם הראשונה יש אות שיכול למושכו טוב יותר שימחוק תיבה הראשונה כדי לחוש אף לדעת ר"ת דשיעור פרשה הוא ג' אותיות:
(110) 'One letter' -- and if he wrote an extra word, he scrapes it off, and he may leave that space blank [where he has no letters from the preceding words that he could extend into that spot], and the blank does not invalidate, as long as its space is not as large as the gap between one passage and another, which is enough for nine letters. And sometimes there is a remedy even for this, such as extending a letter from the preceding word in order to reduce the gap that would hold nine letters. More than this: in a case where the tefillin would be invalidated because of the gap, then even if at the end of the preceding word there is a hei or a kuf, he may extend their roof in order to reduce the gap, and even though, through the extension, the leg of the hei and the kuf will not be at its end, there is no concern after the fact. The Pri Megadim wrote that with a doubled word it is better to erase the second, since the first word was written properly. But if before the first word there is a letter that he can extend, it is better to erase the first word, so as to accommodate also the view of Rabbenu Tam that the passage-gap's measure is only three letters.
(קיא) שיגרור - ולא מיפסל הפרשה משום חק תוכות כיון שאינו עושה מעשה בגוף התיבות והאותיות:
(111) 'That he scrapes' -- and the passage is not invalidated on account of chak tochot, since he performs no act on the body of the words and letters.
(קיב) נראה כשתי תיבות - ופעמים שתיקון מועיל ע"י שיגררנה וימשיך האות שלפניה שתמלא מקומה כגון לאבותיך שכתב מלא וי"ו אחר הב' יגררנה וימשוך הב' שלפניה שתמלא מקומה. וכן אם התיקון תלוי בכ"ף או דלי"ת או רי"ש שאפשר להמשיכן מעט למלא מקום אות היתרה שנגררה אבל אם האותיות שאפשר להמשיכן הן אחר האות היתרה שא"א להמשיכן לאחוריהן עד שיגרר מהם תחלה כגון שאר שכתוב בתורה שכתבה מלא וי"ו אחר האל"ף שא"א למשוך הרי"ש לאחריה עד שיגרר רגלה תחלה ונמצא שביטל צורתה וכשמתקנה אח"כ נמצא כותב שלא כסדרן ואין תקנה אא"כ יכול למלאות מקומו ע"י שיעבה קצת האות שלפניה ושלאחריה שאין בזה משום שינוי האות משא"כ כשהאותיות שאפשר להמשיכן הן לפני האות היתרה אזי אפשר להמשיכן הרבה מבלי שיגרע מהם כלום. אך יש להסתפק במצות הראשון שדינו להיות חסר וכתבו מלא ומחק אח"כ הוי"ו אם מועיל אריכת הצדי"ק למטה אח"כ או דילמא כל עוד שאינו מאריך האות למעלה נחשב כשני תיבות אע"פ שסמכה מלמטה וכן נתן שמשפטו להיות חסר וכן הוצאך אם כתבו מלא ביו"ד בין צדי"ק לאל"ף בכל אלו יש להסתפק אם יש להם תיקון בהאריך האות שלפניו למטה ומ"מ כל שנראה כב' תיבות פסולה אבל אם בתחלת הכתיבה ממשיך רגל התחתון של הנו"ן והצד"י וכותב האות הסמוכה לתוכה כגון פני או ארצי כשר כיון דבתיבה אחת נכתבו ומ"מ לכתחלה אין נכון לעשות כן להבליע אות בתוך אות כי יש מחמירין בזה:
(112) 'It looks like two words' -- and sometimes a repair helps: he scrapes it off and extends the letter before it so that it fills its place, such as la'avotecha that he wrote full with a vav after the bet: he scrapes it and extends the bet before it to fill its place. The same applies if the repair depends on a kaf, dalet, or resh, which can be extended a little to fill the place of the extra letter that was scraped. But if the letters that could be extended are after the extra letter, which cannot be extended backward without first scraping some of them, such as she'er written in the Torah, that he wrote full with a vav after the alef, where the resh cannot be extended backward until its leg is first scraped, so that he has nullified its form, and when he repairs it afterward he turns out to be writing out of order; there is no remedy unless he can fill the space by slightly thickening the letter before and after it, for in this there is no changing of the letter -- unlike when the extendable letters are before the extra letter, in which case they can be extended a great deal without diminishing anything from them. But there is room for doubt regarding the first 'mitzvot,' whose proper spelling is defective, and he wrote it full, then erased the vav: whether extending the tzadi downward afterward helps, or perhaps, as long as he does not extend the letter above, it is still regarded as two words, even though it is joined below. And likewise 'natan,' whose proper spelling is defective, and 'hotzi'acha,' if he wrote it full with a yud between the tzadi and the alef -- in all these there is doubt whether they can be remedied by extending the preceding letter downward. In any case, whatever looks like two words is invalid. But if from the start of the writing he extends the lower leg of the nun or tzadi and writes the adjacent letter into it, such as panei or artzi, it is valid, since they were written as one word; nevertheless, ideally it is not proper to do so, to absorb one letter inside another, for some are stringent in this.
(קיג) הגרר - הגרר מיקרי כשגררו משנתיבש והמחק מיקרי כשמחקו בעודו לח ומש"כ ולא ימחוק עצה טובה קמ"ל ועיין בפמ"ג שכתב דאם ישאר שום רושם דיו אפי' בדיעבד יש חשש בזה ואפילו תיבה בעלמא דלא אזכרה אסור לכתוב על מקום זה:
(113) 'The scraping' -- 'scraping' (gerar) is the term when he scraped it after it dried, and 'erasure' (machak) when he erased it while still wet. And his phrase 'he should not erase' teaches us good advice. See the Pri Megadim, who wrote that if any trace of ink remains, there is a concern even after the fact, and even for a mere word that is not a Divine Name, it is forbidden to write over that place.
(קיד) כל אות וכו' - סעיף זה יבואר בו דין שלא כסדרן ועניניו ארוכין ואכלול בקצרה בדין זה יש בו ג' פרטים [א] אם יש קלקול באיזה אות בין שנעשה זה בעת הכתיבה או שנעשה לאחר הכתיבה [פמ"ג בפתיחה] אם נר' לעין כל שאין צורתו עליו כגון יו"ד שחסר לו רגלו הימני או שי"ן שחסר לו יו"ד אחד וכל כי האי גונא שחסר באות איזה דבר עד שעי"ז אין תמונתו עליו אפילו אין נדמה משום זה לאות אחר וכתב לפניו לא מהני ליה שום תיקון ואפילו אם אירע שהתינוק קראו לאות אפ"ה פסול משום שלא כסדרן וכ"ש אם ע"י קלקולו וחסרונו נדמה לאות אחר כגון דלי"ת דומה לרי"ש או ב' דומה לכ' או חי"ת שברגל שמאלו יש הפסק בין הרגל להגג ונראה כה"א או צדי"ק שיש בו הפסק במקום נגיעת היו"ד לעצמותו ונראה לעין כל כיו"ד ונו"ן וכל כה"ג שאין משגיחין על התינוק ולא מהני ליה תיקון [ב] אם ע"י קלקולו וחסרונו לא נפסד מצורתו לגמרי כגון שיש הפסק דק באיזה אות באמצעו ועדיין עיקר צורתו עליו או כגון שלא היו היודי"ן שעל האלפי"ן והשיני"ן ורגלי התוי"ן נוגעים בגוף האות אם תינוק דלא חו"ט מכירם אף דלא מתכשר האות עי"ז משום דאין צורתו עליו בשלימות עכ"פ מהני זה דנשאר עליו עיקר צורתו לענין שיהא מותר לתקנו ולא יקרא שלא כסדרן. ויש עוד אופן שלישי שאע"פ שעיקר צורתו יש עליו ותינוק קוראו לאות אפ"ה לא מהני ליה שום תיקון כגון אות שנפסל באיזה דבר שתיקונו הוא לגרור מקצתו ולכותבו מחדש [כגון רגל הה"א והקו"ף שנגעו למעלה אפילו נגיעה דקה כחוט השערה שתיקונו הוא לגרור כל הרגל ולכותבו מחדש דלא מהני ליה הפרדה בעלמא משום חק תוכות וכן נגע רגל האל"ף בגג האל"ף וכה"ג וכנ"ל בסעיף י"ח] ואירע שקודם תיקונו כתב לפניו בזה לא יצוייר שום תיקון דהא צריך לגרור כל מה שנכתב בפסול וא"כ מה שמתקנה אח"כ הוי שלא כסדרן. ועתה נתחיל לבאר בעזה"י את הסעיף. כל אות שהיא כתובה וכו' וה"ה אם נתקלקלה אח"כ:
(114) 'Every letter,' etc. -- this se'if explains the law of writing out of order (shelo kesidran); its matters are lengthy, and I will summarize briefly. In this law there are three particulars. [1] If there is a defect in some letter, whether it occurred at the time of writing or afterward [Pri Megadim in the introduction]: if it is plain to every eye that its form is not upon it, such as a yud missing its right leg, or a shin missing one of its yuds, and every such case where something is missing from the letter so that its shape is not upon it -- even if it does not thereby resemble another letter -- and he wrote the next letter, no repair helps it; and even if a child happened to read it as the letter, it is nonetheless invalid because of shelo kesidran. And all the more so if through its defect it resembles another letter, such as a dalet resembling a resh, or a bet resembling a kaf, or a chet whose left leg has a break between the leg and the roof so that it looks like a hei, or a tzadi that has a break where the yud should touch its body, so that it looks to every eye like a yud and a nun -- and every such case, where we do not heed the child, and no repair helps it. [2] If through its defect it was not entirely ruined from its form, such as a fine break in some letter in its middle while the essence of its form still remains upon it, or such as the yuds on the alefs and shins, and the legs of the tavs, not touching the body of the letter: if a child who is neither clever nor dull recognizes them, then even though the letter is not thereby rendered valid -- since its form is not fully upon it -- this at least helps, that the essence of its form remains upon it, in that it is then permitted to repair it, and it is not called shelo kesidran. There is yet a third manner: even though the essence of its form is upon it and a child reads it as the letter, still no repair helps it, such as a letter that became invalid by something whose only remedy is to scrape part of it and rewrite it anew [such as the leg of a hei or kuf that touched above, even a fine touching like a hair's width, whose remedy is to scrape the whole leg and rewrite it anew, since mere separation does not help because of chak tochot; and likewise the leg of an alef that touched the roof of the alef, and the like, as above in se'if 18]: and it happened that before repairing it he wrote the next letter -- here no repair can be conceived, for he must scrape everything written in invalidity, and so whatever he repairs afterward is shelo kesidran. Now we begin to explain the se'if, with God's help: 'Every letter that is written,' etc. -- and the same applies if it became spoiled afterward.
(קטו) ואין צורתה עליה - פי' שנראה לעין כל שאין צורתה עליה כלל ואף דבנגעה רגל האל"ף בגג האל"ף או פני האל"ף בגגו או רגל ה"א וקו"ף הנוגעין למעלה ניכר עליו עדיין עיקר צורת האות ותינוק יקראהו לאות אפ"ה כיון שפסול זה אין תיקונו כ"א ע"י גרירת כל מה שנעשה בפסול וכנ"ל בסעיף י"ח ממילא נתבטל צורתו לגמרי ואם יתקנם אח"כ הוי שלא כסדרן:
(115) 'And its form is not upon it' -- meaning that it is plain to every eye that its form is not upon it at all. And even though, when the leg of the alef touched the roof of the alef, or the face of the alef touched its roof, or the leg of a hei or kuf touched above, the essential form of the letter is still recognizable on it, and a child would read it as the letter, nevertheless, since this invalidity can only be repaired by scraping all that was made in invalidity, as above in se'if 18, its form is automatically nullified entirely, and if he repairs them afterward it is shelo kesidran.
(קטז) רגל האל"ף - וה"ה כל הני דכתב רמ"א בהג"ה סוף סי"ח הנ"ל:
(116) 'The leg of the alef' -- and the same applies to all those cases the Rema wrote in the gloss at the end of se'if 18 above.
(קיז) נוגעים - אפילו נגיעה דקה כחוט השערה:
(117) 'Touching' -- even a fine touching, thin as a hair.
(קיח) צד"י שכתב - פי' שחלק היו"ד מהנו"ן כ"כ עד שנראה כשני אותיות וכן בכל אינך לכן אפילו אם אירע דתינוק קראו כהלכתו אין יכול לתקנן אח"כ שכיון שעינינו רואות שיש להן צורת אותיות אחרות א"כ כשמתקנם אח"כ הרי זה כתיבה מחדש ושלא כסדרן. וה"ה אפילו אם אין להם צורת אותיות אחרות רק שנראה לעין הכל שאין לה עיקר צורתה כגון יו"ד שלא עשה לה רגל הימיני או אל"ף שחסר לה היו"ד העליון וכל כה"ג אין יכול לתקנם אח"כ אבל אם לא עשה להיו"ד רגל שמאלי אף דאם ישאר כך פסול דאיננו יו"ד כראוי לפי דעת רוב הפוסקים כדלקמן בסי' ל"ו מ"מ כיון דיש לה עיקר צורתה דאפילו בלא עוקץ שם יו"ד עליה לכן יכול לתקנה ואין בזה משום שלא כסדרן:
(118) 'A tzadi that he wrote' -- meaning that he separated the yud from the nun so much that it looks like two letters; and likewise in all the other cases mentioned. Therefore, even if it happened that the child read it correctly, he cannot repair them afterward, for since our own eyes see that they have the form of other letters, when he repairs them afterward it is fresh writing and shelo kesidran. The same applies even if they do not have the form of other letters, only that it is plain to every eye that it lacks the essence of its form, such as a yud for which he did not make its right leg, or an alef lacking its upper yud, and every such case: he cannot repair them afterward. But if he did not make the yud's left leg -- even though if it remains so it is invalid, since it is not a proper yud according to most decisors, as below in siman 36 -- nevertheless, since it retains the essence of its form -- for even without the point it bears the name yud -- he may repair it, and there is no shelo kesidran in this.
(קיט) עי"ן יו"ד - וה"ה מ"ם פתוחה שכתבו כ"ו בלי משיכת התג שביניהם:
(119) 'An ayin and a yud' -- and the same applies to an open mem that he wrote as a kaf and vav, without drawing the connecting tag between them.
(קכ) או חי"ת שני זייני"ן - אפילו אם עשה חוטרא על גביהן רק שאין נוגעים זה לזה למעלה וניכר להדיא פרידתן ה"ז הפסידה עיקר צורתה שנראה כשני זייני"ן:
(120) 'Or a chet written as two zayins' -- even if he made a small hump (chutra) on top of them, so long as they do not touch each other above and their separation is plainly recognizable, this letter has lost the essence of its form, for it looks like two zayins.
(קכא) יודי"ן שעל האלפי"ן - וה"ה אם היה הפסק באיזה אות באמצעו [פמ"ג בא"א בפתי']:
(121) 'The yuds on the alefs' -- and the same applies if there was a break in the middle of some letter [Pri Megadim, Eshel Avraham, in the introduction].
(קכב) ותינוק וכו' - פי' לכן אפילו אם פרידתן ניכר להדיא [דהיינו תומ"י כשראה אותן] יכול לתקנם דהרי לא הפסיד עדיין האות עיקר צורתה מדקראה התינוק לאות [כן כתב הגרע"א בחידושיו ודלא כפמ"ג שהחמיר בזה ועיין בבה"ל] אבל אם אין פרידתן ניכר להדיא עד שמסתכל בה אין צריך להראות להתינוק. ומ"מ אם אירע שהראה להתינוק ולא קרא לו אות הולכין אחריו להחמיר ואין יכול לתקן [כמו שכתב הפמ"ג]:
(122) 'And a child,' etc. -- meaning, therefore, even if their separation is plainly recognizable (that is, immediately when he first sees them), he may repair them, for the letter has not yet lost the essence of its form, since the child read it as the letter [so wrote Rabbi Akiva Eiger in his novellae, unlike the Pri Megadim who was stringent in this; and see the Biur Halacha]. But if their separation is not plainly recognizable until he examines it closely, he need not show it to the child. Nevertheless, if it happened that he showed it to the child and he did not read it as the letter, we follow him to be stringent, and it cannot be repaired [as the Pri Megadim wrote].
(קכג) ויש מי שאומר - אין כאן מחלוקת רק חידוש דין:
(123) 'And there is one who says' -- there is no dispute here, only a novel ruling.
(קכד) להדיא - דאם היה ניכר להדיא ה"ז הפסידה עיקר צורתה וכמו שכתבנו בס"ק ק"כ:
(124) 'Plainly' -- for if it were plainly recognizable, it would have lost the essence of its form, as we wrote in sk 120.

