One may recite the Shema while walking, or standing, or lying down, or riding on the back of an animal, or sitting. but not while lying flat on his back (parkedan), that is, with his face pressed down to the ground, or flung on his back with his face turned upward. He may, however, recite it while lying on his side. The Rema adds: since he is already lying down and it would be a bother to get up [הר"י, chapter 'Mi shemeso']. And if he was very corpulent (a man of much flesh) and cannot turn onto his side, or if he was ill, he leans slightly onto his side and recites.

(א) מהלך - עיין לקמן בס"ג:
(1) 'While walking' — see further, in se'if 3.
ס״ק בפרקדן
(ב) פרקדן - ואפילו מוטה מעט על צידו ג"כ אסור מפני שנראה כמקבל עליו עול מלכות שמים דרך שררה וגאוה:
(2) 'Lying flat on his back (parkedan)' — even if he is tilted slightly onto his side, it is likewise forbidden, because he appears to be accepting upon himself the yoke of the kingship of Heaven in a manner of lordliness and haughtiness.

(ג) שכבר שוכב - ר"ל ופשט כל מה שעליו ואיכא טורח לעמוד ולחזור וללבשם אבל אם שוכב בחלוקו צריך לעמוד ועיין בבה"ל:
(3) 'Since he is already lying down' — that is to say, [the leniency applies] when he has removed all his clothing, and it would be a bother to get up and put it back on again; but if he is lying in his shirt (chaluk), he must get up [to recite]. And see the Bei'ur Halachah.

(ד) ואינו יכול וכו' - אבל אם יכול על צידו אפילו רק בפסוק ראשון לבד מחוייב לעשות כן וכ"ש אם יכול לקרותה בישיבה:
(4) 'And he cannot, etc.' — but if he is able [to turn] onto his side even for the first verse alone, he is obligated to do so; and all the more so if he is able to recite it while sitting.
המי שרוצ' ולהחמיר זלעמוד כשהוא יושב ולקרותה מעומד חנקרא עבריין:
One who wishes to be stringent by standing up when he is [already] sitting, so as to recite it (the Shema) while standing, is called a transgressor.
ס״ק המי שרוצה וכו'
(ה) מי שרוצה וכו' - דהלכה כב"ה דס"ל דהא דכתיב ובקומך אין הכונה בעמידה כדעת ב"ש אלא בזמן שדרך בני אדם לקום ממטתם ואסור לו להחמיר לעשות כב"ש ואפילו אם אין הכוונה בעמידתו לעשות כב"ש אלא לעורר הכוונה וכדומה אפ"ה אסור ובין ביום ובין בלילה ואעפ"כ א"צ בזה לחזור ולקרות בדיעבד [פמ"ג עי"ש ועי' בספר מטה יהודא]:
(5) 'One who wishes, etc.' — for the halachah follows Beis Hillel, who holds that the verse 'and when you rise up' does not mean literally standing, as Beis Shammai maintain, but rather refers to the time when people are accustomed to rise from their beds. It is therefore forbidden for him to be stringent and act like Beis Shammai. And even if his intent in standing is not to act like Beis Shammai but only to arouse his concentration and the like, it is nonetheless forbidden, and this applies both by day and by night. Even so, after the fact he need not go back and recite it again. [Pri Megadim; see there, and see the sefer Mateh Yehudah.]
ס״ק ולהחמיר
(ו) להחמיר - כתב ביש"ש פ"ז דב"ק סימן מ"א מי שמחמיר בפני רבים בדבר שמותר ואיכא למיחש ליוהרא מנדין אותו. והיינו אם אותו הדבר פשט היתרו בכל ישראל [פמ"ג] ואם ידוע שעושה לש"ש אין מנדין אותו ואם מחמיר בפני רבו ורבו מיקל מנדין אותו אפילו עביד לש"ש ואפילו אם אינו פשוט כ"כ להתיר לא יחמיר נגד דברי רבו אם לא שיש לו ראיה לסתור דבריו עכ"ל:
(6) 'To be stringent' — It is written in יש"ש, chapter 7 of tractate Bava Kama, siman 41: one who is stringent in public regarding a matter that is [in fact] permitted, where there is cause to suspect arrogance (yuhara), is placed under a ban (niduy). This is so if the permissibility of that matter has spread among all Israel [Pri Megadim]. But if it is known that he acts for the sake of Heaven, he is not banned. And if he is stringent in the presence of his teacher while his teacher is lenient, he is banned even if he acts for the sake of Heaven. And even if it is not so clear-cut that the matter is permitted, he should not be stringent against his teacher's words, unless he has a proof to refute his words; end of his (the author's) words.
ס״ק זלעמוד
(ז) לעמוד - דוקא בזה הוא דאסור משום שנראה לכל דמשום חומרא קעביד אבל אם עומד יכול לישב דאז אינו נראה דמשום חומרא קעביד רק משום דצריך לישב ודוקא בשחרית אבל בערבית אין לו להטות ולישב כשעומד דנראה דעושה כב"ש:
(7) 'To stand up' — it is specifically in this case that it is forbidden, because it is evident to all that he is acting out of stringency. But if he is [already] standing, he may sit down [to recite], for then it does not appear that he is acting out of stringency, but only because he needs to sit. And this [leniency] applies specifically at Shacharis (the morning Shema); but at Arvis (the evening Shema) he should not bend down and sit when he is standing, for it would appear that he is acting like Beis Shammai.

