סעיף א׳

If a person's excrement is behind him, he must distance himself four cubits from the place where the smell ends; even if he has an ailment that prevents him from smelling, he must still distance four cubits from the place where the smell would end for one who can smell. And if it is in front of him, he must distance himself as far as his eye can see, even at night [or if he is blind] [Responsum of the Rashba, siman 168; the Beit Yosef in the name of the Ri] since he cannot see it: he must distance himself until the point where he could not see it by day. And if it is to his side, its law is like when it is behind him. The Rema adds: A chazan (prayer-leader) who is leading the prayers and there is excrement in the synagogue, or in the house where he is leading the prayers, even if it is behind him, anywhere in the building, must fall silent until it is removed, since he is discharging the obligation on behalf of the many, and it is impossible that not one of the congregation is within four cubits of the excrement. ס״ק אצואת אדם

(א) צואת אדם - אפילו אין מגיע ממנה ריח רע ועיין לקמן סימן פ"ב:

(1) 'A person's excrement' — even if no foul smell reaches from it (the distancing still applies). And see further on, siman 82.

ס״ק בד' אמות וכו'

(ב) ד' אמות וכו' - דכתיב והיה מחניך קדוש וקבלו חז"ל שמחנה של אדם הוא ד"א ואם יגיע ריח רע מהצואה בתוך ד' אמותיו הרי אין כל מקום חנייתו בקדושה:

(2) 'Four cubits, etc.' — for it is written, 'and your camp shall be holy,' and the Sages received a tradition that a person's 'camp' is four cubits; and if a foul smell from the excrement reaches within his four cubits, then his entire place of encampment is not in holiness.

ס״ק גמלא עיניו

(ג) מלא עיניו - עיין בפמ"ג שכתב דלהרשב"א דוקא דיבור אסור בתוך כמלא עיניו אבל להרהר בד"ת מותר אם הוא חוץ לד"א ממקום שכלה הריח ולהרא"ש יש לעיין בזה דאפשר דאסור מה"ת או מדרבנן עי"ש:

(3) 'As far as his eye can see' — see the Pri Megadim, who wrote that according to the Rashba only speech is forbidden within eye's range, but to contemplate words of Torah is permitted if he is outside four cubits from where the smell ends; while according to the Rosh there is room to examine this, for perhaps it is forbidden, whether by Torah law or Rabbinically. See there.

ס״ק דאפילו בלילה

(ד) אפילו בלילה - ע"כ אסור לאמר אפילו בלילה ק"ש או שאר כל דבר שבקדושה לפני הבתים כי דרך להיות שם צואה וכ"ש בחצר:

(4) 'Even at night' — therefore it is forbidden to say, even at night, the Shema or any other matter of holiness in front of houses, since excrement is commonly found there, and all the more so in a courtyard.

ס״ק הדינו כמלאחריו

(ה) דינו כמלאחריו - ומ"מ לכתחלה יזהר לילך כדי שיהיה הצואה מלאחריה ואז סגי בד"א ואם א"א רק בטירחא יתירא סגי גם לצדדין בד' אמות כמו מלאחריו וה"מ צדדין ממש אבל צדדין שלפניו [כגון רין שטאקין סרוחים הנמשכים לאורך הרחוב וכה"ג] כתב המ"א דדינו כלפניו וא"ר כתב דדינו כמן הצדדין וסגי בד"א וכתב הח"א דמה שרואה בלא הטיית ראשו לצדדין לכו"ע דינו כלפניו עוד כתב דצריך ליזהר מאוד בשעת קידוש לבנה ברחובות שרין שטאקין סרוחין נמשכין לאורך הרחוב מצדדין שאפילו הם ברחוק ד"א הרי נמשכין גם מלפניו ואסור כמלא עיניו וכ"ש שצריך להרחיק ד"א ממקום שכלה הריח ומוטב שלא לקדש כלל. והנזהר מלהזכיר דברי קדושה במקום שאינו נקי עליו הכתוב אומר ובדבר הזה תאריכו ימים:

(5) 'Its law is like when it is behind him' — nevertheless, at the outset he should take care to walk so that the excrement is behind him, and then four cubits suffices. And if this is impossible except with excessive trouble, four cubits suffices also for the sides, just as when it is behind him. But this applies to the actual sides; however, the sides that are in front of him [such as foul rinnshtokin (open gutters) running along the length of the street, and the like]: the Magen Avraham wrote that their law is like what is in front of him, while the Eliyah Rabbah wrote that their law is like the sides, and four cubits suffices. And the ח"א wrote that whatever he sees without turning his head to the sides, all agree its law is like what is in front of him. He further wrote that one must be very careful during the Sanctification of the Moon (Kiddush Levana) in streets where foul rinnshtokin run along the length of the street on the sides, for even if they are more than four cubits away, they also extend in front of him, and it is forbidden as far as the eye can see; and all the more so must he distance four cubits from where the smell ends; and it is better not to sanctify the moon there at all. And of one who is careful not to mention words of holiness in a place that is not clean, of him the verse says, 'and through this matter you shall lengthen your days.'

ס״ק ועד שיוציאנה

(ו) עד שיוציאנה - ואם עי"ז שהה הש"ץ כדי לגמור כולה ולא היה בתוך ד' אמותיו לא יחזור לראש:

(6) 'Until it is removed' — and if through this the chazan paused long enough to have finished the whole (prayer), but it was not within his four cubits, he does not go back to the beginning.

ס״ק זידי חובתן

(ז) ידי חובתן - ר"ל דהוי כאלו מתפלל כל אחד עתה לעצמו ואף דאנן נוהגין שכל יחיד ויחיד מתפלל לעצמו מ"מ הלא צריך כל יחיד ויחיד לענות אמן על ברכת הש"ץ ואסור להיות צואה לפניו. ואם הש"ץ עוסק עתה בפסוקי דזמרה דאינו מוציא ידי חובה ואין שם עניית אמן מותר לו לאמר כדרכו אם הוא חוץ לד' אמותיו ממקום שכלה הריח ואם הוא בתוך ד' אמותיו צריך לשתוק ואפילו אם שהה כדי לגמור כולה אינו חוזר רק למקום שפסק וכן בברכת ק"ש אבל בק"ש ובתפלה בלחש השוהה כדי לגמור כולה [מראש התפלה עד סופה] והיה הצואה בתוך ד' אמותיו חוזר לראש ומשערין לפי הקורא:

(7) 'Their obligation' — that is to say, it is as if each one is now praying for himself. And although our custom is that each and every individual prays for himself, nevertheless, each individual must answer Amen to the chazan's blessing, and it is forbidden for excrement to be in front of him. And if the chazan is presently occupied with Pesukei d'Zimra, where he discharges no obligation and there is no answering of Amen, he is permitted to recite as usual, provided he is outside his four cubits from where the smell ends; and if he is within his four cubits, he must fall silent. And even if he paused long enough to finish the whole, he returns only to the place where he stopped; and likewise for the blessings of the Shema. But for the Shema itself, and for the silent Amidah, one who paused long enough to finish the whole [from the beginning of the prayer to its end] while the excrement was within his four cubits, goes back to the beginning; and we measure this according to the reader (his own pace).

ס״ק חואי אפשר

(ח) ואי אפשר - ואם אירע ששום אדם אינו יושב בתוך ד"א של הצואה מותר להתפלל ואע"פ שהצואה מפסקת ביניהם ובין הש"ץ יכולין להחזיר פניהם כדי שלא יהא לפניהם דאסור כמלא עיניו מיהו בסימן נ"ה ס"ך כתב י"א דלא יענה אמן כשיש צואה מפסקת ביניהם ועי"ש מה שכתבנו בזה:

(8) 'And it is impossible' — but if it happened that no person is sitting within four cubits of the excrement, it is permitted to pray. And even though the excrement separates between them and the chazan, they can turn their faces away so that it is not in front of them, which would be forbidden as far as the eye can see. However, in siman 55, se'if 20, it is written that some say one should not answer Amen when excrement separates between them; and see there what we wrote on this.

