סעיף א׳

אאחר שלבש טלית מצוייץ ביניח תפילין שמעלין בקדש והמניחים כיס התפילין והטלית לתוך כיס אחת צריכין ליזהר שלא יניחו כיס התפילין למעלה כדי גשלא יפגע בהם תחלה דויצטרך להניחם הקודם הטלית כדי שלא יעבור על המצו': הגה מיהו אם תפילין מזומנים בידו וואין לו ציצית אזין צריך להמתין על הציצית אלא מניח תפילין וכשמביאים טלית מעטפו [דברי עצמו]:

After one has put on a tallit fitted with tzitzit, he then puts on tefillin, for in matters of holiness we ascend (rising from a lesser mitzvah to the greater). And those who place the tefillin-bag and the tallit into a single bag must be careful not to lay the tefillin-bag on top, so that he does not encounter them first and thereby be required to put them on before the tallit (for one may not pass over a mitzvah that presents itself first). The Rema adds: However, if the tefillin are ready at hand and he has no tzitzit available, he need not wait for the tzitzit; rather he puts on the tefillin, and when the tallit is brought he wraps himself in it. ס״ק אאחר שלבש וכו'

(א) אחר שלבש וכו' - ואפילו אם הטלית אינו חייב אלא מדרבנן כגון שאולה אחר שלשים יום וכנ"ל בסימן י"ד וכל כה"ג ג"כ יש להקדימו לתפילין [ארה"ח]:

(1) 'After one has put on' etc. — even if the tallit carries only a Rabbinic obligation, such as one borrowed past thirty days, as explained above in sec. 14, and in any similar case as well, it should be donned before the tefillin [Orchot Chaim].

(2) 'He then puts on tefillin' — one whose means do not suffice to buy both tzitzit and tefillin — the later authorities ruled that tefillin take precedence, because tzitzit is only a mitzvah that applies if he has a four-cornered garment, whereas tefillin is an outright obligation, and one who does not wear them is counted among 'the sinners of Israel with their bodies,' as below in sec. 37. And all the more so regarding buying beautiful, high-quality tefillin versus a fine tallit, that the tefillin take precedence according to all opinions, and people commonly err in this. One whose means do not suffice to buy tzitzit and tefillin is not obligated to go begging door to door in order to buy them; but one who does have the means, yet relies on borrowing from others after they have already fulfilled the mitzvah with them — the Bach wrote that his punishment is great.

(ג) שלא יפגע - פי' אפילו לא יאחוז בהם בידו רק לפי הושטת ידו הם מונחין לפניו תחלה אין מעבירין עליהם וצריך להקדימן וכל זה דוקא אם רוצה להניח עתה התפילין אבל אם עדיין אין רוצה להניחם רק לאחר זמן לא שייך בזה אין מעבירין על המצות:

(3) 'That he does not encounter them' — that is, even if he is not holding them in his hand, but they merely lie before him first, within reach of his outstretched hand, we do not pass over them, and he must don them first. All this is only if he wishes to put on the tefillin now; but if he does not yet wish to put them on, only later, the rule of 'we do not pass over a mitzvah' does not apply here.

(ד) ויצטרך להניחם - נ"ל פשוט דאם מתפלל בביתו ורוצה להניח טלית ותפילין ובתוך חדר שלפניו מונח התפילין ובתוך חדר אחר מונח הטלית צריך להניח תפילין ברישא כדי שלא יעבור על המצות אחרי דהתפלין מזומנין לפניו תחלה ואף שלא נטל עדיין התפלין בידו [וראיה מהא דיומא ל"ג ע"ב בגמרא וכי עייל להיכל וכו' עיי"ש]:

(4) 'And be required to put them on' — it seems to me obvious that if one prays in his house and wishes to don both tallit and tefillin, and in the room before him the tefillin are lying, while the tallit lies in another room, he must don the tefillin first, so as not to pass over the mitzvah, since the tefillin are ready before him first, and this is so even though he has not yet taken the tefillin in his hand [and there is proof from the Gemara in Yoma 33b, 'and when he enters the Sanctuary,' etc.; see there].

(ה) קודם הטלית - ואם עבר והניחם מידו ונטל הטלית שוב אסור לעזבו וליטול התפילין:

(5) 'Before the tallit' — but if he transgressed, set them down from his hand, and took up the tallit, he may no longer put it down to take up the tefillin.

(6) 'And he has no tzitzit' — even if he would go about without a four-cornered garment at all; and all the more so according to our custom, that everyone is careful to wear a tallit katan.

(ז) אין צריך - מפני שאין משהין את המצוה אע"פ שי"ל שיעשה אח"כ יותר מן המובחר מצוה בשעתא חביבא וכן בתדיר ושאינו תדיר דקי"ל דתדיר קודם אם אין התדיר לפנינו א"צ להמתין:

(7) 'He need not wait' — because we do not delay a mitzvah, even though one might argue that he would afterward perform it in a more choice manner, for a mitzvah in its earliest moment is precious. And so too regarding the frequent versus the infrequent mitzvah, where the rule is that the more frequent takes precedence: if the more frequent one is not before us, we need not wait for it.

