All those who are ritually impure (tamei) may read from the Torah, recite the Shema, and pray. The one exception is a baal keri (a man who has had a seminal emission), whom Ezra removed from the general category of the impure. He forbade such a person to engage in words of Torah, to recite the Shema, or to pray, until he immerses in a mikveh. This was so that Torah scholars would not be found constantly with their wives, like roosters. Afterwards they annulled that enactment and restored the matter to the baseline law, according to which even a baal keri is permitted in words of Torah, in the Shema, and in prayer, without immersion and without the washing of nine kavin of water. And so the custom has spread. The Rema adds: Some have written that a niddah woman, during the days she sees blood, should not enter the synagogue, nor pray, nor mention God's Name, nor touch a sacred book. [Hagahos Maimoni, ch. 4] But others say she is permitted in all of these, and this is the essential view. [Rashi, Hilchos Niddah] However, the custom in these lands follows the first opinion. During the days of her whitening (the clean days leading up to immersion), the custom is to be lenient. And even in a place where the custom is to be stringent, on the Days of Awe and similar occasions when many gather to go to the synagogue, they are permitted to go to the synagogue like other women. For it is a great sorrow for her that everyone gathers while she must stand outside. [Piskei Mahari"a, siman 132]
ס״ק אכדי וכו'
(א) כדי וכו' - וגם כי הקרי בא מקלות ראש וד"ת צריך להיות באימה ויראה ברתת וזיע כמו בעת נתינתה:
(1) "So that, etc." ("so that the scholars would not be found constantly with their wives") — The reason for the decree was also that a seminal emission often comes from levity and frivolity, and words of Torah must be received with awe and reverence, with trembling and quaking, just as they were at the time of their giving at Sinai.

(2) "And afterwards they annulled it" — Nevertheless, one who wishes to adopt the practice of immersing — may a blessing come upon him. But this holds only if, by doing so, the time for the Shema and prayer will not pass. And it is possible that even if, on account of this, he would miss praying with the congregation, it is likewise not proper to be stringent in this matter.

(ג) אותה תקנה - שהיתה גזירה שאין רוב הצבור יכולין לעמוד בה ובטלוה משום ביטול תורה ומשום ביטול פריה ורביה:
(3) "That enactment" — It was a decree that the majority of the community could not uphold. So they annulled it, because of the neglect of Torah study it caused and because of the neglect of the mitzvah of procreation.

(ד) המנהג - ומ"מ יש אנשי מעשה שנוהגין בתקנה זו וטובלין א"ע לקריין ואם קשה עליהם הטבילה רוחצין א"ע בט' קבין. וכתבו האחרונים שארבעים סאה מים שאובים כשרים לטבילה זו וכן הט' קבין הוא ג"כ במים שאובים ואפילו משלשה כלים. ובאופן שלא יפסיק משפיכת כלי א' עד שיתחיל השני אבל יותר מג' כלים אין מצטרפין לשיעור ט' קבין. והנך ט' קבין צריך שישפוך עליו אבל לא לטבול בתוכם בין אם הם בכלי או בקרקע דכל שהוא דרך טבילה בעינן דוקא ארבעים סאה ובקרקע כשאר טבילות ומ"מ אם נכנס חציו למקוה ולא הרכין ראשו לטבול חצי גופו אשר בחוץ רק שפכו עליו מלמעלה ט' קבין מועיל לטהר. כתב בספר מטה אפרים דבעת שפיכת הט' קבין על האדם יש לו לעמוד זקוף ושתי ידיו מונחים נגד לבו ולא ידחק אותם בחיבוק הרבה רק בריווח קצת כדי שיבואו המים גם שם ויזהיר לשופכים עליו שישפכו כנגד גופו ממש. ושיעור ט' קבין עיין בבה"ט שהוא שיעור ט"ו קווארט פוליש עיין בספר מטה אפרים הנ"ל שכתב דבקווארט שלנו צריך כ"ד קווארט לשפיכת ט"ק ובשעת הדחק שאין הכלים מחזיקין כ"כ יש להקל בי"ח קווארט. וכן יש ליזהר בכל זה אותם שנוהגים להטהר בער"ה ועיו"כ ע"י ט' קבין. כתב במ"א דאף הנוהג טבילה לקרי דוקא בריא או חולה ששמש מטתו אבל חולה שראה קרי לאונסו פטור מכלום ואין לו רק לרחוץ אותו מקום שלא יהיה מלוכלך מש"ז וכן בריא שראה מים חלוקים פטור מכלום דלא גזר עזרא ע"ז לענין ד"ת ותפלה ורק לענין תרומה טמא משום מים חלוקים:
(4) "The custom" — Nevertheless, there are men of pious deeds who observe this original enactment and immerse themselves after a seminal emission. And if immersion is difficult for them, they wash themselves with nine kavin of water. The later authorities wrote that forty se'ah of drawn water are valid for this immersion, and likewise the nine kavin may also be of drawn water, and even from three vessels. This is provided that there is no interruption from the pouring of the first vessel until the second begins; but more than three vessels do not combine to make up the measure of nine kavin. These nine kavin must be poured over him, but he may not immerse himself within them, whether they are in a vessel or in the ground. For anything done by way of immersion requires specifically forty se'ah, and in the ground, like all other immersions. Nevertheless, if he entered half of his body into a mikveh and did not bend down to immerse the half of his body that remained outside, but rather they poured the nine kavin over him from above, this is effective to purify him. The Matteh Efraim wrote that when the nine kavin are poured over the person, he should stand upright, with his two hands placed against his heart; and he should not press them tightly in a close embrace, but hold them slightly apart, so that the water reaches there as well. He should also warn those pouring over him to pour directly against his body itself. As for the measure of nine kavin, see the Be'er Heiteiv, that it is the measure of fifteen Polish quart. See the Matteh Efraim mentioned above, who wrote that in our quart one needs twenty-four quart for the pouring of the nine kavin; and in pressing circumstances, when the vessels do not hold so much, one may be lenient with eighteen quart. Those who have the practice of purifying themselves on the eve of Rosh Hashanah and the eve of Yom Kippur by means of nine kavin should likewise be careful in all of this. The Magen Avraham wrote that even one who has the practice of immersing for a seminal emission — this applies only to a healthy person, or a sick person who had marital relations; but a sick person who experienced an emission involuntarily is exempt from anything. He need only wash that area so that it will not be soiled from the seminal fluid. And likewise a healthy person who saw a discharge of clear fluid (as opposed to actual semen) is exempt from anything, for Ezra did not decree impurity upon this with respect to words of Torah and prayer, and only with regard to terumah is one rendered impure on account of such clear fluid.

