סעיף א׳

אירחץ ידיו בויברך על נטילת ידים: הגה וי"א גגם אשר יצר ודאפי' לא עשה צרכיו (וכן נהגו) (אבודרהם) מים הפסולים לנטילת ידים לסעודה לקמן סהימן ק"ס כשרים לנטילת ידים לתפלה מיהו יש מי שאומר דולא מברך עזלייהו:

One should wash his hands (upon rising in the morning), and recite the blessing 'al netilas yadayim' (on the washing of the hands). The Rema adds: Some say one also recites 'asher yatzar' (Who formed man), and this is so even if he did not relieve himself, (and so is the custom) (Abudraham). Water that is invalid for washing the hands for a meal, as listed further on in siman 160, is nevertheless fit for washing the hands for prayer; however, there is one who says that one does not recite the blessing over them.

ס״ק אירחץ ידיו וכו'

(א) ירחץ ידיו וכו' - יש ע"ז שני טעמים הרא"ש כתב לפי שידים של אדם עסקניות הן וא"א שלא יגע בבשר המטונף בלילה לזה תקנו חז"ל ברכה על הנטילה לק"ש ולתפלה והרשב"א כתב לפי שבשחר אחר השינה אנו נעשים כבריה חדשה דכתיב חדשים לבקרים רבה אמונתך צריכין אנו להודות לו יתברך שבראנו לכבודו לשרתו ולברך שמו ועל דבר זה תקנו בשחר כל אותן הברכות שאנו מברכין בכל בוקר לכן גם דבר זה תקנו בשחר להתקדש בקדושתו וליטול ידינו מן הכלי ככהן שמקדש ידיו מן הכיור קודם עבודתו. ולהלכה אנו תופסים כשני הטעמים לחומרא לענין נטילה וכדלקמן בזה הסימן. ואם לא בירך ענט"י קודם התפלה שוב לא יברך אחר התפלה לכו"ע [ח"א]:

'One should wash his hands, etc.' There are two reasons given for this (morning washing). The Rosh wrote: because a person's hands are 'askaniyos' — always busy, touching things — and it is impossible that during the night he did not touch a soiled part of the body, so for this the Sages instituted a blessing on the washing, for Kri'as Shema and prayer. And the Rashba wrote: because in the morning, after sleep, we become like a new creation, as it is written, 'They are new every morning; great is Your faithfulness,' we must give thanks to Him, may He be blessed, that He created us for His glory, to serve Him and bless His Name. And for this reason they instituted in the morning all those blessings that we recite each morning; therefore this too they instituted in the morning — to sanctify ourselves with His holiness and to wash our hands from a vessel, like a Kohen who sanctifies his hands from the laver before his service. As a matter of halacha we hold by both reasons stringently regarding the washing, as will be explained further in this siman. And if he did not recite 'al netilas yadayim' before prayer, he no longer recites it after prayer, by all opinions. (Chayei Adam)

ס״ק בויברך

(ב) ויברך - ומיד אחר הנטילה יברך וא"צ להמתין על הניגוב וגם הניגוב אין מעכב. ויש מחמירין שלא יברך עד אחר שינגב ידיו דס"ל דאין רוח רעה סר מהידים עד אחר הניגוב וס"ל דאסור לברך בידים שר"ר שורה עליהם אבל דעת הפוסקים אין כן [ארה"ח]. כתב בסדר היום שלא יגע במלבושיו עד שיטול ובגמרא לא משמע כן [מ"א] איתא בברכות דף נ"א אל תטול חלוקך שחרית מיד השמש ותלבש משום סכנת מזיקין אלא יטלהו בעצמו ממקום שהוא שם. ואפילו אותו השמש כבר נטל ידיו. אמרינן בגמרא רוחץ אדם פניו ידיו ורגליו בכל יום משום כבוד קונו. ובמדינותינו שאין אנו הולכים יחפים א"צ לרחוץ רגליו שחרית [פמ"ג]:

'And he recites the blessing.' Immediately after the washing he recites the blessing, and he need not wait for drying, and drying is also not indispensable. But some are stringent not to bless until after he dries his hands, for they hold the evil spirit does not leave the hands until after drying, and they hold it is forbidden to bless with hands upon which an evil spirit rests; but the view of the (other) poskim is not so. (Orchos Chaim) The Seder HaYom wrote that one should not touch his garments until he washes; but from the Gemara it does not appear so. (Magen Avraham) It is stated in Berachos, folio 51: Do not take your shirt in the morning from the hand of the attendant and put it on, because of the danger of harmful spirits, but rather take it himself from where it lies. And this is so even if that attendant has already washed his hands. We say in the Gemara: a person should wash his face, hands, and feet every day, out of respect for his Maker. But in our lands, where we do not go barefoot, one need not wash his feet in the morning. (Pri Megadim)

ס״ק גגם אשר יצר

(ג) גם אשר יצר - הטעם משום דבבוקר נעשה כבריה חדשה וצריכין אנו להודות לו וניתקן ברכת אלקי נשמה ואשר יצר על יצירת הגוף ויש עוד טעמים אחרים עיין באחרונים וכתב הפמ"ג דלפי הטעם דבריה חדשה אם היה ניעור כל הלילה דאז לא נעשה בריה חדשה בבוקר אין יכול לברך אשר יצר אם לא עשה צרכיו. יש אומרים דאם השתין בלילה יוכל לסמוך לענין ברכת אשר יצר על אשר יצר דשחרית וצ"ע לדינא גם פעמים רבות יקרה שבבוקר משתוקק עוד הפעם להטלת מי רגלים ולא יוכל לחול עוד הברכת אשר יצר דבבוקר ע"ז הטלה דלילה וכדלקמן בסי' ז' במ"ב ס"ק א'. וי"ש יחמיר על עצמו ויטול ידיו וילבוש מכנסים או יחגור בשאר דבר להפסיק בין לבו לערוה ויברך אשר יצר. אך יראה בעת הברכה להרחיק מהעביט של המי רגלים ד' אמות אם הוא עומד בחדרו ואם לא היה העביט מיוחד לזה די בהטלת רביעית מים לתוך המי רגלים בכל פעם ופעם שמשתין:

'Also asher yatzar.' The reason: because in the morning one becomes like a new creation and we must give thanks to Him, and the blessings 'Elokai Neshama' and 'asher yatzar' were instituted over the (renewed) forming of the body. There are other reasons as well; see the Acharonim. The Pri Megadim wrote that, according to the reason of 'a new creation,' if one was awake the entire night — for then he did not become a new creation in the morning — he cannot recite 'asher yatzar' unless he relieved himself. Some say that if he urinated at night, he may rely, for the 'asher yatzar' blessing, on the morning 'asher yatzar,' but this requires further study as to the halacha. Also, it often happens that in the morning one again feels the urge to urinate, and the morning 'asher yatzar' can no longer take effect for that upon the nighttime urination, as (explained) further in siman 7, Mishnah Berurah note 1. A God-fearing person should be stringent: wash his hands and put on trousers, or gird himself with something else to separate between his heart and his nakedness, and then recite 'asher yatzar.' But he should see, at the time of the blessing, to distance himself four amos from the chamber-pot of urine, if he is standing in his room; and if the pot was not designated for this, it suffices to cast a revi'is of water into the urine each and every time he urinates.

ס״ק דואפילו וכו'

(ד) ואפילו וכו' - והרוצה להסתלק מן הספק יזהר לעשות צרכיו תיכף אחר שעירה מים על ידיו ג"פ וכשיצא מבהכ"ס יטול ידיו פעם שניה ויברך אשר יצר ויצא ידי חובה לכו"ע. וטוב יותר שלא יברך אפילו ברכת נט"י עד לאחר נטילה שניה שנוטל אחר יציאתו מבהכ"ס ובפרט אם היה צריך לנקביו בעת נטילה ראשונה שאז בודאי אינו רשאי לברך. והח"א כתב דנכון להמתין מלברך ענט"י עד לאחר שמנקה עצמו ורוצה להתפלל עי"ש טעמו אח"כ מצאתי בספר מעשה רב שכן היה נוהג הגר"א ז"ל ועיין בבה"ל:

'And even, etc.' One who wishes to remove himself from the doubt should take care to relieve himself immediately after he has poured water over his hands three times, and when he leaves the privy he washes his hands a second time and recites 'asher yatzar,' and he has thereby fulfilled his obligation according to all opinions. It is even better not to recite even the 'netilas yadayim' blessing until after the second washing he does after leaving the privy, and especially if he needed to relieve himself at the time of the first washing, for then he certainly may not bless. The Chayei Adam wrote that it is proper to delay reciting 'al netilas yadayim' until after he has cleaned himself and wishes to pray; see there his reasoning. Afterward I found in the sefer Ma'aseh Rav that this was the practice of the Vilna Gaon, of blessed memory; and see the Bi'ur Halacha.

ס״ק הסימן ק"ס

(ה) סימן ק"ס - דהיינו מים שנשתנו מראיהן או נעשו בהם מלאכה או מלוחים או סרוחים שאין הכלב יכול לשתות מהם ומשו"ה ראוים לתפלה דכאן לא צריך רק משום נקיות בעלמא:

'Siman 160.' That is, water whose appearance has changed, or with which work was done (e.g., already used), or (water that is) salty or foul, such that a dog cannot drink from it. And for this reason they are fit for prayer, for here (the washing) is needed only for the sake of mere cleanliness.

ס״ק ודלא מברך

(ו) דלא מברך - ר"ל על נטילת ידים רק על נקיות ידים:

'That he does not bless.' That is, (he does not bless) 'al netilas yadayim' — only 'al nekiyus yadayim' (on the cleanliness of the hands).

ס״ק זעלייהו

(ז) עלייהו - והאחרונים הכריעו דיוכל לברך על נטילת ידים ועיין לקמן בסעיף ז' ובמ"ב ס"ק ט"ז:

'Over them.' The Acharonim decided that he may recite 'al netilas yadayim,' and see further, se'if 7 and Mishnah Berurah note 16.

סעיף ב׳

חידקדק טלערות עליהם מים יג' פעמים להעביר רוח רעה ששורה עליהן:

One should be scrupulous to pour water over them (his hands) three times, in order to remove the evil spirit (ruach ra'ah) that rests upon them (after sleep).

ס״ק חידקדק

(ח) ידקדק - כי חוץ מהטעמים הנזכרים בסק"א שצריך ליטול ידיו לתפלה צריך ליטול גם משום רוח רעה השורה על הידים אך היכא דהנטילה הוא משום רוח רעה לבד לא היו מתקנים ע"ז ברכה לכן אנו צריכים גם לטעמים הנ"ל:

'One should be scrupulous.' For besides the reasons mentioned in note 1 — that one must wash his hands for prayer — one must also wash on account of the evil spirit that rests upon the hands. However, where the washing is only on account of the evil spirit, they would not have instituted a blessing for it; therefore we need also the aforementioned reasons (to justify the blessing).

ס״ק טלערות עליהן

(ט) לערות עליהן - ויטלם לכתחילה עד פרק הזרוע ואם אין לו מים די עד קשרי אצבעותיו. וצריך לפשוט הכפות כמי שרוצה לקבל דבר ויגביהם כנגד הראש. גם טוב להדיח פיו ובתענית צבור לא ידיח:

'To pour over them.' Ideally he washes them up to the wrist-joint of the arm, and if he has little water, it suffices up to the knuckles of the fingers. He should spread out his palms like one who wishes to receive something, and raise them up to the level of the head. It is also good to rinse his mouth, but on a public fast day he should not rinse.

ס״ק יג"פ

(י) ג"פ - ואפילו שופך הרבה בפעם אחד אינו מועיל כי אין הרוח הולך אלא בג' פעמים דהיינו פ"א על יד ימין ואח"כ על יד שמאל עד ג"פ בסירוגין ובספר מעשה רב כתב ד' פעמים ג"פ להעביר רוח רעה והד' להעביר המים שנטמאו. צריך להזהיר לנשים שיזהרו בנט"י ג"פ בסירוגין כמו האנשים וגם כי הם מתקנות המאכלים שלא יטמאום בידיהם גם יש ליזהר שהקטנים יטלו ידיהם בשחרית כי נוגעים במאכל. ובנגיעת עכו"ם במאכלים בלא נט"י אין לחוש דלא מקבלי טומאה:

'Three times.' Even if he pours a great deal at one time, it does not help, for the (evil) spirit departs only through three (separate) times, that is, once on the right hand and then on the left hand, until three times, in alternation. In the sefer Ma'aseh Rav it is written (to pour) four times: three times to remove the evil spirit, and the fourth to wash away the water that became defiled. One must warn women to be careful about washing three times in alternation, just like the men, and also because they prepare the food, so that they not defile it with their hands. One should also be careful that children wash their hands in the morning, since they touch food. But regarding a non-Jew touching food without washing, there is no concern, for they do not receive this defilement.

