סעיף א׳

המתפלל לא יעמוד לא על גבי מטה ולא על גבי כסא ולא על גבי ספסל אואפי' באינן גבוהין ג' [ב"י בשם מהרי"א] גולא על גבי מקום גבוה אלא אם כן היה דזקן או חולה או שהיה כוונתו הלהשמיע לציבור:

One who prays should not stand up on a bed, nor on a chair, nor on a bench, even if these are not three [handbreadths] high (so the Beis Yosef in the name of the Mahari"a), and not on a high place, unless he was old or ill (for whom descending is hard), or if his intent was to make himself heard by the congregation (as the prayer leader).

ס״ק אואפילו וכו'

(א) ואפילו וכו' - מפני שכשהוא עומד עליהם הוא טרוד וירא שמא יפול ולא יוכל לכוין בתפלתו ולפ"ז מה שהתירו בסמוך בזקן וחולה אף דאין בו משום גבהות מ"מ יאסר לעמוד מחמת ביעתותא צ"ל הטעם דלא הטריחוהו חכמים והתירוהו להתפלל עליהם במה שייטב לו בישיבה או בעמידה או י"ל דמיירי שם בגווני דליכא ביעתותא:

(1) 'Even if...' — because when he stands on them he is preoccupied and afraid that he might fall, and will be unable to concentrate in his prayer. According to this, that which was permitted just below for an old or ill person — even though there is no issue of 'height' with them, it would still seem it should be forbidden to stand [on a bed] because of the fear [of falling] — one must say the reason is that the Sages did not trouble him, and permitted him to pray on them in whatever way is easiest for him, whether sitting or standing; or one could say that it refers there to a case where there is no fear [of falling].

(ב) אינן גבוהין ג' - והב"ח והט"ז מתירין אבל הא"ר פוסק כהש"ע:

(2) 'Are not three high' — the Bach and the Taz permit [standing on them], but the Eliyah Rabbah rules like the Shulchan Aruch [to forbid].

(ג) ולא ע"ג וכו' - לפי שאין גבהות לפני המקום שנא' ממעמקים קראתיך ה':

(3) 'And not upon...' — because there is no [place for] haughtiness before the Omnipresent, as it says, 'From the depths I called to You, Hashem.'

(ד) זקן או חולה - שקשה לו לירד מעל המטה:

(4) 'An old or ill person' — for whom it is difficult to climb down from the bed.

(ה) להשמיע לצבור - דמותר לו לעמוד ע"ג מקום גבוה ואפילו ע"ג כסא או ספסל ואין בזה משום גבהות ויש מן האחרונים שכתבו דהיכא דיש בו משום ביעתותא אפילו להשמיע לצבור אסור. כתב המ"א שעכשיו נהגו שהמקום שהש"ץ עומד עליו הוא עמוק משאר בהכ"נ משום ממעמקים קראתיך ה' ולכן נקרא הש"ץ בכ"מ יורד לפני התיבה:

(5) 'To make himself heard by the congregation' — he is permitted to stand on a high place, and even on a chair or bench, and there is no issue of 'height' in this. And some of the later authorities wrote that where there is fear [of falling], it is forbidden even to be heard by the congregation. The Magen Avraham wrote that nowadays the custom is that the place where the chazzan (prayer leader) stands is lower than the rest of the synagogue, because of 'From the depths I called to You, Hashem,' and therefore the chazzan is everywhere called 'the one who goes down before the ark.'

סעיף ב׳

שיעור ומקום גבוה שאמרו ג' טפחים היה גבוה ג' ויש בו ד' אמות על ד' אמות הרי הוא כעלייה ומותר להתפלל בו וכן אם היה זמוקף מחיצות אע"פ שאין בו ד' על ד' מותר להתפלל בו שאין גבהו ניכר כיון שחלק רשות:

The measure of a 'high place' that they spoke of is three handbreadths. If it was three [handbreadths] high but has an area of four cubits by four cubits, it is considered like an upper chamber, and one may pray on it. Likewise, if it was surrounded by partitions, even though it does not have four by four, one may pray on it, since its height is not conspicuous, because it forms a distinct domain.

(ו) מקום גבוה וכו' - פי' אפילו הוא ארעא סמיכתא וגובה ג"ט אסור לעמוד עליו להתפלל אבל פחות מזה אין גבהו ניכר:

(6) 'A high place, etc.' — that is, even if it is solid ground raised three handbreadths high, it is forbidden to stand on it to pray; but less than that, its height is not conspicuous.

ס״ק זמוקף מחיצות

(ז) מוקף מחיצות - ובימה חדשה שבבהכ"נ שעדיין לא הוקפה מחיצות פשוט דאסור להתפלל עליה ומיהו לענין שמש שמקומו לעמוד שם בקביעות לצרכי בהכ"נ נראה דמותר כמו לענין אומנין בס"ג [פמ"ג]:

(7) 'Surrounded by partitions' — and a new bimah in a synagogue that has not yet been surrounded by partitions — it is obvious that it is forbidden to pray on it. However, regarding the sexton (shamash), whose place is to stand there regularly for the needs of the synagogue, it appears that it is permitted, just as with the craftsmen in se'if 3 (the Pri Megadim).

האומנין שעושין מלאכה לבעל הבית יכולין להתפלל בראש הזית ובראש התאנה ואין בזה משום לא יעמוד על גבי מקום גבוה ויתפלל דכיון שעלו לעשות מלאכתם הוי כמו שעלה לעלייה ובשאר אילנות צריכים לירד והטעם שנשתנה הזית משאר אילנות מפני שיש להם ענפים הרבה יותר משאר אילנות ויש טורח גדול בעלייתם ובירידתם ויתבטלו ממלאכתם ולפיכך אמרו שיתפלל שם אבל שאר אילנות דליכא ביטול ירדו ובעל הבית אפילו מראש הזית והתאנה צריך לירד להתפלל דהא אינו משועבד למלאכה שהוא ברשות עצמו ואם הקילו אצל פועלים מפני ביטול מלאכה לא הקילו אצל בעל הבית:

Craftsmen who are doing work for a householder may pray at the top of an olive tree or a fig tree, and there is no violation here of 'one should not stand on a high place and pray,' since, because they climbed up to do their work, it is as though one has gone up to an upper chamber. But in other trees they must come down (to pray). The reason the olive differs from other trees is that they have many more branches than other trees, and there is great effort in climbing up and down them, so they would be idled from their work; therefore they said he may pray there. But other trees, where there is no such loss of work — they must come down. And the householder himself, even from the top of an olive or fig tree, must come down to pray, for he is not bound to the work — he is his own master; and if they were lenient with hired workers because of loss of work, they were not lenient with the householder.

סעיף ד׳

צריך לפתוח פתחים חאו חלונו' כנגד ירושלים כדי להתפלל כנגדן וטוב שיהיו בב"ה טי"ב חלונות:

One should open doorways or windows facing Jerusalem, in order to pray toward them. And it is good for a synagogue to have twelve windows.

(ח) או חלונות - ואפילו בבהכ"נ כשמתפלל עם הצבור נכון ליזהר בזה וכ"ש כשמתפלל בבית ביחידי דצריך ליזהר בזה לכתחילה וכדאיתא בגמרא דלא יתפלל אדם אלא בבית שיש בו חלונות ואע"ג דצריך שיתן עיניו למטה וכמ"ש סימן צ"ה ס"ב ומה נ"מ בהחלונות מ"מ כשנתבטלה כוונתו ישא עיניו לשמים לעורר הכוונה:

(8) 'Or windows' — even in a synagogue, when praying with the congregation, it is proper to be careful about this, and all the more so when praying at home alone, where one must be careful about this at the outset, as the Gemara states, that a person should pray only in a room that has windows. And even though one must direct his eyes downward, as is written in siman 95, se'if 2 — so what difference do the windows make? — nevertheless, when his concentration lapses, he can lift his eyes to heaven to awaken his focus.

(ט) י"ב חלונות - לאיזה צד שירצה ובתנאי שיהיה גם בצד שמתפלל לקבל ירושלים [פמ"ג]:

(9) 'Twelve windows' — on whichever side he wishes, provided that some are also on the side toward which he prays, facing Jerusalem (the Pri Megadim).

סעיף ה׳

ילא יתפלל יאבמקום פרוץ יבכמו בשדה מפני שכשהוא במקום צניעות חלה עליו אימת מלך ולבו נשבר:

One should not pray in an open, exposed place, such as in a field, because when he is in a private, secluded place the awe of the King settles upon him and his heart becomes humbled.

ס״ק ילא יתפלל

(י) לא יתפלל - ובגמרא איתא דחצוף הוא מי שעובר ע"ז וכתב הפמ"ג דע"כ אם נזדמן לו בית שאין בו חלונות ובקעה טוב יותר להתפלל בבית שאין בו חלונות:

(10) 'He should not pray' — and in the Gemara it is stated that one who transgresses this is brazen. The Pri Megadim wrote that, accordingly, if he has available a room without windows or an open valley, it is better to pray in the room without windows [than in the open field].

