סעיף א׳

אאסור לתלות תפילין בבין בבתים בין ברצועות אבל מותר לתלותן גבכיסן:

It is forbidden to hang tefillin, whether by the boxes (the batim) or by the straps, but it is permitted to hang them by their bag.

ס״ק אאסור לתלות

(א) אסור לתלות - על היתד מפני שהוא דרך בזיון:

(1) 'It is forbidden to hang' — on a peg, because that is a manner of disgrace.

(ב) בין בבתים - שהבתים תלויות למטה ובין שהרצועות תלויות למטה. ומ"מ באקראי בעלמא שאוחז התפילין בידו והרצועות תלויות למטה אין להקפיד אבל אם התפילין תלויין אסור בכל גווני ואין בכלל זה מה שהתש"ר תלוי באויר ומחזיקן ביד ברצועות ומשימם על הראש כי זהו צורך הנחתן. ויש מניחין הש"ר על הדף וכדומה בשעה שלובשין:

(2) 'Whether by the boxes' — meaning whether the boxes hang down or the straps hang down. Even so, in a merely incidental case, where he holds the tefillin in his hand and the straps hang down, one need not be strict; but if the tefillin themselves are hanging, it is forbidden in every case. Not included in this is when the head-tefillin hangs in the air and he holds it by the straps and sets it on his head, for that is a need of putting it on. And some place the head-tefillin on a shelf or the like at the time they are putting them on.

(3) 'By their bag' — but a Torah scroll is forbidden to be hung in any case, even when it is in the holy ark and one hangs the ark; and see the Chayei Adam (ח"א), klal 31, who wrote that even when the ark is fixed by pegs to the wall it is forbidden, as long as nothing stands beneath it; and books, such as volumes of the Talmud and the like, are similar to tefillin (in this). Even so, books or prayer-siddurim that are fixed onto boards (covers) which have a silver chain — it is forbidden to hang them by it, for the boards are not like a bag, since they are attached to the siddur and are as the siddur itself. It is permitted to write verses on paper and hang them at the entrance of the synagogue. People have the custom to fast when tefillin fall from one's hand to the ground without their case; and the same applies when a Torah scroll falls, even in its case. And see the Eliyah Rabbah, who wrote that even for tefillin in their case one should give a coin to charity.

בית שיש בו דתפילין אסור לשמש בו המטתו ועד שיוציאם או שיניחם זבכלי תוך כלי והוא חשאין השני מיוחד להם שאם הוא מיוחד אפי' מאה חשובים כא': הגה ואם שניהם אינן מיוחדים להם או שהפנימי אינו מיוחד להם והחיצון מיוחד להם מותר וע"ל סי' ר"מ ס"ו'. (ב"י):

A room in which there are tefillin — it is forbidden to have marital relations there, until he removes them, or places them in a vessel inside a vessel (a double covering); and this is provided the second vessel is not designated for them, for if it is designated for them, then even a hundred coverings count only as one (and do not help). (ד) תפילין - וה"ה חומשים או סדורי תפילות או שאר ספרים בין בכתיבה או בדפוס הכל יש בהם קדושה ובעינן כלי תוך כלי ואפילו אם הן כתב משיט"א [היינו שאינה כתיבת סת"ם והוא רק כתב אשורי] וכריכת הספר אינה נחשבת לכיסוי דהיא מגוף הספר ובעינן עוד שני כיסויין. ועיין ביו"ד בסי' רע"א בט"ז שם סק"ח שכתב כל המיקל בקדושת ספרים הנדפסין עתיד ליתן את הדין דדפוס הוי כמו כתיבה. אך בתשובת חו"י סי' קפ"ז נוטה להקל בזה בשעת הדחק כשאין לו במה לכסות:

(4) 'Tefillin' — and the same applies to Chumashim, or prayer-siddurim, or other holy books, whether handwritten or printed — they all have sanctity in them, and we require a vessel inside a vessel; and even if they are in Mashita script [that is, not scribal (STaM) writing, but only Assyrian square script]; and the binding of the book is not counted as a covering, since it is part of the book's body, and we require yet two more coverings. And see Yoreh De'ah, siman 271, in the Taz there, sub-paragraph 8, who wrote that whoever is lenient with the sanctity of printed books will in the future have to give an accounting, for print is like writing. But in the responsa Chavos Yair (חו"י), siman 187, he leans to be lenient in this in a pressing situation, when he has nothing with which to cover them.

