גדול אשכר מצות תפילין וכל מי בשאינו מניחם הוא גבכלל פושעי ישראל דבגופן:
Great is the reward of the mitzvah of tefillin, and anyone who does not put them on is included among the sinners of Israel with their bodies (those punished bodily).
ס״ק אשכר
(א) שכר - שכל המניחן מאריך ימים בעוה"ז שנאמר ד' עליהם יחיו כלומר אותם שנושאים שם ה' עליהם בתפילין יחיו ומובטח שהוא בן עוה"ב ואין אש של גיהנם שולט בו וכל עונותיו נמחלין לו. טור בשם השמושא רבא:
(1) "The reward" — for anyone who wears them lengthens his days in this world, as it says, "Hashem is upon them, they shall live"; that is to say, those who bear Hashem's name upon them in tefillin shall live. And he is assured that he is a member of the World to Come, and the fire of Gehinnom has no power over him, and all his sins are forgiven him. So the Tur writes in the name of the Shimusha Rabba.
ס״ק בשאינו מניחם
(ב) שאינו מניחם - פי' אפילו מניעתו הוא רק לפרקים וכ"ש אם מבטל תמיד ממצוה זו והפמ"ג הביא בשם נ"צ דאפילו מי שביטל מתפילין יום אחד הוא ג"כ בכלל פושעי ישראל:
(2) "Who does not put them on" — meaning even if his failure is only occasional, and all the more so if he constantly neglects this mitzvah. And the Pri Megadim brought in the name of נ"צ that even one who neglected tefillin for a single day is likewise included among the sinners of Israel.

(ג) בכלל פ"י - ודוקא שאינו מניחן בשביל שהמצוה בזויה בעיניו אבל הירא להניחם משום דבעי גוף נקי ושמא לא יזהר בקדושה כראוי אע"ג דעבירה היא דבקל יכול אדם ליזהר בשעת ק"ש ותפלה מ"מ לא הוי בכלל פושעי ישראל. וכ"ש אם המצוה תמיד חביבה עליו ונזהר שיהיה גוף נקי אך עתה אית ליה אונס חולי שאין גופו נקי לכו"ע אין עליו דין פושעי ישראל כלל. ודע דכתב הב"ח דאפילו אם אין המצוה בזויה בעיניו אך ממנע /נמנע/ מלהניחם מפני ביטול מלאכה או שאר הפסד ממון או מחמת עצלות ג"כ הוא בכלל פ"י בגופן אך דיש חילוק ביניהם לענין עונש עי"ש. וד"ז הוא תוכחת מגולה לאותן אנשים שמפני עצלותן מצוי שיהיו תפיליהן מונחין על מצחן ולא על הקרקפתא וגם הש"י אין מונח על מקומו כדין דהלא זה הוא כמי שלא הניח כלל. וכבר זירז ע"ז ג"כ אותנו הפמ"ג בסימן כ"ז שכתב שם דתפילין שמונחין שלא במקומן הרי הם כמונחין בכיסן. ועיין לעיל בסימן כ"ז בבה"ל שהארכנו בזה:
(3) "Among the sinners of Israel (poshei Yisrael)" — this applies specifically when he does not put them on because the mitzvah is contemptible in his eyes; but one who is afraid to put them on because they require a clean body, and lest he not observe the required holiness properly — even though it is a transgression, since a person can easily be careful during Shema and prayer — nevertheless he is not included among the sinners of Israel. And all the more so if the mitzvah is always beloved to him and he is careful to keep a clean body, but right now he has the compulsion of illness so that his body is not clean — according to all opinions the law of the sinners of Israel does not apply to him at all. And know that the Bach wrote that even if the mitzvah is not contemptible in his eyes, but he refrains from putting them on because of interrupting his work, or other monetary loss, or out of laziness, he too is among the sinners of Israel with their bodies, except that there is a distinction between them as to punishment; see there. And this matter is an open rebuke to those people who, out of their laziness, commonly have their tefillin resting on their forehead and not on the scalp (the proper spot), and also the hand-tefillin (shel yad) is not resting in its proper place as the law requires; for such a one is like someone who did not put them on at all. And the Pri Megadim already urged us about this too in siman 27, where he wrote that tefillin resting not in their place are as if they are resting in their bag. And see above in siman 27 in the Bei'ur Halacha, where we discussed this at length.