מי שהוא זהיר בטלית קטן ילבשנו ויניח תפילין חבביתו וילך לבוש בציצית ומוכתר בתפילין לבית הכנסת טושם יתעטף בטלי' גדול: הגה והעולם נהגו ליהתעטף אף בטלי' גדול קוד' ויאלברך עליו ואחר כך מניח התפילין והולך לבית הכנס':

One who is careful to wear a tallit katan should put it on and don his tefillin already in his house, and go to the synagogue clothed in tzitzit and crowned with tefillin, and there wrap himself in the large tallit. The Rema adds: But the common custom is to wrap oneself even in the large tallit beforehand, and to recite its blessing, and afterward to put on the tefillin, and then go to the synagogue.

(ח) בביתו - כדי שיצא מפתח ביתו בציצית ותפילין וכמו שהביא הב"י והד"מ בשם הזוהר עי"ש שהוא ענין גדול. ואם יודע שילך דרך מבואות המטונפות או שמצויין נכרים ברחוב יניחם בחצר בית הכנסת ואם אי אפשר יניחם בביתו ויכסם בכובעו או בידו. ועיין באחרונים שכתבו במשכים קודם אור הבוקר ובא לבהכ"נ לא שייך אזהרת הזוהר דעדיין לא מטי זמן חיובא. ומ"מ כשיאור היום יותר טוב שיצא לחצר בהכ"נ וילבשם שם ויכנס אח"כ לבהכ"נ:

(8) 'In his house' — so that he goes out from the door of his house already in tzitzit and tefillin, as the Beit Yosef and the Darchei Moshe brought in the name of the Zohar — see there — that this is a great matter. But if he knows he will pass through filthy alleyways, or that non-Jews are common in the street, he should don them in the courtyard of the synagogue; and if that is impossible, he dons them in his house and covers them with his hat or his hand. And see the later authorities, who wrote that one who rises early, before daybreak, and comes to the synagogue — the Zohar's admonition does not apply, since the time of obligation has not yet arrived. Nevertheless, once the day has grown light, it is better that he go out to the synagogue courtyard, put them on there, and then enter the synagogue.

(ט) ושם יתעטף - ואע"פ שבא הט"ג לידו קודם שהניח התפילין א"צ להתעטף בו בביתו כיון שאין דעתו ללבשו כאן:

(9) 'And there he wraps himself' — and even though the large tallit came to his hand before he donned the tefillin, he need not wrap himself in it in his house, since he does not intend to wear it here.

(י) להתעטף - ובמקום שמצויין נכרים ברחוב יתעטף בחצר בית הכנסת אם אפשר לו:

(10) 'To wrap himself' — and in a place where non-Jews are common in the street, he should wrap himself in the courtyard of the synagogue, if he is able.

(יא) ולברך עליו - פי' ברכת להתעטף ויכוין לפטור בברכה זו גם הט"ק וכדלעיל בסימן ח' סעיף יו"ד עי"ש במ"ב ס"ק כ"ד:

(11) 'And to recite its blessing' — that is, the blessing 'to wrap oneself in tzitzit,' and he should intend with this blessing to exempt the tallit katan as well, as above in sec. 8, se'if 10; see there in the Mishnah Berurah, note 24.

סעיף ג׳

הרא"ש הי' מסדר הברכות עד עוטר ישראל בתפארה יבואז היה מניח תפילין יגומברך עוטר ישראל בתפארה:

The Rosh would recite the morning blessings in order until the blessing 'who crowns Israel with glory,' and at that point he would put on his tefillin and recite 'who crowns Israel with glory' (so that the blessing of glory would coincide with the tefillin, which are themselves a glory).

(יב) ואז היה וכו' - כדי ליתן שבח והודאה בברכה זו גם על התפילין שנקראין פאר שנאמר פארך חבוש עליך וקאי על תפלין שהן פאר לישראל כמו שנאמר וראו כל עמי הארץ וגו' ויראו ממך ודרשינן אלו תפילין שבראש:

(12) 'And at that point he would' etc. — in order to give praise and thanks, with this blessing, also for the tefillin, which are called a 'glory' (pe'er), as it is said, 'bind your glory upon yourself,' which refers to tefillin, which are a glory for Israel, as it is said, 'and all the peoples of the earth shall see... and be in awe of you,' which the Sages expounded: this refers to the tefillin of the head.

(יג) ומברך עוטר וכו' - ובארה"ח כתב לא ראיתי שנוהגין כן רק מניחין תפלין קודם ברכת השחר או אח"כ כ"א לפי מנהגו רק ראיתי מדקדקים למשמש בתש"י וש"ר בשעה שמברך ברכה זו:

(13) 'And recites who crowns' etc. — but the Orchot Chaim wrote: I have not seen that people practice this way; rather they put on tefillin before the morning blessings or afterward, each according to his own custom. I have only seen the meticulous touch the hand-tefillin and head-tefillin at the moment they recite this blessing.

סעיף ד׳

צריך שיהיו תפילין עליו ידבשעת ק"ש ותפלה:

One must have tefillin upon him at the time of the reading of Shema and of the Amidah prayer.

ס״ק ידבשעת ק"ש ותפלה

(יד) בשעת ק"ש ותפלה - ר"ל לכל הפחות בשעת ק"ש ותפלה וכדלקמן בסימן ל"ז ס"ב ואמרינן בגמרא כל הקורא ק"ש בלי תפלין הרי הוא כאלו מעיד עדות שקר בעצמו ח"ו ופירשו בתוספות לפי שאומר וקשרתם לאות וגו' ואין קושר ואף שבדיעבד יצא ידי ק"ש מ"מ יש לו עבירה מצד אחר שמראה על עצמו שאין רוצה לקיים רצון הש"י וזהו עדות שקר שמעיד על עצמו ויש עוד פי' אחר עיין בלבוש וכתב בספר חרדים דמזה נלמוד כשאומר ואהבת את ד' וגו' יראה להכניס אהבת הש"י בלבו שלא יהיה כדובר שקר ח"ו. ודע דלא אמרו כן אלא כשעושה כן במזיד שמתעצל להניח תפלין קודם ק"ש אבל מי שאין לו תפלין או כשהוא בדרך ומחמת קור וצינה אינו יכול להניח תפלין וכל כה"ג בודאי אין לו לאחר ק"ש בזמנה מחמת זה. לבוש בסימן נ"ח והעתקתי שם את לשונו עי"ש:

(14) 'At the time of Shema and the prayer' — that is to say, at the very least at the time of Shema and the Amidah, as below in sec. 37, se'if 2. And we say in the Gemara: whoever recites Shema without tefillin is as though he bears false witness against himself, God forbid. Tosafot explained: because he says 'and you shall bind them for a sign,' etc., yet does not bind them. And even though after the fact he has fulfilled his obligation of Shema, nevertheless he bears a transgression on another account — that he shows himself unwilling to fulfill the will of God — and this is the false testimony he bears against himself. There is yet another explanation; see the Levush. And the Sefer Chareidim wrote that from this we learn: when one says 'and you shall love the Lord,' etc., he should take care to bring the love of God into his heart, so that he not be as one who speaks falsely, God forbid. And know that they said this only of one who acts so deliberately, being lazy about donning tefillin before Shema; but one who has no tefillin, or who is on the road and cannot don tefillin because of cold and frost, and any similar case, certainly should not delay Shema past its proper time on that account. טויכוין בהנחתם שצונו הקב"ה טזלהניח ארבע פרשיות אלו שיש בהם יחוד שמו ויציאת מצרים על הזרוע כנגד הלב ועל הראש כנגד המוח כדי שנזכור ניסים ונפלאות שעש' עמנו שהם מורים על יחודו ואשר לו הכח והממשלה בעליונים ובתחתונים לעשות בהם כרצונו וישעבד להקב"ה הנשמה שהיא במוח וגם הלב שהוא עיקר התאות והמחשבות ובזה יזכור הבור' וימעיט הנאותיו ויניח של יד יזתחלה יחויברך להניח יטתפילין ואח"כ יניח של ראש ולא יברך כי אם ברכה אחת לשתיהם: הגה וי"א לברך על של ראש עכל מצות תפילין אפי' לא הפסיק בנתים [הרא"ש הל' תפילין] [וכן פשט המנהג בבני אשכנז שמברכין ב' ברכות] וכאטוב לומר תמיד אחר הברכה השניה ברוך שם כבוד מלכותו לעולם ועד [מהר"י בן חביב אגור סי' ל"ח]:

When putting them on, he should have in mind that the Holy One, blessed be He, commanded us to place these four Torah passages [in the tefillin], which contain the proclamation of His unity and the exodus from Egypt, upon the arm opposite the heart and upon the head opposite the brain, so that we will remember the miracles and wonders He did with us, which testify to His unity, and that His is the power and dominion, in the worlds above and below, to do with them as He wills; and through them he subjugates to the Holy One, blessed be He, the soul that is in the brain, and also the heart, which is the seat of desires and thoughts; and by this he will remember the Creator and lessen his own pleasures. He puts on the hand-tefillin first and recites the blessing 'to put on tefillin,' and afterward puts on the head-tefillin, and does not recite a second blessing; rather one blessing serves for both (this is the Mechaber's view). The Rema adds: But some say that over the head-tefillin one recites the blessing 'concerning the commandment of tefillin,' even if he did not interrupt in between [Rosh, Laws of Tefillin], and so the custom has spread among the Jews of Ashkenaz, that they recite two blessings. And it is good always to say, after the second blessing, 'Blessed be the name of His glorious kingdom forever and ever' [Mahar"i ben Chaviv, Agur, sec. 38].

(טו) יכוין בהנחתם - כתב הב"ח בסימן ח' טעם לזה מדכתיב והיה לך לאות על ידך וגו' למען תהיה תורת ד' בפיך כי ביד חזקה הוציאך וגו' יורה כי עיקר המצוה וקיומה תלויה בכונה שיכוין בשעת קיום המצוה וכתב הפמ"ג דמ"מ בדיעבד אפילו אם לא כיון רק לשם מצוה בלבד יצא:

(15) 'He should have intent when putting them on' — the Bach in sec. 8 wrote a reason for this: since it is written, 'and it shall be for you a sign upon your hand... so that the Torah of the Lord shall be in your mouth, for with a strong hand He brought you out,' etc. — this indicates that the essence of the mitzvah and its fulfillment depend on the intention he has at the time of performing it. And the Pri Megadim wrote that nevertheless, after the fact, even if he intended only 'for the sake of the mitzvah,' he has fulfilled his obligation.

ס״ק טזלהניח ד' פרשיות

(טז) להניח ד' פרשיות - ויש נוהגים מחמת זה לקרות הארבע פרשיות לאחר הנחת תפלין היינו קדש והיה כי יביאך דשמע והיה אם שמוע בלא"ה קורין כל ישראל בשעת ק"ש. ובתפלין דר"ת יאמר כל הד' פרשיות. ומנהג יפה הוא [ארה"ח]:

(16) 'To place the four passages' — and some, on account of this, have the custom to read the four passages after donning tefillin, namely 'Kadesh' and 'V'haya ki yevi'acha,' for 'Shema' and 'V'haya im shamo'a' are in any case recited by all Israel at the time of Shema. And with the tefillin of Rabbeinu Tam, he should say all four passages. And it is a fine custom [Orchot Chaim].

(יז) תחלה - דכתיב וקשרתם וגו' והדר והיו לטוטפות וגו':

(17) 'First' — for it is written, 'and you shall bind them,' etc. (the hand), and only afterward, 'and they shall be as frontlets,' etc. (the head).

(יח) ויברך - ר"ל קודם ההידוק וכדלקמן:

(18) 'And he recites the blessing' — that is to say, before tightening [the tefillin], as below.

ס״ק יטתפילין

(יט) תפילין - הלמ"ד בדגש:

(19) 'Tefillin' — the letter lamed [in the blessing] takes a dagesh (pronounced 'tefil-lin').

ס״ק כעל מצות

(כ) על מצות - בפת"ח תחת הוא"ו שהוא לשון יחיד ולא יאמר בחול"ם שהוא לשון רבים שהרי לא ניתקנה ברכה זו כ"א לתש"ר בלבד כמו שיתבאר בסימן כ"ו [כן הכריעו רוב האחרונים דלא כט"ז]:

(20) 'The commandment (mitzvat)' — with a patach under the vav, which is the singular form ('mitzvat'), and he should not say it with a cholam, which is the plural ('mitzvot'), for this blessing was instituted only for the head-tefillin alone, as will be explained in sec. 26 [so most of the later authorities ruled, not like the Taz].

(כא) וטוב לומר - משום חשש ספק ברכה לבטלה כמש"כ בסימן ר"ו ולא שהוא ספק גמור דא"כ איך יברך מספק ברכה לבטלה ויסמוך על שיאמר בשכמל"ו אלא דאנן בני אשכנז סבירא לן להלכה כדעת ר"ת רק לרווחא דמילתא להוציא עצמינו מידי כל פקפוק נוהגין לומר בשכמל"ו. ויזהר מאוד שלא לומר ברוך שם רק אחר שיהדק הש"ר על ראשו כראוי דאל"כ יהיה הפסק בין הברכה להנחה ויהיה ברכה זו לבטלה בודאי וצריך לחזור ולברך והעולם נכשלין בזה:

(21) 'And it is good to say' — because of the concern of a possibly-wasted blessing, as written in sec. 206; not that it is a full-fledged doubt, for if so, how could he recite a possibly-wasted blessing and rely on his later saying 'Baruch Shem'? Rather, we, the Jews of Ashkenaz, hold as a matter of law like the opinion of Rabbeinu Tam; only, for good measure, to free ourselves of any misgiving, we are accustomed to say 'Baruch Shem Kevod Malchuto Le'olam Va'ed.' And he must be very careful not to say 'Baruch Shem' until after he has properly fastened the head-tefillin on his head; for otherwise it would be an interruption between the blessing and the donning, and this blessing would certainly be wasted, and he would have to repeat it — and people commonly stumble in this.

סעיף ו׳

אם כבפגע בשל ראש תחלה צריך כגלהעביר על אותה מצוה ויניח של יד תחלה ואח"כ של ראש:

If he encountered the head-tefillin first, he must pass over that mitzvah (leave it for now) and put on the hand-tefillin first, and only afterward the head-tefillin (since the Torah states the hand before the head).

(כב) פגע וכו' - דוקא פגע אבל אם הניח ש"ר תחלה או שמצא הש"י שנשמט ממקומו אין להסיר הש"ר דמאי דהוה הוה וימהר להניח ש"י על מקומו ויש חולקין ועיין בביאור הלכה:

(22) 'He encountered' etc. — specifically where he merely encountered it before donning; but if he already donned the head-tefillin first, or found that the hand-tefillin had slipped from its place, he should not remove the head-tefillin, for what is done is done; rather he should hasten to put the hand-tefillin in its place. And some disagree; see the Biur Halachah.

(כג) להעביר - כיון דכתיב בקרא מפורש דיד קודם דמתחלה וקשרתם והדר ולטוטפות לפיכך אין משגיחין על העברת המצוה משא"כ לעיל בס"א גבי ציצית ותפלין:

(23) 'To pass over the mitzvah' — since it is written explicitly in Scripture that the hand comes first — for first 'and you shall bind them,' and only then 'and as frontlets' — therefore we do not take into account the 'passing over' of the mitzvah; which is not the case above in se'if 1, regarding tzitzit and tefillin.

סעיף ז׳

יברך כדלהניח בקמ"ץ תחת הה"א ולא בפתח ובדגש:

He recites the blessing 'lehani'ach' with a kamatz under the letter hei, and not with a patach and a dagesh (for the kamatz form means 'to place,' while the other would mean 'to abandon').

ס״ק כדלהניח בקמץ

(כד) להניח בקמץ - שהוא לשון הנחה כמש"כ להניח ברכה אל ביתך ולא בפת"ח שהוא לשון עזיבה כמש"כ אחיכם אחד הניחו אתי [אחרונים]:

(24) 'Lehani'ach with a kamatz' — which denotes 'placing,' as in 'to cause a blessing to rest upon your house'; and not with a patach, which denotes 'leaving' or 'abandoning,' as in 'leave one of your brothers with me' [the later authorities].

סעיף ח׳

כל המצות מברך עליהם עובר לעשייתן [פירוש קודם. ויעבור את הכושי פירושו רץ והקדים לפניו] לפיכך צריך לברך על התפלה של יד כהאחר הנחה על הקיבורת כוקודם קשירתם שקשירתם זו היא עשייתן [ הגה וכן בשל ראש כזקודם שמהדקן בראשו. טור]:

Over all mitzvot one recites the blessing 'over la'asiyatan' — before performing them (the word 'over' means 'before'; as in the verse 'and he outran the Cushite,' whose meaning is that he ran and got ahead of him). Therefore one must recite the blessing over the hand-tefillin after placing it on the biceps (the upper-arm muscle), but before binding it, for this binding is the essential performance of the mitzvah. The Rema adds: And likewise for the head-tefillin, the blessing is before he fastens it upon his head [Tur].

ס״ק כהאחר הנחה וכו'

(כה) אחר הנחה וכו' - דקודם לכן לכתחילה אין ראוי לברך דהוי קודם דקודם וצריך לקרב הברכה לעשיית המצוה בכל מה דאפשר:

(25) 'After placing it' etc. — for before that point it is improper, initially, to bless, since it would be 'before the before' (too early), and one must bring the blessing as close to the performance of the mitzvah as possible.

ס״ק כוקודם קשירתן

(כו) קודם קשירתן - ובדיעבד יברך אפילו אח"כ דמצוה שיש לה משך זמן הוא בכולי יומא:

(26) 'Before binding them' — but after the fact he may bless even afterward, for a mitzvah that has an extended duration may be blessed throughout the entire day.

ס״ק כזקודם שמהדקן

(כז) קודם שמהדקן - כי ההידוק הוא מצות הקשירה וצריך גם כן ליזהר שיהיה הברכה אחר שמונחים על הראש לא כאותן שמברכין בעודם בידם דא"כ הו"ל קודם דקודם. גם בשעת ברכה של תש"ר יראה שיהיה מכוסה ראשו בטלית ולא יברך בגילוי הראש:

(27) 'Before he fastens them' — for the fastening is the fulfillment of the mitzvah of binding. And one must also take care that the blessing be after they are already resting on the head, not like those who bless while they are still in their hands, for if so it would be 'before the before' (too early). Also, at the time of the blessing over the head-tefillin, he should see that his head is covered with the tallit, and not bless with his head uncovered.

It is forbidden to interrupt with speech between donning the hand-tefillin and the head-tefillin. And if he did interrupt, he recites over the head-tefillin the blessing 'concerning the commandment of tefillin.' The Rema adds: And according to our practice, that we recite two blessings, even if he did not interrupt he must recite over the head-tefillin both 'to put on' and 'concerning the commandment.' [His own opinion.]

(28) 'It is forbidden to interrupt' — even with speech that is itself a mitzvah, such as returning a greeting to one's teacher and any similar case, because he thereby causes an unnecessary additional blessing. And even for those who don tefillin on Chol HaMo'ed without a blessing, or who don the tefillin of Rabbeinu Tam after removing the tefillin of Rashi, or who removed tefillin intending to put them back — where the Rema in se'if 12 ruled that one need not repeat the blessing when donning them afterward — even so it is a transgression to interrupt between them, for initially we require that they be adjacent and consecutive to one another, as it is written, 'and it shall be for you a sign upon your hand and a reminder between your eyes' — that there be a single act of 'being' for both.

(29) 'With speech' — even in the Holy Tongue. And initially it is forbidden even to interrupt in silence, if he tarries a long while needlessly, even if he did not divert his attention. And even to hint with his eyes or gesture with his fingers between donning the hand-tefillin and the head-tefillin — one should also be careful about this initially. If he donned the hand-tefillin in one house and the head-tefillin in another, having intended this, see above in sec. 8, se'if 13, and the Mishnah Berurah there regarding the tallit, and the same applies to our case.

(31) 'And according to our practice' etc. — for the reason we recite two blessings over tefillin, and 'lehani'ach' alone does not suffice, is that we hold the original institution of these blessings was as follows: at the outset of donning them they instituted 'lehani'ach,' which applies also to the head-tefillin, and when he dons the head-tefillin and fastens it he also recites 'concerning the commandment,' this being the completion of the mitzvah. Therefore it follows that if he spoke and diverted his attention, he must repeat 'lehani'ach' as well over the head-tefillin [Rosh].

(32) 'To repeat the blessing' — and it is proper that he then handle the hand-tefillin, shifting it slightly from its place and tightening the knot, so that thereby the blessing 'lehani'ach' will apply again to the hand-tefillin as well, and it will be as though he now donned the hand-tefillin and head-tefillin consecutively, one right after the other. And if he blessed without handling it, he should handle it after the blessing. And see the Biur Halachah what we wrote in the name of Rabbi Akiva Eiger on this.

If he spoke for the sake of the tefillin (something they required), he does not repeat the blessing. If he hears Kaddish or Kedushah between donning the hand-tefillin and the head-tefillin, he should not interrupt to respond with them; rather he stays silent, listens, and directs his mind to what they are saying (which counts as though he responded).

(34) 'He does not' etc. — but initially it is forbidden to speak from the blessing 'lehani'ach' until after donning the head-tefillin, even about matters needed for the tefillin, unless it is a case where it cannot be done otherwise. But on Chol HaMo'ed, when no blessing is recited, it is possible that one may be lenient even initially regarding matters needed for the tefillin.

ס״ק להלא יפסיק

(35) 'He should not interrupt' — even to answer Amen to this very blessing, such as answering Amen to the tefillin-blessing that another person recites, is forbidden, unless his fellow intends to discharge his obligation with this blessing on his behalf [Responsum of Da"sh, and Rabbi Akiva Eiger in his novellae, not like the Pri Megadim; see there].

ס״ק לולענות עמהם

(36) 'To respond with them' — and if he interrupted and responded 'Amen, may His great name...,' or Kedushah, or Barchu, or answered Amen to some blessing he heard, he repeats the blessing; and see the Biur Halachah. But on Chol HaMo'ed, or one donning the tefillin of Rabbeinu Tam and the like, who dons them without a blessing, one may be lenient and interrupt to respond to 'Amen, may His great name...,' Kedushah, Barchu, and Amen; but afterward he should shift the hand-tefillin from its place before donning the head-tefillin, so that there be a single act of 'being' for both.

(37) 'He stays silent and listens' — for here the silence is like responding, as far as fulfilling the obligation goes, but not to the extent that it be reckoned as an interruption.

סעיף י״א

אחר שקשר של יד על הזרוע יניח של ראש לחקודם שיכרוך הרצועה סביב הזרוע ויש מי שאומר לטשאסור להוציא תפלה של ראש מהתיק עד שתהא תפלה של יד ממונחת: הגה ואף אם שניהם לפניו חוץ לתיק למאא יתקן לפתוח התפלה של ראש עד אחר הנחה של יד [מהרי"א ומהר"י בן חביב] יש מי שכ' להניח של יד מיושב ושל ראש מעומד [אגור בשם הזוהר סי' פ"ד] ובמדינות אלו לא נהגו כן אלא שמבתיהן מעומד:

After he has bound the hand-tefillin on the arm, he puts on the head-tefillin before he winds the strap around the forearm. And there is one who says that it is forbidden to take the head-tefillin out of its bag until the hand-tefillin is already in place. The Rema adds: And even if both are before him, outside the bag, he should not make ready to open the head-tefillin until after he has donned the hand-tefillin [Mahari"a and Mahar"i ben Chaviv]. There is one who wrote to don the hand-tefillin while seated and the head-tefillin while standing [Agur in the name of the Zohar, sec. 84], but in these lands the custom is not so; rather both are donned while standing.

ס״ק לחקודם שיכרוך

(38) 'Before he winds the strap' — the reason is that the blessing 'lehani'ach' applies also to the head-tefillin, as above in note 31, and all the more so according to the Mechaber above in se'if 5, who holds that one recites only a single blessing; therefore he should minimize the interruption as much as he can. And the winding around the forearm is not part of the essential law, so it is good to delay it until he has donned the head-tefillin. In the Sefer Kavanot of the Arizal, of blessed memory, it is written that he would wind the seven windings around his arm first [but not the three windings on the finger], because he holds that, since ideally the windings too are part of the mitzvah, they do not constitute an interruption; and so is the custom in most places. And see the responsa Mishkenot Yaakov, sec. 28, whose view is likewise like our custom, to wind first around the forearm for firmness, for otherwise it does not hold and is not called 'binding'; see there. The Sefer M"M wrote: if he heard Kaddish and Kedushah after he blessed over the hand-tefillin, and if he winds the strap he will not have time to don the head-tefillin and respond, he should don the head-tefillin before the windings, provided he can fasten the hand-tefillin partially so that it does not shift from its place.

ס״ק לטשאסור וכו'

(לט) שאסור וכו' - היינו אפילו אם ירצה להוציא הש"ר והש"י שניהן בשוה מן התיק דבזה אין מעביר על המצות אפ"ה יש ליזהר כי יש בזה טעם ע"פ הקבלה כמש"כ בב"י וכ"ש להניח הש"י מידו ולהתעסק בהוצאת הש"ר מדינא אסור:

(39) 'That it is forbidden' etc. — that is, even if he wishes to take the head-tefillin and hand-tefillin both out of the bag together, at the same time, where there is no 'passing over the mitzvot,' even so one should be careful, for there is a reason for it according to Kabbalah, as written in the Beit Yosef. And all the more so, to set the hand-tefillin down from his hand and busy himself with taking out the head-tefillin is forbidden by the letter of the law.

ס״ק ממונחת

(מ) מונחת - ר"ל שתהיה מהודקת יפה על הזרוע ואז מותר אפי' קודם שעשה השבעה כריכות. ואם אחר יכול להוציא ולתקן ש"ר בעוד שחבירו מניח של יד הפמ"ג מחמיר וארה"ח מיקל עי"ש:

(40) 'In place' — that is to say, that it be well fastened on the arm, and then it is permitted to take out the head-tefillin even before he has made the seven windings. And whether another person may take out and prepare the head-tefillin while his fellow is donning the hand-tefillin — the Pri Megadim is stringent and the Orchot Chaim is lenient; see there.

ס״ק מאלא יתקן

(מא) לא יתקן - ר"ל אפילו אם בעת תיקון הש"ר לא יניח הש"י ג"כ מידו אפ"ה כשמניח אח"כ הש"ר להניח הש"י הוי כמעביר על המצות:

(41) 'He should not prepare it' — that is to say, even if, at the time he prepares the head-tefillin, he does not also set the hand-tefillin down from his hand, even so, when he afterward dons the head-tefillin before donning the hand-tefillin, it is as one who passes over the mitzvot.

(42) 'Both while standing' — see the Magen Avraham, who wishes to rule that the donning of the hand-tefillin be done seated and the blessing standing; but the Eliyah Rabbah, in the name of the Maharshal in a responsum, sec. 98, wrote: who is greater among us than Rabbi Shimshon of Chinon, who, after he had studied Kabbalah, would pray like a day-old infant, for one who cannot grasp its secret properly may come to 'cut down the plantings' (fall into heresy); therefore let the blessing and the donning both be while standing. And in the commentary of the Vilna Gaon he proved that even according to the Zohar it is permitted to don the hand-tefillin while standing, so one should not deviate from the custom. The Knesset HaGedolah wrote, among the principles of the halachic authorities: in anything where the masters of Kabbalah and the Zohar disagree with the Gemara and the authorities, follow the Gemara and the authorities; however, if the Kabbalists are stringent, one should be stringent as well; and if a matter is not mentioned in the Gemara and the authorities, even though it is mentioned in Kabbalah, we cannot compel people to practice so; but a ruling not mentioned to the contrary in the Talmud and the authorities — one should follow the words of Kabbalah; and also, where there is a dispute among the authorities, the words of Kabbalah decide.