ס״ק יאבמקום פרוץ

(יא) במקום פרוץ - והנה לחד תירוצא דתוספות אם הוא עומד בצד הדרך במקום שאין מתיירא שיפסיקוהו עוברי דרכים שרי אך בב"י ממאן בדבריהם והנה אף שהמ"א ושארי אחרונים מיישבים לדברי התוס' מ"מ כתבו שבזוהר משמע שיש להתפלל דוקא בבית. ועוברי דרכים לכ"ע מותרים להתפלל בשדה ומ"מ כשיש שם אילנות טוב יותר שיעמוד שם ביניהם ויתפלל אם אין קשה עליו איחור דרכו דמקום צנוע הוא קצת עי"ז וכשהוא בביתו אין לסמוך ע"ז:

(11) 'In an open place' — Now, according to one answer of Tosafos, if he stands at the side of the road, in a spot where he does not fear that passersby will interrupt him, it is permitted; but the Beis Yosef rejects their words. And although the Magen Avraham and other later authorities uphold the words of Tosafos, they nonetheless wrote that the Zohar implies one should pray specifically in a building. Travelers on the road, according to all opinions, are permitted to pray in a field. Nonetheless, when there are trees there, it is better that he stand among them and pray, if the delay to his journey is not hard for him, since it is somewhat of a private place thereby; but when he is at home, one may not rely on this.

(יב) כמו בשדה - ובמקום שהוא מוקף מחיצות אע"פ שאינו מקורה שפיר דמי:

(12) 'Such as in a field' — but in a place that is surrounded by partitions, even though it is not roofed, it is perfectly fine.

סעיף ו׳

יגולא בחורבה ידמפני חשד ומפני המפולת ומפני המזיקים:

Nor in a ruin, because of suspicion, because of collapse, and because of harmful spirits.

(יג) ולא בחורבה - מוכח בגמרא דמוטב להתפלל בדרך מבחורבה ואפילו היכא דליכא בה כ"א טעם אחד ואם הוא מתיירא שיפסיקוהו עוברי דרכים יתפלל תפלה קצרה עיין סימן ק"י:

(13) 'Nor in a ruin' — it is proven in the Gemara that it is better to pray on the open road than in a ruin, even where there is only a single one of these reasons present. And if he fears that passersby will interrupt him, he should recite the short prayer; see siman 110.

ס״ק ידמפני חשד

(יד) מפני חשד - שיחשדוהו שיש לו זונה מוכנת שם ואם החורבה עומדת בשדה אין לחוש בה לחשד שאין זונה מצויה בשדה וה"ה אם אשתו עמו ג"כ ליכא למיחש לחשד ואם היא חורבה בריאה וחזקה ליכא למיחש בה למפולת ואם שנים נכנסין בה אין לחוש למזיקין שלאחד נראה ומזיק ולשנים נראה ואינו מזיק ולג' אין נראה כלל אם לא במקום שידוע שרגילין שם מזיקין ואבוקה כשנים וירח כשלשה לפיכך אם הם שנים מותר ליכנס בה אם היא בריאה וחזקה ועומדת בשדה [פמ"ג]:

(14) 'Because of suspicion' — that they will suspect he has a harlot waiting for him there. And if the ruin stands in a field, there is no concern of suspicion, for a harlot is not commonly found in a field. And likewise, if his wife is with him, there is also no concern of suspicion. And if the ruin is sound and sturdy, there is no concern of collapse. And if two enter it, there is no concern of harmful spirits — for to one [alone the spirit] appears and harms, to two it appears but does not harm, and to three it does not appear at all — except in a place known to be frequented by harmful spirits; and a torch counts like two, and moonlight like three. Therefore, if they are two, it is permitted to enter it, provided it is sound and sturdy and stands in a field (the Pri Megadim).

ולא אחורי ב"ה אם אינו מחזיר פניו לב"ה טוואחורי ב"ה הוא הצד שפתח פתוח בו והוא הפך הצד שפונים אליו טזהקהל כשמתפללים וי"מ יזבהפך וראוי לחוש לדברי יחשניהם וגם כשמתפלל יטבשאר צדדים חוץ לב"ה יש להחמי' כשיחזי' פניו כאלב"ה וכל זה כשניכר שמחזיר אחוריו לב"ה אבל אם הוא מתפלל בבית הסמוך לב"ה ופניו כנגד א"י כראוי ואחוריו לכותל ביתו שהוא כותל ב"ה מותר שאינו ניכר שמחזיר פניו מב"ה:

Nor behind the synagogue, if he does not turn his face toward the synagogue. 'Behind the synagogue' is the side on which the door is open, which is the opposite of the side the congregation faces when they pray. Some explain it the reverse way, and it is proper to be concerned for both views. Also, when one prays on the other sides outside the synagogue, one should be stringent to turn his face toward the synagogue. All this is when it is conspicuous that he is turning his back to the synagogue. But if he is praying in a house adjacent to the synagogue, with his face toward the Land of Israel as is fitting, and his back to the wall of his house, which is [also] the wall of the synagogue, it is permitted, since it is not conspicuous that he is turning his face away from the synagogue.

(טו) אחורי בהכ"נ - בתשובת יד אליהו סימן ז' כתב דנ"ל מה שאמרו גבי המתפלל אחורי בהכ"נ לא שייך אלא דוקא כשהצבור מתפללים תפילת י"ח והוא ג"כ מתפלל י"ח עי"ש ובספר מאמר מרדכי חולק עליו:

(15) 'Behind the synagogue' — in the responsa Yad Eliyahu, siman 7, he wrote that it appears to him the ruling about one who prays behind the synagogue applies only when the congregation is praying the Shemoneh Esrei, and he too is praying the Shemoneh Esrei; see there. But in the sefer Ma'amar Mordechai he disagrees with him.

(טז) הקהל - כלומר דמיירי במתפלל באותו צד שהפתח פתוח שם דהיינו בצד מערב לפיכך אם מחזיר פניו כלפי בהכ"נ נמצא שמתפלל לאותו צד שהצבור מתפללין וע"כ לא נקרא רשע אבל אם מחזיר פניו מבהכ"נ נמצא מתפלל היפך מהצבור שהם מתפללין למזרח והוא למערב וע"כ נקרא רשע שנראה כשתי רשויות ח"ו ולפי פירוש זה אם עומד אחורי בהכ"נ בצד מזרח והופך מבהכ"נ ומתפלל לצד מזרח כמו שהצבור מתפללין ג"כ אינו נקרא רשע:

(16) 'The congregation' — that is, it is speaking of one praying on the same side where the door is open, namely on the west side. Therefore, if he turns his face toward the synagogue, it turns out he is praying toward the same side the congregation prays, and so he is not called wicked. But if he turns his face away from the synagogue, it turns out he is praying opposite the congregation — they pray to the east and he to the west — and so he is called wicked, since it appears as if there are two [divine] authorities, God forbid. And according to this explanation, if he stands behind the synagogue on its east side, turns away from the synagogue, and prays toward the east just as the congregation prays, he is likewise not called wicked.

(יז) בהיפך - הוא דעת ר"י הובא בתוס' שם דמפרש אחורי בהכ"נ היינו אחורי כותל מזרחי שאין שם פתחים וכשעומד אחורי אותו כותל ואחוריו כלפי הכותל אע"פ שפניו כלפי רוח מזרח ונמצא מתפלל לרוח שכל הצבור מתפללין אפ"ה נקרא רשע כי הוא מכלל אותם שנאמר עליהם ואחוריהם אל היכל ד' אבל אם מהדר אפיה לבי כנישתא אע"פ שנמצא שהוא מתפלל כלפי רוח מערב וכל הקהל כנגד רוח מזרח לית לן בה כיון שכל הקהל מתפללין כלפי כותל מזרחי ששם ההיכל והוא פניו ג"כ כלפי אותו הכותל אין לחוש:

(17) 'The reverse way' — this is the view of ר"י, cited in Tosafos there, who explains that 'behind the synagogue' means behind the eastern wall, where there are no doorways. And when he stands behind that wall with his back toward the wall — even though his face is toward the east, so that he turns out to be praying in the same direction the whole congregation prays — even so he is called wicked, for he is among those of whom it is said, 'and their backs were toward the Sanctuary of Hashem.' But if he turns his face toward the synagogue, even though he turns out to be praying toward the west, while the whole congregation faces east, we have no concern with it, since the whole congregation prays toward the eastern wall, where the Ark is, and his face too is toward that same wall — there is nothing to be concerned about.

(יח) שניהם - שלא יתפלל אלא במערב ויחזיר פניו לבהכ"נ ואף דזה מותר לכ"ע מ"מ לא שרי אלא מדוחק הלא"ה מצוה להתפלל בבהכ"נ כמ"ש בסעיף ט':

(18) 'Both [views]' — that he pray only on the west side and turn his face toward the synagogue. And although this is permitted according to all, it is nevertheless permitted only in pressing circumstances; otherwise, it is a mitzvah to pray inside the synagogue, as written in se'if 9.

(יט) בשאר צדדים - דהיינו בצפון או בדרום ומיירי בשאי אפשר לו להפוך פניו למזרח כגון שיש צואה לפניו כמלא עיניו הא לאו הכי עדיף טפי שיהפוך פניו למזרח ומ"מ גם בכל זה לא שרי אלא מדוחק כמש"כ בס"ק הקודם:

(19) 'On the other sides' — namely, on the north or the south, and it speaks of a case where he cannot turn his face to the east — for example, there is excrement before him as far as his eye can see; for otherwise, it is preferable that he turn his face to the east. And nevertheless, even in all this it is permitted only in pressing circumstances, as written in the preceding note.

