צריך לדקדק אבכתיב' האותיו' שלא תשתנה בצורת שום אחת מהן ולא תדמה גלאחר'. הגה ולכתחלה יכתוב בדכתיבה תמה כמבואר בטור ובשאר פוסקים והוא ידוע אצל הסופרים מיהו אהם שינה בצורת הכתב אינו פסול:
One must take care in the writing of the letters, that the form of none of them be altered and that it not come to resemble another letter. The Rema adds: Ideally one should write in perfect script (ketivah tammah), as is set out in the Tur and the other authorities, and it is well known among the scribes. However, if he deviated in the style of the writing, it is not invalid.

(א) בכתיבת - וה"ה אם נשתנה האות מצורתה אחר הכתיבה ע"י נקב או קרע או טשטוש דפסול וכדלעיל בסימן ל"ב:
(1) 'In the writing' — And the same law applies if the letter's form became altered after it was written, by means of a hole, a tear, or a smudge, so that it is invalid, as explained above in siman 32.

(ב) צורת - אפי' אם שינוי הצורה היה רק במקצת האות כגון שחסר הראש של האל"ף או קוץ היו"ד או שנגעו יוד"י האל"ף בגג האל"ף וכדומה ואפילו אם התינוק יקראהו לאות לא מהני כיון שאנו יודעין שאין צורתה עליה כראוי:
(2) 'The form' — even if the change of form was only in part of the letter, such as where the head of the alef is missing, or the thorn of the yud, or the yuds of the alef touched the roof of the alef, and the like — and even if a child would read it as that letter, it does not help, since we know that its proper form is not upon it.

(3) 'To another [letter]' — I have seen in the Maaseh Rokeach that he cites as practical law, in the name of the responsum of the Maharanach (siman 1), that even if only part of the letter resembles another letter, it is invalid. But from the words of the Vilna Gaon above in siman 32:18 it does not appear so, and so wrote the Pri Chadash.

(ד) כתיבה תמה - ר"ל כתיבה תמה ושלימה בתמונת האותיות כפי מה שלמדוהו מהתלמוד וקבלת הראשונים וע"פ הסוד וכמבואר בב"י בסימן זה:
(4) 'Perfect script (ketivah tammah)' — that is to say, writing that is whole and complete in the forms of the letters, according to what they learned from the Talmud, the tradition of the Rishonim, and according to the mystical teaching, as is explained in the Beit Yosef on this siman.

(5) 'If he deviated, etc.' — This means that he did not write the letter-forms mentioned in the [scribal] books, but the basic form of the letter he does still need, as the Mechaber wrote, that it not be altered, etc., and all the more so that he must not change it into a different letter — such as from a dalet to a resh, or from a bet to a khaf, and the like. And the intent is as the Noda BiYehuda wrote (siman 80): that a detail which has no root in the Gemara — one does not invalidate the letter on its account. And so that the reader will know how to write ideally, and also which detail has a root and belongs to the essential form of the letters, such that it is indispensable even after the fact — I therefore strengthened myself, with God's help, and made a special pamphlet at the end of this siman, and copied from the Beit Yosef, the Pri Megadim, and the other Acharonim the form of every letter in practice, and called it by the name Mishnas Sofrim. And I included in it also a summary of the general laws of encirclement by parchment (hekef gvil), of chak tochot (engraving-out), and of writing out of order (shelo kesidran), from the Pri Megadim and other authorities.

Every letter must be one solid body (golem); therefore one must be careful with the point atop the alef, that it be like a yud, and with the point beneath it, and with the yuds of the shin and the ayin, and the back of the tzadi — that they touch the body of the letter; and if even one is not touching, they are invalid. So too with the other letters — except for the heh and the kuf, whose leg must not touch the roof; and if it touched, it is invalid.

(7) 'And with even one' — meaning even with a single yud of the shin; and the same applies if there is a gap in the middle of the letter.

(8) 'That is not touching' — even if the separation is fine, such that its parting is not clearly discernible, the reading of a child does not help here, since the letter is known and there is no mistaking it for another; for only where its defect stems from a doubt that it resembles another letter does the child's reading help, as above in siman 32:16. And all this is without a repair; but through a repair it does help, so that it will not be a case of writing out of order if the child read it as the letter, as above in siman 32:25 (see there what we wrote in the name of Rabbi Akiva Eiger, and regarding the yud behind the tzadi, whether it looks like a yud and a nun). And in all this there is no difference whether it happened at the time of writing or after the writing, as above in siman 32.
ס״ק טוכן בשאר אותיות
(ט) וכן בשאר אותיות - כגון הנקודה שלמטה שבג' או הנקודה שבפ"א או הרגל שבתוך התי"ו אם לא נגעו בהאות או שיש הפסק באמצע איזה אות:
(9) 'So too with the other letters' — such as the lower point of the gimel, or the point of the pe, or the leg inside the tav — if they did not touch the letter, or if there is a gap in the middle of some letter.

