The time for reciting the morning Shema (Shacharis) begins from when a person can see a fellow with whom he is somewhat familiar at a distance of four cubits (amos) and recognize him. Its time extends until the end of the third hour of the day, which is a quarter of the day (the day being reckoned as twelve hours). The choicest way to perform the mitzvah is to recite it like the Vasikin (the term Vasikin means: disciples; and Rashi explains it to mean people who are humble and who cherish the mitzvos), who would time it to recite the Shema a little before sunrise (netz ha-chamah) (netz means the coming-out of the sun, as in the verse 'the pomegranates have budded (heineitzu)'), so that he would finish the Shema and its blessings exactly at sunrise, and join the Shemoneh Esrei prayer to it immediately at sunrise (thereby joining redemption to prayer). Whoever is able to arrange to do this, his reward is very great. The Rema adds: The measure of 'sunrise' referred to here is roughly one hour before the entire body of the sun has risen above the earth (so cited from the Rambam, chapter 1).
ס״ק אזמן ק"ש
(א) זמן ק"ש - וברכות ק"ש לפניה ג"כ אין לומר קודם הזמן הזה:
(1) 'The time for reciting Shema' — the blessings of the Shema that precede it likewise may not be said before this time.

(ב) הרגיל עמו קצת - כאכסנאי דאתי לפרקים דאי רגיל עמו הרבה אפילו רחוק ממנו מכירו ואי אינו רגיל כלל אפילו קריב לגביה אינו מכירו. ונקבע זה הזמן לק"ש אף דמקצת אנשים קמים ממטתם משעלה עה"ש וקרינן ביה ובקומך מן התורה דלכן בדיעבד יצא וכדלקמן בסעיף ד' מ"מ כיון דרובא דאינשי לא קיימי עד שיכיר א' את חבירו ועוד מפני שקבעו פ' ציצית בק"ש דכתיב בה וראיתם אותו לפיכך קבעו חכמים זמנה משיכיר בין תכלת ללבן והוא הזמן דמשיכיר את חבירו ברחוק ד"א:
(2) 'With whom he is somewhat familiar' — like a guest who comes only from time to time; for if he is very familiar with him, he would recognize him even from farther away, and if he is not familiar with him at all, he would not recognize him even up close. This time was fixed for the Shema even though some people rise from their beds already from dawn, and for them the Torah's phrase 'and when you rise up' would apply from then by Torah law — which is why after the fact one fulfills his obligation, as stated below in se'if 4. Nevertheless, since most people do not arise until one can recognize a fellow, and furthermore because they included the passage of tzitzis in the Shema, about which it is written 'and you shall see it,' therefore the Sages fixed its time from when one can distinguish between the blue (techeiles) and the white, which is the same time as when one can recognize a fellow at a distance of four cubits.

(ג) עד סוף - ולכתחילה אסור להתאחר עד אותו הזמן [שנות אליהו בשם הירושלמי]:
(3) 'Until the end' — but ideally (lechatchilah) it is forbidden to delay until that last moment [Shenos Eliyahu in the name of the Yerushalmi].

(4) 'Three hours' — for it is the way of princes to rise at that hour, and therefore the phrase 'and when you rise up' still applies then. One counts these three hours from the time of dawn; so wrote the Magen Avraham. But the opinion of the Vilna Gaon is that one counts from sunrise. As far as the ideal practice is concerned there is no practical difference between them, since in any case it is forbidden to delay, as stated above in se'if katan 3.