(125) 'It is permitted to join them' -- for the child is not accustomed to such a chet, so that even a properly valid one he would read as two zayins.

(126) 'Attached' -- whether above or below; and these words apply where they became joined at the time of writing, but if they became joined after the writing was completed, it is forbidden to separate them; and see the Biur Halacha.
(קכז) להפרידם - ואין בו משום איסור מחיקה כיון שמתקן בזה וכ"ש אם היו דבוקות לאותיות אחרות דמותר להפריד האותיות האחרות מהם בכל גווני ובלבד שיזהר שלא יגע הסכין באותה נקודה אחרונה המדובקת עם השם [בה"ט בשם שכנה"ג ומ"ש בשעת הדחק זה אינו להמעיין שם]:
(127) 'To separate them' -- and there is no prohibition of erasing in this, since he thereby improves it. And all the more so if they were attached to other letters, that it is permitted to separate those other letters from them in any case, provided he takes care that the knife not touch that last point which is joined to the Name [Ba'er Heitev in the name of Knesset HaGedolah; and what he wrote 'in pressing circumstances' is not so, to one who examines the source there].

(128) 'That were partly erased' -- meaning that some of the ink's appearance faded from the letters. And if at the start of the writing the ink was not black but resembled white, dimmed in its appearance, or reddish, and one needs to pass a quill over them, it is shelo kesidran. But in the Shulchan Aruch's case here it is not called shelo kesidran, since even now the writing is valid, and what he adds to it merely preserves it from being erased further. In what case? When some of the ink's color remains; but if all the ink flaked off the kelaf and only a reddish trace remains from the corrosion of the ink, then when he passes a quill over them, this is writing shelo kesidran. Therefore, if from part of the length of the vav a little ink peeled off and only the corrosion-trace remains there, and they must show it to the child, if the upper part has the measure of a vav, he must cover the lower part so that the child does not combine it, similar to what we wrote above in sk 48. And know further that the Pri Megadim holds that even if the substance of the ink remained, only that the upper blackness peeled off and it turned red, it is shelo kesidran, since red is not valid for tefillin. But the Chatam Sofer in Yoreh Deah, siman 256, disagrees with him and holds that if the change to reddishness is due to age, it is valid, since it was written with ink; and for this the halacha was stated, 'to write with ink,' to teach that it need only be written with ink; and such is the way of most ink, that as it ages its appearance dims and it turns somewhat reddish, becoming a certain hue (called in the vernacular 'brown'). Nevertheless it is good to pass a quill over it, and even in the holy Names it is nearly certain that it is permitted, as ink over ink, for there is no erasure here. But if it changed to actual red, which is not the way of ordinary ink, or even only to reddishness, but it changed quickly right after the writing, there is no remedy for that Torah scroll, for it appears that this is not from age, and there must be a deficiency in the very ink, which was made from other substances; hence it is invalid from the outset, since it was not written with ink, and in the Names it is forbidden to pass ink over it, etc.; see there, where he elaborates on all this with reasoned argument.
(קכט) שלא יכנס - אפילו כל שהוא ראש הלמ"ד בשורה שלמעלה הימנה וה"ה בך' פשוטה וכדומה שלא יכנס בשורה שלמטה באות ט' וע' וכדומה:
(129) 'That it not enter' -- even the slightest bit -- the head of the lamed entering the line above it; and the same applies to a final kaf and the like, that it not enter the line below into a tet, an ayin, and the like.
(קל) באויר הה"א - וה"ה באויר אל"ף או תי"ו וכדומה וכ"ש שיזהר שלא יכנס באויר ד' או רי"ש שלא יראה כה"א וכדלקמיה:
(130) 'Into the airspace of the hei' -- and the same applies to the airspace of an alef, a tav, and the like; and all the more so he should be careful that it not enter the airspace of a dalet or resh, lest it look like a hei, as explained below.
(קלא) או החי"ת - וה"ה אם נכנס ראש למ"ד לתוך אויר של כ' פשוטה וכדלקמיה בס"ק קל"ב [תשובת מהרי"מ מבריסק בסי' ח' עי"ש וכן הקיל בזה הגאון רע"א בחידושיו בדיעבד]:
(131) 'Or the chet' -- and the same applies if the head of a lamed entered the airspace of a final kaf, as below in sk 132 [responsum of the Maharim of Brisk, siman 8, see there; and the Gaon Rabbi Akiva Eiger was likewise lenient in this in his novellae, after the fact].

(132) 'Without touching' -- for with actual touching it is invalid anyway, on account of the lack of surrounding gevil. And it is implied from the Shulchan Aruch's wording 'one should be careful' that this is only ideally, and not indispensable after the fact. And this applies where it did not enter in a way that spoils the letter's form, such as where it entered only a little; but if it entered so much that the form of the letter changed -- so that a child who is neither clever nor dull, if the lower line is covered for him so that only the head of the lamed is visible and not its body, would not recognize what the letter is -- this is a change of the letter's form and is invalid [and no repair can even be conceived for it, because of shelo kesidran]. And all the more so if the head of the lamed entered the hollow of a dalet or resh so that it looks like a hei, that it is invalid, and the child's reading it correctly does not help here, for our own eyes see that it thereby changed into another letter.
(קלג) שגורות בפיו - דהיינו בעת שהוא מתחיל לכתוב מסתמא עדיין אין בקי בקריאתן בע"פ כראוי ובפרט במלא וחסר:
(133) 'Fluent in his mouth' -- that is, when he begins to write, presumably he is not yet expert in reciting them by heart properly, and especially in matters of full and defective spelling.

(134) 'From a written text' -- or from the mouth of one dictating to him, so that he not err. And if part of the passage is fluent by heart to him, he may write that part from memory. And see the Bach, who wrote that nonetheless the choicest fulfillment of the mitzvah is to write from a written text in every case.
(קלה) יודע לקרות - דאל"ה בקל יכול לטעות ואינו מרגיש:
(135) 'Knows how to read' -- for otherwise he could easily err without noticing.