ס״ק טד' אמות וכו'

(ט) ד' אמות וכו' - ר"ל ממקום שכלה הריח. ואם תינוק השתין מים בבהכ"נ ג"כ ישתוק הש"ץ וימתין עד שיטילו בהן מים או יכסוהו או ירחיקו כל הקהל מהן ד"א [ט"ז ופמ"ג ודה"ח] ועיין מה שכתבנו בבה"ל דאם המי רגלים היו חוץ לד"א של הש"ץ אפשר דיש לסמוך על סברת המקילים שאין צריך להודיעו. ומ"מ יראו הקהל להתרחק או לכסות או להטיל מים דאל"ה לא יוכלו לענות אמן:

(9) 'Four cubits, etc.' — that is to say, from the place where the smell ends. And if a child urinated in the synagogue, the chazan likewise falls silent and waits until they pour water on it, or cover it, or the whole congregation distances four cubits from it [the Taz, the Pri Megadim, and the דה"ח]. And see what we wrote in the Biur Halacha: that if the urine was outside the chazan's four cubits, perhaps one may rely on the view of the lenient authorities that there is no need to inform him. Nevertheless, the congregation should see to distance themselves, or cover it, or pour water on it, for otherwise they will not be able to answer Amen.

סעיף ב׳

יהיתה יאבמקום גבוה עשרה טפחים או נמוך עשרה או שהיתה בבית אחד והוא יבבבית אחר אפילו הפתח פתוח ויושב יגבצדה ורואה אותה אם אין לה ריח יכול לקרות דכיון שהיא ברשות אחרת קרינן ביה שפיר והי' מחניך קדוש להרא"ש אבל להרשב"א ידדוקא טוכשאינו רואה אותה טזואם יש לה ריח יזלא מהניא הפסקה יחולא שינוי רשות וי"א דכי היכי דהפסקה מועל' לצואה עצמ' ה"נ מועיל' לריח רע יטשלה:

If it was in a place ten handbreadths high, or ten handbreadths low (in a pit), or it was in one room and he is in another room, even if the doorway is open and he sits beside it and sees it, if it has no smell he may recite (the Shema), for since it is in a separate domain we can properly apply to him 'and your camp shall be holy'; so holds the Rosh. But according to the Rashba, this is only when he does not see it. And if it has a smell, neither a partition nor a change of domain helps; and some say that just as a partition helps for the excrement itself, so too it helps for its foul smell.

ס״ק יהיתה וכו'

(י) היתה וכו' - וה"ה להיפך אם הוא היה עומד על המקום הגבוה והצואה מונח למטה בארץ ועיין לקמן סימן פ"ז במ"ב בדין אם היה שוכב על מטה גבוה עשרה ותחתיה או לפניה עומד גרף של רעי ועוד ענינים השייכים לסעיף זה:

(10) 'If it was, etc.' — and likewise the reverse: if he was standing on the high place and the excrement lay below on the ground. And see further on, siman 87, in the Mishnah Berurah, concerning the case where one was lying on a bed ten handbreadths high with a chamber pot of excrement beneath it or in front of it, and other matters pertaining to this se'if.

ס״ק יאבמקום גבוה וכו'

(יא) במקום גבוה וכו' - וגם שהוא רוחב ד' על ד' טפחים דהוי מקום חשוב ובדיעבד אם לא היה רוחב ד' על ד' ג"כ אינו צריך לחזור ולהתפלל רק בתורת נדבה כי יש פלוגתת האחרונים בזה [דה"ח]:

(11) 'In a place ten handbreadths high, etc.' — and also that it is four by four handbreadths wide, so that it is a significant (distinct) place. And after the fact, even if it was not four by four wide, he likewise need not repeat the prayer, except as a voluntary offering, since there is a dispute among the Acharonim about this [the דה"ח].

ס״ק יבבבית אחר

(יב) בבית אחר - פי' בחדר אחר:

(12) 'In another room' — meaning, in a different chamber.