(5) 'Which is a quarter of the day' — there is no difference between the summer days, when the day is long, and the winter days, when the day is short; we reckon the day as twelve (proportional) hours, and always a quarter of the day is the time for Shema. Therefore one must be careful in the winter days to hurry to read the Shema, since the day is short and a quarter of the day is short [Taz]. But in truth, in the summer days one must be even more careful, for people tend to rise at the same clock-time as in winter, and by then the time for Shema has already come and gone; for the longer the day, the earlier the deadline for Shema arrives, and one must finish the whole of it within its time. Those who delay the Shema for the sake of tzitzis or tefillin are mistaken; rather he should read the Shema with its blessings in its time even without tzitzis and tefillin, and when he obtains them he should put them on and read with them the Shema, or another passage, or a psalm from Tehillim. And even if he is in doubt whether the time for Shema may pass, he likewise should not wait for a tallis and tefillin, for these do not hold one another back (they are not interdependent). But otherwise (if there is no such time pressure) he should wait, for whoever reads the Shema without tefillin is as if he bears false testimony against himself. There are people who delay the time of Shema for the sake of praying with a congregation, and this too is contrary to the law. In any case they should take care to read the Shema in its time before the prayer service and to have in mind to fulfill the obligation thereby, as stated above at the end of Siman 46 in the Mishnah Berurah; see there. One should not delay the reading in the synagogue for the sake of the elderly who come late, such that they would have to pray alone, since through this the time of Shema would pass; for we do not tell a person, 'Sin so that your fellow may gain merit.' On Shabbos and Yom Tov it is very common for the time of Shema to pass, for various reasons; therefore the wise man, whose eyes are in his head, will gather a minyan and pray earlier, or at the very least read the Shema in its time before he stands to pray with the congregation, as stated above at the end of Siman 46; and see there in the commentary of the Vilna Gaon and in the Bi'ur Halachah there.
ס״ק ושהי' מכוונין
(ו) שהי' מכוונין - כי עיקר מצות תפילה לכתחילה הוא מעת התחלת הנץ מדכתיב יראוך עם שמש וכמו שנתבאר לקמן בסימן פ"ט ואם היו מתחילין לקרותה משיכיר את חבירו היה הרבה בין זה השיעור ובין הנץ והיה להם להתאחר אחר ק"ש ולהמתין עד שתנץ החמה ולא היו סומכין גאולה לתפלה לכן היו מכוונין לקרותה סמוך להנץ החמה ולגומרה עם הנץ:
(6) 'Who would time it' — for the primary time for the mitzvah of prayer, ideally, is from the moment sunrise begins, as it is written 'they shall fear You with the sun,' as explained further in Siman 89. And if they were to begin reading the Shema from when one can recognize a fellow, there would be a large gap between that point and sunrise, and they would have to delay after the Shema and wait until the sun rose, and they would not be joining redemption to prayer. Therefore they would time it to read the Shema close to sunrise and to finish it exactly at sunrise.

(ז) הנץ החמה - היא השעה שהחמה מתחלת לזרוח בראשי ההרים:
(7) 'Sunrise' — it is the moment when the sun begins to shine upon the tops of the mountains.
ס״ק חמאד
(ח) מאד - ומובטח לו שהוא בן עוה"ב ולא יוזק כל אותו היום:
(8) 'Very [great]' — he is assured that he is destined for the World to Come and that he will not be harmed the entire day.
ס״ק טשיעור שעה
(ט) שיעור שעה - ויש גורסין עישור שעה ועיין בביאור הגר"א שכתב שצ"ל שליש עישור שעה ועי' בבאור הלכה:
(9) 'The measure of an hour' — some have the reading 'a tenth of an hour' (isur sha'ah), and see the commentary of the Vilna Gaon, who wrote that the correct text should be 'a third of a tenth of an hour,' and see the Bi'ur Halachah.
אם לא קרא אותה קודם הנץ החמה יש לו ילהקדים לקרותה יאבמהרה כל מה שיוכל:
If a person did not recite the Shema before sunrise, he should hurry to recite it as early as he possibly can.
ס״ק ילהקדים
(י) להקדים - דזריזין מקדימין למצות ומ"מ אין צריך להתפלל עבור זה ביחידי או לקרות בלא תפילין ועיין בסוף סימן מ"ו במשנה ברורה:
(10) 'To hurry [it earlier]' — for the zealous perform mitzvos at the earliest opportunity. Nevertheless, one need not for this reason pray alone or read without tefillin; see the end of Siman 46 in the Mishnah Berurah.

