One who is ill in his bowels (a stomach ailment) is exempt from tefillin, The Rema adds: even if he is in no pain. But any other sick person — if he is in distress from his illness and his mind is not settled upon him — is exempt, and if not, he is obligated. [The Mordechai, and א"ח, and Maimonides, chapter 4]

(א) חולה מעיים - וה"ה מי ששתה משקה המשלשל:
(1) 'One who is ill in his bowels' — and likewise one who drank a laxative potion [is exempt].

(3) 'From tefillin' — one who neglected the mitzvah of tefillin because of illness, and thirty days passed over him during which he did not wear them — when he resumes wearing them, he need not recite the Shehecheyanu blessing.

(4) 'Distress' — even if he is walking in the marketplaces and the streets, he is exempt, and it is forbidden for him to be stringent upon himself in this, except during the Shema and the Amidah, if he knows that he can hold himself with a clean body, as is written further in se'if 2.

(5) 'Is exempt' — lest, on account of the distress, he divert his attention from them. And if he wishes to be stringent upon himself, he is permitted. One whose chest is bare — that is, that he goes about in trousers alone and above [the waist] he is bare (and this does not include the case where merely the collar is open) — should not wear tefillin; for although he is permitted to recite the blessing, since his nakedness is covered, as is proven in siman 74, even so it is not proper that his chest be exposed while he wears tefillin.

One for whom it is certain that he cannot pray without breaking wind — it is better that the time for prayer pass than that he pray without a clean body. [And see further, siman 80.] But if it appears to him that he will be able to hold himself with a clean body during the recitation of the Shema, he should put on tefillin between [the blessing of] Ahavah and the recitation of Shema, and recite the blessing over them.

(6) 'One for whom it is certain' — to exclude the case where he does not know it clearly; [then] he certainly should not forgo even communal prayer on account of this.

(7) 'To pray' — specifically the Amidah, because it is like standing before the King, and it is disgraceful to stand and pray with the intention of pausing in the middle until the odor dissipates; but the Shema and its blessings are permitted, only without tefillin.

(8) 'During the Shema' — see further, siman 80, in the Mishnah Berurah, for there it will all be explained, with God's help.
ס״ק טויברך
(ט) ויברך - ויקרא בהן שמע ואח"כ יחלצן. ואם יודע שאין יכול לעצור עצמו מלהפיח אלא בכדי שיוכל לחלוץ השל ראש אפ"ה מותר להניח לכתחלה את שניהם כ"כ המ"א אבל הפמ"ג מפקפק בזה:
(9) 'And recite the blessing' — and he should read the Shema while wearing them, and afterward remove them. And if he knows that he cannot restrain himself from breaking wind for longer than the time it takes to remove the head-tefillin, even so he is permitted to put on both of them at the outset — so writes the Magen Avraham; but the Pri Megadim casts doubt on this.
ינשים ועבדים פטורים מתפילין מפני שהוא מצות עשה יאשהזמן גרמא: הגה ואם היבנשים רוצים להחמיר על עצמן מיגוחין בידם [כל בו]:
Women and [Canaanite] slaves are exempt from tefillin, because it is a positive commandment bound by a set time. The Rema adds: and if women wish to be stringent upon themselves [and wear them], we protest against them (prevent them). [Kol Bo]

(י) נשים - וטומטום ואנדרוגינוס חייבין בתפילין מספק ככל המצות:
(10) 'Women' — but a tumtum and an androgynos are obligated in tefillin out of doubt, as with all the mitzvot.

(11) 'Bound by a set time' — for Shabbat and Yom Tov are not a time for tefillin.

(יב) הנשים - עיין בפמ"ג שה"ה לענין עבדים ועיין בספר תוספות שבת שכתב בהדיא להיפך ועיין בספר תוספות ירושלים:
(12) 'The women' — see the Pri Megadim, that the same applies regarding [Canaanite] slaves; and see the work Tosefet Shabbat, who writes explicitly the opposite; and see the work Tosefot Yerushalayim.

(יג) מוחים בידן - מפני שצריכין גוף נקי ונשים אין זריזות להזהר:
(13) 'We protest against them' — because [tefillin] require a clean body, and women are not scrupulous to be careful.

One who wears tefillin must guard himself against thoughts of desire for a woman. The Rema adds: and if it is impossible for him without such thoughts, it is better not to wear them. [Kol Bo, and א"ח]

(יד) ליזהר - דבעינן גוף נקי גם ממחשבה רעה:
(14) 'To guard himself' — for we require a clean body, [clean] also of evil thought.