(136) 'From a written text' -- it implies that when he writes from a written text he need not articulate with his mouth, and it speaks specifically where they are also fluent for him, so that we do not suspect he might err [so wrote the Magen Avraham and Eliyah Rabbah to resolve any contradiction from this to Yoreh Deah, siman 274, se'if 2; and see the Pri Megadim that such is the Magen Avraham's intent]. But many of the later authorities disagreed with this and ruled that in every case he must articulate the word with his mouth before writing it. The reason, as the Bach wrote: this is the mitzvah of writing tefillin, mezuzot, and Torah scrolls, so that the holiness of the breath of each word uttered from the reader's mouth be drawn upon the letters as he writes them on the kelaf. All this is ideally; but after the fact it is not invalidated in any case, provided he did not err.
(קלז) ע"פ שמקרא וכו' - ואפילו הוא שגור בפיו ג"כ:
(137) 'By heart, what another dictates,' etc. -- and even if it is fluent in his mouth as well.
(קלח) ויקרא בפיו - כל תיבה ותיבה קודם שיכתבנה כדי שלא יטעה וכ"ש אם הוא כותב ע"פ בלי מקריא:
(138) 'And read it aloud' -- each and every word before he writes it, so that he not err; and all the more so if he is writing from memory, without anyone dictating.
(קלט) למעלה - מהשיטות כדי גגה של למ"ד ונ"ל דהיינו מכתב בינוני אפילו הוא כותב רק כתב קטן [דהלא אמרו במנחות ל"א כמלא אטבא דספרי ופירשו הראשונים שהוא כדי לכתוב גגה של וכו' הנ"ל ואם איתא דיש חילוק בזה איה שיעורם ואפשר לדחות בדוחק דהגמרא לא איירי רק בכותב כתב בינוני]:
(139) 'Above' -- from the lines, the measure of the roof of a lamed. And it appears to me that this means measured by average-sized script, even if he writes only a small hand [for in Menachot 31 they said 'the width of a scribe's clamp,' and the Rishonim explained that it is enough to write the roof of a lamed, as above; and if there were a distinction in this, where would their measure be? Though one can push off, with difficulty, that the Gemara speaks only of one who writes average script].
(קמ) פשוטה - ועוד משהו להקפת גוילם וטעם לכל זה כדי שכשיזדמן לו לכתבם שיהיה לו מקום לזה וי"א דצריך להניח עוד למעלה מגגה של למ"ד ולמטה מך' ונו"ן פשוטה כדי חצי ציפורן וזה רק לכתחלה:
(140) 'Straight nun' -- and a bit more, for their surrounding gevil. The reason for all this is so that, when the occasion arises for him to write them, he will have room for it. And some say one must leave, in addition, above the roof of a lamed and below a final kaf or nun, the measure of half a fingernail; and this is only ideally.
(קמא) כלל - רק משהו להקפת גוילם:
(141) 'At all' -- only a slight amount, for their surrounding gevil.

(144) 'A line' -- and some say one need only leave this in a Torah scroll; and so the scribes were accustomed, not being particular about this.

(145) 'A hair's breadth' -- this is only ideally; but after the fact one should not invalidate unless the word appears divided into two, as all this was explained in Yoreh Deah, siman 277, regarding a Torah scroll.
(קמו) מעט חלק - אבל המ"א בשם כמה אחרונים והגר"א בביאורו הכריעו דאין צריך להניח חלק יותר מבין תיבה לתיבה באמצע פסוק [ודלא כמ"ש הש"ך ביו"ד רע"ד סק"ו ע"ש]:
(146) 'A little blank' -- but the Magen Avraham, in the name of several Acharonim, and the Gra in his commentary, decided that one need not leave any more blank than the space between one word and another in the middle of a verse [not like what the Shach wrote in Yoreh Deah 274, sk 6, see there].
(קמז) ואחת יוצאת - ואפילו אות אחת משום זה אלי ואנוהו:
(147) 'And one protruding' -- even a single letter, on account of 'This is my God and I will glorify Him.'

(148) 'Three letters' -- since he did not distinguish, it implies that even if these three letters are a minority of the word, it is forbidden. But in Yoreh Deah, siman 273, he ruled like the Rambam, that we are only particular that he not write the majority of the word beyond the line; and if the word is of eight letters, it is permitted to write half of it beyond the line. See the Shach there, who wrote that one should be stringent like the ruling here. And see the Eliyah Rabbah, whose view is that at least in tefillin, where the margins are short, one should be stringent.
(קמט) ואם כתבם - בין שהיה הבליטה בתחלת השיטה או בסופה:
(149) 'And if he wrote them' -- whether the protrusion was at the beginning of the line or at its end.

(151) 'One word' -- and if the word is of three letters, it is permitted to write two of its letters beyond the line, even though they are the majority of the word [Yoreh Deah, siman 273]; and see the Biur Halacha.