(יא) במהרה - מכאן תוכחת מגולה לבני אשכנז שמאחרים מאד ק"ש ואחז"ל אלמלא לא נברא העולם אלא בשביל קבלת מלכות שמים די ועי' לקמן בסימן פ"ט במ"ב סקכ"ב דנכון למנוע מלשתות הטיי וקאפע בבוקר קודם התפילה באסיפת חברים עי"ש:
(11) 'As early as he can' — from here comes an open rebuke to those of Ashkenaz who delay the Shema greatly. The Sages said: had the world been created for no other purpose than the acceptance of the yoke of Heaven, that alone would suffice. See further in Siman 89, in the Mishnah Berurah se'if katan 22, that it is proper to refrain from drinking tea and coffee in the morning before prayer at a gathering of friends; see there.
מי שהוא יבאנוס כגון שהי' יגמשכים לצאת לדרך במקום גדודי חיה ולסטים שלא יוכל לעמוד ולא לכוין אפי' פרשה ראשונה ואפילו עד (על) לבבך או שבני השיירא (קאראוואני בלע"ז) הולכים מהרה ולא ימתינו לו ידכלל טויכול טזלקרותה עם ברכותיה משעלה עמוד השחר דכיון שעלה עמוד השחר שפיר קרינן ביה ובקומך וגם שפיר מקרי יזיוצר אור אבל אם אינו במקום גדודי חיה ולסטים וגם אין בני השיירא נחפזים כ"כ אפי' יוצא לדרך אחר שעלה' עמוד השחר אינו קורא עד שיגיע זמנה:
One who is under duress (an oness), such as one who must rise early to set out on a journey through a place of wild-animal packs and bandits, so that he will not be able to stop and concentrate even on the first paragraph, and not even up to the words 'al levavecha' ('upon your heart'), or where the members of the caravan (karavani in the vernacular) are moving quickly and will not wait for him at all — he may recite the Shema with its blessings from the time that dawn (amud ha-shachar) has risen, since once dawn has risen we may properly apply to it the verse 'and when you rise up' (uvekumecha), and it is also properly called a time to say 'Yotzer Or' (Former of light). But if he is not in a place of wild-animal packs and bandits, and the members of the caravan are also not so hurried, then even though he is setting out on the road after dawn has risen, he does not recite it until its proper time arrives.

(יב) אנוס - וה"ה כשיש קבורת מת בעיר או מילה או יום ערבה דמפשי ברחמים וצריך להקדים את עצמו יכול לקרותה משעלה עה"ש:
(12) 'Under duress' — and likewise when there is a burial of a deceased in the city, or a circumcision, or Hoshana Rabbah (the day of the willow), when they lengthen the prayers of supplication, and one needs to make himself early, he may recite it from when dawn has risen.

(יג) משכים - פי' שאין לו פנאי להמתין ולהתעכב עד הזמן משיראה כגון שצריך לצאת לדרך וה"ה שאר ענינים כיוצא בזה שאין לו פנאי כדאיתא בטור:
(13) 'Rises early' — meaning that he has no free time to wait and tarry until the proper time of 'when one can see [a fellow],' such as when he needs to set out on a journey, and likewise other similar matters where he has no free time, as stated in the Tur.

(יד) כלל - אם ירצה לקרות באמצע הדרך ומיירי דזמן הליכתו עם השיירא או בכל כיוצא בזה ימשך עד סוף זמן ק"ש:
(14) 'At all' — if he wishes to read in the middle of the journey, and the case is where the time of his travel with the caravan, or the like, would extend past the end of the time for Shema.

(טו) יכול וכו' - וגם יש לו להתפלל בביתו אחר ק"ש וברכותיה:
(15) 'He may, etc.' — and he should also pray in his home after the Shema and its blessings.
ס״ק טזלקרותה
(טז) לקרותה - ויניח תפילין ולא יברך עליהם קודם שיגיע הזמן דמשיראה את חבירו ברחוק ד"א ויכירנו וכנ"ל בסימן ל':
(16) 'To recite it' — and he should put on tefillin but not recite a blessing over them before the time arrives of 'when one can see a fellow at a distance of four cubits and recognize him,' as stated above in Siman 30.
ס״ק יזיוצר אור
(יז) יוצר אור - והמ"א ופמ"ג פסקו דאין לומר יוצר אור כ"כ בהשכמה עד שיכיר בין תכלת ללבן והוא הזמן דעד שיראה חבירו ברחוק ד"א הנ"ל. גם בביאור הגר"א מצדד כהמ"א ובלא"ה צריך לכתחילה להמתין אם יוכל מחמת מצות תפילין וכנ"ל:
(17) 'Yotzer Or' — the Magen Avraham and the Pri Megadim ruled that one should not say Yotzer Or so early in the morning, until one can distinguish between the blue and the white, which is the time of 'until one can see his fellow at a distance of four cubits' mentioned above. The commentary of the Vilna Gaon also inclines toward the Magen Avraham's view. And in any case one must ideally wait, if he is able, on account of the mitzvah of tefillin, as stated above.
אם קראה משעלה יחעמוד השחר אע"פ שלא היה אנוס יטיצא בדיעבד: ואם קראה בלא ברכות יחזור לקרותה בזמנה עם הברכות ועי' לקמן סי' ס' (ב"י סי' מ"ו):
If a person recited the Shema from the time dawn rose, even though he was not under duress, he has fulfilled his obligation after the fact (bedi'avad). And if he recited it without the blessings, he should recite it again at its proper time with the blessings. See further in Siman 60. (Beis Yosef, Siman 46).
ס״ק יחעמוד השחר
(יח) עמוד השחר - י"א דעמוד השחר הוא מעט קודם שהאיר פני המזרח וי"א דעמוד השחר נקרא משהאיר פני המזרח ועיין בבה"ל וזה הזמן הוא קודם הזמן דמשיראה את חבירו הנ"ל בס"א:
(18) 'Dawn' — some say that dawn (amud ha-shachar) is a little before the face of the east has become light, and some say that dawn is called from when the face of the east has become light; and see the Bi'ur Halachah. This time is earlier than the time of 'when one can see a fellow' mentioned above in se'if 1.