סעיף ג׳

לא יגע בידו יאקודם נטילה לפה ולא לחוטם ולא לאזנים יבולא לעינים:

One should not touch, with his hand, before washing, his mouth, nor his nose, nor his ears, nor his eyes.

(יא) קודם נטילה - מפני שהרוח רעה השורה על הידים יוכל להזיק לאלו האיברים:

'Before washing.' Because the evil spirit that rests upon the hands can harm those limbs (the mouth, nose, ears, and eyes).

ס״ק יבולא לעינים

(יב) ולא לעינים - ויש ליזהר אפילו ע"ג עיניו מבחוץ אם אפשר לו:

'Nor his eyes.' One should be careful even about (touching) the eyes from the outside, if it is possible for him.

סעיף ד׳

יגאפילו מי שנטל ידיו לא ימשמש בפי הטבעת תמיד מפני שמביאתו לידי תחתוניות ולא יגע במקום הקזה שמשמוש היד מזיק לחבורה:

Even one who has already washed his hands should not constantly handle the anus, because this brings him to hemorrhoids (tachtoniyos), and he should not touch the site of bloodletting, for handling with the hand is harmful to the wound.

ס״ק יגאפילו וכו'

(יג) אפילו וכו' - וקודם נטילה יש אוסרין מליגע בפי הטבעת אפילו במקרה וכן לאמה במקום הנקב אפילו אם הוא נשוי וכן כה"ג במקום נקב הקזה כי אז יוכל הרוח רעה להזיק לכל נקב שבגוף:

'Even, etc.' Before washing, some forbid touching the anus even by chance, and likewise the male organ at the opening, even if he is married, and likewise, similarly, the site of a bloodletting opening, for then the evil spirit could harm any orifice in the body.

סעיף ה׳

לא יגע בגיגית שכר שמשמוש היד ידמפסיד השכר:

He should not touch a vat of beer, for handling with the hand spoils the beer.

ס״ק ידמפסיד השכר

(יד) מפסיד השכר - ואם נגע במאכל קודם שנטל ידיו אין לאסור המאכל עי"ז אבל לכתחילה מאוד יש ליזהר שלא ליגע אז בשום מאכל ואם נגע באוכל ידיחנו ג"פ. וכן אין לשתות עשן טבא"ק קודם נט"י:

'Spoils the beer.' If one touched food before he washed his hands, the food is not to be forbidden on account of this, but ideally one must be very careful not to touch any food at that time, and if he did touch food, he should rinse it three times. Likewise, one should not smoke tobacco before washing the hands.

סעיף ו׳

טואין צריך רביעית לנטילת ידים לתפלה:

One does not require a revi'is (of water) for washing the hands for prayer.

ס״ק טואין צריך

(טו) אין צריך - ר"ל דיעבד אין מעכב הברכה ומברך על נטילת ידים אבל לכתחילה טוב להקפיד שיהיה לו ג"כ רביעית וכמו שכתב בסעיף שאחר זה דקאי גם על שיהיה לו רביעית וכמו שכתבו האחרונים:

'One does not require.' That is, after the fact (a revi'is) does not prevent the blessing, and he recites 'al netilas yadayim.' But ideally it is good to be particular that he have a revi'is as well, as (implied by) what is written in the following se'if, which applies also to having a revi'is, as the Acharonim have written.

סעיף ז׳

טוב להקפיד בנטילת ידים שחרית בכל הדברים המעכבים בנטילת ידים לסעודה ( הגה מיהו אטזינו מעכב ליזא כלי ולא כח גברא ושאר דברים הפוסלים בנטילת הסעודה (מרדכי ריש פ' אלו דברים תשובת רשב"א סימן קצ"א):

It is good to be particular regarding the morning washing of the hands about all the things that are indispensable for washing the hands for a meal. The Rema adds: However, (for the morning washing) it is not indispensable — not (the requirement of) a vessel, nor human power (koach gavra), nor the other things that disqualify the washing for a meal (Mordechai, beginning of the chapter Elu Devarim; responsum of the Rashba, siman 191).

ס״ק טזאינו מעכב

(טז) אינו מעכב - ר"ל דיעבד לענין הברכה ויוכל לברך ענט"י או אפילו לכתחלה היכא דאי אפשר בענין אחר אבל היכא דאפשר טוב להקפיד:

'Is not indispensable.' That is, after the fact regarding the blessing — he may recite 'al netilas yadayim,' or even ideally where it is impossible in another way; but where it is possible, it is good to be particular.

ס״ק יזלא כלי וכו'

(יז) לא כלי וכו' - ר"ל דמהני אף להעביר רוח רעה ולכן אם אין לו כלי שלם מותר ליטול מכלי נקוב וכן מפלו"מף אף שאין כאן כח גברא כמבואר לקמן בהלכות נט"י אבל אם שכשך ידיו במים לא מהני לרוח רעה וכדלקמן:

'Not a vessel, etc.' That is, (these washings) are effective even to remove the evil spirit, and therefore if he has no whole vessel he may wash from a perforated vessel, and likewise from a pump/faucet (a 'flum'), even though there is no human power here, as explained further in the laws of washing the hands (for a meal). But if he merely swished his hands in water, it does not help for the evil spirit, as (stated) further on.

סעיף ח׳

נטילת ידים שחרית אין נוטלין ע"ג יחקרקע אלא לתוך יטכלי:

For the morning washing of the hands, one does not wash directly onto the ground, but rather into a vessel.

ס״ק יחקרקע

(יח) קרקע - ואפילו ע"ג קיסמים אסור מפני שרוח רעה שורה עליהם:

'The ground.' Even (washing) onto wood-chips is forbidden, because an evil spirit rests upon them (the waters).

ס״ק יטכלי

(יט) כלי - וטוב שיניח שני כלים מראשותיו אחד מלא ואחד ריקן:

'A vessel.' It is good to place two vessels at the head of his bed — one full (of water) and one empty (to catch the used water).