(טו) שלא להניחם - ומ"מ יראה בכל היכולת לכוף את עצמו ולמשוך הלב ליראת שמים כדי להסיח הדעת מדברי הבאי המזיקים לגוף ולנפש ולפנות הלב לקבל עליו עול מ"ש בקדושה:
(15) 'Not to wear them' — nevertheless he should strive with all his ability to compel himself and to draw his heart toward the fear of Heaven, in order to divert his mind from vain matters that harm the body and the soul, and to turn his heart to accept upon himself the yoke of the Kingdom of Heaven in holiness.

A mourner, on the first day, is forbidden to wear tefillin; from then on he is obligated, even if new faces (people who had not yet come to console him) arrive.

(16) 'On the first day' — meaning, even on the day of burial that is not the day of death, since it is the first day of mourning and of the consolers; and therefore even if the burial was at night, he does not wear tefillin the [next] day. But if [the relative] died or was buried during Chol HaMoed, he wears tefillin — both during Chol HaMoed [and the Pri Megadim in siman 71 casts doubt on this, for the first day is nevertheless a bitter day for him, and in any case he must be careful not to recite a blessing over them, and in any event the custom is not to recite a blessing over tefillin on Chol HaMoed] — and both after the festival, even though it is the first day of mourning, nevertheless consolers have already comforted him during the festival. And likewise, when he was buried on the second day of Yom Tov, he wears tefillin in the Diaspora (א"ח), for the second day of Yom Tov counts toward the seven [days of mourning], and the day after the festival is reckoned as the second [day]. And likewise, if he heard a 'near report' [that is, within thirty days, even on the thirtieth day itself], its law is likewise as that of the day of burial; and therefore even if he heard it at night, he does not wear tefillin the [next] day. And even if a near report came to him after he had already put on tefillin and begun to pray, he removes them. But if he heard a 'distant report' — that is, after thirty days, when the mourning [obligation] is only one hour — he is permitted to wear tefillin, and all the more so that he need not remove them. And therefore, if the report came to him in the middle of Pesukei d'Zimra and the like, he does not remove the tefillin; he only removes his shoes on account of mourning. But if through the report he comes to weeping, he must remove them, as is proven from Yoreh De'ah, siman 388, se'if 2, and siman 402 in the Shach, se'if katan 2. And see further in se'if 9.

(יז) אסור - דתפילין נקראין פאר בפסוק ואבל מעולל באפר ואין נאה לתת פאר תחת אפר:
(17) 'Is forbidden' — for tefillin are called 'splendor' (pe'er) in the verse, and a mourner wallows in ashes (efer), and it is not fitting to place splendor (pe'er) in place of ashes (efer).

(יח) מכאן ואילך - דכתיב ואחריתה כיום מר ש"מ דעיקר מרירות הוא יום ראשון:
(18) 'From then on' — for it is written, 'and its end like a bitter day,' from which we learn that the essential bitterness is on the first day.
ס״ק יטחייב
(יט) חייב - משמע דחייב מיד ויש פוסקים דביום ב' אין להניח קודם הנץ ע"כ מהנכון להמתין מלהניח עד אחר הנץ:
(19) 'Is obligated' — this implies that he is obligated immediately; but there are authorities who hold that on the second day one should not put them on before sunrise, therefore it is proper to wait to put them on until after sunrise.
ס״ק כפנים חדשות
(כ) פנים חדשות - לנחם אותו ומשמע דמניח לכתחלה אבל האחרונים מסקי דאין להניח בפניהם תפילין עד שילכו להם אלא דאין חולץ אם הניח קודם שבאו פנים חדשות:
(20) 'New faces' — [who come] to console him. And it is implied that he may put them on at the outset; but the later authorities conclude that one should not put on tefillin in their presence until they depart, only that he need not remove them if he had put them on before the new faces arrived.

On the Ninth of Av one is obligated in tefillin (and see further, siman 555).

(כא) חייבין בתפילין - דלא חמיר ת"ב משאר ימי אבילות:
(21) 'Are obligated in tefillin' — for the Ninth of Av is not more stringent than the other days of mourning.
חתן ושושביניו (פירוש רעיו השמחים עמו) וכבכל בני חופה פכגטורין משום דשכיח שכרות וקלות ראש:
A groom and his groomsmen (meaning his companions who rejoice with him) and all the members of the wedding party are exempt, because drunkenness and levity are common [there].