(ה) נדה - כתב רבינו ירוחם יש טועים לומר שהנשים יולדות לא יכנסו לבהכ"נ עד שעברו מ' יום לזכר ופ' לנקיבה ומנהג טעות הוא וצריך למחות בידם:
(5) "A niddah" — Rabbeinu Yerucham wrote that some err in saying that women who have given birth should not enter the synagogue, until forty days have passed for a male child and eighty for a female child. This is a mistaken custom, and one must protest against it.
ס״ק ואו להתפלל וכו'
(ו) או להתפלל וכו' - ובבנימין זאב סימן קנ"ג כתב שלא נהגו רק שלא לכנוס לבה"כ ולא לראות ס"ת וגם כשמתפללת אינה עומדת בפני חברותיה ומשום מנהג וכבוד עושין כן ולא משום איסור עכ"ל וכן הסכימו האחרונים דצריכה להתפלל בביתה ולברך כל הברכות ובפרט ברהמ"ז וקידוש שהוא מן התורה וע' במ"א:
(6) "Or to pray, etc." — In the Binyamin Ze'ev, siman 153, he wrote that the custom was only that she not enter the synagogue and not look at a Torah scroll, and also that when she prays she does not stand in front of her fellow women. They do this on account of custom and honor, and not because of any actual prohibition. These are his words. And so the later authorities agreed, that she must pray in her home and recite all the blessings, and in particular the Grace after Meals and Kiddush, which are of Torah origin. (ז) אבל המנהג וכו' - ובמדינותינו נוהגין היתר לעולם ומברכות ומתפללות ומ"מ לא יסתכלו בס"ת בשעה שמגביהים אותה להראות לעם [ח"א] עוד כתב שלא יכנסו לבית הקברות עד שיטבלו:
(7) "But the custom, etc." — In our lands the custom is always to be lenient, and they recite blessings and pray. Nevertheless, they should not gaze at the Torah scroll at the time it is raised to be shown to the people. [Chayei Adam] He further wrote that they should not enter a cemetery until they have immersed.

(ח) נוראים - ומיום ראשון של סליחות ואילך מיקרי ימים נוראים לכל כה"ג וה"ה אם משיאה בנה או בתה או שהיא בעצמה יולדת שהולכין לבה"כ אחר ד' שבועות שרי אע"פ שהיא נדה וכיון שמותרים לילך לבה"כ שרי ג"כ להתפלל בכל זה לכו"ע:
(8) "The Days of Awe (Nora'im)" — From the first day of Selichos onward is called the Days of Awe with respect to all such cases. And likewise if she is marrying off her son or her daughter, or if she herself has given birth and they go to the synagogue after four weeks, it is permitted, even though she is a niddah. And since they are permitted to go to the synagogue, it is likewise permitted to pray in all these cases according to all opinions.
