On "that were made [by a non-Jew]": This means that the non-Jew attached them to the garment. They are invalid even where a Jew stands over him and instructs him to do it for the sake of the mitzvah (lishmah). On "to require men": Even a man standing over the woman while she works does not help to validate it. This is because the phrasing "the children of Israel... and they shall make" is understood to also exclude the daughters of Israel from the making.

On "and it is good to do so, etc.": Similarly, it is fitting and proper not to have the attaching of tzitzis onto an adult's garment done, at the outset, by a minor who is under thirteen years old. But if he is thirteen years and one day old, then even though he has not yet shown the two hairs (the physical signs of maturity), there is no need to be stringent, even a priori. And the ארה"ח is lenient to allow it even a priori through a minor. All of this leniency is only where an adult stands over the minor and instructs him to do it for the sake of the mitzvah (lishmah). But without this (i.e., where no adult directed him), even if the minor already attached them to the garment, one must untie them and re-attach them.

הטיל ישראל ציציות בבגד ובלא כוונה אם אין ציציות אחרים (מצוים) להכשירו יש לסמוך זעל הרמב"ם שמכשיר אבל חלא יברך עליו:

A Jew attached the tzitzis-strings to the garment without intent (i.e., without intending them for the sake of the mitzvah). If no other tzitzis are available with which to make the garment valid, one may rely on the Rambam, who rules such tzitzis valid. However, he should not recite a blessing over it (since not all authorities validate it).

On "without intent": This means that he made the top knot — which is required by Torah law — without intent. But if he tied the top knot and one coil with proper intent, then even though he afterward made the remaining knots and coils not for the sake of the mitzvah, it may be validated even in a case where other tzitzis are available.

On "upon the Rambam who validates": He validates even where the attaching, and also all the knots and coils, were done without intent. For the Rambam holds that although the spinning must be done for the sake of the mitzvah, nonetheless the attaching does not require being done for the sake of the mitzvah. He derives this from the verse "the children of Israel," which comes to exclude a non-Jew; this implies that a Jew's attaching, even without intent, is valid. And should you ask: let him untie them from the garment and re-attach them with intent, for the sake of the mitzvah — one can answer that the case is where it is close to Shabbos and there is not enough time to untie them and re-tie them. Alternatively, the case is where one of the ends has snapped, such that if he were to untie them it would then be forbidden to re-attach them to the garment, as was written in siman 12.

(ח) לא יברך עליו - אפילו אם לא עשה רק התחיבה בכנף שלא לשמה וכ"ש אם עשה הקשר עליון שלא לשמה דרש"י והרא"ש והתו' ס"ל דבעינן מדאורייתא ג"כ תליה לשמה וקרא דמיעט עו"ג צריך אפילו ישראל עומד ע"ג ומלמדהו לשמה ע"כ צריך ליזהר לכתחלה קודם התליה בבגד שיוציא בשפתיו בפירוש שתולה כל אלו הציצית לשם ציצית וכמו שכתבנו לעיל בסימן י"א לענין טוייה ושזירה ועיין בביאור הלכה:

On "he should not bless over it": This holds even if the only thing done not for the sake of the mitzvah was the insertion of the threads into the corner, and all the more so if he made the top knot not for the sake of the mitzvah. For Rashi, the Rosh, and Tosafos hold that by Torah law the attaching, too, must be done for the sake of the mitzvah. And the verse that excludes a non-Jew is needed even for a case where a Jew stands over him and instructs him to do it for the sake of the mitzvah (i.e., a non-Jew's work is invalid even then). Therefore one must be careful, at the outset, before attaching them to the garment, to state explicitly with his lips that he is attaching all of these threads for the sake of the mitzvah of tzitzis. This parallels what we wrote earlier in siman 11 regarding the spinning and the twisting; and see the Biur Halacha.