(י) שאין ליגע - ולכתחילה יהיה הפסק בכדי שאדם בינוני יכירנו היטיב מעל ס"ת שע"ג בימה כשהוא קורא בו גם לא ירחיקו יותר מעובי הגג:
(10) 'That it must not touch' — Ideally the gap should be enough that an average person would recognize it well from atop a Torah scroll that is on the reading table while he is reading it; also, one should not distance it more than the thickness of the roof.

(יא) בגג - וה"ה הקו"ף ביריכו שבצידו וכ"ז אפילו אם נעשה הנגיעה אחר הכתיבה ואפילו אם הנגיעה דקה כחוט השערה וכמו שנתבאר לעיל בסימן ל"ב סי"ח במ"ב שם ועי"ש בענין תיקון האות אם לא כתב אח"ז דאל"ה הוי שלא כסדרן:
(11) 'To the roof' — and the same applies to the kuf with its inner leg at its side; and all this holds even if the touching occurred after the writing, and even if the touch is as fine as a hair's breadth, as was explained above in siman 32:18 in the Mishnah Berurah there, and see there regarding repairing the letter, if he has not yet written after it — for otherwise it would be [writing] out of order.

One must add crowns (tagin) to the letters shin, ayin, tet, nun, zayin, gimel and tzadi (SHATNEZ GATZ), and the scribes have adopted the custom of adding crowns to other letters as well. (And if he did not add the crowns) — even to SHATNEZ GATZ — it is not invalid.

(12) 'To add crowns' — even in a Torah scroll, and all the more so in tefillin and mezuzot. These crowns are three small crowns, thin as a hair, standing upright upon these letters — one on the right, one on the left, and one in the middle; and some say all three are on top, and so is the custom. Each crown is like a thin line — such is the custom in these lands; but it is better to make each one somewhat in the form of a zayin, only that they be very small and thin.

(יג) שעטנ"ז ג"ץ - וה"ה צד"י כפופה ונו"ן פשוטה. ואם הוסיף הסופר לעשות תגין חוץ מאותיות שעטנ"ז ג"ץ וחוץ מאלו המוזכרים בטור ובלבוש שנהגו בהם הסופרים לא עכב אך בתנאי שיהיו מחוברים להאות אבל אם אינו מחובר יש למוחקו ואפילו באותיות שבשם הקודש ולכתחילה אין נכון להוסיף תגין מעצמו כל שלא מוזכר בספרים. ותיוג של שעטנ"ז ג"ץ הוא בשין על ראש השלישי של האות ובעי"ן וטי"ת וצד"י על ראש השמאלי וידביקן באמצעיתו לא בסופו. כתבו האחרונים בשם תשובת הרמ"ע שיזהר שיהיו התגין נפרדין כל אחד מחבירו כדי שלא יראו רק כתמונת זיונין ולא כעיי"ן ושי"ן ולעיכובא הוא. גם צריך שיהיו התגין נוגעין בגוף האות ואל"ה פסולין דאף דאין עיכוב בעשיית התגין כמו שפסק המחבר מ"מ זה גרע דהוי כיתרון אות קטנה בין השיטין ועיין ביד אפרים שכתב דלא מהני אף אם ימשיכם אח"כ אל האות רק צריך לגוררם ולכותבם מחדש רק אם ידעינן שכתבן מומחה תלינן שנפרד אחר שנכתב ומכשירין בהמשכה אל האות. והלבושי שרד כתב דהרמ"ע ס"ל דלא גרע דבר זה מחסרון הקפת גויל דאינו מעכב רק בתחלה וע"כ אם נפרד אחר שנכתב כשר בלא תיקון כלל וממילא לדבריו אם לא היו נוגעין מתחלת הכתיבה מהני עכ"פ תיקון דומי' דמש"כ המ"א בסי' ל"ב סקכ"ז לענין הקפת גויל וכן משמע לענ"ד מפשטא דלישניה דהרמ"ע ע"ש. ומ"מ לכתחלה נכון להחמיר כיד אפרי' ועי' פמ"ג:
(13) 'SHATNEZ GATZ' — and the same applies to the bent tzadi and the final nun. And if the scribe added crowns beyond the letters SHATNEZ GATZ and beyond those mentioned in the Tur and the Levush that the scribes were accustomed to crown, it does not invalidate, but on condition that they are attached to the letter; however, if it is not attached, it must be erased — even in the letters of a holy Name; and ideally it is improper to add crowns of one's own accord whenever it is not mentioned in the books. The crowning of SHATNEZ GATZ is: on the shin, upon the third (leftmost) head of the letter; and on the ayin, tet, and tzadi, upon the left head; and he should attach them at its middle, not at its end. The Acharonim wrote in the name of the responsum of the Rema (Rabbi Menachem Azariah of Fano) that one should take care that the crowns be separated one from another, so that they appear only like the form of little zayins and not like an ayin or a shin; and this is indispensable. Also the crowns must be touching the body of the letter, and if not, they are invalid; for although there is no indispensability in the making of the crowns, as the Mechaber ruled, nevertheless this is worse, for it is like an extra tiny letter between the lines. And see the Yad Ephraim, who wrote that it does not help even if he afterward extends them to the letter; rather he must scrape them off and write them anew — except that if we know a skilled scribe wrote them, we assume they became separated after being written, and we validate them by extending them to the letter. The Levushei Srad wrote that the Rema holds this matter is no worse than a lack of parchment-encirclement, which is indispensable only at the outset; therefore if it became separated after being written, it is valid with no repair at all. And consequently, according to him, if they were not touching from the start of the writing, a repair helps in any case — similar to what the Magen Avraham wrote in siman 32:27 regarding parchment-encirclement; and so it seems to me, in my humble opinion, from the plain sense of the Rema's language — see there. Nevertheless, ideally it is proper to be stringent like the Yad Ephraim; and see the Pri Megadim.

(יד) נהגו לתייג - בתפילין אותיות אחרות מלבד אלו והם מוזכרים בטור בשם השמושא רבא ובשם הרמב"ם. והתגין האלו הם תגינים גדולים אך שיהיו דקים שלא יתקלקל האות עי"ז ומאוד צריך ליזהר ביותר בתגין שעל הוי"ו או שעל היו"ד כי בקל ישתנה האות עי"ז:
(14) 'Were accustomed to crown' — in tefillin, other letters besides these, and they are mentioned in the Tur in the name of the Shimusha Rabba and in the name of the Rambam. These crowns are large crowns, only that they should be thin so that the letter not be ruined by them; and one must be especially careful with the crowns on the vav or on the yud, for the letter is easily altered by them.

(טו) לא פסל - והב"ח פוסל בזה וגם הגר"א בביאורו מיישב לכ"א מן השיטות ומביא הרבה פוסקים דמחמירין בזה ע"כ מהנכון מאוד לחוש לזה ולתקנם אח"כ ותיקון מהני אפילו בתו"מ ולא הוי בזה שלא כסדרן דבלא התגין נמי צורתה עליה (אחרונים) ודע עוד דהמחבר מיירי שעשה ראש האות למעלה כתיקונו אך שחיסר התגין שעליו אבל אם עשה למעלה ראשו עגול ג"כ משמע מהב"י דאין להקל אפי' בדיעבד לפי פירוש הרא"ם וצ"ע למעשה כי לכאורה להרמב"ם יש להקל בכל גווני [עיין בביאור הגר"א דלהרמב"ם לא איירי הגמרא כלל בתפילין רק במזוזה ולא לענין עיגול והמשכה אך לענין תגין ממש ורק לכתחלה] כתב בספר איגרת הטיול שעטנ"ז הוא אותיות שט"ן ע"ז והם ב' מקטרגים גדולים וזהו ג"כ סוד של שעטנ"ז ג"ץ כי ג"ץ ג"כ שם מקטרג אחד והתגין שעליהם הם כמו חרב וחנית להנצל מהם:
(15) 'It is not invalid' — But the Bach invalidates in this case; and also the Vilna Gaon in his commentary reconciles each of the views and cites many authorities who are stringent about this. Therefore it is very proper to be concerned for this and to repair them afterward, and the repair helps even in tefillin and mezuzot, and there is here no 'out of order,' for even without the crowns its form is upon it (Acharonim). Know further that the Mechaber is speaking where he made the head of the letter above as it should be, only that he omitted the crowns upon it; but if he made its head round above, then too it is implied from the Beit Yosef that one may not be lenient even after the fact, according to the interpretation of the Reem; and it requires study in practice. For seemingly, according to the Rambam, one may be lenient in all cases [see the Vilna Gaon's commentary, that according to the Rambam the Gemara does not speak of tefillin at all, only of the mezuzah, and not regarding rounding and extension, but rather regarding actual crowns, and only as an ideal]. The book Iggeret HaTiyul wrote that SHATNEZ is the letters SATAN and AVODAH ZARAH (idolatry), and these are two great accusers; and this too is the secret of SHATNEZ GATZ, for GATZ is likewise the name of one accuser, and the crowns upon them are like a sword and spear, to be saved from them.