(כ) שיחזיר פניו - כדי שלא יהיה אחוריו נגד בהכ"נ ואף שאכתי אינו מתפלל לרוח שהצבור מתפללין מ"מ כיון שאינו מתפלל בהיפך לית לן בה וכ"ז כשעומד בצפון בהכ"נ או בדרומו אבל כשעומד במזרחו או במערבו אסור אף אם רוצה להטות עצמו לצפונו או לדרומו:

(20) 'That he turn his face' — so that his back is not toward the synagogue. And even though he is still not praying in the direction the congregation prays, nevertheless, since he is not praying in the opposite direction, we have no concern with it. And all this is when he stands to the north of the synagogue or to its south; but when he stands to its east or its west, it is forbidden, even if he wishes to turn himself toward the north or the south.

ס״ק כאלבהכ"נ

(כא) לבהכ"נ - וה"ה בעזרות הבנויות בכותל מזרחי שרי להתפלל שם דחדר הוא ואין נראה כאחוריו לבית הכנסת וכ"כ השכנה"ג שראה קהלות רבות שעזרותיהם לצד מזרח ומתפללין ופניהם כלפי מזרח ואחוריהם כלפי כותל מזרחי שבבהכ"נ ומ"מ יותר טוב בעת שבונים העזרות לעשותו בצד אחר לא בצד מזרח כי יש מפקפקים בזה עיין בא"ר:

(21) 'Toward the synagogue' — and the same applies to the antechambers built onto the eastern wall — it is permitted to pray there, since it is a [separate] room and does not appear as though his back is to the synagogue. So too wrote the Knesses HaGedolah, who saw many communities whose antechambers are on the eastern side, and they pray with their faces toward the east and their backs toward the eastern wall of the synagogue. Nevertheless, it is better, when building the antechambers, to make them on another side and not on the east side, since some cast doubt on this; see the Eliyah Rabbah.

סעיף ח׳

אסור לעבו' חוץ לב"ה כבבצד שהפתח פתוח בו בשעה כגשהצבור מתפללים מפני שנראה ככופר כיון שאינו נכנס להתפלל ואם נושא משאוי כדאו שלבוש תפילין כהאו שיש ב"ה אחר בעיר או שיש לב"ה זה פתח אחר כו[או שרוכב על הבהמה] מותר [ב"י בשם רי"ו]:

It is forbidden to pass outside the synagogue, on the side where the door is open, at the time the congregation is praying, because he appears like a denier, since he does not enter to pray. But if he is carrying a load, or is wearing tefillin, or there is another synagogue in the city, or this synagogue has another door, (or he is riding on an animal), it is permitted (so the Beis Yosef in the name of רי"ו).

(22) 'On the side where the door...' — see the Biur HaGra (the commentary of the Vilna Gaon).

ס״ק כגשהצבור מתפללים

(כג) שהצבור מתפללים - עיין בפמ"ג שיש להחמיר אפילו בעת ק"ש ופסוקי דזמרה:

(23) 'While the congregation is praying' — see the Pri Megadim, that one should be stringent even at the time of the Shema and Pesukei DeZimra.

ס״ק כדאו שלבוש וכו'

(כד) או שלבוש וכו' - דנראה שעול מלכותו עליו ולא יבואו לחשדו:

(24) 'Or is wearing, etc.' — for it is evident that the yoke of His kingship is upon him, and they will not come to suspect him.

ס״ק כהאו שיש ב"ה וכו'

(כה) או שיש ב"ה וכו' - נ"ל דה"ה אם רגילין בבהכ"נ הזה לעשות כמה מנינים ג"כ שרי דלא יבואו לחשדו:

(25) 'Or there is a synagogue, etc.' — it appears [to me] that the same applies if this synagogue regularly holds several minyanim — it too is permitted, for they will not come to suspect him.

(כו) או שרוכב - שניכר שמפני שהוא טרוד בשמירת הבהמה אינו נכנס:

(26) 'Or he is riding' — for it is evident that it is because he is occupied with guarding the animal that he does not enter.

סעיף ט׳

ישתדל אדם כזלהתפלל בב"ה כחעם הציבור ואם הוא כטאנוס שאינו יכול לבא לב"ה ליכוין להתפלל בשעה שהציבו' מתפללין [וה"ה בני אדם הדרים בישובים ואין להם מנין מ"מ לאיתפללו שחרית וערבית לבבזמן שהצבור מתפללים סמ"ג] וכן אם נאנס ולא התפלל בשעה שהתפללו הציבו' והוא מתפלל ביחיד לגאעפ"כ יתפלל בב"ה:

A person should make an effort to pray in the synagogue with the congregation. And if he is prevented by circumstances beyond his control and cannot come to the synagogue, he should aim to pray at the time the congregation is praying. (And the same applies to people who live in [small] settlements and have no minyan: nevertheless they should pray Shacharis and Maariv at the time the congregation is praying — the Sema"g.) And likewise, if he was prevented and did not pray at the time the congregation prayed, and he is praying alone, even so he should pray in the synagogue.

ס״ק כזלהתפלל בבהכ"נ

(כז) להתפלל בבהכ"נ - ואפילו אם יש לו עשרה בביתו ישתדל בבהכ"נ ועיין בסי"ח במ"ב ס"ק נ"ד:

(27) 'To pray in the synagogue' — even if he has ten [men] in his home, he should make an effort [to pray] in the synagogue; and see se'if 18, in the Mishnah Berurah, note 54.

(כח) עם הצבור - מפני שאין הקב"ה מואס בתפלת הצבור ואפילו היה בהם חוטאים לא ימנע מלהתפלל עמהם. אם יש לו שתי בתי כנסיות ואחד יש בו ברוב עם מצוה להתפלל בו יותר. כתבו האחרונים דאם יש בבהכ"נ של רוב עם רוב בלבול ואין אדם שומע לא תפלה ולא קה"ת מוטב להתפלל בביתו בעשרה. ובהכ"נ ביחיד ובביתו בעשרה תפלת צבור עדיף ואפילו יכול לשמוע קדיש וברכו אפ"ה תפלת צבור עדיף [פמ"ג]. ועיקר תפלה בצבור הוא תפלת י"ח דהיינו שיתפללו עשרה אנשים שהם גדולים ביחד ולא כמו שחושבין ההמון שעיקר להתפלל בעשרה הוא רק לשמוע קדיש וקדושה וברכו ולכן אינם מקפידין רק שיהיו י' בבהכ"נ וזהו טעות ולכן חוב על האדם למהר לבוא לבהכ"נ כדי שיגיע להתפלל י"ח בצבור [ח"א]. מי שהולך בשבת ויו"ט בהשכמה להתפלל במנין עשרה כי רוב צבור מאחרים תפלתם ובאותו מנין מתפללים גם תפלת מוסף תיכף אחר תפלת שחרית ויש זמן אח"כ לילך לבהכ"נ יותר טוב לילך להתפלל מוסף עם הצבור בבהכ"נ דברוב עם הדרת מלך כ"כ בתשובת יד אליהו סימן מ"ב ודוקא אם מקום מיוחד לתפלתו הוא בבהכ"נ אבל אם אין מקומו מיוחד להתפלל בבהכ"נ טוב יותר שיתפלל כל התפלה במקום אחד. כתב בתשובת רדב"ז תפוס שהשר נתן לו רשות יום אחד להתפלל עם הצבור במנין איזה יום שירצה יתפלל אותו יום תיכף ולא יחמיץ המצוה להמתין על יום כיפור או פורים ועיין בח"א כלל ס"ח ובנשמת אדם שהאריך בכמה פרטים שיש בענין זה:

(28) 'With the congregation' — because the Holy One, blessed is He, does not despise the prayer of the congregation, and even if there were sinners among them, He does not refrain from praying with them. If one has two synagogues, and one of them has a larger crowd, it is a greater mitzvah to pray in it. The later authorities wrote that if the synagogue with the larger crowd has much confusion, and no one can hear either the prayer or the Torah reading, it is better to pray at home with ten. But [between] a synagogue alone and his home with ten, communal prayer is preferable; and even if he can hear Kaddish and Barchu, still communal prayer is preferable (the Pri Megadim). And the essence of communal prayer is the Shemoneh Esrei — namely, that ten adult men pray it together, and not as the masses think, that the essence of praying with ten is only to hear Kaddish, Kedushah, and Barchu, and therefore they are only particular that there be ten in the synagogue — and this is a mistake. Therefore it is an obligation upon a person to hurry to come to the synagogue so that he arrive to pray the Shemoneh Esrei with the congregation (the Chayei Adam). One who goes early on Shabbos and Yom Tov to pray in a quorum of ten, because most of the congregation delays its prayer, and in that quorum they also pray Musaf right after Shacharis, and there is time afterward to go to the synagogue — it is better to go and pray Musaf with the congregation in the synagogue, for 'in a multitude of people is the King's glory.' So it is written in the responsa Yad Eliyahu, siman 42. And this is specifically if his designated place of prayer is in the synagogue; but if his place is not designated to pray in the synagogue, it is better that he pray the entire prayer in one place. The responsa Radbaz wrote: [regarding] a captive to whom the official granted permission for one day to pray with the congregation in a quorum, on whichever day he wishes — he should pray on that very day at once, and not let the mitzvah go stale by waiting for Yom Kippur or Purim. And see the Chayei Adam, klal 68, and Nishmas Adam, who elaborated on several details in this matter.