ס״ק המטתו

(ה) מטתו - או לעשות צרכיו:

(5) 'Marital relations' — or to relieve himself.

ס״ק ועד שיוציאם

(ו) עד שיוציאם - בחדר אחר או שמפסיק בפניהם במחיצה גבוה יו"ד טפחים. ועיין לקמן בסי' ר"מ במ"א סקט"ו:

(6) 'Until he removes them' — to another room, or he interposes before them a partition ten handbreadths high. And see below, siman 240, in the Magen Avraham, sub-paragraph 15.

(ז) בכלי תוך כלי - ל"ד כלים דה"ה שני כיסויין ואם פירש טלית או שאר כיסוי על הכיס של תפילין אע"פ שהכיסוי אין מכסה רק למעלה ומן הצדדין ולא למטה אפ"ה שרי. ועיין בבה"ל. ואותן המניחין כיס התפילין והטלית לתוך כיס אחד גדול הרי גם הכיס הגדול נקרא כליין המיוחד להן וצריך עוד כסוי על גבן אם לא שמכסה בטלית על התפילין בתוך הכיס דאז שרי דהטלית אינו כליין וה"ה אם כיס התפילין מחובר למעלה על הכיס הגדול הרי צד הב' של כיס הגדול אין נקרא כליין ומועיל להן אם הפכן. ועיין בביאור הלכה מה שכתבתי בשם הא"ר. כתב המ"א דה"ה במזוזה הקבועה לפנים בחדר צריך כלי בתוך כלי דהיינו שיכסה אותה בב' כסויין ואחד מהם יהיה עכ"פ אינו מיוחד לה וכדלקמן ואם על המזוזה יש כסוי זכוכית אף שהמזוזה נראית מתוכה אפ"ה נחשבת כסוי אחד ודי בפריסת סודר על המזוזה דהא עתה לא מיתחזיא וכ"כ הדה"ח. אבל לכו"ע לא מהני אם יכסנה עוד בזכוכית מלמעלה אע"ג שמכוסה בשני כסויין דהא המזוזה נראית מתוכן. כתב בחכמת אדם נ"ל דבין במזוזה או שאר ספרים אם עשה מתחלה ב' כלים שיחשב אחד לכלי בתוך כלי כגון שכרך המזוזה בנייר ואח"כ הניחה בתיק שלה מותר כיון שבתחלה כיון לכך. ויתר כל הדינים בזה נבאר לקמן בסימן ר"מ בעזה"י:

(7) 'A vessel inside a vessel' — it is not precisely vessels, for the same applies to two coverings; and if he spread a tallit or another covering over the bag of the tefillin — even though the covering covers only from above and on the sides but not below — even so it is permitted. And see the Biur Halacha. As for those who put the tefillin bag and the tallit into one large bag — the large bag too is called a vessel designated for them, and one needs yet another covering over them; unless he covers the tefillin with the tallit inside the bag, for then it is permitted, since the tallit is not their designated vessel. And likewise, if the tefillin bag is attached at the top to the large bag, then the other side of the large bag is not called their vessel and it avails for them if he inverts it. And see the Biur Halacha for what I wrote in the name of the Eliyah Rabbah. The Magen Avraham wrote that the same applies to a mezuzah fixed inside a room: it requires a vessel inside a vessel, that is, he should cover it with two coverings, and at least one of them should not be designated for it, as below; and if over the mezuzah there is a glass covering, even though the mezuzah is seen through it, even so it counts as one covering, and it suffices to spread a cloth over the mezuzah, since now it is not visible — and so wrote the Derech HaChaim (דה"ח). But according to all opinions it does not avail if he covers it further with glass from above, even though it is covered by two coverings, since the mezuzah is seen through them. The Chochmas Adam wrote: it seems to me that, whether regarding a mezuzah or other books, if he made two vessels from the outset so that one may count toward a vessel inside a vessel — such as wrapping the mezuzah in paper and afterward placing it in its case — it is permitted, since from the start he intended it thus. And the rest of all the laws in this we will explain below, in siman 240, with God's help.