(כב) וכל בני חופה וכו' - ודוקא במקום החופה דשם שכיח שכרות וקלות ראש:
(22) 'And all the members of the wedding party, etc.' — specifically at the place of the wedding, for there drunkenness and levity are common.
ס״ק כגפטורים
(כג) פטורים - בתשובת רמ"א סימן קל"ב כתב דהאידנא שאף החתן חייב בק"ש ותפלה [כמו שכתב בסימן ע'] ממילא חייבין החתן וכל בני החופה גם בתפילין עי"ש ועיין במ"א שמפקפק בדינו ומצדד לפסוק כהשו"ע דפטורין מתפילין בעת המשתה וגם לענין תפלה המיקל כדעת רש"י לפטור בעת המשתה לא הפסיד אם החתן מיסב אצלם דאז הוי מצוה לדעת רש"י אבל מדברי הגר"א בביאורו משמע שאין להקל לענין תפלה וכמו שכתב בב"י בסימן רל"ב ועיין בעולת תמיד ובברכי יוסף שכתבו דנתפשט המנהג כהרמ"א שהחתן וכל סייעתו קורין ומניחין תפילין ומתפללין מיום הראשון עד יום השביעי:
(23) 'Are exempt' — in a responsum of the Rema, siman 132, he wrote that nowadays, since even the groom is obligated in the Shema and the Amidah [as is written in siman 70], it follows that the groom and all the members of the wedding party are also obligated in tefillin — see there. And see the Magen Avraham, who casts doubt on his ruling and inclines to rule like the Shulchan Aruch, that they are exempt from tefillin during the [wedding] feast; and also, regarding prayer, one who is lenient in accordance with the view of Rashi to exempt during the feast has not lost, if the groom reclines among them, for then it is a mitzvah according to Rashi's view. But from the words of the Vilna Gaon in his commentary it is implied that one should not be lenient regarding prayer, and as is written in the Beit Yosef in siman 232. And see the Olat Tamid and the Birkei Yosef, who wrote that the custom has spread in accordance with the Rema, that the groom and all his company read [the Shema], wear tefillin, and pray, from the first day until the seventh day.

Those who write tefillin and mezuzot — they, and their dealers, and the dealers of their dealers, and all who are engaged in the work of Heaven — are exempt from wearing tefillin the entire day, except during the recitation of the Shema and the Amidah. The Rema adds: and if they needed to do their work during the time of the Shema and the Amidah, then they are exempt from the Shema, from the Amidah, and from tefillin, for whoever is engaged in one mitzvah is exempt from another mitzvah — if he would have to exert himself for the other one; but if he can do both together without exertion, he should do both. (Hagahot Asheri in the name of א"ז and the Ran, chapter HaYashen)

(כד) ותגריהם - אף שמרויחין מזה ודוקא אם עיקר כוונתם כדי להמציאן למכור למי שצריך להם אבל אם עיקר כוונתם רק להשתכר לא מיקרי עוסק במצוה [מ"א]:
(24) 'And their dealers' — even though they profit from it; and specifically if their main intention is to make them available for sale to those who need them, but if their main intention is only to profit, they are not called 'engaged in a mitzvah' [Magen Avraham].

(כה) ותגרי תגריהם - הקונים מן הקונים למכור על יד על יד:
(25) 'And the dealers of their dealers' — who buy from the [first] buyers in order to sell little by little.