ס״ק כטאנוס

(כט) אנוס - היינו שתש כחו אף שאינו חולה. ואם הוא אונס ממון שמחמת השתדלותו להתפלל עם הצבור יבוא לידי הפסד יכול להתפלל בביתו ביחיד או בבהכ"נ בלא צבור אבל משום מניעת ריוח לא ימנע מלהתפלל עם הצבור דחילוק יש בין מניעת ריוח לבין הפסד מכיסו וכ"כ בשם יעקב והעיד על הגאון מוה' זלמן מירל"ש אב"ד דק"ק האמבורג שפעם אחת הלך לבהכ"נ מעוטף בטלית ותפילין כדרכו ופגע בו אדם אחד שהיה לו למכור אבנים טובות ורצה שילך עמו לביתו והגאון השיב לו שימתין עד שיבוא מבהכנ"ס ובתוך כך מכרן לאחר והאחר הרויח בהם כמה אלפים ר"ט ושמח הגאון שמחה גדולה שהשליך מנגד ממון רב עבור תפלת צבור [מגן גבורים] וכ"כ בספר אליהו רבא בשם תשובת ב"י דיש לקנוס האנשים שמונעים לילך לבהכ"נ משום שעוסקין בתורה או משום שמשתכרין ממון. ולעשירים יש לקנוס יותר ובעל תורה אף שעוסק בלימוד מ"מ איכא חשדא וחילול השם כמש"כ סי"ח:

(29) 'Prevented by circumstances' — that is, that his strength has weakened, even though he is not ill. And if it is a monetary constraint — that through his effort to pray with the congregation he would come to a loss — he may pray at home alone, or in the synagogue without a congregation; but on account of preventing a [potential] profit, he should not refrain from praying with the congregation, for there is a distinction between preventing a profit and an actual loss from his pocket. And so it is written in [the sefer] Shem Yaakov, who testified concerning the Gaon, our teacher R' Zalman Mirels, the Av Beis Din of the holy community of Hamburg, that once he went to the synagogue wrapped in tallis and tefillin as was his way, and a certain man met him who had precious stones to sell and wanted him to come with him to his house, and the Gaon answered him that he should wait until he came out of the synagogue; and in the meantime he sold them to another, and that other profited from them several thousand reichsthaler, and the Gaon rejoiced with great joy that he had cast aside much money for the sake of communal prayer (Magen Gibborim). And so it is written in the sefer Eliyah Rabbah, in the name of the responsa of the Beis Yosef, that one may fine the people who refrain from going to the synagogue because they are occupied with Torah or because they are earning money. And the wealthy should be fined more; and as for a Torah scholar, even though he is occupied with study, nevertheless there is suspicion and a desecration of the [Divine] Name, as written in se'if 18.

ס״ק ליכוין להתפלל וכו'

(ל) יכוין להתפלל וכו' - ודוקא אם טריחא ליה מילתא לאסוף עשרה. משמע בע"א דף ד' ע"ב דאם מתפלל מוסף בשעה שהצבור מתפללין שחרית לא מיקרי בשעה שהצבור מתפללין ואם מתפלל עמהם בבהכנ"ס מיקרי תפלת הצבור:

(30) 'He should aim to pray, etc.' — and this applies specifically when it is troublesome for him to gather ten. It is implied in [tractate] Avodah Zarah, folio 4b, that if one prays Musaf while the congregation is praying Shacharis, it is not deemed 'at the time the congregation prays'; but if he prays together with them in the synagogue, it is deemed communal prayer.

ס״ק לאיתפללו שחרית

(לא) יתפללו שחרית - ובימות הקיץ שהצבור מאחרים תפלת שחרית והדר בישוב אסור אפילו ללמוד כמש"כ סימן פ"ט ס"ו וסימן רל"ב שמא ימשוך בלימודו ויעבור זמן תפלה וא"כ יתבטלו זמן ארוך לכן מוטב שיתפלל תיכף בהנץ החמה ומכ"ש כהיום דבקהלות גדולות מתפללין תיכף משהאיר הבוקר וא"כ לעולם הוא בשעה שהצבור מתפללין:

(31) 'They should pray Shacharis' — and in the summer, when the congregation delays the Shacharis prayer, one who dwells in a settlement is forbidden even to study, as is written in siman 89, se'if 6, and siman 232, lest he be drawn into his study and the time for prayer pass, so that they would remain idle [from prayer] for a long time. Therefore it is better that he pray right away at sunrise; and all the more so nowadays, when in large communities they pray as soon as morning has become light, so that he is always [praying] at the time the congregation prays.

ס״ק לבבזמן שהצבור

(לב) בזמן שהצבור - פי' בשעת שקהלות ישראל מתפללים. ובאשכנז שנהגו להקדים ערבית כמש"כ סימן רל"ה יחיד הדר בכפר או בדרך צריך להמתין עד צאת הכוכבים:

(32) 'At the time the congregation [prays]' — that is, at the time the Jewish communities pray. And in Ashkenaz, where the custom is to pray Maariv early, as written in siman 235, an individual who lives in a village or is traveling must wait until the emergence of the stars.

ס״ק לגאעפ"כ וכו'

(לג) אעפ"כ וכו' - מפני שהוא מקום קבוע לקדושה ותפלתו מתקבלת שם יותר. ופשוט דאם הוא ת"ח ויש חשש חילול השם כשיבוא אחר התפלה בבהכ"נ דיתפלל בביתו:

(33) 'Even so, etc.' — because it is a place established for holiness, and his prayer is accepted there more [readily]. And it is obvious that if he is a Torah scholar, and there is concern for a desecration of [God's] Name if he arrives at the synagogue after the [communal] prayer, he should [rather] pray at home.

סעיף י׳

כשעומד לדעם הציבור אסור לו להלהקדים תפלתו לתפלת ציבור אא"כ לוהשעה עוברת ואין הציבור מתפללים לפי שמאריכים בפיוטים או לסבה אחרת: [אבל בלא שעה עוברת יתפלל הפיוטים והתחינות עם הציבור ולא יפרוש מן הציבור אפי' לעסוק בדברי תורה וע"ל סי' ס"ח]:

When he is standing with the congregation, it is forbidden for him to begin his prayer before the congregation's prayer, unless the time [for prayer] is passing and the congregation is not yet praying, because they are prolonging matters with piyutim (liturgical poems) or for some other reason. (But when the time is not passing, he should recite the piyutim and supplications together with the congregation, and not separate himself from the congregation, even to occupy himself with words of Torah; and see above, siman 68.)

ס״ק לדעם הצבור אסור

(לד) עם הצבור אסור - אע"ג דבסעיף הקודם כתב דאפילו הוא בביתו יכוין לשעה שהצבור מתפללין היינו כדי שתהא תפלתו נשמעת אבל איסורא ליכא אי מקדים לתפילת צבור אבל כשעומד עם הצבור ומקדים איסורא נמי איכא ועיין באורחות חיים שכתב הטעם מפני שהוא כמבזה את הצבור ומשמע בגמרא דאפילו אם הוא רוצה לעשות זה בשביל לימוד התורה כגון שיש לו שיעור קבוע ללמוד תורה אצל אחד. כתב הב"ח דאם צריך הוא למהר תפלתו כגון שיוצא לדרך יצא מבהכ"נ ויתפלל בביתו ואפשר דבשביל לימוד התורה ג"כ מותר לעשות כן וכן משמע בספר מאמר מרדכי אך שם איירי לענין תפילת מוסף ואפשר דה"ה לענין שחרית ועיין לקמן בסי"ח:

(34) 'With the congregation it is forbidden' — although in the previous se'if he wrote that even when at home he should aim for the time the congregation prays — that was so that his prayer be heard [and accepted] — but there is no prohibition if he begins before the communal prayer [while at home]; however, when he is standing with the congregation and begins earlier, there is also a prohibition. And see the Orchos Chaim, who wrote the reason: because it is as if he is slighting the congregation. And it is implied in the Gemara that [this holds] even if he wishes to do so for the sake of Torah study — for example, he has a fixed shiur to learn Torah with someone. The Bach wrote that if he needs to hurry his prayer — for example, he is setting out on a journey — he should leave the synagogue and pray at home. And perhaps for Torah study it is likewise permitted to do so, and so it is implied in the sefer Ma'amar Mordechai, though there it deals with the Musaf prayer, and perhaps the same applies to Shacharis; and see further in se'if 18.

ס״ק להלהקדים תפלתו

(לה) להקדים תפלתו - ואפילו רוצה לצאת חוץ לבהכ"נ כ"כ המ"א בשם הריב"ש אבל בספר מאמר מרדכי כתב דאין מדברי הריב"ש ראיה ומסיק דאין בו איסור דמקדים תפלתו אלא דלאו שפיר עביד דמפסיד מיהא תפלת הצבור:

(35) 'To begin his prayer early' — even if he wishes to step outside the synagogue [it is forbidden] — so wrote the Magen Avraham in the name of the Rivash. But in the sefer Ma'amar Mordechai he wrote that there is no proof from the words of the Rivash, and he concludes that there is no prohibition in beginning his prayer early; rather, he does not act properly, since he thereby forfeits [the merit of] communal prayer.