אם מניח תפילין כמה פעמים ביום צריך לברך עליהם מגבכל פעם מדנשמטו ממקומם וממשמש בהם להחזירן למקומן צריך לברך: הגה ואם מחזיר אחת מהם מברך כמי שמניח תפלה אחת כדלקמן סי' כ"ו [דברי עצמו] הזיזם מממהקומם אדעתא להחזירם מיד צרמויך לברך. הגה וי"א שלמזא לברך [טור סי' ח'] והכי נהוג וכבר נתבאר לעיל סי' ח' סעיף י"ד מי שמניח תפילין של מחיד ובירך ובתחלת ההדוק נפסק הקשר של יד והוצרך לעשות קשר אחר אמנם לא מטהסיח דעתו אינו צריך לחזור ולבנרך אם הותנאר של יד קודם הנחה של ראש מהדקן ואין צריך לחזור ולברך אבל אם הניח של ראש ואחר כך הותר של יד מהדנבק ומברך. מותר לברך על תפילין שאונגלין ולא על גזונדלין:

If he puts on tefillin several times in a day, he must recite the blessing over them each time. If they slipped from their place and he handles them to restore them to their place, he must recite the blessing again. The Rema adds: And if he is restoring only one of them, he blesses as one who dons a single tefillin, as explained below in sec. 26. [His own words.] If he moved them from their place intending to restore them immediately, he must recite the blessing. The Rema adds: But some say not to bless [Tur, sec. 8], and so is the practice, as was already explained above in sec. 8, se'if 14. One who is donning the hand-tefillin and recited the blessing, and at the start of tightening it the knot of the hand-tefillin snapped, and he had to make another knot — provided he did not divert his attention — he need not repeat the blessing. If the hand-tefillin came undone before he donned the head-tefillin, he refastens it and need not repeat the blessing; but if he had already donned the head-tefillin and afterward the hand-tefillin came undone, he refastens it and recites the blessing anew. It is permitted to recite the blessing over borrowed tefillin, but not over stolen ones.

ס״ק מגבכל פעם

(מג) בכל פעם - אפילו אם כשסילקן היה דעתו להחזירם תיכף ואפילו אם לא שינה מקומו כלל בינתים. והרמ"א בסמוך פליג ע"ז. ואם בשעת ברכה היה דעתו שאח"כ יסלקם ויחזור ויניחם מוכח מדברי המג"א לעיל בסימן ח' סקט"ז דלכו"ע אין צריך לחזור ולברך:

(43) 'Each time' — even if, when he removed them, he intended to restore them immediately, and even if he did not change his location at all in the meantime. And the Rema, just below, disagrees with this. But if at the time of the blessing he intended that he would afterward remove them and then re-don them, it is evident from the words of the Magen Avraham above in sec. 8, note 16, that according to all opinions he need not repeat the blessing.

ס״ק מדנשמטו

(מד) נשמטו - כתב של"ה הא דלא נהיגי האידנא לברך כשנשמטו ממקומם משום דבשעת תפלה מסתמא אינו מסיח דעתו מהם והוי כחולצן ע"מ להחזירן דפסק ההג"ה בסמוך דאין לחזור ולברך. וא"כ אותן שהולכין לפעמים עד חצות בתפילין אם נשמטו ראוי לברך. והח"א כתב דאף בשעת התפלה אם נשמטו המברך לא הפסיד. ומ"מ נראה דלמעט בברכות עדיף:

(44) 'They slipped' — the Shela"h wrote that the reason we are not accustomed nowadays to bless when they slip from their place is that during prayer one presumably does not divert his attention from them, so it is like removing them intending to restore them, concerning which the gloss just below ruled that one does not repeat the blessing. If so, those who sometimes go about in tefillin until midday — if theirs slip, it is proper to bless. And the Chayei Adam wrote that even during prayer, if they slip, one who does bless has not lost anything. Nevertheless it appears that minimizing blessings is preferable.

ס״ק מהממקומן

(מה) ממקומן - דוקא כולן או רובן אבל מקצתן אף דצריך להחזירן על מקומן אין צריך לחזור ולברך [ט"ז בסימן ח' סט"ו ועי"ש בפמ"ג]:

(45) 'From their place' — specifically if all of them, or most of them, slipped; but if only a part of them slipped, although he must restore them to their place, he need not repeat the blessing [Taz in sec. 8, se'if 15; and see there in the Pri Megadim].

(46) 'He must bless' — for since he moved them from their place, it is as though he removed them entirely.

(47) 'Not to bless' — since he moved them intending to put them back; which is not the case when they slip on their own, where we say that the moment they slip the mitzvah has departed, and this is why the Rema did not object to the Mechaber there. And know further that likewise, if he removed them entirely intending to restore them immediately, the view of 'some say' also disagrees and holds he need not bless, and even if he changed his location in the meantime; and the later authorities ruled so. But if he did not intend to restore them immediately, only after a while, even if he in fact donned them soon afterward, or if he had intended to restore them immediately but the matter was then delayed and he diverted his attention in the meantime, according to all opinions he must repeat the blessing. And likewise, if he removed them to enter the privy, even if he intended to don them again immediately, he must bless according to all opinions, since he may not go into the privy with them, so the mitzvah was set aside, as written in sec. 65. And the Chayei Adam wrote that likewise when he removes them because he needs to break wind — since it is forbidden to break wind while wearing them — he must repeat the blessing.