סעיף ט׳

מים של נט"י שחרית אסור ליהנות כמהם ולא ישפכם בבית ולא במקום שעוברים שם כאבני אדם:

The water of the morning hand-washing — it is forbidden to derive benefit from it, and one should not pour it out inside the house, nor in a place where people pass by.

ס״ק כמהם

(כ) מהם - ע"כ לא יתנם לפני בהמתו:

'From it.' Therefore he should not place it (this water) before his animal (to benefit from).

ס״ק כאבני אדם

(כא) בני אדם - כי יוכלו להנזק ע"י הרוח רעה. וישפכם במקום מדרון או בעפר תיחוח:

'People.' Because they could be harmed by the evil spirit. He should pour it out on a sloping place or into loose earth.

סעיף י׳

נוטל כלי של מים ביד ימינו כבונותנו ליד שמאלו כדי שיריק מים על ימינו תחלה:

He takes the vessel of water in his right hand and passes it to his left hand, so that he pours water onto his right hand first.

ס״ק כבונותנו

(כב) ונותנו - כדי שיתגבר ימין שהוא חסד על שמאל שהוא דין. וגם באיטר אזלינן בתר ימין דעלמא:

'And he passes it.' So that the right, which is kindness (chesed), should prevail over the left, which is judgment (din). And even for a left-handed person, we follow the right of most people (the ordinary right hand).

סעיף י״א

כגלא יטול כדממי שלא נטל ידיו שחרית:

One should not have water poured for his washing by one who has not yet washed his own hands in the morning.

ס״ק כגלא יטול

(כג) לא יטול - ר"ל לשפוך לו על ידיו אבל להביא לו מים מותר:

'He should not wash.' That is, (the one who has not washed should not) pour onto his hands; but to bring him water is permitted.

ס״ק כדממי שלא וכו'

(כד) ממי שלא וכו' - ובנטילה לאכילה רשאי ליטול ממי שלא נטל ידיו:

'From one who has not, etc.' But for washing for a meal, he is permitted to have water poured by one who has not (yet) washed his hands.

סעיף י״ב

אם שכשך ידיו לתוך כלי של מים עלתה לו נטילה כהלק"ש ולתפלה כואבל לא לרוח רעה שעליהם אם שכשך ידיו בשלש מימות מחולפים יש להסתפק אם עלתה לו להעביר רוח רעה שעליהם:

If he swished his hands inside a vessel of water, the washing counts for him for Kri'as Shema and for prayer, but not for (removing) the evil spirit that is upon them. If he swished his hands in three separate (changes of) water, it is a matter of doubt whether it counts to remove the evil spirit that is upon them.

ס״ק כהלק"ש ולתפלה

(כה) לק"ש ולתפלה - ויוכל לברך על נטילת ידים דאמרינן בכיור ורחצו ממנו ולא בתוכו הא בעלמא אפילו בתוכו אבל להעביר הרוח רעה בעי עירוי ג"פ דוקא ושכשוך בכלי אפילו ק' פעמים לא חשיב אלא אחד שמיד נטמאו המים והויין כמו שופכין ומשום הכי נסתפק אח"כ במימות מחולפים דאפשר דלאו דוקא עירוי בעינן להעביר רוח רעה ואפילו רחיצה סגי או דבעינן דוקא עירוי מכלי על ידיו. וכתב הפמ"ג דלפ"ז אם תחב ידו בנהר ג"פ או בשלג המונח על הארץ בשלשה מקומות מחולפים אפ"ה לא מהני רק לתפלה ויוכל לברך ענט"י אבל ספק אם מהני להעביר רוח רעה דאולי בעינן לזה עירוי מכלי והארה"ח ולבושי שרד פסקו דבנהר וכן בשלג ובמי מקוה מהני אף להעביר רוח רעה ואפילו אין בהם ארבעים סאה ועי"ש עוד בארה"ח:

'For Kri'as Shema and prayer.' And he may recite 'al netilas yadayim,' for we expound regarding the laver, 'and they shall wash from it' — from it and not within it — implying that in general even (washing) within it (is valid). But to remove the evil spirit, pouring three times specifically is required, and swishing in a vessel, even a hundred times, counts as only one, since the water became defiled immediately and is like waste-water. For this reason (the Shulchan Aruch) was then in doubt about separate (changes of) water: perhaps pouring specifically is not required to remove the evil spirit, and even washing suffices; or perhaps pouring specifically from a vessel onto his hands is required. The Pri Megadim wrote that, accordingly, if one dipped his hand in a river three times, or in snow lying on the ground in three separate spots, even so it helps only for prayer, and he may recite 'al netilas yadayim,' but it is doubtful whether it helps to remove the evil spirit, for perhaps pouring from a vessel is required for this. But the Orchos Chaim and the Levushei Serad ruled that in a river, and likewise in snow and in mikveh water, it helps even to remove the evil spirit, even if they do not contain forty se'ah; and see there further in the Orchos Chaim.

ס״ק כואבל לא וכו'

(כו) אבל לא וכו' - ע"כ יראה ליטול פעם שנית מן כלי אפילו אחר התפלה:

'But not, etc.' Therefore he should see to wash a second time from a vessel (by pouring), even after prayer (to remove the evil spirit).

סעיף י״ג

אם היה נעור כזכל הלילה יש להסתפק אם צריך ליטול ידיו שחרית כחלהתפלל ולהעביר רוח רעה מידיו: הגה (כטויטלם בללא ברכה) (הרא"ש כלל ד' ורשב"א סי' קצ"א):

If one was awake the entire night, it is a matter of doubt whether he needs to wash his hands in the morning, for prayer and to remove the evil spirit from his hands. The Rema adds: (He should wash them without a blessing.) (Rosh, klal 4; and Rashba, siman 191.)

ס״ק כזכל הלילה

(כז) כל הלילה - ואם ישן במקצתה לכו"ע צריך ליטול ידיו בבוקר כדין והוא שישן שינת קבע על מיטתו ומשום דסתם ידים עסקניות הן ובודאי נגע במקום מטונף אבל אם ישן שינת ארעי להרא"ש דינו בזה כאלו לא ישן כלל:

'The entire night.' But if he slept during part of it, according to all he must wash his hands in the morning as required, provided that he slept a fixed sleep (shenas keva) on his bed, and this is because hands are generally busy and he certainly touched a soiled place. But if he slept only a casual nap (shenas arai), then according to the Rosh his status is as if he did not sleep at all.