ס״ק לוהשעה עוברת

(לו) השעה עוברת - משמע דאז אפילו בבהכ"נ שרי וכן מוכח לשון תר"י והב"ח פסק דוקא שהזמן קצר כ"כ שבעוד שילך לביתו יעבור זמן תפלה אבל אם יש זמן ילך לביתו ויתפלל ביחיד ע"ש. איתא בגמרא דאם חלש לבו יכול להתפלל בביתו קודם הצבור ובבהכ"נ אף זה אסור ועיין סימן קי"ד ס"ב דאם הוא חולה או אנוס אף בבהכ"נ שרי כ"כ הב"ח והפרישה שם:

(36) 'The time is passing' — it is implied that then, even in the synagogue, it is permitted; and so is proven from the language of תר"י. But the Bach ruled that [this is] only when the time is so short that by the while he goes home the time for prayer would pass; but if there is time, he should go home and pray alone; see there. It is stated in the Gemara that if his heart is faint (weak), he may pray at home before the congregation; but in the synagogue even this is forbidden. And see siman 114, se'if 2, that if he is ill or under duress, even in the synagogue it is permitted — so wrote the Bach and the Perishah there.

סעיף י״א

מי לזשיש לו בית הכנסת בעירו ואינו נכנס בו להתפלל לחנקרא לטשכן רע וגורם גלות לו ולבניו:

One who has a synagogue in his city and does not enter it to pray is called a 'bad neighbor,' and he brings about exile for himself and his children.

(לז) שיש לו וכו' - ואם יש שתי בתי כנסיות בעיר טוב לילך להרחוקה כי שכר פסיעות יש:

(37) 'One who has, etc.' — and if there are two synagogues in the city, it is good to go to the farther one, for there is reward for [each of] the steps.

(לח) נקרא וכו' - דכן דרך שכנים הרעים שאין נכנסין לבית חביריהם. וע' באחרונים שכתבו שאפילו אין שם מנין עשרה דהא סתמא קתני ובפמ"ג מסתפק בזה. ואם מתפלל בביתו בעשרה בכל גווני אינו נקרא שכן רע דכל בי עשרה שכינתא שריא ומיהו עכ"פ מידי חובת בהכ"נ לא נפיק אא"כ אותו המקום שמתפללין בו קבוע לקדושה:

(38) 'Is called, etc.' — for such is the way of bad neighbors, who do not enter their fellows' homes. And see the later authorities who wrote that [he is a 'bad neighbor'] even where there is no minyan of ten, since [the ruling] is stated without qualification; and the Pri Megadim is in doubt about this. And if he prays at home with ten, in any case he is not called a 'bad neighbor,' for in any [gathering of] ten the Divine Presence rests. However, in any event he does not thereby fulfill the obligation of [praying in] a synagogue, unless the place where they pray is established for holiness.

ס״ק לטשכן רע וכו'

(לט) שכן רע וכו' - דכתיב כה אמר ה' על כל שכיני הרעים וגו' הנני נותשם מעל אדמתם. וכל המשכים ומעריב לבהכ"נ זוכה לאריכת ימים שנאמר אשרי אדם שומע לי לשקוד על דלתותי יום יום וכתיב אחריו כי מוצאי מצא חיים וגו':

(39) 'A bad neighbor, etc.' — as it is written, 'Thus says Hashem concerning all My evil neighbors... behold, I will uproot them from upon their land.' And whoever comes early and stays late at the synagogue merits length of days, as it says, 'Fortunate is the one who listens to Me, to be diligent at My doors day by day,' and it is written afterward, 'for whoever finds Me has found life...'

סעיף י״ב

ממצוה מאלרוץ כשהולך לב"ה וכן לכל דבר מצוה אפי' מבבשבת שאסו' לפסוע פסיעה גסה אבל כשיוצא מבית הכנסת מגאסור לרוץ:

It is a mitzvah to run when going to the synagogue, and likewise for any matter of a mitzvah, even on Shabbos, when it is forbidden to take a large stride. But when he leaves the synagogue, it is forbidden to run.

ס״ק ממצוה וכו'

(מ) מצוה וכו' - שנאמר ונדעה נרדפה לדעת את ה' וגו' ומזה נלמוד דכ"ש שיש ליזהר אז שלא לעמוד באמצע הדרך להסיח עם חבירו באיזה חפצי עצמו כי עי"ז מצוי שבא אחר ברכו וקדושה. ועיין בפרישה שכתב דעיקר הריצה יהיה כשבא סמוך לבהכ"נ דשם מינכר הוא שעושה לשם מצות בהכ"נ וכתב הפמ"ג דבשחרית שהולך עם טלית ותפילין בידו תמיד מינכר הוא ומ"מ ברחוב עכו"ם לא ירוץ:

(40) 'It is a mitzvah, etc.' — as it says, 'Let us know, let us pursue to know Hashem...' And from this we learn that all the more so one should be careful then not to stand in the middle of the road to converse with his fellow about his own affairs, for thereby it often happens that he arrives after Barchu and Kedushah. And see the Perishah, who wrote that the main [obligation of] running is when he draws near to the synagogue, for there it is evident that he is doing it for the sake of the mitzvah of [going to] the synagogue. And the Pri Megadim wrote that at Shacharis, when he goes with his tallis and tefillin in hand, it is always evident; nevertheless, in a street of gentiles he should not run.

ס״ק מאלרוץ

(מא) לרוץ - עד פתח בהכ"נ ובבהכ"נ עצמה אסור לרוץ אלא ילך באימה:

(41) 'To run' — [this applies] up to the entrance of the synagogue; but within the synagogue itself it is forbidden to run — rather, he should walk with awe.

ס״ק מבבשבת שאסור

(מב) בשבת שאסור - ואף בחול נוטל אחד מת"ק ממאור עיניו של אדם ועיין בפמ"ג:

(42) 'On Shabbos, when it is forbidden' — and even on a weekday, [taking a large stride] removes one five-hundredth of a person's eyesight; and see the Pri Megadim.

ס״ק מגאסור לרוץ

(מג) אסור לרוץ - ולא לפסוע פסיעה גסה לפי שמראה עצמו שעיכוב בהכ"נ דומה עליו כמשאוי בד"א כשהולך לעסקיו אבל אם יוצא ע"מ לחזור מצוה לרוץ כדי לחזור מהר וכן אם יוצא מבהכ"נ לבית המדרש כדי ללמוד תורה:

(43) 'It is forbidden to run' — and also not to take a large stride, because he shows himself that lingering at the synagogue is like a burden to him. In what case is this said? When he is going out to his affairs; but if he leaves intending to return, it is a mitzvah to run, so as to return quickly, and likewise if he leaves the synagogue for the study hall in order to study Torah.

סעיף י״ג

מותר מדלרוק בבית הכנסת מהודורסו ברגלו או מומכסהו בגמי:

It is permitted to spit in the synagogue, and he treads on it with his foot or covers it with rushes.

ס״ק מדלרוק בבהכ"נ

(מד) לרוק בבהכ"נ - פי' שלא בשעת תפילת י"ח אלא כגון ק"ש וברכותיה אבל בתפלת י"ח אסור לרוק כדלקמן סימן צ"ז ס"ב עי"ש:

(44) 'To spit in the synagogue' — that is, not during the Shemoneh Esrei, but rather [at times] such as the Shema and its blessings; but during the Shemoneh Esrei it is forbidden to spit, as [stated] further in siman 97, se'if 2; see there.

ס״ק מהודורסו ברגליו

(מה) ודורסו ברגליו - שלא יהיה מגולה מפני הכבוד והרוצה שלא ירוק תדיר בבהכ"נ ילעוס קודם כניסתו שורש מתוק שקורין לאקעריץ (ואף בבוקר שרי דלא שייך בזה גאוה וגם אין מכניס לגופו) אבל בעיה"כ ובעט"ב אסור שישאר המתיקות בפיו וכשבולע הרוק בולע המתיקות:

(45) 'And treads on it with his feet' — so that it not remain exposed, out of respect [for the synagogue]. And one who wishes not to spit constantly in the synagogue should chew, before entering, a sweet root called licorice (and even in the morning this is permitted, since there is no matter of vanity in it, and he is also not taking [food] into his body [before praying]), but on the eve of Yom Kippur and the eve of Tishah B'Av it is forbidden, for the sweetness would remain in his mouth, and when he swallows his saliva he swallows the sweetness.

ס״ק מומכסהו בגמי

(מו) מכסהו בגמי - ר"ל שאם יש תבן או גמי בבהכ"נ רוקק עליו וא"צ לשפשף שהרקיקה מכוסה בגמי:

(46) 'He covers it with rushes' — that is to say, that if there is straw or rushes in the synagogue, he spits on it and need not rub it out, since the spittle is covered by the rushes.

סעיף י״ד

ישכים אדם לב"ה מזכדי שימנה עם הי' הראשונים:

A person should rise early [to go] to the synagogue, so that he will be counted among the first ten.