(ד) בגופן - ודינו פסוק בש"ס ר"ה י"ז דאפילו הוא איש בינוני דדרכו של הקב"ה להטות הכף כלפי חסד מכיון שנמצא בתוך עונותיו עון זה כף חובה מכרעת והוא מוכרח לירד לגיהנם ואם ח"ו ג"כ עונותיו מרובין מזכיותיו נידון בגיהנם י"ב חודש ואח"כ גופן כלה ונשמתן נשרפת ורוח מפזרת אפרן תחת כפות רגלי הצדיקים. וע"ש בתוס' דכ"ז בשלא עשה תשובה. ויען כי גדול כח המצוה כ"כ ולהיפך העונש ר"ל לכן יזהר כל אדם לקנות תפילין מסופר מומחה וי"ש ובעל תורה וכן רצועות יקנה מאיש נאמן כדי שיהא בטוח שנעבדו לשמן מעורות טהורות כי מי שהוא מניח תפילין פסולים לא לבד שאינו מקיים המצוה אלא שמברך כמה וכמה ברכות לבטלה שהוא עון גדול. ובעו"ה רבה המכשלה במה שקונים תפילין ורצועות ממאן דהוא לפי שמוכרים בזול ורובן אינם מרובעין ועוד יתר קלקולים שמצוי בהם בעת כתיבתן וכל ירא שמים יתן אל לבו אם על מלבושיו וכליו הוא מהדר שיהיו כתיקונם מכ"ש בחפצי שמים שלא יצמצם ויחוס על הכסף אלא יהדר לקנות אותן שהם בודאי כשרים אף שמחירם רב. וכתב הד"מ בשם המרדכי יש לאדם להדר אחר תפילין נאים שנאמר זה אלי ואנוהו דהיינו שכתבן לבלר אומן בכתב נאה ובדיו נאה ובקולמוס נאה וקלפים נאים:
(4) "With their bodies" — his sentence is stated explicitly in the Talmud, Rosh Hashanah 17, that even if he is an average person (with merits and sins equally balanced) — for the way of the Holy One, blessed be He, is to tip the scale toward kindness — since this sin is found among his transgressions, the pan of guilt tips the balance, and he must descend to Gehinnom. And if, God forbid, his sins also outnumber his merits, he is judged in Gehinnom for twelve months, and afterward their body is consumed and their soul is burned, and a wind scatters their ashes beneath the soles of the righteous. And see there in Tosafos that all this is when he did not repent. And since the power of the mitzvah is so great, and conversely the punishment (may the Merciful One spare us), therefore let every person take care to buy tefillin from an expert scribe who is God-fearing and a Torah scholar; and likewise let him buy the straps from a trustworthy man, so that he may be sure they were processed for their sake (lishmah) from kosher hides. For one who wears invalid tefillin, not only does he fail to fulfill the mitzvah, but he recites many, many blessings in vain, which is a grave sin. And regrettably (because of our many sins) the failure is widespread, in that people buy tefillin and straps from just anyone, because they sell cheaply, and most of them are not squared properly, and there are yet further defects commonly found in them at the time of their writing. And let every God-fearing person take to heart: if he is particular that his clothing and utensils be as they should be, all the more so in matters of Heaven he should not skimp and spare his money, but rather be particular to buy those that are certainly kosher, even though their price is high. And the Darchei Moshe wrote in the name of the Mordechai: a person should seek out beautiful tefillin, as it says, "This is my God and I will glorify Him" — that is, that a skilled scribe wrote them, with fine script, fine ink, a fine quill, and fine parchments.
מצותן הלהיותם עליו כל היום אבל מפני שצריכי' גוף נקי שלא יפיח בהם ושלא יסיח דעתו מהם ואין כל אדם יכול ליזהר בהם נהגו שלא להניחם כל היום ומ"מ צריך כל אדם ליזהר בהם להיותם עליו ובשעת ק"ש זותפלה:
Their mitzvah is that they be upon a person the entire day; but because they require a clean body — that one not pass gas while wearing them, and that one not divert his mind from them — and not every person is able to be so careful with them, people adopted the custom not to wear them the whole day. Nevertheless every person must take care with them, to have them upon him at the time of the recitation of Shema and of prayer.