ס״ק חשאין השני

(ח) שאין השני - לאו דוקא וה"ה אם הפנימי אינו מיוחד והחיצון מיוחד או ששניהם אינם מיוחדים וכמו שכתוב בהג"ה ואינו אסור כלי בתוך כלי רק אם שניהם מיוחדים אבל אם אחד אינו מיוחד מצטרף עם המיוחד ושרי וההג"ה לא בא רק לפרש דברי המחבר דלא נטעה בלישניה וכלי אחד אפילו אינו מיוחד לא מהני ואסור:

(8) 'That the second' — this is not precise, for the same applies if the inner one is not designated and the outer one is designated, or if both are not designated, as is written in the Rema's gloss; and a vessel inside a vessel is forbidden only if both are designated, but if one is not designated it combines with the designated one and is permitted. The gloss came only to explain the words of the Mechaber, so that we not err in his phrasing — that a single vessel, even if not designated, does not avail and is forbidden.

אפילו להניח בכלי בתוך כלי אסור להניחם תחת מרגלותיו וכן אסור להניחם תחת מראשותיו טכנגד ראשו אפילו בכלי תוך כלי ואפי' אין אשתו עמו אבל שלא כנגד ראשו אם אין אשתו עמו ימותר ואם אשתו עמו צריך כלי יאבתוך כלי:

Even to place them in a vessel inside a vessel is forbidden beneath his feet (at the foot of the bed); and likewise it is forbidden to place them beneath his head-place opposite his head, even in a vessel inside a vessel, and even if his wife is not with him; but not opposite his head — if his wife is not with him, it is permitted, and if his wife is with him, he needs a vessel inside a vessel.

(ט) כנגד ראשו - שהוא ג"כ דרך בזיון:

(9) 'Opposite his head' — for that too is a manner of disgrace.

ס״ק ימותר

(י) מותר - אפילו שלא בכלי כלל רק שמניחן בענין שלא יתגלגלו משם לצדדין כגון שמניחן בין כר התחתון לכר שתחת ראשו שלא כנגד ראשו:

(10) 'It is permitted' — even with no vessel at all, provided he places them in a way that they will not roll away to the sides, such as placing them between the lower pillow and the pillow beneath his head, not opposite his head.

ס״ק יאבתוך כלי

(יא) בתוך כלי - דהיינו שמניחן בתוך כלי או כיס המיוחד להן תחת הכר דהכר מיקרי כלי שני או שיניחן בלי כלי כלל תחת שני כרין ולא התירו חכמים להניח תפילין תחת מראשותיו כשאשתו עמו אפילו בכלי תוך כלי אלא כדי שישתמרו מן הגנבים והעכברים ולפיכך אם יש לו מקום אחר שמשתמרים שם לא יניחם כלל במטה. ומיהו אם יש למעלה מראשותיו מקום יוצא מן המטה שהוא גבוה ג"ט או נמוך ג' טפחים למטה מראשותיו מותר להניחן עליו:

(11) 'Inside a vessel' — that is, he places them inside a vessel or bag designated for them beneath the pillow, for the pillow is deemed a second vessel; or he places them with no vessel at all beneath two pillows. The Sages permitted placing tefillin beneath his head-place when his wife is with him, even in a vessel inside a vessel, only so that they be guarded from thieves and mice; therefore, if he has another place where they are guarded, he should not place them in the bed at all. However, if above his head-place there is a spot projecting from the bed that is three handbreadths high, or three handbreadths lower than his head-place, it is permitted to place them upon it.