(153) 'One must,' etc. -- the Magen Avraham, in the name of the Gaon Rabbi Yitzchak of Posen [and likewise the Olat Tamid, the Eliyah Rabbah, and several of the Acharonim], concluded that this is specifically ideally, but after the fact one should not be stringent. Nevertheless, if this happened in a Torah scroll, he ruled to erase all the upper lines, if they contain no Divine Name among the Names that may not be erased, and to extend them so that they are even with the Name; for since it can be repaired, it is not considered a case of after-the-fact. But if there was above it some Divine Name, or in tefillin and mezuzot, where one cannot erase because of shelo kesidran, it is valid as is, without repair. And some are stringent even after the fact; Rabbi Akiva Eiger and the Derech HaChaim agreed with them. However, if in the upper lines the last letter is a bet, dalet, resh, or the like, which he can extend, all agree that whether in a Torah scroll or in tefillin and mezuzot he should extend them so that they are even with the letter of the Name that went out beyond the line, and there is no shelo kesidran in this. And likewise, if he had written only one line, and in the second line he extended the Name beyond the line, he should draw additional ruling-lines and extend them so that they run to the end of the Name; and regarding the first line there is no concern. And know further that regarding the letters attached to the Name, the consensus of the Acharonim is that one should not be stringent, after the fact, about one going out beyond the line.
(קנד) מהם כלל - אפילו אות אחת ואפשר דאף רובו ככולו אבל מקצת האות לית לן בה ואם יצא השם כולו חוץ לגליון העמוד כשר בדיעבד ואינו דומה ליוצא אות אחד חוץ לשיטה דמה שיוצא לחוץ הוא חשוב כתליה וקי"ל ביו"ד רע"ו דמקצת השם אין תולין משא"כ בזה כן כתב הבני יונה והגרע"א בחידושיו בסי' זה מחמיר גם בזה עי"ש אבל בביאור הגר"א מוכח בהדיא כהבני יונה להקל:
(154) 'From them at all' -- even a single letter; and possibly even the majority of it is treated like the whole, but with part of a letter we have no concern. And if the entire Name went out beyond the margin of the column, it is valid after the fact, and it is not like one letter going out beyond the line, for what goes outside is regarded as 'hanging' (an appendage), and we hold in Yoreh Deah 276 that part of the Name may not be 'hung,' which is not the case here. So wrote the Bnei Yonah; and Rabbi Akiva Eiger, in his novellae on this siman, is stringent also in this, see there; but in the commentary of the Gra it is proven explicitly like the Bnei Yonah, to be lenient.
(קנה) כל פרשיותיה - ר"ל מהתפילין של יד הואיל והן נכתבות בקלף אחד ושייך בהן פתוחה וסתומה דהיינו שכשמניח מקום חלק בסוף שיטה אחרונה של פרשה ראשונה כדי ט' אותיות ומתחיל פרשה שלאחריה בראש השיטה בדף הב' הרי פרשה שלאחריה נקרא פתוחה כמו שבס"ת נקראת פרשה המתחלת בראש השיטה פרשה פתוחה לכו"ע כשיש ריוח כדי ט' אותיות לפניה בשיטה הקודמת לה או בסוף שיטה אחרונה שבדף הקודם אבל בתש"ר שהפרשיות נכתבין על ד' קלפים אין להקפיד בהן בפתוחות וסתומות אך נהגו לכתחלה להקפיד בזה כ"כ האחרונים ועיין בבה"ל במה שכ' בשם הפמ"ג בזה:
(155) 'All its passages' -- meaning of the hand-tefillin, since they are written on a single kelaf, and so 'open' and 'closed' apply to them; that is, when he leaves a blank space at the end of the last line of the first passage, enough for nine letters, and begins the next passage at the head of the line in the second column, behold the next passage is called 'open,' just as in a Torah scroll a passage that begins at the head of the line is called an 'open' passage, according to all, when there is a space of nine letters before it in the preceding line, or at the end of the last line in the preceding column. But in the head-tefillin, where the passages are written on four kelafim, one need not be particular about them regarding 'open' and 'closed,' though the custom is to be particular about this ideally; so wrote the Acharonim; and see the Biur Halacha in what he wrote on this in the name of the Pri Megadim.
(קנו) פתוחות חוץ וכו' - מפני שג' ראשונות שהם קדש והיה כי יביאך שמע הם פתוחות בתורה ופרשת והיה אם שמוע סתומה לפיכך צריך לכתוב בתפילין ג"כ ככה. דהיינו שיניח מקום חלק כדי ט' אותיות בסוף שיטה אחרונה שבפ' קדש כדי שבפ' והיה כי יביאך שיתחיל בראש השיטה הא' שבדף הב' תהיה הפרשה פתוחה כמו שהיא בתורה וכן אחר פ' והיה כי יביאך כדי שפ' שמע תהיה פתוחה אבל פ' והיה אם שמוע יעשה סתומה ואופן סתימתה יבואר לקמיה. ופרשת קדש אף דבתורה היא פתוחה מחמת שהוא מפסיק בריוח ט' אותיות בשורה הקודמת לה וכאן אין שייך זה דהיא פרשה ראשונה מ"מ כיון שהוא מתחילה בראש שיטה ואין כתוב לפניה כלום היא נקראת פתוחה דאין כתב אחר סותמה:
(156) 'Open, except,' etc. -- because the first three -- Kadesh, Vehaya Ki Yeviacha, and Shema -- are 'open' in the Torah, and the passage Vehaya Im Shamoa is 'closed'; therefore one must write it in the tefillin the same way. That is, he leaves a blank space, enough for nine letters, at the end of the last line of the passage Kadesh, so that the passage Vehaya Ki Yeviacha, which begins at the head of the first line in the second column, will be 'open' as it is in the Torah. And likewise after the passage Vehaya Ki Yeviacha, so that the passage Shema will be 'open.' But the passage Vehaya Im Shamoa he makes 'closed,' and the manner of its closing will be explained below. And the passage Kadesh, though in the Torah it is 'open' because it is separated by a space of nine letters in the line preceding it, and here this is not applicable, since it is the first passage -- nevertheless, since it begins at the head of the line and nothing is written before it, it is called 'open,' for there is no writing that seals it.
(קנז) ואם שינה - בין שעשאה מסתומה פתוחה או מפתוחה סתומה:
(157) 'And if he changed' -- whether he made a closed passage open, or an open passage closed.
(קנח) ויש מכשירין - ר"ל בדיעבד וטעמם שאף שבתורה פ' והיה אם שמוע היא סתומה מ"מ כיון שבתורה אינה סמוכה כלל לפרשת שמע אין זה נחשב שינוי מה שהריוח שבינה לפרשת שמע הוא פתוח ולא סתום כמו שסתום הריוח שלפניה בתורה כיון שגם בתורה יש בינה לפרשת שמע שבתורה ריוח הרבה פתוח וכן הסכימו האחרונים:
(158) 'And some validate' -- meaning after the fact; and their reason is that even though in the Torah the passage Vehaya Im Shamoa is 'closed,' nevertheless, since in the Torah it is not adjacent at all to the passage Shema, this is not considered a change: that the space between it and the passage Shema is 'open' and not 'closed' as the space before it is closed in the Torah, since in the Torah too there is a large open space between it and the passage Shema; and so the Acharonim agreed.
(קנט) בכולם פתוחות - ולהיפך אם עשה איזו פרשה מהשלש פרשיות סתומה לכו"ע פסול כ"כ האחרונים עוד כתבו דדוקא אם עשה לפרשת והיה א"ש פרשה פתוחה כשר לדעה זו אבל אם אין לפניה ריוח כלל בינה לפרשת שמע לא בדף שלה ולא בדף של פרשת שמע דהיינו שהתחיל אותה בראש שיטה העליונה שבדף ולא הניח ריוח כלל לפניה באותה שיטה ולא בסוף שיטה של פ' שמע או שהניח ריוח ואין בו כשיעור ריוח שבין פרשה לפרשה דהיינו כדי לכתוב ט' אותיות ה"ז נחשב שינוי גמור ממה שהיא כתובה בתורה ופסול לכו"ע אפילו בפרשה זו. ובסוף פרשת והיה א"ש אין צריך להניח שום ריוח וכן נוהגין לסיים על הארץ בסוף שיטה התחתונה:
(159) 'All of them open' -- and the reverse: if he made any of the three passages 'closed,' it is invalid according to all; so wrote the Acharonim. They further wrote that specifically if he made the passage Vehaya Im Shamoa an 'open' passage, it is valid according to this view; but if there is no space at all before it, between it and the passage Shema -- neither in its own column nor in the column of the passage Shema -- that is, that he began it at the head of the top line of the column and left no space at all before it in that line, nor at the end of the line of the passage Shema, or he left a space but it does not have the measure of the space between one passage and another, namely enough to write nine letters -- behold this is considered a complete change from how it is written in the Torah, and it is invalid according to all, even in this passage. And at the end of the passage Vehaya Im Shamoa one need not leave any space; and so the custom is to conclude 'al ha'aretz' at the end of the bottom line.
(קס) ובמדינות אלו וכו' - ואף דלכתחלה מצוה לעשות אותה סתומה גם להיש מכשירים וא"כ המנהג הזה הוא שלא כהוגן מ"מ העתיקו הרמ"א דכיון שהעיקר הוא שבדיעבד כשר בכל ענין וא"א לעשותה סתומה לד"ה יש להחזיק בהמנהג הזה כדי שלא להוציא לעז על הראשונים וכ"כ המ"א בשם הל"ח אבל מדברי הלבוש והגר"א משמע שיותר טוב לעשות כמה שכתוב בשו"ע:
(160) 'And in these lands,' etc. -- even though ideally it is a mitzvah to make it 'closed,' even according to the 'some validate' view -- so that this custom is improper -- nevertheless the Rema recorded it, since the essential point is that after the fact it is valid in any case, and it is impossible to make it 'closed' according to all opinions; there is reason to uphold this custom, so as not to cast aspersion on the earlier authorities. And so wrote the Magen Avraham in the name of the Lechem Chamudot; but from the words of the Levush and the Gra it is implied that it is better to do as is written in the Shulchan Aruch.
(קסא) נוהגים אף וכו' - וכן בתפילין של ר"ת יעשה ג"כ כולם פתוחות ואף שכותב והיה א"ש אחר שמע כדלקמן בסימן ל"ד במ"ב סק"ג יניח כשיעור ט' אותיות אחר על הארץ וכשכותב פרשת שמע מתחיל בתחלת העמוד בראש השיטה:
(161) 'The custom is even,' etc. -- and likewise in the tefillin of Rabbenu Tam he should make all of them 'open.' And even though he writes Vehaya Im Shamoa after Shema, as below in siman 34 in the Mishnah Berurah, sk 3, he should leave a space of nine letters after 'al ha'aretz'; and when he writes the passage Shema he begins at the start of the column, at the head of the line.
(קסב) מתחילין בראש וכו' - דזה עושה אותה לפתוחה לכו"ע כשהשאיר חלק כדי ט' אותיות בסוף שיטה התחתונה בעמוד הקודם ואם לא התחיל בראש השיטה אלא הניח מעט ריוח אפילו פחות מט' אותיות הרי פרשה זו נקראת סתומה להרמב"ם ופסולה אפילו דיעבד ובפמ"ג [אות כ"ו] כתב דאפי' אם לא המשיך לפנים בראש קדש או והיה כ"י או שמע רק אות אחת או שתים ג"כ י"ל דפסול וצ"ע בזה ובספר מאמר מרדכי משמע דאין להחמיר בזה בדיעבד ועכ"פ לכתחלה יש ליזהר בזה מאוד [ואם השאיר כשיעור תיבת אשר נ"ל דיש להחמיר אפילו בדיעבד דהרי בשיעור זה בוודאי יש כששה אותיות קטנות ויותר וכמו שכתב המחה"ש והרי לדעת הט"ז מצטרף מדינא לכו"ע להקרא סתומה אפילו לא היה הריוח שלמעלה ולמטה רק כשיעור ט' אותיות קטנות ע"י צירוף וכמו שכתב הפמ"ג הרי דמה שכתב הרמב"ם ויניח מעט ריוח וכו' הוא שיעור קטן מאוד] ע"כ אם רואה שהתחיל הפרשה אפילו אות אחת לפנים שלא במקום ששירטט מתחילה יראה לעשות גם שאר השורות באופן זה:
(162) 'They begin at the head,' etc. -- for this makes it 'open' according to all, when he left a blank space of nine letters at the end of the bottom line in the preceding column. And if he did not begin at the head of the line but left a little space -- even less than nine letters -- this passage is called 'closed' according to the Rambam, and is invalid even after the fact. And in the Pri Megadim [letter 26] he wrote that even if he did not extend inward at the start of Kadesh, or Vehaya Ki Yeviacha, or Shema, only one letter or two, it is also arguable that it is invalid, and this requires examination. In Sefer Ma'amar Mordechai it is implied that one should not be stringent in this after the fact; in any case, ideally one must be very careful about this. [And if he left the measure of the word 'asher,' it appears to me that one should be stringent even after the fact, for in this measure there are certainly about six small letters and more, as the Machatzit HaShekel wrote; and according to the Taz it combines by law, according to all, to be called 'closed,' even if the space above and below was only the measure of nine small letters, through combination, as the Pri Megadim wrote; so that what the Rambam wrote, 'and he should leave a little space,' etc., is a very small measure]. Therefore, if he sees that he began the passage even one letter inward, not at the place where he originally ruled, he should see to make the other lines too in this manner.
(קסג) ט' אותיות - כתבו האחרונים דלכתחילה צריך להניח כדי ג' תיבות אשר ע"כ צריך להניח ג"כ ריוח מלא ב' אותיות קטנות מלבד הט' אותיות דהא בין תיבה לתיבה צריך להניח מלא אות קטנה ובדיעבד יש להקל כשמניח רק כמלא ט' אותיות קטנות [דהיינו יודי"ן] וכמשמעות השו"ע כאן וכתב הפמ"ג דמשערין הריוח של הט' אותיות כפי אותו הכתב וכל השיעור הזה הוא בין לפתוחה או לסתומה:
(163) 'Nine letters' -- the Acharonim wrote that ideally one must leave enough for three words of 'asher.' Therefore one must also leave a space of two small letters besides the nine letters, since between one word and another one must leave the space of a small letter. But after the fact one may be lenient when he leaves only the measure of nine small letters (that is, yuds), as is the implication of the Shulchan Aruch here. And the Pri Megadim wrote that one measures the space of the nine letters according to that particular script. And this whole measure applies whether for an 'open' or a 'closed' passage.
(קסד) סתומה לדעת הרמב"ם - ואף דלדעת הרא"ש היא פתוחה מ"מ אנו עושין כך כי א"א לעשות בתפילין צורת סתומה שיצא בה אליבא דכו"ע כי סתומה שאנו נוהגין לעשות בס"ת דהיינו שמסיים הפרשה שלפניה באמצע שיטה ומפסיק כדי ט' אותיות ואח"כ מתחיל הפרשה שאחריה ג"כ באותה השיטה והיא נקראת סתומה אליבא דכו"ע דסתומה מלפניה ומלאחריה וא"א לעשותה פה בתפילין דכל פרשה הוא בעמוד אחר וכן אם ירצה להניח שיטה אחת חלק בתחלת פרשת והיה א"ש ולהתחילה בראש שיטה שנייה זה ג"כ איננה סתומה לכו"ע דהיא רק להרא"ש ולא להרמב"ם דלדידיה היא פתוחה וכיון שא"א לעשותה סתומה לד"ה נהגו כהרמב"ם לפי שכן עיקר אף בס"ת אם א"א לעשות לד"ה כמ"ש ביו"ד סימן ער"ה. ובט"ז המציא עצה לעשותה סתומה שיצא אליבא דכו"ע דהיינו שבפרשה או"ב יעשה הכל כמו שכתוב בשו"ע רק שבפרשה שמע בסופה יניח ריוח פחות מכדי ט' אותיות קטנות וכן יניח ריוח פחות מט' אותיות קטנות בתחלת פרשת והיה א"ש דעי"ז שאין לה ט' אותיות במקום אחד כ"א ע"י צירוף היא נקראת סתומה לכו"ע וכ"כ בתשובת הרמ"ע מפאנו ובביאור הגר"א וכן משמע מפמ"ג שגם הוא נהג לעשות כן. ודע דבדיעבד אפילו אם שייר ריוח כט' אותיות גדולות מכל צד ג"כ כשר דלהרמב"ם היא סתומה ולהרא"ש היא פתוחה וכתבנו לעיל בס"ק קנ"ח בשם האחרוני' דהסכימו דהלכה כהיש מכשירין הנ"ל ויש מהגדולים שנהגו לעשות כן לכתחילה ונהרא נהרא ופשטיה ועיין בבה"ל:
(164) 'Closed according to the view of the Rambam' -- even though according to the Rosh it is 'open,' we nonetheless do so, since it is impossible to make in tefillin a form of 'closed' that would be valid according to all opinions. For the 'closed' that we customarily make in a Torah scroll -- that is, ending the preceding passage in the middle of a line, interrupting for nine letters, and then beginning the following passage in that same line -- and this is called 'closed' according to all, since it is closed before and after -- this cannot be done here in tefillin, for each passage is in a separate column. And likewise, if he wishes to leave one blank line at the start of the passage Vehaya Im Shamoa and begin it at the head of the second line, this too is not 'closed' according to all, for it is so only according to the Rosh and not the Rambam, since to him it is 'open.' And since it cannot be made 'closed' according to all opinions, they followed the Rambam, since that is the main ruling even in a Torah scroll where it cannot be done according to all opinions, as written in Yoreh Deah, siman 275. And in the Taz he devised a counsel to make it 'closed' in a way valid according to all: that in the passage Vehaya Ki Yeviacha he does everything as written in the Shulchan Aruch, only that at the end of the passage Shema he leaves a space of less than nine small letters, and likewise he leaves a space of less than nine small letters at the start of the passage Vehaya Im Shamoa; so that, since it does not have nine letters in one place but only through combination, it is called 'closed' according to all. And so wrote the responsum of the Rama of Fano and the commentary of the Gra; and so it is implied from the Pri Megadim, that he too practiced this. And know that after the fact, even if he left a space of nine large letters on every side, it is also valid, for according to the Rambam it is 'closed' and according to the Rosh it is 'open,' and we wrote above in sk 158 in the name of the Acharonim that they agreed the halacha is like the 'some validate' view mentioned; and some of the great ones practiced this ideally -- each river follows its own course (each to his custom), and see the Biur Halacha.
(קסה) עור הבתים - וה"ה עור התיתורא והמעברתא כיון שמחובר ותפור בהבתים:
(165) 'The leather of the batim' -- and the same applies to the leather of the titura and the ma'avarta, since it is connected and sewn to the batim.
(קסו) טהורים - דכתיב למען תהיה תורת ה' בפיך מן המותר בפיך וכיון דאות שי"ן שהוא מרמז על שם שדי נקמט בעור התפילין הוא בכלל תורת ה'. ואין חילוק בין הש"ר או הש"י:
(166) 'Kosher' -- for it is written, 'so that the Torah of Hashem may be in your mouth' -- from what is permitted to your mouth; and since the letter shin, which alludes to the Name Shaddai, is embossed in the leather of the tefillin, it is included in 'the Torah of Hashem.' And there is no difference between the head-tefillin and the hand-tefillin.
(קסז) מקלף - ואע"פ שהוא דק שפיר מיקרי עור:
(167) 'From kelaf' -- and even though it is thin, it is properly called 'leather.'
(קסח) שליל - דגם עורו נקרא עור ואע"ג דהוא נקרא בשר לענין טומאה מ"מ לא גרע מעור עוף:
(168) 'A fetus' -- for its hide too is called 'leather'; and even though it is called 'flesh' regarding impurity, nevertheless it is no worse than the hide of a bird.