ס״ק כחלהתפלל ולהעביר

(כח) להתפלל ולהעביר - דהיינו לתפלה יש ספק אם הטעם של נט"י שחרית כהרשב"א לעיל במ"ב סק"א וא"כ אע"ג דהשתא לא נעשה בריה חדשה לא פלוג רבנן וצריך נטילה או שמא עיקר הטעם כהרא"ש שם ובניעור ולא נגע במקום מטונף א"צ נטילה. ולהעביר הרוח רעה יש ג"כ ספק אם בעלמא השינה גורם הרוח רעה וא"כ אפילו ישן ביום שורה ר"ר וצריך ליטול ידיו וניעור בלילה א"צ ליטול ידיו או הלילה גורם הרוח רעה וא"כ יהיה הדין בהיפוך:

'To pray and to remove.' That is: regarding prayer, there is a doubt — perhaps the reason for the morning washing is like the Rashba's above in note 1, in which case, even though now (having stayed awake) he did not become a new creation, the Rabbis did not distinguish, and he requires washing; or perhaps the main reason is like the Rosh there, and one who stayed awake and did not touch a soiled place does not require washing. And regarding removing the evil spirit there is likewise a doubt: whether in general it is sleep that causes the evil spirit — in which case even one who slept in the day has an evil spirit rest on him and must wash, while one awake at night need not wash — or whether it is the night that causes the evil spirit, in which case the law would be the reverse.

ס״ק כטויטלם

(כט) ויטלם - ר"ל ג"פ מחמת ספק וכן בשני הסעיפים שאחר זה:

'He should wash them.' That is, three times, on account of the doubt; and likewise in the two se'ifim that follow.

ס״ק לבלא ברכה

(ל) בלא ברכה - יש מהאחרונים שחולקין על הכרעת הרמ"א בזה וסוברים דצריך לברך ויש שמסכימים עמו וכ"ז בלא עשה צרכיו אבל אם עשה צרכיו קודם התפלה הסכמת אחרונים דבזה צריך ליטול ידיו ולברך. וכן נכון לעשות לכתחילה במי שניעור כל הלילה כגון בליל שבועות יעשה צרכיו או יטיל מים וישפשף שאז לכו"ע יתחייב לברך ויברך ענט"י ואשר יצר:

'Without a blessing.' Some Acharonim disagree with the Rema's ruling here and hold that he must bless, while others agree with him. All this is when he did not relieve himself; but if he relieved himself before prayer, the consensus of the Acharonim is that in this case he must wash his hands and bless. And it is proper to do so, ideally, for one who stayed awake the whole night, such as on the night of Shavuos: he should relieve himself, or urinate and rub (clean), for then, by all opinions, he becomes obligated to bless, and he recites 'al netilas yadayim' and 'asher yatzar.'

סעיף י״ד

השכים קודם עמוד השחר ונטל ידיו יש להסתפק אם צריך ליטול ידיו פעם אחרת לאכשיאור היום לבלהעביר רוח רעה השורה על הידים: הגה ויטלם בלגלא ברכ':

If one rose before dawn (amud hashachar) and washed his hands, it is a matter of doubt whether he must wash his hands another time when the day grows light, to remove the evil spirit that rests upon the hands. The Rema adds: He should wash them without a blessing.

ס״ק לאכשיאור היום

(לא) כשיאור היום - כי י"א דבעמוד השחר חוזר הר"ר לשרות פעם שנית:

'When the day grows light.' Because some say that at dawn the evil spirit returns to rest (on the hands) a second time.

ס״ק לבלהעביר וכו'

(לב) להעביר וכו' - הכא לא נקט להתפלל כמש"כ סעיף י"ג דודאי משום תפלה אין צריך בזה עוד הפעם ליטול ידים ואפילו אם חזר וישן פעם שנית קודם עמוד השחר דבזה בודאי צריך משום רוח רעה עוד הפעם ליטול ידים מ"מ אין יכול לברך ענט"י ואפילו אם השינה היתה שינת קבע דאנו חוששין לשיטת הרשב"א דס"ל דטעם הנטילה משום דבבוקר נעשה בריה חדשה ופ"א נעשה האדם בריה חדשה ולא שתי פעמים ומשום רוח רעה בלבד לא תקנו ברכה:

'To remove, etc.' Here (the author) did not say 'to pray,' as he did in se'if 13, for certainly, for prayer's sake, he does not need to wash his hands again in this case. And even if he went back and slept a second time before dawn — where he certainly must wash again on account of the evil spirit — even so he cannot recite 'al netilas yadayim.' And even if the sleep was a fixed sleep — since we are concerned for the view of the Rashba, who holds that the reason for the washing is that in the morning one becomes a new creation, and a person becomes a new creation once, not twice — and for the evil spirit alone they did not institute a blessing.

ס״ק לגבלא ברכה

(לג) בלא ברכה - הנה נראה דאפילו אם בפעם הראשון כשנטל ידיו לא בירך ענט"י מ"מ לא יברך עתה דאיך יאמר וציונו ענט"י הלא כבר יצא ידי חובת הנטילה לתפלה לדעת הרא"ש כמבואר בב"י וכה"ג כתב לעיל בשערי תשובה סק"ד ומ"מ הנכון שיביא עצמו לידי חיוב ברכה דהיינו שיעשה צרכיו קודם התפלה ויתחייב לברך ענט"י וכנ"ל בסק"ד בשם הח"א:

'Without a blessing.' It appears that even if, at the first time when he washed his hands, he did not recite 'al netilas yadayim,' nevertheless he should not bless now, for how could he say 'and commanded us concerning washing the hands' — he has already fulfilled the obligation of washing for prayer, according to the Rosh, as explained in the Beis Yosef. The Sha'arei Teshuvah wrote similarly above, in note 4. Nevertheless, the correct thing is to bring himself to an obligation of a blessing — that is, to relieve himself before prayer, so that he becomes obligated to recite 'al netilas yadayim' — as above in note 4 in the name of the Chayei Adam.

סעיף ט״ו

ישן ביום לדיש להסתפק אם צריך לערות מים עליהן ג' פעמים (ויטלם בלא ברכה):

If one slept during the day, it is a matter of doubt whether he must pour water over them three times. (He should wash them without a blessing.)

