If one was sleeping naked wrapped in his tallis (cloak), he must make a partition with the tallis over his heart, and only then may he recite (the Shema), because when his heart 'sees' the nakedness (the two being together with nothing between them) it is forbidden. The Rema adds: and likewise, if his heart sees the nakedness of his fellow, it is forbidden (the Tur).
(1) 'If one was sleeping naked' — the author (the Mechaber) took the wording of the Gemara [Berachos 23b], for there that expression fits; but in our matter it is likewise so when one was sleeping in his robe without trousers — the law is also thus, that he is forbidden to engage in words of Torah or to recite any blessing, until he presses the tunic with his hands at the place of the heart or below his heart, so that there be a partition between his heart and the nakedness.
(2) 'He must make a partition' — that is, that he presses the tallis onto his heart, so that there be a partition between his heart and the nakedness; but otherwise it is forbidden, for although his heart is covered by the tallis that is over his whole body, his heart and the nakedness are nevertheless still together, with nothing between them.
(3) 'Over his heart' — and likewise if he makes the partition with his tallis below his heart, so that there be a partition between his heart and the nakedness, and even if his heart is completely uncovered, as stated further in se'if 6.
(4) 'Because his heart, etc.' — for the Torah made the matter of nakedness dependent on sight, as it is written, 'that He see no unseemly thing in you,' etc.; and we find the term 'seeing' applied to the heart, as it is written, 'and my heart has seen much wisdom.' Therefore the Sages were stringent in this. And know that even if his heart is covered by a garment to separate between it and the nakedness, his nakedness must also be covered; and if it is uncovered, many later authorities agree that it is forbidden to recite by Torah law, even if he is covered by the tallis also over his head and eyes so that he cannot see the nakedness, for it does not say 'you shall not see an unseemly thing,' but rather 'that He see no [unseemly thing] in you,' meaning that it must be covered in such a way that it could not be shown even to another. Therefore, one who stands naked in a house and put his head out the window so that he would not see his nakedness — even though he made a partition with a garment over his heart, he still may not recite, since his nakedness is uncovered and visible in the house. But one who sleeps naked in a bed-canopy that is not ten tefachim high, and put his head outside of it, and also made a partition with something to separate between his heart and the nakedness — even though his nakedness is uncovered within the canopy, this is like being covered by a tallis, for since the canopy is not ten tefachim high it has the status of a covering, like a garment, and it is not comparable to a house, which is a separate domain of its own and to which we cannot apply the name 'covering' — therefore (in the case of the house) it is forbidden. And likewise, if there is excrement in the house within four amos, and he put his head out the window, it is forbidden to recite the Shema, for we cast his head after the majority (of his body) [the Magen Avraham — that is to say, it is forbidden even according to those who are lenient further on, in siman 76 se'if 4; see there, and see the Pri Megadim]. And if he brought his head into a room where there is excrement, it is likewise forbidden according to all to recite, since in any case the excrement is before his eyes; and according to the opinion of the Rashba, cited in siman 79 se'if 2, it is forbidden even if he stands outside opposite the doorway, since the excrement is opposite him; see there [the Pri Megadim].
(5) 'Sees the [nakedness], etc.' — see the דה"ח, that even after the fact, if he recited the Shema or prayed (in this state), he must repeat it; and so is proven from the Pri Megadim in siman 71, in the Eshel Avraham, letter 5. It is further proven there that the Shema must be repeated together with its blessings if he recited them while his heart 'saw' the nakedness, for so did the Sages ordain; but regarding other blessings there is doubt, after the fact, whether he must repeat, and in a doubt concerning blessings we are lenient. And in the ח"א, principle 3, law 33, and in the Nishmas Adam, principle 4, it is implied that one may be lenient after the fact even regarding prayer, in a case where the prohibition is only Rabbinic; and see the בה"ל, siman 185. And it is possible that one should hold like it in this matter, combining the view of Rashi and R' Shimshon his student, cited in Tosafos [Berachos 25b].
