סעיף א׳

כשיכנס לבה"כ יאמר התכבדו מכובדים וכו'. אועכשיו לא נהגו לאמרו:

When one enters the bathroom he should recite 'Be honored, honored ones...' and so on — the formula addressed to the escorting angels, asking them to wait for him. But nowadays the custom is not to say it.

ס״ק אועכשיו וכו'

(א) ועכשיו וכו' - כי אין אנו מוחזקין ליראי שמים שמלאכים מלוין אותנו שנבקשם שימתינו עלינו עד שנצא:

On the words 'but nowadays' etc., the MB explains: because we are no longer presumed to be such God-fearing people that angels escort us, such that we would ask them to wait for us until we come out.

סעיף ב׳

יהא צנוע בבית הכסא ולא יגלה עצמו בעד שישב: הגה וגלא ילכו שני אנשים ביחד גם לדא ידבר שם ויסגור הדלת בעדו משום צניעות. (אור זרוע):

One should be modest in the privy and not uncover himself until he sits down. The Rema adds: two people should not go in together, and one should also not talk there, and he should close the door behind him — all out of modesty. (This is from the Or Zarua.)

ס״ק בעד שישב

(ב) עד שישב - וה"ה שלא יקום כשהוא מגולה:

On 'until he sits down': the same applies that he should not stand up while still uncovered.

ס״ק גולא ילכו

(ג) ולא ילכו - ואם מפחד יכול אחד להניח ידו על ראשו דרך החלון ובלבד שלא יראה פירועו וכדלקמן בס"ח וליכנס שם להדיא אסור אפילו עם אשתו אך עם קטן שאין בו דעת מותר ליכנס [ארה"ח]:

On 'two should not go in together': but if one is afraid, the other may place his hand on his head through the window, provided he does not see his exposure, as stated below in se'if 8. To enter there openly with him is forbidden even with one's wife, but with a small child who lacks understanding it is permitted to enter. (This is from the Orchos Chaim.)

ס״ק דלא ידבר

(ד) לא ידבר - ואם הוא לצורך גדול אפשר דמותר לדבר כ"ז שאין נפנה עדיין אבל בעת שנפנה אף לצורך גדול אסור ואם א"א לסגור הדלת ואיש אחר רוצה לכנוס ינחרו זה לזה ולא ידברו רק הנשים כשהולכות לבית הכסא הקבוע לרבים כמו בהכ"ס שבשדה בימיהם או בחצר בהכנ"ס במדינות אלו התקינו חכמים שיהיו מספרות זו עם זו כדי שישמע קולן מבחוץ ולא יכנוס איש לשם ויתיחד עמהן [סנהדרין י"ט] ומשמע קצת שם דנכנסות ג"כ בשתים בבהכ"ס:

On 'he should not talk': if there is a pressing need, it is possibly permitted to speak as long as he has not yet begun to relieve himself, but while actually relieving himself, even for a pressing need it is forbidden. And if the door cannot be closed and another man wishes to enter, they should signal to each other by clearing the throat rather than by speaking. Only women — when they go to a public privy, such as the field privies of their times or a courtyard privy near the synagogue in these lands — the Sages ordained that they should talk with one another, so that their voices are heard from outside and no man would enter and be secluded with them. (This is from Sanhedrin 19.) And it is somewhat implied there that women, too, would enter the privy in pairs.

סעיף ג׳

אם רוצה הלמשמש בפי הטבעת בצרור או בקיסם לפתוח נקביו ימשמש קודם שישב ולא ימשמש אחר שישב מפני שקשה לכשפים:

If one wishes to rub the anal opening with a pebble or a wood-chip in order to open his orifice, he should do the rubbing before he sits, and not rub after he has already sat, because doing so afterward makes one vulnerable to witchcraft.

ס״ק הלמשמש

(ה) למשמש - אם אינו יכול לפנות ילך ד"א וישב ויעמוד וישב עד שיפנה או יסיח דעתו מדברים אחרים. ולא יפנה בעמידה:

On 'to rub': if he cannot relieve himself, he should walk four cubits, then sit, stand, and sit again until he is able, or he should divert his mind from other matters. And he should not relieve himself while standing.