(169) 'To make them from kelaf' -- only that he must blacken them, for black straps are a law given to Moshe at Sinai.
(קע) מעובד לשמו - ואם העיבוד היה רק לרצועות לא מהני להבתים דקדושתן חמורה:
(170) 'Processed lishmah' -- and if the processing was only for the straps, it does not suffice for the batim, since their holiness is weightier.
(קעא) היכא דאפשר - כי הרמב"ם ס"ל דלא בעי כלל עיבוד עור הבתים דאדרבה יותר חזק הוא כשלא נתעבד משום הכי כשר אפילו עור שאינו מעובד כלל וכ"ש דלא בעי עיבוד לשמה ורוב הפוסקים חולקים עליו ומצרכי עיבוד וגם לשמה ופסק השו"ע דהיכא דאפשר בעי לשמה אבל היכא דלא אפשר למצוא חיפוי הבתים מעור המעובד לשמה מותר לסמוך על דברי הרמב"ם מלהתבטל ממצות תפילין וכשימצא אח"כ מעור המעובד לשמה יגנוז הבתים אלו ויעשה מעור המעובד לשמה ונחלקו האחרונים אם לע"ע יניחם בברכה או בלא ברכה והברכי יוסף הסכים להמ"א דיוכל לברך ועיין בבה"ל:
(171) 'Where possible' -- for the Rambam holds that the leather of the batim requires no processing at all; on the contrary, it is stronger when it is not processed, and therefore it is valid even from leather not processed at all, and all the more so it does not require processing lishmah. But most decisors disagree with him and require processing, and lishmah too; and the Shulchan Aruch ruled that where possible it must be lishmah. But where it is impossible to find covering for the batim from leather processed lishmah, one may rely on the Rambam's words rather than forgo the mitzvah of tefillin; and when he later finds leather processed lishmah, he should store away these batim and make new ones from leather processed lishmah. And the Acharonim disagreed whether, for the time being, he should wear them with a blessing or without; the Birkei Yosef agreed with the Magen Avraham that he may recite the blessing; and see the Biur Halacha.
(קעב) מעור אחד - וחתיכת עור תפורים יחד מצדד המ"א דחשובים כעור אחד וכ"כ בתשובת ח"ס או"ח סימן ה' שיש להקל בתפורות ואם היו רק דבוקות בדבק מחמיר שם אבל בח"א משמע דה"ה אם הם דבוקות בדבק וכן משמע באו"ז וכן נתפשט עתה המנהג במדינותינו ומ"מ לכתחילה ראוי ונכון לעשותו מעור אחד ממש כי יש מחמירין וסוברין דלא מהני בחתיכות תפורות יחד או מדובקות בדבק ועיין בח"א דעכ"פ צריכין שיהיו הד' בתים פרודות זה מזה ולא יהיו מדובקין ולא כמו שעושין הסופרים שמדבקין ע"י דבק רק שלמעלה עושין סימנים כמו חריץ בעלמא דצ"ע אם להכשיר אפילו בדיעבד דממ"נ אם אנו חושבין ע"י דיבוק עור אחד א"כ אין לנו אלא בית אחת ובתוכו ד' מחיצות דפסול ואם אין הדבק עושה עור אחד ויש כאן ד' בתים עם ד' חריצים דהדיבוק כנפרד דמי א"כ התפילין גופייהו נעשו משתי עורות ופסולים ובאמת טוב הוא שאפילו העושין מעור אחד ממש יהיו תפיליהן פרודות דשמא הדיבוק חבור וכן התפילין של הגר"א היו פרודות ועיין בבה"ל:
(172) 'From one leather' -- and pieces of leather sewn together -- the Magen Avraham considers them regarded as one leather, and so wrote the responsum of the Chatam Sofer, Orach Chaim siman 5, that one may be lenient with sewn ones; and if they were only attached with glue, he is stringent there; but in the Chayei Adam it is implied that the same applies even if they are attached with glue, and so it is implied in the Or Zarua, and so the custom has now spread in our lands. Nevertheless, ideally it is fitting and proper to make it from a single leather literally, for some are stringent and hold that it does not help with pieces sewn together or attached with glue. And see the Chayei Adam, that in any case the four batim must be separated one from another and not attached, and not as the scribes do, who attach them with glue, only that on top they make markings like a mere groove -- for it requires examination whether to validate this even after the fact; for either way: if we consider that through attachment they are one leather, then we have only a single bayit with four partitions inside it, which is invalid; and if the glue does not make them one leather, and there are here four batim with four grooves, the attachment being like separate, then the tefillin themselves were made from two leathers and are invalid. And in truth it is good that even those who make batim from a single leather literally should have their tefillin separated, for perhaps the attachment is a connection; and so the tefillin of the Gra were separated; and see the Biur Halacha.
(קעג) שיהיו מרובעות - ואם לא עשה מרובעות מעכב בדיעבד [הרמב"ם פ"ג מהלכות תפילין עי"ש] ומ"מ אם אין לו תפילין אחרים יניחם לע"ע בלא ברכה וכשיזדמן לו תפילין אחרים יניחם ועיין בבה"ל:
(173) 'That they be square' -- and if he did not make them square, it invalidates even after the fact [Rambam, ch. 3 of the Laws of Tefillin, see there]. Nevertheless, if he has no other tefillin, he should wear them for the time being without a blessing, and when other tefillin become available to him he should wear those; and see the Biur Halacha.
(קעד) שיהיו ריבוען - של התפירות ונ"ל פשוט דצריך להיות התפירות מרובע בין למעלה ובין למטה ואף דלא ברירא לי לענין דיעבד מ"מ לכתחילה בודאי יש ליזהר בזה:
(174) 'That their square be exact' -- of the stitches; and it appears to me obvious that the stitches must be square, both above and below. And even though it is not clear to me regarding after the fact, nonetheless ideally one should certainly be careful in this.
(קעה) כדי שיהי' וכו' - פי' בריבוע גמור שארכו כרחבו ממש שיערו חכמים כל השיעור שיש לו יש לו באלכסון ב' חומשים נוסף על אותו השיעור וגם כאן צריך שיהיה מרובע ממש אבל אם לא יהיה מרובע ממש לא יהיה באלכסון שלו כשיעור ב' חומשים תוספות אלא שיעור אחר. וע"כ ימדדנו בד' קוים וידע אם הוא מרובע דהיינו תחלה ימדוד קו אחד באורך וקו אחד ברוחב שיהי' שוה אך שמא באמצעו שוה ובצדדיו מתמעט לכן ימדדנו עוד בשני קוים באלכסונו שיהיו שוים ב' קוי האלכסון ג"כ:
(175) 'So that it be,' etc. -- meaning in a complete square, whose length is exactly its width. The Sages estimated that whatever measure a square has, its diagonal has two-fifths more than that measure. And here too it must be exactly square; but if it is not exactly square, its diagonal will not have the additional two-fifths measure, but a different measure. Therefore he should measure it with four lines and thereby know whether it is square: first he measures one line along the length and one along the width, that they be equal; but perhaps in the middle it is equal while at the sides it diminishes; therefore he measures it further with two lines along its diagonal, that the two diagonal lines be equal as well.
(קעו) וצריך לרבע וכו' - וגם זה הוא מהלמ"מ לדעת רוב הפוסקים. וגם זה הוא בריבוע גמור כמו בהתפירה ואף דמרובע ממש במלאכת הבתים דהיינו שיהיה בתכלית הצמצום הוא כמעט מן הנמנע מ"מ כל מה דאפשר לו לאדם לעשות בענין זה בודאי חייב הוא לעשות ועיין בע"ד:
(176) 'And one must square,' etc. -- this too is from the law given to Moshe at Sinai, according to most decisors. And this too must be a complete square, as with the stitching. And even though making the batim exactly square -- that is, in the utmost precision -- is nearly impossible, nevertheless, whatever a person is able to do in this matter he is certainly obligated to do; see there in the source.
(קעז) מושבן - והוא התיתורא דהיינו שיחתוך המעברתא מב' צדדיו כדי שיהא ניכר ריבוע התיתורא וכדלקמן בסמ"ד. וצריך להשגיח מאד ע"ז כי כל זה מעכב אפילו בדיעבד וגם יש להשגיח בענין התפירה כי מחמת שהסופרים עושין נקבים גדולים קצת נמשך החוט לצדדין ועי"ז אין התפירות שוות בריבוע זה נכנס וזה יוצא. והתיתורא צריכה להיות מרובע בין מלמעלה ובין מלמטה ועכשיו בעו"ה הרבה שאין משגיחין על תפיליהן שיהיו מרובעין כדין אפילו המדקדקין במצות יש שאין משגיחין כ"א על ראש הבתים שיהיו מרובעין ואין משגיחין על התיתורא ועל התפירות שהוא ג"כ מעיקר הדין והוא דבר הנקל לתקן:
(177) 'Their seat' -- and this is the titura -- that is, that he cuts the ma'avarta on its two sides so that the square of the titura be recognizable, as below in the Mechaber's words. And one must pay great attention to this, for all of it invalidates even after the fact. One must also attend to the matter of the stitching, for since the scribes make the holes somewhat large, the thread is drawn to the sides, and thereby the stitches are not even in this square -- one goes in and another out. And the titura must be square, both above and below. And nowadays, in our many sins, many do not attend to their tefillin being square according to law; even among those exacting in mitzvot, there are those who attend only to the head of the batim being square, and do not attend to the titura and the stitches, which are also from the essence of the law, and it is a thing easy to fix.
(קעח) וגם הבתים - דלא כמו שנוהגין קצת לעשות של יד עגולה בראשו רק שמרבע התיתורא מלמטה אלא בין הש"י ובין הש"ר יהיו מרובעים. והכוונה בהש"ר כשהארבעה בתים יחד יהיו מרובעים ולא כל אחד בפני עצמו. וריבוע הבתים צ"ל בכל משך גובהן וגם הריבוע יהיה ע"י הבתים עצמן ולא ע"י ד"א שמטיח עליהם ועיין לקמן ס"ק קפ"ה:
(178) 'And also the batim' -- not as some are accustomed to make the hand-tefillin round at its top, only squaring the titura below; rather both the hand-tefillin and the head-tefillin should be square. And the intent regarding the head-tefillin is that the four batim together be square, and not each one by itself. And the squaring of the batim must extend the whole length of their height; and the squaring should be by the batim themselves, not by some other thing that he plasters upon them; and see below in sk 185.

(179) 'Their square became spoiled' -- such as the batim became bent, this one turning east and that one west, or the corners of the batim became wholly spoiled until it turned round, or the titura or the stitching became spoiled until they lost their square.