סעיף ג׳

השואל מחבירו טלית שאינה מצוייצת טפטור מלהטיל בה ציצית כל ל' יום דכתיב כסותך ולא של אחרים אבל אחר שלשים יום חייב ימדרבנן מפני שנראית כשלו: הגה ואם החזירו תוך שלשים יום וחזר ולקחו אינו מצטרף רק בעינן ל' יום רצופים (נמוקי יוסף הלכות ציצית): שאלה כשהיא מצוייצת מיאברך עליה מיביד:

One who borrows from his fellow a tallis that has no tzitzis on it is exempt from attaching tzitzis to it for the entire first thirty days. For the verse says "your garment" — and not one belonging to others. But after thirty days he is obligated by rabbinic decree, because by then it appears to be his own. The Rema adds: If he returned it within the thirty days and then borrowed it again, the two periods do not combine. Rather, we require thirty consecutive days for the obligation to take effect. If he borrowed it when it already had tzitzis on it, he recites the blessing over it immediately.

ס״ק טפטור

(ט) פטור - והמטיל בה ציצית ומברך לא הפסיד כמו נשים שיכולות לברך על מ"ע שהזמ"ג אף שפטורות וממילא יכול לצאת בו בשבת לר"ה דנוי הוא לבגד:

On "exempt": Yet one who does attach tzitzis to it and recites the blessing has lost nothing (i.e., has done nothing improper). This is comparable to women, who may recite the blessing over a positive time-bound commandment even though they are exempt from it. Consequently he may go out wearing it into a public domain on Shabbos, since the tzitzis serve as an adornment for the garment.

ס״ק ימדרבנן

(י) מדרבנן - ויברך עליה ושוכר דינו כשואל (ע"ת שמוכיח כן מתוס' מנחות מ"ד ע"א ד"ה טלית וכו') ובעיטור מצאתי שכתב ושכירות מספקא לן:

On "by rabbinic decree": And he does recite the blessing over it. One who rents a garment has the same law as one who borrows it (the ע"ת proves this from Tosafos in Menachos 44a, the passage beginning "tallis," etc.). But in the Ittur I found that he wrote: regarding renting, the matter is in doubt for us.

ס״ק יאמברך עליה

On "he recites the blessing over it": Some are stringent and hold that he should not bless unless the lender explicitly gave it to him as a gift on condition that he return it. However, most of the later authorities agree with the ruling of the Shulchan Aruch (that he blesses even so). The reasoning is that the lender lent it to him precisely so that he could bless over it; and since he cannot bless unless it is considered his, it is as though the lender gave it to him as a gift on condition to return it. A priori it is certainly better to ask the lender to give it to him as a gift on condition to return it, though this is not indispensable. And this rule applies specifically where he borrowed from him a tallis that is designated for the mitzvah. But if it is a garment meant for ordinary wear, and tzitzis are placed on it only because most of it is open, and it was not made for the sake of the mitzvah of tzitzis; and likewise if he borrowed a tallis to be called up to the Torah, or to lead the prayers, or to go up to the platform (for the priestly blessing), which is only for the sake of honor — in these cases he does not bless over it, since perhaps the lender's intent was to lend it merely as a garment to wear, and not to transfer ownership to him. But there are those who disagree on this and hold that in all such cases one does bless. Therefore the Derech HaChaim wrote that in all these cases it is better that he intend not to acquire it, so that, according to all opinions, he will not be required to bless — except for a tallis that he borrowed at the time of prayer in order to fulfill the mitzvah with it. All of this concerns the taleisim of a private individual. But regarding the taleisim of the community, like ours that are found in the synagogues, one must bless over it according to all opinions, even when he wears it only to lead the prayers or to be called up to the Torah. This is because a communal tallis was acquired from the start with this intent: that whoever wears it should have it be considered his own — just as is the case with a communal esrog. And see what is written in the Biur Halacha in the name of the Shaarei Efraim.