ס״ק הלהיותם עליו
(ה) להיותם עליו - דבזמן קצר כזה בקל יכול ליזהר מהפחה ומהסח הדעת:
(5) "To have them upon him" — for in such a short span of time one can easily be careful against passing gas and against diverting his mind.
ס״ק ובשעת ק"ש
(ו) בשעת ק"ש - דכל הקורא ק"ש בלא תפילין כאלו מעיד עדות שקר בעצמו. ואם לא נזדמן לו אז או שהיה חולה מעיים בשעת מעשה כל היום זמנו ומחויב להניחן עכ"פ כדי שלא יבטל יום אחד ממצות תפילין:
(6) "At the time of Shema" — for anyone who recites Shema without tefillin is as though he bears false witness against himself. And if the opportunity did not present itself to him then, or he had a stomach ailment at that time, the entire day is its proper time, and he is obligated to put them on in any event, so that he not miss a single day of the mitzvah of tefillin.
ס״ק זותפלה
(ז) ותפלה - ועיין לעיל סימן כ"ה סי"ג. וזהו לכל אדם אבל אנשי מעשה נוהגין ללמוד אחר התפלה בתפילין אך יש ליזהר שלא לדבר בהם דברים בטלים דמלבד איסור דברים בטלים הוא בא עי"ז לידי היסח הדעת. ועיין לעיל בסימן כ"ח סק"ג ובמעשה רב:
(7) "And prayer" — and see above, siman 25, se'if 13. This applies to every person; but men of [pious] deeds have the custom to study after prayer while wearing tefillin. One must, however, take care not to speak idle words while wearing them, for besides the prohibition against idle words, he comes through this to divert his mind (from the tefillin). And see above in siman 28, se'if katan 3, and in the Maaseh Rav.
קטן חהיודע לשמור תפילין בטהר' שלא יישן בהם ולא יפיח בהם: הגה ושלא ליכנס בהן לבית הכסא [רש"י פ' לולב הגזול] חייב אביו לקנות לו תפילין לטחנכו: הגה וי"א דהאי קטן דיוקא שהוא ביאן י"ג שנים ויום א' [בעל העיטור] ויבכן נהגו ואין לשנות [דברי עצמו]:
A minor who knows how to guard tefillin in purity — that he not sleep in them and not pass gas in them — The Rema adds: and that he not enter the privy with them, [Rashi, in the chapter Lulav HaGazul], his father is obligated to buy him tefillin in order to train him. The Rema adds: and some say that this "minor" specifically means one who is thirteen years and one day old [the Baal HaIttur]; and so the custom is, and one should not deviate from it [his own words].

(ח) היודע - דקודם לכן אין רשאי להניח תפילין ולאו חינוך הוא:
(8) "Who knows [how to guard them]" — for before that point he is not permitted to put on tefillin, and it does not constitute [an act of] training.
ס״ק טלחנכו
(ט) לחנכו - במצות הנחתן וכן ללמדו הדינים הנצרכים לזה:
(9) "To train him" — in the mitzvah of putting them on, and likewise to teach him the laws needed for this.
ס״ק ידוקא
(י) דוקא - וקודם לכן אין מניחו ללבוש תפילין אפילו אם ירצה דבודאי אין יודע לשמור תפילין:
(10) "Specifically" — and before then we do not allow him to wear tefillin even if he wishes, for he certainly does not [yet] know how to guard tefillin.
ס״ק יאבן י"ג שנים
(יא) בן י"ג שנים - היינו אפילו אם לא הביא ב' שערות [פמ"ג]:
(11) "Thirteen years old" — meaning even if he has not yet grown two [pubic] hairs (the physical signs of adulthood) [the Pri Megadim].
ס״ק יבוכן נהגו
(יב) וכן נהגו - ועכשיו נהגו להניח ב' או ג' חדשים קודם הזמן [מ"א] ועיין בבה"ל. חרש המדבר ואינו שומע או שומע ואינו מדבר חייב להניח תפילין אבל אין שומע ואין מדבר אין מוחין בידו מלהניחם אם רוצה [בה"ט]:
(12) "And so the custom is" — and nowadays the custom is to begin putting them on two or three months before the time (of becoming bar mitzvah) [the Magen Avraham]; and see in the Bei'ur Halacha. A deaf-mute who speaks but does not hear, or who hears but does not speak, is obligated to put on tefillin; but one who neither hears nor speaks, we do not prevent him from putting them on if he wishes [Be'er Heitev].