(6) 'Sees the nakedness of his fellow' — that is, that there is no partition between his heart and his fellow's nakedness, such as when the two of them lie naked and cover themselves with a single tallis, and they are distant from one another, meaning their flesh does not touch, but their faces are toward each other; and though he himself has a partition between his own heart and nakedness, it is nonetheless forbidden, because his heart sees his fellow's nakedness. Or such as when the two of them stand in water and his heart does not see his own nakedness, because it is covered by a garment below his heart, but it does see his fellow's nakedness, which is not covered — it is forbidden even though his eyes are outside the water, for in any case his heart sees.
One who bathes naked in clear water and wishes to drink (and to recite a blessing) should cover himself with a garment below his heart, so that his heart will not 'see' the nakedness when he blesses. This works specifically with a garment, but with one's hands it is not considered a covering. The Rema adds: and likewise, if he covers his head with his hands, that is not called a covering of the head; and see above, siman 91 (the Terumas HaDeshen in the name of א"ז). And if the water was murky, such that his limbs are not visible in it, he is permitted to recite while he is inside it, provided that the water does not have a foul smell. And if his heart is not within the water but only above the water, it is permitted even in clear water (ד"ע).
(7) 'He should cover with a garment, etc.' — that is, that the water, even though it is clear, nevertheless serves as a covering, with respect to his not being forbidden on account of exposed nakedness, on condition that he put his head outside the water and not gaze at the nakedness, since the water is clear and his nakedness is visible in it. But there is still a prohibition because his heart sees the nakedness, since the heart is together with the nakedness in the water; therefore he must cover with a garment below his heart, so that there be a partition between his heart and the nakedness. And likewise, if he makes the partition with a garment over his heart, that too is effective, as above in se'if 1.
(8) 'When he blesses' — and likewise he should cover his head, so that he does not bless with an uncovered head.
(9) 'But with the hands, etc.' — whether he covers over his heart, or between his heart and the nakedness, unless he embraces himself with his arms, as stated further on; and the reason is that one part of the body does not cover another part of the body. This is specifically with his own hands; but if others cover his heart with their hands, it is permitted.
(10) 'It is not called [a covering], etc.' — that is to say, with respect to being permitted to bless or to utter other words of holiness; and see above in siman 2, and further in siman 91 in the Mishnah Berurah.
(11) 'Murky' — and if it is clear, he stirs it up (making it murky) with his feet; and this applies specifically in the ground, but not in a vessel that has no earth or mud in it — so wrote the Magen Avraham. But in the Or Zarua, siman 128, he wrote that this applies even when one washes himself in a tub.
(12) 'Their smell is foul' — see further, siman 86, and in the Mishnah Berurah there.
(13) 'Only above [the water], etc.' — for the water is considered a partition between his heart and the nakedness. And he should also take care that his eyes be outside the water and that he not gaze at the nakedness, as above, for it is no better than nakedness seen through a glass lantern, which is explained in siman 75 se'if 5 to be forbidden.
If a person embraces his body with his arms, we judge this to be a valid partition (between his heart and the nakedness).
(14) 'As a partition' — that is, if he stands in clear water and his heart too is within the water, and he needs to make a partition between his heart and his nakedness, this (embracing) suffices to serve as a partition. Even though a mere covering with his hands is explained in se'if 2 to be ineffective, this is superior, and the reason is that since it is not the way of people to embrace themselves thus, and he does so, it is considered a partition even though it is one body. And so the later authorities agreed, unlike מהר"ם טיוולו and the פר"ח, who are stringent in this. And when he goes about in a robe without trousers, and he presses with his hands upon his robe over the heart or below his heart in order to separate between his heart and the nakedness, even according to them it is permitted.
There is one who says that women may bless and pray when they are dressed in a shift (a robe), even though they do not make a partition below the heart (since a woman's nakedness is low and her heart cannot see it). The Rema adds: and if they are naked, her nakedness must be pressed against the ground, or she must sit upon some other thing, for then her nakedness is not seen (lit. 'her heart does not see her nakedness') — which is not the case with a man (the Beis Yosef in the name of א"ח). And see further, siman 206, se'if 3.