(כו) צריכים וכו' - כגון שנזדמן לו קונה שרוצה לקנות סת"ם והקונה רוצה לפרוש בים או בשיירא עכשיו ואי אפשר לו להמתין עד שהסופר או התגר יקיים מצוה אחת שבאה לידו כגון הנחת תפילין או ק"ש וה"ה שאר כל המצות ע"כ מותר לכתוב ולמכור לזה אע"פ שעי"ז יעבור זמן המצוה [לבוש] ועי' בבה"ל:
(26) 'They needed, etc.' — for example, a buyer happened upon him who wishes to purchase Torah scrolls, tefillin, or mezuzot (STaM), and the buyer wishes to set out to sea or with a caravan now, and it is impossible for him to wait until the scribe or the dealer fulfills a mitzvah that has come to his hand, such as putting on tefillin or [reciting] the Shema — and likewise all the other mitzvot — therefore it is permitted to write and sell to this one, even though thereby the time of the mitzvah will pass [Levush]. (כז) אז פטורין וכו' - ומיירי שכבר התחיל לכתוב קודם שהגיע זמן ק"ש אבל משהגיע הזמן אסור להתחיל לכתוב כמש"כ סי' ע"ב ס"ב כ"כ המ"א אכן לפי מה שציירנו מתחלה בשם הלבוש שהקונה צריך לעבור בים או בשיירא וא"א לו להמתין עד שהסופר יקיים ק"ש ותפלה פשוט דלכו"ע מותר הסופר לעשות לו מלאכתו אם הוא משער שישאר לו זמן לקרות ואם יוכל לקרוא פרשה אחת מקודם יקרא:
(27) 'Then they are exempt, etc.' — and this speaks of where he had already begun to write before the time of the Shema arrived; but once the time has arrived it is forbidden to begin writing, as is written in siman 72, se'if 2 — so writes the Magen Avraham. However, according to what we depicted at the outset in the name of the Levush — that the buyer must travel by sea or with a caravan and it is impossible for him to wait until the scribe fulfills the Shema and the Amidah — it is obvious that according to all opinions the scribe is permitted to do his work for him, if he estimates that there will remain time for him to recite [the Shema]; and if he is able to read one paragraph beforehand, he should read it.
ס״ק כחדכל העוסק וכו'
(כח) דכל העוסק וכו' - ודוקא עוסק במצוה כגון בשעה שהוא לובש התפילין או עוסק בתיקוני האבידה כגון לשוטחה לצורכה או להשיבה לבעליה וכל כה"ג אבל בשעה שהוא מקיים מצוה כגון שהוא כבר לבוש תפילין או שומר אבידה שהיא מונחת כבר בתיבתו וכל כה"ג אע"פ שהוא מקיים מצוה איננו עוסק במצוה ולא מיפטר ממצוה אחרת עי"ז ועיין בבה"ל שביארתי יותר:
(28) 'For whoever is engaged, etc.' — and specifically one who is [actively] engaged in a mitzvah, such as at the moment he is putting on the tefillin, or engaged in tending to a lost object, such as spreading it out for its preservation or returning it to its owner, and all similar cases; but at a time when he is [merely] fulfilling a mitzvah, such as when he is already wearing tefillin, or guarding a lost object that is already placed in his box, and all similar cases — even though he is fulfilling a mitzvah, he is not 'engaged in a mitzvah,' and he is not exempted from another mitzvah on account of this. And see the Biur Halacha, where I have explained further.
ס״ק כטאם צריך וכו'
(כט) אם צריך וכו' - ר"ל ואפילו אם עי"ז לא יתבטל המצוה הראשונה ואפילו אם המצוה השניה יותר גדולה כיון שכבר התחיל לעסוק בראשונה [או"ז וריטב"א]:
(29) 'If he would need, etc.' — that is to say, even if thereby the first mitzvah would not be nullified, and even if the second mitzvah is greater, since he has already begun to engage in the first [Or Zarua and the Ritva].
למצטער ומי לאשאין דעתו מיושבת עליו ונכונה פטור מפני שאסור להסיח דעתו מהם:
One who is in distress, and one whose mind is not settled and steady upon him, is exempt, because it is forbidden to divert one's attention from them [the tefillin].

(31) 'Whose mind is not [settled], etc.' — and this speaks of where it is impossible for him to settle his mind; but if it is possible for him, he is obligated to settle his mind and wear them.

One who is engaged in [studying] the Torah is exempt from wearing tefillin the entire day, except during the recitation of the Shema and the Amidah.

(לב) בתורה - אפשר דדוקא בתורה שבכתב אבל לא בעוסק בגמרא דתורה י"ל שהיא עצמה אות שנזכר בה יציאת מצרים:
(32) 'In the Torah' — it is possible that this applies specifically to the Written Torah, but not to one engaged in the Gemara; for regarding [the Written] Torah one could say that it itself is a 'sign,' since the Exodus from Egypt is mentioned in it.

(33) 'Is exempt' — that is to say, that he need not interrupt his study in order to put them on; but before this [before he begins learning] he is obligated. Also, in the middle [of his study], if he wishes to pause and put them on, he is likewise permitted, and he may recite the blessing over them; for although he is exempt from interrupting for their sake, nevertheless, since he wishes to interrupt his study, he becomes obligated in tefillin as soon as he stops.