(ח) נקרא עבריין - כדאמרינן בפרק כירה דמאן דעבר אדרבנן שרי למיקרי ליה עבריינא. כתב א"ר בשם מהרש"ל דביוה"כ כו"ע מודים דשרי לעמוד דאינו עושה משום יוהרא אלא מצותו בכך ר"ל להדמות אז למלאכים שנקראים עומדים והפמ"ג אוסר גם בזה:
(8) 'Is called a transgressor' — as we say in the chapter 'Kirah,' that one who transgresses the words of the Rabbis may be called a transgressor. The Eliyah Rabbah wrote in the name of the Maharshal that on Yom Kippur all agree it is permitted to stand [for the Shema], for he does not do so out of arrogance, but rather this is his mitzvah [on that day] — that is to say, to resemble on that day the angels, who are called 'those who stand.' But the Pri Megadim forbids [standing] even in this case.
טהיה מהלך בדרך וצריך לקרות ק"ש יצריך לעמוד יאבפסוק ראשון:
If one was walking on the road and needs to recite the Shema, he must stand still for the first verse.

(ט) היה מהלך - אע"ג דלעיל ס"א משמע דמן הדין מותר לקרות כשהוא מהלך מ"מ מצוה מן המובחר לעמוד בשעת פסוק ראשון דהוא עיקר ק"ש לפי שאינו מיושב כ"כ ואינו יכול לכוין כשהוא מהלך כאשר היה יושב ובדיעבד אם קרא כשהוא מהלך אינו צריך לחזור ולקרות [פמ"ג]:
(9) 'If one was walking' — even though above, in se'if 1, it was implied that by strict law one may recite while walking, nevertheless it is the choicest way to perform the mitzvah to stand still during the first verse, which is the essence of the Shema, because while walking his mind is not so settled and he cannot concentrate as well as he could while sitting. But after the fact, if he recited while walking, he need not go back and recite it again [Pri Megadim].
ס״ק יצריך לעמוד
(י) צריך לעמוד - ר"ל להתעכב במקום אחד ומותר לקרותה בין בעמידה ובין בישיבה ואפילו לק"ש של ערבית דדוקא אם משנה מעמידה לישיבה אסור לק"ש של ערבית משום דנראה שעושה כב"ש משא"כ מהליכה לישיבה. ויושב בקרון או בספינה אינו צריך לעמוד דיוכל לכוין היטב עיין בש"ת ובפמ"ג. וברוכב על הבהמה יש דיעות בין האחרונים ונכון להחמיר:
(10) 'He must stand still' — that is to say, to halt in one place, and he may then recite it either standing or sitting, even for the evening Shema. For it is only if he changes from standing to sitting that it is forbidden for the evening Shema, because it appears he is acting like Beis Shammai; this is not the case when he goes from walking to sitting. And one sitting in a wagon or on a boat need not stand, since he is able to concentrate well. See ש"ת and the Pri Megadim. And regarding one riding on an animal, there are differing opinions among the Acharonim, and it is proper to be stringent.
ס״ק יאבפסוק ראשון
(יא) בפסוק ראשון - וברוך שם כמל"ו בכלל פסוק ראשון הוא ויש מחמירין עד על לבבך. ומשם והלאה מותר לקרותה בהליכה או בעמידה:
(11) 'For the first verse' — and 'Baruch Shem Kevod Malchuso Le'olam Va'ed' is included within [the requirement of] the first verse, and some are stringent [to stand] until the words 'al levavecha' (upon your heart). From there onward one is permitted to recite it while walking or standing.
עיקר הכוונה הוא יבבפסוק ראשון הלכך אם קרא ולא כיון לבו בפסוק ראשון יגלא יצא ידי חובתו ידוחוזר וקורא ואפילו למ"ד מצות אינן צריכות כוונה טומודה הכא:
The essential requirement of concentration (kavanah) is in the first verse. Therefore, if he recited but did not direct his heart during the first verse, he has not fulfilled his obligation, and he goes back and recites it again. And even according to the view that mitzvos do not require intent, he concedes here [that intent is required].
ס״ק יבבפסוק ראשון
(יב) בפסוק ראשון - עיין סקי"א דה"ה בשכמל"ו ואם לא כיון בו ג"כ צריך לחזור ולקרות בכונה:
(12) 'In the first verse' — see se'if katan 11, that the same law applies to 'Baruch Shem Kevod Malchuso Le'olam Va'ed'; and if he did not concentrate during it as well, he must go back and recite it with concentration.