אשתו עמו במטה ואינו רוצה לשמש יבמקרי אין אשתו עמו:

If his wife is with him in the bed but he does not wish to have relations, this is deemed as though his wife is not with him.

(12) 'Is deemed, etc.' — but the Taz forbids his wife to be with him in the bed until he places the tefillin in a vessel inside a vessel, lest he forget and have relations; and so is implied in the commentary of the Vilna Gaon; and see the Eliyah Rabbah.

סעיף ה׳

להניחם במטה כנגד צדו יגדינן כתחת מרגלותיו:

To place them in the bed opposite his side — their law is like beneath his feet.

(יג) דינן וכו' - שפעמים מתהפך במטה וישכב עליהן ספסלים שבבהכ"נ שתחת הספסלים יש תיבה להצניע שם טלית ותפילין י"א דאסור לישב על הספסלין ויש מתירין אבל כשיש חלל טפח בהתיבה פנוי מותר ודאי לישב על הספסלין ובעל נפש ראוי לו להחמיר שלא במקום הדחק גם בזה כי תפילין יש להזהר בקדושתן מאד. ואם קבעו במסמרים לכותל מותר לישב על הספסל:

(13) 'Their law, etc.' — for at times he turns over in the bed and lies upon them. The benches in the synagogue beneath which there is a chest to store a tallit and tefillin — some say it is forbidden to sit on the benches, and some permit it; but when there is an empty space of a handbreadth in the chest, it is certainly permitted to sit on the benches. And a person of conscience should be stringent, when not in a pressing situation, in this too, for one must be very careful with the sanctity of tefillin. And if they fixed it (the chest) to the wall with nails, it is permitted to sit on the bench.

If he forgot and had marital relations while wearing tefillin, he should not grasp them by the boxes nor by the strap, until he washes his hands, because the hands are busy (they touch here and there), and perhaps they touched an unclean place.

(14) 'Until he washes his hands' — and afterward he removes them (his tefillin), until he wipes the emission, as is written in se'if 7.

ישן בהם וראה קרי לא יאחוז בבתים טואלא יאחוז ברצועה ומסיר אותם עד שיקנח הקרי מעליו טזויטול ידיו (ב"י):

If he slept in them and had a seminal emission, he should not grasp them by the boxes, but rather grasp them by the strap and remove them, until he wipes the emission off himself and washes his hands. (Beit Yosef).

(טו) אלא יאחוז וכו' - דבזה לא חיישינן כ"כ שמא נגעו במקום הטינופת ולכך הקילו לאחוז ברצועה ולהסירה כדי שלא להשהות התפילין על עצמו בעוד שהוא מטונף בהקרי:

(15) 'But rather grasp, etc.' — for in this we are not so concerned lest they touched an unclean place; and therefore they were lenient to grasp it by the strap and remove it, so as not to keep the tefillin on himself while he is soiled by the emission.

(טז) ויטול ידיו - אבל אח"כ מותר להניחן אע"פ שהוא טמא:

(16) 'And washes his hands' — but afterward it is permitted to put them on, even though he is impure.

הנכנס לסעוד' קבע יזחולצן ומניחן יחעל השלחן עד זמן ברכ' וחוזר ומניחן יטאבל לאכילת כעראי אין צריך לחלצן:

One who sits down to a fixed meal removes them (his tefillin) and places them on the table, until the time of the blessing (Grace), and then puts them back on; but for an incidental (casual) eating he need not remove them.

(17) 'Removes them' — for there is concern lest he become drunk at the meal and be disgraced in his tefillin.
