It is forbidden to sit within four cubits of a person who is standing in prayer (the Shemoneh Esrei), whether in front of him, or at his sides, (or behind him) (this is derived from Tosafot, the Mordechai, and the Rosh in the chapter 'Ein Omdin'), and one must move four cubits away. But if he is occupied with matters that are part of the fixed order of the prayers (liturgical passages), and even with the chapter 'Eizehu Mekoman' (the Mishnah about the sacrifices recited in the morning), he need not move away. And some permit it when he is engaged in Torah study, even though this is not part of the fixed order of the prayers. And there is one who says that all this applies only when he sits at the side, but directly opposite him it is forbidden even as far as the eye can see, and even if he is occupied with the recitation of the Shema.
(1) 'It is forbidden to sit' — and even leaning (against something for support) is forbidden; but a partial leaning — where, if the support were removed, he could still stand on his own — may be treated leniently in a pressing situation.
(2) 'Within four cubits' — even when he sits diagonally (at an angle to the one praying), four cubits suffices, and we do not require the four cubits to be measured along the diagonal (which would be longer); so writes the Magen Avraham. And see the Pri Megadim. The ח"א writes: if the one praying stands on one side of an object that is fixed in place, ten (handbreadths) high and four (handbreadths) wide, it is permitted to sit on the other side, since the object divides them into separate domains. But as for passing on the other side, it may be that if it is not tall enough to prevent him from seeing over to the other side, passing is forbidden. And so ruled the הלק"ט, and the Pri Megadim likewise inclines, in siman 90, sub-paragraph 5, that one should be stringent about passing at the almemar (the raised reading platform) opposite the one praying, even though it is a domain unto itself; though for sitting he permits it in a separate domain, even within four cubits. [all this is in this siman, sub-paragraph 2, in the משב"ז].
(3) 'Of one who is praying' — even if the one praying is standing in the supplications recited after the Amidah, as long as he has not yet stepped back (the steps that conclude the prayer); and likewise with regard to not passing in front of the one praying.
(4) 'And whether behind him' — so too the later authorities (the Acharonim) agreed.
(5) 'With the chapter Eizehu Mekoman' — and likewise if he is occupied with (studying) the chapters of Pirkei Avot at Mincha on Shabbat, it is also permitted to sit beside the one praying.
(6) 'And some permit, etc.' — for they hold that the Sages forbade sitting beside one who is praying only when he sits silent and idle, since he then appears as though he does not wish to accept upon himself the yoke of Heaven (ol malchut shamayim); but when he sits and is engaged in Torah, he is like one who is accepting upon himself the yoke of Heaven. And see the Acharonim, that it is good to be stringent and to stand, in accordance with the first opinion, except in a pressing situation; and regarding one who is behind him, it appears to me that one need not be stringent about this.
(7) 'When occupied with Torah' — specifically if he articulates the words of Torah with his lips, but merely contemplating them in his heart does not help; and this is so even in matters of the fixed order of the prayers, for people will come to suspect him of not accepting upon himself the yoke of Heaven.
(8) 'But directly opposite him, etc.' — because he appears as though he is bowing down to him (the one praying). And according to this reasoning, only sitting is forbidden, but standing is permitted, even within four cubits. And perhaps he holds that even standing is forbidden, since through this the concentration of the one praying is disrupted.
(9) 'Even if he is occupied, etc.' — that is, the one sitting opposite the person praying is occupied with reciting the Shema. And see the פר"ח, who ruled like the first opinion, that there is no distinction between in front of him and at his sides; while the other Acharonim wrote that it is good to be stringent like the opinion of 'there is one who says.' And it appears to me that when standing outside four cubits one certainly need not be stringent, and perhaps even within four cubits, as explained above in sub-paragraph 8.
And there is one who says that if the one sitting at the side of the person praying is weak (frail), it is permitted for him to sit there.
(10) 'Weak' — that is to say, it is known that he is frail and cannot stand, and therefore it is permitted for him to sit, for his weakness makes it evident that it is on account of it that he is sitting. And this is specifically to sit at the side of the one praying; but directly in front of him, some are stringent even in the case of a frail person.
(11) 'It is permitted' — and one may rely on his words if it is not easy for him to move four cubits away and sit there.
If the one who is sitting was already seated, and this other person then came and stood beside him to pray, he (the one already seated) need not rise, for it was this one (who came to pray) who entered the other's domain. (Nevertheless, it is a measure of piety to rise even in such a case) (this is from the Beit Yosef in the name of Mahari"a).
(12) 'To rise' — rather, it is the one who wishes to pray who must move four cubits away from him (the one already seated), when he wishes to stand and pray.
(13) 'Entered his domain' — and this is specifically in his own home, but at a fixed minyan, and all the more so in a synagogue, he must rise, since it is a place designated equally for all people. And even if the seats are fixed for each individual, having been purchased with money, one should nonetheless be stringent. However, one who is engaged in Torah study need not be stringent in this, and all the more so a teacher (rav) who sits with students while they are learning, and ten men came to pray — he need not rise, and there is not even any measure of piety (that would require it).
(14) 'A measure of piety' — in order to remove a stumbling-block from his fellow, who acted improperly in that he stood to pray within four cubits of the one who was already sitting there permissibly, for his (continued) sitting is a disgrace to the holy setting of the prayer.
It is forbidden to pass in front of those who are praying within four cubits, and this is specifically directly in front of them, but at their sides it is permitted to pass and to stand.
(15) 'It is forbidden to pass' — because through this he disrupts the concentration of the one praying, and therefore it is forbidden even if he (the one passing) is then occupied with reciting the Shema. And the ח"א gave the reason that it is because he interposes between the one praying and the Divine Presence (the Shechinah).
(16) 'In front of them' — and as for the sides that are toward the front, according to the Magen Avraham in sub-paragraph 6 they are considered like the front (and forbidden), but according to the Eliyah Rabbah it is permitted.
(17) 'But at their sides' — yet the Zohar, in the portion of Chayei Sarah, forbids it even at their sides, within four cubits.
(18) 'To pass and to stand' — that is to say, that he passes and stands there and does not continue walking further, so that he will not be directly in front of their faces; for whatever is within the range he can see — even if it is the sides that are toward his front — is considered like the front, and it is forbidden, because through this he disrupts his concentration. And according to this, all the more so is it forbidden to walk up and stand directly in front of him within four cubits. So it is according to the view of the Magen Avraham. But the Eliyah Rabbah holds that they forbade only passing within four cubits in front of his face, whereas to walk within four cubits and then stand is permitted even in front of him, and it is possible that one may be lenient in a pressing situation.
If one has finished his own prayer (Shemoneh Esrei), and there is another person praying behind him, he is forbidden to take the three steps back, until the one behind him finishes his prayer; for if he does this (stepping back into the other's four cubits), he is like one who passes in front of a person who is praying. And one must be scrupulous about this even if the latter one began to pray after him, since he (the one behind) has already begun.
(19) 'Praying behind him' — and if he is not directly behind him but rather set off to the sides, it appears that it is permitted according to the Eliyah Rabbah mentioned above.
(20) 'Three steps' — and this speaks of a case within four cubits, or where he would come within four cubits by means of the three steps that he takes backward.
(21) 'Since he has already begun' — and so he (the one behind) is not called one who entered the other's domain, and this holds even if the latter one prolongs his prayer, for on the contrary, the one who wishes to step back is the one now entering the other's domain.