(34) 'From wearing tefillin' — and although one is obligated to interrupt Torah study in order to fulfill all the mitzvot whose obligation is upon him, as is stated in Yoreh De'ah, siman 240, the mitzvah of tefillin is different, for its main benefit is for the Torah, as it is written, 'and as a reminder between your eyes, so that the Torah of the Lord may be in your mouth'; therefore, since he is already engaged in the Torah beforehand, he need not neglect Torah for this, except during the Shema and the Amidah, in order to accept upon himself the yoke of the Kingdom of Heaven, and also because at that time he is not yet engaged in the Torah, and he is obligated to have tefillin upon him. And the Vilna Gaon ruled in his commentary that this applies specifically to one whose Torah is his [sole] occupation, such as Rabbi Shimon bar Yochai and his colleagues, but people such as ourselves must interrupt even for tefillin.
לא יחלוץ תפילין להבפני רבו אלא יפנה לצד אחר לומפני אימתו ויחלוץ שלא בפניו:
One should not remove his tefillin in the presence of his teacher; rather he should turn to another side, out of awe of him, and remove them not in his presence.

(לה) בפני רבו - היינו רבו מובהק דרוב חכמתו הימנו:
(35) 'In the presence of his teacher' — that is, his primary teacher, from whom the majority of his wisdom [comes].

(לו) מפני אימתו - ר"ל דזלזול הוא שמגלה ראשו בפניו ולפ"ז אפילו אם כבר חלץ רבו תחלה אסור ואם מטה עצמו קצת לצד אחר וזהיר מלגלות ראשו בפניו נראה דיש להקל בכל גווני כ"כ הפמ"ג ועי"ש עוד דמשמע מיניה דאם חולצן סמוך לחשיכה יש להחמיר בכל גווני מלחלוץ אותם קודם שחלץ רבו דנראה שמורה הלכה בפני רבו שהגיע זמנו לחלוץ ועיין לעיל סימן כ"ה ס"ק נ"ח מ"ש שם בשם הפמ"ג:
(36) 'Out of awe of him' — that is to say, it is a disgrace for him to uncover his head in his presence; and according to this, even if his teacher already removed [his own] first, it is forbidden. But if he turns himself slightly to another side and is careful not to uncover his head in his presence, it appears that there is room to be lenient in all cases — so writes the Pri Megadim. And see there further, for it is implied from him that if one removes them close to nightfall, one should be stringent in all cases against removing them before his teacher has removed [his], for it would appear that he is ruling on a matter of law in his teacher's presence, [namely] that the time to remove them has arrived. And see earlier, siman 25, se'if katan 58, what is written there in the name of the Pri Megadim.
היה צריך לתפילין ומזוזה ואין ידו משגת לקנות שניהם לזתפילין קודמים:
If one needed [both] tefillin and a mezuzah, and his means do not reach to buy both, the tefillin take precedence.

(לז) תפילין קודמים - דהיא מצוה שבגופו ועוד דקדושת תפילין למעלה מקדושת מזוזה וכדלעיל בסימן ל"ב ס"ח. מיהו לדידן שאין מניחין רק בשעת ק"ש ותפלה אם אפשר בשאלה מזוזה קודמת דא"א בשאלה [מ"א]:
(37) 'The tefillin take precedence' — for it is a mitzvah upon his own body, and furthermore, the sanctity of tefillin is above the sanctity of a mezuzah, as [stated] earlier in siman 32, se'if 8. However, for us, who wear [tefillin] only during the Shema and the Amidah, if [tefillin] can be obtained by borrowing, the mezuzah takes precedence, since [a mezuzah] cannot [be fulfilled] by borrowing [Magen Avraham].
לחמנודה ומצורע אסורים להניח תפילין:
One who is under a ban (menudeh) and a leper (metzora) are forbidden to wear tefillin.

(לח) מנודה ומצורע וכו' - עיין בל"ח ובש"ך ביו"ד סי' של"ד ס"ב ובשארי אחרונים דפוסקים להיפך וכתב הפמ"ג דיניחו בלי ברכה אבל מביאור הגר"א משמע לכאורה דצריכין לברך ג"כ:
(38) 'One under a ban and a leper, etc.' — see the ל"ח and the Shach in Yoreh De'ah, siman 334, se'if 2, and the other Acharonim, who rule the opposite [that they are permitted]; and the Pri Megadim wrote that they should wear [them] without a blessing, but from the commentary of the Vilna Gaon it appears, at first glance, that they must recite the blessing as well.