ס״ק מזכדי שימנה וכו'

(מז) כדי שימנה וכו' - ודוקא שיתפלל שם עמהם והאר"י לא היה מן הראשונים כי הוצרך לפנות שהיה לו חולי וגם כדי שילך מעוטף בטלית ותפילין לבהכ"נ וזה אי אפשר קודם היום ובזוהר נשא איתא שיתאספו עשרה ביחד ויבואו לבהכ"נ:

(47) 'So that he will be counted, etc.' — and specifically that he pray there together with them. And the Arizal was not [always] among the first [ten], because he needed to relieve himself, for he had an illness, and also so that he go wrapped in tallis and tefillin to the synagogue, and this is impossible before daybreak. And in the Zohar, [parshas] Naso, it is stated that ten should gather together and come to the synagogue [as one].

סעיף ט״ו

אם נשאר אדם יחידי מתפלל בבה"כ שבשדות או אפילו בב"ה שבעיר אם היא תפלת ערבית (שמתפללין בלילה) חייב חבירו למחהמתין לו עד שיסיים תפלתו כדי שלא יתבלבל בתפלתו (ויש מחמירין אפי' ביום ובב"ה שלנו שהם בעיר) (הטור ומרדכי בשם ר"י והר"י פ"ק דברכות) ואם מאריך בבקשות ותחנונים אינו חייב להמתין לו:

If a person is left alone praying in a synagogue that is out in the fields, or even in a synagogue in the city, if it is the evening prayer (which is recited at night), his fellow is obligated to wait for him until he finishes his prayer, so that he not become confused in his prayer (out of fear of being left alone). The Rema adds: Some are stringent even by day, and in our synagogues, which are in the city. (The Tur and the Mordechai in the name of ר"י and the הר"י, first chapter of Berachos.) But if he prolongs with requests and supplications, [his fellow] is not obligated to wait for him.

ס״ק מחלהמתין

(מח) להמתין - דוקא אם נכנסו בשוה אבל אם נכנס יחידי בשעה שלא יוכל לסיים עמהם תפלתו אין חייב להמתין לו דכיון שרואה שלא יוכל לסיים עמהם ונכנס איגלאי מילתא שאינו מפחד אם נשאר יחידי מיהו מדת חסידות הוא להמתין אף בכה"ג:

(48) 'To wait' — specifically if they entered at the same time; but if he entered alone at a time when he could not finish his prayer together with them, [his fellow] is not obligated to wait for him, for since he sees that he cannot finish together with them yet still entered, it becomes evident that he is not afraid of being left alone. However, it is a trait of piety to wait even in such a case.

סעיף ט״ז

ההולך בדרך והגיע לעיר מטורוצה ללון בה נאם לפניו עד ד' מילין מקום שמתפללים בי' צריך נאלילך שם נבולאחריו צריך לחזור עד מיל כדי להתפלל בי':

One who is traveling on the road and reaches a city and wishes to lodge there: if ahead of him, within four mil, there is a place where they pray with a [minyan of] ten, he must go there; and behind him, he must go back up to one mil in order to pray with ten.

ס״ק מטורוצה ללון בה

(מט) ורוצה ללון בה - ה"ה בבוקר אם בדרך ההולכת לפניו בד' מילין יש מקום שמתפללין בעשרה ימתין עד שיגיע שם והוא שעי"ז לא יעבור זמן ק"ש ותפלה:

(49) 'And wishes to lodge there' — the same applies in the morning: if on the road ahead of him, within four mil, there is a place where they pray with ten, he should wait until he reaches there, provided that thereby the time for Shema and prayer will not pass.

ס״ק נאם לפניו

(נ) אם לפניו - דוקא בדרך ההולכת לפניו שבלא"ה יצטרך לבסוף לילך שם אבל בצדדין דינו כמלאחריו:

(50) 'If it is ahead of him' — specifically on the road going ahead of him, where he would in any case ultimately need to travel there; but for places to the sides, its law is like that of [a place] behind him.

(נא) לילך שם - ובאופן שלא יצטרך לילך יחידי עי"ז וגם מיירי שעוד היום גדול שאפילו אם ילך עד שם יוכל להגיע שם בעוד השמש על הארץ דאל"ה אינו מחוייב דלעולם יכנס אדם בכי טוב. ועיין בפמ"ג שכ' דבדרך אם נזדמן לו עשרה להתפלל מנחה אחר חצי שעה שאחר חצות רשאי אע"ג דבלא"ה אין כדאי לכתחילה כדאיתא בסימן רל"ג כאן מותר:

(51) 'To go there' — and in a manner that he will not thereby need to travel alone; and it also speaks of when the day is still long, so that even if he goes all the way there, he can arrive while the sun is still over the land; for otherwise he is not obligated, since a person should always enter [a town] 'while it is yet good' (in daylight). And see the Pri Megadim, who wrote that on the road, if ten happen to be available to him to pray Minchah after the half-hour that follows midday, he is permitted, even though otherwise it would not be proper to do so at the outset, as stated in siman 233 — here it is permitted.

ס״ק נבולאחריו וכו'

(נב) ולאחריו וכו' - עיין בס"ק הקודם והיושב בביתו דינו כמלאחריו ע"כ הדר בישוב תוך מיל למקום שמתפללין בעשרה צריך לילך בכל יום בבוקר להתפלל בעשרה אבל לא בערב כי א"צ לילך בלילה בדרך בשביל מנין וזה הסעיף הוא תוכחת מגולה לאותן האנשים שהם בעיר ומתעצלים לילך לבהכ"נ להתפלל מנחה ומעריב:

(52) 'And behind him, etc.' — see the preceding note. And one who is sitting at home, his law is like that of [a place] behind him. Therefore, one who lives in a settlement within a mil of a place where they pray with ten must go every day in the morning to pray with ten, but not in the evening, for he need not travel by night on the road for the sake of a minyan. And this se'if is an open rebuke to those people who are in the city yet are lazy about going to the synagogue to pray Minchah and Maariv.

סעיף י״ז

יש מי שאומר שמכ"ש שלא ישכים אדם נגלילך מעיר שמתפללים בה בי' אם יכול לבא למחוז חפצו בעוד היום גדול נדושלא יהא צריך ללכת יחידי אחר התפל':

There is one who says that all the more so a person should not set out early to leave a city where they pray with ten, if he can reach his destination while the day is still long, and so that he will not need to travel alone after the prayer.

ס״ק נגלילך מעיר וכו'

(נג) לילך מעיר וכו' - מיירי בהולך לדבר רשות ועיין בפמ"ג שהקשה דכאן משמע דוקא אם עי"ז יתבטל אצלו תפלה בצבור ובל"ז שרי הא בלא"ה אסור לצאת לדרך קודם תפלת ח"י כדלעיל בסי' פ"ט ס"ג אך לפי מה שכתב הרמ"א שם בהג"ה ניחא דמיירי שאמר הברכות שקודם התפלה ואפ"ה אסר כאן משום ביטול תפלה בצבור:

(53) 'To leave a city, etc.' — it speaks of one who is going for an optional (non-mitzvah) matter. And see the Pri Megadim, who raised a difficulty: here it is implied [it is forbidden] only if thereby he would miss communal prayer, but otherwise it would be permitted — yet in any case it is [already] forbidden to set out on the road before the Shemoneh Esrei prayer, as above in siman 89, se'if 3! But according to what the Rema wrote there in his gloss, it is resolved: it speaks of a case where he [already] recited the blessings that precede the prayer, and even so [the Mechaber] forbade it here, because of missing communal prayer.

ס״ק נדושלא יהא וכו'

(נד) ושלא יהא וכו' - הא אם יש לו עתה שיירא ואינו רוצה להמתין עליו מותר:

(54) 'And so that he will not, etc.' — for if he now has a caravan [to travel with], and it does not wish to wait for him, it is permitted [to set out early].

סעיף י״ח

בית המדרש קבוע קדוש יותר מבית הכנסת ומצוה להתפלל בו יותר מבית הכנסת נהוהוא שיתפלל בי': [ הגה וי"א דאפילו בלא י' עדיף להתפלל בבית המדרש הקבוע לו ודוקא מי שתורתו אומנתו נוואינו מתבטל בלאו הכי] [תר"י פרק קמא דברכות] ואפי' הכי לא ירגיל עצמו לעשות כן נזשלא ילמדו עמי הארץ ממנו ויתבטלו מב"ה [תשובת הרא"ש כלל ד' והטור] וכ"ש שלא יעסוק בתורה בב"ה נחבזמן שהצבור אומרים סליחות ותחינות [הגהות אלפסי החדשים]:

A permanent study hall (beis midrash) is holier than a synagogue, and it is a greater mitzvah to pray in it than in a synagogue — provided that he prays there with ten. The Rema adds: And some say that even without ten it is preferable to pray in the study hall that is fixed for him, and specifically one whose Torah is his occupation and who would not, in any case, be idled [from learning by praying there]. (תר"י, first chapter of Berachos.) Even so, he should not make a habit of doing this, so that the unlearned not learn from him and neglect the synagogue. (the Responsa of the Rosh, klal 4, and the Tur.) And all the more so he should not engage in Torah study in the synagogue while the congregation is reciting selichos and supplications. (the new glosses on the Alfasi.)