(180) 'There is one who says' -- none disagrees in this; and the Mechaber's manner is such in many places, as we wrote above in sk 123.
(קפא) שצריך לרבען - דכיון דריבוען הוא הלמ"מ בכל שעתא בעינן שיהיו מרובעין ומ"מ אין צריך למודדן בכל יום אם ריבועם קיים שמעמידים אותם על חזקתם אם לא שרואה שנתקלקל ואם נתעקם התיתורא אף שבעצם הוא מרובע רק מחמת התעקמות התיתורא נראית כמו שאינו מרובע יחזור ויתקן:
(181) 'That he must re-square them' -- for since their square is a law given to Moshe at Sinai, they must be square at all times. Nevertheless, one need not measure them every day to check whether their square remains, for we maintain them on their presumed status (chazakah), unless he sees that it became spoiled. And if the titura became bent, even though it is essentially square, only that because of the bending it appears not square, he should go back and fix it.
(קפב) ויעשה - ובדיעבד אפילו אחד רחב מחבירו כשר:
(182) 'And he should make' -- and after the fact, even if one is wider than another, it is valid.
(קפג) הבתים - וכ"ש שידקדק שהשי"ן יהיה שחור ולפעמים מחמת רוב יושנו נקלף ממנו השחרות:
(183) 'The batim' -- and all the more so he should be careful that the shin be black; and sometimes, because of its great age, the blackness peels off it.
(קפד) מצוה וכו' - משמע דבדיעבד אינו לעיכובא ויש פוסקים דס"ל דהוא הלמ"מ כמו הרצועות ולעיכובא הוא אפילו בדיעבד ובביאור הגר"א משמע שהוא מצדד כן להלכה וכן בישועות יעקב וכן משמע בא"ר ובשכנה"ג דיש להחמיר אם לא במקום דלא אפשר יש לסמוך אדברי המקילין כדי שלא להתבטל ממצות תפילין:
(184) 'A mitzvah,' etc. -- it implies that after the fact it is not indispensable; but there are decisors who hold it is a law given to Moshe at Sinai, like the straps, and indispensable even after the fact; and in the commentary of the Gra it is implied that he inclines so in halacha, and likewise in the Yeshuot Yaakov, and so it is implied in the Eliyah Rabbah and the Knesset HaGedolah, that one should be stringent, unless in a place where it is impossible, where one may rely on the lenient authorities, so as not to forgo the mitzvah of tefillin.
(קפה) שחור - והשחרות טוב יותר שיהיה בצבע שחור שאין בו ממש כלל והתפילין יהיו שחורים רק בחזותא בעלמא ומ"מ המשחירין במין גלאנ"ץ שא"א לקלפו אע"פ שיכולין להסיר מן הקלף ע"י פירורין דקין אין להחמיר בדיעבד ועיין במה שכ' בסעיף מ"ח בבה"ל בשם הפמ"ג שדעתו ג"כ דאין להחמיר בזה אכן מה שחדשו סופרי זמנינו שמשחירין בטיחה שיכולין לקלוף בשלימות מכל צד מן התפילין וצורתו כמו נייר שחור זהו פסול [מספר נשמת אדם ושהסכים אתו הגאון בעל בית מאיר דלא כנב"י עי"ש]:
(185) 'Black' -- and the blackening is better if it is with a black color that has no substance at all, so that the tefillin are black only in mere appearance. Nevertheless, those who blacken with a kind of lacquer ('glanz') that cannot be peeled off -- even though it can be removed from the leather by fine crumbs -- one should not be stringent after the fact. And see what he wrote in se'if 48 in the Biur Halacha in the name of the Pri Megadim, whose view too is that one should not be stringent in this. However, what the scribes of our time introduced -- blackening with a coating that can be peeled off entirely from every side of the tefillin, its form like black paper -- this is invalid [from Sefer Neshmat Adam, who noted that the Gaon author of the Beit Meir agreed with him, unlike the Noda BiYehuda, see there].
(קפו) סי' ל"ג - בס"ד בהג"ה ועי"ש במ"ב דהרמ"א קאזיל לשיטת המחבר הכא דהוא רק מצוה בעלמא ולפי מה שכ' באות קפ"ד יש לעיין בזה:
(186) 'Siman 33' -- in se'if 4 in the gloss; and see there in the Mishnah Berurah, that the Rema follows the approach of the Mechaber here, that it is only a mere mitzvah; and according to what he wrote in sk 184, there is room to examine this.
(קפז) והוא שיהיה וכו' - אבל אם אינו ניכר מבחוץ אף שמבפנים יש ד' בתים וכל פרשה ופרשה מונחת בית בפ"ע לא מהני:
(187) 'And that it be,' etc. -- but if it is not recognizable from the outside, even though inside there are four batim, and each passage lies in its own separate bayit, it does not help.
(קפח) ניכר החריץ - אבל שריטה או רשימה בעלמא לא מהני כלל כי עכ"פ צריך הבדל מעט בין הבתים שיהיו החריצין ניכרים ממש וכן הח"א מיאן במעשה הסופרים שמדבקין הבתים וטחין את כל הבית בטיח או בגלאנ"ץ רק שעושין רושם בהגלאנ"ץ ומה גם דלכתחלה בעינן שיהי' החריץ מגיע עד למטה ועיין בבה"ל וכ"ש הסופרים שתולין עור על הד' בתים ורושמין בו חריצין בסכין שתהיה נראה כארבעה בתים דפסול דעי"ז נעשה תפילה של יד:
(188) 'The groove is recognizable' -- but a mere scratch or marking does not help at all, for in any case there must be a slight separation between the batim, so that the grooves are truly recognizable. And likewise the Chayei Adam rejected the practice of the scribes who attach the batim and coat the whole bayit with a coating or with lacquer, merely making a mark in the lacquer; and all the more so, since ideally we require the groove to reach down to the bottom; and see the Biur Halacha. And all the more so the scribes who hang leather over the four batim and cut grooves in it with a knife so that it appears as four batim, that it is invalid, for thereby it becomes a hand-tefillin.
(קפט) אורך ורוחב - ומ"מ נכון לחוש לדברי הגאונים שסוברין שלכתחילה לא יעשה אותן קטנים מאצבעיים על אצבעיים והיינו עם התיתורא ועיין בע"ת שכתב דאם אין מחזיק עם התיתורא רק כאצבע על אצבע אפילו בדיעבד פסול וכן פסק בספר ביאור מרדכי ועיין בספר א"ר שלמד עליהם זכות ומ"מ סיים דכל בעל נפש יזהר לעשות התיתורא רחב ב' אצבעיים ולבד כל אלו מצוי מאוד באלו התפילין הקטנים שפרשיותיהן גרועות עד מאד מצד דחק המקום כאשר בעיני ראיתי הרבה מהם ע"כ השומר נפשו ישמור מהם:
(189) 'Length and width' -- nevertheless it is proper to be concerned for the words of the Geonim, who hold that ideally one should not make them smaller than two fingerbreadths by two fingerbreadths, that is, including the titura. And see the Olat Tamid, who wrote that if it does not hold, with the titura, more than a fingerbreadth by a fingerbreadth, it is invalid even after the fact; and so ruled Sefer Biur Mordechai. And see Sefer Eliyah Rabbah, who found merit for them, yet concluded that every conscientious person should take care to make the titura two fingerbreadths wide. And apart from all these, it is very common in these small tefillin that their passages are exceedingly poor, because of the cramped space, as I myself have seen with many of them; therefore, one who guards his soul should keep away from them.
(קצ) הלכה למשה מסיני - ואם נתקלקל השי"ן ואינו ניכר צריך לתקנו מחדש דומיא דאם נתקלקל ריבוע המבואר בסמוך:
(190) 'A law given to Moshe at Sinai' -- and if the shin became spoiled and is not recognizable, he must repair it anew, similar to the case where the square became spoiled, explained just above.
(קצא) כמין שי"ן - ומשמע באחרונים דתמונת שיני"ן שלנו שאנו עושין בתפילין די דלא בעינן דוקא כתב סת"מ ממש אלא דוגמא ומנהג סופרים כהיום באיזה מקומות להדר ולעשותן בכתב אשורית ממש:
(191) 'A kind of shin' -- and it is implied in the Acharonim that the shape of our shins, which we make on the tefillin, suffices, for we do not specifically require the actual script of tefillin, mezuzot, and Torah scrolls, but only a semblance; and the custom of scribes today, in some places, is to beautify and make them in actual Ashuri script.
(קצב) בולטת וכו' - ואם עשה השי"ן בקלף אחר והדביק בדבק על הבית פסול:
(192) 'Protruding,' etc. -- and if he made the shin on a separate kelaf and attached it with glue onto the bayit, it is invalid.
(קצג) מקמטי העור - דהיינו שמקמט העור במלקט ע"י כפילה שכופל מהעור עד שנעשו סעיפי השי"ן. ולעשותן ע"י דפוס דהיינו שעל הדפוס חקוק שי"ן בולטת ודוחק הדפוס בעור הבית ונעשה תואר שי"ן עיין בט"ז ומ"א דמשמע דלכתחילה טוב למנוע מזה ובכנה"ג בשם תשובת הרמ"ע כתב דזהו יותר הידור וכן המנהג פשוט כהיום לעשותן בדפוס מפני שעי"ז יש לה תואר שי"ן בחוליותיה וזיונה יותר משי"ן המקומטת מהעור:
(193) 'From the folds of the leather' -- that is, he creases the leather with tweezers by a folding, folding the leather until the branches of the shin are formed. And as for making them by means of a mold -- that is, a protruding shin is engraved on the mold and he presses the mold into the leather of the bayit so that the form of a shin is produced -- see the Taz and the Magen Avraham, from whom it is implied that ideally it is good to refrain from this. But the Knesset HaGedolah, in the name of the responsum of the Rama of Fano, wrote that this is more of a beautification; and so the custom is widespread today to make them with a mold, because thereby it has the form of a shin, in its segments and its adornment, more than a shin creased from the leather.
(קצד) של ימין המניח - ואין חילוק בזה בין איטר לאחר דבתר ימין ושמאל דעלמא אזלינן:
(194) 'On the right of the wearer' -- and there is no difference in this between a left-handed person and anyone else, for we follow the ordinary right and left.

(195) 'Is not invalidated' -- but if he made on both sides only a shin of three heads, or shins of four heads, it is invalid; and all the more so if he entirely omitted one shin.

(196) 'Of the shin' -- both the right one and the left one.