(יט) יצא - דמקצת אנשים קמים באותו הזמן וקרינן ביה ובקומך ובדיעבד העמידוהו על דין תורה ודוקא באקראי בעלמא דהיינו פ"א בחודש הוא דיוצא בדיעבד אבל אם הוא רגיל לעשות כן אמרו חכמים שאפילו בדיעבד לא יצא וצריך לחזור ולקרותה מיהו אם שעת הדחק הוא אפילו רגיל טובא שרי דמאי הו"ל למיעבד:
(19) 'He has fulfilled his obligation' — for some people arise at that time, and the verse 'and when you rise up' applies to it, and after the fact they upheld it according to Torah law. But this is specifically when it is a mere chance occurrence, that is, once a month, that one fulfills his obligation after the fact; but if he regularly does so, the Sages said that even after the fact he has not fulfilled his obligation, and he must go back and read it again. However, if it is a pressing circumstance, it is permitted even if he does so very often, for what else could he have done?
אם נאנס ולא קרא ק"ש ערבית עד שעלה עמוד השחר כיון שעדיין לא הנץ כהחמה קורא ק"ש ויוצא בה ידי חובת קריאת שמע ערבית ואם היה אנוס באותה שעה לצאת לדרך מקום גדודי חיה ולסטים כאלא יקרא אז ק"ש פעם כבשנית לצאת בה ידי חובת ק"ש של יום שמאחר שעשה לאותה שעה לילה אי אפשר לחזור כגולעשותה יום:
If a person was under duress and did not recite the evening Shema (Maariv) until dawn had risen, since the sun has not yet risen he may still recite the Shema and thereby fulfill his obligation of the evening Shema. But if at that same hour he is under duress to set out on a journey to a place of wild-animal packs and bandits, he should not then recite the Shema a second time in order to fulfill with it the obligation of the daytime Shema, for since he has treated that hour as night (for the evening Shema), it is impossible to turn around and treat it as day.

(כ) החמה - ומקצת אנשים ישנים באותו הזמן לכן בשעת הדחק קרינן ביה ג"כ ובשכבך אבל בלא"ה אפילו בדיעבד לא יצא:
(20) 'The sun [has not yet risen]' — and some people are still asleep at that time, therefore in a pressing circumstance we may also apply to it the verse 'and when you lie down,' but otherwise, even after the fact, he has not fulfilled his obligation.

(21) 'He should not recite' — there are those who disagree on this; see the Eliyah Rabbah and the commentary of the Vilna Gaon.

(כב) שנית - אפילו אחר שיגיע הזמן דשיכיר את חבירו ברחוק ד"א:
(22) 'A second time' — even after the time arrives of 'when one can recognize a fellow at a distance of four cubits.'
ס״ק כגולעשותה יום
(כג) ולעשותה יום - אלא ימתין אולי יזדמן לו לקרותה בזמנה כהלכתה:
(23) 'And treat it as day' — rather he should wait; perhaps the opportunity will arise for him to read it in its proper time, according to the law.
אע"פ שזמנה נמשך עד סוף השעה הג' אם עברה שעה ג' ולא כדקראה קורא אותה בברכותיה כל כהשעה ד' שהוא שליש היום ואין לו שכר כקורא בזמנה ואם כועברה שעה ד' ולא קראה כזקוראה בלא ברכותיה כל היום:
Even though its proper time extends until the end of the third hour, if the third hour passed and he did not recite it, he may still recite it with its blessings throughout the fourth hour, which is a third of the day, though he does not receive the reward of one who recites it in its proper time. And if the fourth hour passed and he still did not recite it, he recites it without its blessings the entire day.