ס״ק נהוהוא שיתפלל בי'

(נה) והוא שיתפלל בי' - ואפילו אם בבהכ"נ איכא רוב עם הדרת מלך מ"מ בה"מ עדיף וה"מ למי שלומד בו וכדי שלא יבטל מלימודו לילך לבהכ"נ הא בלא"ה רוב עם עדיף כ"כ הפמ"ג ונראה פשוט דזה דוקא בבה"מ שקבוע ליחיד ללימוד דלא קבוע קדושתו כ"כ וכדמשמע ממ"א בסימן קנ"ג ס"א דבזה איירינן הכא אבל בה"מ שקבוע לרבים ללימוד התורה בוודאי קדושתו חמורה יותר מבהכ"נ ומוטב להתפלל בו בעשרה יותר מבהכ"נ שיש בו רוב עם אפילו מי שאינו לומד בו כלל וכדאיתא בגמרא דאוהב ה' שערים המצויינים בהלכה יותר מבתי כנסיות וכו' וכן משמע מכמה אחרונים:

(55) 'Provided that he prays with ten' — even if in the synagogue there is a large gathering — 'in a multitude of people is the King's glory' — nevertheless the study hall is preferable. But this applies to one who studies in it, [so that] he not interrupt his study to go to the synagogue; for otherwise a large gathering is preferable. So wrote the Pri Megadim. And it appears obvious that this refers specifically to a study hall fixed for an individual's study, whose holiness is not so firmly established, as is implied from the Magen Avraham in siman 153, se'if 1, that this is what we are speaking of here. But a study hall established for the public's Torah study — its holiness is certainly weightier than a synagogue, and it is better to pray in it with ten than in a synagogue that has a large gathering — even for one who does not study in it at all — as it is stated in the Gemara that Hashem loves the gates distinguished in halachah more than synagogues, etc.; and so it is implied by several later authorities.

ס״ק נוואינו מתבטל וכו'

(נו) ואינו מתבטל וכו' - ר"ל כ"א לדברים הכרחים לצרכי גופו ולימודו ע"כ אין לו ללכת לבהכ"נ אפילו אם אין שם עשרה מפני שמבטל מלימודו בשעת הליכתו ועיין בביאור הגר"א שכתב דבאופן זה שתורתו אומנתו אפילו לדעה הראשונה לא בעינן עשרה וכ"ש בלומד תורה ברבים עם תלמידים שאין לו לבטל מלימודו לילך לבי כנישתא:

(56) 'And is not idled, etc.' — that is to say, [he is idled] only for matters essential to his bodily needs and his study; therefore he should not go to the synagogue even if there are not ten there, because he would be idled from his study during the time of his going. And see the Biur HaGra, who wrote that in such a case, where his Torah is his occupation, even according to the first opinion we do not require ten; and all the more so for one who studies Torah publicly with students — he should not interrupt his study to go to the synagogue.

ס״ק נזשלא ילמדו וכו'

(נז) שלא ילמדו וכו' - כי לא ידינוהו לכף זכות לתלות בתורתו שבשביל לימודו הוא מתפלל ביחיד רק יאמרו שאינו חושש בתפלה וידונו ק"ו על עצמם ולא יחושו כלל לתפלה:

(57) 'So that they not learn, etc.' — for they will not judge him favorably, attributing it to his Torah — that it is because of his study that he prays alone; rather, they will say that he simply does not care about prayer, and they will reason 'all the more so' with regard to themselves, and not care at all about prayer.

ס״ק נחבזמן שהצבור

(נח) בזמן שהצבור - וכן בשעת קה"ת עיין סי' קמ"ו. כתב בספר מאמר מרדכי דאם הוא כבר התפלל ואינו עומד שם אלא לענות הקדישים והקדושות מאותם שפורסים על שמע או שחוזרים כל התפלה עוסק בתורה ואינו חושש וכן מוכח מלשון הג"ה דמיירי דוקא בענין שפורש מן הצבור וכו' עי"ש:

(58) 'While the congregation [prays]' — and likewise during the reading of the Torah; see siman 146. The sefer Ma'amar Mordechai wrote that if he has already prayed and is standing there only to answer the Kaddishes and Kedushos of those who lead 'Poreis al Shema' or who repeat the entire prayer, he may engage in Torah study and need not be concerned; and so is proven from the language of the gloss, that it speaks specifically of a case where he separates himself from the congregation, etc. See there.

סעיף י״ט

נטיקבע מקום לתפלתו שלא ישנהו אם לא לצורך ואין די במה שיקבע לו ב"ה להתפלל אלא גם בב"ה שקבוע בה צריך שיהיה לו סמקום קבוע:

One should fix a set place for his prayer, and not change it unless out of need. And it is not enough that he fixes a synagogue for himself to pray in; rather, even within the synagogue in which he is settled, he must have a fixed place.

ס״ק נטיקבע מקום

(נט) יקבע מקום - שכן מצינו בא"א שקבע מקום לתפילתו כדכתיב וישכם אברהם בבוקר אל המקום אשר עמד שם את פני ד' וגו'. וגם כשמתפלל בביתו יקבע מקום שלא יבלבלוהו בני הבית:

(59) 'He should fix a place' — for so we find with Avraham Avinu, that he fixed a place for his prayer, as it is written, 'And Avraham arose early in the morning to the place where he had stood before Hashem...' And also when he prays at home, he should fix a place, so that the members of the household not disturb him.

(ס) מקום קבוע - ותוך ד"א חשוב מקום אחד דא"א לצמצם:

(60) 'A fixed place' — and within four cubits is considered one [and the same] place, since one cannot be exact [to the precise spot].

סעיף כ׳

יכנס סאשיעור שני פתחים ואחר כך יתפלל. י"מ שיעור שני פתחים דהיינו ח' טפחים יכנס לפנים שלא ישב אצל הפתח שנראה כמשאו ישיבת ב"ה ולפי זה אם יש לו מקום מיוחד אצל הפתח אין בכך כלום וי"מ שהטעם מפני שמביט לחוץ ואינו יכול לכוין ולפי זה אם אינו פתוח לרשות הרבים אין בכך כלום וי"מ שלא ימהר להתפלל מיד כשנכנס אלא סבישהה שיעור שני פתחים ונכון לחוש לכל הפירושים:

He should enter the distance of two doorways, and only then pray. Some explain 'the distance of two doorways,' namely eight handbreadths, means he should move inward and not sit right by the door, which would look as though he regards sitting in the synagogue as a burden. According to this, if he has a designated place by the door, there is nothing wrong with it. Others explain the reason is that he looks outside and cannot concentrate; and according to this, if [the door] does not open onto a public thoroughfare, there is nothing wrong with it. And others explain that he should not rush to pray immediately upon entering, but should wait the interval of two doorways. And it is proper to take all these interpretations into account.

ס״ק סאשיעור שני פתחים

(סא) שיעור שני פתחים - עיין בב"ח שכתב שצריך לעשות עזרה לפני בהכ"נ דוגמת האולם שהיה לפני ההיכל והאריך לפרש בזה המאמר דשיעור שני פתחים וכ"כ המ"א וכן נהגו כהיום בכל מקום וע"כ טוב להדר לכתחילה שלא להתפלל בעזרה כ"א בבהכ"נ:

(61) 'The distance of two doorways' — see the Bach, who wrote that one should make an antechamber before the synagogue, similar to the Ulam (entrance hall) that stood before the Sanctuary, and he explained at length the statement 'the distance of two doorways' in this light. So too wrote the Magen Avraham, and such is the custom nowadays everywhere. Therefore it is good to be scrupulous, at the outset, not to pray in the antechamber, but rather in the synagogue [proper].

ס״ק סבישהה שיעור וכו'

(סב) ישהה שיעור וכו' - כדי שתתיישב דעתו עליו ויתפלל בכונה כי כשיתפלל תיכף בכניסתו פתאום אין דעתו מיושבת עליו. מכבדין בפתח בהכ"נ שיכנס הגדול תחלה הואיל וראוי למזוזה:

(62) 'He should wait the interval, etc.' — so that his mind settle upon him and he pray with concentration, for when he prays immediately upon entering, suddenly, his mind is not settled upon him. At the doorway of the synagogue, honor is given that the greater person enter first, since [the doorway] is fit for a mezuzah.

סעיף כ״א

צריך סגשלא יהא דבר חוצץ סדבינו ובין הקיר ודבר קבוע כגון ארון סהותיבה אינם חוצצים ולא חשיב חציצה סורק בדבר גדול שגבהו י' סזורחבו ד' אבל דבר קטן סחלא חשיב הפסק [אבודרהם ואורחות חיים בשם הראב"ד] וכן בעלי חיים אינם חוצצים אפי' אדם אינו חוצץ: הגה ולי נראה דבעלי חיים חוצצים ואדם אינו חוצץ וכן נראה סברת הפוסקים ואפשר נפל טעות בספרים:

One should ensure that nothing forms a barrier between him and the wall. A fixed object, such as the ark or the reading table, does not form a barrier; and it is only considered an interposition with a large object whose height is ten [handbreadths] and width is four. But a small object is not considered a separation. (the Abudraham and the Orchos Chaim in the name of the Ra'avad.) And likewise, living creatures do not form a barrier — even a person does not form a barrier. The Rema adds: But it appears to me that living creatures do form a barrier, whereas a person does not, and so appears the reasoning of the decisors; it is possible an error crept into the [printed] texts.