(יג) לא יצא - אפילו אם קודם שהתחיל לקרות נתכוין לקיים בהקריאה המ"ע דק"ש מ"מ כל שבאמצע פנה לבו לדברים אחרים הרי לא קבל עליו מלכות שמים בהסכמת הלב:
(13) 'He has not fulfilled his obligation' — even if, before he began to recite, he intended to fulfill through the recitation the positive commandment of the Shema, nevertheless, since in the middle he turned his heart to other matters, he has not accepted upon himself the kingship of Heaven with the assent of the heart.
ס״ק ידוחוזר וקורא
(יד) וחוזר וקורא - בלחש שלא יהיה נראה כמקבל שתי רשויות ח"ו ועיין לעיל בסימן ס"א במ"ב סקכ"ב. ואפילו אם כבר קרא כל פרשת שמע והיה אם שמוע ואח"כ נזכר שלא קרא פסוק ראשון בכונה צריך לחזור ולקרות כל הפרשה שמע דאם לא יקרא רק הפסוק ראשון הוי כקורא למפרע דאינו יוצא כדלקמן בסי' ס"ד. ואם נזכר באמצע פרשת והיה אם שמוע יגמור עד ויאמר ויתחיל ויקרא שמע עד והיה אם שמוע ויחזור לפרשת ויאמר:
(14) 'And he goes back and recites' — [he recites it] quietly, so that he not appear to be accepting two authorities, God forbid; and see above, in siman 61 in the Mishnah Berurah, se'if katan 22. And even if he already recited the entire paragraph of Shema and Vehayah im shamo'a, and afterward recalled that he did not recite the first verse with concentration, he must go back and recite the entire Shema paragraph. For if he were to recite only the first verse, it would be like reciting out of order, in which case he does not fulfill his obligation, as [explained] further in siman 64. And if he recalled [the omission] in the middle of the paragraph of Vehayah im shamo'a, he should finish up to 'Vayomer,' then begin and recite from Shema until Vehayah im shamo'a, and then return to the paragraph of Vayomer.
ס״ק טומודה הכא
(טו) מודה הכא - דאע"פ שאין מתכוין לצאת בזה ידי המצוה עכ"פ צריך כוונת הלב בכל פסוק ראשון כדי שיקבל עליו ע"מ =עול מלכות= שמים:
(15) 'He concedes here' — for even though he does not intend to fulfill the mitzvah through this, in any case one needs concentration of the heart throughout the entire first verse, so that he accept upon himself the yoke of the kingship of Heaven.
אם היה ישן מצערים אותו ומעירים אותו עד שיקרא פסוק ראשון והוא ער ממש מכאן ואילך אין מצערים אותו כדי שיקרא והוא ער ממש שאף על פי שהוא קורא טזמתנמנם יצא: הגה ודין שתוי ושכור ע' לקמן סי' צ"ט סעיף א':
If he was asleep, one troubles him and wakes him until he recites the first verse while fully awake. From that point onward one need not trouble him so that he recite the rest while fully awake, for even though he recites while dozing, he has fulfilled his obligation. The Rema adds: as for the law of one who has drunk (tipsy) or is drunk, see further, siman 99, se'if 1.
ס״ק טזמתנמנם
(טז) מתנמנם - וה"ה אונס אחר המבטל כונתו יצא דהרי עכ"פ קרא כולה אבל אם נשתקע בשינה ולא קרא לא יצא דהרי עכ"פ צריך לקרותה כולה. ודע דיש ג' דיעות בין הפוסקים י"א דרק פסוק ראשון בלבד הוא מן התורה וי"א דכל הפרשה ראשונה הוא מן התורה וי"א דגם השניה הוא מן התורה ופרשה ציצית לכו"ע הוא מן התורה כדי להזכיר יציאת מצרים ותקנו להזכיר בזמן ק"ש ועיין לקמן בסימן ס"ז במ"ב ובשערי תשובה שם:
(16) 'Dozing' — and likewise any other unavoidable circumstance (ones) that nullifies his concentration — he has [still] fulfilled his obligation, since in any case he recited all of it; but if he sank into sleep and did not recite [the rest], he has not fulfilled his obligation, for in any case he must recite all of it. And know that there are three opinions among the poskim: some say that only the first verse alone is [obligatory] from the Torah; and some say that the entire first paragraph is from the Torah; and some say that the second paragraph too is from the Torah. The paragraph of tzitzis is, according to all, from the Torah — in order to mention the Exodus from Egypt — and they instituted to mention it at the time of the Shema. And see further, in siman 67 in the Mishnah Berurah and in the Shaarei Teshuvah there.
הקורא קריאת שמע יזלא ירמוז בעיניו ולא יקרוץ בשפתיו ולא יראה באצבעותיו יחבפרשה ראשונ' שהוא עיקר קבלת עול מלכות שמים מפני שנראה כקורא עראי וכתיב ודברת בם ודרשינן עשה אותם קבע:
One who recites the Shema should not make signals with his eyes, nor gesture with his lips, nor point with his fingers, during the first paragraph, which is the essence of accepting the yoke of the kingship of Heaven, because doing so makes it appear as though he is reciting casually (in a haphazard manner). And it is written, 'and you shall speak of them,' and we expound: make them fixed (keva).