(כד) קראה - אפי' בפשיעה ונראה פשוט דמה שכתב ולא קראה ל"ד דה"ה אפילו קרא אותה כולה מקודם בזמנה בלא ברכותיה אלא לרבותא נקטיה דלא נימא כיון דלא קראה כלל עד עתה גרוע יותר וכ"כ בהדיא בב"י סוף סימן מ"ו עי"ש ובתשובת משכנות יעקב סימן ע"ז מפקפק בזה היכא דמתחלה קרא את כולה עי"ש:
(24) 'He recited it' — even if he failed to do so through negligence. It seems obvious that the wording 'and did not recite it' is not to be taken precisely (lav davka), for the same applies even if he had already read all of it earlier in its time but without its blessings — rather he stated it for emphasis, so that we should not say that since he had not read it at all until now his case is worse. So it is written explicitly in the Beis Yosef at the end of Siman 46; see there. But in the responsa Mishkenos Yaakov, Siman 77, he raises a doubt about this in a case where he originally read all of it; see there.
ס״ק כהשעה ד'
(כה) שעה ד' - דברכות אינם שייכים לק"ש דאע"פ שנתקנו קודם ק"ש מ"מ לאו ברכת ק"ש היא שהרי אינו מברך אקב"ו לקרות שמע והרי הם כמו תפילה ולפיכך דינם כמו תפילת השחר שהוא רק עד שליש היום:
(25) 'The fourth hour' — for the blessings do not intrinsically belong to the Shema; although they were instituted before the Shema, they are nevertheless not blessings of the Shema itself, for he does not recite a blessing 'who sanctified us with His commandments and commanded us to read the Shema.' Rather they are like prayer, and therefore their law is like that of the morning prayer, which extends only until a third of the day.

(כו) עברה שעה ד' - אפילו נאנס אפ"ה מכאן ואילך הפסיד הברכות. ואם בירך הוי ברכה לבטלה ועיין בביאור הלכה:
(26) 'The fourth hour passed' — even if he was under duress, nevertheless from here onward he has forfeited the blessings. And if he recited them, it is a blessing in vain. See the Bi'ur Halachah.

(כז) קוראה - עיין בלבוש שכתב יכול לקרותה וכו' והכוונה הוא שטוב שיקראנה כדי שיקבל עליו עול מ"ש אבל אינו מחוייב שאינו מקיים בזה המ"ע דק"ש וכמו שהסכימו כל האחרונים שאין נמשך זמן ק"ש מן התורה רק עד ג' שעות וכנ"ל ודע דמ"מ פ' ציצית או שארי פסוקים שהם מזכירת י"מ מחוייב מן התורה כל היום דהא מן התורה לא נקבע זמן לזכירתה וכמו שכתב הש"א סימן י' דעד הערב הוא זמן לזכירת י"מ עי"ש:
(27) 'He recites it' — see the Levush, who wrote 'he may recite it, etc.,' and the meaning is that it is good for him to recite it in order to accept upon himself the yoke of Heaven, but he is not obligated, since he does not fulfill through it the positive commandment of Shema, as all the later authorities agreed that the Torah-level time of Shema extends only until three hours, as stated above. And know that nevertheless the passage of tzitzis, or other verses that are part of the remembrance of the Exodus from Egypt, one is obligated in by Torah law the entire day, for by Torah law no fixed time was set for that remembrance, as the Sha'agas Aryeh wrote in Siman 10, that until evening is the time for the remembrance of the Exodus from Egypt; see there.
אם לא קראה ביום י"א כחשיש לה תשלומין בערבית וכן אם לא קרא ק"ש בערבית יש לה תשלומין ביום כטויש חולקים:
If a person did not recite the Shema during the day, there are those who say that it has a make-up (tashlumin) at the evening Shema. And likewise, if he did not recite the Shema in the evening, it has a make-up during the day. But there are those who disagree.
ס״ק כחשיש לה תשלומין
(כח) שיש לה תשלומין - אין הכונה שיצא בזה ידי ק"ש מאחר שכבר עבר זמנה ואינו אלא כקורא בתורה רק שלכתחילה צריך להשלימה כמו תפילה ע"כ מיבעי ליה לאקדומי חובת שעתא ברישא ותיכף אחר מעריב יקרא עוד שמע בשביל זה הפעם שחיסר אם בשוגג חיסרה כמו שנתבאר לקמן בסימן ק"ח:
(28) 'That it has a make-up' — the intent is not that he fulfills through this his obligation of Shema, since its time has already passed, and it is only like one reading in the Torah; rather, ideally he must make it up, just as with prayer. Therefore he should give precedence to the obligation of the present hour first, and immediately after Maariv he should read the Shema again on account of the time he missed, if he missed it inadvertently, as explained further in Siman 108.

(כט) ויש חולקין - הגר"א והברכי יוסף הכריעו כדעה זו:
(29) 'But there are those who disagree' — the Vilna Gaon and the Birkei Yosef ruled in accordance with this opinion.