ס״ק לדיש להסתפק

(לד) יש להסתפק - אי לילה גורם לרוח הטומאה או שינה גורם ודוקא הישן שיתין נשמי אבל פחות מזה אין רו"ר שורה ואפי' בלילה:

'It is a matter of doubt.' whether it is night that causes the spirit of impurity, or sleep that causes it. And (the evil spirit rests) specifically on one who slept sixty breaths; but less than that, no evil spirit rests, even at night.

סעיף ט״ז

דוד היה נזהר שלא לישן להשיתין נשמין (פירוש ששים נשימות) כדי שלא יטעום טעם מיתה: הגה ובגמרא פ' הישן משמע דדלווקא ביום היה נזהר: (דברי עצמו ועיין בב"י):

King David was careful not to sleep sixty breaths (shisin neshimin) (that is, sixty breaths), so that he would not taste the taste of death. The Rema adds: In the Gemara, chapter HaYashen, it is implied that specifically during the day was he careful. (His own words; and see the Beis Yosef.)

ס״ק להשיתין נשמי

(לה) שיתין נשמי - ר"ל רצופין אלא היה מתנמנם כמה פעמים פחות משיתין נשמי עד חצות לילה ומחצות ואילך היה מתגבר כארי:

'Sixty breaths.' That is, consecutive (breaths of sleep). Rather, (King David) would doze several times, each less than sixty breaths, until midnight, and from midnight onward he would strengthen himself like a lion (to engage in Torah).

ס״ק לודדוקא ביום

(לו) דדוקא ביום - השיגו עליו האחרונים דלא נמצא שם כן בגמרא רק על האמוראים אבל דוד בעצמו גם בלילה היה נזהר ונ"מ כ"ז לדידן שבעל נפש יחמיר עכ"פ ביום. ואין שבת בכלל זה. ועיין לקמן בסימן רל"א ס"א דאם א"א לו ללמוד בלא שינת הצהרים מותר לישן מעט אבל לא יאריך בה עיי"ש ועיי"ש עוד שגם זה לא תהיה כונתו להנאת עצמו רק לעבודתו יתברך. ועיין במחצית השקל שכתב דענין השינה ביום תלוי לפי מה שהוא אדם וכפי הצורך לעבודתו ית':

'Specifically during the day.' The Acharonim objected to him (the Rema), for it is not found there in the Gemara (said) except concerning the Amoraim, but David himself was careful even at night. The practical difference of all this for us: a spiritually sensitive person (ba'al nefesh) should be stringent at least during the day. And Shabbos is not included in this (caution against daytime sleep). See further, siman 231:1, that if he cannot study without a midday nap, he may sleep a little but should not prolong it; see there. And see there further that even this — his intention should not be for his own pleasure, but only for the service of Him, may He be blessed. And see the Machatzis HaShekel, who wrote that the matter of daytime sleep depends on the sort of person one is and on the need for his (Divine) service.

סעיף י״ז

יש נוהגין לרחוץ פיהם שחרית לזמפני הרירין שבתוך הפה:

Some have the custom to rinse their mouth in the morning, because of the mucus (rir) inside the mouth.

ס״ק לזמפני הרירים

(לז) מפני הרירים - כי צריך להזכיר את השם הגדול בקדושה ובטהרה [ב"י] ואם הוא איסטניס ואינו רוצה להכניס המים לפיו מפני שאינם זכים וצחים אין מעכב מלברך [לבוש]:

'Because of the mucus.' For one must mention the great Name in holiness and purity. (Beis Yosef) And if he is fastidious (istenis) and does not wish to put the water into his mouth because it is not clear and pure, this does not prevent him from blessing. (Levush)

סעיף י״ח

אלו דברים לחצריך נטילה לטבמים. הקם מהמטה מוהיוצא מבית הכסא. ומבית המרחץ. והנוטל צפורניו. והחולץ מאמנעליו. והנוגע ברגליו. והחופף ראשו וי"א אף ההולך מבבין המתים. ומי שנגע מגבמת. ומי שמפליא מדכליו. והמשמש מטתו. והנוגע מהבכנה. והנוגע בגופו מובידו. ומי שעשה אחת מכל אלו ולא נטל אם ת"ח הוא תלמודו משתכח. ואם אינו ת"ח מזיוצא מדעתו:

These are the things that require washing with water: one who rises from bed; one who comes out of the privy; and from the bathhouse; one who cuts his nails; one who removes his shoes; one who touches his feet; one who rubs his head; and some say also one who walks among the dead; and one who touched a corpse; and one who delouses his garments (mafli keilav); and one who has marital relations; and one who touches a louse; and one who touches his body with his hand (in a covered place); and one who did one of all these and did not wash — if he is a Torah scholar, his learning is forgotten; and if he is not a Torah scholar, he loses his mind.

ס״ק לחצריכים נטילה

(לח) צריכים נטילה - להסיר רוח רעה השורה עי"ז ע"כ ימהר ליטול תיכף. והנטילה תהיה עד הפרק ועכ"פ עד סוף קשרי אצבעותיו אבל אם ליכלך ידו בטיט וברפש דאין בו משום רוח רעה א"צ רק לקנח מקום המלוכלך בלבד ודי. ולענין תפלה יבואר לקמן בסימן צ"ב עי"ש בבה"ל:

'Require washing.' To remove the evil spirit that rests (on the hands) through these — therefore he should hurry to wash immediately. The washing should be up to the joint (wrist), or at least to the end of the knuckles. But if his hand became dirtied with mud and mire, in which there is no evil spirit, he need only wipe the dirtied spot alone, and that suffices. As for prayer, it will be explained further in siman 92; see there in the Bi'ur Halacha.

ס״ק לטבמים

(לט) במים - אף דלתפלה וכ"ש לתורה די אחר כל אלו בנקיון בעלמא וכדלקמן בסעיף כ"ב דמיירי בקם מן המטה וכ"ש באינך מ"מ להסתלק רוח רעה צריך דוקא מים ועיין לקמן בס"ק מ"א. וא"צ ג' פעמים כ"א בקם מן המטה ויש מחמירין בהולך בין המתים ומשמש מיטתו דבעינן ג"כ ג"פ. ובספר היכל הקודש מחמיר ביוצא מבהכ"ס ג"פ ובמ"א סימן ז' סתר דבריו:

'With water.' Even though for prayer — and all the more so for Torah — mere cleaning suffices after all these, as (stated) further in se'if 22, which deals with one who rose from bed, and all the more so in the other cases, nevertheless, to remove the evil spirit, water specifically is required; see further note 41. And three times is not required except for one who rose from bed. But some are stringent regarding one who walked among the dead and one who had relations, that three times is required there as well. The sefer Heichal HaKodesh is stringent that one leaving the privy (wash) three times, but the Magen Avraham in siman 7 refuted his words.

ס״ק מוהיוצא מבהכ"ס

(מ) והיוצא מבהכ"ס - אפילו לא עשה צרכיו וכן מבית המרחץ אפילו לא רחץ שם ומשום רו"ר ששורה באלו המקומות:

'And one who leaves the privy.' even if he did not relieve himself, and likewise (one leaving) the bathhouse, even if he did not bathe there, and this is because of the evil spirit that rests in these places.

ס״ק מאמנעליו

(מא) מנעליו - משום שנוגע בידיו בעת החליצה אבל בלא נגע בהם א"צ נטילה והחולץ מנעליו ונוגע ברגליו וחופף ראשו אינו משום רוח רעה רק משום נקיות ע"כ א"צ למהר ליטול ידיו תיכף משא"כ באינך דמשום רו"ר וכנ"ל בס"ק ל"ח:

'His shoes.' because he touches (them) with his hands at the time of removing them, but if he did not touch them, washing is not required. And (the cases of) one who removes his shoes, touches his feet, and rubs his head are not on account of an evil spirit but only for cleanliness; therefore he need not hurry to wash immediately, unlike the others which are on account of an evil spirit, as above in note 38.

ס״ק מבבין המתים

(מב) בין המתים - בבית הקברות וכתב מהרי"ל סי' כ"ג שיש ליטול קודם שיתפלל על הקברות ורוחצין שנית בשובו לחצר בה"ק שרוחות רעות מלוין החוזרין. ויש נוהגין אז לרחוץ גם הפנים:

'Among the dead.' In the cemetery. The Maharil, siman 23, wrote that one should wash before praying at the graves, and one washes a second time upon returning to the courtyard of the cemetery, for evil spirits accompany those who return. And some have the custom to wash the face as well at that time.

ס״ק מגבמת

(מג) במת - ואפילו מי שנכנס אצל מת אחד או שהלך ללותו נוהגין בנטילה. ונהגו להקפיד אם יכנס אדם לבית אחר קודם שירחץ ומנהג אבותינו תורה היא [רמ"א יו"ד שע"ו]:

'A corpse.' Even one who came in to a single corpse, or who went to escort it, (people) have the custom to wash. And they have the custom to be particular (not) to enter another house before washing, and the custom of our fathers is Torah. (Rema, Yoreh De'ah 376)

ס״ק מדכליו

(מד) כליו - אפילו לא נגע בכנה שלא מצא:

'His garments.' Even if he did not touch a louse, because he did not find one (while searching).

ס״ק מהבכנה

(מה) בכנה - ובפרעוש אפשר דדי בנקיון בעלמא:

'A louse.' But for a flea, it is possible that mere cleaning suffices.

ס״ק מובידו

(מו) בידו - במקומות המטונפות שיש בהם מלמולי זיעה:

'With his hand.' In the soiled places where there are beads of sweat.

ס״ק מזיוצא מדעתו

(מז) יוצא מדעתו - עיין בא"ר דר"ל דנתלבש בו רוח שטות ועי"ז יוכל לבוא אח"כ לעבירה וכמאמרם דאין אדם עובר עבירה אא"כ נכנס בו רוח שטות:

'He loses his mind.' See the Eliyah Rabbah that it means a spirit of folly (ruach shtus) clothes itself in him, and through this he can afterward come to sin, as (the Sages) said: a person does not transgress unless a spirit of folly has entered him.

סעיף י״ט

המקיז מחדם מהכתפים ולא נטל ידיו מפחד שבעה ימים. המגלח ולא נטל ידיו מפחד ג' ימים. הנוטל צפרניו ולא נטל ידיו מפחד יום א' ואינו יודע ממה מפחד:

One who lets blood from the shoulders and did not wash his hands will be afraid (without knowing why) for seven days. One who shaves and did not wash his hands will be afraid for three days. One who cuts his nails and did not wash his hands will be afraid for one day, and he does not know what he is afraid of.

ס״ק מחדם מהכתפים

(מח) דם מהכתפים - ואפשר עלוקה [שקורין פייווקע"ס] או ביינקע"ס ג"כ צריך ליטול וטוב להחמיר:

'Blood from the shoulders.' It is possible that (after using) a leech (called 'pi'evkes') or cupping-glasses (bankes) one must also wash; and it is good to be stringent.

סעיף כ׳

הרוחץ פניו ולא נגבם יפה פניו מתבקעו' או עול' בהן שחין ורפואתו לרחוץ הרבה במי סילקא:

One who washes his face and does not dry it well — his face will crack (become chapped), or boils will rise on it; and its remedy is to wash frequently in beet-water (mei silka).

סעיף כ״א

צריך לזהר מטבתפלה או באכילה (וע"ל סני' צ"ב ס"ז ונאסי' קס"ד) שלא ליגע בשוק וירך ובמקומות המכוסים באדם לפי שיש שם מנבלמולי זיעה. מלמולי זיעה פ' זוהמא כעין שעורים קטנים) וכן שלא לחכך בראשו אבל מקומו' המגולי' בראשו ונגבפניו ומקו' המגולה שנדבזרועותיו אין להקפיד:

One must be careful, during prayer or during eating, (and see siman 92:7 and siman 164), not to touch the calf (shok) and the thigh (yarech), and the covered places on a person, because there are there beads of sweat (milmulei zei'ah). ('Milmulei zei'ah' means grime, like small barley-shaped grains.) And likewise not to scratch in the hair of his head. But the exposed places on his head and face, and the exposed area of his forearms, one need not be particular about.

ס״ק מטבתפילה

(מט) בתפילה - וה"ה בשעה שהוא עוסק בתורה [בסימן צ"ב ס"ז בהג"ה]:

'During prayer.' The same applies while he is engaged in Torah study. (Siman 92:7 in the gloss)

ס״ק נסימן צ"ב סעיף ו'

(נ) סימן צ"ב סעיף ו' - דנתבאר שם שאם עומד בתפלה ונזכר שנגע במקום מטונף די בנקיון עפר או שמחכך ידיו בכותל דמה יעשה באמצע תפלה. ומיהו אם עומד עדיין בק"ש או בפסוקי דזמרה צריך לילך וליטול ידיו:

'Siman 92, se'if 6.' For it is explained there that if one is standing in the Shemoneh Esrei and remembers he touched a soiled place, it suffices to clean with earth or to rub his hands on the wall, for what can he do in the middle of the Amidah (he cannot leave). However, if he is still at Kri'as Shema or Pesukei DeZimra, he must go and wash his hands.