סעיף ד׳

לא יגלה עצמו כי אם מלאחריו וטפח ומלפניו טפחיים ואשה מאחריה טפח ומלפניה ולא כלום:

A man should uncover himself only a handbreadth from behind and two handbreadths in front, and a woman a handbreadth from behind and in front nothing at all.

(ו) טפח - ולא יותר משום צניעות ומלפניו טפחיים דמתוך שהוא דוחק א"ע לגדולים הוא בא לידי קטנים וצריך טפחיים משום קלוח מי רגלים הנתזין למרחוק והב"ח כתב דנכון להחמיר שיהיה גם מלפניו רק טפח ולא הסכימו עמו הרבה מהאחרונים. ויזהר שלא ילכלך שם בגדיו וגופו ומנעליו:

On 'a handbreadth': and no more, out of modesty. In front, two handbreadths — for since he presses himself for a bowel movement he comes to pass urine as well, and two handbreadths are needed because of the stream of urine that sprays far. The Bach wrote that it is proper to be stringent that even in front it be only one handbreadth, but many of the later authorities did not agree with him. And he should be careful not to soil his clothes, his body, or his shoes there.

סעיף ה׳

אם נפנה במקום זמגולה חשאין בו מחיצות יכוין שיהיו פניו לדרום ואחוריו לצפון טאו איפכא אבל יבין מזרח למערב אסור: (ולהטיל מים בכל ענין שרי) (ב"י בשם הרמב"ם):

If one relieves himself in an open place that has no partitions, he should arrange to face south with his back to the north, or the reverse. But facing between east and west is forbidden. (To urinate, however, is permitted in any direction.) (This is the Beis Yosef citing the Rambam.)

ס״ק זמגולה

(ז) מגולה - אבל בחצר בכל ענין שרי כ"כ הב"י והמ"א אבל הט"ז הסכים עם מהר"י אבוהב דבחצר ג"כ אסור באמצע החצר בין מזרח למערב דהלא מגולה הוא באותו מקום אם לא שמקרב עצמו לצד אחד מהכתלים וכ"כ הדרישה וש"א:

On 'open place': but in an enclosed courtyard it is permitted in every case — so write the Beis Yosef and the Magen Avraham. The Taz, however, agreed with Mahari Abohav that in a courtyard too it is forbidden — in the middle of the courtyard, facing between east and west — since in that spot he is in the open, unless he draws close to one of the walls. And so write the Derishah and other authorities.

ס״ק חשאין בו מחיצות

(ח) שאין בו מחיצות - אבל אם יש בו מחיצות ואפילו רק מחיצה אחת לצד מערב ישב בצד המחיצה בסמוך לה [דהיינו עכ"פ בתוך ד' אמות] ואחוריו למערב כלפי המחיצה ונפנה שם וכן אם הכותל במזרח יושב בסמוך לה ואחוריו למזרח ויש מחמירין בזה מפני שפירועו שלפניו הוא לצד מערב והשכינה במערב ובמקום שאפשר טוב להחמיר. כתב הפמ"ג דאין שיעור לגובה המחיצה רק כל שאין פירועו מגולה עי"ז שרי:

On 'that has no partitions': but if it does have partitions, even just one partition on the west side, he should sit beside the partition, close to it (that is, at least within four cubits), with his back to the west facing the partition, and relieve himself there. Likewise, if the wall is on the east, he sits close to it with his back to the east. Some are stringent in this case, since his frontal exposure faces west and the Divine Presence is in the west; where possible it is good to be stringent. The Pri Megadim wrote that there is no minimum height for the partition; as long as it keeps his exposure from being seen, it is permitted.

ס״ק טאו איפכא

(ט) או איפכא - וי"א דאיפכא לא וטוב ליזהר בזה:

On 'or the reverse': some say the reverse — back to the south, face to the north — is not allowed, and it is good to be careful in this.

ס״ק יבין מזרח וכו'

(י) בין מזרח וכו' - משום דהשכינה שורה במערב ואפילו אם מחזיר פניו למערב אסור דמזרח שהוא נגד מערב יש לו ג"כ קדושה:

On 'between east and west': because the Divine Presence rests in the west, and even if he turns his face toward the west it is forbidden, since the east, which stands opposite the west, also has sanctity.

