The bearers of the bier, and those who relieve them, and those who relieve the relievers, whether they are in front of the bier or behind it, since the bier has need of them, are exempt from reciting Shema. But the rest of those escorting the deceased, whom the bier does not need, are obligated.
(1) "And those who relieve the relievers" — even though the later group has time to recite while the first group is still carrying, even so they are exempt, because sometimes the carriers change their minds and hand the bier over to them to carry, and therefore they should not begin (lest they be interrupted mid-recitation).
(2) "have need of them" — for example, in a city that has a society (chevrah) designated for this task of burial, and all the members of the society take turns carrying because they all wish to merit the mitzvah — they are all exempt from Shema, since they are preoccupied with the concern of a mitzvah, and this is so even for those who are far from the bier. But in a place where there is no society designated for this, those close to the bier are exempt, since it is customary to give them a share in the mitzvah when the load grows heavy for the carriers, but those far from the bier are obligated.
(3) "are obligated" — that is, in Shema. [And even though escorting the deceased is included in acts of loving-kindness (gemilus chasadim), and gemilus chasadim is a Torah obligation, nevertheless these people are not preoccupied at all, and they can recite the first verse with concentration and while standing still, and the rest while they walk.] But they are exempt from the Amidah prayer, as is written in Siman 106.
One does not take the deceased out for burial when it is close to the time of Shema, that is, when there is not enough time to take him out and bury him before the time for Shema arrives. But if they already began to take him out, they do not interrupt in order to recite.
(4) "One does not take out, etc." — and if the time for Shema has already arrived, they should delay for a while, long enough that they can estimate that most of the congregation has already prayed, and also that the bearers of the bier have already recited Shema and prayed.
(5) "the deceased" — even for an important person (one might have thought there is room to be lenient), for in this regard there is, in our times, no one important enough to warrant leniency on that account.
(6) "before the time... arrives, etc." — from the unqualified wording of the Shulchan Aruch it would seem that the same law applies to the evening Shema; but in practice the later authorities (the Acharonim) agreed to be lenient regarding the evening, because if they do not bury him that day they transgress the prohibition of "you shall not leave the body overnight," and even though he could bury him at night after reciting Shema and praying, in any case he would transgress the positive commandment "you shall surely bury him on that day" if he does not bury him before sunset. And if it happened that the burial procession was delayed until dark, they should wait to take him out until the congregation has prayed the evening service (Maariv).
(7) "they began to take him out" — even after the time for Shema has already arrived.
(8) "they do not interrupt" — this means the people who are needed to carry the bier, even if the time for Shema will pass because of this, for burying the dead is a Torah obligation. But those whom the bier does not need are obligated to recite immediately, even though there is still more time remaining.
The people occupied with delivering the eulogy — at a time when the deceased lies before them — slip away one by one and recite the Shema and pray. If the deceased is not lying before them, they recite and pray where they are. And the onen (the close relative before burial) sits and remains silent.
(9) "they slip away" — for it is not possible for them to recite here beside the deceased, because of "one who mocks the poor" (to perform mitzvos before the dead, who can no longer perform them, mocks them).
(10) "and they pray" — but many decisors disagree and hold that they were lenient regarding prayer even when the deceased lies before them, since prayer (the Amidah) is a Rabbinic obligation. And it appears that with regard to the one leading the eulogy, one may certainly rely on this to be lenient, so that he need not break off in order to pray, for even with regard to Shema some say that he is exempt in this case. See the Tur and the Beis Yosef.
(11) "and remains silent" — and he answers nothing in response to them, for the reason that was explained in Siman 71.
Once they have buried the deceased and the mourners have turned back to receive consolation, and all the people go after them from the gravesite to the place where the mourners stand, to form a row (shurah) through which the mourners are consoled — if the people are able to begin and finish even a single verse before they reach the row, they should begin; but if not, they should not begin. The Rema adds: This ruling that they should not begin applies only when there is still time left in the day to recite afterward. (Beis Yosef in the name of the Ramban)
(12) "they should begin" — and they should recite as much as they are able.
(13) "there is time" — but if the time for reciting Shema would otherwise pass, they should recite Shema first, since they have not yet begun the mitzvah of consoling the mourners.
Those standing in the row to console the mourner: the inner ones, who can see the mourner's face, are exempt, and the outer ones, who cannot see the mourner's face, are obligated.