ס״ק סגשלא יהא דבר חוצץ

(סג) שלא יהא דבר חוצץ - שנאמר ויסב חזקיהו פניו אל הקיר ויתפלל ומ"מ אין זה אלא למצוה מן המובחר ולית ביה איסורא כשצריך לכך מצד דוחק המקום ע"כ אם א"א בקלות להתפלל בע"א כגון לפעמים שמתפללין בעשרה באיזה חדר וא"א לכל אדם לעמוד בלי חציצה לכותל אל יעכב התפילה בשביל זה לילך לחדר אחר להתפלל ומ"מ יעצים עיניו או יתפלל מתוך הסידור ולא יביט לחוץ כדי שלא יבוא לידי ביטול כונה ע"י דבר החוצץ שלפניו:

(63) 'That nothing form a barrier' — as it says, 'And Chizkiyahu turned his face to the wall and prayed.' Nevertheless, this is only a preferred way of doing the mitzvah, and there is no prohibition in it when needed due to lack of space. Therefore, if it is not easily possible to pray otherwise — for example, when they sometimes pray with ten in some [small] room, and it is impossible for everyone to stand without an interposition to the wall — he should not hold up the prayer on account of this to go to another room to pray. Nevertheless, he should close his eyes or pray from the siddur and not look outside, so that he not come to a lapse of concentration on account of the interposing object before him.

ס״ק סדבינו ובין הקיר

(סד) בינו ובין הקיר - ואפילו אם הוא רחוק מן הקיר שעומד באמצע בהכ"נ ג"כ יש ליזהר שלא יחוץ בינו לקיר והפמ"ג מצדד לומר דאם החציצה הוא חוץ לד"א ממנו רשות אחרת היא ושרי וכן פסק המגן גבורים:

(64) 'Between him and the wall' — even if he is far from the wall, standing in the middle of the synagogue, one should likewise be careful that nothing interpose between him and the wall. And the Pri Megadim inclines to say that if the interposing object is beyond four cubits from him, it is a separate domain and is permitted; and so ruled the Magen Gibborim.

ס״ק סהותיבה

(סה) ותיבה - ומטות שלנו העשויות לשכיבה ואין דרך לטלטלן ממקום למקום נקראות דבר קבוע ואינם חוצצות ויש חולקין וטוב להחמיר בדאפשר:

(65) 'And the reading table' — and our beds, which are made for lying on and are not customarily moved from place to place, are called a fixed object and do not form a barrier. But some disagree, and it is good to be stringent where possible.

ס״ק סורק בדבר גדול

(סו) רק בדבר גדול - עיין בט"ז דכל דבר שהוא צורך תפלה אפילו הוא גדול הרבה אינו חשוב הפסק כגון השולחן שבבית שמניחין עליו הסידור ולכן נהגו בבה"כ שיש לפני כל אחד שולחן קטן [שקורין שטענדער] שמניחין עליו הסידורים אע"פ שגבוה עשרה ורוחב ד' וכ"כ שארי אחרונים:

(66) 'Only with a large object' — see the Taz, that any object which is a need of the prayer, even if it is very large, is not considered a separation — for example, the table in the house on which one places the siddur. And therefore the custom in the synagogue is that before each person there is a small table (called a shtender) on which the siddurim are placed, even though it is ten [handbreadths] high and four wide; and so too wrote the other later authorities.

ס״ק סזורחבו ד'

(סז) ורחבו ד' - אפילו אם אינו רחב ד' רק למעלה ולא למטה:

(67) 'And its width is four' — even if it is four wide only at the top and not at the bottom.

ס״ק סחלא חשיב הפסק

(סח) לא חשיב הפסק - והפר"ח חולק וכן בספר מאמר מרדכי כתב דמדברי תשובת הרמב"ם שהובא בב"י לא משמע הכי ומ"מ ספסלים שבבה"כ לכו"ע לא חשיב הפסק דקבועים הם עי"ש בפר"ח:

(68) 'Is not considered a separation' — but the Pri Chadash disagrees, and likewise the sefer Ma'amar Mordechai wrote that from the words of the Rambam's responsum, cited in the Beis Yosef, it does not appear so. Nevertheless, the benches in the synagogue, according to all opinions, are not considered a separation, since they are fixed; see there in the Pri Chadash.

סעיף כ״ב

ויש מי שאומר סטשיש ליזהר מלהתפלל אחורי שום אדם וטוב לחוש לדבריו:

And there is one who says that one should be careful not to pray behind any person, and it is good to heed his words.

(סט) שיש ליזהר מלהתפלל - כתב בספר מאמר מרדכי לכאורה יש לדקדק בזה דא"א ליזהר בזה דאיך אפשר שיהיו כל העם העומדים בבהכ"נ נגד הכותל בלא הפסקת אדם לכן נראה דאף להי"א לא הוי הפסק גמור שיהא אסור לכל אדם אלא זהירות בעלמא שיש ליזהר בדאפשר ובבה"כ וכיוצא בו דא"א בענין אחר פשיטא דמותר לכתחלה להתפלל אחורי אדם אלא שהמדקדק במעשיו יראה שיהיה לו מקום קבוע נגד הכותל עכ"ל:

(69) 'That one should be careful not to pray [behind]' — the sefer Ma'amar Mordechai wrote: seemingly there is a difficulty to raise here, that it is impossible to be careful about this — for how could all the people standing in the synagogue be against the wall without any person interposing? Therefore it appears that even according to the 'some say,' it is not a complete separation that would be forbidden to everyone, but merely a matter of caution that one should heed where possible; and in a synagogue and the like, where it is not possible otherwise, it is obvious that it is permitted at the outset to pray behind a person, except that one who is scrupulous in his deeds should see to it that he have a fixed place against the wall. End of quote.

הבגדים המצויירים אע"פ שאינ' בולטת עאין נכון להתפלל כנגדם ואם יקרה לו להתפלל כנגד בגד או כותל מצויר יעלים עיניו: הגה ולכן אסור גם כן לצור צעאיורים בספרים שמתפללים בהם שלא תתבטל הכוונה [מרדכי ריש פרק כל הצלמים] אבל בגדים שמצוייר עליהם דברי תפלות אעבפי' לישב עליהם בב"ה אסור [תשובת הרא"ש סימן ב' כלל ה']:

Garments that have designs, even if they are not raised (embossed), it is not proper to pray facing them. And if it happens that he prays facing a decorated garment or a decorated wall, he should avert his eyes. The Rema adds: Therefore it is likewise forbidden to draw designs in the books from which people pray, so that concentration not be disrupted. (the Mordechai, beginning of the chapter Kol HaTzelamim.) But garments on which frivolous or lewd matters are depicted — it is forbidden even to sit on them in the synagogue. (the Responsa of the Rosh, siman 2, klal 5.)

ס״ק עאין נכון וכו'

(ע) אין נכון וכו' - שלא יהא מביט בציורם ולא יכוין בתפילתו אבל משום חציצה לית בבגדים ולכן אם אין מצוירים ותלוים על הכותל שרי להתפלל נגדם:

(70) 'It is not proper, etc.' — so that he not gaze at their designs and fail to concentrate in his prayer; but there is no issue of interposition with garments. Therefore, if they are not decorated and are hanging on the wall, it is permitted to pray facing them.

ס״ק עאציורים בספרים וכו'

(עא) ציורים בספרים וכו' - וכן יש ליזהר מטעם זה שלא לצייר בכותל בה"כ ציורים נגד פניו של אדם אלא למעלה מקומת איש. אסור להתפלל כנגד המראה דמיחזי כמשתחוה לבבואה שלו והיינו אף בעינים סתומות דבפתוחות בלא"ה אסור משום ביטול כונה. אחרונים:

(71) 'Designs in books, etc.' — And likewise one should be careful, for this reason, not to draw designs on the synagogue wall opposite a person's face, but rather above a man's height. It is forbidden to pray facing a mirror, since it appears as if he is bowing to his own reflection; and this is so even with closed eyes, for with open eyes it is forbidden in any case, because of the loss of concentration. [So write] the later authorities.

ס״ק עבאפילו לישב עליהם וכו'

(עב) אפילו לישב עליהם וכו' - שנאמר ולא תביא תועבה אל ביתך ואפילו בביתו אסור:

(72) 'Even to sit on them, etc.' — as it says, 'And you shall not bring an abomination into your house'; and even in his own home it is forbidden.

סעיף כ״ד

לא יתפלל עגבצד רבו עדולא אחורי רבו עהולא לפניו [יש אומרים דכל זה לא מיירי אלא להתפלל ביחיד אבל בצבור אם כך הוא סדר ישיבתו עואין לחוש אם מתפלל לפניו או אחוריו [ב"י בשם מהרי"א ואוהל מועד] ואע"פ עזשטוב להחמיר עחהמנהג להקל אם הרחיק עטד' אמות מותר פועיין ביורה דעה סימן רמ"ב סעיף ט"ז:

One should not pray at the side of his teacher, nor behind his teacher, nor in front of him. Some say that all this applies only to praying alone, but with a congregation, if such is the arrangement of the seating, there is no concern if he prays in front of him or behind him. (the Beis Yosef in the name of the Mahari"a and the Ohel Mo'ed.) And although it is good to be stringent, the custom is to be lenient: if he distanced himself four cubits, it is permitted. And see Yoreh De'ah, siman 242, se'if 16.

ס״ק עגבצד רבו

(עג) בצד רבו - כי הוא יוהרא שמראה שהוא שוה לרבו ורבו היינו שרוב חכמתו הימנו או גדול הדור. כתב הח"א נ"ל דה"ה אביו:
