זמן אהנחתן בבוקר משיראה את חבירו הרגיל בעמו קצת ברחוק ארבע אמות ויכירנו:
The time for donning them (tefillin) in the morning is from when one can see a fellow with whom he is somewhat acquainted at a distance of four cubits (amos), and can recognize him.
ס״ק אהנחתן
(א) הנחתן - ר"ל תחלת זמן הנחתן משיראה ומצותן כל היום וכדלקמן בסימן ל"ז עי"ש והטעם דעד זמן הזה חיישינן שמא יישן בהם ובכלל לילה הוא לענין תפילין:
Explaining 'the time for donning them': that is to say, the beginning of the time for donning them is from when he can see [a fellow at four cubits], while the mitzvah [of wearing them] extends the entire day, as [explained] further on in siman 37; see there. The reason [it does not begin earlier] is that until this time we are concerned lest he fall asleep in them, and [that earlier hour] is included in 'night' with respect to tefillin.

(ב) עמו קצת - דאלו הרבה יכירנו אפילו מרחוק ואינו רגיל כלל לא יכיר אפילו בקרוב מאוד:
Explaining 'somewhat acquainted with him': for one whom he knows well he would recognize even from afar, while one with whom he is not acquainted at all he would not recognize even at very close range — so the measure is set by a moderately familiar acquaintance.
אסור להניח תפילין גבלילה שמא ישכחם דוישן בהם. אם הניחם הקודם שתשקע החמה וחשכה עליו אפילו הם עליו וכל הלילה זמותר חואין מורין כן. אם לא חלץ תפילין מששקעה חמה מפני שלא היה מקום לשמרן טונמצאו עליו כדי לשמרן מותר ומורין כן:
It is forbidden to don tefillin at night, lest he forget about them and sleep while wearing them. If he put them on before the sun set and then night fell upon him, then even though they remain on him the whole night, it is permitted [to leave them on]. But one does not issue this as a public ruling. If he did not remove the tefillin once the sun had set, because there was no place to safeguard them, and so they remain upon him in order to keep them safe, it is permitted, and one may even issue this as a public ruling.

(ג) בלילה - ובין השמשות מדברי המג"א משמע דמותר לכתחלה להניח אבל בפמ"ג מסתפק בזה אם לא שלא קיים עדיין מצות תפילין באותו יום דאז יניחם בין השמשות:
Explaining 'at night': and as for twilight (bein hashemashos), from the words of the Magen Avraham it appears that it is permitted to don them even at the outset; but the Pri Megadim is in doubt about this. This is unless he has not yet fulfilled the mitzvah of tefillin that day, in which case he should put them on during twilight.
ס״ק דויישן בהם
(ד) ויישן בהם - וחיישינן שמא יפיח בשינתו אבל מדאורייתא מותר להניחם בלילה דקי"ל לילה זמן תפילין:
Explaining 'and sleep in them': we are concerned lest he break wind in his sleep, which is a disgrace to the tefillin; but by Torah law it is permitted to don them at night, for we hold that night is [in principle] a time for tefillin.

(ה) קודם וכו' - ר"ל דלא אסרו רבנן רק להניחם לכתחלה בלילה אבל מכיון שכבר מונחין עליו מבעוד יום לא הצריכום לחלצן:
Explaining 'before, etc.': that is to say, the Rabbis forbade only donning them at night in the first place, but since they are already resting on him from while it was still day, they did not require him to remove them.

(ו) כל הלילה - פי' כל זמן שאין חולצן דאלו חולצן פ"א שוב אסור להניחן:
Explaining 'the whole night': that is, [it is permitted] for as long as he does not remove them; for if he removes them once, it is then forbidden to put them back on [at night].

(ז) מותר - ר"ל עד זמן שרוצה לישן דאז בהכרח מסירן שאסור לישן שינת קבע בהן וכדלקמן בסימן מ"ד. ואפשר דבלילה דזמן שינה הוא אפילו שינת עראי אסור מדינא:
Explaining 'it is permitted': that is to say, [it is permitted to leave them on] until the time he wishes to sleep, for then he must necessarily remove them, since it is forbidden to sleep a fixed sleep while wearing them, as [explained] further on in siman 44. And it is possible that at night, which is a time for sleeping, even a brief nap is forbidden by law [while wearing them].

(ח) ואין מורין כן - הלכה למעשה לאחרים שמא יבואו להניחן לכתחלה וע"כ לא יעשה כן אלא בינו לבין עצמו אבל לא ברבים דהוא ג"כ כהוראה וע"כ אין להתפלל בהם תפילת ערבית בתענית צבור ברבים:
Explaining 'and one does not rule so': [one does not issue this] as a practical ruling to others, lest they come to don them in the first place [at night]; and therefore he should do this only privately, between himself and himself, but not in public, for that too is like [issuing] a ruling. And therefore one should not pray the evening prayer while wearing them at a public communal fast in the presence of the congregation.

(ט) ונמצאו עליו - דוקא נמצאו מקילינן ומורין שבשביל השמירה אין צריך לחלוץ אפילו כל הלילה כ"ז שלא ישן אבל להניחם לכתחלה אסור בשביל השמירה ויש מקילין בזה [ע"ת והגר"א]:
Explaining 'and they remain on him': specifically when they already remain on him do we rule leniently and permit it publicly, namely that for the sake of safeguarding them he need not remove them even the whole night, as long as he does not sleep; but to put them on in the first place for the sake of safeguarding is forbidden. And some are lenient in this matter [per the cited authorities and the Vilna Gaon (the Gra)].
היה רוצה ילצאת לדרך יאבהשכמה יבמניחם יגוכשיגיע זמנם ימשמש בהם ויברך דליכא למיחש שמא יישן בהם כיון שהשכים ידויצא לדרך:
If he wished to set out on a journey early [before dawn], he may put them on [even then], and when their [proper] time arrives he should feel them [to renew his awareness of wearing them] and recite the blessing; for here there is no concern that he will fall asleep in them, since he rose early and went out on the road.

(י) לצאת לדרך - וקשה לו להניחן אח"כ מפני הקור וכל כה"ג [ח"א]:
Explaining 'to set out on a journey': [this leniency applies] where it would be difficult for him to don them afterward on account of the cold, and any comparable case [Chayei Adam].

(יא) בהשכמה - אפילו קודם עמוד השחר:
Explaining 'early [in the morning]': even before dawn (amud hashachar).

(יב) מניחם - קודם יציאתו. ויכול לכוין שלובשם לשם מצוה כיון דקי"ל לילה זמן תפילין הוא ואפילו היה לו מקום לשמרן ג"כ מותר ללובשן כיון דליכא למיחש לשמא יישן בהם וכדלקמיה:
Explaining 'he dons them': before he departs. And he may intend that he is wearing them for the sake of the mitzvah, since we hold that night is [in principle] a time for tefillin. And even if he had a place to safeguard them, it is likewise permitted for him to wear them, since there is no concern that he will fall asleep in them, as [explained] just below.

(יג) וכשיגיע זמנן - דאף דהתירו חז"ל להקדים ההנחה בלילה במקום דליכא למיחש לשינה אפ"ה לענין ברכה לא רצו לתקן לומר וציונו קודם הזמן. ומ"מ אם קידם ובירך בלילה כשהניחם א"צ לברך שנית בבקר:
Explaining 'and when their time arrives': for although the Sages permitted donning them early, at night, in a case where there is no concern about sleep, nevertheless, with regard to the blessing they did not wish to institute saying '[Who sanctified us...] and commanded us' before the [proper] time. In any event, if he did recite the blessing early, at night, when he put them on, he need not recite the blessing a second time in the morning.

(יד) ויצא לדרך - ודוקא הולך ברגליו או רוכב אבל יושב בעגלה אסור להניח שמא יישן בהם ועיין בבה"ל:
Explaining 'and went out on the road': and this is specifically when he goes on foot or rides [an animal]; but one who sits in a wagon is forbidden to don them, lest he fall asleep in them. And see the Bei'ur Halachah.
היה בא בדרך ותפילין בראשו טוושקעה עליו חמה או שהיה יושב בבית המדרש ותפילין בראשו טזוקדש עליו היום יניח ידו עליהם עד שיגיע לבית ואם יש בית קרוב לחומה שמשתמרין שם חולצן ומניחם שם:
If he was traveling on the road with tefillin on his head and the sun set upon him, or he was sitting in the study hall with tefillin on his head and the [Shabbos] day became sanctified upon him, he should place his hand upon them [to cover them] until he reaches home. And if there is a house near the wall where they can be kept safe, he removes them and leaves them there.

(טו) ושקעה וכו' - רישא זו מיירי בחול ולחולצן ולנושאן בידו הוא מתיירא שמא יפלו ממנו בדרך והתירו לו להניח ידו עליהם ולכסותם ואע"ג דבס"ב אמרינן דמכיון שהם מכבר עליו א"צ לחולצן שאני הכא דמי שיפגע בו פן יטעה לומר שמותר להניח אז תפילין אבל בסמוך מיירי שיושב בביתו. והאי ושקעה חמה פירוש סוף שקיעה דהוא צאת הכוכבים דבבין השמשות א"צ לחולצן ומורין כן למעשה וכ"ז מדינא ובשם האר"י ז"ל כתוב שהיה נזהר לחולצן אחר שקיעת החמה:
Explaining 'and [the sun] set, etc.': this first clause deals with a weekday. He is afraid to remove them and carry them in his hand, lest they fall from him along the way; so they permitted him to place his hand over them and cover them. And although in se'if 2 we said that since they are already upon him he need not remove them, here it is different, for one who encounters him might err and say that it is permitted to don tefillin at that time — hence he must cover them; but the case immediately following deals with one who is sitting in his home. And this '[the sun] set' means the end of sunset, which is the emergence of the stars; for during twilight he need not remove them, and one may rule so in practice. All this is by the letter of the law; but in the name of the Arizal it is written that he was careful to remove them right after sunset.

(טז) וקידש וכו' - ר"ל דנעשה בין השמשות וא"א לו לישא אותם בידו לביתו מפני קדושת שבת ולהשאיר אותם שם אי אפשר דבתי מדרשות שלהם היו בשדה מקום שאין משומר מפני הגנבים ע"כ התירו לו חכמים לנושאם עליו דרך מלבוש עד ביתו אך צריך לכסותם שלא יראוהו שהוא נושא תפילין עליו בשבת:
Explaining 'and [the day] became sanctified, etc.': that is to say, twilight had set in [ushering in Shabbos], and he cannot carry them home in his hand because of the sanctity of Shabbos, and to leave them there is impossible, for their study halls were in the field, a place not guarded against thieves; therefore the Sages permitted him to carry them upon himself in the manner of a garment [i.e., worn] until he reaches his home. But he must cover them, so that people will not see that he is carrying tefillin upon himself on Shabbos.
יש מי שאומר שאם התפלל תפל' ערבית יזמבעוד יום עד שלא הניח תפילין אין לו להניחם אחר כך:
There is one authority who says that if one prayed the evening prayer (Maariv) while it was still day, before he had yet donned tefillin, he should not put them on afterward.

(יז) מבעוד יום - ואפילו עוד היום גדול קודם שקיעה לפי שכבר עשאו לזמן הזה לילה וזמן שכיבה בק"ש ותפלה של ערבית ואם יניח בו תפילין יחזור ויעשהו יום והרי הן שתי קולות שסותרות זו את זו אך האחרונים הסכימו להלכה דמחוייב להניחן ובלי ברכה כל זמן שהוא קודם צאת הכוכבים ואם הוא לא התפלל עדיין אע"פ שהצבור התפללו אין בכך כלום ויניחם בברכה אם הוא עדיין יום כיון שהוא אינו עושה שתי קולות הסותרות זו את זו ודוקא אם לא הניחן באותו יום כלל אבל אם כבר הניח תפילין רק שרוצה להניח גם עתה אין ראוי להניחם אם הצבור כבר התפללו ערבית:
Explaining 'while it was still day': and this applies even when it is still broad daylight, before sunset, because [by praying Maariv] he has already made this time into 'night' and the time of lying down, through the [evening] Shema and the evening prayer; and if he were now to don tefillin, he would once again turn it back into 'day,' and these would be two leniencies that contradict one another. However, the later authorities (Acharonim) agreed as a matter of law that he is obligated to don them — but without a blessing — at any time before the emergence of the stars. And if he himself has not yet prayed [Maariv], then even though the congregation has prayed, it is of no consequence, and he may don them with a blessing, provided it is still day, since he is not creating two contradictory leniencies. And this is specifically if he did not don them at all that day; but if he already donned tefillin [earlier] and merely wishes to don them now as well, it is not proper for him to put them on if the congregation has already prayed the evening prayer.