ס״ק יגבצדה

(יג) בצדה - פי' אצל מקום הפתח ואין חילוק בין יש שם דלת או לא ואם הכניס ראשו למקום שיש שם הצואה לכו"ע אסור ואפי' בעוצם עיניו [מ"א סי' ע"ד ודה"ח] וכן להיפך אם הצואה והאדם בבית והוציא ראשו חוץ לבית או חוץ לחלון ג"כ אסור לקרות דשדינן ראשו בתר רובו [שם]:

(13) 'Beside it' — meaning, next to the place of the doorway. And there is no distinction whether there is a door there or not. And if he put his head into the place where the excrement is, all agree it is forbidden, even with his eyes shut [the Magen Avraham, siman 74, and the דה"ח]. And likewise the reverse: if the excrement and the person are in the room and he put his head outside the room or outside the window, it is likewise forbidden to recite, for we deem his head to follow the majority of his body [ibid.].

ס״ק ידדוקא כשאינו וכו'

(יד) דוקא כשאינו וכו' - טעמו דס"ל דקרא דולא יראה קאי ג"כ אאיסור צואה האמור בתחלת המקרא ואם הוא רואה אותה דרך חלון של זכוכית לכו"ע שרי וכדלעיל בריש סימן ע"ו עי"ש. ואם מעצים עיניו או בלילה י"א דשרי בזה לכו"ע כיון שהוא ברשות אחר ויש אוסרין ובשעת הדחק שאינו יכול להחזיר פניו יש לסמוך ע"ד המקילין אולם בשאינו יכול לראות הצואה מחמת גובהו או עומקו לכו"ע שרי בזה:

(14) 'Only when he does not, etc.' — his reason is that he holds the verse 'and no unseemly thing shall be seen' refers also to the prohibition of excrement stated at the start of the verse. And if he sees it through a glass window, all agree it is permitted, as above at the beginning of siman 76; see there. And if he shuts his eyes, or at night, some say it is permitted in this to all, since it is in a separate domain; but others forbid. And in a pressing situation, where he cannot turn his face away, one may rely on the lenient authorities. However, where he cannot see the excrement because of its height or depth, all agree it is permitted in this.

ס״ק טורואה אותה

(טו) רואה אותה - ולכן אסור לדבר דברי קדושה והוא מסתכל דרך חלון פתוח אם רואה האשפתות (ורין שטאקין) שברחובות או שחזיר עומד לפני חלונו אע"פ שאין מגיע לו ר"ר וצריך לזהר בזה בשעת קידוש לבנ' דרך חלון פתוח (או על גאנקעס) אלא צריך שעכ"פ יעצים עיניו ואז אם אין ריח רע מגיע לו מותר ובמקום שמסופק בזה אם הוא אשפה מותר דהוי ס"ס שמא הלכה כהרא"ש ומ"מ לכתחילה נכון יותר שיעצים עיניו מהיות טוב וגו' [ח"א] ועיין בבה"ל:

(15) 'Sees it' — and therefore it is forbidden to speak words of holiness while he gazes through an open window, if he sees the refuse heaps (and rinnshtokin, open gutters) in the streets, or a pig standing before his window, even though no foul smell reaches him. And one must be careful about this during the Sanctification of the Moon through an open window (or on balconies); rather, he must at least shut his eyes, and then, if no foul smell reaches him, it is permitted. And where one is in doubt whether it is a refuse heap, it is permitted, for it is a double doubt: perhaps the halacha follows the Rosh. Nevertheless, at the outset it is more proper that he shut his eyes, 'it being better to be good, etc.' [the ח"א]; and see the Biur Halacha.

ס״ק טזואם יש וכו'

(טז) ואם יש וכו' - וכדעה זו פסקו האחרונים:

(16) 'And if it has, etc.' — the Acharonim ruled in accordance with this view.

ס״ק יזלא מהני

(יז) לא מהני - ר"ל ובעינן ד"א ממקום שכלה הריח ויש מקילין דבזה די עד מקום שיכלה הריח לבד ועיין בבה"ל:

(17) 'Does not help' — that is to say, we require four cubits from the place where the smell ends; and some are lenient, holding that for this it suffices only up to where the smell ends by itself; and see the Biur Halacha.