סעיף ו׳

וכן אסור לישן יאבין מזרח למערב אם אשתו עמו ונכון להזהר יבאפילו כשאין אשתו עמו:

Likewise it is forbidden to sleep oriented between east and west if his wife is with him, and it is proper to be careful even when his wife is not with him.

ס״ק יאבין מזרח וכו'

(יא) בין מזרח וכו' - רק יכוין שיהא ראשה של המטה לצפון ומרגלותיה לדרום. ובתשובת מנחם עזריה פסק כמו שכתב הזוהר פרשה במדבר שיהא ראשה ומרגלותיה של המטה זה למזרח וזה למערב והסכים שם שיהא הראש למערב וכ"כ בארצות החיים בשם כמה אחרונים ומ"מ טוב יותר לכתחילה לנהוג כהשו"ע כי בתשובת בנין של שמחה כתב בשם הגר"א שאמר שגם כוונת הזוהר הוא כהגמרא ולא כפירוש הרמ"ע הנ"ל:

On 'between east and west' regarding sleeping: he should simply arrange that the head of the bed be to the north and its foot to the south. In the responsa of Menachem Azaryah (the Rama miPano) he ruled like the Zohar in Parashas Bamidbar, that the head and foot of the bed be one to the east and one to the west, and he concluded there that the head should be to the west; so too writes the Aretz HaChaim in the name of several later authorities. Nevertheless, it is better initially to follow the Shulchan Aruch, for the responsa Binyan Shel Simchah cites the Vilna Gaon that even the Zohar's intent accords with the Gemara, and not like the interpretation of the Rama miPano mentioned above.

ס״ק יבאפילו כשאין וכו'

(יב) אפילו כשאין וכו' - עיין בארה"ח דבזה אין להחמיר רק בשוכב ערום ובאין קלעים סביב המטה:

On 'even when his wife is not with him': see the Orchos Chaim, that in this case one need only be stringent when lying naked and there are no curtains around the bed.

סעיף ז׳

המטיל מים מן הצופים ולפנים (פי' מקום שיכולים משם לראות הר הבית ומשם והלאה אין יכולים לראות רש"י) (ליגא) ישב ופניו כלפי הקודש (אלידא לצפון או לדרום) או יסלק הקודש לצדדין:

One who urinates from Tzofim and inward — that is, within sight of the Temple — (Rashi explains: Tzofim is the place from which one can still see the Temple Mount; beyond it one can no longer see it.) should not sit with his face toward the holy place, (but rather turned to the north or the south), or he should shift the holy place off to his side.

ס״ק יגלא ישב ופניו וכו'

(יג) לא ישב ופניו וכו' - כצ"ל. ט"ז וש"א:

On 'he should not sit with his face' etc.: this is the correct reading — so the Taz and other authorities emend the text.

ס״ק ידאלא לצפון וכו'

(יד) אלא לצפון וכו' - וה"ה אם אחוריו כלפי הקודש שרי בהטלת מי רגלים ועיין בביאור הגר"א שהסכים דאפילו מן הצופים ולחוץ אם פניו כלפי הקודש אסור בהטלת מי רגלים. אסור לעמוד לפנות להדיא נגד בהכ"נ או בהמ"ד דלא יהא מכלל מי שנאמר עליהם ואחוריהם אל היכל ד' וכן לא יעשה בהכ"ס מכוון כנגד בהכ"נ או בהמ"ד שלא יהא הפי הטבעת מגולה נגדם [ס"ח סי' תתי"ד והעתיקו בא"ר והגהות רעק"א] ואם בונה כותל באמצע להפסיק בין מחיצת בהכ"ס לבית הכנסת לכאורה אין להחמיר ועיין בארה"ח:

On 'but rather to the north' etc.: the same applies that if his back is toward the holy place, urinating is permitted. See the Biur HaGra, who held that even from Tzofim and outward, if his face is toward the holy place, urinating is forbidden. It is forbidden to stand and relieve oneself directly opposite a synagogue or study hall, so that he not be among those of whom it is said 'and their backs were toward the Sanctuary of Hashem.' Likewise one should not make a privy aligned directly opposite a synagogue or study hall, so the anal opening not be exposed toward them. (This is from Sefer Chasidim §814, copied by the Eliyahu Rabbah and the glosses of Rabbi Akiva Eiger.) But if one builds a wall in between to separate the privy's partition from the synagogue, seemingly one need not be stringent; and see the Orchos Chaim.

סעיף ח׳

כשנפנה בשדה אם הוא אחורי הגדר טויפנה מיד ובבקעה יתרחק עד מקום שלא יוכל חבירו לראות טזפירועו:

When one relieves himself in a field: if he is behind a fence, he may relieve himself right away, but in an open valley he should distance himself to a spot where his fellow cannot see his exposure.

(טו) יפנה מיד - דהא אין חבירו רואה את פירועו וכן בחצר אחורי כותל הבית ואע"פ שחבירו שומע קול עיטושו שלמטה אין בכך כלום שבהשמעת קול עיטוש שלמטה אין בו איסור משום צניעות אלא שהיא חרפה ובושה לבנ"א ומי שאינו מקפיד אינו מקפיד:

On 'he may relieve himself right away': for his fellow does not see his exposure; the same applies in a courtyard behind the wall of the house. And even though his fellow hears the sound of his lower 'sneeze,' that is of no concern, for making the sound of a lower 'sneeze' heard involves no prohibition of immodesty, it is merely a disgrace and embarrassment for people — and one who is not particular about it, is not particular.

ס״ק טזפירועו

(טז) פירועו - ר"ל גילויו מה שמגלה מבשרו מלפניו או מלאחריו ואע"פ שרואה את גופו ושומע קול עיטוש שלו שרי:

On 'his exposure': this means his uncovering — the flesh he exposes, whether in front or behind. And even though his fellow sees his body and hears the sound of his 'sneeze,' it is permitted.

סעיף ט׳

לא ישב במהרה ובחוזק ולא יאנוס לדחוק עצמו יותר מדאי שלא ינתק שיני הכרכשתא:

One should not sit down quickly or forcefully, and should not strain to press himself too much, so that he not tear the muscles of the rectum.

סעיף י׳

לא יקנח יזביד ימין:

One should not wipe himself with the right hand.

ס״ק יזביד ימין

(יז) ביד ימין - מפני שקושר בה תפילין על זרוע השמאלי ועוד טעמים אחרים עיין בגמרא וטוב ליזהר מלקנח באצבע האמצעי שכורך עליו הרצועה וכתבו האחרונים דאיטר יד שכל עניניו עושה בשמאל מקנח בשמאל דידיה שהוא ימין כל אדם ואם כותב בשמאל ושאר מעשיו עושה בימין או להיפך עיין בבה"ל:

On 'with the right hand': because with it he ties the tefillin onto the left arm; and there are other reasons — see the Gemara. And it is good to avoid wiping with the middle finger, around which one winds the strap. The later authorities wrote that a left-handed person, who does all his affairs with his left, wipes with his left — which is most people's right. And if he writes with the left but does the rest with the right, or the reverse, see the Biur Halachah.

סעיף י״א

לא יקנח יחבחרס משום כשפים ולא בעשבים יבשים שהמקנח בדבר שהאור שולט שיניו התחתונות נושרות ולא בצרור שקנח בו יטחבירו מפני שמביא את האדם לידי תחתוניות: הגה ועכשיו שבתי כסאות שלנו אכינן בשדה נהגו לקנח (בחרס וכן נהגו לקנח) בכאדבר שהאור שולט בו ואינו מזיק ופוק חזי מאי עמא דבר. (חדושי אגודה פרק המוציא):

One should not wipe with a shard of earthenware, because of witchcraft, nor with dry grasses — for one who wipes with something that fire has acted upon causes his lower teeth to fall out; nor with a pebble that his fellow already wiped with, because it brings a person to hemorrhoids. The Rema adds: nowadays, since our privies are not in the field, the custom is to wipe (even with earthenware; and so the custom is to wipe) with something that fire has acted upon, and it causes no harm, and 'go out and see what the people are doing' — the widespread practice may be relied upon. (This is from the Chidushei Agudah, chapter HaMotzi.)

ס״ק יחבחרס

(יח) בחרס - ואפילו היא חלקה ואינה מקרע הבשר דאם אינה חלקה ויש בה חדודים קטנים יש בזה ג"כ מפני הסכנה שלא ינתק שיני הכרכשתא:

On 'with earthenware': even if it is smooth and does not tear the flesh — the ban is because of witchcraft. For if it is not smooth and has small sharp points, there is in addition the danger that it may tear the muscles of the rectum.

ס״ק יטחבירו

(יט) חבירו - אבל אם קנח הוא עצמו בו או שיבש או שקנח מצד אחר לית לן בה:

On 'his fellow': but if he himself wiped with it, or it has dried, or he wipes on its other side, there is no concern.

ס״ק כאינן בשדה

(כ) אינן בשדה - ולא שכיחי כשפים לכן מותר בחרס ודוקא אם הוא חלק וכנ"ל:

On 'are not in the field': and witchcraft is not common there, so earthenware is permitted, and specifically if it is smooth, as above.

ס״ק כאבדבר שהאור וכו'

(כא) בדבר שהאור וכו' - אפשר דוקא לענין שאר דברים אבל לענין עשבים יבישים גם לההג"ה יש להחמיר דהם מחתכים את הבשר וכדלקמן בסי' שי"ב ס"ה עיין בפמ"ג. כתב בהגהות ר"ע איגר בשם הס"ח כשיוצא מבהכ"ס יראה המקום שישב עליו שלא יהיה טינופות שמא יבוא חבירו פתאום או בלילה וישב עליו:

On 'with something that fire has acted upon': possibly this permits only other materials, but regarding dry grasses, even according to the Rema's gloss one should be stringent, for they cut the flesh, as stated below in siman 312, se'if 5 — see the Pri Megadim. Rabbi Akiva Eiger's glosses cite Sefer Chasidim: when one leaves the privy he should check the spot he sat on, that there be no filth, lest his fellow come suddenly, or at night, and sit on it.

סעיף י״ב

יפנה כבבצניעות בלילה כמו ביום:

One should relieve himself modestly at night just as by day.

ס״ק כבבצניעות בלילה

(כב) בצניעות בלילה - ר"ל שלא יגלה עצמו יותר מביום ולא יגלה עצמו עד שישב וכה"ג כי לפניו ית' חשיכה כאורה אבל א"צ להתרחק ואם אין שם אדם מפנה ברחוב ורק שיזהר שלא יהיה במקום הילוך ב"א כדי שלא יטנפו בני אדם על ידו אבל אם יש שם אדם אפילו נכרי אסור לפנות בפניו. וכ"ז לפנות אבל להשתין מותר אפילו ביום בפני רבים אם צריך לכך שאין לו מקום ואפילו בפני אשה משום דאיכא סכנתא אם יעמיד עצמו. ואשה לא תעמוד להשתין אפילו נגד פניו של תינוק משום דאיכא חציפותא אבל לצדדין שאינה משתנת ממש נגד פניו לית לן בה:

On 'modestly at night': meaning that he should not uncover himself more than by day, and not uncover himself until he sits, and the like — for before Him, may He be blessed, darkness is as light. But at night he need not distance himself. And if no one is present he may relieve himself in the street, only being careful that it not be in a place where people walk, so that people not be soiled on his account. But if a person is there, even a non-Jew, it is forbidden to relieve himself in his presence. All this is about relieving oneself; but urinating is permitted even by day before many people, if he must because he has no other place, and even before a woman, since there is danger if he holds himself in. A woman, however, should not stand to urinate even facing an infant, because of the immodesty, but off to the side, where she does not urinate directly facing him, there is no concern.

סעיף י״ג

לא ישתין מעומד מפני ניצוצות הניתזין כגעל רגליו כדאם לא שיעמוד במקום גבוה או שישתין לתוך עפר תחוח (פירוש קרקע שאינה בתולה אלא כגון של ארץ חרושה):

One should not urinate while standing, because of the droplets that spray onto his feet, unless he stands on a raised spot, or urinates into loose earth. (This means ground that is not virgin soil, but rather like plowed earth.)

ס״ק כגעל רגליו

(כג) על רגליו - ויאמרו שהוא כרות שפכה שאין מימי רגליו מקלחין אלא שותתין וכרות שפכה אינו מוליד ויאמרו על בניו שאינם שלו:

On 'onto his feet': for people will say that he is 'severed of flow,' whose urine does not shoot out but merely dribbles, and such a person cannot father children, so they will say of his children that they are not his.

ס״ק כדאם לא וכו'

(כד) אם לא וכו' - ואם אין לו עצות אלו וגם שם א"א בישיבה יוכל לעשות עצה אחרת שלא יבוא לידי נצוצות שיסייע בבצים להגביה הגיד קצת או ע"י מטלית עבה ואם איתרמי שנפלו ניצוצות על רגליו מצוה לשפשפם:

On 'unless...': if none of these expedients is available to him, and he also cannot do it sitting there, he can use another expedient to avoid the spraying droplets: he may steady himself by the testicles to raise the member a little, or use a thick cloth. And if it happens that droplets fell onto his feet, it is a mitzvah to rub them off.

סעיף י״ד

יזהר שלא יאחוז באמה וישתין אם לא מעטרה כהולמטה כומפני שמוציא ש"ז לבטלה אלא אם כן כזהוא נשוי ומדת חסידות ליזהר אפילו כחהנשוי:

One should be careful not to hold the member while urinating, except from the corona and below, because otherwise he may emit seed in vain, unless he is married. And it is a measure of piety for even a married man to be careful.

ס״ק כהולמטה

(כה) ולמטה - ואפילו אם האבר בקישוי מותר מעטרה ולמטה:

On 'and below': even if the member is erect, it is permitted to hold from the corona and below.

ס״ק כומפני שמוציא

(כו) מפני שמוציא - ר"ל שע"י נגיעתו בגיד בא לידי חמום והרהור ויבא לזה וחומר עון הזה עיין באה"ע סימן כ"ג:

On 'because he emits': meaning that through touching the member he comes to arousal and improper thoughts, and may come to this, and as to the gravity of this sin, see Even HaEzer siman 23.

ס״ק כזהוא נשוי

(כז) הוא נשוי - דיש לו פת בסלו ואין יצרו תוקפו כ"כ ואם היא נדה או שהוא בדרך אסור. ועיין בא"ע סימן כ"ג ס"ד דאפילו נשוי אינו מותר להושיט ידו לאמה כלל אלא בשעה שהוא צריך לנקביו:

On 'he is married': for he has 'bread in his basket,' and his inclination does not overpower him so much. But if his wife is a niddah, or he is away on a journey, it is forbidden. And see Even HaEzer siman 23, se'if 4, that even a married man may not put his hand to the member at all, except when he needs to relieve himself.

ס״ק כחהנשוי

(כח) הנשוי - ואם עומד במקום שיש לו פחד שלא יפול אין להחמיר בנשוי כלל. [ארה"ח]:

On 'a married man': if he is standing in a place where he is afraid he may fall, there is no need for a married man to be stringent at all. (This is from the Orchos Chaim.)

סעיף ט״ו

אפי' מי שאינו נשוי מותר לסייע כטבבצים:

Even one who is not married is permitted to steady himself by the testicles.

ס״ק כטבביצים

(כט) בביצים - שאינו מתחמם ע"י כך. ולפעמים מותר לאחוז באמה להשתין כגון ע"י מטלית עבה שאינו מחמם אבל ע"י החלוק אסור ויש מפקפקין גם ע"י מטלית עבה משום דלא ידעינן שיעורו:

On 'by the testicles': since he is not aroused thereby. And sometimes it is permitted to hold the member to urinate — for instance, through a thick cloth that does not arouse, but through the shirt it is forbidden. Some object even to a thick cloth, since we do not know its required measure.

סעיף ט״ז

לא הותר לנשוי לאחוז באמה אלא להשתין אבל ללהתחכך לא:

A married man was permitted to hold the member only in order to urinate, but not in order to scratch.

(ל) להתחכך לא - לפי שהחיכוך מביא לידי חמום ובקל יבוא לידי ש"ז ועיין בח"א שמתיר ע"י בגד עב. ומותר לסרוק זקן התחתון אך שלא יגע אז באמה בידו ועיין בבה"ל:

On 'but not to scratch': because scratching brings arousal, and he may easily come to emission of seed. See the Chayei Adam, who permits it through a thick garment. And it is permitted to comb the lower hair, provided he does not then touch the member with his hand. And see the Biur Halachah.

סעיף י״ז

המשהה נקביו עובר משום לאבל תשקצו:

One who holds back his bodily needs transgresses the prohibition of 'do not make yourselves detestable.'