(15) 'May bless, etc.' — the reason is that their nakedness is very low, and her heart cannot see it; and nevertheless, if they are standing naked, there is another prohibition regarding them, namely the prohibition of exposed nakedness — not from the aspect of the heart, but from the aspect of what is said, 'that He see no unseemly thing in you' — and she is forbidden to bless; rather she must be sitting, as the Rema wrote about this, that through her sitting her lower parts are covered and her nakedness is not visible. And what the Rema wrote, that 'then her heart does not see her nakedness,' is not precisely about her heart, for her heart in any case does not see her nakedness; rather he is speaking about there not being exposed nakedness at all. And it is a scribal error, and it should read: 'and then her nakedness is not seen' [the Acharonim].
(16) 'From the heart' — the Bach disagrees and holds that even for a woman we require a partition between the heart and the nakedness, even when she has a garment; but the rest of the Acharonim agreed with the ruling of the Shulchan Aruch. And see in Yoreh De'ah, siman 200, that the Taz and the Shach there conclude that according to what the Shulchan Aruch ruled here — that for a woman 'her heart sees the nakedness' does not apply — she is permitted to recite the blessing of immersion while standing in the water, even though she is still naked, for there is no issue of exposed nakedness in this, since the water is regarded as a covering. And it is better that her heart be above the water, for this is permitted even for a man, as the Rema wrote in his gloss in se'if 2, or that she embrace with her arms to separate between her heart and the nakedness, and so ruled the חכמ"א; and likewise, if she stirs up the water with her feet so that her limbs are not visible in it, this is effective according to all. And if there are other naked women standing in the immersion-house, it is obvious that at the time of the blessing she must turn her face and body away from them; and even if we were to say that the place of the mikveh is a domain of its own, it does not help, as is proven further in siman 79 se'if 2; see there.
(17) 'Pressed [to the ground]' — that is to say, attached and covered by the ground; which is not so for a man, for whom this does not apply, since the testicles and the member protrude. And see the Magen Avraham further in siman 206, whose opinion is that even if the buttocks are visible one need not be particular, for the buttocks do not have the status of nakedness; and so it is somewhat implied from the commentary of the Vilna Gaon. But the Eliyah Rabbah ruled that the buttocks do have the status of nakedness.
If his other limbs 'see' the nakedness, it is permitted; but if any of his limbs touches, whether his own nakedness or the nakedness of his fellow, it is forbidden to recite the Shema or to pray. And as for his thighs, upon which the nakedness rests, he must separate them with a garment or hold them apart in such a way that the member does not touch them.
(18) 'See the [nakedness], etc.' — that is to say, we do not require that the nakedness itself be covered with something so that the limbs not 'see' it.
(19) 'Any of his limbs' — for we decree against the touching of his other limbs on account of the touching of his hands, and the touching of his hands is forbidden lest he come to sinful thoughts.
(20) 'The member on them' — but concerning the touching of the scrotum one need not be particular, for there is no concern of sinful thought with it; yet the scrupulous are scrupulous even in this, since there are those who disagree. And after the fact he has fulfilled his obligation even if the member touched the thighs [the Pri Megadim, according to the view of the פר"ח cited above in siman 73 in the Mishnah Berurah, seif katan 4].
If his tallis was girded around his loins, covering him from his loins downward, even though from his loins upward he is naked, it is permitted to recite the Shema; but to pray is forbidden until he covers his heart.
(21) 'From his loins downward' — that is to say, even only down to below his nakedness, for by law this suffices for the Shema; but for prayer his whole body must be covered.
(22) 'Even though, etc.' — this is in a pressing situation, for otherwise it is not proper at the outset to do so even for any blessing, and all the more so for the Shema.
(23) 'It is permitted to recite' — since his nakedness is covered and the tallis also separates between his heart and the nakedness.
(24) 'His heart' — the same applies to his whole body; he mentioned 'his heart' only because of the earlier clause, that for the Shema he need not cover his heart. And the reason that prayer is more stringent is that in prayer one must see himself as standing before the King and speaking with Him, so that he must stand in awe; but in the Shema he is not speaking before the King.