(197) 'It should reach,' etc. -- that is, all the way to the titura itself. And after the fact it is valid even if it did not reach, as long as the form of the shin is upon it.
(קצח) היו"ד שבשי"ן - יש מהגדולים שמחלקין בין שי"ן הימיני להשמאלי שבשמאלי אדרבה ידקדק שלא יגעו היודי"ן בשולי השי"ן למטה אבל המ"א פסק דאין לחלק בין הימיני להשמאלי ובהשמאלי בעינן ששני היודי"ן יהיו נוגעין למטה בשוליה וכ"כ הפמ"ג דכן ראוי לעשות וכ"כ בברכי יוסף בשם מהר"י עי"ש וכ"פ שארי אחרונים עוד כתב הפמ"ג דיראה שיהיה על השיני"ן צורת יודי"ן לא קוין פשוטין בעלמא:
(198) 'The yud of the shin' -- there are some of the great ones who distinguish between the right shin and the left, holding that in the left, on the contrary, he should be careful that the yuds not touch the base of the shin below. But the Magen Avraham ruled that one should not distinguish between the right and the left, and in the left too we require that both yuds touch below at its base; and so wrote the Pri Megadim, that thus it is proper to do, and so wrote the Birkei Yosef in the name of Mahari, see there, and so the rest of the Acharonim ruled. The Pri Megadim further wrote that he should see to it that the shins have the form of yuds, not mere straight lines.
(קצט) ליגע למטה - דבלא"ה אין שם שי"ן עליו ולעיכובא הוא אפילו בדיעבד ובשי"ן השמאלי אם אחד נוגע ואחד אינו נוגע פסול ועיין בבה"ל:
(199) 'To touch below' -- for without this it has no status of a shin, and it is indispensable even after the fact. And in the left shin, if one touches and the other does not, it is invalid; and see the Biur Halacha.
(ר) שגם שולי השי"ן - ר"ל חודיהן של השיני"ן והטעם דצריך שיהא כל השי"ן נראה ולקיים מה דכתיב וראו כל עמי הארץ כי שם ה' נקרא עליך וא"ר אלעזר אלו תפילין שבראש שם ה' נקרא ר"ת שי"ן ובדיעבד אם נכנס מעט לתוך התיתורא עד שאין לו עי"ז תמונת שי"ן כראוי צ"ע ועיין בבה"ל:
(200) 'That also the base of the shin' -- meaning the points of the shins. And the reason is that all of the shin must be visible, and to fulfill what is written, 'And all the peoples of the earth shall see that the Name of Hashem is called upon you,' and Rabbi Elazar said: these are the head-tefillin, upon which the Name of Hashem is proclaimed -- alluded to by the shin. And after the fact, if it entered a little into the titura, so that thereby it does not have the proper form of a shin, it requires examination; and see the Biur Halacha.
(רא) שישים וכו' - ואפילו לדעת הסוברים דהבתים צריכים להיות כולם מעור אחד ממש מ"מ לא בעינן שיהא התיתורא והמעברתא עם הבתים מעור אחד אלא אפילו אם הוא עור בפני עצמו כשר וזהו שכתב המחבר שישים וכו'. ומ"מ אם באפשרי טוב להדר גם בזה לצאת דעת המחמירין בזה ועיין בבה"ל:
(201) 'That he place,' etc. -- even according to those who hold that the batim must all be from a single leather literally, we nonetheless do not require that the titura and ma'avarta be of one leather with the batim; rather even if it is a leather by itself, it is valid, and this is what the Mechaber wrote, 'that he place,' etc. Nevertheless, if possible it is good to beautify in this too, to satisfy the view of those stringent in this; and see the Biur Halacha.
(רב) יהא ארוך - ואם נפסקה מותר לתופרה:
(202) 'Should be long' -- and if it tore, it is permitted to sew it.
(רג) שיהא ניכר - כי גם התיתורא צריכה מדין להיות מרובע וכמו שכתבנו למעלה בסעיף ל"ט:
(203) 'That it be recognizable' -- for the titura too must, by law, be square, as we wrote above in se'if 39.
(רד) מסופה לתחלתה - בעת שנותנה לביתה כמו מזוזה שנגללת מאחד כלפי שמע ולא להיפך מטעם שנתבאר ביו"ד סי' רפ"ח:
(204) 'From its end to its beginning' -- at the time he places it in its bayit, like a mezuzah, which is rolled from its end (the word echad) toward the Shema and not the reverse, for the reason explained in Yoreh Deah, siman 288.
(רה) וכורכם וכו' - ר"ל לכתחלה אבל אם לא כרכם כשר בדיעבד אם אין לו אחרים ועיין במחצית השקל ובבה"ל:
(205) 'And he wraps them,' etc. -- meaning ideally; but if he did not wrap them, it is valid after the fact, if he has no others; and see the Machatzit HaShekel and the Biur Halacha.
(רו) בקלף קטן - וה"ה בחתיכת בגד אם אין לו קלף [פמ"ג] ועיין בביאור הגר"א:
(206) 'In a small kelaf' -- and the same applies with a piece of cloth, if he has no kelaf [Pri Megadim]; and see the commentary of the Gra.
(רז) בקלף כשר - ר"ל אבל לא מבהמה וחיה טמאה אבל במטלית גם לדיעה זו שפיר דמי ועיין בב"י שכתב בטעם הדבר דכיון שהוא מביא קלף צריך להיות דוקא מן המותר לפיך כמו לבתים ולרצועות ובביאור הגר"א מפקפק בדין זה:
(207) 'In valid kelaf' -- meaning, but not from a non-kosher domesticated or wild animal; but with cloth, even according to this view it is fine. And see the Beit Yosef, who gave the reason: since he brings kelaf, it must be specifically from what is permitted to your mouth, as with the batim and the straps. And in the commentary of the Gra he casts doubt on this ruling.
(רח) והלמ"מ - לכן אם לא כרך השיער עליה פסול אף שכרך עליה קלף:
(208) 'And it is a law given to Moshe at Sinai' -- therefore, if he did not wrap the hair upon it, it is invalid, even though he wrapped kelaf upon it.
(רט) ונוהגין לכרוך וכו' - כי י"א שיכרוך השער על גוף הפרשה ואח"כ יכרוך הקלף למעלה וי"א להיפך לכך נוהגין לקיים דברי שניהם ועיין בביאור הגר"א שכתב דמדינא אין קפידא איזו קודם:
(209) 'And the custom is to wrap,' etc. -- for some say he should wrap the hair on the body of the passage and then wrap the kelaf on top, and some say the reverse; therefore the custom is to fulfill the words of both. And see the commentary of the Gra, who wrote that by law there is no concern which comes first.
(רי) של עגל - כדי שיזכור מעשה עגל ולא יחטא וגם כדי לכפר על עון זה וכתב הא"ר דמזה הטעם טוב לעשות כל תיקון תפילין מעור עגל ולאפוקי מאותן שעושין הרצועות מעור תייש:
(210) 'Of a calf' -- so that he will recall the sin of the golden calf and not sin, and also to atone for that sin. And the Eliyah Rabbah wrote that for this reason it is good to make all tefillin repairs from calf leather, to exclude those who make the straps from goat leather.
(ריא) קצת שער - עיין במ"א ועיין בחידושי רע"א שהסכים ששער היוצא יהיה פחות מאורך שעורה:
(211) 'A little hair' -- see the Magen Avraham, and see the novellae of Rabbi Akiva Eiger, who agreed that the protruding hair should be less than the length of a barleycorn.
(ריב) חוץ לבתים - י"א שיהיה אצל הבית שמונח בו פרשת קדש וי"א אצל והיה א"ש וטוב שיצא מפרשת והיה א"ש בצד הפונה לפרשת קדש:
(212) 'Outside the batim' -- some say it should be beside the bayit in which the passage Kadesh is placed, and some say beside Vehaya Im Shamoa; and it is good that it protrude from the passage Vehaya Im Shamoa, on the side facing the passage Kadesh.
(ריג) זקופה - כדרך קריאתה וכדרך שמעמידין ס"ת בהיכל ובדיעבד אם נתנה שם מושכבת אין לפסול התפילין בשביל זה כ"כ הב"י בשם הר"י בן חביב וכ"כ הב"ח ועיין במ"א ונראה דמ"מ על להבא צריך לתקן דהיינו שיוציאם ויניחם כהלכה:
(213) 'Upright' -- in the manner it is read, and as a Torah scroll is stood upright in the Ark. And after the fact, if he placed it there lying down, one should not invalidate the tefillin on this account; so wrote the Beit Yosef in the name of Rabbi Yosef ben Chaviv, and so wrote the Bach; and see the Magen Avraham. And it appears that nonetheless, going forward, he must fix it -- that is, take them out and place them properly.
(ריד) לצד פה - דאל"ה יעמדו האותיות הפוכות נגד הקורא:
(214) 'Toward the mouth' -- for otherwise the letters would stand inverted facing the reader.
(רטו) כהלכתן - שהרי מצינו שסדר הנחתן בבתים ג"כ הם מסודרים לפני ימין הקורא אשר הוא עומד נגד המניח שיהיה קורא כסדר מתחלה פ' קדש של ימינו ואח"כ פ' והיה כ"י ושאר הפרשיות כמש"כ בסי' ל"ד ע"כ צריך להיות סוף הגלילה שהוא ראש הפרשה ג"כ מצד ימין נגדו:
(215) 'Properly' -- for we find that the order of their placement in the batim too is arranged before the right of the reader, who stands facing the wearer, so that he would read in order: first the passage Kadesh on his right, and then the passage Vehaya Ki Yeviacha and the rest of the passages, as written in siman 34. Therefore the end of the rolling, which is the beginning of the passage, must also be on the right side opposite him.
(רטז) אפילו אין וכו' - ר"ל וכ"ש כשיש ריוח בין הפרשיות שיוכל לחתכם וישתייר כדי היקף גויל לכל אחת דשפיר דמי אף דבעת הכתיבה כתבן בקלף אחד וכתבו האחרונים אע"ג דכשאין ריוח ביניהם יהיה מוכרח להניח כל פרשה בביתה שלא בזקיפה אפ"ה כשר כי הזקיפה אינה אלא למצוה [כן מתבאר הפירוש לפי מש"כ הב"י בשם מהרי"א ומהר"י בן חביב וכן הסכים הב"ח ועיין במ"א בשם הד"מ]:
(216) 'Even if there is not,' etc. -- meaning, and all the more so when there is space between the passages, that he can cut them apart and enough surrounding gevil remains for each, that it is fine, even though at the time of writing he wrote them on a single kelaf. And the Acharonim wrote that even though, where there is no space between them, he will be forced to place each passage in its bayit not upright, it is nonetheless valid, for the uprightness is only for a mitzvah [thus the explanation is understood, per what the Beit Yosef wrote in the name of the Maharia and Rabbi Yosef ben Chaviv; and so the Bach agreed; and see the Magen Avraham in the name of the Darchei Moshe].
(ריז) או משיחה - ר"ל דכיון שכתב הפרשיות בעור אחד צריך להפסיק בחוט או משיחה או בגיד כמו שאנו נוהגין בין בית לבית כדי לתת היכר שהבתים מובדלים אבל בכתב הפרשיות על ד' עורות א"צ לתת כלום בין בית לבית ויש פוסקים דבכל גווני צריך לתת הבדל בין הבתים וכן יש לנהוג כמו שכתב המחבר לקמן בסעיף נ"א ויעביר חוט וכו' ומ"מ לענין דיעבד כתב הט"ז דאינו מעכב שם שהעיקר כסברא הראשונה:
(217) 'Or a cord' -- meaning, since he wrote the passages on one leather, he must separate them with a thread, a cord, or a sinew, as we are accustomed, between one bayit and another, in order to give a sign that the batim are distinct. But if he wrote the passages on four leathers, he need not place anything between one bayit and another. And there are decisors who hold that in all cases one must place a separation between the batim; and so one should practice, as the Mechaber wrote below in se'if 51, 'and he passes a thread,' etc. Nevertheless, regarding after the fact, the Taz wrote that it does not impede there, for the essential ruling is like the first opinion.
(ריח) בארבעה בתים - וכ"ש אם הניחם בבית אחד דטפי עדיף:
(218) 'In four batim' -- and all the more so if he placed them in one bayit, which is even better.
(ריט) והמנהג וכו' - ר"ל אם הניחם בבית אחד אף דבודאי יצא מ"מ לכתחלה מצוה לדבקם. כתבו האחרונים דאף שלכתחלה מצוה לכתוב הד' פרשיות של יד בקלף אחד מ"מ אם כבר כתב בד' קלפים חשוב כדיעבד ומותר להניחם לכתחלה אם מדביקם מקודם ואם נמצא טעות בפרשה רביעית מותר לכותבה בקלף לבד אפילו לכתחלה ולהדביקה דזה הוי כדיעבד:
(219) 'And the custom,' etc. -- meaning, if he placed them in one bayit, even though he has certainly fulfilled the obligation, nevertheless ideally it is a mitzvah to glue them. The Acharonim wrote that even though ideally it is a mitzvah to write the four passages of the hand-tefillin on one kelaf, nevertheless, if he already wrote on four kelafim, it is considered like after-the-fact, and it is permitted to use them even ideally, if he glues them beforehand. And if an error is found in the fourth passage, it is permitted to write it on a separate kelaf, even ideally, and to glue it, for this is like after-the-fact.