ס״ק יחולא שינוי רשות

(יח) ולא שינוי רשות - ע"כ מי שמתפלל בבית והריח ר"ר ממקום אחר יפסיק וישהא עד שיעבור הריח. ומי שיש לו חולי שאינו מריח אפשר שיש להקל בזה במקום הדחק:

(18) 'Nor a change of domain' — therefore one who prays in a house and smells a foul odor from another place should stop and pause until the smell passes. And one who has an ailment that prevents him from smelling: perhaps there is room to be lenient in this in a pressing situation.

ס״ק יטשלה

(יט) שלה - אם העבירו צואה בבית ונשאר עדיין ריח רע בבית יש להחמיר מיהו נ"ל דמי שאינו מריח מותר לקרות בזה [מ"א]:

(19) 'Its (smell)' — if excrement was removed from the house but a foul smell still remains in the house, one should be stringent; however, it seems to me that one who cannot smell is permitted to recite in this case [the Magen Avraham].

סעיף ג׳

חצר קטנה שנפרצה במלוא' לגדול' והגדול' עודפת עליה מן הצדדים קטנה לא חשיבה כבית בפני עצמה כיון שנפרצה במלואה לגדולה אבל הגדולה כיון שכתליה עודפים על של קטנה מצד זה ומצד זה חשיבה כבית בפ"ע הלכך אם צואה בגדולה אסו' לקרות בקטנה עד שירחיק ככשיעו' ואם צואה בקטנה מות' לקרות בגדולה בלא הרחקה כאאם אין מגיע לו ריח רע:

A small courtyard that was breached along its full width into a large one, where the large one extends beyond it on the sides (its walls flanking the opening): the small courtyard is not regarded as a house in its own right, since it was breached along its full width into the large one. But the large courtyard, since its walls extend beyond those of the small one on this side and on that side, is regarded as a house in its own right. Therefore, if excrement is in the large one, it is forbidden to recite in the small one until he distances himself the required measure; but if excrement is in the small one, it is permitted to recite in the large one without any distancing, provided no foul smell reaches him.

ס״ק ככשיעור

(כ) כשיעור - היינו ד"א ממקום שכלה הריח כן מוכח בב"י ועיין בבה"ל:

(20) 'The required measure' — namely, four cubits from the place where the smell ends. so it is proven in the Beit Yosef; and see the Biur Halacha.

ס״ק כאאם אין וכו'

(כא) אם אין וכו' - סתם כדעה קמייתא שבסעיף הקודם:

(21) 'If there is no, etc.' — he ruled plainly like the first view in the preceding se'if.

סעיף ד׳

צואת כלב וחזי' אם נתן בהם עורות מרחיקים מהם כמו מצואת אדם ואם לאו דינם כדין צואת שאר בהמה חיה ועוף שאין צריך להרחיק מהם אם אין בהם ריח רע כבואם יש בהם כגריח רע דינם כדכמו צואת אדם:

The excrement of a dog or a pig: if hides were placed in them (they were fed skins for tanning), one distances from them as from human excrement; and if not, their law is like that of the excrement of other animals, beasts, and birds, from which one need not distance, provided they have no foul smell. And if they do have a foul smell, their law is like human excrement.

ס״ק כבואם יש בהם וכו'

(כב) ואם יש בהם וכו' - ר"ל אם ידעינן שיש בהם ר"ר אבל מסתמא א"צ לבדוק בזה דמסתמא אין בהם ר"ר:

(22) 'And if they have, etc.' — that is to say, if we know that they have a foul smell; but ordinarily one need not check into this, for ordinarily they have no foul smell.

ס״ק כגריח רע

(כג) ריח רע - היינו כל שדרך בני אדם להצטער מאותו הריח. כתב הח"א דבר שטבעו ריח רע כגון עטרן וכדומה מותר ולא נקרא צואה אלא מה שנסרח מחמת עיפוש וכ"כ בספר מנחת שמואל:

(23) 'A foul smell' — namely, anything from whose smell people are commonly pained. The ח"א wrote that something whose nature is to smell bad, such as tar and the like, is permitted, and only that which has putrefied through decay is called 'excrement'; and so wrote the sefer Minchat Shmuel.