ס״ק יבמיד

(יב) מיד - עיין סימן תרנ"ח ס"ה לענין לולב ובפמ"ג שם ומזה נלמוד לענינינו ג"כ דצריך להחזירו להנותן בזמנו היינו אם היום יצא בו בעליו ישיב לו עכ"פ למחר קודם התפלה כדי שיהיה לו בעצמו ג"כ במה לצאת ואם לא החזיר לו והנותן אין לו טלית אחר נראה דנעקר המתנה למפרע ולא קרינא ביה כסותך [ואף שיש לו ט"ק מ"מ מסתברא דאדעתא דהכי לא נתן לו] דלא כמו שכ' בס' נ"ח. גם נתבאר שם דאחר שיצא בו צריך לחזור ולתנו לבעליו במתנה כדי שיהיה של בעלים שהרי נעשה שלו ופשוט דה"נ בענינינו. נ"ל פשוט דאם נתקלקל הטלית או אחת מציציותיה אצל השואל אף שהיה ע"י אונס ולא החזיר לו כמו שלקחה אינו יוצא בהמצוה עיין בסימן תרנ"ח סעיף ד' ובחדושי רע"א שם:

On "immediately": See siman 658, se'if 5, concerning the lulav, and the פמ"ג there; and from that we can learn for our matter as well. Namely, that he must return it to the giver in its proper time: that is, if the owner needs to fulfill the mitzvah with it today, he should return it to him at least by tomorrow before prayers, so that the owner himself will also have something with which to fulfill the mitzvah. And if he did not return it and the giver has no other tallis, it appears that the gift is retroactively nullified, and it is not considered "your garment" (so the borrower did not fulfill the mitzvah). [And even though the giver has a small tallis (tallis katan), nonetheless it stands to reason that he did not give it to him on such a condition, that he be left without his large tallis.] This is unlike what is written in the sefer נ"ח. It was also explained there that after one has fulfilled the mitzvah with it, he must give it back to the owner as a gift, so that it becomes the owner's again — since it had become the borrower's; and it is obvious that the same applies in our case. It appears obvious to me that if the tallis, or one of its tzitzis, became damaged while in the borrower's possession — even if it happened through circumstances beyond his control — and he did not return it as he had taken it, he does not fulfill the mitzvah; see siman 658, se'if 4, and the novellae of Rabbi Akiva Eiger there.

מותר ליטול יגטלית חבירו ידולברך עליה ובלבד טושיקפל אותה אם מצאה מקופלת: הגה וה"ה בתפילין (נ"י פרק הספינה) אבל אסור ללמוד מספרים של חבירו בטזלא דעתו דחיישינן שמא יקרע אותם בלמודו נ"י הלכות קטנות:

On "his fellow's tallis": This means without the owner's knowledge, for a person is content to have a mitzvah performed with his property. This is only on an occasional basis, but on a regular, fixed basis it is forbidden. And even on an occasional basis, it is only permitted in the same place; but to take it out of his house to the synagogue, or the reverse, is forbidden, for perhaps he is particular about this, and it would be theft. And see the פמ"ג, who wrote that in all cases it is proper to be careful, when the owner is present, to ask his permission. One should not rely on the presumption (that he does not mind) in a case where one can easily clarify the matter with him — and all the more so if he knows the owner to be particular about it.

ס״ק ידולברך עליה

(יד) ולברך עליה - עיין במ"א ועיין בדרך החיים שכתב דיותר טוב שיכוין שלא לקנות ולא יברך:

On "and to bless over it": See the מ"א. And see the Derech HaChaim, who wrote that it is better that he intend not to acquire it, and then not bless.

ס״ק טושיקפל אותה

(טו) שיקפל אותה - כקיפולה הראשון ובשבת יקפל אותה ולא כקיפולה הראשון והמ"א מיקל בשבת שלא לקפל כלל:

On "that he refold it": He should fold it along its original folds. But on Shabbos he should fold it, yet not along its original folds. And the מ"א is lenient on Shabbos, holding that one need not fold it at all.