(רכ) דבק כשר - ר"ל מבהמה טהורה. וכתב בפמ"ג דזה רק למצוה אבל לא לעיכובא כיון דהדיבוק אינו מעכב ממילא אין קפידא במה מדבק:
(220) 'Valid glue' -- meaning from a kosher animal. And the Pri Megadim wrote that this is only for a mitzvah, not indispensable; since the attachment itself does not impede, there is automatically no concern regarding what he attaches them with.
(רכא) או בעור - פי' שעשה עור מתחלה מבהמה טהורה ואח"כ ציפה על אותו עור מבהמה טמאה אפ"ה פסולים ואפילו חתך במקום השיני"ן שהשי"ן נראה [פמ"ג] ועיין בבה"ל:
(221) 'Or with leather' -- meaning that he first made leather from a kosher animal and then overlaid upon that leather [leather] from a non-kosher animal, even so they are invalid; and even if he cut at the place of the shins so that the shin is visible [Pri Megadim]; and see the Biur Halacha.
(רכב) בגידי בהמה - ולוקחין מהעקב שהם לבנים ואם הם קשים מרככים באבנים עד שיעשו כפשתן וטווין אותם ושוזרין אותם ודעת המ"א בסוף ס"ק ס"ו דבעינן בזה הטוייה לשמה והא"ר ופמ"ג מפקפקין בזה:
(222) 'With the sinews of an animal' -- and they take from the heel sinews, which are white; and if they are hard, they soften them with stones until they become like flax, and spin and twist them. And the view of the Magen Avraham at the end of sk 66 is that this spinning must be lishmah; and the Eliyah Rabbah and the Pri Megadim cast doubt on this.
(רכג) טהורים - אפילו מנבילות וטריפות שלהם:
(223) 'Kosher' -- even from carcasses and fatally-defective ones of such species.
(רכד) בגידי שור - ואם אין לו יקח מגידי בהמה דקה אבל מטמאה אפילו בדיעבד פסול וצ"ע אם מותר לתפור בגיד הנשה [אחרונים]:
(224) 'With the sinews of an ox' -- and if he has none, he should take from the sinews of a small kosher animal; but from a non-kosher one it is invalid even after the fact. And it requires examination whether it is permitted to sew with the sciatic sinew (gid hanasheh) [Acharonim].
(רכה) דחיישינן וכו' - ודוקא כשהוא הולך לבתי הנכרים לקנות מהם גידין וגם ידוע לו שמקצת מן הנכרים הנוטלין הגידין מבהמה טמאה לכן אע"פ שהרוב נוטלין מטהורה כיון שהוא הולך אצל נכרי בשעה שהם קבועין בבתיהם אין הולכין אחר הרוב שכל קבוע כמחצה על מחצה דמי אבל אם העו"ג הביא לשוק מותר לקנות ממנו שכיון שפירש מקביעותו אמרינן כל דפריש מרובא פריש אם לא שמוכרין שם בשוק בחנויות אז חוזרין לקביעותן וכן אם אין ידוע שמקצתן נוטלין אותן מבהמה טמאה ג"כ מותר לקנות מהם בכל ענין שרוב גידין הם מבהמות טהורות אך כ"ז בגידין שאינן טויין אבל בגידין טויין דעת המ"א דאסור לקנות מהם אפילו הוא יודע שהם מבהמה טהורה שכיון שהוא הלמ"מ צריך שתהיה עשייתן לשמה וטויית הגידין זו היא עשייתן ונכרים לאו בני לשמה נינהו וכבר כתבנו דהא"ר ופמ"ג מפקפקים אי בעי כלל בזה טוייה לשמה:
(225) 'For we are concerned,' etc. -- and specifically when he goes to the houses of the non-Jews to buy sinews from them, and it is also known to him that some of the non-Jews take the sinews from a non-kosher animal; therefore, even though the majority take from a kosher one, since he goes to the non-Jew while they are fixed in their houses, we do not follow the majority, for anything 'fixed' in its place is regarded as half-and-half. But if the non-Jew brought them to the market, it is permitted to buy from him, for since it left its fixed place we say, 'whatever separates, separates from the majority' -- unless they sell there in the market in shops, in which case they revert to their fixed status. And likewise, if it is not known that some of them take them from a non-kosher animal, it is also permitted to buy from them in any case, for the majority of sinews are from kosher animals. But all this is with sinews that are not spun; with spun sinews, however, the Magen Avraham's view is that it is forbidden to buy from them, even if he knows they are from a kosher animal, for since it is a law given to Moshe at Sinai, their making must be lishmah, and the spinning of the sinews is their making, and non-Jews are not capable of acting lishmah. And we already wrote that the Eliyah Rabbah and Pri Megadim cast doubt whether spinning lishmah is required at all in this.
(רכו) בטאליאדור"ש - הם חוטין הנעשים מן הקלף ובמקום הדחק ס"ל כיון דמינו הוא הם כגידין עצמן וכשרים לתפור בהם סת"ם:
(226) 'With taliaduras' -- these are threads made from kelaf; and in a pressing situation he holds that since it is of its own kind (leather), they are like the sinews themselves and are valid to sew with them tefillin, mezuzot, and Torah scrolls.
(רכז) עד שיזדמנו - כדי שלא להתבטל ממצות תפילין וכשיזדמן לו גידים יתירם ויתפור בגידים ויש מאחרונים שחוששין שלא לצאת בהם אפילו בשעת הדחק שהרי הלמ"מ הוא גידין והטאליאדור"ש עור הוא שהוא הקלף ועור לתפירה לא שמענו ולפי"ז אם אין לו גידים אחרים עכ"פ לא יברך עליהם וכן בני מעיים דקים ויבשים כמין חוטים של גידים אין לתפור בהם דהלמ"מ הוא דוקא גידים עוד כתבו שאין לתפור בגידי עוף טהור כי מי יכריע איזה מהם קרוי גידין ואיזה מהם חוטין ואיזה מהם וורידין ואנן גידין בעינן:
(227) 'Until they become available' -- so as not to forgo the mitzvah of tefillin; and when sinews become available to him, he should untie the kelaf threads and sew with sinews. And some Acharonim are concerned not to fulfill the obligation with them even in a pressing situation, for the law given to Moshe at Sinai is 'sinews,' whereas the taliaduras is leather -- namely kelaf -- and 'leather for sewing' we have not heard of. According to this, if he has no other sinews, he should at least not recite a blessing over them. And likewise thin, dry intestines resembling sinew-threads, one should not sew with them, for the law given to Moshe at Sinai is specifically 'sinews.' They further wrote that one should not sew with the sinews of a kosher bird, for who can decide which of them is called 'sinews,' which 'threads,' and which 'veins' -- and we require 'sinews.'
(רכח) בכל צד - טעם לי"ב תפירות נגד י"ב שבטי ישראל ולא בעינן תפירה תוך הבית רק סמוך להבית ואין תופרין כתופר בגדים בשפת הבגד בלי שיור אלא משייר מן התיתורא חוץ להתפירה וצריך שעור הבתים מלמטה לפיו יהיו יוצאים מכל ארבע רוחותיהם עד שיהיו מגיעים תחת נקבי התפירה כדי שיתפור עור הבתים מכל צד עם התיתורא ולא כהסופרים המקצרין עור של הבתים שאינו עובר הלאה תחת נקבי התפירה ואינה נתפרת כלל עם התיתורא רק שמהדקין הבית בתוך הארובה של התיתורא והברוך שאמר כתב שפסל כמה תפילין מחמת זה אלא צריך לתפור יחד העור של הבתים עם התיתורא:
(228) 'On each side' -- the reason for the twelve stitches is corresponding to the twelve tribes of Israel; and we do not require the stitch to be inside the bayit, only next to the bayit. And one does not sew as one who sews garments at the garment's edge without a remainder; rather he leaves some of the titura outside the stitching. And the leather of the batim below, at its mouth, must protrude from all four of their sides until it reaches beneath the stitching-holes, so that he sews the leather of the batim on every side together with the titura; and not like the scribes who shorten the leather of the batim, so that it does not extend beyond, beneath the stitching-holes, and is not sewn at all with the titura, only pressing the bayit into the opening of the titura. And the Baruch She'amar wrote that he invalidated several tefillin on account of this; rather, one must sew the leather of the batim together with the titura.
(רכט) משתי רוחות - ר"ל שכל התפירה יהא מסובבת משני צדדין פנים ואחור נמצא תופר בב' מחטין אחת יוצאת לאחור ואחת נכנסת לצד פנים:
(229) 'From two sides' -- meaning that the entire stitching should encircle from both sides, front and back; it turns out he sews with two needles, one going out to the back and one entering to the front side.
(רל) מיהו אם וכו' - וכן אם לא העביר חוט התפירה אינו מעכב בדיעבד ועיין לעיל בס"ק רי"ז:
(230) 'However, if,' etc. -- and likewise, if he did not pass the sewing thread between the batim, it does not impede after the fact; and see above in sk 217.
(רלא) בחוט אחד - ואם נפסק י"א דיכול לקושרו וי"א דיטלנו כולו משם ויחזור ויתפור מחדש בחוט אחר שכיון שנפסק בשעת התפירה ניכר שהחוט קלוש ועומד ליפסק ואינו כלום אבל כשהחוט קצר מתחלתו ואינו נפסק לכו"ע יכול לקשור לו חוט אחר לגמור התפירה וכתב הפמ"ג דאם אין לו גידין אחרים יש לסמוך על סברא הראשונה ולקשור חוט שנפסק וכ"ז אם נפסק באמצע התפירה אבל אם נפסק אחר התפירה עיין לקמן סימן ל"ג ס"ב:
(231) 'With one thread' -- and if it tore, some say he may tie it, and some say he should remove it all and re-sew anew with another thread, for since it tore during the sewing, it is evident that the thread is thin and prone to tear, and is worthless. But when the thread is short from the outset and did not tear, all agree he may tie another thread to it to finish the sewing. And the Pri Megadim wrote that if he has no other sinews, one may rely on the first opinion and tie a thread that tore. And all this is if it tore in the middle of the sewing; but if it tore after the sewing, see below in siman 33, se'if 2.
(רלב) ויעשה קשר - וקשר של תפילין הוא הלכה למשה מסיני ונראה שצריך לעשותו לשמה ולא יעשהו קטן [פמ"ג]:
(232) 'And he should make a knot' -- and the knot of tefillin is a law given to Moshe at Sinai; and it appears that he must make it lishmah, and he should not make it small [Pri Megadim].
(רלג) כמין ד' - ויש שעושין קשר כמ"ם סתומה שנראה כשני דלתי"ן משני צדדין רגלו של זה בצד ראשו של זה ועיין בספר תפארת אריה שהביא בשם תשובה מאהבה והסכים עמו לדינא דאלו העושים קשר של דלי"ת מכוון יותר לדינא. גם לא יעשה קשר העשוי להשמט אנה ואנה כמו שביארתי בבה"ל. כתב א"ר מעשה באחד שראה אחר חליצת התפילין שהותר הקשר ש"י והוריתי לחזור ולהניחן ולקרות ק"ש בלי ברכה דהא מצות תפלין כל היום עכ"ל וטעמו דלשיטת רש"י דס"ל דהיו"ד הוא הלמ"מ לא יצא עדיין ידי המצוה:
(233) 'Like a dalet' -- and there are those who make a knot like a closed mem, which looks like two dalets on two sides, the leg of this one at the side of the head of that one. And see Sefer Tiferet Aryeh, who cited the Teshuvah MeAhavah and agreed with him in law, that those who make a knot of a single dalet are more correct according to the law. Also, he should not make a knot that is liable to slip this way and that, as I explained in the Biur Halacha. The Eliyah Rabbah wrote of an incident with one who saw, after removing the tefillin, that the knot of the hand-tefillin had come undone, and I ruled to put them on again and recite the Shema without a blessing, for the mitzvah of tefillin lasts the whole day; end of his words. And his reason is that according to Rashi's approach, who holds that the yud of the knot is the law given to Moshe at Sinai, he has not yet fulfilled the mitzvah.
(רלד) להעביר - הטעם לפי שהתפילין ש"י משימין אותם תחת הבגדים ומתנדנדים ונפסדים ומתקלקלין לכך נהגו להעביר רצועה זו עליהן לחזקן ועכשיו באלו הארצות לא נהגו בזה [א"ר ע"ש]:
(234) 'To pass' -- the reason: because the hand-tefillin are placed under the garments and shake about and become ruined and spoiled; therefore they were accustomed to draw this strap of leather over them to strengthen them. And nowadays, in these lands, they did not practice this [Eliyah Rabbah, see there].
(רלה) אלא לאחר וכו' - ר"ל כן נכון לכתחלה ואי איתרמי שהותר הקשר ש"ר א"צ רק לתקנו ולא להתיר הש"י:
(235) 'Except after,' etc. -- meaning, thus it is proper ideally; and if it happened that the knot of the head-tefillin came undone, he need only fix it, and not untie the hand-tefillin.