ס״ק כדכצואת אדם

(כד) כצואת אדם - ר"ל ובעינן הרחקה ד"א ממקום שכלה הריח מלאחריו ומלפניו כמלא עיניו ואפשר אפילו אם פסק הריח אח"כ מ"מ כבר חלה עלייהו שם צואה ואסור כמו בצואת אדם. והמ"א חולק על כל זה ופסק דסתם צואת בהמה חיה ועוף לבד מאלו הידועים שריחן רע מאוד וכדלקמן אפילו אם יש בהם ר"ר בעת היציאה אין הר"ר חזק כ"כ ודרכו לפסוק ע"כ אין דינם כצואה וא"צ להרחיק אלא עד מקום שיכלה הריח וכן פסק בספר מגן גבורים ובדה"ח סובר דהוא ספיקא דדינא ע"כ בק"ש אם קרא בתוך ד"א חוזר וקורא ובתפלה יחזור ויתפלל ויתנה אם יצא שתהא לנדבה עי"ש ול"נ דאין להחמיר כלל לענין תפלה דהרבה אחרונים סוברים כהמ"א:

(24) 'Like human excrement' — that is to say, we require distancing of four cubits from where the smell ends when it is behind him, and in front of him as far as the eye can see. And perhaps, even if the smell later ceased, the status of 'excrement' has already taken hold upon them, and it is forbidden as with human excrement. But the Magen Avraham disagrees with all this and rules that ordinary excrement of animals, beasts, and birds, apart from those known to have a very foul smell, as below: even if they have a foul smell at the time it comes out, the smell is not so strong and it tends to dissipate; therefore their law is not that of excrement, and one need only distance up to the place where the smell ends. And so ruled the sefer Magen Gibborim; while the דה"ח holds it is a doubt in the law, therefore, regarding the Shema, if he recited within four cubits he goes back and recites again, and regarding the Amidah he should repeat it and stipulate that if he already fulfilled his duty it shall be a voluntary prayer; see there. And it seems to me that one should not be stringent at all regarding the Amidah, since many Acharonim hold like the Magen Avraham.

סעיף ה׳

כהצואת חמו' הרכה לאחר שבא מהדרך וצואת חתול ונמיה ונבילה מסרחת דינם כצואת אדם וההולך בדרך אע"פ שרואה צואת בהמה כנגדו אם אין הריח בא לו אינו חושש למיעוט לתלותה בשל חמור ובסמוך לעיר יש אומרים שיש לחוש לפי שרוב הבהמות המצויות שם הם חמורים: הגה במקום דשכיחי חמורי':

The soft excrement of a donkey right after it comes from the road, and the excrement of a cat, a marten, and a foul carcass: their law is like human excrement. One who is walking on the road, even though he sees animal excrement facing him, if no smell reaches him, need not be concerned about the minority (of cases), so as to attribute it to a donkey's. But near a city, some say one should be concerned, since most of the animals found there are donkeys. The Rema adds: in a place where donkeys are common.

ס״ק כהצואת חמור וכו'

(כה) צואת חמור וכו' - והני מסתמא ריחן רע ולכן אפילו אם יזדמן פ"א שאין מריחין אסור דה"ל כצואת אדם כ"כ המ"א ועיין בבה"ל:

(25) 'The excrement of a donkey, etc.' — and these ordinarily have a foul smell, and therefore, even if it happens on occasion that no smell is detected, it is forbidden, for it has the status of human excrement; so wrote the Magen Avraham; and see the Biur Halacha.

סעיף ו׳

בירושלמי אוסר לקרות כנגד מי רגלי חמור הבא מן הדרך וכנגד צואת תרנגולים כואדומה:

In the Yerushalmi it is forbidden to recite opposite the urine of a donkey that has come from the road, and opposite the excrement of red hens.