(יז) לא ירמוז - ואפילו לדבר מצוה אסור לרמוז וכ"ש שאסור לשאוף טאבאק בק"ש:
(17) 'He should not make signals' — even for the sake of a mitzvah it is forbidden to make signals, and all the more so that it is forbidden to sniff tobacco (snuff) during the Shema.
ס״ק יחבפרשה ראשונה
(יח) בפרשה ראשונה - ויש מחמירין גם בפרשה שניה אך לדבר מצוה לכו"ע מותר לרמוז בפרשה שניה אבל להפסיק להדיא לא עיין לקמן בסימן ס"ו:
(18) 'During the first paragraph' — and some are stringent [to forbid signaling] also during the second paragraph; but for the sake of a mitzvah all agree it is permitted to make signals during the second paragraph, though to interrupt outright [with speech] is not [permitted]. See further, in siman 66.
היה עוסק במלאכה ורוצה לקרות קריאת שמע יתבטל ממלאכתו יטעד שיקרא פרשה ראשונה כדי שלא יהא כקורא עראי:
If he was engaged in work and wishes to recite the Shema, he should cease his work until he has recited the first paragraph, so that he not be like one reciting casually.

(יט) עד שיקרא וכו' - משמע דמכאן והלאה מותר אפילו בברכות ק"ש וכן מבואר בהדיא בסי' ס"ו בב"י בד"ה ומ"ש רק אם ארעו וכו' עי"ש ועיין לקמן בסימן קצ"א בט"ז סק"א וצע"ג:
(19) 'Until he recites, etc.' — this implies that from here onward it is permitted [to interrupt one's work] even during the blessings of the Shema, and so it is explicitly explained in siman 66 in the Beis Yosef, in the passage beginning 'and that which he wrote: only if it happened to him, etc.'; see there. And see further, in siman 191 in the Taz, se'if katan 1; and this requires great analysis.
האומנין וכן בעל הבית שהיו עושים מלאכה בראש האילן או בראש שורות הבנין קורין ק"ש במקומם ואינם צריכים לירד:
Craftsmen, and likewise a householder, who were doing work at the top of a tree or atop the courses of a building, may recite the Shema in their place and need not come down.
הכתף אע"פ שמשאו כעל כתפיו קורא ק"ש אבל לא יתחיל בשעה שטוען ולא בשעה שפורק מפני שאין לבו מיושב:
A porter, even though his load is on his shoulders, may recite the Shema. But he should not begin at the moment he is loading it on, nor while he is unloading it, because his mind is not settled then.
ס״ק כעל כתיפו
(כ) על כתיפו - ואפילו אם המשא הוא של ד' קבין דלגבי תפלה אסור לקמן בסימן צ"ז ס"ה לגבי ק"ש מותר:
(20) 'On his shoulder' — even if the load is of four kabin (a substantial measure), which with regard to [the Shemoneh Esrei] prayer is forbidden, as [stated] further in siman 97, se'if 5, with regard to the Shema it is permitted.