ס״ק נאוסי' קס"ד

(נא) וסי' קס"ד - דשם נתבאר שאם עבר ונגע בתוך הסעודה צריך ליטול ידיו שנית כדין אך לענין ברכת ענט"י הסכמת רוב האחרונים שלא לחזור ולברך ע"ש במ"ב:

'And siman 164.' For there it is explained that if one transgressed and touched (a covered place) during the meal, he must wash his hands again, as required, but regarding the 'al netilas yadayim' blessing, the consensus of most Acharonim is not to bless again; see there in the Mishnah Berurah.

ס״ק נבמלמולי זיעה

(נב) מלמולי זיעה - עיין ביו"ד סי' קי"ו דצריך ליזהר מזיעה דכל זיעה סם המות חוץ מזיעת הפנים וסימן לדבר בזיעת אפיך תאכל לחם:

'Beads of sweat.' See Yoreh De'ah, siman 116, that one must be wary of sweat, for all sweat is (like) a deadly poison, except for the sweat of the face, and a mnemonic for this is, 'By the sweat of your brow you shall eat bread.'

ס״ק נגובפניו

(נג) ובפניו - וכן בצוארו עד החזה [ב"י] וכתב במחצית השקל דזה תלוי לפי מנהג המקומות אם הדרך להיות מגולה שם:

'And his face.' And likewise his neck down to the chest. (Beis Yosef) The Machatzis HaShekel wrote that this depends on the custom of the locale — whether it is usual to be uncovered there.

ס״ק נדשבזרועותיו

(נד) שבזרועותיו - עד הפרק הנקרא (איילי"ן בויגי"ן). וכן אם הולך יחף ברגליו אפשר דהוי בכלל המקומות המגולין [פמ"ג בסי' צ"ב]:

'Of his forearms.' Up to the joint called (the 'elbow-bend'). And likewise, if one goes barefoot, it is possible that (his feet) are included among the exposed places (about which one need not be particular). (Pri Megadim in siman 92)

סעיף כ״ב

נהאם אין לו מים נויקנח ידיו בצרור או נזבעפר או בכל מידי דמנקי ויברך על נחנקיות ידים ויועיל לתפלה אבל לא להעביר רוח רעה שעליהן:

If he has no water, he should wipe his hands with a pebble or with earth, or with anything that cleans, and he recites the blessing 'al nekiyus yadayim' (on the cleanliness of the hands), and this suffices for prayer, but not to remove the evil spirit that is upon them.

ס״ק נהאם אין וכו'

(נה) אם אין וכו' - ואם יש לו מים צריך ליטול אפילו לתפלת מנחה וערבית אפילו אם אינו יודע להן שום לכלוך. והנטילה יהיה בלא ברכה כי לא תקנו ברכה כ"א בשחרית וכדאיתא בסימן ז' ס"א. ואם אין לו מים י"א דדינו כהכא דינקה בכל מידי דמנקי פן מודבק בהם איזה דבר מאוס או זוהמא ועיין לקמן בסי' צ"ב וברל"ג במשנה ברורה:

'If he has no (water), etc.' But if he does have water, he must wash even for Mincha and Ma'ariv, even if he knows of no dirt on them. This washing is without a blessing, for they instituted a blessing only in the morning, as stated in siman 7:1. And if he has no water, some say his law is like here — that he cleans with anything that cleans, lest something disgusting or grimy be stuck to them — and see further in siman 92 and in siman 233 in the Mishnah Berurah.

ס״ק נויקנח ידיו

(נו) יקנח ידיו - ואפילו היו מלוכלכים בודאי כגון שעשה צרכיו וקינח ג"כ מהני ועיין לקמן בסי' צ"ב כמה צריך לחזור אחר מים:

'He should wipe his hands.' Even if they were certainly dirty — for example, if he relieved himself and wiped — (wiping) also helps, and see further in siman 92 how much one must go in search of water.

ס״ק נזבעפר

(נז) בעפר - או שישפשף בטלית יבש. ודע דנקיון כיון שהוא עומד במקום מים צריך לנקות כל היד בין גבו ובין תוכו עד הפרק ובדיעבד די עד סוף קשרי אצבעותיו אבל לא כמו שנוהגין איזה אנשים שמנקין רק ראשי אצבעותיהן:

'With earth.' Or he may rub (them) on a dry cloth. Know that since this cleaning stands in place of water, he must clean the entire hand, both its back and its palm, up to the joint, and after the fact it suffices up to the end of the knuckles, but not as some people do, who clean only the tips of their fingers.

ס״ק נחנקיות ידים

(נח) נקיות ידים - י"א דגם בזה מברכין ענט"י ומ"מ כל האחרונים לא זזו מפסק השו"ע:

'Cleanliness of the hands.' Some say that even in this (case of wiping) one recites 'al netilas yadayim,' but nevertheless all the Acharonim did not budge from the ruling of the Shulchan Aruch (that one says 'al nekiyus yadayim').

סעיף כ״ג

לא תקנו נטילת ידים אלא לק"ש ולתפלה אבל ברכות דשחרית יכול לברך נטקודם נטילה אא"כ הוא ישן על מטתו סערום שאז אסור להזכיר את השם עד סאשינקה אותם:

They instituted washing of the hands only for Kri'as Shema and prayer; but the morning blessings he may recite before washing, unless he slept in his bed unclothed, for then it is forbidden to mention the (Divine) Name until he cleans them (his hands).

ס״ק נטקודם נטילה

(נט) קודם נטילה - דסתם ידים דהיינו שאינו יודע אם הם מלוכלכים אינן פסולות לברכה וכ"ש לד"ת דהרי מברכין על הפירות וא"צ נט"י:

'Before washing.' For ordinary hands — that is, where he does not know whether they are dirty — are not disqualified for a blessing, and all the more so for words of Torah, for indeed one recites blessings over fruit without needing to wash the hands.

ס״ק סערום
